All right, if you would go and step out of the vehicle, and make sure you're not under the influence, and we'll have you on your way, all right? I'm not allowed to. You're not allowed to? What do you mean? Why aren't you allowed to? I'm not allowed to at this point. All right, everybody, welcome back. We got another video for you. This one comes from Crime Scrutiny. First time we're doing one of theirs. Lawyer's daughter refused to get out in a DUI stop. Haven't seen it. Let's go. It's a little on the short end. It's triggering trauma child. I'm sorry to hear that. Why would this trigger that? I haven't seen him for a while. This is not triggering it, but I'm trying to get to my boyfriend's house. How many times have we talked about when people say, "I just want to go home." or "I'm just trying to get to my boyfriend's house."? It's all It's typically a sign there's something else, probably some in intoxication. Six beers. So, you haven't had anything to drink? >> No. All right, if you would go and step out of the vehicle, and make sure you're not under the influence, and we'll have you on your way, all right? I'm not allowed to. You're not allowed to? What do you mean? Why aren't you allowed to? I'm not allowed to at this point. My dad's a lawyer. Your dad's a lawyer? And I'm not allowed to. >> Okay, well, even as a lawyer, he would tell you if you're ordered out of a vehicle that you should come that you have to comply. Yeah, cuz he's told me otherwise. Pennsylvania v. Mims says if they are if you're ordered out of the vehicle, you got to get out of the vehicle. No, he wouldn't. If he told you that, that's bad lawyering on his part. He wouldn't tell you that that you don't have to come out if you're told to? I don't know what he is. He's a piece of [ __ ] so. That's what it sounds like he would say, yeah. He's He's giving you bad information. So, if you would go and step out, if you're not under the influence, you'll be on your way. Okay. All right, so come on out. >> to, so. No, go ahead and step out. I'm not allowed. Explain to me why you're not allowed to. Or kill me. You know. He's not going to kill you. He would tell you if he was giving you sound legal advice, he'd tell you when you're ordered out of a vehicle to step out. Come on out. I'm not allowed to. Last chance. I'm not allowed to. All right, come on out. Go on out. Come on over here. Are you able to walk a straight line? You can see how intoxicated she is just by the way she looks. She's got that glossed over deer in a headlight look. So, you'll you'll notate that. I can't really see closely if her eyes are bloodshot. I'm sure there's an odor of alcohol coming from the vehicle. So, you've got that. Um now you got the field sobriety as well. Can you balance on one foot? Yes. All right. You're going to bring your feet together for me. You're going to follow the red light with your eyes only and you're going to keep your head still. Do you understand? Yes. Keep your head still. This is HGN, horizontal gaze nystagmus, and she looks like she's about ready to pull some type of little shenanigans right here. What's going on? Do we have to call fire rescue? I passed out. You passed what? I tried my best to do together with the ball. For what? >> [gasps] >> Society. I mean you'd start to hold them accountable and they break down and cry and >> [laughter] [gasps] [laughter] >> Yes. I said I don't have to trick. What happened? Hi, Ms. Gilbert. Let me explain something, all right? This this episode that you're having, while I understand that it might be genuine we still have an investigation to do. >> No, I don't have to just give me a kiss. The more you're exasperating I can smell the odor of an unknown alcoholic beverage coming off of your breath. So, we got we got something to do here. And if you got to go to the hospital, we can continue the investigation there. Ms. Gilbert, do you wish to do the exercises with me? What do you do in this situation? What would you do? She's just on the ground crying like this. This is a grown adult. Okay? Um supposedly. By age, yes. By behavior, entitlement, all that, no. All right. If you would come to your feet, please. I said I loved that the cops were not even playing into it. They didn't go down and go, "Oh, are you okay?" They said, "Do you need fire here? Do you need something? Or do you want to do these tests? Okay, let's keep going." You'll have to do the penlight test, all right? All right, the instructions are the same as before. Follow the red light with your eyes only and keep your head still. Now, place your right foot in front, heel touching toe. When I tell you to begin, I want you to take nine heel-to-toe steps. Take a series of small steps, turn around, and then take nine heel-to-toe steps back. Once you start, you don't stop. You keep your arms at your sides and you count your steps out loud. We respect your time, so we remove the small talk. Subscribe to Crime We like the small talk. Sometimes some of the best stuff is captured during the small talk. and Scrutiny for fast, no-nonsense body cam. Do you remember what you were instructed to do? Nine steps. Nine heel-to-toe steps and then I got to be honest with you. I've never really seen where they I mean, you don't see too often. I can't say I've never really seen it. Where they just stop in the middle of the nine heel-to-toe steps. We didn't put a line down. We would try to find a line, but we didn't put a line because it it makes them think that that's the end of where they need to turn around. Instead, um you just have them walk in a straight line because they might take 20 steps. And you let them do it cuz you notated it in the in the um FSTs. Then what? Then the turn around that I showed you and 9-hill to toe steps back. Even then, they put a piece of tape down and she still couldn't do it. >> can be the one leg stand, all right? You can go ahead and step off the line or you can just stand You can just stand right there, too. That's fine, too. You guys are over here to do whatever you have to do. We're still giving you a chance. What are you talking about? Shaking my head. I need I'm not shaking my head. Whenever you're ready, go ahead and bring your feet together just like mine are. >> I'm sorry. You're wasting our time. >> [snorts] >> Not wasting my time. I'm I'm on the clock. >> You caught me in the middle of The middle of what? You look back in your video footage. I told you that. No, you didn't tell me anything. I don't know what you're talking about. Do you wish to continue the exercises, ma'am? >> I just need to >> I don't understand what you're asking for help with. I need to deal with this. To deal with what? PTSD. To deal with PTSD? >> I just told you. You didn't tell me what was that. Well, I told you that. I would suggest that you see counseling for that, but during a DUI investigation isn't the time to to deal with it. This generation with their PTSD and anxiety, I mean, they had had a tough time in the '80s, that's for sure. But I was got during it. No, I'm saying >> look back at me and I told you all of Okay, and that's not what I said to you. I said I suggest you see counseling for that, but during a DUI investigation is not the time to deal with it. I told you to look back in your >> This This is a DUI investigation. Okay, I'm going to ask you one last time, Ms. Gilbert. >> in Do you wish to participate in standardized field sobriety exercises? Yes. I don't know why they're blurring out the other officer, the other cop. Maybe it's a gang and drug detective or something. >> All right. So, when you're ready, go ahead and stand up. >> [laughter] >> Okay. Okay. Stand up. Please come to your feet. I really like this guy. I really do. >> Your feet together, hands at your sides. This is going to be the one leg stand. When I tell you to begin and not before then, He's not playing the game. approximately 6 in off the ground. While you're doing that, you're going to keep both knees straight. You're going to look down at your raised foot and you're going to count out loud. 1,001, 1,002, and so on until I tell you to stop. Okay, just watch me. Just do exactly what I'm showing you. Both knees are straight, my toes are pointed out, my hands are on my sides, and I'm looking down at my foot. This is all you have to do for 30 seconds. Do you see what I'm doing, Ms. Gilbert? I'm not doing this. You're not doing it? All right. You're being placed under arrest for driving under the influence. Okay. And as well as um obstructing an officer. Yep. We got four cameras out here. Well, you didn't remember anything, so You didn't cooperate, so that's where we're at with that. What what Her saying that at the beginning and whatever your anxiety or your PTSD, what does that have to do with them processing her through an FST? Um so, she just feels like if she just says that, they should just go, "Oh, we're sorry. Go right ahead. Continue to drive under the influence to wherever you're going." That's not how it works. That's not how it works. This is called real life where consequence actions have consequences. That's what this is. That's what the world needs more of. All right, go and take a seat. According to court records, Anne was arrested on charges including driving under the influence and resisting an officer without violence. The case was later resolved through a guilty plea with the DUI charge dropped. The court withheld adjudication on reckless driving and resisting an officer without violence and sentenced her to 12 months of probation along with $746.50 in court costs, a $250 fine, and a $250 donation. Okay, so that's pretty standard, okay? Uh I know you're probably thinking that she didn't go to jail or anything. And what they did is they withheld it. So, as long as she completes all those things, it'll fall off her record is basically what they're saying, which is the reckless driving. And so, she's got the 12 months probate or probation. Um, she's got a bunch of the other stuff, the fines. If she completes all that, then it goes away. I'm not a total I'm not against that. Um, I believe if you if they you pay your price, then there should be some day of redemption for you. And uh hopefully she learns a lesson and doesn't do it again. Um, but yeah, she uh she was hoping that I think that if she just claimed that she had PTSD or anxiety that the cops were going to go, "Oh, we're just so sorry. You should go on your way." I like this guy. He was just saying he was very empathetic or he was not empathetic. He was understanding of that, but at the same time, we're still going to deal with what we got going on right now, which is a DUI investigation, and we need you to complete these FSTs. Ultimately, she plead plead pled guilty. So, let me know what you think. What How did they handle this? How would you have handled this kind of behavior there? Comment, like, subscribe. We'll catch you on the next video.
