She's 21, driving home from a night out and absolutely convinced she's fine to drive. The body cam tells a different story. She drifts all over the road, swearing she's sober, then struggling through simple instructions, losing her balance and fighting to hold it together as the officer starts to realize just how impaired she might be. Watch closely. Every step, every stumble, every answer she gives decides what happens next. Does she walk away or ride to jail in the back of a patrol car? The only way to find out is to see how this traffic stop ends. On April 25th, 2024, at approximately 12:30 a.m. in Tallahass, Florida, police noticed a black Volkswagen Tegan drifting out of its lane on Stadium Drive, swerving into a bike lane, and finally pulling into a Circle K on Jackson Bluff Road. The driver, 21-year-old Giovana, still had a wristband on from a local bar. She insisted she was fine to drive despite the smell of alcohol and clear signs of impairment. What happens next on body cam, the field sobriety tests, her mistakes, and the moment this traffic stop turns into a full DUI arrest is something you'll want to see all the way to the end. >> Final 20 be the Circle K at Hendry and Jackson Bluff. Hello, I'm Officer Smith with FCPD. How you doing tonight? >> I'm good. How are you >> doing? Well, do you know why I'm stopping you? >> Oh, I'm just getting gas. >> Okay. Do you know why pull why I'm pulling you over? >> No. >> I'm pulling you over. >> Oh, why? Oh, because when you're making the we were coming out of the roundabout there in Collegetown and you drove over the sidewalk. >> Oh, I'm sorry. I didn't mean to. >> Yeah. Is there any reason? >> Oh, no. I was trying to get home. >> Okay. Where where are you coming from? >> Um, I was at Wilbur's and so I'm just trying to get home. >> Okay. Where's home? >> Okay. So, right down the street. >> Yeah. >> Okay. Can I see your driver's license registration, proof of insurance, please? 92. >> No. >> Are you the registered owner of the car? >> Yeah. >> Okay. >> Sorry. I have napkins. >> No, you're fine. >> No. So, I'm just trying to get home. >> Okay. >> I'm just down the road. >> Okay. Yeah, that's fine. >> Did you notice you drove over the curb? >> Yeah, I did. >> Okay. Okay. Did you just not see it or >> Oh, no. I was just turning and it was a little bit of hard right. So, >> gotcha. Okay. Do you have the uh registration as well? This is the insurance. >> Yeah. Um should be in here. >> 4308 quarters 1027. >> Are you a student here in town? >> Yeah. >> Okay, cool. >> I have two. I just recently got it renewed. Um, >> that's fine. >> In March. So, >> are you the only registered owner? >> Um, technically my parents, but >> Okay, I can I'll take that. That looks like it. >> It's this one or the next one? >> That looks valid. >> Yeah. >> Okay. All right. Just hang tight for me, ma'am. >> Her speech is slightly slurred, and she avoids eye contact with the officer. Clear signs she knows she's in trouble and is bracing for what's coming next. Just one. Yeah. Yeah. 38 headquarters. Copy. Florida number. >> Yeah. >> Hey, Miss Felton. Um, question for you. >> Yes. >> So, at the Wilbur, did you have any alcohol to drink tonight? >> Um, I had a couple drinks, but like nothing over whatever I'm supposed to. I'm just I'm >> like I'm just trying to get home. Okay. How many is a couple drinks? >> Two. >> Two. Or beer, liquor, wix, whiskey, wine. >> Liquor. >> Yeah. >> Okay. Okay. About how long ago? >> Um maybe like an hour and a half ago. Like I'm definitely not over the legal limit. >> Like I'm I'm fine to drive home. >> Okay. Would you be willing to step out and do some voluntary fuel exercise for me? >> Um >> just to make sure you're good to get home from here. >> I mean I I think I'm completely fine to get home. >> Yeah. And the only reason I ask is cuz since you did drive over that curb. No, literally that was like a drive over >> between that between that. That's why I'm trying to make sure you're good to drive from here and which is what the exercise would happen. >> I'm just I'm fine to drive home. Like I'm right there clearly. >> So I would like to not participate in that. But I am >> completely fine to drive home if you would like to follow me. Like that's fine. But I'm >> 100% fine to drive home. >> Well, I'm not 100% sure you are. So that's why I want you I'm asking if you do the exercises to see if you are good to drive home. And if you don't, that's your choice. But I have to make my decision on what we do next. Whether it be letting you drive home, giving you a ticket, or arresting you based on what I've seen so far. >> Understand that? >> Yeah, absolutely. Um, what type of exercises would you have me do? >> Standardize. So I'll look at your eyes, uh, walk and turn on a line and balancing on one foot. >> Okay. Yeah, I'm fine to do that. >> Okay. All right. Yeah. Um, then you can go on and step out for me. >> She refused at first, hoping to avoid the tests, but the eye exam will reveal what she can't hide. Watch closely. This is where the truth comes out because involuntary eye movement never lies. >> Um, we can just hang out on over here for me. >> 30 hours. I'll be doing a single one. That's good. Um, do you have any before we start, do you have any medical problems I need to know about? >> So, do you have any like concussions, any eye problems? Uh, medical problems like diabetes, not schizophrenia or schizophrenia, I guess, seizures. >> I'm in the circus, so like maybe there's here or there, but like no. >> Okay. Would you consider yourself in like perfect health? >> Yeah. >> Okay. All righty. Um, so for the first one, we're going to check your eyes. If you could just stand with your feet together or actually if you stand right just right there for me. We'll just stand like this >> like on the spine. >> Close enough to that right there's fine. So stand with your feet together and your arms down at your side for me. >> And then I want you to focus on this blue light with your eyes and your eyes only and don't move your head. You understand? >> Yeah. You can already see her eyes are not tracking smoothly and instead are jumping from location to location. Just keep keep your eyes as best you can on this. Okay. She's already failed the horizontal gaze nestagmas test, and her go-to excuse of just two drinks probably isn't the full story. Now, it's time for the walk and turn. Watch closely. This is where things usually fall apart. People forget to count out loud, miss heel to toe steps, take too many steps, or use their arms to balance. All clear signs of impairment. Let's see what she forgets because the camera doesn't miss a thing. Um, so the next one for the walk and turn, do you have any problems with your feet? Um, any knee problem? You said you're in circus, right? No. >> Okay. Um, so no like surgery, nothing hurts or anything? You haven't had a car crash or anything? >> I have been in a car crash, but like not currently. >> Not not recently. >> No. >> Okay. All righty. Um, let's see. Do you want to use those shoes there or do you want to Are those fine to walk in? >> Yeah. I mean, like I could also go barefoot if that helps. >> It is up to you. I mean, it's okay. >> Whatever. Whatever helps you. >> That'll be fine. Um, so if you would want over here for me. >> So, if you would just come over here, you can just come right over here and just stand right there. So, I'm going to expl I'm going to explain everything and then demonstrate to you. So, if you would stand with your left foot on the line in front of you, with your right foot in front of it, with your right heel touching your left toe, and put your arms down at your side, and do not begin until I tell you to. Do you understand? So when I tell you to, you're going to take nine heel totoe steps down the line, leaving your lead foot on the line. In turn by taking a series of small steps with the other foot, then returning >> one in front of the other. >> Yes. Then returning nine steps back down the line. Keep your eyes on your feet at all times and count your steps out loud. Um, and don't use your arms for balance. If you ever step off the line to step back on, if you ever don't stop, but if you do have to, just keep on going. So it's going to look like this. 1 2 3 4 5 and so forth until you get to nine. Turn by taking a series of small steps and then one two three and so forth until you get to >> nothing. Okay. May I take my shoes off? These are relative new shoes. Haven't broken them in. Thank you. >> All right. Do you have any questions or anything? >> No. So, left in front of the other. >> Yep. Yep. So, left foot on the line, right foot in front of it, and then um continue the truck. >> All right. And then arms out to side. All right, you may begin. >> She skipped heel to toe. They need to touch. She rushed through the steps and she couldn't stay on a straight line. Not exactly how the walk and turn test is supposed to go. Now it's time for the one leg stand. Will she keep her balance or is another fail about to happen? Keep watching. This next part could seal the deal. >> Um, so for this one, you're going to stand with your feet together, arms at your side, and don't begin until I tell you to. Do you understand? Okay. So, when I tell you to, you're going to raise one leg, either leg approximately 6 in off the ground, keeping your foot parallel to the ground, and keeping your eyes on the raised foot at all times. Doing so, you're going to count out loud like 10,00 1, 10,00 3, and so forth until I tell you to stop. >> 20 seconds just >> until I tell you to stop. So, you're going to be like this and then 100 1 2 1 100 3 100 4 until I tell you to stop. Do you have any questions? >> Okay. Um, Officer Clark will tell you when to begin and when to stop. >> Okay. And arms up my tight. >> Yes, ma'am. >> You may begin. She starts with 1,002, not 1,001. And then when she gets to 1,45, she goes back to 1,4 again and eventually drops the 1,000 altogether as she blurts out 17, 18, 19. At this point, the entire test is completely botched. So, the real question is, after seeing all that, do you think the cuffs are coming out next? >> What do you think? >> You're pinpoint as hell and like nestagmas, but like very long, slow, smelling really good. Just circles. Yeah. Yeah, she stumbled when she got out the car. She drove over the drove over the sidewalk and around about I don't know. It just my DR is kicking cuz she's got to be on. >> All right, man. So, I I do think you've had too much to drink to be driving. Okay. So, you are going to be you are going to be placed under arrest for DUI. Okay. >> And I will be completely fine driving to my apartment. If you would like to follow me, if you would like to follow me, that is >> So, I'm going to need you to turn around and put your hands on your back for me. Okay. I'm so I'm so sorry. It's okay. It's okay. It's okay. It's okay. Ma'am, it's okay. Calm down. Calm down. >> Calm Calm down. Calm down. Ma'am. Ma'am. Ma'am, I don't want to do this. Calm down. Just take a breath. >> I understand that. I understand. Can you please Okay. I have been under calm down. Calm down. >> Officers. Officers. Can you please realize >> don't resist? I'm not resisting. Just wait for a second. I know. I know. Take a breath. Take a breath. You'll be okay. >> It's always tough to watch someone panic the moment those handcuffs come out. But when you consider the very real possibility that she could have killed someone else or even herself, the perspective shifts. A DUI isn't just a mistake, it's a danger. With any luck, this experience becomes a wake-up call. And next time, she chooses an Uber instead of risking lives. >> Um, I'm a I'm a straight A student. This is not what I need. I have a super stressful week. This is >> Come on over here for me. Okay. Can you please I do not want you please just please just listen for two seconds. >> The decision's right. Okay. Just just please listen to you. Okay. We're listening to you. The decision's right. No. I'm I'm completely fine. I'm completely Please. Please stop. >> You're fine. Just sit down. Don't Don't get in. Just sit your butt right there. >> Okay. Okay. I'm >> sorry. >> I'm I'm completely fine to drive. Like I swear to God, I have had a very stressful week. >> But you've had I'm I am fine. >> You've had you've had too much of >> I I will be completely fine driving home. Um >> Yes, ma'am. >> I'm completely fine to drive. If you would like to follow me to my apartment, it is fine, ma'am. >> And I understand that you are past that. >> I do not want to get in any trouble. This week has been absolute hell for me and I'm so sorry that this has had to happen. Um I can drive. If you would like to follow me, please do. I do not want to get in any trouble. Like, I am >> I just want to get home, honestly. It's been a very long night and and I do not want to get a criminal record. I don't want to get anything of the sort. And I'm sorry that we should we should we should have thought about that before we got behind the wheel of this intoxicated. Okay. >> And and I don't think that I'm not intoxicated. And I'm sorry, but I am fine to drive. I really am. >> Do you need your wallet? Listening to her slurred speech and panicked rambling, it's clear she's shit-faced and in no condition to be behind the wheel. >> Have do you have a a wallet or anything you want me to get you? >> Um, >> a female officer arrives on scene to conduct a search of Giovana before she's transported for processing. I don't think anything alcohol must make her eyes are very confusing. You want you have anything on you that I miss because if you go to jail, >> I'm so sorry, Miss Johnson. I >> can you just answer that question first? >> I don't have anything on anything on me. Okay. Um >> Okay, let's go have a seat real quick. I >> know. Let's have a seat. Can you put your feet in for me? >> Officers, can you slide your feet in like right face there? >> May please just speak to you for two seconds. I'm not a criminal. I'm not anything bad. >> I I would be happy to let you follow me home. I am >> Okay, we're past that. Um, with your car, >> I know we were past that. I >> I know. Would you like us So, we have to figure something out with your car. Would you like us to leave your car here in a parking spot or do you have a friend that can come? >> Please just please just drive my car home. We I can't I can't I can't drive it. >> I can't drive it. But we can have someone come get it. We can have it towed. We can leave it here. >> I don't want to tow it. I don't want to leave it here. I >> Would you like a friend to come get it? >> I can't have a friend come get it. Okay. I'm sorry. >> Leaving it here is the the the I could tow it with one of our tow trucks. >> Or we could leave it We could leave it here and see if And we can get in the morning. >> Yeah. Let's just get it in like a parking spot over there because in the spot that it is in right now it's >> How about I pull it forward right there in that spot and I'll ask the manager not to tow it till the morning >> and I can't guarantee it but he can he might let you. >> Officer Smith that I don't want to get killed. I >> So that's the best option I have for you. Is that okay? >> And that's >> Is that okay? >> Officer Smith. It's fine. Like I just had a place. >> I know. So I'm going to I'm going to move your car to that spot. Okay. >> So much more. I know. Is that okay? Is that okay? >> I'm really sorry. I'm so sorry. >> Slide your Let's slide your feet in. Slide your slide your feet in. >> Slide your feet in. I'm going to buckle you in. >> I'm so >> Okay. And then I need to sign the the ticket as well. So, this is a DUI citation ticket. Um I need your autograph here. It's the same thing. Not an admission of guilt, just saying that you received it. Um, and then I will explain what to do with driving after this. >> Okay. Could you explain it before? >> Sure. Um, so you can get a uh like a hardship license if you go to the DMV. Um, you'll get a copy of this. >> See, one of them. So, you'll get uh this copy here and you'll be able to drive for 10 days on the copy as like provisional. Um, and that's for going to school, going to work, stuff like that. Not Not going out and about. >> Um, and then you can get a uh So, your license is suspended for a year since you didn't blow. But, but you can >> Yes, ma'am. >> I just really like to go home. >> I promise it won't happen again. I swear to God, I have worse. >> I know. >> If you I'm not I'm not going to say anything. We're not going to >> And you'll be okay. No, I'm not. Lisa, >> yes, you you will be okay. It's just a missed meme and it's something you could get off your record. >> Look through my file. >> Oh, no. I got to >> So, I just need your signature there and then we can get get going with everything else. >> So, my So, my license will be suspended for an entire year. >> Yes, as of right now. Um, there's other, like I said, you can get your hardship license. So, you can still drive, you can still go to school, you can still go to work and whatnot on that license. You talk to the DMV. >> Okay. >> Um >> Um and what are the, you know, other options besides that? If I get a lawyer, am I allowed to still drive because I need to drive? >> That's something that's something that they're all going to have more. >> I live in South Florida, I can't not complete my senior year. >> Yes. And >> this week has been it's not it's not going to keep you from that. As long as you get do the proper things and go to the DMV and get that hardship license, you'll be fine. But if you don't do anything whatsoever, just drive around. >> I promise I will. >> And yes, and you don't seem like someone who would do that. >> So, you're going to be you're going to be fine. Just But if you sign this ticket, then I can give you your copy, which is what you wanted to drive with. >> Um, it's right there. >> Do I have the opportunity to call a lawyer right now? >> Is it what's it's not not going to help me? None. This isn't an admission of guilt or anything. That's just saying a signature. >> Yeah. You don't have to sign it. But I'm not going to split in custody if you >> a citation. >> Yeah. >> So, you'll be able to talk with a lawyer and everything afterwards. >> I am done with lawyers. >> Okay. >> This entire week. >> I know. I >> If you're If you're not going to sign it, that's fine. Then >> I'm not I'm not not GOING TO SIGN IT. But I don't I'm not like Please don't like Please don't. No. And I will sign it like I will sign it. >> Okay. Then you can sign it right there. It doesn't matter to me. She's >> So, when can I get my one call? >> The faster we give the sign and you get through that process. >> Yeah, then that's fine. >> This is the only thing. >> Yeah. >> And then the the deputies will be in charge of all that. >> That's fine. >> Two of them. >> Yes. >> Okay. That's fine. >> So, which one is which? >> I'm so done with this. >> And like I said, like I said, this isn't the end of the world for you. You just made a bad moral decision. >> Oh, no. It's not my [ __ ] decision. I I don't mean to curse. >> Okay. >> Does the copier work on the side? >> Based on Giovana's erratic driving behavior, including running over a curb, her admission to consuming alcohol, and her inability to successfully complete the field sobriety exercises. She was placed under arrest for driving under the influence. She was transported to the Lyon County Jail for processing where she refused to submit to a breath test. As a result, Giovana driver's license was suspended for 12 months. She was later released pending her court appearance. What do you think about this incident?
