Like And she would just kept going and then she'd rev her car. And I was like, "Okay." And so, we like tried to get her out and then she kept revving her car. Then then backed up, we're like like she can't go anywhere, her tire is popped, but like we don't want to be next to it in case she like >> as you guys pulled up, she was turning her car trying to get out. >> Okay. So, you guys watched her hit this pole? >> Yes. Yes. We walked We were walking this way towards Lake Claire, and we had like walked through the parking lot and then crossed the street. Okay. Um just keep any tape for me if you don't mind. Is that Francesca? Yeah. I'm Officer Tembrado with the UCF Police Department. So, I'm going to be doing the traffic crash investigation. With that in mind, there's a couple things I want to ask you, okay? Um Do you remember hitting anything? At all. Nothing at all. Okay. Is this your car or is it like mom's car, dad's car? >> It's your car? Okay. Um Do you know how many things you hit tonight? I didn't hit anything. Didn't hit anything? Okay. Okay. Um well, are you aware now that you hit something? I didn't hit anything. So, even right now you still don't think you hit anything? At all. Okay. Okay. Were you wearing your seatbelt this whole night? I was. Okay. Okay. In approximately how fast do you think you were driving in this parking lot? Probably 55. You were driving 55 mph in this parking lot? Okay. Do you know where you're at right now? No. No? Okay. You're on the UCF main campus in Orlando, Florida. Um and you were involved in a traffic accident, multiple traffic accidents, based off of the damage on your vehicle as well as the damage that's scattered throughout this parking lot. So, you've hit multiple curbs, okay, and then you've also hit a light pole right here. Okay, so I'm I'm letting you know that now. You said you didn't hit anything. You did. Okay, then there's substantial damage all over your vehicle. Right. Okay. Um are you aware that you have no front driver's side tire? No. No? Okay. Have you had anything to drink tonight? No. You had nothing to drink tonight? >> At all. Anything to smoke tonight? No. Anything to inject tonight? No. Okay. Do you typically Do you do any drugs at all? So, I'm going to let you know that again, this is for my traffic crash investigation, right? Um based off of everything, you are found at fault for this crash, okay? Uh I have no assessment of the damage yet cuz I haven't done a full workup of all of the different things that you've hit. And I'm just finding out now that there might be more stuff that you hit, okay? Has anybody asked you if you need a medical attention? No. No? Okay. Um so again, you're going to be found at fault for this traffic crash, okay? So, what you're what's going to happen is the email that you provided to me, I'm going to do my traffic crash investigation, you're going to get a form, okay? It's going to have all of your information. It's going to get sent to the email that you just provided me with. Are you a student here on campus? I'm not. Are you a student anywhere? I'm not. Okay. Okay. And how old are you? I'm 26. 26? Okay. Okay. Um again, right? So, just to reiterate, you are going to be found at fault for this traffic crash. Um I I don't know the extent of the damages right now. It's a normal. I'm sorry? It's a normal. What do you mean it's normal? Because you said I'm on a crash Correct. for this accident. Correct. >> I'm not understanding what the incident. So, you've hit multiple different curbs. What's the multiple different curbs? The multiple different curbs is what you're trying to say? Okay, so for starters, there is still part of your vehicle laying over there from the curb you hit. Okay? I haven't done >> I I I haven't found the exact amount yet. Okay. Okay. Also, the light pole that you hit >> Right. that your car is parked up against. >> What's the light pole? Where's the light pole? >> Where's the light pole? Take a look to your left. Okay. It's right there. Okay. Okay. So, there's multiple different things you hit. I'm going to do a full workup to see if there's anything else that's been hit based off of cameras and everything else, okay? So, once that is done, um the traffic crash accident form itself, you can get the >> accident? What do you mean, what's the accident? What's the accident? What do you mean, where's the accident? The accident you've been in. What's the accident you've been in? You hit multiple curbs. >> Where's the curbs? Okay, I'm not going to explain it to you multiple times. Okay. >> Okay, I've already said it to you three times. >> That's it. Okay? That's it. You were involved in a crash, you hit multiple curbs, there are parts of your vehicle right there. You also hit the >> I don't need you explaining explaining yourself anymore. Okay. All right, well I've concluded my traffic crash investigation, okay? Another officer is going to come over here and speak to you about something completely different, okay? >> That's correct. Officer Torrado. Just to confirm, when you walked up to her driver's side, she was still revving her engine, right? >> Yeah. Tried it twice. So, mace baseball bat Mace baseball bat >> bat was tucked right there by the driver's seat. I saw it when I was trying to grab her out. I couldn't. Not from my side, at least. No registration. Is that her ID right there? Where? No, that's her ID's from Delta. Pocket knife. Yeah, there's a pocket knife, a couple of them. >> the spray at? In here. In the center console? >> In the center console. I can't find her ID anywhere, though. >> was found in the center console or the glove compartment? >> No. There's a bag back here. She said her I'm searching her bag. There's a vape. It's a nicotine vape, though. She gave me consent to search the car, anyways. Hey, Francesca. Hi. >> I'm back. >> Okay, so I got to explain a couple of things, right? At this point, the crash investigation has concluded, right? >> What crash? There was a crash. Where? Right now, your car is in in a pole. Your front right your front tire left tire Okay, is anybody injured? No, no one's injured. You were the only one who was in the car. >> That's it. Perfect. That's it. >> So, there was a crash that occurred. Right. >> Right? And that's what I saw when I was when I when I showed up. >> Where's the injured? There is no injured. >> Okay, that's good. There is a crash that occurred between your vehicle that you were in and a light There's nobody injured, right? Are you injured? I'm not. Then no one's injured. I'm asking. I'm telling. Okay. So, the crash investigation has concluded, right? At this point we are switching the hats. I'm going to be responsible for a criminal investigation. Potent the under reasonable suspicion that you may be operating a vehicle under the influence of alcohol, chemical, or controlled substance, okay? Because of that, I got to read your Miranda warnings, all right? So, I'm going to read this out. Every time I finish a statement, I'm just going to ask if you understand, yes or no, okay? Just respond with a yes and then we'll go from there, okay? Right? All right. You have the right to remain silent. Yes, you understand? I need an audible yes or no. >> I'm silent. Okay, so I'm going to keep reading these Third. Third, right? I need you to Anything you say will be used um in court as evidence against you. You're entitled to talk to an attorney now and have them present uh now or at any time during questioning. I haven't finished yet. Okay. If you cannot afford to hire an attorney, one will be appointed for you without cost. Do you desire to consult with an attorney first or have one during this interview? Where's the attorney? Again, I'm just reading your Miranda warnings, okay? Okay, so your questions is not valid. Okay. If at any time herein you wish to remain silent, have an attorney, all questioning will be stopped. Has anyone at any time threatened, coerced, or promised you anything in order to induce you to make a statement right now? Francesca? It said I got the right to remain silent, right? You're right, but this is this is not That's it. Francesca That's it. That's it. >> Francesca, I just need you to listen to understand, right? I'm not asking you any incriminating questions right now. I'm asking if you understand what I'm telling you. Do you understand what I have been telling you? I'm asking if you understand what I'm telling you. >> to remain silent. You're right, but I need to understand Okay. >> So, do you understand these rights? Again, not asking any incriminating questions. >> I don't need a lawyer to ask you your Miranda >> don't need a lawyer to ask you your Miranda rights. >> the lawyer. >> All right, perfect. So, I'm assuming at this time because you've been saying that you want to call a lawyer, you want to induct your um your right >> the lawyer. You're right. Um you're inducting your single right. Got it. Your Amendment 5 rights. >> However, I need to continue with my investigation, right? >> Exactly. As long as the lawyer is in presence right now. Perfect. In presence? In presence. >> In presence. >> Presence. Presence. Got it. So, I am going to continue with my investigation, right? I will not be asking you any incriminating questions. >> answer any questions without my lawyer being present right now. >> Perfect. I'm not asking you any questions. >> Okay. I am going to ask you if if you are willing to conduct standardized field sobriety exercises. >> I do not consent. >> You do not consent. Perfect. So, I do need to inform you Hold on. >> consent. >> You don't have to consent, but I do need to inform you of your adverse >> You don't have to consent. But, I do need to inform you >> not consent. >> Perfect. I need to inform you of your adverse I >> I need you to listen to understand and not just listen to talk, okay? >> consent. Okay. So, I need to advise you of your adverse consequences. I'm still going to advise you as you say that you do not consent. >> I'm over here trapped. Look, you see my both hands? Yes. Okay, I'm trapped. I can't move nowhere. So, I do not consent with any lawyers being present >> Perfect. >> to any ask or questions that you have. I'm not asking you any >> is present, I'm going to ask your questions. >> Perfect. Francesca, I'm not asking you any incriminating questions. >> That's it, baby. Perfect. So, >> have to ask me any questions at all. Any incriminating or no incriminating. As long as my lawyer is not questioned I'm not questioning a lawyer, I am. So, adverse consequences basically mean that I'm going to have to take the totality of the circumstances to include the traffic crash investigation and my interaction with you. And I have to take that all to make my decision whether or not you're going to be arrested for DUI tonight, right?
