There's a small steps. >> Okay. >> One. Two. Three. >> Yep. >> One. Two. Three. Let me know. >> All right, everybody. Welcome back. We got another video for you. This one comes from Midwest Crime Watch. And man, I've been seeing this one. And look, I'm a fan of this guy as an announcer. And so, I'm going to do the best I can to be respectful. But it is the Tony Romo T DUI arrest body cam video released. I have not seen this. Let's go. >> Hi there. >> You got a nice big Jeep. Okay. This would throw you off unless you looked at the plate. But a lot of times when I would pull a traffic stop, you you call out the plate. You don't get the return on the plate until you're already at the door the window of the car unless you type it in before before you pull them over. So, in this particular case, if you pull them over, you call it out. The dispatcher is going to come back to you while you're standing there on the traffic stop. So, imagine walking up and seeing Tony [laughter] Romo. >> Deputy Foreman, Milwaukee County Sheriff's Office. >> Were you speaking on the speaker right there? >> I was. >> I didn't even know you guys had that. So, sorry. >> All right. Reason for my stop today, yep. >> That was what you said? >> Yep. Reason for my stop today is the unsafe passing on the right, the lane deviation. >> loud and clear. I'm sorry. >> Unsafe passing on the right, cutting across the gore. Obviously, the gore. >> Yes. >> The marked area. >> Got you. >> Where are you coming from? >> Well, I live in Dallas, so I came in to visit my grandma and grandpa. So, we're here. I'm going to leave that, but I got the >> You got the what? >> The gore, you said? >> Yep. >> That's what it is for you for us to say? >> Yep. >> Yes. I got what you're saying. >> And you were coming from grandma and grandpa? What did you say? It's really hard to hear you, dude. >> I I can't hear you, either. >> Yeah, I know. We got to basically yell at each other, right? >> at you. >> Okay. All right. Where are you coming from? >> The golf course, and I'm going to meet grandma and grandpa. >> Okay. >> Okay. >> All right. I'll take a driver's license from you. >> You got it. >> He's being super cool. >> So, I want to meet grandma and grandpa, and I passed the Gore, which is the place you're talking about that I drove over. I got it. You're saying I went over the white line. >> What's a good phone number for you? >> Mm, smooth. Got his number. Nice work, deputy or officer. I know that's not what she was doing, but she got it. >> Okay. All right. Hang tight for me. >> By the way, I'm not a Cowboys fan. Don't I've been to the Cowboys training facility. Phenomenal. It's the Seriously, probably the best training facility. Uh saw Dak Prescott in the locker room. One of the perks of being a sheriff. Uh I love Tony Romo as an announcer. I think he's a phenomenal announcer. Uh I love watching the games that he's announcing. He does a great job. Okay, coming back to the car. >> All right. How many drinks have you had? You're coming from a golf course? >> I played in a golf tournament in Wisconsin today after I >> Okay. >> So, it's like a USGA >> Okay. All right. I'm going to run you through some fields. >> Is that it? >> Fields sobriety test. Are you willing to take any field sobriety tests? >> Uh no. >> I'm sorry? >> I'm not going to do it. I don't want to do it. I'm not going to do it. >> Yes, you're denying to step out of the vehicle pending field. Okay, step out of the vehicle. No, step out of the vehicle. Step out of the vehicle. Field sobriety test. You're not. No, step out of the vehicle. >> She's right. We're on a traffic stop. Right now, he's impeding the the investigation. He can call his lawyer if he gets arrested, but right now we're actually she's conducting an investigation and she needs to be able to do that. She has made a lawful request multiple times for him to step out of the vehicle. >> I'll take an additional 10-17. >> So, she's calling for another unit. >> vehicle for field He's recording, look. He's recording her now. >> I want you to step out of the vehicle. >> I mean Look, I'm no Tony Romo. Um it's when you People know you, they see you in places, you got to be on your best professional behavior and and kudos to him. He's not in a great situation right now. He knows he's going to be filmed, body cam. I mean, already starting to process this. He's being respectful. Um I even his request to call his attorney was not done in a disrespectful manner. Uh I He knows probably I assume he knows he had some drinks. And so now it's, you know, you're starting to get a little pucker factor. I probably shouldn't stop it as much cuz it'll take us forever to get through this video. So I might I might talk over a little more than I normally do. So he's setting up his recorder. This is a Terry Pat. Okay, so what she's doing is she's saying this is not an even ground. It's not the best place to do field sobriety tests. She doesn't have a lot of distance in between there. Wisely, she wants to move him to another place. So he'll probably have somebody come in, stand by with the vehicle. She'll move to a different location that is better suited for field sobriety tests. I totally good with what she's doing here. And he's being cool about it, too. >> Yeah. >> 20, that's a negative. >> Roger that. Do you have your operator's license, do you have them? >> I'll grab your phone for you, okay? >> All right, I've already at the jail. Do you need anything else? >> All right. So >> What about the keys in the vehicle? >> Okay, hang on. >> Nope, I've got them. >> Uh 5501 is at the jail and 2501 is still at the jail. >> the keys, your phone, I will grab as well, okay? You're detained pending a DWI investigation. I've patted you down for any weapons. I would normally seat you on the passenger side. Due to it being so close to the concrete barrier, we're going to go in the traffic very carefully in the distress. Yeah. Because you're not able to fit, sir. There's no So, we're going to walk in the distress. We're going to go in the distress. >> Can you grab the phone first? >> I will, sir. I only have two hands. >> I'm on the phone with Howard. There's two more of a car that fit on that vehicle. >> So, she looks like a traffic enforcement. >> Have a seat. >> A big dude. >> You want to go all the way? >> What's that? >> You want to go all the way? >> Um I'm in. Yes, uncomfortably, but yes. Um >> I know you're a taller fellow. >> Yeah, it's a little bit Yeah. >> You just Honestly, you feel for some of these people sometimes. You know, even though he played for the Cowboys, you still feel for him. >> All right, so do you want to swing your feet up outside so you have a little more room? >> Yeah, I guess. Can you take the handcuffs off for a second, please? Just for the back. >> I should have come out. >> Just for my back. >> All right, sir. Is that possible? >> What? Sir, I'm going to have you step out completely. >> I'm trying. I'm sorry. Just the bad back. >> Oh, I can assure you, especially if you played sports all that time, and then on top of that, you just got through playing golf, I'm sure his back is probably tightening up. >> Yep. Are you going to take your hand out? You're welcome. >> He's doing [laughter] some stretching. >> Based on your driving Where are you coming from? Is that the golf course? >> Well, let me tell you right now, these other dudes showed up and they're like, "Tony Romo? Shoot, I'll be there right there. I'll be right there." Uh, they're playing it cool, but you know, I these two are both probably around the same age. They're They're at the age where they would have watched Tony Romo playing. >> Correct. Okay. The uh red glassy eyes. And then the odor of an intoxicated alcoholic beverage from your breath. >> All of that stuff. >> Okay. Um and then when my partner brought the backpack that you wanted >> Oh, Sheriff. >> Basically do not an inventory, but I make sure that there's no gun. Exactly. And there were a few shooters in there that I observed. >> Yeah. Any of you were drinking? >> Okay. So >> None of you were drinking, right? >> Okay. So, based off of that, I'm going to run you through some field >> Yeah. >> SFSTs. >> Let's do it. I'm good. >> Okay. All right. So, flat surface, free to breathe. All my lights and everything are off. You're just going to stand in the front here for me. >> Yes, yes. >> No. Go. Go ahead, dude. >> [laughter] >> I've honestly never I don't know that I've ever seen anybody stretch on a DUI before. This is a professional right here. He knows he's going to have to getting in the game. He's going to stretch out. Let's go. >> All right. Just stand in the middle for me, sir. Yep. And you're just going to turn around. You're going to have stand facing me. Feet together. >> Yep. Just slight half step for- forward up. Push back. Perfect. Thank you. >> Feet together. >> Sorry. >> It's okay. Feet together, arms down at your side. >> Okay. >> Okay? Uh any head injuries? >> Excuse me? >> Any head injuries recently? Any concussions? >> He's laughing cuz I'm laughing. Of course he's had head injuries, concussions, but I think she's referring to recent. I think you typically, you know, within the last 6 months or whatever. >> Years, yes, but not recently. >> Okay. So, please stand with your feet together and your hands down at the side. Do not do any >> All right, before we get started on this, I got this I don't know if you guys have seen. I've been talking about giving away one of these watches, a Wason 250th Anniversary watch. Beautiful watch, field watch. Just got this box and uh I'm giving this one away. Boom, there it is. All you got to do to get it is like this channel and subscribe, which you already probably already have. And by the way, it comes with a blue band and a red, white, and blue band. So, all you got to do to win this watch is like this channel and subscribe, please, to our ranch channel Lam Ranch Official and my wife has a new child children's channel, Little Lambs Official. All you got to do, subscribe to those channels and one of you is going to win this. I'm probably going to give this away probably within a few days after this video if you're watching it. So, and thank you, Paul from Owosso. He sent me a note saying, "Thank you so much for your order and for your patience. Enjoy the watch and extra strap." Thank you. I did notice you got an extra strap. I got I didn't get that one. But, you guys will. All right, I'm not going to delay this anymore, but please, if you want to win this watch it's a $500 watch. I'm giving it away to one of my supporters, one of my followers. All you got to do is just go to those other channels. So, let's get back to the video. >> Please stand with your feet together and your hands down at your side. Do not do anything until I tell you. Do you understand? >> Do you want the shoes off? >> What do you prefer? >> Whatever you want. >> Okay. I'm going to check your eyes. Please keep your head still during the test. >> Okay. >> Look at the stimulus and follow the movement of the stimulus with your eyes only. >> All right. >> Keep looking at the stimulus until the test is over. Do you understand? Stimulus, top of my pen, right over here, okay? >> Yep. >> Do you understand? >> I I got you. >> Okay. Can you maintain the position? >> Yeah. Let's go. >> I'm going to make a couple of passes, okay? Top of my pen. >> So, what am I doing? Just tell me. Am I looking at it or >> You're going to look at the top of my pen movements, okay? Yes. Make a couple of passes, okay? >> Okay, so I'm following this as you move. >> [laughter] >> That's what you're saying. >> Yes, sir. >> Okay, got it. >> No head movement. Don't move your head. >> Am I supposed to move my head or am I supposed to keep it still? >> Would you like the instructions one more time, sir? It's okay. >> So, what she's doing is tracking right now, which she's not doing well at because he keeps turning his head. So, what you're looking for is your eyes. The eyes are like windshield wipers sometimes if they don't track well. So, now she's testing at a at a clear out here to this angle, all the way out to the shoulder. She'll go to both sides, back to the middle, then she's going to go 45. Oh, no, she's doing it twice. Horizontal gaze is nystagmus. Now she's coming all the way back out slower. She's going to hold it there for a second. And you'll see the eyes will bounce if it's Now she's going to come off to the 45°, which is just right here. Before she's way out here, now she's coming off the shoulder here and here. And you're watching the same thing. And then she'll go up and down. >> Little closer than I usually did it. I didn't do it as close. Not supposed to move your head. Just watching. You're also paying attention if they're swaying front to back, back side to side. They're able to hold their balance. >> Just going to Keep your head straight for me. We're going to do that, okay? >> All right. Okay. >> Little longer than I She's She's doing a very thorough HGN test. >> Follow the top of my pen. >> Yeah. >> Up and down now. So, each one of those passes you do twice. >> Eyes and eyes only, please, okay? >> Okay. >> You can come this way. >> Like I saw one part, only one tiny little part of this video where he was he was moving around like Dak Prescott when he does his warm-ups. And I'm like, "Hold on, I got to watch this video." >> Just walk. The next step is the walking >> Okay. >> The next step is going to be the walking turn instructions, okay? >> Yep. >> Place your left foot on the line, real or imaginary, so you're going to picture a straight line in front of you. >> Okay. >> You You can remind me to also >> I'll start over? Walking turn instructions, you're going to picture a straight line in front of you. >> Okay. >> Place your left foot on the line, real or imaginary. So, take your left foot, put it on that line, place your right foot on the line. >> He's supposed to be doing it. >> With the heel of your right foot against the toe of the left foot. >> Exactly. >> Exactly how I'm doing it? >> Good. >> Place your arms down at the side. >> What am I doing with my arms? >> Maintain this position until I complete the instructions. >> Okay. What are the instructions after that? >> So, maintain that position for me. Would you like me to start over? >> What are the instructions after What am I doing after >> Okay, I'll start. So, picture a straight line in front. >> He's like, "So, what am I doing?" She just got through explaining all of it, and he's like, "What am I doing?" >> Take your left foot, put it on that line. >> All right, then. >> Take your right foot, >> Okay. >> put it in front, >> Okay. >> heel-to-toe touching, place your arms down at the side. Maintain this position until I've completed the instructions. You can >> The instructions [clears throat] after that are to turn >> Do not start to walk until I until you're told to do so. >> Okay. >> Do you understand the instructions so far? >> So, I put my left foot down and I'm doing it wrong and I'm on the line and I'm bringing my All right. All right. I think I'll use I'm not going to step down. I'll walk down the Ready? >> When I tell you to start, take nine heel-to-toe steps on the line, turn, and take nine heel-to-toe steps down the line. I'm going to demonstrate by doing three steps. Okay? When you turn, keep your front foot on the line and turn by taking a series of small steps with the other foot. >> She's reading it verbatim. I don't know if this is her style. Some people Some deputies and officers will do it just verbatim. When you do a lot of DUIs, you get really used to doing them and then you have your way like you know it. You got it down. Um and that way you can maintain eye contact and keep watching them as you're giving them the instructions, which is why I tried to memorize everything so that I could just as I'm talking to them, I don't break eye contact. I can watch whether they're swaying, whether they're listening to my instructions, whether they start too soon, all of the things that we pay attention to. Doesn't say I'm not saying she's doing it wrong. Just saying some people folks do it more thorough. They read everything. Um but I was more fluid with it. >> I will demonstrate it for you, okay? While you are walking, keep your arms at your sides, watch your feet at all times, and count your steps out loud. Once you start walking, do not stop until you have completed the test. Do you understand the instructions? Okay. All right. So, take your left foot, put it on the line, the straight line, real or imaginary. Take your right foot, >> So, this is one of those ones sometimes you just go, "Hey, let's just use this line right here." You got two lines right there. Just use one of the lines. We would use imaginary just because we didn't have a line a lot of times. I would just say, "Hey, use the line, stand on the line, give me the instructions, and then show them, give them a little sample of what it looks like what she's she's about to do." >> Left foot on the line, right foot in front, heel to toe touching. >> Sorry, I missed that. >> Yep. Heel to toe touching. >> Sorry, I missed >> Yep, just like this. Left foot on >> So, Dayton was just telling me the part that I thought was in this video of him doing the Dak Prescott, which by the way, I was like, "Dadgummit, he moves good still." Dayton just told me it's AI. Dadgummit. Now I feel like an idiot cuz I was just telling him that was the only part I saw of the video. That's not in here, folks. That's not real. It's AI. Sorry. But, in all fairness to me, I only saw just a smidge and that made me want to watch the video, so here we are. >> Arms down at your sides while you place the rest of your >> I was like, "He moves good." >> Yep. >> Yep. >> All right. Place Place your arms Place your arms down at the sides. Okay? Keep your arms down at the sides. Maintain this position until I have completed the instructions. Do not start to walk until I until you're told to do so. Do you understand the instructions so far? When I tell you to start, take nine heel to toe steps on the line. Turn and take nine heel to toe steps. I will demonstrate for you, okay? When you turn, keep the front lead foot on the line and turn by taking a series of small steps with the other foot. I'm going to demonstrate with three. You will do nine, okay? >> Uh, this doesn't look good, by the way. If you're ever doing FSTs, it's not going to look good if you're doing that. I get it. You want to stretch, playing it cool, uh, but it doesn't look good. Cuz part of the part of the FSTs is your ability to follow the instructions and stand there in that supposed that's part of it. Standing with your front foot in front of the one foot in front of the other on this line or imaginary line with your hands down at your side and don't start until she tells you to start. So that's all part of >> two three I'm sorry. Okay. You're going to use a series of small steps. >> Okay. >> one two three one two three let me know if you need another demonstration. Would you like me to Sure. Place your left foot on the line real or imaginary. Place your right foot on the line ahead of the left foot with the heel of your right foot against the toe of the left foot. I'm demonstrating for you. This is my left foot. I'm taking my right foot putting it in front of my left heel to toe touching, okay? So you're going to take nine heel to toe steps on that line. You're going to take nine heel to toe steps back along that same line keeping your front foot lead foot forward. I can start over with the instructions if you would like, sir. nine steps >> Nope. Nope. Nope. Not heel to toe. I'd have been like number nine steps like your jersey, bro. Turn it. He said Turn it. >> Can you feel the toe steps? >> Nope. Nope. Nope. Prognosis negative. That's for all the Seinfeld fans out there who know prognosis negative. >> No, the next technique is going to be the one leg stand. >> Okay. >> Okay? Please stand with your feet Please stand with your feet together. >> So, typically you'll say is there any you'll explain it to them and they say is there any injuries, anything that would keep you from being able to do this test? >> together and your arms down at the side. Demonstrating it for you. >> Yep. >> Do not start the test until I tell you to do so. Do you understand? >> Yep. >> Okay. Would you like me to read the first part over again for you? Please stand with your feet together, arms down at the side. >> I know he's getting frustrated. >> you to do so. Do you understand? When I tell you to start, raise either leg with the foot approximately 6 in off the ground keeping your foot parallel to the ground. Keep both legs straight and your arms down at the side. So, foot parallel to the ground, okay? >> No, still not right. >> All right. Keep both legs straight and your arms down at the side. Holding that position, count out loud in the following manner. 1,001 1,002 1,003 and so on until you are told to stop. Keep your arms at your sides at all time and keep watching the raised foot. I'm going to demonstrate for you. >> The instructions are so much more difficult if you don't know them. Like you the more you can memorize these instructions that the better it flows and the people tend to understand you a little bit better. And it you really kind of get a a pretty good barometer if they're if they're tracking you or not. Um it's but it's also designed to uh check to see if you can keep up and follow instructions and all that. >> Okay? >> Okay. >> And then you just tell me which foot you want to raise, okay? I think I'm going to raise my right, okay? Approximately 6 in 1,001 1,002 1,003 1,004 and so on until I tell you to stop. >> Yeah. >> Okay? And tell you to begin. >> Step away from the vehicle. >> Do you understand? >> Yes, sir. >> Okay. Which foot are you choosing to raise, sir? >> I'm trying to think about which one's stronger but all the actual relief I've done with all the back exercises but I would just probably go with the left I would say. Maybe the right. Not the right one. Definitely left. >> Okay. >> I don't know. Maybe left, right? I don't >> Okay. Ready to begin. >> He's an athlete so his balance is probably going to be pretty decent. So she's timing. She's going to she's going to do 30 second or he's supposed to estimate the passage of 30 seconds. I've had him go like >> I know that was at least 8 or 9 seconds. By the way I do this consistently every day. But the right >> Going to be stopping the test. >> I feel like >> Oh, sorry. Let me go to the right. >> Prognosis negative. >> I'm sorry. >> Just >> You uh >> You're under the influence. >> What is that? >> Machine that you blow in? >> It's a preliminary breathalyzer. >> It does not determine the results of >> Uh we're not doing that. >> Okay. >> I heard this from all the lawyers, don't ever do that. >> Okay. >> So >> All right. >> I'm not going to do that. >> All right, sir. >> Did I pass this test? >> You turn around. >> No, I didn't. >> [laughter] >> my phone real quick because there's a plane taking off right now. My parents are there. >> for >> Okay. >> operating under the influence, okay? >> Can you turn around? >> I'll read you a sheet and everything. >> Okay. I'm just Okay. Put your shoes on. >> DUI is not something I'm okay with. I mean, it's uh he should be grateful that they got him because if he would have gone down the road and maybe ran into somebody and killed them, that's it. He's done. You can get over this, a DUI, he can get past that. Taking somebody's life or seriously injuring somebody while under the influence, like we experienced in our family, can be life-changing on all on many levels for both parties. So, he should be grateful that this is the extent of what happened. >> Do I need to turn around? >> Yep. >> Okay. Thank you. >> So, Tony, if you're out there listening, >> We'll get to that. We'll get to that. >> You were you were a pro here today. >> Do you need two cuffs, sir, or are you okay with one? Okay. Yeah, so it gives you a little more armor? >> Well, the back, I'm saying that was uncomfortable on my arm. >> Okay. Would you like two? >> the second set of cuffs? >> what that means. >> A little bit easier on your shoulder. We'll give you two. >> I don't know what that means. >> Well, we'll tell you how to do it. two cuffs. >> We're just going to go a little bit easier on your shoulders. We saw you last Yeah, a little wider. A little easier on your shoulders, okay? >> Can I seriously call the parents real quick and just tell them >> We We We got some other stuff we got to get through first and then we'll >> He's not going to get I don't know how they do it in Milwaukee. We wouldn't book him in. We would not book this guy in. He's been totally cool. We would go process him, take his blood. And as soon as we're done, which will probably be up from this point on, maybe 30 minutes. We're pretty quick quick with DUI investigations. Have somebody come pick him up and he goes home for the night. And he could He can deal with this later. >> Sir, you got a child. I understand who you are. >> He's on a plane. >> I got you. I understand who you are. We're going to try to make >> Yeah. >> We're going to We're going to get We'll get you through this, okay? >> Anyone want to search the mail, please? >> Yeah. I'm going to search you one more time, okay? Anything else on you? >> Yep. >> Nothing else on you? Okay. Nothing that's going to poke me, harm me, stick me or anything like that? >> I think you're good. >> Okay. I just ask everybody that. >> All right. >> Hey. >> Mr. Almond, do you mind if I read you something? If I open If I open the door, you're not going to try to get out, are you? >> If you let me get out, I'd love to stretch, but >> Well, can't technically let you out. >> All right. >> She's probably going to read the admin per se, which basically says you have to submit to breath, blood or urine, whatever the off the deputy chooses. >> to read read you the informing me of your rights. >> Is it possible for me to stand up while you do this? Just get up. I didn't have a person. >> Okay. >> I'm sorry. I really have had two back surgeries. I'm not >> Okay. >> No, it's >> All right. So, how about this? I'll meet you halfway. I'll open the door, you can swing your legs out. that way you're a little more comfortable, okay? >> That's good. You are a taller individual, so I'm willing to work with you. Just stay seated just like that, please, okay? >> Thank you. >> Don't get up. Perfect. I don't want the door to hit you. All right. This is the informing the accused. Under Wisconsin's implied consent law, I'm required to read this notice to you. You've either been arrested for an offense that involves driving or operating a motor vehicle after using alcohol or drugs or both, or you are suspected of driving or being on duty time with respect >> If you refuse this, the blood, the urine, or the breath, we we started just doing pretty much all blood. Just get a search warrant, take the blood, and get them out quick as possible. Um if you refuse, we're still going to get it. We'll go get a warrant, and we'll hold you down and take your blood. But, then you lose your license for a year. If you you might only lose your license for like 90 days on a regular DUI. You will automatically in Arizona lose your license for 1 year if you refuse to do a breath blood or urine test. >> back to a commercial motor vehicle after using alcohol or drugs or both. This law enforcement agency now wants to test one or more samples of your breath, blood, or urine to determine the concentration of alcohol or drugs in your system. If any test shows more alcohol in your system than the law permits while driving or detectable amount >> Yeah. >> of a restricted controlled substance, your operating privilege will be suspended. If you refuse any requested test, your operating privilege will be revoked, and you will be subject to other penalties. The test results or the fact that you refuse testing can be used against you in court. If you take all the requested test, you may also choose to take the alternative test that this law enforcement agency provides free of charge. You may >> that? >> You may also >> What's the alternative? >> You may also have a test conducted by a qualified person of your choice at your expense. You, however, >> So, basically what she's saying is they can have a test on which means he can go straight directly from being released, which is why we release him because we don't have the the the results back that day. So, we typically release him unless they're just being totally, you know, just completely out of out of sorts. But, um you release him and then he can then go to the hospital or to a blood uh some type of clinic and he can have his blood pulled for his own, but it's at his expense is what she's saying. >> I'll do that. >> You'll have to make your own arrangements for that test. If you have a commercial driver's license or were operating a commercial motor vehicle, other consequences may result >> Yeah. >> from positive test results or from refusing testing such as being placed out of service or disqualified. >> Okay. >> Will you submit to an evidentiary chemical test of your breath? >> No. Like I said, I want my lawyer. >> Okay. >> For the eighth time. >> I would have a I I would have taken the time to really explain it to him and just said, "I get it." Um I can't give you any legal advice. Refusal is an automatic 1 year or revoke revocation. We're and we're going to get a search warrant. We're taking your blood one way or the other. So, you can do it willingly or you can do it this We would We would explain it to him cuz if you're intoxicated, you may not be comprehending exactly what's going on. He's going to give breath or blood. The question is, do you want your license revoked for a year or not? And I don't know I don't In this I don't think he understands that right now. >> Okay. So, maybe swing back in here. Kind of explain what the next steps are from here, okay? So, since you refused, which is which is totally your right to do, okay? We we have to So, what we're going to do is now is we got to apply for a search warrant and have a judge sign off on it, okay? So, we're going to get a test on it. And also, that's that's that's his constitutional right. So, and then once that's once that blood draw is complete, then we can look at getting you a phone call, okay? >> to call my parents just to tell them that >> Well, Well, we will we will get >> We got to hold off now. >> All right. I'm going to I'm going to buckle you up, okay? >> Now, we probably could have taken his phone and called his parents and said, "Hey, just Tony's not going to make it." He's not going to make it. Not right now, at least. Going to be tied up a little bit. >> Yeah, unfortunately. All right. >> Well, >> Won't be too much longer, okay? >> This sucks. There's no other way to put it. I mean, you get caught and when you get in trouble for this, it sucks. I always try to put it into perspective. This could be much worse. You could have killed somebody. You could have hurt somebody. So, this could absolutely be much worse. He was very He was cooperative. Um I think he made I can't give him legal advice. I think he made a colossal mistake not giving breath or blood because you're going to give it no matter what. If you're ever pulled over for a DUI, we're taking your breath or blood. We can do it with consent. If you don't want to do that, we're still going to get it. We're just going to get a search warrant and like I said, forcefully if we need be. So, I would I cannot give legal advice. Me, personally, I'm never going to find myself in this position cuz I don't do drugs, and I've never drank a sip of alcohol in my life, neither is my wife. Zero, zilch, so I don't have to worry about this, but um should I ever find myself in that situation, I would absolutely always give blood. Um not breath I would probably just do blood, do consent, and be done with it, and not lose my license for a year or have it revoked. So, that was the mistake he made. Uh fine not doing the PBT. Uh probably I wouldn't do FSTs. I would just be like, "Nah, I'm not I'm go ahead and let's just pull my blood, and let's get on with it." So, I wouldn't do FSTs, any of that. Anyway, that's just me. But, uh let me know what you think. How was he? I thought he was very cool, kind, and uh was a professional, and sucks that he went through this. Don't drink and drive. This is an example of why you don't. And uh good luck I hope wish him the nothing but the best of luck, but I'm just glad that he didn't hurt anybody in the process cuz it could have been a much worse, like I said. So, and I'm sorry I got y'all riled up thinking he was going to be doing the Dak Prescott turn and turn and turn. I saw the AI. It looked great, and I was thinking, "Man, for a guy with a bad back, he was sure moving well." And then Dayton comes in and tells me it was all AI. So, all right. I'm just going to take this one off so I don't show you the uh the one in the Dayton's going to see if we can focus. This is what's in this box right here, okay? This is what the watch looks like.
