What happened? >> Okay, a grave mistake. Okay. >> your right hand. >> My right hand. >> All right. Do you swear to tell the truth, the whole truth, and nothing but the truth? >> to tell the whole truth and nothing but the truth. >> All right, everybody, welcome back. Guess what? I'm giving away my watch, but you're going to have to hang on to the end of the video to see it and find out how you can win it. Today, we got another video for you. This one comes from Body Cam Goat, and it is mom arrested after sending toddler to daycare with a loaded gun in the lunch box. Look, I'm as big of a gun guy as the as anybody. Uh this is out of bounds. You can't send it with your toddler. I haven't seen it. Let's go. >> This is 39-year-old Shinay Davis. On March 14th, [music] 2024, Riviera Beach police responded [music] to a call from a local daycare in reference to a discovery inside of a toddler's lunch box. >> Imagine [laughter] Can you imagine there when they go to open the kids lunch box, there's a loaded gun in there? Uh yeah, that's a problem, Shinay. >> Officers learned >> Shinaynay. >> found the weapon while attempting to prepare lunch for the child [music] and immediately called police after realizing the firearm was real. Watch what Ms. Davis tells police when she arrives to the daycare and let us know what you think in the comments below. >> How you doing? >> How you doing? >> Are you the mom? >> Yes, ma'am. >> All right. Uh stand right here for me so I can talk to them and then I'll come and talk to you. How you doing? >> Hello, how are you? >> I'm good. All First and foremost, where's the what? >> She She got She took She had She had but let me tell you where you >> No, where is it now? >> She has it. She put it in her car. >> Ma'am. Ma'am, where's the weapon? >> It's in my car. >> Okay. Let me Let me get the weapon. >> So, the reason they need the weapon, that's evidence. There's a crime. Like I don't know why they didn't The mom came in probably just bullied him into giving him the the the gun. But, you got to have the gun. It's part of the crime. It's evidence. >> Ma'am, it is the owner. >> Okay. >> She's getting ready to take me to jail. Are you >> I need the weapon. >> Oh. >> Ma'am, I need >> See, this is why I don't wear those dang gloves. I always carry a pair of, like I said, these Gorilla Grip gloves. You can just put it in your right in your vest. And they're like five bucks. So, if you ruin a pair, you can just go get a new one. >> I'm not trying to be a hotshot. Don't give me a gun. >> These things are too dang hard to get on. Look at this. >> Ma'am, she's getting ready to Are you She said >> Ma'am >> She's getting out of the car. >> She's out of the >> Yes, ma'am. >> Okay. Can you Hold on. Stand all the way back. >> I know. >> Now, you don't need a search warrant. Obviously, well, you know that the evidence is in the car. Um you're going to make it safe. So, you you can you can get away without a search warrant here. You can articulate this. >> Hold on. Don't walk away. >> I'm sorry. I'm sorry. >> It is the owner, ma'am. >> Okay, hold on. I'll talk to you in a minute. >> Okay. >> So, >> you see like they're here. The police are here right now. They're aggressively >> I'm not aggressive. >> I'm sorry, ma'am. You're not. But basically what I'm saying is she has her gloves on. She's taking a picture of my gun. She's ready to fresh charges on me and take me to jail, exactly. And this is what I'm >> At least not savvy enough to know that you can't put a gun in the the lunchbox. Savvy enough to know, street smart enough to know that she's going to get arrested. >> talking about. >> And what? She's got a Hi-Point. >> Okay. So, what happened? Can you talk to me? >> Well, okay. You hold on 1 second. This is the owner. Hold on 1 second. Hold on, Ms. Jackson. Please don't hang up cuz I have to I have to explain to the officer. >> In the In the In the mean This her phone call? Look, these your keys? >> Yeah. >> I know what I'm talking about right now. >> Okay, so >> So, hold on. What happened? >> Okay, a grave mistake. Okay. >> your right hand. >> My right hand. >> All right. >> You swear to tell the truth, the whole truth? >> the truth, the whole truth, and nothing but the truth? >> I swear to tell the whole truth nothing but the truth. >> All right. >> Okay, so it My son go here. I take him to school every morning. >> is your son? >> Okay, so basically she Ms. Granger >> Can you Can you get off the phone real quick? >> Ms. Jackson, hold on. Okay, it's like four police officers. Oh my god. Okay. >> Get off the dadgum phone. >> right here. At 9:00 they close the door and they lock the door. I don't carry purses, all right? I keep my gun in my glove compartment, locked in my glove compartment. I just got work done on my tire. They breaking cars out where I live. So, the only reason why I took the gun out of my car is cuz I didn't want the car my car to get broken into and they get access to the gun or what. >> Most car break-ins are for They see a backpack in the car, they see something of value. Computers, guns tend to be the most common thing that they're looking for because they can take it and go sell it on the street and get a few hundred bucks cash quickly when they take a gun out of a car. So, when we had breaking and entering into a car, a smash and grab, it was typically for a backpack that was visible or checking to see if there was a handgun or maybe some prescription pills in the vehicle. >> Whatever. So, this morning I took him. I put the gun in his lunchbox to bring it outside. Instead of carrying it bare, I don't like I said, I don't carry purses. So, instead of me Huh? So, so instead I'm still talking to her. I already got I already got the zero. >> Yeah, and she said she don't want to press charges on me. >> Hold on. >> Ma'am, it was a grave mistake. >> I don't think that this lady can be the deciding factor in whether charges are This is going to be misconduct involving weapons and it's not really that victim. She's not the victim over here. Um Yeah, I don't think that I don't think you need a victim in this case. >> I'm I'm pretty sure that's what it is. It doesn't seem like anything malicious. >> was a grave mistake. I feel I'm so sick in my stomach. I'm so sick in my stomach. That's I literally I don't My son has never seen the gun before. He's never even seen it before. This is why I put it in his book bag this morning. I put his book bag under my arm cuz I don't carry purses. I don't. That's why I don't even carry the gun on me. >> You might want to start carrying a purse now. >> Right. All right. Let me call you Let me call you right back. All right. So, you're packing the lunch. You put the You put the weapon inside of the lunchbox and then what happened? >> And I closed >> So, what do you do in this situation? Are you charging her? Are you charging the mom? Are you chalking it up for a mistake? Love to know. Like these are the These are the the situations we find ourselves in as police is you know, what where where does the line Where do you draw it? You know, cuz mistakes happen. Um so I'd like to know where What are you going to do in right now? How do you think you would proceed on this? I'll see what she does. >> I lose it and I put it in my passenger side. Okay, the whole point was to take it out before and put it in my glove before I bring him before I get him out of school. Okay, 9:00 they locked that door and you already know if you have kids once they lock the door you can't get in for the rest of the day to get your child out of school. >> What's What's your address? >> So their lunch is at 11:00. >> The lunch time is at 11:00. >> Mhm. >> So >> 21 real >> It's between 11:00, 11:30, something like that. So I get a call between 11:00, 11:30 and they're like, "We need you to come up." >> Oh. Dang. >> Can I at least make a phone call? >> I'll call 21 and let you >> What am I being charged with? >> Neglect. >> I'll I'll let you know in a minute, but go ahead. >> Um That's him for I'm going to talk to her real quick. I'll be back. Why y'all doing me like this? And the crazy part about it is I could have just got my son and went home. And now y'all arresting me. Y'all can't NTA? >> An NTA is a notice to appear. The same as a citation, but a citation is going to be misdemeanor crimes. You can issue somebody a citation, disorderly conduct, assault. You can issue a citation as long as, you know, you can say, "Look, it's it's everything's safe. it's not an ongoing problem. You have the You have the ability to issue a citation. And And notice to appear is kind of like that. Um this is probably going to be a felony charge, so a felony we would do something called a long form where we would issue tell them, "Hey, we're going to submit this to the county attorney and it's going to go to a grand jury, and then you may get a subpoena to appear uh for these charges." So this that you're instead you're sending it to the county attorney for them to make the final decision as to whether they're going to file those charges or not. >> Ma'am, sir. >> I'm not investigating officer. >> Um that decision was already made by our supervisor, so >> Who was the supervisor? Like y'all not even giving me the opportunity to make a phone call any >> That explains why all of a sudden they just put handcuffs on. I'm sure over the radio the supervisor's like, "Hey, you got a 10-15 this lady. You got to arrest her." >> You can make a phone call. Just this is not the time for the phone call. >> That's right. >> I'm at my son's school. My son is right in there. Y'all take my son. >> son. You can't see your son. >> And I've cooperated. I said it had to wait for y'all. >> Okay. >> Before you go in, let me just I don't have nothing on my hand. >> hand. >> Okay. All right, go ahead and have a seat. Go ahead and >> Go ahead and have a seat. >> I mean, it sucks, but mistakes have consequences, too. They're not always uh you know I believe her when she I And look, nobody's putting a gun in their child's for them to take to school. I believe her when she said she put it in there to carry it out to the car, but yeah, it is very dangerous what she did. Neg- neglect or misconduct involving firearms, something along that lines. >> You got to put your legs in slowly. >> I I need to talk to somebody, ma'am. Can I talk to the officer, please? >> Ma'am, the decision already had made. The only dis- thing you could do right now is when we go to the station, if there's somebody else you want to speak to, we'll get that supervisor or whoever else that you want to talk to, but right now you are under arrest. Okay? >> What are my charges? >> We're going to let you know in a few. Is the Are you okay with the godmother picking up your son? Yes. >> I'm a good mom to my child, and I'm about to lose everything because y'all >> doubting that you're not a good mom. It's just we have to do our job. >> I know, but this is crazy right here. >> She put it in the book bag just for safekeeping. Yep. And forgot to take it out. >> Dang, that [clears throat] is The kids could have just grabbed it and I mean, they could have been very dangerous. >> It don't work. >> Officers go to speak with the staff of the daycare that discovered the weapon in the lunch box. >> Hello. >> All right. So, who found the weapon? >> Um my teacher My teacher I was standing at talking to the teacher and she and she discovered it. So, it was a kind of like both of us. >> All right. So, where were you guys normally when it when you when you found when you located the weapon? >> Um well, all the kids were at the table um getting ready for lunch. >> All right. So, can you raise your right hand for me? Do you swear that the statement you're about to give is the truth, the whole truth, and nothing but the truth? >> I do. >> First, can you tell me what happened? >> Um so, um all the children were sitting at the yellow table. She sits at the yellow table. Um I did like a a circle round I opened up one child he was the last one that I got to. So I got to his lunch box. I opened it up and when I went to reach for his sandwich after I picked up the sandwich I saw >> Which indicates to me that that gun was in there before she finished preparing the lunch to put the sandwich on top of the gun. >> The gun at the bottom of his lunch box. >> And then what did you do? >> I freaked out and went to the office and told them like hey you know, there's a gun in here. I'm like there's a g u n g u n g u n and Ms. Shawn ended up entering the classroom and when she entered she removed the lunch box from the class. >> Okay, anything else that you want to add to the statement? >> Um, no. >> Okay. Can you tell me what happened? >> Um, I was standing in the doorway talking to uh the teachers down there. Uh, my teacher uh Shequisha was opening the kids lunch box. So when she got to that particular child she unzipped she unzipped the lunch box and she went to reach and she WAS LIKE OH! AND I WAS LIKE WHAT WHAT WHAT WHAT? SHE WAS LIKE HUH SO she said what it was so I I then went down opened the lunch box I saw >> What color was the lunch box? >> Uh lunch box is like a black maybe navy blue it's like a dark color with like uh maybe like like white uh lines in it or something like that. >> Can you do me a favor can you go in her car and get that lunch box out of the car it's in the front. >> It's in the car? Her car? >> Yeah. >> Okay, so you got the lunch box >> So I got the So I got the lunch box. >> Yeah, you're going to want to have the lunch box for evidence on this as well. So the lunch box and the gun. >> I I looked I I felt the heaviness of the lunch box so I know it was definitely a real weapon but I wanted to you know make sure. So, I would treat you >> I wanted to make sure. So, I popped off a couple rounds and I realized it's real. >> Gloves. I put [clears throat] gloves on. Um took it out. >> Excellent job, honestly, by these ladies. She took the time to put the gloves on. They made it, you know, made sure that the kids were safe. Uh they did a good job here. >> To make sure um that it was um a real weapon. That's when I realized, oh yeah, it's definitely real, definitely loaded. I put it back, stuck it back in the lunch box, and then I immediately called her and told she needs to get to the school. >> Okay. And then what did she say? >> Uh I didn't tell her why I was calling her. I just said I need to see you at the school, and it's urgent. She kept asking me why, why, why. Um I said, I just need you here type thing. We hung up. She said, I'm on the way. Um I'd say maybe 3 to 5 minutes later, she called back, and that's when she realized why we were calling her. And she >> Like, I'm so, so sorry. >> area that you guys were in when >> Uh that's it make you sick to your stomach to to remember that you left a gun in your son's lunch box. >> He sits right here, right? Right here? He sits The child sits right here. So, it was >> Hi, how you doing? >> I'm good. This is Officer Hunter with the Urban Crest Police Department. So, um well, I'm I know that you're the owner and the director of the facility. Uh >> [clears throat] >> So, would you like to prosecute as well? >> No, I don't. She got that baby, and the baby needs somebody. He need his mama. I I I don't want to do that. I just thank the good Lord nobody got hurt. None of the other kids got gun, and I'm going to have to let her put him somewhere else. So, I'm going to hoping that would never happen with us again. And I I just >> Okay. Um I have to I have to look Yeah, I I understand, but I is is other you know policies in reference to because this is a school that we have to go by so I still have to you know obviously speak with supervisors and make sure that I'm I'm following all rights and protocols because even though you might not want to prosecute state says that I might have to so I have to go by what they say. >> That's what I said earlier. So even though they don't want to be the victim there still may be charges that she can't you don't need a victim on. >> I just want to let you know that I will give them a copy of the case number and you guys can contact for someone to come and pick up the kid okay cuz I'm not going to make her let her make a phone call just yet. Okay? >> Officer I I told her that I I was not going to press charges but I didn't know what you all was going to >> Yeah yeah we have yeah we have it's a whole another it's a school so >> It's it's dangerous cuz I mean my little kid >> Okay. Okay. >> All right. >> All right. >> I appreciate everything you doing. >> Anytime. >> Thank you so much. >> All right. Shanae Davis was charged with felony child neglect and allowing [snorts] a minor to obtain a firearm. Ouch. I don't know what that charge carries with it. I got to believe like [snorts] certainly probation um Some mistakes just have more worse consequences than others. I definitely don't think she did it on purpose obviously she was put the gun in there and remembered later on was apologetic but she also understood that what the what the situation was so These are some of the tougher ones that we come across and charged with neglect and letting a minor have a firearm. So, let me know what you think. Uh I'd love to know if you think what what should be your punishment in this situation. Uh do you think she deserves some prison time? I I don't. I probation is what I think would be appropriate, so. Um yeah, okay. Another thing I told you, I'm giving away this watch from Wasson w a s s o n and it was for the 250th anniversary of our country.
