The officers then called the drug recognition expert officer to conduct field sobriety tests on the suspect. >> So what's going on? >> So we walk in, walk in the parking lot walking. >> So you guys are roaming. >> Yeah. He pulls up next to us, speeds off into here. >> So he goes signal 12 up the ramp. Speeds right past us. >> Okay. >> We were like, "Okay, this car want to pull out with him to see what's going on." >> Okay. >> He pulls in here. >> Did his tire screech or anything? >> Uh when he came in this way, he like he cut the corner. >> So you heard his tire screech? He cut the corner. He screeched and broke like very abruptly >> and backed up. Tried to get into this parking spot. As he did, >> he pulls in and hits the front >> the car. >> This is the car that he has. And then he hits the front part right here, scrapes all the way through. And this is his finished parking job right here. >> Okay. >> Um and then when we pull up in the passenger side cup holder, there's a beatbox. Uh-huh. >> And then when I went to the driver's side, >> you still have that? >> It's in there. >> And then on the driver's side, there's a beatbox that was on his feet and he was actively trying to hide it. >> I called him out on it. >> Okay, cool. >> What's up, man? Is he coughed? >> No. No. >> Oh, okay. Hey, man. My name's Edwin. What's up? >> You guys need this or not? >> What's your name? >> Can I relax in front of these money cuffs, please? >> What's that? >> Can I relax in front of these money cuffs? >> Yeah. Are you handcuffed right now? >> No. >> All right. My name's Edward, man. You're good to relax, dude. >> But I don't feel relaxing. >> I don't know what what you're talking >> I can talk to you in in a separate with you, >> you guys. All right. Can I just have one over here? I'm going to talk to him about my car. Come over here, dude. Hey, come on. Come over me, dude. What's your name? >> Yo, are you willing to go over here and talk to me? >> All right. What's fine, man? >> Can you please take the car, please? And I can >> Hey, hey, just come over here. We'll talk. >> No, just take the car key. >> No, no. All right. All right. Let's go. >> Okay. You're not free to go, but you're going to come talk to me. I'm fine in either case. >> You could stop yelling at me. All right. >> You had it. I'm sorry. I'm not yelling. This is >> Hey, I'm so sorry. >> You're good, dude. >> This is my Indian my natural problem. Everyone say stop yelling. >> What's your name, man? >> I'm I'm not yelling. What's your name? Being an international student, being all these shenanigans, I just know one thing. All these formalities might take time. And I asked my friends to not to wait with me and to have fun. >> Yeah. Yeah. >> Just because whoever was faulty or not faulty, >> whoever was whoever was on the Wii is the one who is under the inspection. >> So, I'll tell you this right now. I don't know what you're talking about. I'm gonna I'm gonna tell you what I'm doing. Okay. >> I'm gonna be completely honest with you. The officers over there observed you in the driver's seat and they saw your your behalf. >> Yeah, that's what I said. >> Hear me out. Let me finish. Right. They saw you um driving and as a result, you hit the other car. There's no question about that. I have that from the officers. They have it documented on their bodywn cameras and there was alcohol in the car. All right. I agree. >> I'm here. The crash investigation's over. All right. What I'm doing is called the changing of the hats. It means I'm investigating your driving behavior and I'm investigating DUI. All right. >> Yes. >> Oh, you understand that? >> Yes. >> Do you have any mental health issues? >> No. >> Do you have uh >> have you ever had uh TBI, traumatic brain injury, concussion? >> Based on my uh advisor saying, if I don't know what TBI stands for, I don't know what it is. >> Traumatic brain injury. >> That's what I say. >> Have you had a concussion? >> No. >> No. Okay. Do you wear glasses? >> No. >> Okay. Okay. So, uh, that's a alcoholic beverage. You can let them go. >> And according to my blood alcohol concentration, I'm like 225 lbs. If I drink like according to BC four legal drinks, I'm legal to drive under 0.08 BC legal driving limit >> and I am right now in legal driving. >> Well, I don't know that. >> You can check me if you want. >> Okay, that's so I'm going to ask that you submit to some exercises so I could see how you're functioning. All right. I don't know what your but I could look I can't look at you and tell you what your blood alcohol level is. I I'm not I could do is see if if you're impaired or not and I'm going to ask you to do some exercises and if you're willing to do that >> fine if all these things had not happened I would have gone to a restroom really quick. >> Okay. But that's neither here nor there because all those things did happen and we're here right now. Okay. >> Yes, but it took me already like 10 15 minutes. >> Okay. So, you're willing to do these exercises? >> Yes. >> All right. Thank you so much. All right. So, um the first thing you don't wear contacts. How are those shoes? Are they pretty comfortable for you? >> Okay. >> Do you want to keep them on or turn them off? Take them off. >> Depends on the exercise. >> Okay. Well, we'll go through the first one. I just want to look at your eyes and stuff. Okay. Are you okay with that? All right. Can you do me a favor? Just make sure cars don't come. You have to come over here for me and then come over here. I don't want a car to hit you. Okay. All right. Can you put your feet together and your hands down to your side? Your hands to your side like this. All right. This is called a stimulus. your Bluetooth pen. All right. Can you see this stimulus? >> Yes or no? All right. Can you touch that stimulus? >> Mhm. >> Can you touch it? Perfect. Now, put it back. All right. I want you to follow this with your eyes and your eyes only. Do not move your head. Do you understand my instructions? All right. [Music] All right. Perfect. All right. Um, do you take any medications or anything like that? Um, you said you're not under the care of a physician. When's the last time you ate something? >> Around 8:30ish. >> Okay. Did you have a normal night's rest? >> Yes. >> Yeah. Okay. All right. Cool. Can you do me a favor? You see this line right here? All right. Can you face that way? Just right here. Just like this. Right. Perfect. >> Is there something I should be worried about? I mean, uh, the floor is pretty flat, right? This is a flat part of the garage. >> No, no, no, no. >> Not about the test. I'm not afraid about the test. >> Okay. >> The only thing if I ever ask you if I'm afraid about is your uh conclusion based on which I No, no, no. I know. I know. I know. But hear me out. >> Okay. >> Hear me out, please. I'm sorry. >> Sure. If I have to tell my mom who is sitting thousands of miles away like, "Mom, I'm sorry. I didn't realize." >> How old are you? >> I'm 38. >> You don't have to tell your mom anything. Okay. Do me a favor. Could you put your left foot on that line? Just like this. >> Right. >> Left. >> This one. Right. Left foot on the line. Just like that. >> On the line. >> Yep. And then your right foot heel to toe. Just like this. Now hold hands out to your side. Hold that position. Hold. Hands on to your side. Hands down to your side. Right here. Hands down to your side. All right. All right. Hold that position till I'm done explaining. Do you understand? >> Mhm. >> All right. When I tell you you're going to take nine heel toe steps. You're going to plant your lead foot, take a series of small steps, and take nine heel toe steps back. I'm going to demonstrate. Hold on. >> So, you're saying front and back. >> Watch my demonstration. Look at me. All right. From the starting position, I'm going to do three steps. You're going to do nine. Do you understand? Watch my demonstration. One, two, three, all the way to nine. Plant your lead foot. Take a series of small steps. >> One question. Do another plant. >> Two, three, all the way up to nine before you do the another three. One curious question. >> Whoa. Whoa. Whoa. Whoa. Okay. Try it again. There you go. You are a trained professional in one sense. Whatever sense you are trained professionally, I might be under and in your constitution. I might be under the influence of alcohol or I might be untr of the case scenarios. >> All right. Do you understand? I want me to explain them again. >> I do not. But I need to ask one question for clarity. >> Sure. >> I do not understand it. That's why I wanted to ask. >> That's fine. >> Either of the both scenarios. >> I could demonstrate again if you want. >> No, no, no, no. I don't care about the demonstration. >> My question is if I am raggling like this, would you consider this as drunk or just like untrue? >> I don't. Do you understand my instructions? Yes or no? >> Want me to reexlain it for you? >> No. >> So, >> it will not help me. >> What's not going to help you? Even though you reexplain it to me, it will be the same instruction. If you want me to conduct it, I will conduct it. >> Do you understand my in cuz if >> I will I don't not. >> Okay. Do you want me to demonstrate again? >> So I can't if you don't >> It's a loophole. I'm sorry. It's a loophole. >> So are you refusing to do the exercises? >> No, I'm doing the exercise. I'm down. >> So do you understand them? >> No, I don't understand. If you're not You don't understand. >> You don't explain those answers in my language. >> Explain me my language. >> I don't speak your language. There's a different language. >> Would you want me to demonstrate it again? >> I'll demonstrate it again. So, from the starting position, you're going to >> You want me to do that? I can do it. >> Nine steps. >> Nine heel toe steps. >> Nine, >> sir. Watch my demonstration and then I'll do it again cuz I There's clearly some confusion. Watch from the starting position. I'm going to do three. You're going to do nine. Watch my demonstration. One, two, three. All the way to nine. Take a series of small steps and take one 2 3 all the way to nine. Once you start, don't stop. Count every step aloud and keep your hands down to your side. Do you understand? You understand? All right. You may begin. >> I understand to your instructions. >> Okay. >> But not to the rules. >> That is the rules. >> Instructions, but not rules. There's a fine line difference in both of them. Nine steps. You said one. >> Nine heel toe steps. Plant your lead foot and take a series of small steps. >> One. >> That's not one. >> So watch my demonstration. >> So I can do this as my one. >> No, that's not exercise. >> Watch. We'll start. I'm going to get you in the starting position. >> Your left foot here. >> All right. >> Do it. Left foot. Your right foot. Heel to toe. >> Okay. >> Right foot. Next. >> And I'll do it. >> You have to do it. >> I'll do it. >> You're not doing it. >> All right. I'll do it. >> Hands out to the side just like I'm doing. >> All right. I'll do it. >> All right. I'm going to do three steps. You're going to do nine. Watch my demonstration. >> Hey. Hey. Hey. You You're doing the demonstration. I'm watching. So, that's why I'm saying >> you have to be in the starting position. >> That's why I'm saying I'm doing it. You do n three. I'll do nine. >> Okay. But you're not in the starting position. >> Sure. >> No, you're not. >> So, this is one. >> That's not one. >> So, you were saying >> So, I said, watch my demonstrate. Put your >> Go back to the starting position. I'm watching. >> Sure. Go back to the starting position. >> All right. Hold that position until I'm done explaining. Hands on to your side. Hold that position until I'm done explaining. >> All right. >> So, starting position, take a series of small steps. 1 2 3. All the way to nine. I did three. You do nine. You may begin. >> Count allow. 2 3 4 >> 4 5 6 7 8 9. >> You want me to go back >> the way I explained it to you? >> I need to hear it again. >> Plant your lead foot. Take a series of small steps and take nine heel toe steps back. >> Heel toes back like this. or >> plant plant that lead foot and take a series of small steps >> like this. >> The way I explained it to you, >> this or the other way around? >> The way I explain it to you, sir. >> I don't understand it. You need to show me a demo of back. >> All right. So, we're done with this. We're going to go on to the next one. >> 1 2 3 4 5 6 7 8 9. >> Okay, perfect. Come over here. >> Thank you. real quick. >> All right. Yeah. Yeah. >> You can come over here, sir. All right. So, the next one is a one leg stamp. All right. You could pick any foot you choose. When I tell you you could raise whatever foot you choose approximately six feet. >> You don't mind me putting my hands in my pocket? >> Just keep your hands out to your side for me, please. All right. >> Thank you. >> Here, let's come over here now that the road is being blocked off. All right. You can pick any foot of your choosing. Your left or your right. Doesn't matter. For demonstration purposes, I'm going to use my left foot. You're going to raise your left foot approximately 6 in off the ground. That's like a soda can, right? You're going to keep that foot parallel to the ground and you're going to count out loud. 100 1 2 100 3 until I tell you to stop. Watch my demonstration. I'm using my left foot. I'm raising it. 1,00 1,002 1003. >> If it looks helpful if I raise it in the back >> the way I instructed you. No other way other than how I instructed you. So, watch my demonstration. Using my left foot, raising approximately 6 in off the ground. 100,00 one 1002 until I tell you to stop. Okay. >> Not in the back. >> What's that? >> Not in the back. >> Not in the back. You're under arrest for driving under the influence. Don't tense up. You're going to get another charge if you tense up, sir. >> You're not. >> So, you're going to catch another charge if you tense up again. >> Stop resisting. >> I'm >> Stop resisting. >> Stop resisting cuz you're tensing your muscles. Stop resisting. >> I'm not. >> I'm sorry. >> Look forward. Stop touching your body. >> All right. This way. What else do you have on you? Do you have anything's going to poke me, stick me, or hurt me? >> No, just a phone. >> Just a phone. That could go with you to property and evidence. Okay. >> Can you do me a favor, please? Please, please, please. >> Can you just stop yelling? What's up? >> Can you please just give me a call to one of the friends? >> You're going to get a phone call after this process. >> I don't remember the number. >> You're going to have your phone with you. >> Oh, thank you.
