In the middle of a seemingly peaceful afternoon, a small camera shook the entire building. I don't think I need to just speak with them really about anything. Mr. Eddie, you cannot take picture anything. Why Why [music] is that, sir? What you should say is per the law, like you did, there's nothing we can do. A seemingly innocent question, a seemingly unintentional action, opens up a heated debate about power and law. He was like, "No, he didn't go past anything. He was cool. He was fine." So Yeah. Oh, I do need your name and badge number, actually. When reason meets power and everyone argues over the obvious. You can do that without permission. Well, who would I need Oh, that's why I'm asking who am I you representing? Are you representing the company >> or the building? It's our liability. Well, I'm just I'm just taking No, it's my job. Manager coming down. So, talk with them. I don't need permission. [music] I have permission already. The law says >> So, that's why I ask you. You wait some Let me ask you your manager. Oh, go ahead. Ask him. >> [laughter] >> I don't I don't need to ask anybody. In the middle of the building's lobby, a heated argument was taking place. Each word was like a hammer blow to the already tense atmosphere, but the most surprising thing [music] was yet to come. Are you from Wareham? Wareham Properties? Oh, no. I guess his concern is like, do you have permission to take pictures? That's what he was asking you. Oh, I mean, I I haven't asked anybody permission, but I it shouldn't be a problem. Are you here to take the picture for some purpose? Yeah, for Yeah, for my for for my purposes, yeah. Not for you guys or something you guys are doing. So, for my purposes, yeah. My question is, are you going to do something [music] to the cameras? That's why you're taking the pictures to take it back to the office? >> No. No, no, I'm just taking pictures. I'm taking pictures and video of the of the office, the lobby, and everything else. I don't think so you can do that without permission. Well, who would I need permission from? Um the management, the state building. Yeah, so it's So, oh, that's why I'm asking who am I you representing? Are you representing the company >> I'm just by myself. I'm I'm I'm doing a story, but I'm just by myself. Uh no, I mean, not exactly, no. No. Yeah, I didn't think so. Without permission, you can That's why he's concerned was in How did you enter the building? I opened the door. It's open. People come in here, right? To do business. >> Um but yeah, but you have to sign. Yeah, you have to because you are in the building. It's our liability. We want to know who's in the building. I know, but we don't have to do that. That's what I'm saying. Nobody asked [music] me to sign in. As in in the visitor log, can you please sign in? Yeah, no, I don't I don't typically sign in. I don't have to. I don't give my information. We We ask all our visitors to sign in this sheet so that we know who came [music] in and who came out. Right, you asked them to, right? And so, some people do. So, we need to know who is in the building. Say something [music] happens, we are having liability. Right. Yeah, I disagree. I think you guys want to know. >> I Every time I talk to you, you interrupt me. I don't interrupt you. >> Sorry, I'm trying to tell you that you cannot take picture without any The sound [music] of boots echoed. The silhouette of the police appeared. Everyone held their breath, waiting for the verdict, but just one sentence [music] made the whole building stunned. criticism when you tell public employees, when you don't really know the situation or what's going on or the individual Yeah. that hey, they're they're just trying to get a confrontation. What you should say is per the law, like you did, there's nothing we can do. Yeah. You know, you guys should just do your job, be professional, and then there won't be a response, right? What's up? What are you doing? Did it did Right. And Sure. trying to get a response. No, I get you. But I would just looked around. I tell them, "Man, I'm just doing a story, taking pictures." I like to talk to you guys about that cuz we're trying to change that a little bit. >> you. So, what I was trying to do, and I wasn't trying to be a jerk to you either, was so that way I have all the information armed in my back pocket with like, "Okay, here's where we're at. Do your thing." Right? This is birthday. We We are used to it. We don't So, it's like make sure you get my good side. Having said that, I wanted to find out how far it had gone. And he was like, "No, he didn't go past anything. He was cool. He was fine." Yeah, where I can legally go. And I told him that you could do that. They wanted me to let you know they do close at 5:00. I know. I mean, I do my research. Anything I can do for you though? Yeah, that's it, man. I just Oh, I do need your name and badge number, actually. Duh duh duh duh Sirletti. C E R L E T T I. And I am 144, which is 12 * 12, man. >> [laughter] >> I wish Appreciate you. Take care. When the door closed, a name, a number, a promise to return. After all, what remained was not just an image, but a question that no one dared to answer. By the way, I wanted to introduce myself. My name is James. >> Uh I don't shake hands, but I can give you a fist bump if you want. So, whenever you guys are ready to do the public records request, I'd be awesome. Not I don't got much time left, so Oh, that's I know what car you drive, by the way. What's that? I know what car you drive, by the way. It's It's okay about what car [laughter] I drive, but I would No, no. I'm so proud of the work that we do here for the [music] community. Stand, I won't take it. I don't need it. I just want to do a public records request at this point. Okay. Let me get someone to help you with that. Okay. I'll be right back. So, um he's this dude. I don't like when people do that. He's trying He's trying to be as professional as he can, but he's also putting on a front, right? Trying to clean up what his other coworkers just did. And like, that's not the way it works, right? So, not okay. But um we're not going to let him do that. So, I'm in 215. And this is run run run. And uh obviously and uh probably a month in two or three weeks, we'll hop back over here and check everything out again. Who's going to do the records request? Okay. Uh if you want to wait here, I'll go get someone to help you. Okay. Would you like to I'll chill here. >> about what we do to help the community? Amazing. The group of scientists here with their whole heart. I've never worked in a place like this, but with their whole heart, they really go out of the way to protect the community from the toxics in the dirt and in the in the soil and the I don't know what you think. It would have been dope like if you would have came out at first. And then like we would have It would have been super cool, you know? I'm glad to be here now. I'll be right back. I appreciate you. Thank you. I'll wait here for you. Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS 1983. Individuals/organizations are required to pay damages to the injured party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/police chief. There was no ban or enforcement. The police confirmed that the principle [music] was clear. People had the right to record in public areas of the building as long as they did not enter restricted areas. Up next, an ordinary [music] citizen is confronted by armed guards, hands firmly on their guns, but the story takes an unexpected turn. Can you take your hand off your weapon, please? I'm on my weapon. Can you put >> Am I a threat? No, but I'm concerned with your Wait, this officer right here also said that most people are not under the understanding that this is actually their property line. A guard with his hand on his weapon, facing an unarmed civilian, a request for identity, a flat refusal, and a vague red line about to reveal a secret that made everyone hold their breath. Good deal. Can I ask you what you're doing? Yeah, you want to get your hand off your weapon, please? Uh I don't know if I'm authorized to be You can get your hand off your weapon though. Can we talk to you? Can you take your hand off your weapon, please? I'm on my weapon. Can you put your hand off your weapon, please? And what do I have to tell you? I don't feel safe around you with your hand on your weapon. Can you what? Can I ask you why you're here? It's quite obvious, isn't it? Get your hand off your weapon, dude. What's the badge you have on? Are you affiliated with the base Yeah, well, I don't feel very comfortable with your hand on your weapon. Am Am I a threat? No, but I'm concerned with your well-being. Wait for the truck cuz I can't I have I'm very hard of hearing. Why do I care? Why do you put your line so close to the road if people are allowed to walk in back and forth? I don't You don't line. You don't control this line? I don't have to control I understand that. I totally understand that. I'm taking pictures, I'm taking videos. I'm minding my business and you should probably do the same. And just observe and report and that's it. Okay, but now you've left their property and you're trespassing. No, I get I was given a warning, okay? I see the warning right there. I did not know about this demarcation line and he even said that most people don't. >> When the lieutenant appears, questions about authority, [music] power, and a hidden invitation make the situation tense to the point of suffocation. What's going on? Just taking pictures and video from a public easement. Okay. That's it. All right. They're getting their panties in a bunch. >> Were you on the property? Did you cross the red line or anything? I'm not going to answer that question. Can I have your name and badge number? Yep, I'm Officer Nelson, badge number 110. >> Okay, are you recording? I am recording. Like I said, I'm Officer Nelson, New Boston Police. Yeah. My body cam is recording. Cool. I got a call because, you know, had someone called in said you were recording. Yeah. So Well, I mean, it says no photos or video allowed. >> on a public road? Well, I think I think they under Yeah, yeah. Yeah. And those signs right there, they all say warning you know, federal property. Right? To not go past that. Yeah, as long as you're not on their property. The only thing I had a concern with that I did speak with them, maybe they can kind of help fix it and this officer right here also said that most people are not under the understanding that this is actually their property line. Look at this nice big red line right Yeah, that doesn't say anything about no trespassing. I understand where that confusion may be. Yeah, 100%. Yeah, but, you know, he did tell me, he's like, "Look, I don't care what you're doing as long as you be on that red line." I said, "Why, what's a red line?" He's like, >> Let me as long as you're not over the shred line, Nope. you're technically not on their property. I have no intention of going past this red line after being advised. Okay. You mind if I just ask what you're recording? You just It's a cool place. Yeah. I wouldn't advise going past the red line, though. I wouldn't either at this point. I wouldn't advise anybody to go past this red line. So I just wish that it said something other than maybe they could paint no trespassing. You know what I mean? Yeah, they don't I don't know who would who would go about that, but >> No. It looks like this guy's in charge, but he's a real I don't know. Well, I don't know them personally, and so like they said that if you step over the red line, that's technically their property, okay? Yeah. Cuz this is their parking lot. Yep, I've already been advised I've already been advised you have no jurisdiction You have no jurisdiction on it. I'm a law enforcement officer who they called in. >> have no jurisdiction on this property right now, so you should probably get back over the red line. Okay. No, not by law. Amidst the wind [music] whistling through barbed wire a battle of wits ensues. Ambiguous [music] signage challenge liberties and demands for transparency that bring the entire [music] system to a standstill. tell you that my only concern is the simple fact that it's deterring people from taking pictures even from a public easement public standpoint by saying no photos are video allowed. And then the other concern really, to be honest, it and I think it's dangerous literally dangerous grounds to play on is that this should at least be posted say no trespassing 50 [music] times all the way across. I I At least it would stand out a little bit more and tell me. So there's You know what I mean? And that's to protect your property well you is to protect your property. And I'm willing to give you my point of view on that regarding the property line post it, no trespassing. Put a sign right at the end there, put a sign right at the end there. And then it tells you that beyond [music] that sign and beyond that sign at the red lines, you know what I mean? The warnings over there. But I other than that, I would never know. The line we don't use the line as a stand alone thing. So if somebody were to pull in here, like I said, we've had people pull in and, you know, they get out and take a picture and Yep, yep. and they say to me, "Look, you really can't be here. This is their property." And they they think they can And that's exactly what I did with this gentleman when he told me about the red line I said, "No problem." You know, there needs to be a have that dialogue and that exchange, that conversation. >> Agreed. It can't just be like the hammer drops immediately, right? But once there's a concern, then then that might change. He's dismissing you. Why are you guys so afraid of a camera? Something you guys are doing back there that I should know about? Amid all the onlookers, the patrol cars quietly backed away. A tense drive of shame ended. >> [music] >> There was no arrest warrant and the camera man was not detained for being on public land. Waste of time. Now I Now I got to walk in the road because you parked like Now you all forced me cuz I got to go down that way. No, I don't think I will. I think you're putting my safety in uh No, I can't. That's on federal property. Are you serious? You're a real [ __ ] piece of It's always the bald ones, huh? Yeah, [ __ ] you. Talk like a next time. LT, you're dismissed. Goodbye. See you later, bud. Have a good one. Hey, your feelings enforcement officers are now going bye-bye. All set here, yeah? All set, yeah? Can't No, we can't do anything about it? Uh Look like a bunch of Yeah. A democracy is only truly strong when both the people and the government respect [music] the law, transparency, and civilized dialogue. Hey everyone, what do you think about this situation? If you enjoyed the video, don't forget to like, subscribe, and support us with a donation. Thank you so much. Next, a man is just sitting in his car when suddenly the police approach him without explanation. Who are they looking for or is it simply a setup? reason and plate like this, expect a lawsuit. What's hilarious about this is you can't even see inside this car. >> When you drove You can't even see inside this car, sir. So please It's okay. And I And I got a I got a letter from my doctor from the VA for that, too. Because it says it's a No license plate, [music] no dangerous behavior, yet this traffic stop was conducted as if it were an arrest of a high-level criminal. Doesn't have a proper form. I don't care. I'm not saying anything about the I was not talking on the phone. You can't even see inside the car. The police shouldn't say that. And I got three or four cameras in this car. Okay. Running at all times. >> well, if you don't mind, just hang outside your car, hang outside your car and I'll be back. Sir, we'll bring you a service for you then. I'm not answering your question. Okay. There's no reason for the stop. It's not a valid stop. You know you know it's not a valid stop. I'm sure you're a great guy, but just too many cops that don't They don't do what they should do. Like I get it, you guys are pressured by your police chief. You don't want to tell your police chief. Disciplinary records were requested, but the response from City Hall added to the mystery. Will the truth come out or continue to be buried in silence? Civilian complaint against a police employee? So, I'm going to give you a pen here. You know what? Can I I'm going to fill this out. Can you give me your email or internal affairs email and I can email it over? This is the supervisor's office here. It said she [music] worked for the supervisor. Hi, ma'am. How are you? Um can Can I speak to a supervisor here? Somebody in charge. Regarding a complaint. Regarding um I don't know her name. I would go as far as saying unhinged, you know, yelling at me, had had a police officer try and take my camera from me. I have freedom of press. And I She just said you can't film in here without a permit. Do you have $5,000? You know, just escalated situation. I'm an independent journalist exercising my freedom of press right. I don't [music] need a permit, which I tried to explain to her. But again, her behavior and the way she conducted herself was completely out of line. Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS 1983. Individuals {slash} organizations are required to pay damages to the injured party. Violating police officers may be disciplined, [music] have their licenses suspended, fired, or expelled depending on the policy of the agency {slash} police chief. The case shows that a lack of transparency and accountability can lead to loss of public trust and the risk of litigation. Up next, a CHP camera outside the gate, and then things escalated into a tense confrontation between citizens [music] and law enforcement. I never said I could be inside. I said I could be by the gate. So Yeah, it is there. It's there. I know cuz all you guys are the same. CHP What time am I being detained for? I have I have been the whole time. The detention order was suddenly issued, but when the citizen asked for the legal reason, the police's answer left everyone stunned. Is that right? What am I being detained for? We need to violate the gate. No, we didn't. That's why we're going to check the video. You can leave afterwards if you didn't. I can leave after I did it. What What reasonable suspicion do you have on Another officer, what? Saw you. Saw me outside of the gate? Inside the gate. There's nobody that saw me inside the gate. How do you know? I know because I wasn't inside the gate. Okay. Okay. You guys have Well, why are you standing up on the corner by the punch box, sir? I never said I could be inside. I said that. I said I could be by the gate. So whatever, man. I need the name who said it? Well, so what's your purpose just hanging out on this by our office? None of your business. You have a name and ID? What's that? You have a name? Of course I have a name. You have a driver's license number? May I have it, please? Why? So we can know what you're who you are and if you have any issues with law enforcement, why you're hanging around our office and refusing to comply. How have I refused to comply? You won't ID yourself. Yeah, you asked me to ID and how is how is getting my name and driver's license number going to help you know if I'm what I'm doing here and whatever you just said. >> Police identities, [music] procedures, and even harsh words began to appear. Everything seemed to be getting out of control. >> What's your name and badge number? You're asking me politely and you're asking me to change it. Yeah, well he won't say the question. What's your name and badge number? You You won't answer it. You won't answer it. Answer the question. What's your name and badge number? Name and badge number? My name's right here. Your name's right here? You guys got a lot of cousins, man, and uncles and [ __ ] A lot of people named right here that work at law enforcement. So, you know that, right? I don't. Yeah, it is there. It's there. I know cuz all you guys are the same. CHP. What's your name and badge number? Teach these younger guys, huh, how to do that. Want to try again? Maybe follow the the lead of your co-worker there? I'm off in the morning. You ain't getting [ __ ] I need your name and badge number for our documentation purposes. [music] I'm looking at the video right now. It doesn't matter. I need your name and I'm Me asking I said the same thing. I said name and badge number. Name and badge number. Name and badge number. Name and badge number. I'm being rude because you're refusing to follow your protocol. What is the protocol? You're refusing. Yes, it is. California Highway Patrol have to identify Were you in the back Were you in the gate? I'm not going to talk to you till I get your name and badge number. It's real simple. >> tell you what. When if if you if the video shows you weren't in our parking lot illegally, you can go. A minor inspection [music] turns into a controversial detention. Is this the ultimate limit of power or evidence of an act beyond the law? And what crime am I being detained for? Can I ask? That should be simple, right? Crime I'm being detained for? Am I being detained still? Am I being detained? You're the supervisor, right? You're sergeant. Am I being detained? Okay. And what crime am I being detained for? State. What crime am I being detained for? I I have been the whole time. You just interrupted me, so I'm not I'm not [laughter] having a conversation. Baby, you're a cop. You need a little thicker skin, man. Get thickening it up. Didn't you do anything before you were a cop? You can't just tell me I'm being detained. And stop calling me names. What am I being detained for? I'm not You guys are [music] used to that stuff. I'm not baiting. Jesus Christ. What am I being detained for? What am I being detained for? by the gate, did you notice that sign that's [music] on the gate right there? What What is it What What sign? >> authorized personnel only. Yeah, for sure. I know. It's trespassing? Yes, sir. Okay. So, you guys have to have per 6020 of of the penal code. 6020 is trespassing, buddy. Go look it up. I know it better than you do. So, you guys are now detaining me for being outside of a gate. And that's illegal. [music] You guys cannot do that. Right now, you have no signs up. Has to be a no trespassing sign up. Ultimately, citizens demanded all records, recordings, and internal communications, but what was revealed next was truly shocking. The incident [music] exposed gaps in CHP training and procedures, lack of transparency, [music] detention of citizens without clear grounds, failure to adhere to reasonable detention guidelines, and police identification regulations. Violation I need some information about a stop you guys just did with me that I asked the officers for and then they just dispersed. They dispersed? They just walked away. Yeah, and I need the information and I need the officer's name and badge number so that we can file paperwork and also need to know if that was on a personal line or a recorded dispatch line so I can get a copy of that call as well because the key is next to a gate and behind a gate is a huge difference, right? That's the way that works. And if they said I was by it and you just detained me for 30 minutes, you just up cuz you illegally detained me. So, it's one of those. It's one of them. Which Oh, it was one of them was more. Okay. So, you're looking for the names and what else? I need the officer who who called and I need to know what he said. I need his name and badge number. Was it on a personal line or a recorded line and what exactly did he say? Cuz we're making a false claim and he's an officer, he can't do that. Or you're going to admit that you guys illegally detained me. So, it's one or the other. Has to happen. What what team are you talking about here? What was that? Your team. You said your team. Yeah, I have a I have a team. Well, I was just I was literally here for two I was I wasn't here in the first place. I was just getting a couple cool pictures for this paper that we're doing. Okay. That's it. >> What about? What's that? >> What What's your paper about? >> Why? I mean, you're taking pictures of us. I was taking pictures of a couple cars. That's all I was just taking pictures of the cars and I was on my way. I was literally walking away. I was not like I was standing out here for an hour, you know, or something doing surveillance on you guys or some crazy [ __ ] And instead I got detained for 20 minutes and tried to explain I was just by a gate. I was by a gate. They said no, you we got told you were inside of it. So, that's what I'm saying. >> Right. That is what we had gotten told and we just Every abuse of power, no matter how small, is a reminder that justice must be constantly monitored so that no one is above the law. Hey everyone, what do you think about this situation? If you enjoyed the video, don't forget to like, subscribe, and support us with a donation. Thank you so much. Hands off me, dude. What's wrong with you? >> 56, I'm uh I'm being attacked. Body cam on? It sure is. And you got yourself pushing me? A seemingly simple encounter between police and a driver suddenly turns into a tense drama. On April 28th, 2024, when a police stop for suspected dangerous driving turns into a heated argument, what happens when the line between power and citizenship is broken? Can I help you? No? Can I help you? Yeah. You was swerving. Get back in your vehicle. Hands off me, dude. I'm uh being attacked by one. That's what I need. Get on the ground now or you're going to get tased. Get on the ground or you're going to get tased. Get on the ground or you're going to get tased. GET DOWN ON THE GROUND or you're going to get tased. Put your hands behind your back. You just attacked me, fool. And it's on camera. >> Okay. You just attacked me. 56, give me the air, please. I got him prone out at taser point right by subway. Dude, you pushed me. No, you do not get out of your car. You do not follow a police officer. Are we understood? You do not get to do that. You do not get out of your car. I do not know you. I do not know if you're aggressive. Now, exercise your right to remain silent. I thought you were drunk. Are you kidding me? Dude, you just You cut over lanes without even blink or using your signal. >> 56, I'm code four. He's compliant. I got him at taser point. You are not going to follow me. You're not going to step out of your vehicle. Okay? I do not know you. I do not know if you have a weapon. You're right. You put your hands on me, though. Yeah. Well, I'm a police officer. You do not approach a police officer in an aggressive manner. You could have told me to step back and I would have. Yeah. Well, you've made your decisions today. You've made your decisions today. You got your body cam on? It sure is. And you got yourself pushing me? Yeah. Code four. 82 with one. Use force taser display, but we'll get that later. Yeah, what was your probable cause for putting hands on me? Uh you were following me and you stepped out of your car in an aggressive manner towards me. You are not going to advance on a police officer. That is a threat. You made towards you. You put your hands on me. Uh I I told you to back up. >> not. You put your hands on me. >> on you. Yes, I did. You pushed me back. Okay, whatever. You had no reason to put your hands on me. You had no lawful authority to put your A confrontation between a police officer and a citizen that was supposed to be a traffic check ended up with [music] both facing harsh accusations and unanswerable denunciations. It was defending myself once you attacked me. No, sir. I don't have anything illegal on me. I asked you if there's anything that's going to No, sir. I don't have anything that's going to be dangerous to you or that is illegal. I'm in no way a threat to you or anyone else. There I've got my headphones on. Yep. Absolutely. Who was the one that just hit his head? Was that you? Yeah. You okay? I'm good. Uh also, uh I'm heading westbound on 41 here. And this guy's like doing weird things to like avoid me getting his license plate. So, I pull over. He goes to the right lane. And then he starts following me. He's like, "Are you drunk?" He's He's out of his car and I'm like, "No, don't get out of your car." And it was on. When words are no longer enough, force and authority are put to the test. But is it a last resort or an unacceptable abuse of power? It's funny you think that you can just punch somebody for no reason. You put yourself in that situation. >> No, sir. >> never touched you. We'll agree to disagree. If you don't like it, go to court. >> You can go to court if you want to. You put your hands on me. You assaulted me. I did nothing but defend myself. Okay there. I can't I could have, but I didn't. Whatever you say. What do I Yeah, buddy. Look up the code, man. You don't have to agree with me. Just after you drop me off. That's what I'm saying to you. You don't have to agree with me. No matter how many ways you turn this, you're in the wrong, sir. >> Yeah, whatever you say, man. All I'm saying is look up the code after you drop me off. You cannot just walk up to a civilian who has not committed a crime and touch them. You have no lawful authority. You realize I didn't walk up to you. Got out of your car and advanced on me, right? You walked up to my car. You You do not get to step out of a car unless a law enforcement officer commands you. Okay, Russell. We're going to agree to disagree. It's not agree to disagree. You're full of [ __ ] Okay. That's That's your opinion. >> enforcer, dude, and you don't even know the law? You think you can just touch people? Clearly, you know all about the law. This That's your rap sheet, brother. Yeah. And with how old it is From a simple situation, a debate exploded with accusations and tense actions, causing both the participants and viewers to ask the question, who is right, who is wrong? You guys like to play games and not hand them out. Why are you so angry? Dude, look how you treated me. I got out of the car. You put your hands on me. I did the same thing to you, and then you throw me on the ground and act like I did something wrong. You're just terrified, dude. You're a scared little [ __ ] Seriously, you got You put your hands on me, and then I touch you back, and oh my god, he touched me. Get on the ground. You realize how ridiculous that is, right? You act your age, dude. You're supposed to be a cop. What is wrong with you? What's wrong with you? You put your hands on a citizen without a legal right. You understand that, right? Yeah, whatever you say. Don't be mad at me cuz you lost the argument. >> idiot. Apparently, it's legal for cops to touch anyone they want. That's for no reason. Sit down after. Wherever you want. Citizens are restrained, subject to arrest or fines. Police actions that show signs of abuse of power, provocation, or lack of transparency in their actions [music] may result in internal investigations or legal complaints. A seemingly harmless policy suddenly became the spark that ignited a tense confrontation between citizens and security forces. Sir, I can film government employees in the course of their duties. If you're preventing me from doing that, that's a violation of my civil rights, sir. When people ask for transparency, the answer is silence and confusing head shakes from the government. What are they hiding? I don't know who you are, sir. You need to sign in to You're You're the one confronting me, ma'am. No, with all due respect. >> you to come downstairs and comply with me. I walked I walked into a publicly accessible building, ma'am. I'm not going to I'm not going to go and and and jump through your hoops. Just I I walked in. No one told me to sign in. No one This is a public building. Yes, and and there's I have a right to be here. >> you should sign in downstairs. There's a rule? I'm just asking you to come downstairs and sign in. >> No, ma'am I'm not going to go downstairs and sign in. No, I'm not going to do that because that that's me giving up my personal information. Now, you don't. Hey, how are you doing? All right. Uh thank you for signing in downstairs with me. Yeah, you never told me to sign in, though. Perhaps the mess I did, but perhaps the mess but you got to sign in. I'm not sure if this is a law, but Yeah. with me you got to sign in, though. Yeah, you can you can put on You can put down uh No, no. I can't write anything for you. You have to sign in. No, I'm not going to give up my rights and sign away my I'm signing a name. Yeah. It's not to stop you from doing anything. Just with me and you know, got to sign in. Okay. You didn't You didn't tell me that, though. Uh perhaps. Okay. So, let me let me finish up with my business here really quick, and then I'll I'll get down there. No, I got to go with you so you could sign in then you can I mean, you can follow you can follow me everywhere you want, yeah. >> No, no, no. I'm not stopping you. I don't know if this is a law or not. Yeah. What I'm saying is you better sign in with me. Yeah. Then you do what you got to do. But I'm already in the building. So, what is it I I could I could easily take care of that when I go back downstairs. No. Yeah, I can easily take care of that when I go back downstairs. You signing out, but if you're here you got to sign in. If you're in the building, that's the policy. It's downstairs too to sign in. And this is I'm trying to get the policies. I want to just con- confirm what you're saying. Yeah, I'm I'm trying to talk to somebody here, and then I want to go to the city manager's office. Police escalate. Threats of arrest over a camera? Can policy be above the Constitution? I will sign in. I don't want you guys uh blocking me in here. Can I get Can I get your name and badge number, officer? >> literally looking right at my name and badge. Well, I would like you to identify yourself. That's all. >> Would you please go sign in, please? Hi, how are you? How are you? Good. Good. >> Would you just go sign in, please, and then you can go about all your business? So, I don't have to give up I don't Wait, I'm not going to give up any of my my identifi- I'm not giving you my license or anything like that. So, just so we're clear before I go downstairs. >> and sign in. What are the What are the pro- What are the procedures for signing in? We'll discuss this downstairs. Why can't I just know the procedures? I'm going to go sign in, Okay. but I'm not going to give you my my license or anything. Just so we're clear, okay? Okay, great. Whatever you decide. Great. Hi, can I get your name and badge number? Officer O'Connor, 230. How about you, officer? Officer O'Connor, 289. Great. As citizens search for the truth, the FOIA process is mentioned, but will justice come before the city gates close? Does it seem like there's anybody who can help me, Lieutenant? How about you do Can you help me find somebody to to help me conduct my business? >> told me what business you need to conduct. >> I need to speak with somebody at the city manager's office, which you've kindly enough pointed out to me. And now that I'm in the city manager's office, there is no one here to speak to. And you as you just stated, the building doesn't close for another 24 minutes. That there is no one here. >> Sir, I can try and put you to the right person. I I just want to speak to somebody. There you go. You need to ring your bell. Oh. >> know anyone was here. Oh, great great great. Hi, how are you? Can I get your name now? Now that I'm >> is John McNally. I'm the director of public relations. Director of public relations. Oh, that's great, you know. Fantastic. >> your name? Uh no, I'm not going to give it. You can check the sign-in sheet downstairs that I that I signed in now. But um So, yeah. I just wanted to know there I want to see the policy for requiring somebody to sign in to your to the city hall because the the officers couldn't supply me with that policy. >> Sure. You can just FOIA it. Oh, you want me to do a Freedom of Information Act? Sure. That's So, I would do that with the city clerk. So, it's well you it's city clerk. >> you want me to head it to you? >> I probably be able to do that on the spot with you. Excuse me? He's probably not going to be able to do that on the spot with you. A FOIA request? Correct. Why wouldn't he be able to do it on the spot? A FOIA request is 5 days for the city to acknowledge it. No, no. I understand that, but I'm talking about submitting submitting the FOIA request. >> You can do that or you can email it. >> Today, correct. Yeah, okay. So, I'm going to do that. You know email address is FOIA at longbeach.gov. Okay. And And And my other question to you would be is that what So, [snorts] is that policy been I I I know you're not going to show me the policy, but that is in fact the case that it's the policy here of this building? >> You have to FOIA that to see what the policy is. Oh, okay. So, you don't know any of the policies here as the media relations person? The formal complaint has been filed. Will this spark a groundbreaking investigation or lead to familiar silence? So, what is it you asked me to come here so that you could file a complaint? So, I My My complaint is that your policy here, Lieutenant, is unconstitutional. That's my complaint. >> That the complaint is about the policy being unconstitutional. Correct. And being threatened to be arrested by not only now Sergeant Alexander, but but yourself for trespassing. Trespassing doesn't say anything about filming in public, sir. You would be using that crime of trespassing I have every right to be in that lobby. Can we agree on that? You can certainly go into the lobby. You can't record in the So, if I record in the lobby, I'll be charged with trespass criminal trespassing. And that that is that and that is my complaint. And that would be my complaint with the police department, sir. Okay. So, Get You know, do you have a chief? The sergeant the sergeant for now informing you of the policy I'm I'm not sure what the complaint I my my complaint is against the policy in its totality. >> Okay. So, the complaint is not about the officer. The complaint is about the policy. >> The policy, correct. And he should know better to enforce a policy. He's law enforcement. He's not policy enforcement. He's law enforcement, just like yourself, sir. I told you this at city hall. There's laws that you enforce, and that's it. That's your job. You took an oath to the Constitution of the United States to uphold the Constitution. Thank you for letting me know. >> You should take that oath very seriously, and that oath and that Constitution says that I'm allowed to film I'm allowed to redress my government. Film The Supreme Court has said that I can film government employees in the course of their duties out of a Not the Supreme Court. It's a district court, federal district court. It's case law, Turner v. Driver. I can film government employees in the course of their duties. If you're preventing me from doing that, that's a violation of my civil rights, sir. And you're And you're you're doing that by that policy is is exactly what it's doing. What do you have to hide in there? What is What is Can you tell me the reason behind the policy, Lieutenant? I could. There are people that discuss private matters in there. They would have their own personal matters to discuss with the desk officer, which is why the policy is in place. So, to protect people's privacy in public? Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS 1983. Individuals {slash} organizations are required to pay damages to the injured party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency {slash} police chief. Police risk being sued for violating constitutional rights, being subject to internal investigations, losing public credibility, and being forced to change policies legally. Up next, just one camera and immediately security and police appeared. What made the whole force act so urgently? Excuse me. Can you stop? I can, but I don't want to. Am I being detained? >> Yes. For what crime? What crime? What crime? What crime? What crime? What crime? And this is a this is the second call that we've gotten from What crime? What crime am I being detained for? Taking pictures is causing a disturbance? How? How? I'm asking the questions, not you. How? How I'm asking the questions. How? How is How is taking pictures How? How? How? What crime do you have? I record for me. They even got the wrong name. >> [laughter] >> What What crime? I'm asking you a question. >> I don't care. I'm asking you questions. What crime? >> The The crime is 415. What How How is taking pictures a 415? How is taking pictures a 415? Like I said >> How is taking pictures a 415? How is taking pictures a 415? No. No, no. Look up 148G and learn the law. Taking picture cannot be a disturbance, suspicious, a detainment at all. Well, good luck with it. Good luck. Good luck. Over crossing the line, no disturbance, yet citizens are threatened with arrest. What policy is behind this controversial decision? Is your body cam on? I'm asking you questions, though. Is your body cam on? I am. I do not. Detainment don't need I mean I need to On top of that, this isn't a legal detainment. This isn't a legal detainment. It is because 148G says I can take pictures from public areas. I was in a public area taking pictures, so. >> [laughter] >> Oh, boy. This is Oakland PA. This is the second one. And again, it seems like she feels like she has a little I am recording. I know. >> [music] >> It's been fine. It's been fine even taking pictures from where I was taking pictures at, so. It doesn't matter. It don't matter. It don't matter. And I did I go past the guard? Did I go past the gates? So, that means I'm on public property. Public property. Public Go ahead, but that's not a 415. They called you for what? Taking pictures? Did they call for taking pictures? It's not private. We got ignorant Baker back. Okay, well. What's your name? Cool. Badge number? Nice. Okay. Cool. What's your name? A heated confrontation broke out when citizens cited the law right in front of the police. Was the truth distorted to cover up wrongdoing? Let's go ahead and pull up 602 of the California Penal Code. >> Go ahead. And And let's see where it describes either lawful business I know 602 like the back of my hand. It's not 602. Let's pull up Hold on. Let's pull up United States Supreme Court cases that this has been tested time and time again. Many of them. This has been tested time and time again. Look them up. Look them up. The thing is The thing is is I I'm irritated is you guys should already You guys should already know this, right? Where Where I see ignorance in an officer that has two stripes to walk up and say you're being detained You're being detained. Look it up. I Look, Google it. Google it. My lawyer sent me probably like 15 different cases to to to know. Look it up. Goo- It's as easy as Googling it. I'm on private property. I'm on private property. Are we good? I just want I I would rather highlight officers. I'm not anti-police at all. I'm actually pro-police, but when I have a ignorant officer coming up detaining me for taking pictures, it's kind of that's where we draw the line. That's where we get [music] mad. Yes, it is. Yes, it is. Yes, it is. What did you respond to then? Somebody on public property? Somebody on public property? That's the thing and this is what we see, too, where when you're wrong, you won't admit it. It would be better if you just say, "Hey, we were wrong. You could be here. You could take pictures as long as you don't go past the gate. Sorry, we're gone." That would be better. That's what we want to see, but look what you're doing. And look at how like like a waste. This is just a waste of resources for a dude with a camera. And what was the last one? What was the last one? What did they call for? Cuz I'm going to get the radio chatter, you know that, right? I'll get a copy of it. Ask what the last call was. What was it for? Somebody taking pictures? What did they call about? I want to Somebody taking pictures? But was it somebody taking pictures? Smitherum. Was it somebody taking pictures? Cuz Show me. Let's see it. The arrest warrant was suddenly exposed. The call transcript revealed a truth that many people could not believe. for that. I got I know how to do that. I know how to do that already. Don't worry about that. So, this is ignorant. Are you going to Are you going to train the officer? Do your thing. Are you going to train the officer? Are you going to train the officer? I just want to know if you're going to train her. >> [music] >> Because it's an illegal detainment. But you You'll see You'll see it. Look, she said I'm being detained for harassment and being on private property and disturbing the peace. That's not what we just heard in the call. Okay, we heard a guy taking pictures. What Do you know 148G of the Penal Code? Just Do you know 148G of the Penal Code? I just want her to train. 148G says that taking [music] pictures cannot be deemed suspicious. You can't be detained for it. You You have to be left alone as long as you're on public property. I was on public property the whole time. This whole driveway is public property until you get to that gate. So, go train the officer. I just I was trying to tell her that, but she won't hear it cuz you guys have this block where you get mad when somebody's pointing out something wrong. Don't take it as a bad thing. How are we going to bridge the gap and fix this? You know what I mean? I I mean, no need to be mad. She could have just said, "Hey, I [ __ ] up. Sorry." I would have walked away.
