Just like this. Just hypothetically. >> Off the record, this reminds me of 911. >> We know 911. I might drink. >> Okay, then I'm going to see. >> All right, everybody. Welcome back. We got another video for you. This one comes from Body Cam Files and it is Cocky Driver finally gets what she deserves. I haven't seen it. Let's go. Cook County, Illinois. That's Chicago. Hi. >> Hello. My name's Officer Lee with the Mount Prospect Police Department. Pulled you over today for speeding. Do you know how fast you're going? >> I hope in the in the limit. >> No, far from it. Do you know what the posted speed limit on Route 83 over here is? Elmer's Road. >> Well, um >> Okay. How fast do you think you're going? >> I I thought I was going to You're going 55 in a 35. 20 miles over the supposed speed limit. Any reason you're going so fast? >> No, I'm just making river. >> I feel like she's kind of sluring her speech a little bit. And so sometimes when they roll that window down, you're going to try to see if you can get your nose close to it. Smell, see if you smell the odor of alcohol or maybe marijuana coming out of the car. And so we get close to the window for that reason. Plus, when they're not talking very loud, it it's hard to hear them. It took you so long to stop even though I honked at you Mercedes 28 of >> Nora. You said you didn't see me. >> I was following you for a little quite a quite a bit of waste through here to parking. >> Running red lights. >> Do you have your driver's license on you? >> I'm going to come over and get that from you. >> Can I see your license, please? >> Yeah, of course. >> I didn't see you at all. >> Okay. Where you coming from tonight? >> My house. >> Your house? I have my boyfriend's living sitting here. >> Your boyfriend lives here? Okay. >> Hm. >> Tell me. >> My driver's license. >> Yes, please. >> No, >> that's not your driver's license. >> Oh, I'm so sorry. >> So, a lot of times that's a sign of impairment as well. Like you'll you'll ask them for a driver's license, they'll give you their credit card and stuff. >> No, it is. It's And it's completely gone. I'm so sorry. >> It's completely what? >> It's it's it's good. It's good. >> Okay. All right. How much you have to drink tonight? I didn't. >> Clear Valley. >> Ah, you did. I think you did. >> Okay. What kind of drink? >> Just like a little um >> Golden Colorado. >> A cocktail or a beer or >> back in a Toyota? >> I came to my friend's house. Yeah. A little cocktail. Like >> a cocktail like what? Like vodka or rum? >> Just little mixed drink. >> A little mixed drink. About >> me here. >> Okay. About what time did you have that mixed drink? >> Um like 2 hours ago. 2 hours ago. Was it a big glass, small glass? >> A mediumsized glass. >> Medium sized glass. Did you finish the whole thing? >> I did. >> How long did it take you to drink? Guess >> maybe like an hour and a half. >> Now, you might be asking yourself, why is he asking all these questions? Well, the level of alcohol matters with how long ago you drank, how much you had to eat, did you drink the full drink? Did you drink one beer, two beers? Was it a mixed cocktail? Which means there's going to be a higher concentration of alcohol in those drinks. This is all matters because you can have 0.08 um over 0.08 is beyond the legal limit. And so these are why these are questions are important to establish whether or not she there are signs of impairment. It also starts to get her in on a story that she's she continues to acknowledge the fact that she has been drinking prior to driving. >> Hour and a half. Okay. So about 2 hours ago. And then you finished drinking >> maybe half an hour ago. Would you say that was safe? >> 20. >> Okay. Very good. And nothing else besides that one mixed drink? >> No, thanks. >> Okay. The only reason I asked cuz you're kind of slurring your speech a little bit. I can smell the odor of an alcohol based beverage. >> No, it's not that serious. >> Okay. Do you take any >> Oh, guys, it's not that serious. So, yeah, she promises us it's not that serious. >> Medication or anything like that? >> I mean, no. What do you mean? >> No, it's just funny because like honestly like I do. >> Okay. You're not diabetic, are you? >> No, I'm not. I'm not. I'm healthy and well. I'm sorry. >> All right. Very good. Do you have uh proof insurance for the car? >> Do you have proof of insurance for the car? >> Why don't you go work on that? I'll be right back with you. Okay, so stay right here. >> The reason why he asked if she was diabetic or because sometimes a diabetic coma can can seem similar to somebody under the influence of alcohol. Um so he's eliminating all the possible arguments that she could have down the road when she goes to fight this DUI. 2017 by driving me but I don't have insurance. >> Okay, very good. We'll worry about that in a little bit. >> Like if I um No, actually I >> Frankly, the insurance is the least of our concern right now. >> You mind stepping out? I got to talk out here for just a moment. >> Okay. >> This car in park? >> Yeah. >> All right. Very good. I don't want this to roll off on you. If you step out, I got to talk to you back here. >> What's up? >> You can't talk to me right here? >> No, I got to talk to you back over here. >> Yeah. Mhm. We'll turn that down for you. >> Busted. >> Over here. >> Over here. >> Melissa, over here. [laughter] >> Okay. Talking over here. So, you said you just had the one drink? >> Yeah. >> The mixed drink about 2 hours ago. >> Mhm. >> Okay. Because of some of your behavior and some of your driving, I want to run you through a few tests, make sure you're okay. That's all. Okay. So, >> the officer is doing a great job. Great job. >> Do you wear any contacts or glasses or anything like that? >> Uh, I do have contacts, but I didn't wear them today. >> Okay. All right. Very good. Do you have any other eye problems, abnormalities, stuff like that? >> The reason why he's asking about her contacts and her eye abnormalities is he's about ready to administer an HGN test, horizontal gaze, nestagmus. It requires them to move their eyes off to the side, which can be, you know, having contacts. contacts can pop out. So, also wants to know if she has any stigmatisms or anything like that. >> You're good. How's like your general health? You're not sick or anything, are you? >> I No. >> No. Okay. How's like your hips, ankles, knees, all that? That all good? >> I had to just go to the bathroom, but other than that, I'm great. I >> I'll try to make this fast for you. Okay. >> Uhhuh. >> All right. Do me a favor. Stand with your feet together just like this? >> No, we have to. Okay. >> Your hands at your side like this. >> Yeah, of course. >> What I want you to do is follow the tip of my finger. >> You guys don't look at me. >> These are my These are my bodyguards. >> Of course. Of course. [laughter] I want you to follow the tip of my finger with your eyes and your eyes only. Okay? So, don't move your head, just your eyes. Okay? >> All right. You see my finger? >> Our driver here is telling me this is some kind of permanent plate out of my turn. >> Cuz the bright is that better? >> Yeah, I was going to say. Yeah, I can see it. >> Okay, keep following it. >> The only reason I was lying is because I watch too many cop cars. I'm sorry. like you know like the cocktails. Okay, fine. >> Keep on keep >> focus focus focus. >> I know. No, that's good. You're good. >> I promise you like >> no hands in pockets. >> There you go. >> Trust me, we we've dealt with far worse. So, >> just let us >> So, try not to move your head. Okay. Stare straight ahead and just follow the tip of my finger. Okay. You see it? >> Can you look at it? >> Yeah. >> All right. There we go. >> These are all things we're going to notate that she couldn't struggle struggled to follow instructions. um couldn't keep her hands down at her side. Uh kept moving her head, all that stuff. >> Okay. You said it was just the one drink. Are you sure? >> Okay. Very good. Why don't you stand right here for me and face the cars? So, what I want you to do is imagine from your left foot all the way that way is a straight line. And I want you to stand with your right foot in front of your left like this. >> Keep your hands at your side. You going to be good to do it with those shoes on? You >> you can take them off if you'd like. >> I don't think it's >> okay. I'm just trying to give you the benefit of doubt. So stand with your >> What if I have to put like Okay, >> I'm trying to make this as fast as possible. So imagine from your left foot all the way there, straight line. Once you put your right foot in front of your left hand, >> I'm not really seeing the cocky. I mean, she certainly has a lot of uh confidence in herself and she thinks this is probably less serious than it is. >> Hands at your side like this and stay there. >> Okay, I'm going to >> Nope. I'm I'm going to explain the test. So, get back in that position for me. >> I'm going to explain the test for you. >> I'm going to demonstrate the test and then you go. Can you get back in that position for me? >> Right foot in front of left heel to toe. Just like this. Just hypothetically off the record. >> This reminds me of Reno 911. >> Reno 911. [laughter] I might >> Okay, then I'm going to remember that one, too. At least I'm not wear >> That is a great Reno 911 skit. It really is. >> The short shorts, right? >> No, exactly. >> All right. Very good. So stand like this. >> Stand like this for me. >> All right. So it's going to be nine heel to toe steps this way. Turn. >> How many steps? >> Nine. >> And then turn. Nine back. I want you to count out loud. It's going to go just like this. I'm going to demonstrate the whole test for you. I'm going to count. One 2 3 9. Turn. 1 2 7 8 9. >> Wow. He shoulder the whole thing. >> Nine heel toe steps. Count out loud. Look down at your feet. Okay. Whenever you're ready. Keep your hands at your side, too. >> Of course. >> So, whenever you're ready. Go ahead. [laughter] >> She >> She is definitely confident. Cocky, I guess. >> Okay. Okay. >> You ready? >> I was doing what I can. >> Go. >> No pressure. Nine and back. >> Okay. >> All right. Watch this one. >> Central from 7100. When you get a chance, I have another for you. >> Six. Seven. Hands down at >> not touching heel to toe. >> Don't bring in my flat seat. >> Back 9 one. [laughter] >> This might be better than the Reno 911. >> All right. Very good. Do you have your phone on you? >> She gave a little >> You're saying that's a >> I got >> She keeps putting her hands in her pockets, but >> Oh god. How many more? I'm trying to make this as quick as you can. I'm being as quick as I can. I'm not being mean. No. Come on. >> Okay. Come on. So, this next one, you're going to pick either foot you want. I want your hands down your side like this. I'm going to use my right foot. You can use any foot you want. Doesn't matter to me. >> Going to do the one-legged stand. >> Hold it approximately 6 in above the ground, parallel, and count. 1,00 1 1,002 1,003. And keep going till I say stop. Look at your foot and keep it 6 >> in count. >> Yeah. And count out loud. >> 6 in. 6 in above the ground. >> Six inches. I need inches. >> You ready? You understand? >> Well, hold on. Hold it up till you say so. >> Oh my god. >> Don't start until I say so and count out loud till I tell you to stop. Okay. Remember, hands at your side, too. >> Okay. >> H how far my hands going to have to breathe? >> Keep your hands at your side. >> Oh, right here. That's >> when I say go. Go. >> It's like trying to do the robot. >> Count out loud. >> One. >> And look at your foot. >> 100,000. What was the 100? >> Just count. Oh gosh. >> 2 3 4 5 6 >> Hands not down at the side. >> 9 10 >> 11 12 >> A lot of these girls have pretty decent balance though. A lot even on under the influence. But she's swaying from side to side >> of Illinois, Montana, and Colorado >> doing goofy stuff. only had my >> I'm sorry guys [laughter] like like Rafiki was that Kumbaya >> no what what is Rafiki saying >> all right so now he's going to do a a PBT a portable breath tester typically not admissible in court but it is good to verify your findings on your field sobriety tests Uh, kuna mata. >> Hakuna matata. So this next one I'm just going to ask you what you do is you blow into it and if you keep blowing out one big solid breath takes about 6 to 10 seconds. Okay. >> I Okay, this is where this is where I have no offense cuz I use your job. But I cannot go into that. >> Why is that? >> I just I've seen I honestly I've been like very educated with the like you know I don't know. I just I have nothing. Okay. >> This is to see where you at cuz I think you've been drinking. So this is the to see where you're at. I already admitted to that. >> Which is which I appreciate. If you don't do this, then I have to base my judgment what's going to happen from here on based on everything else I've seen here. If you said you've only had one drink, it should really >> You didn't do very well. >> You guys didn't think I did well. >> It's not really a pass or fail. If we just take look for the cues of impairment and she did not do well. >> Oh, >> you didn't see this? Oh, then I'm definitely going to if Thanks for the audience. I'mma forfeit this. Can I go to the bedroom really quick? Okay. >> So, you sure? Cuz I want to see where you're at. >> I I obviously Well, based on the like if I fail the test and then No, I don't want to blow like I'm I'm honestly >> because I'm trying to give you the opportunity to prove to me that you're okay to drive and you're under the legal limit. So, I want to prov I want to provide you with every opportunity to prove that. >> I think I did that with my dancing. >> What's that? You did that with your dancing? >> My thing, right? >> Okay. Well, >> and I pulled their >> Just an FYI, if you ever get pulled over for DUI and they're having you do the field sobriety test, don't start dancing. It's not going to go over very well. And she thinks because she was able to dance, she should not be held accountable here, right? >> Um, like, no. So, I'm going to I'm just going to opt to test. >> You're going to opt not to, >> but Okay. So, Melissa, >> based on everything I've seen here, based on your >> You think? >> Yeah. I think you've been drinking. I think you're over the legal limit. I think you're intoxicated. So, right now, you're under arrest for DUI. I need to put your hands behind your back. Okay. >> Wait, wait, wait. One second. One second. One second. One second. I I want to admit one second. Okay. I'll fly test. You'll do it >> maybe. But can you please go to the bathroom first? >> Not right here. I can't. That's illegal. >> I was going to like if I go my >> I can't let you do that right now. I can't let you. >> I can't escort. Okay. You guys going to make this I can't so bad over you. I'm trying to make this quick. >> That's the only reason I watch the quicker you do this, the quicker we'll we'll get on. So, blow real hard like you're blowing a big balloon. Okay. >> Hey, can I can I get like inial advice from a friend? >> No. >> This isn't phone a friend. This isn't uh do you want to be a millionaire? You can't phone a friend. >> Yes or no? >> I have a good lawyer. >> You're going to need a good lawyer. >> Okay. >> It's a It's a yes or no. Melissa, >> I need you to relax. >> Listen, listen, listen. >> She's serious. She feels she's acting like she's on a game show or something like, "Oh, I might win. I don't know. Let me phone a friend." >> Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. >> Look, I am blow. This is your last shot. >> Okay. You're right. I'm not I don't think I'm that drunk. >> Blow real hard. Blow. Blow. Blow. Hard. Don't blow in. Blow. >> Don't suck in. Blow in. >> Hard. Blow. Blow. Blow. Blow. Blow. Blow. Blow. You got to blow. You got to blow longer. >> Keep blowing until he tells you to stop. >> Okay. >> But can I go to the bathroom first? >> Not right now. >> Just put her in cuffs. Go. >> Okay. >> Blow out real hard. Real >> cops. >> Blow up a big giant balloon. >> Okay. Okay. [ __ ] it. >> The gun thing. I'm not going to blow into this thing. I'm not going to compromise myself. >> Okay. >> Quit messing around. >> Need to put your hands behind your back. Okay. >> Melissa, calm down. >> I have to pee. You guys are peeing. >> I'm going let you pee back to the station. Okay. >> We'll bring you back and then you can >> one thing at a time, but we'll let you go. If I get it, >> we're going to get everything you need. Okay, >> we got to go to the car now. Melissa, go with Go with my partners. I'm going to get it. >> No, no, no. I don't want anyone I don't authorize anyone to go into my car. >> This is like a typical She was funnier than most, but typical DUI investigation. >> Get your stuff out of your car. >> No, you don't. There you go. >> Okay. Door. >> You want your phone? >> I don't know how to find it. Stop. >> Okay. I'm getting everything you need. Stop. Melissa, if you don't comply, you're going to get other charges. You're going to get other charges. Don't do that to yourself. >> Please, can I please call my friend >> when you get back to the station? I promise. >> No. No. He can just take my car and that's and he can >> when you get back to the station. I promise. Melissa, you're getting very close to me. >> Come on. >> Which is going to be worse. >> Can you please go? >> No. Listen to me. >> No. We're done talking. Go. >> Listen to me. >> Melissa, go. >> Okay. Stop. >> Pull her. >> Listen to me. I don't want. >> Oh boy. >> So, what he's looking for is probably getting her purse. Not really doing a search. Although, they will do a inventory of the vehicle if they decide to tow it. >> We're taking care of your car. Don't worry. >> I'm lucky. >> I'm getting everything you need. >> It's like Christmas thing like All right. It's not Christmas day. It's December 9th, 2022. >> You guys been just >> I'm going tell you, I watched this DUI investigation. December 9th, 2022. On December 16th, 2022, my kids, my son, my granddaughter, my daughter-in-law were killed by somebody driving under the influence of alcohol and drugs. So, I really don't while some of these investigations can be funny. I It's not a funny laughing matter. And you'll be happy to know that the guy that did that just got sentenced last week. Got 17 years in prison for it. Not enough. >> You're getting in THE CAR RIGHT NOW. >> PARK. You can't let him park my car. >> Stop. You are so rude. >> She doesn't want this. But trust me, this is better than going and hurting somebody or killing somebody and ended up in prison for it. >> You can just attack my car. We live right here. Hold on a like. >> Melissa, you're about to get another charge. >> No, for real. Like you like I can't like you going to tow my car. That's rude. It's like Christmas time. >> We'll get more back to the station. >> Isn't that enough that he was [ __ ] pulling me over? >> Get in the car. >> [ __ ] you up like this. >> Get in the car, Melissa. Oh no, >> it's her own actions. Accountability, Penny, please. Just like, can you just be my car? >> Put your foot back in the car. >> Get your foot in the door. >> No, I'm just serious. I'm not trying to be funny. Like, it's not >> foot in the door. >> No. Like, this is so I'm sorry. Okay. >> He lives. My boyfriend lives here. Let him park here. Please. It's going to be like an >> You're getting charged with resisting right now. >> No, I'm not trying to do that. Like I doing that right now. >> I'm trying to comply. >> Put your foot in the door now. >> I just don't want my car to get >> Okay, put her foot in the door and close it. >> [ __ ] the door. >> Somebody knocked foot in the door. >> Can you please? >> Melissa was charged with driving under the influence and obstructing an officer. Further case details are unavailable at this time. So, I'm guessing that she's already been pleded out or whatever, been charged with it or whatever it is. But, uh, yeah, I think this was appropriate. She's lucky. She gets a DUI, she's going to go to the station, they're going to process her, and then they're going to send her on her way home. Her obstruction probably got her booked in, but typically, you would just get processed and then somebody comes and picks you up. Boyfriend can take the car, all that. But this situation, she made much worse than what it was. What did you guys think of it? Obviously, one of the funnier DUI um field tests that she went through, but this is a serious matter and people can get hurt and killed and all do every day in this country from people like this that are driving under the influence of alcohol or drugs. So, I think uh they did a good job. They were very patient with her. They very professional. Did everything the way that I would have done it and uh excellent job. got her off the street so she didn't hurt anybody and saved herself some grief uh in her own life at the same time. So, let me know what you think. Comment, like, subscribe. We'll catch you on the next
