They asked me for my debit card and I paid on my debit card. They did not ask me for my identification card. >> All right, everybody. Welcome back. We got another video for you. This one comes from Body Cam Watch and it is what happens when you won't let officers verify who you are. Let's go. >> On July 7th, 2022, officers detained a woman suspected of shoplifting at Five Below. No, that this >> Okay, first of all, why are you stealing from Five Below and it everything's below five bucks from >> um Ross? Um, >> no. I watched the surveillance footage. >> Okay. >> And they're being nice. They're not pressing charges. They want you trespass. So, >> all right. Okay. >> Don't fight it. >> Okay. Regardless of a store's decision not to press charges, the officers could still arrest the suspected shoplifter if they had sufficient video evidence or other witnesses of the crime. That's a big difference. Most places you need a victim of a theft charge or shoplifting. In this particular case, Florida says you can still charge him if you have evidence of it. >> All right. Can I see your your right index finger? >> Okay. Since the woman didn't have any identification on her, the officer was just trying to use a fingerprint scanner to verify who she was. >> Don't Don't push down so hard. Let me I'll control the pressure. >> Stop, lady. >> And then can I see your left in >> a one roll? >> Don't push down so hard. >> Let me control the pressure. Stop pushing down so hard. >> Do anything. Office. >> Ma'am, let me see your finger. It didn't scan. >> Do anything. What did I do? >> Yes, you did. You stole from the Five Below and now they thankfully they don't want to press charges. Just give me your ID. >> You stole items from the store. >> I This is what This is the only thing. This is from >> the basketball and the pillow. >> Okay. This is from basketball. >> Destiny. >> Ma'am. >> Let me see. You're fingered >> here. >> So we can verify your identity. >> This from >> what you I'm trying to explain you very calmly. So, I don't know why you're getting >> Because they didn't ask me for my ID. >> We need to >> They asked me for my debit card and I paid with my debit card. >> They did not ask me for my identification card. >> Negative. No record or like they're down. >> So, may I please go pay for it or you can take it? Can you run her out of >> We're going to take it back for you cuz they do not want you there. >> That's fine. >> Not go back to Five Below and >> Can I take you to Ross? Did you pay for Destiny? >> Yes, baby. >> Destiny, what's your middle name? >> Sir, >> I don't have her name. >> Yeah, she's saying she doesn't have one. >> Take it. Let me just go with my car. >> Destiny, here's the issue. Okay. >> Yes, sir. >> We You gave me your name and your social. >> I gave it to Dispatch. They're not finding any proof of identification from you. >> They ask me for it. >> I just did. >> But they did not. >> No, we're not asking about Destiny. Listen to me. We're not talking about Five Below. Talking about me and you right here. I need to know who you are. >> You gave me Okay. You gave me that information. >> Yes, sir. >> Dispatch is telling me that you there's no record of you out of Nevada. >> Did I ask my ID? >> Yes, I did. >> No, I'm talking about my debit card and my ID. >> Okay. So, you gave me your social security number, right? So, >> I don't argue with you. >> I'm not talking about Five Below. They don't need your ID for you to buy the stuff that we we know this. >> Why am I here, ma'am? Five Below. >> Okay. D as in >> entitlement alert. >> I just want to give five below my ID identification because they asked for my debit card officer. >> I'm asking you for identification >> and I'll give it to >> I would talk to her the same way. I'd be like, "And now I'm asking you for your ID." I would talk to her the same way. >> They don't need it. I need you not need it when I pay for my items. >> You didn't pay for your items. >> I did. I would gladly pay for them. Officer, I will. This is from Ross. >> No, you cannot go back to Five Below. >> So, take it back. >> I'm going to take it back. >> So, can I take from Ross? Cuz I paid for this. Ross did not call you Five Below. >> Five Below is gold. >> Okay. This is Ross. May I take myself from Ross and go to my vehicle and leave? >> No, you are not free to leave yet because we still have not been able All I We are asking is for you to put one of your fingers on that P. That's really all we need to do >> cuz we need to identify who you are to write our trespass. >> The Five Below did not ask me for my fingerprint. We are asking that >> We are asking not five below. >> Ma'am, can I say something? >> Yes. >> May I refuse to put my my finger on that because if I go to >> May I refuse? >> No. If you refuse to identify yourself >> with a valid identification, you can go to jail >> for what? >> For refusing to identify yourself to law enforcement, >> but I pay with a debit card. >> That has nothing to do with this. We need to know who you are. You told me your name's Destiny Martin. >> Destiny Martin >> from Las Vegas. >> Correct. I will get seven. >> Dispatch is telling me that there's no record of you in Las Vegas or Florida >> because I I just got >> that has nothing to do with that. >> I don't understand what law broke. >> Have you ever lived in Oregon? >> No. >> It's a great commercial for Big Mac. I mean, I have to Some of you are probably hungry for a Big Mac after this. >> I don't eat Big Macs. >> That's when that social came back to >> I never 1070 of 80 something. >> Huh? 1070 of like >> arrest me for whatever law. >> We're not arresting you. You have so >> this is wrong. >> I understand. >> May I leave? >> Ma'am, please don't touch me. >> Okay, I'm sorry. May I leave? >> Can I leave? Sir, >> you're dropping stuff all over the floor. >> This is boss. That's why below. May I leave? >> I need you to sit back down. >> But for what law? and I will gladly sit for you >> because I need to identify you positively. Okay? >> So, you see what this says. If you're going to if they want to trespass, you need to identify this person. Even though they may not want to press charges, you want to identify him so that they know who they've trespassed. A picture, the name to go with the picture. >> For what law? >> For the law of needing to identify you because So, you're being accused of stealing stuff. >> Five Below, right? >> I get that. I get that. Listen to me for a second. >> This is what they do. They try to convolute the situation. >> You may not leave. >> Listen to me for a second. Interrupting me so I can explain it to you. >> Okay. >> Five Below is accusing you of stealing items from them. >> And this you're interrupting me again. >> Okay. I'm sorry. >> They are accusing you of stealing items from Five Below. Correct. >> Okay. So, we're here to investigate that, right? >> Correct. And that's your job. >> So, part of that is I have to positively identify who you are. >> And I gave you my name. >> Okay. And I gave that to dispatch. And it's saying that they can't find a record of you. So there. Nope. Therefore, that's why I need you just to give me two fingerprints on here. >> Can I refuse? >> I was just shopping. >> If you refuse to positively identify yourself, >> that is a crime. >> What law? Arrest me, officer. >> Okay, do it. >> Arrest her. >> Are you refusing to Are you refusing to allow us to identify? >> Um, I'm refusing. Yes, because they didn't ask for my ID. They asked for my debit card. >> They didn't ask your ID. I'm asking for your ID. >> When I pay for stuff, officer, I ask I I use my debit card. Where's your debit card right now? >> I pay with Google Pay. >> Pay with with what? >> Google Pay. >> Google Pay on your phone? >> Yes, sir. >> Where's your phone at? >> In here. My phone. >> You have to go down my phone. >> Pick all this stuff up now. >> But this is from Ross. >> Okay. Well, I'm asking you to pick it up. Now you're just throwing stuff over. >> This is from Ross. Officer >> purchase from Ross. Yes, sir. >> With what? >> This is the vlog. >> Can I ask what crime I committed? >> I'm asking you to put it back in the bag. That's all I'm asking you to do. >> Okay, that's fine. >> Ask me to pick up the mess you're making. >> Okay. >> Can I see privately? >> This is privately right here. >> So, I came here from Vegas to my son for his birthday, my co-parent >> and I went to Five Below and I bought and I bought this lady walked out with me up from the store. >> Folks, think about this. I just want to go home with myself and you may have that. >> And I'm telling you this, if you let me scan two fingerprints. >> Why though? >> So I can identify who? >> Because I was shocked. >> Cuz she knows she has warrants. That's why you don't scan your fingerprints. >> Because you were stealing. So I need to identify. >> That's why she's not >> show you the camera. >> We did. And it shows that you I don't have it. They have it. >> Sir, I refuse. Can I go to jail? I would just take her at this point. >> I don't care at this point. I just >> I'm going to jail for shopping at Ross. >> Why? >> We don't need to take you to jail. >> I just want to go stuff. Hey, I'll be right back if I below it. I'll take the whippity. >> No, I taking that back cuz you are not allowed to go back there. If you go back from Ross, ma'am. >> Destiny, this is what we're explaining to you. >> We got it. It's from Ross. We got it. >> Interrupting me. I'm done at this point. You're fine. All right. >> At this point, we need you to put two of your fingerprints on there so we can just verify you say who you are cuz we have to write a test passport. You are not allowed back at 5 below. >> This is from Ross. >> That is from Five Below. I'm not talking about Ross. >> Forget about Ross, lady. >> You cannot go back there cuz you are trespass. Which is why we need to identify you. >> That is from Ross. You literally only need >> Do you see the kind of nonsense we have to put up with the >> two fingerprints and then you >> may I take my items from Ross and go to my vehicle, sir? Why? >> Because I need to know who you are. >> I told you who I am. >> Okay, but it's not it's they're calling me. >> So, it's a crime to go shopping for my crime to steal stuff and lie about who you are. >> But this is for Ross. This is for buy. It's two different stores. >> Do you want to go home? You want to leave? >> Yes, sir. >> Folks, it's from Ross. >> I do not need. >> They didn't even do that. Wow. >> And and and she looks like she's frustrated with the law enforcement. Folks, it's from Ross. >> I don't know why you guys can't understand that. >> Why, ma'am? I would have to go to jail. I know what law I >> We need to identify. >> What law do I break? >> We need to identify it. >> I told my name. >> Okay. Okay. And it's come back saying that it's not true. >> It is true. >> Santa, there's no record of you out of the box. >> Oh wow. >> That's why I need to scan your fingerprint. >> I can't think something I paid for. >> Okay. Now, because we are with the Ross. >> Why? >> Because we still haven't identified you. >> Officer my vehicle. >> Where's your car at? >> Over there. Can you want me? >> What kind of car is it? >> Is it Nissan Maxima? Can you want me? Is >> it a Nissan? >> Yes, sir. >> No. We're not going out there yet. Point to your car. Okay. >> What car is yours? All mine. >> So this kid looks like maybe a security for McDonald's. Maybe one of them security for this five below. One's maybe security for McDonald's. Maybe both of loss prevention for five below. >> Below is boss. >> Point to me. Which car belongs to you? >> I did not break any law. >> Point to me. Which one? >> You're being really unfair. No, you're the one who's not cooperating with us. >> How we doing this several times? >> Okay. >> And I asked you to take me back to Five Below so I can pay for my items. >> May I please >> I'll make this simple. Are you refusing to let me positively identify who you are? >> Because when you go shopping, do you give me your ID? >> Are you refusing to positive allow me to positively identify you? >> Do you give them your ID? >> No, we're not talking about that. Talk about me trying to identify. >> I'm be honest with you. I put cuffs on her like 10 minutes ago. Are you you're refusing to let allow me to identify you? Okay. Put these items down. >> Okay. >> You're going to jail. >> Put your hands behind your back. >> We're not going to break. >> You are not allowing me to positively identify who you are. >> Wait, wait, wait, wait, wait. >> I did not break the law, though. >> I did not break a law. >> Don't resist. You're going to catch another charge if you start resisting. >> Turn around. >> Done. I didn't break a law. I didn't break one leg. Did I break? >> He's already told you three times. >> But I didn't break the law. Officer, you >> did. [laughter] >> Folks, you didn't break the law. >> Supposedly, >> okay. Okay. I'll go to jail. The law did I break? I just want to know so I can never do it again. >> Bye, Charlie. 81. >> The law did I break? >> I've explained to you thousands of times. >> You didn't tell me. Yeah. >> Don't me 2015. I didn't even break the law went shopping. >> You want me to jail for go shopping? >> I told you I would take it back and pay for it. Let me pay for it. >> Too late. >> I want to go to jail for something I can pay for. >> She still doesn't understand. It's not even about that. It's about the fact that she didn't identify herself so that they could trespass her. >> But why am I going to jail? I've explained to you several times. >> I don't understand what I did. All of a sudden, please talk to me. I just don't understand what I did. I just want to do it again for my son, please. >> All right. >> Stand right here. >> What law did I break? >> You're not identifying yourself. >> I did. I didn't break. I didn't break the law. Stop. [screaming] I didn't break the law. I did was go shopping. >> All I did was go >> This kid may be an explorer. So, like somebody who's uh like a cadet program or something. >> Stop. I didn't break the law. >> I didn't break the law. >> Destiny, stand up. >> I did NOT BREAK A LAW. THERE WAS NO SHOPPING. Please stop. >> Stand up. >> Stop. That was wrong. I paid for it. I'll pay for it again. Let me pay for it. >> Here. Listen to me. Listen to me. >> I didn't break the law. >> Listen to me for a second. >> I didn't break. >> Listen to me for a second, Destiny. If you let me scan your fingerprint, I will not. Listen, listen, listen, listen. Stop interrupting me. >> If you let me scan your fingerprint, I can let you go. >> So, when you go shopping, scan your finger. >> If you let me scan your fingerprint, >> they scan yours when you go shopping. >> You're not understanding. >> Let me pay for it again. Just go with me. >> I didn't break no law. >> Please. Please arrest me. >> Break the law. I didn't break the law. I didn't break the law. I didn't go shopping. Please. Police arrest me. >> What did you What did you take today? >> She's definitely She's on. >> What did you drink? >> I was at the beach. It was 4th of July yesterday. >> Okay. What did you take any drugs today? >> No, I drank Hennessy. >> Cuz you got like some foamy spit coming out of your mouth. You got pinpoint pupils. >> What did you take today? >> I'm drunk. >> Okay. >> So, I'm going to jail cuz I'm drunk and I shopped and I paid. >> You know, it's you cuz you're not not identifying yourself or allow us to verify your identity. >> It is a law. >> What law is it? >> I just told you what it was. I don't text. Stop. You can't just keep bickering with her. Just put her in the car already. I know you don't want Look, we don't like do reports on these trivial little matters. We just wish that we the folks would just give your fingerprint. We'll trespass you. You can go on about your way. We can go on our way. She shouldn't be getting in a car and driving anywhere anyways. >> Number. But it's a law. Failing to to positively identify yourself or allowing law enforcement to identify you is a crime. If you let me scan your fingerprint, we're going to get it regardless. >> Can you take me off? Then I'll say >> comply and let me scan your fingerprint. >> Take me off and I'll do it. >> No, we're going to scan your fingerprint then I'll take the cuffs off. That's that's going to this is how this is going to work. >> Okay. You're either going to comply >> or you're going to go to jail. >> You don't drink? >> I do drink. That has nothing to do with this. I drank on my You want to relax? >> I think >> the fourth was not yesterday. Today's the 7th. Fourth was not >> on Monday. It's >> Monday. Today's Thursday. >> Thursday. >> I did not commit a crime. >> She doesn't even know what day it is. >> Let me go. I was shopping. I will pay for it again. >> Can't keep doing this. We can't keep doing this. Guys, let's go. I want to fast forward it just so that I don't have to listen to her anymore. >> I was just shopping. Listen, if you don't stop trying to pull away from us, >> I was shopping. I don't ever heard of somebody asking for ID for shopping. >> This has nothing to do with you shopping. >> But that's what I was doing. >> Get her in the car. >> Just let her down. I didn't like >> and have a seat. >> I'm going to jail for >> Have a seat. >> No. >> Sit down in the car. >> Take her to jail. >> Listen, bro. No. No. >> Apparently, you're resisting. So, >> I'm not resisting. I know. >> This is what you're doing. You're sitting down. You're pulling away from me. That's resisting. Sit in the car now. >> Sit. Swing your legs into the car now. >> I didn't do nothing while the car did. >> Jesus Christ. >> She was charged with giving a false name to Ao. >> That's it. All that and we just charged with giving a false name to Leo. They were very nice to her. They could have probably charged her with the the um the shoplifting, but Five Below was nice enough not to charge her. Um she bought it at Ross. We we clearly established that. But this could have been done with away with in like two minutes. When I'm in another establishment, I would try to deal with that quickly so that we don't disturb the the business. we don't disturb the McDonald's any longer than you have to get her out. Get her to your car. Do something. Um, but in the end, these guys were super patient with her and nice and she didn't ID herself. So, she got charged with failure to ID herself for providing a false name to law enforcement. So, let me know what you think. How did it go? What would you have done in this situation?
