seat belts available for them that's a problem on September 15th 2021 officers responded to a call about a four-year-old child who fell out of a moving vehicle on State Road 100 in Flagler County Florida a passor by witnessed the incident and reported that the vehicle driven by an 18-year-old man with a 26-year-old woman is sleep inside continued westbound without stopping leaving the child behind deputies later discovered four unrestrained children aged 4 to n in the back seat along with evidence of marijuana [Music] use how you doing hey sir thank coming so quick I've never seen regular you know sedan Alpha 216 Flagler so the he come out of the front seat or the back seat back seat back right back the car came off Old Kings Road right he he or she made a u-turn white car is right there I'm sitting first one in line over there turned and I I thought it was a dent in the door but it was the damn door open and he F in the back and he just signal 14 says he may have9 mass and I just I just looked at him say just silver car is all I can think of yeah and I just got I kind of did the door close when it keep going or did no it was it was still open high was it Reckless High rate of speed or just it wasn't like it was out of control it wasn't like it was burning tires or anything yeah um I don't know I even tried to ask anybody know that you were out of the car could wear a seat Bel right um well you have this four kids and that's only three seats so how four kids for three seats with three seat belt they all fit there it doesn't matter if they all fit there how many seat belts are there there's three seat belts every now needs to be in a seat belt so obviously someone's not in a seat belt if there's four kids I mean I just got this car I used to have a big van but so just saying if I if I just get this car I'm going to sit four kids back seat I'm going to make sure there's four seat belts so did you check sem seat Bel car I have six kids what do you I know VI I didn't think that my son would ever do something like that I know but under state law every child to be in a seat Bel at least I know that certain ages so how are they all SE I bu them in second thing four kids in the back seat only three seat belts available for them that's a problem and the third thing is we all can smell the marijuana coming out of the car including the paramics fir so we're look into those three things right now so hang tight while we can finish do doing is there any marijuana in this car do you know well with or without your permission just the snow of marijuana alone give us the right to check your car so that's what Deputy where where are we I don't even know you're in Palm Coast Florida probably about half hour north of Daytona all right so I'm my brother went into the to pump gas I guess and he went into the store okay but that's not what happened he didn't even notice that my son fell out the car right here like I didn't even like until when we went to this gas station was in the police so you were sleeping here I was sleeping okay and did you guys leave Miami today or how long have you we left today today okay and you guys stopping here for gas stopping here for gas okay and so you say you're were sleeping and then driving up there your uh daughter woke you up yes my daughter my daughter woke me up because all I heard heard her say that you know of course I'm going to get up from something like that and then that's when I went crazy and and we was like right there on the eway so we had to hurry up and turn around to get off and come back to the same gas station that he said he my brother said he was at so you guys already on 95 so you want to put next exit turn around and then turn around all right and the pills I found in the glove box the Xanax bars the Xanax yeah those are my anxiety pills okay are those you have a prescription I don't have it in my um bottle no I don't have my prescription you have a prescription for Xanax particular um they give me um some type of pills like that's for like that has that doctor prescribed Xanax virs to you that's what we're asking um we we can check that we can go on the record we check see so he hasn't prescribed you any Z they prescribe me with pills that are like in the Xanax family in the Xanax family but he hasn't prescribed you those those pills where you get those I have bad anxiety pill I mean problem where did you get those pills from my friend gave them to me your friend gave you those pills yeah like my anxieties that I have does your friend have a prescription for the pills is it his is it his prescription probably he probably have a prescription of okay cuz my sister passed away and um not too long ago so I I'm been with like anxieties and stuff so I would have to take that's understanding well if if you got anxiety that's when you go to the doctor and the doctor prescribe you medication stuff getting from you see the bottles right there you can probably see the that I have right there so the secondary I've been trying to go to the doctor the the secondary concern that I have is when you guys left Miami okay you got four four children in the back seat um their ages are on the back seat right now is it five or 9 5 4 and three that's that's their ages in the back seat um yeah n five seven seven N9 seven five four five and four okay so under Florida law uh and you do you have driver's license in Florida no I have to get one so you don't have a driver's license on okay well it's it's law that states that any juvenile that's in a vehicle that's under the age of five needs to be in a car seat on top of that any juvenile that's under the age of 18 needs to have a seat Bel now all right so the problem is is these cars are designed for for three passengers in the rear seat right now we have four passengers in okay so the car is legally not allowed to travel with four juveniles even four adults in the back seat you could travel with four adults in that back seat if you want to because everyone has to have the option to be able to sit with the seat belt even as an adult you don't have to sit with a seat belt in the back seat you still have to have that option but like I said the main concern is is that we left Miami we put four juveniles in the back seat and obviously one of the juveniles didn't have a seat belt on because you got three seat belts three seat belts and four juveniles that leav someone out from getting it and obviously the one that I don't I don't know why the door opened I don't know if he had hit the door if it was a malfunctional door I see that there's damage on that side of the car so with with the damage on the side of the car maybe the door locks not working properly I I I don't know that I'm mechanic but all I know is that by simple math three seat belts for juveniles and one juvenile falls out that's most likely the one that wasn't wearing the seat belt okay so that's that's the concern that I have the secondary concern is um who is the male that was driving the car my little brother that's your little brother okay um were you awake when your brother was smoking marijuana in the car no no you weren't awake when he was sleeping okay you were sleeping when he was smoking marijuana did you know that he had marijuana on him not no I wasn't aware that he had marijuana on okay so you weren't aware that he had marijuana marijuana you it doesn't matter if it's if it's an ounce or 10 oun it's still not legal to have marijuana with you and then obviously it's not if if he smoked it 20 minutes ago it's it's not legal to we don't know I don't know when he smoked it I don't know he smok when he stops here I don't know I see gets back on the road now he is driving under the influence of Narcotics with four juveniles one of them obviously not in the seat I can't I can't say that they all were in seat belts I know that when we came up to the car they weren't in their seat belts but uh two of them were supposed to be in car seats which one said I thought you said four supposed to be in car seat so anybody under the age of five needs to be in a car seat under five and under five and under has to be in a car seat two out of the four kids should have been in all right other two seat belts are fine so then that basically that means I can't drive my car at all because I have six kids yes this is would not be a vehicle that would be suitable for you to drive I know that I just got car for now to get around you would have to have a vehicle that would SE sex juveniles yeah I know I always used to have Vans and stuff like big cars this is my I lost my car the only option that I had to have apart from now I understand so like I said there's other options that you as a mom have to take for the safety of your children because as a mom and those of your kids you're saying hey you know what I know there's not car seats and I can't fit them I know only have three seat belts but hey I got to go up to South Carolina so he can see his dad a better option would be finding somebody to watch your juveniles so that you can fit up there or hey I'm going to stay here your brother do you mind running him up to South Carolina to go his dad or bringing his dad back so that he can see his kid all that that would be stuff that I would expect a parent to do um for their children to make sure that their children are safe okay um do you have any family that's in the area here where is your family at far away we don't live here at all I understand you don't live here but where would your family be at where would the nearest relative be at very far Miami Florida and nobody have a car and nobody has a car down in Miami they don't know anybody that could I just got my car and this car is not even under my name I I was going to do all thetion and everything I get back to Miami my brother brother my older brother your older brother is the m the license and but he had to go to work your older brother had to go to work okay so your younger brother does he have a license he never had a license before so your younger brother never had a license before anything like that okay so did you know he didn't have the license um I think yeah yeah he didn't I don't think yeah he didn't have a ni so that that's other concern that I have is now you're asking your little brother to drive you knowing that knowing that he doesn't have a license and you're putting your children in the back of the car who don't have seat bels on a non-licensed driver listen I love all of my kids I understand what I'm saying I'm not this isn't a question if you love your kids or not okay I know what happened was a mistake I understand I don't know you there's there's a lot I want you to do as a mom to to for the safety I can I can at this time we're going to detain you all right yes walk with us walk the of yours walk us how I going to get out ofil over here right now we're detaining you we're not putting you in jail we're detaining you okay just walk I don't want to put your handcuff for of your C just walk back this car walk and talking the rear your car all my credit cards that are in my back got you we'll get all that they fell all of them gra he wants you to recheck his handcuff he's saying it's too tight I check them and and where how am I going to get all the information for my kids we will let you know as soon as they get here we'll have to put in our report so we will let you know inside the jail inside the jail so right now the Department of Children family services are going to have control of your children that's why I know I'm going to get my kids back all right so um you said that um what um you're going to give me the information in jail what if I get bonded out now you're not going to bond out right now it's why not cuz we have to do our reports before you out all right Des a few more questions for you okay this address on your ID is this your most updated address all that's all I need for you for now okay a question come back all right this point your brother's being placed under arrest for driving under um driving with suspend driver's license felony possession of marijuana and the child neglect we're also being placed under arrest for child neglect and possession of the Xanax pills if they turn out these anx okay the two of you had every reason or right to either one put those kids on a car seat or make sure they're properly buckled in with the two of you failed I mean you put your children's life in danger by letting them smoke marijuana and driving like that know okay well all right let me call somebody so they can come give my kids all right give well here's the right now I can't sit with your kids while someone come from Miami so I did call Department of Children and Families they are on their way to take possession of your kids but you give me that name I will give that name to them and that would be someone they can contact to turn the kids over I can't Miami's what how far is Miami from here hours four four five hours I can't say in McDonald's Park two kids are 4 hours and how am I going to get out do you get my kids to have to call somebody to come get up all right so who do you want me to give this number to the DCF for your kids to come get them who be calling can I can you give me my phone I don't know all my numbers not where's your phone my mom you got my mom number right we do yeah do we Okay um before he leaves he'll give that to me and I'll give it to the DCF investigator and they will call her okay what I'm going to do is we're going to take you we're going to place you in the back of that patrol car I'm going to take your oldest child put him in one of these cars and I'm going to drive the car literally from here to the parking lot and get them off the roadway um did the kids eat this morning bref or anything man did the kids eat breakfast if I was go to McDonald's and get anybody have any allergies or anything that can't eat all right so I'll go to McDonald's get them some food and the investigator should be here the next half hour 45 minutes okay so step on out and they're going to walk you over to the other car sense know and then there's a puppy in the car too correct yeah those are my puppies puppies there's more than one in there all right they're going to go to we're going to turn them over to I can't to our um animal control and can I pick them up yeah I'll give them your name you be pick them up can I get my CR C my own out yes we'll grab your credit card you want your credit card and your cell phone out of the car correct yes okay we'll grab that out of the car for you before we go so I give every I give your brother the opportunity do you have anything on your persons because if you have anything on your persons I can go get a female Deputy to come and search you but intruction anything into my in facility is going to be a secondary charge so that's why I give you if you my car not under my name well here's that's the problem the car is going to get to it's going to go to the local tow pound you won't be able to get it out until you bring a valid registration insurance for the car cuz the car is not registering the car insur so you shouldn't be driving this on the road Z okay okay all to find some car seats all right oh I fit in here all right we're just going to get off the road the man and woman were charged with child neglect with a man also facing charges of driving with a suspended license and possession of marijuana and the woman charged with possession of a controlled substance the man's Bond was set at $3,400 while the woman's was set at $5,000 and both were
