Take them home. >> You're going to get fingerprinted. You're going to get photographed. And then you can call whoever you want. >> You're saying I'm going to jail for this? >> This is just lock up. You're not going away to jail. You're coming right here. Okay. >> I mean, what? Getting locked up for what? >> DUI and obstructing resisting. >> Why the distance? I didn't harm you while protecting you. Good fake man. >> Hey everyone, it's Trent, prior deputy sheriff patrol sergeant and K9 handler. So, due to the nature of this call of Dave and Busters, which can get kind of rowdy sometimes, I guess, right away, everybody inside of that vehicle when these officers stop it is automatically going to be detained regardless of that littering situation. And when this driver stated that everybody in the vehicle is over the age of 21, that is nice. However, that's not relevant to the situation whatsoever because that still does not give any of them the legal authority to drink and drive, have an open container, or litter on top of that. Not to mention putting that small child in the back seat, safety in jeopardy with everything else. And even if you're a passenger inside of the vehicle, having an open container is still going to be illegal. So these officers giving him all those lawful commands is exactly what they are. And when he starts to become combative and not listen, that becomes an immediate safety issue when the driver starts to exit the vehicle and begins to get in the way. And everything that rear passenger did, of course, he did not need to do. He could have acted like the front passenger who was calm, cool, collected, and cooperated the entire time. However, that's easier said than done when you are dealing with somebody at this level of intoxication and trying to deescalate them can be extremely challenging. >> The mother faced charges including DUI, child endangerment, and other traffic and alcohol offenses, while the uncle was charged with aggravated battery to a police officer, disorderly conduct, and resisting arrest. The restaurant also received a citation for conduct violations, but all remain innocent until proven guilty in a court of law.
