She's drunk and backs into a patrol car. What started as a minor accident turns into a DUI investigation with missed cues, attitude, and a kick at the officer. No chaos, just choices with real consequences, including a refused breath test. Why turn a minor incident into something so much worse? On October 8th, 2024, at approximately 10:50 p.m. in Tampa, Florida, a gray 2012 BMW backs out of a parking spot, straight into a police car. Not exactly the best start to a night of drinking. A Tampa PD supervisor arrives, meets the driver, Elsie, and immediately spots the telltale signs of impairment. From there, what starts as a DUI investigation turns into multiple charges. Keep watching and see how her attitude gets her into more trouble than expected. No crash. >> No crash. All right. Who's got her ID? >> I got it. Okay. Hello. >> How are you? >> Good. How are you doing? >> I'm fine. Yourself? >> What's your first name? >> Elsie. >> Elsie. Okay. There's no monster bar. Obviously, these officers called me here because they concerned maybe you had something to drink tonight. >> That was probably maybe more than two hours ago. >> Oh, was it? >> Yes. >> What did you have? >> Um, I took maybe half a beer. >> That was it? >> That was it? >> Okay. Are you on any medication? Yes, sir. >> Okay. Do you mind stepping out for me? Y >> you have any uh anything like physically wrong with you? any uh injuries with like your legs, your back, your knees? >> Nope. >> And you said you're not on any medications right now? >> You're perfectly healthy then? >> I'm healthy. I have anxiety, but besides that, I'm good. >> You're on medication for that? >> I not tonight. I only take it when needed. >> Okay. Do you wear contacts? >> I wear glasses. >> All right. Can you stand with your feet together like this? Arms down at your side. What I'd like to do is begin by checking your eyes as part of some field exercises. Okay. You see the red light here in front of you? >> Absolutely. >> What I want you to do is follow that light with your eyes, keeping your head still as I move that light back and forth. Okay, >> keep your head still. >> The officer starts with the horizontal gaze nestagmas test, a standardized field sobriety check that looks for involuntary eye jerking as a sign of impairment. But she's already screwing up by not following directions. First misstep, she moves her head instead of just her eyes. It's small, but those little mistakes stack up fast. >> Okay. There's a couple other exercises I'd like you to do. Okay. You willing to do those for me? >> Absolutely. >> All right. Come on down here. So, we'll use this white line right here as a line to walk down. >> I'm going to give you some instructions. I'll show you how to do it. >> And then after I do all of that, you can ask questions. Okay? I just prefer that you don't ask questions while I'm giving the instructions cuz it's kind of hard for me to stop. All right? >> So, while I'm doing all of that, what I would like you to do is stand with your left foot at the very beginning of the line. Then, take your right foot, place it in front of your left foot, so it touches heel to toe. Make sure both feet are on the line and one directly in front of the other. Place your arms to your side. Now, don't begin walking until I tell you to start. Okay. >> Okay. >> So, when I tell you to, I want you to take nine heel totoe steps, counting your steps out loud as you walk down the line. >> Spot the next mistake in the walk and turn. She even asks a question, then still starts wrong. Pay close attention. Not to mention, he said, "Place your left foot in front of your right foot." >> So on until you get to nine. >> Okay. So, straight down. Slowly turn. Come down. >> Exactly. >> Count out loud. >> Exactly. So, Is this one or is the next one? >> So, your first step will be number one. >> This one. >> Your first step will be number one. >> Okay. So, while you do this, I'd like you to look at your feet as you walk. Count your steps out loud, keeping your arms down to your side, just like this. Don't stop walking until you've completely finished this. >> Okay. Do you have any other questions? >> No. Straight down. Slow turn. Back to you. No questions. >> Okay. You can begin then if you understand. 1. 2 3 4 5 6 7 8 9. Boom. 1 2 3 4 5 6 7 8 9 >> Okay. Next, what I want you to do, stand with your feet together, arms down to your side. You can forget about this line. We're not going to use it. Okay? I don't want you to do anything until I tell you right now. Okay? I'm just going to show you how to do this and explain everything. Okay? So, when I tell you to, I want you to raise one leg. Doesn't matter which one. I'm going to raise my left leg just cuz that's what I like to do. Raise it so it's about 6 in off of the ground. Point your toe straight out. Look at >> Hesitation or a lack of confidence can be a telltale sign. When someone lacks confidence before a particular field test, officers often read it as another clue they expect to struggle with it. >> Just pick it back up and continue counting from where you left off. >> You won't need to balance right now. Okay. >> Is that a problem? >> No, we're working out. All right. Well, you see me doing it. >> You're a cop. >> Doesn't mean anything. >> Let's do it. >> All right. >> All right. >> Do you have any questions on how to do it? >> No. You just told me raise leg till you count. If I put my leg down, stop till you tell me. Keep counting. >> Well, if you put your if you put your foot down, I want you to pick it back up and continue counting um from where you left off. And you do that all on your own. Okay. >> Okay. 1. You want me to count by,00? >> Yeah. 10001, 10,002, etc. Yep. Any other questions? >> Nope. >> Okay. And begin when you're ready. >> Okay. >> 1,001. >> Make sure you're looking at your foot. >> 100. >> She clearly doesn't remember the instructions and her balance is already off. >> 1007 1008 1 9 1 >> Make sure you're looking at your foot. 1,345 1 178 >> All right, you can stop. Go ahead and put your foot down and put your arms around your back. What am I doing? >> DUI for what? >> Driving under the influence. Do >> you have anything? [clears throat] >> Well, you did the exercises. You just didn't perform them how I asked you to. There's a lot of inclusive impairment that I observed during that. Leads me to believe you've been drinking a lot more than you you're telling me. When we get down to the jail, I am going to ask you to do a breath test. Are you willing to do that? >> N. >> All right. Come on. You don't have anything hidden on you, do you? >> Okay. Do you carry anything? Do you carry anything in your in your top? Any any cash? Any Okay, just making sure >> there was not even but okay. You stand right here. Face the truck. >> Can relax your arms. She's good searching in just a sec. Okay. >> I know. We got to make sure. I'm going to get the passenger. >> No, don't impound my car. There's people in there. They can drive it. >> We have to The car is in your name. We don't have a choice. >> But I have people in there. I don't even live over here. Like >> that was a whole act. Do >> you want to hear what I have to say or not? >> No. Because why? You want to impound my car for what? Like there's people in the car that can literally take my car where it needs to go. Like you guys have been extra. I barely even bumped that damn car. I've been more than >> Okay, come over here. >> Respectful. No, cuz I've been more than respectful. And >> you have? I appreciate that. >> I don't No, but can we talk? >> Yeah, we can. Well, you said you didn't want to hear what I had to say. >> Well, let's listen to it because there's no way. I don't even live over here and have them impound my car. >> We have to by by our policy. We can't really >> people here. >> I'm trying to tell you. I'm trying to tell you something. >> Have a seat. You don't want to listen to me. So, >> don't get No, because you know what? Have a seat. Sit in. Sit in the car. Sit in the car. I'm going to put Sit in the car or I'm going to put you in the car. >> I'm sitting in the car and I'm trying to have a conversation. No, I'm trying to have >> Stand up. We're going to put you in the car if you don't listen. Not wanting to get in the car, the officer places Elsie in the car and she kicks him. That was smart. >> Touching on the car from what? >> Battery. >> Battery. For what? I haven't touched any of you guys. I'll go see if she has any like wallet or phone. >> Yeah. >> Yeah. You're not going to be able to talk to her right now. She's not cooperative with us, so nothing against you, but >> I just don't want her to get hyped up again. Okay. >> Officers tell Elsie's friends they'll need another ride since her BMW will be impounded. Before the tow, police conduct a standard inventory to log her property and note any contraband, open containers, narcotics, etc. Elsie is transported to the Tampa Police Department for processing, then taken to the Hillsboro County Jail to await bond. Elsie was charged with DUI, resisting arrest and battery on a law enforcement officer. She also refused the breath test, triggering a one-year license suspension.
