I don't care what you want right now. Stop yelling. You're under arrest. If you don't come here, we're going to put hands on you. >> What happens when someone is told they are under arrest, but decides to walk away anyway? In many cases, that one decision can turn a bad situation into a much worse problem. >> No. >> Ma'am, MA'AM, YOU'RE UNDER ARREST. >> THIS CASE IS NOT ABOUT POLICE AND LEGAL TROUBLE. The hardest part is watching a child get caught in the middle of a tense and emotional situation. >> [music] >> What's up, everybody? Welcome back to today's video. Today, we're looking at a case that starts with a family dispute, but quickly turns into an arrest. As officers try to handle the situation, emotions take over, tensions rise, [music] and a child finds himself caught in the middle of all of it. Stay until the end and decide for yourself. Was this a parent acting out of emotion, or did things go too far? >> [music] >> Now, let's get into it. >> But if you can have all the stuff home, because I asked him It is not up to him. >> Well, if you're going to walk away, I can't help you. >> Because he took my phone, too. >> Okay, well, you don't want to talk? >> I need a lawyer. >> Hey, Bill. >> Russell, she can't have the baby. She just walked into the house and grabbed the baby. It's criminal trespass. >> Nope, sure. >> So, it's it's criminal trespass. Cuz she just can't walk into the house. >> is her >> So, she just can't walk in the house. >> What did she Did they ever give her permission before? >> No. The The gentleman right here is Just cuz the past doesn't mean Cuz you can look at it that way. I'm looking at it like if she just walks into the house >> Where Where is Dad? Where is >> Hey. >> Hey, come here. Nope, come here. Nope, come. Come here. Come here. Come here. >> EXCUSE ME. STOP HER. STOP. COME HERE. I DON'T care what you want right now. Stop yelling. Come here. Come here. We're going to keep following you. >> We're less than 2 minutes into this case and the word lawyer has already entered the conversation. That's usually an early sign that things are not going smoothly. It's always interesting that some people seem to think that saying I need a lawyer instantly puts everything on hold. Um, in reality it does not act like a magical force field that stops a situation from moving forward. The process continues and the investigation proceeds based on the facts and circumstances at hand. >> Ma'am, come here. What? >> I'm telling you right now you're under arrest if you keep going. You're you're resisting arrest then. Okay? Either you can come You're under arrest. If you don't come here, we're going to put hands on you. >> So, you want to let us in there and we'll go chat with her? >> Grab her. >> No, you're not allowed to touch me. That's illegal. >> Ma'am. Come here. Come here. Ma'am. MA'AM, YOU'RE UNDER ARREST. STOP. SERGEANT, CAN YOU COME OVER HERE? >> [screaming] >> WHAT? MA'AM. [screaming] >> [screaming] >> LISTEN. >> OKAY. >> RELAX. CAREFUL. >> IT'S ILLEGAL. >> MA'AM, YOU [screaming] NEED CALM DOWN. CALM DOWN. CALM DOWN. CALM DOWN. CALM DOWN. RELAX. YOU ARE UNDER ARREST. YES, YOU DID. RELAX. >> [laughter] >> LISTEN. RELAX. RELAX. DO YOU WANT me to TALK FOR A MINUTE? >> [laughter] >> YOU NEED TO LISTEN. YOU'RE ON RELAX. RELAX. STOP. WE'RE GOING TO GET MORE charges if you don't stop. YES, YOU DID. GET OFF HER OR WE'RE GOING TO PUT YOU IN RELAX. >> NOW, notice something important here, right? Once an officer tells you that you're under arrest, walking away is not a negotiation tactic. I mean, more often than not, it's the kind of decision that creates an even bigger legal problem. What makes the situation especially difficult is that a child is caught in the middle of it, and uh child seems genuinely distressed. [music] And that's often the hardest part to watch in these videos. Uh regardless of what's happening between the adults, moments like this can have a real impact on a child who's just witnessing everything revealed IN REAL TIME. >> I DON'T KNOW WHAT >> HOW IS HE ALLOWED TO DO THIS? >> LET GO. >> Please >> That's not an interrogation. >> AM I UNDER ARREST? >> LET'S GO. >> NO, SIR. You are abusing me. >> No, we are not. >> YES, YOU ARE. I AM ASKING PLEASE, STOP IT. >> [screaming] >> [ __ ] ALL RIGHT. ALL RIGHT, SIR. >> PLEASE, STOP. PLEASE, STOP. >> JUST RELAX. >> I ONLY HAVE ONE TRAFFIC TICKET. I'm sorry. I wanted my son. I didn't pay the ticket to their home. >> Relax. Ma'am, we got to talk to you about the ID card. >> I FEEL LIKE I AM MY LIFE IS BEING THREATENED. THIS IS DANGEROUS. DEAR GOD, PLEASE HELP ME. PLEASE, HELP >> I'M WE'RE LOCKING THEM FOR YOU SO THEY DON'T GET TIGHT on you. >> It goes in here. >> Well, after what you just did, yes, you >> Sir, I know you are. What are the reasons that I need to be put IN THIS IN >> TIGHTER? >> CAN I PLEASE SPEAK TO A LAWYER? >> [laughter] >> OH MY GOD. LET ME GO. I SWEAR I'LL GO SOMEWHERE ELSE. AND I'LL GO TO BUT I NEEDED MY PHONE. >> MA'AM, JUST CALM DOWN. We're going to take you in in a minute, OKAY? >> NO, I DON'T CARE. I love him. I need him. I need >> Okay, ma'am. You guys can rest on the floor. Okay. >> I understand, but you I just I I wanted to Why am I being arrested today? >> Ma'am, you can't go into someone's house. >> I did not. They had my child in there. >> That's a damn lie. You stole something. >> I didn't go in there. I asked him if I He said well, if I >> She said she watched me go in. >> [laughter] >> I did not. >> You know what? We're going to get your whole side of the story when we get down there, okay? >> There's a lot being said all at once here. This is something you don't see quite often in cases like this, right? When the legal arguments stop gaining [music] traction, the conversation moves toward reactions instead. What also stands out is how concerning the behavior appears to those watching. The situation raises questions about judgment and decision-making, and it's understandable why some people might wonder whether a professional evaluation is appropriate. >> So, put your hands behind your back. Stand up. We're not going to drag you. Come on. You got feet. >> ALL RIGHT. YOU CAN'T LEAVE >> YOU GOT TO >> Here you go. >> What do I do with this, baby? >> Yes, this is bad. >> You got it. >> I want to go home. I promise. I'm being taken. That's all. My oldest son is not his. Can you please Can I ask if you could please go to my parents' home? >> Wait for that. It's too late. You had an opportunity to talk to us. >> Oh my gosh, this is really aggressive. See, you guys >> No, it's not aggressive, ma'am. >> I went into her house. >> Drive up the street. >> No, that's not right. You can't do that. MY CHILD IS NOT OURS. >> We tried to talk to you. >> Sir, I understand. >> You walked off, and you kept saying >> woman. >> And you kept saying you had a lawyer. All right, you'll have your lawyer. >> I don't have a lawyer. >> have a lawyer. We'll get you Watch your head. Watch your head. >> Okay, I closed >> Get back. >> I am a patient. >> You were not patient with us. Slide over. I know. Yeah, you're in trouble now. Cuz you went into the house without permission. >> go in. >> And you fought us. Yes, you I have two witnesses who are going to file statements [laughter] against you. >> I'm so sorry. No. >> You can't do IT YOUR WAY. SIT UP. SIT UP. SIT BACK. WE GOT TO SEATBELT YOU. SIT BACK. >> Oh my god. >> Sit back. Put on THE CAR SEATBELT. RELAX. RELAX. CALM DOWN. WELL, you can't fight with the police. >> And now we've reached a point where everyone probably wishes those first 5 minutes had gone very differently. I mean, imagine being at home, suddenly finding yourself in the center of a chaotic situation involving adults, police shouting, and constant tension. Therefore, any child that would be incredibly frightening. More than anything else, the child seems overwhelmed by everything happening around him, and that's really the hardest part to watch in situations like this. The consequences of these moments can stay with a child long after the incident itself is over. >> What can I do, please? >> You're You're probably going to jail tonight. You can't fight us. We told you you're under arrest. And those times you continued to walk. I don't care what you want. Well, that's your right to get a lawyer, but that right now you wouldn't listen to us. That's all civil. That's all No, you cannot do that. Absolutely not. You can't just walk into someone's house. Well, there's two people filing statements on you. I'm not talking to you any further, okay? You need to calm down. You need medical attention? >> No, I don't know how So, I need my father. I don't know how much it's going to be able to get me out. I do not need to be in jail. I am a person >> Okay. >> who is very civil. I can go to my parents' home. I understand >> Ma'am, we are way past that. >> For what? >> You just fought with us for a good 10 minutes straight. I'm done talking to you. Ma'am, relax. >> I'm so scared. I don't know what I did wrong. >> If you don't know what you did wrong, then that's a problem. >> I just needed my son out of there. >> Well, I understand that, but you can't fight with the police. >> I didn't. >> We gave you a lawful order to stop, and you denied. >> I did. I understand that. >> Okay. And due to those actions, you're going to get >> I did something wrong, but I just needed my child I'm so embarrassed. I was so scared. This is terrible. I've never done anything like this. I I can come out slowly, sir. Is there any way I can use the restroom? >> Yes, I'll let you use the I'll let you out of the cuffs. >> Being hurt does not change what happens in the last 10 [music] minutes. This entire arrest likely could have been avoided if she simply had just stopped walking away and listened from the start. These are the kinds of situations where things escalate quickly because basic cooperation breaks down early. Following her arrest, Katherine Casper was transported to the station and booked on charges of criminal trespass to a residence and resisting arrest. Although she chose to remain silent after being advised of her Miranda rights, she still made several spontaneous statements, including "I am sorry" and "I just wanted my child." After being fingerprinted, photographed, and issued her court citations, she was released from custody and transported to her parents' home. Do you think Katherine's actions were driven by emotion and concern for her child, or did she cross a line that justified the arrest? Let us know your thoughts in the comment section below.
