I ain't got no criminal. >> No one wants to see her facing serious consequences, but letting a 12-year-old [music] take the wheel went too far. On June 7th, 2023, patrol officers stopped a vehicle after noticing it moving unsafeely [music] and veering onto the curb in a neighborhood where children were nearby. When they [music] approached, the biggest surprise wasn't the vehicle. It was that the driver was only 12 years old. In that moment, responsibility rested not with the child, but with the adult who allowed it to happen. >> What's going on? >> Hey, you guys, listen. You You can't have the kids come here. Come here and talk to us really quick. You can't you can't you can't leave yet. Come here and talk to it. Ma'am, will you guys stop? >> Oh, me. I'm a kid, >> ma'am. Hey, ma'am. Don't Don't make it anything. It's not. Okay. >> It's not even us. >> Stop. Okay, we'll just tow the car. That's fine. I'll just tow it. >> Nope. It's going to get towed. >> Yeah, it'll get towed. No, no, no. Stay. Stay back there. Don't come up to me. >> I'm not doing that. >> Go over there. >> What? >> Because I said so. What happened? >> Relax. >> Relax. >> Go. >> What's that mean? It means we fix quality of life issues. >> Hold on. >> Ma'am, you're just going to have a seat till you get identified. We're going to tow your car and that's all there is to it. >> Yeah. Young lady, how old are you? >> Okay. >> I'm walk past you. >> I appreciate you. >> Just have a seat so we can ID you, ma'am. Just have a seat so we can ID you. It doesn't need to be all this. >> I ain't even did nothing. >> Okay. I'm sure you did. >> I didn't take your purse off. >> Except for letting a 13-year-old drive. >> It's not that the 13-year-old drive. Listen, listen. >> Take your purse off. Take your purse off. Take your purse off. Take your purse off. >> Listen. I don't have no weapons. That's >> Take your purse off. I'm just saying. >> I got to get my phone. >> Hey. Hey. Hey. No one's No one's asking you. >> I need to get my phone. >> Hey, listen. No one's asking. We're going to go in handcuffs for just >> My arm is broke. >> Okay. We're trying not to We're trying not to do this. >> My arm's been broke. >> Let go of your purse. Stop. Stop. >> Let go of your purse. WHAT ARE YOU DOING? >> I JUST REBROKE my whole arm. I just rebroke my arm. I swear to God your arm. >> I swear to God. Go get my son. >> All right. YOU'RE GOING IN MY ARM. >> WELL, we can have a sergeant come out. You're going to go into >> cuz the way you're acting, I don't know if there's a weapon in there or what. >> Ain't no weapon right there. That little Hey, >> step back. >> Hey, get my son out of my arm. They just >> re back my arm. Stop. >> Stop. My arm. Stop. My arm IS BROKEN. AND I'M TRYING TO PUT an extra set of cups on you. I believe it, but we're trying to. She will not listen to us. >> Do you realize how you're acting right now? >> This is all on you and no one else. So, act like an adult. >> I'm not I'm not doing nothing. >> No, you are. You're being You're resisting. You're resisting. No, I'm not. >> Yes, that's exactly what you're doing. I don't want nothing to happen to your arm, but you're going to go in HANDCUFFS FOR MY SAFETY AND YOUR SAFETY. >> BROKE. It's broke. >> Oh my god. Kev, CALL YOUR GRANNY. CALL YOUR GRANNY. >> I GOT HER DOWN. WHICH ARM? >> NO, I can't go behind. >> She can't pull that. Pull pull that bastard. >> Okay, let's go in front then. We'll go in front. Okay. Well, I'm I'm going to I'm going to call my sergeant because I think your actions are what caused it to break and not mine. Okay. We'll be more happy to call our purse. >> Get my purse. >> I got it. Don't worry. I got it. I got it. >> I got it. Do me a favor, you guys. Do me a favor. Just step on over there for me, please. >> Yeah. >> Little man, go to your house, okay? Before I call children services. >> What? As the situation with a woman gradually settled, officers still [music] had difficulty getting cooperation from the young girl. At that age, emotional reactions often come more from confusion than understanding. >> There you go. That's a good way to talk. Actually, you know what? Come here as well. You were You were driving, correct? Come over here and talk to me. Huh? >> Come on. >> Yeah. Come on over here. >> Relax. Hey, you're just going to be You're just going to be talked to, but I'm not going to put you in the back of the car. I'm going to have you stand right there. But if you try to run or walk away, >> you got to go find my dad. >> Yeah. You're going to walk to the front of my car, though. >> What? >> Walk to the front of my car. Okay. >> Right here. Right here. Just walk right here. Walk right here. Right here to the front of my car. >> Hey, my actions didn't lead to this. You're good. Okay. I'm trying to be cooperative with you. I can't have you walking away and stuff. >> Go get dad, bro. >> Go get your dad. That's all. >> GO GET DAD. Go get >> just step over here. Just >> over there, bro. out. >> Uh, I would say behind the 900 block of Danner or 900 block of Danner, >> bro. >> Yeah, if you don't mind, I'll Dad's going to come over, so I'm sure I'll talk to him. >> Hello, Mr. Nicholson. >> What happened? Well, I'll tell you. I'll tell you. Come over here. >> You see the way it's parked? >> Yeah. >> That's cuz your 13-year-old daughter was driving. >> 12. >> 12? I'm sorry. She said driving the car. >> She told me to. >> So, where your mama at? >> At home cooking. >> So, we see the car driving kind of erratic. They pull in here. They're hitting curves. So, as we come up, they're all switching seats, jumping out. >> I got to be out here. >> I got I got She's the driver. She's not in trouble. 12-year-old kid. I don't They just have an attitude, and that's fine. I mean, that's I get it. This lady, who is she? Their aunt. her mom's friend. >> Her mom's friend. Okay. >> Okay. So, that's Yeah. So, she's I don't know if she's intoxicated or what, but she's having her drive. So, like I said, your daughter's not in trouble. We are just going to need her info for the report. She's the one that's in trouble. I just wanted to make sure a parent was over here that could take responsibility for the children since she's obviously not a capable adult to do so. So, if we could just get her name, her date of birth, we'll get your phone number and address, and then we'll we'll go from there till we cut loose. Okay. Hey, ma'am. Hey. Hey. Listen to me really quick. All right. We cuffed you in the front because your arm. Okay. >> Yeah. >> I can't have you trying to pull on doors and stuff. >> No. No. I just want to get my phone. >> Whose car is it? >> My son. >> Where's your son at? >> I need What's his name? >> I need to get my phone. >> My [snorts] phone. That's all I'm asking. Can I I'm in handcuffs. Can I get my phone? >> We'll get your stuff. We will get your stuff. But you need to be cooperative with us. Okay. >> Now, now you are. >> We This did not need to go anywhere near this way. >> Ma'am, our our body cameras will show I can do anything without your consent. >> Listen, our body cams will show otherwise. >> Reboke my arm >> and we'll we will take you to the hospital. But here's the thing. We were trying to handcuff you due to your actions. All right? If your arm was broken and it's rebroken, we will take you to the hospital. We will get you checked out before you go to jail. Absolutely. But right now, you're in the backseat of a car because of your actions and no one else's. Letting a 12-year-old drive probably not the smartest thing to do. So, I need you to just relax. All right. And we're going to figure it out. >> Can I just get my phone? >> No. It's Campo coming out. >> Yeah. >> All right. What's up? >> I really need my phone. >> Why do you really need your phone? >> Because I have surgery and everything due up. I just got that phone. >> Well, we're going to get your phone. I'm not going to leave here without your phone. Get it out the front seat, please. >> Where's it at? Front seat. Where? >> Front seat. It's a black and white case. I just make need to make sure don't nobody take my phone. >> I will make sure nobody takes I'll grab it right now. >> Grab it. >> All right. >> The child's decision to drive ended up drawing several adults into the situation, showing how one poor judgment call can ripple outward and affect many people. >> Hi, ma'am. >> Why Why are you letting your kids go? >> I didn't know. >> Who's your friend? >> She's my friend, but I didn't know they was driving. >> Well, I'm not saying that, but she's obviously intoxicated. You 12 being 12. You could have heard her kill or kill himself or anything. How you got off that? [ __ ] you 12 years old. >> Yeah, it's going to be >> She could have told some [ __ ] up. That's why they put you running up on [ __ ] man. >> I didn't even I was in there cooking. I got flowers and [ __ ] on. >> Your kids aren't in trouble. They're I mean, they're kids, but it's just it's her decision. It's not a 12-year-old or I don't know how old little man is, but >> you was in there, too. I thought y'all cuz they was sitting right there. I'm like I'm She pulled up. She was talking to the kids. I'm in there cooking and I got my stuff. >> Like I said, they're not in trouble for anything. They're just they they're just kids. Like she is in trouble for us. So, um you you guys are good to take your kids. We We have the info of your daughter. You they're not getting a ticket or anything. She's 12 years old. They're just You just got to take your kids home to a safe place and we'll deal with her. Okay. >> Okay. So, ain't no way I can help her? >> No. I mean, we're not towing the car. She says it's her sons. I'm going to have him come move it. I'm not going to tow his car. I got license. >> Yeah. No, I'm not going to tow her car for >> She's going to jail. >> She will be going to jail. Yeah. She's not only allowing a 12-year-old to drive, she's also intoxicated and allowing a 12-year-old to drive. So, >> a relative arrived worried about her physical well-being [music] and concerned that a vehicle registered in their name was now tied up in official procedures. >> Listen, if you hand you can't hand you can't wait a minute, you can't handcuff her because her her arm is messed up. >> So, she's handcuffed in the front >> like this. >> Yeah. Yeah. And that's after her her being super combative and we tried to cuff her in the back. She said her arm must have been rebroken. >> So we are going to get medical treatment for >> but I mean this is all kind of a moot point if she's cooperative with us. We don't have to put her in handcuffs or anything. >> Yeah. Yeah. Cuz her arm is >> So and once and once she continues to say that we did we put her in the front. So >> what's she back there hauling for? What the hell wrong? Wait a minute. >> Well, I think she's slightly intoxicated and >> can I talk to her for one second? >> Hold on. Give me one sec cuz my sergeant's got to um do his job and then before we leave, ma'am, I promise I'll let you. >> Wait a minute. >> He's trying to do his investigation, but as you can see, she's not cooperating just like she hasn't been the entire shut the up. Tell her I said that. >> Well, I'll let I'll let I'll let mom talk to her. I'm sure mom can put a little Well, give me a sec. Give me a sec. He's got to do his job first. >> I don't know. >> SHE CRYING. >> WAIT A MINUTE. >> Her arm. >> YEAH. >> WAIT A MINUTE. N RELAX, NATE. All right. Do me a favor. If we could if we could just go back here. >> Her arm is messed up. >> Pulling it back. >> No, but her arm is really like really pull it back. >> Yeah. >> Her arm is her arm is really pull her arm back like that. >> She was going in handcuffs. >> But see, you have to Her arm is so messed up, man. >> Well, hear me out. I I don't know that. I know that someone is telling you. >> I know that someone's being resistive. She didn't tell us until we started doing >> I told you that though. Y'all told me to get back. Yeah, you're right. You're right. You're right. Because we don't let people come and interfere with our arrest because I don't know him coming out here for I got a job to do, right? >> Like this. Yes, ma'am. >> Okay. >> It's okay. She going to go to the [laughter] hospital. >> Well, she let a 12-year-old drive her car while she's intoxicated. It's not completely on us, okay? We're doing our job to try to >> Okay. We're not We're not speaking in uh >> y'all might need to have to call the ambulance. >> We have an ambulance on the way, man. >> So, is she going to jail or what? >> She's going to go to jail for what? for resisting arrest. >> For resisting arrest, don't take her to jail. >> Resisting arrest, >> man. You know, I'm always cooperative with everybody. I try to do what I can, but I mean, she's the one that's cooperative letting the 12-year-old drive. >> That's That's just unacceptable. The 12-year-old hit. Is that your car? Whose car is that? >> Where? >> The Pontiac. >> My car. >> Okay. Cuz the 12-year-old hit the curb like three or four times. >> That's That's not safe for anybody. There's kids out here playing and then we're trying to do our job when we get things going. No, we you're not getting yelled at for that. You're just getting yelled at for >> my man right here is kind of yelling. >> No, but her arm is really up. Like I >> And I sympathize with that, but when we're doing our job and telling her to just calm down and she won't give us her purse or anything, we don't know if she has a weapon or anything, but our job is to protect ourselves and everyone else around. >> I totally understand that. It's just, you know, I guess you see what it is. It's all It's okay. She >> Yeah, cuz she's her arm is really really really >> And I get that. If she would have cooperated and said, "Hey, my arm's messed up." Then we would have never put her in handcuffs. >> Yeah. She got to go to the hospital. She's not >> We'll take her to the hospital. We'll make sure that the >> MLM's coming. >> Yeah, you can hear them. >> I didn't know it was the MLM coming here or not. >> Yeah, we're not we're not trying to hide anything or we want to help her, but at the same time, we got a job to do, and that's to protect the citizen. A 12-year-old driving with an intoxicated subject in the passenger seat. That's not protecting the citiz. >> Thank you. >> Uh her daughter. >> Whose keys are being? >> These are mine. The car is being towed. >> Can I get her phone out the car? Why is the car being towed? >> For safekeeping. >> For what? for safekeeping. Are you the registered owner? Is it in your name? >> Wait a minute. I just need to know exactly why she told >> for safekeeping. >> What does that mean? >> She allowed a 12-year-old to drive her car, which is a crime, right? So, that was used in a crime. So, we're going to tow the car. No one can let a 12-year-old drive that car. Unless the registered owner gets here before Sandy's does, we'd be more than happy to give her the car. Give them the car, >> right? So, there's no way. >> Is it your car? >> Yes, it's my car. >> Is it in your name? >> Yeah. >> What's your name? >> What's your name? >> My name's Officer Irwin, ma'am. Huh? Okay. So, >> ma'am, what's the phone look like? >> What does this person say? >> I asked him and he walked away. >> What? What is that with a phone look like? >> Yeah, I try to look. >> Inside the patrol [music] car, emotions ran high as the woman repeatedly spoke about her health, leading officers to conduct appropriate checks. Even during a tense moment, [music] standard care and procedures were still followed. >> That's my humorous. I've been going through this for a year. Therapy? I've been doing therapy for a year. Well, the medics are here to do their job. >> I got a lie about money. I'm not going to lie. >> Nobody's accusing you. >> I've been going to domestic violence for somebody that broke my arm. >> Ma'am, can we look at you? >> Okay. Can I open your door? >> I ain't for nobody trying to take me to jail. I ain't no criminal. I'm not no criminal. I'm not a criminal. Y going to tell the car to y going to try to take me to jail. Wait for real. A lot of [ __ ] that be going around here. Y'all trying to take me to jail. >> Man, >> you want us here or not? >> Yes. >> Okay, >> man. They rebroke my arm, mama. They rebroke my back. Let them take you to the hospital and relax. Go to the hospital at >> You got my phone. Stop. I don't need no address. I still talk to my family, though. I'm not a I'm not a criminal. >> You want to go to the hospital? >> I don't want to go to the house. You still need to talk to my family. Do >> you want us still? >> Do you want us to take you? You want somebody else? >> Okay. You want somebody else to take you? What do you want to do? >> All right. Step on up there, >> mama. >> Step on up there. Mom's telling you to step up there as well. >> What's up? Oh my god. >> Is it possible to have her uncuff? >> Yeah, absolutely not. >> I'm not a criminal. >> Nothing. I got one kid. I ain't got no take off. >> They're taking off right now. [laughter] So, what happened that you you think you're >> I was just letting they he forced my arm behind my back and it was >> You think that because they put it behind your back that it broke your >> I feel it. I feel it. My humorous was broke. >> Okay, I'm gonna feel around. Okay. >> Okay. Just feel I'm just feeling Make sure. So, they both feel the same. >> No, it's right here. >> It's right here. >> Okay. Did you feel a cop or a crack? >> Did you? Okay. Do me a favor. Sit back for me. Sit back. >> I'm not a criminal at all. >> Ma'am, I at this point I'm not concerned with that. I'm not concerned. I'm >> not a criminal. I swear I'm not. >> If you say that one more time, ma'am, look at me. >> What? >> We're going to get one. Thank you straight. If you say that you're not a criminal one more time, I'm going to kick you ass find another way to offer. Okay. Okay. Yes. Do you understand it? Yes or no? Okay. I'm concerned only with your health. Okay. We're going to deal with that. Okay. All right. Do me a favor. Try to raise your arm for me. >> It's not going to rain. >> It's not racing. Okay. We'll just leave it at that. Which hospital do you prefer? >> Which one do you prefer? >> Valley or Grandio? >> I'm going to go to the Valley cuz the Grandio was the one that played me. Is that you? >> Yeah. >> If you want to tell Lang. >> All right. I'm going to ride with you. Hey, just give me one sec. >> I was supposed to get surgery. Last time I seen the doctor was at Victor Casano down the street on the 17th of May. I was supposed to be getting scheduled for my surgery, which is they didn't give me a designated time when it was scheduled, but I'm supposed to be getting scheduled for surgery for my arm. supposed to manipulate my shoulder to make it cuz I can't bend my elbow or anything. >> That being said, it's been like that for a year. On May 21st, 2023, a man drove to a police station asking for help, saying the woman in the passenger seat, his wife, had behaved in ways that worried him while children were still in the vehicle. Officers stepped in quickly. She was still holding objects that could be unsafe and was not ready to cooperate. All right. >> Hey, PUT THE SCISSORS DOWN. You >> mind hanging up the phone? >> Hey, let me call you back later, man. >> All right. >> With emotions running high, officers separated the two adults to calm the situation and collect information from each side. The father began sharing his version of events. >> What's up, bro? >> What's going on, dude? >> Okay. I've been in the hospital cuz I had it cool out. >> All right. She done had my truck for the last 4 days. Ain't came to the house. Ain't did [ __ ] First of all, we don't even live together. Sergeant Larry had to do the uh police report. Some other girl brought my keys to me last night. She said she don't want to stay there. I ain't got no problem with you when not standing at the house. It ain't no problem. So, I'm going to take you to your friend's house. That's over on Mercy Drive. I'm taking you to your friend's house. But they have two kids in the car, too. >> Are the kids both yours? >> Are the kids yours, too? >> The two girls are hers that I I raised up. The boy that's in the back is mine. The young the three that's at the house is mine with her. I only have two kids with her. >> He didn't cut my son, too. drink out of the car. I did. I didn't touch me yet. >> I got it. I understand. You can do it. >> I got you. >> While things were still being sorted out, the woman repeatedly answered phone calls and did not respond to requests for cooperation. >> I can't. >> Try to have a seat. >> I can't breathe. >> You want to sit down the curb? Look. Come sit on the curb over here. >> I'm >> sit on the curb. Sit in the curb. Try to relax. >> See how tired I am. I'm tired. I'm tired. >> Ma'am, try to have a seat on the curb. We're investigating a crime. >> Hey, what crime I committed? >> You said he said he was going to hurt you? >> He did? >> Okay. And he said that you pulled out of the scissors. >> I did. >> Okay. So, we're trying to figure out what happened. >> Investigation. That's not what happened. We're trying to get to the bottom of it because if he's saying he's going to hurt you, that could be a crime. If you're pulling out scissors, that could be a crime. So, we're trying to figure out what happens. >> If he wouldn't touch me, sir, I'm touching me. >> I'm going your side. I didn't get his side. The officers over there are going to get his side. >> But he's a liar. He ain't on the mayor. >> I'm sure he's going to say you're a liar. >> He is a narcissist. >> Okay. >> You know what it is? >> Yeah. Like a >> He's a narcissist. He will manipulate and make it seem like he didn't do nothing wrong and anybody did everything else to him. That's what he do. Not him doing the damn he knowing the mayor. You should probably see what happened. It's raining a little hard. Are you sure you don't want to go underneath your own? >> We have a little awning over here. You can stand in. I don't want you to get too wet. >> Many family disagreements can be resolved calmly, but in this case, three sensitive factors appeared at once. a legal marital relationship, objects that raised safety concerns, and children present. When these elements overlap, officers must proceed carefully, even if everybody appears safe. >> So you don't get wet. And actually, you know what? Once you come out, get your bottle. Is that okay? >> Close my door to my car. Am I trying to get wet inside? >> You want him to close it? >> Yeah. The AC is on. >> I don't know. >> Okay. What's going on? Can you tell me what happened? When I was leaving the house, I came in the house, help me get his medicine. He called me and said, "Hey, I need my medicine." So, I came while I was at my my door to my daughter. You see got his twisties on. Was at resort, my sister, okay, for my daughter's birthday this weekend. I got work next weekend. So, boom. I came, I got his prescription. He said, "You see the receipts that was in the car?" I said, "Only I see is in the middle console." So, he jumped out at Walgreens, went to Walgreens, get his medicine. I came in the car. He start yelling and stuff like he's throwing my my damn receipts away. Mying money. What receipt you talking about? I ain't throw nothing away when I vacuum. I just vacuum and wash outside the car. So I throw away the way. Only thing I throw away is my kids stuff my stuff. Your stuff I leave that in there. So he was like, "Well, you always touch." So we got to the house. He said, "Start throw all my stuff out the car." I said, "Man, you put my in that car and take me to my sister out. Take my sister out. Leave me alone. Take my sister out. That's all you got to do now. Leave you alone. Don't call me good." Going now. You know this extra push me start laughing. It's funny. I said, "Kevin, you think it's funny? Don't touch me. I'm good. Don't touch me. picture to the house. I'm supposed to the whole time. I grab the suspect on my side cuz I know him and we going and he got mad cuz I'm over talking to him. Now this is what he said. I was dashing fat hole and like that. He turned around you know what he turned around and came here. I had knife. I had sisters in my head. I sure did cuz you not going to touch me but my kids don't. And I told him I will kill you. Don't do that. I will kill you when I can't go to jail. I told him that. I meant that. And now he's man already his son anyway. Mom trying to do mom. >> Mom, I tried to leave. Mom. Mom, I tried to leave and it's Kevin. Mom, it's Kevin. He going to let me go. >> For what? >> For what? I'm getting arrested. >> For what? GET MY PHONE. For what? >> For what though? From what? >> From what? >> I need you. >> As [ __ ] man. Man, >> man. Come on, man. That's crazy as [ __ ] Why? Can you explain it to me? >> No, you didn't explain to me why he cussed me. >> Who is he? >> The officer arrest me. >> NO. TELL ME WHY YOU ARRESTED ME FIRST. HE'S UNDER arrest for what? Rest for what? Behind us. >> Aggravated assault. >> Yes, ma'am. >> For what? So on me, he ain't here to jail either. For real. My king my >> man. LET ME SEE MY MAN. COME ON, MAN. >> NO, MAN. Hell no. Come on, man. That's wrong, man. No. No. >> The mother was charged with aggravated, domestic, and child. Under Florida law, she could face up to 10 years in prison and a $10,000 [music] fine. Sometimes knowing when to pause, manage emotions, and create a sense of security for children matters more than proving who is right or wrong. Children don't choose the situations around them, but adults can choose to respond with greater care and awareness. Adults often don't think about the impact of arguing in front of their children until support services have to step in to help make sure the environment stays safe. >> She is getting arrested for domestic family offense. we have to uh send the kid to CSV. >> On August 25th, 2025, officers were sent to a home after a report of a disagreement between two adults related to child custody. When they arrived, emotions were still running high with continued verbal exchanges showing the situation had become difficult to manage. >> Hey guys, go up there. talk to me. >> Can you guys go up there, please? >> Like what? My mom at my mama house. My house here at my mama house. You talking about >> So can someone tell me what's going on? >> She at my mama house at what 4 IN THE MORNING. THEN SHE YEAH, IT'S HERE. THEN she pulled back up. Talk about she want to fight. Talk about report that she ready to fight. Come off the porch. She pulled up with her babies. Talk about some come off the porch. She ready to fight. So we're here to fight. Why are you >> calling? That's a ride. That's a ride. YOU AIN'T GOT NO RIDE. I HAVE A CAR. HE HAS MY KEYS. Shut up. In your in your house. >> Shut the up. DO YOU WANT TO GO TO JAIL? Do you want to go to jail? >> Then back the up. >> Okay. >> And you shut up or you're going to go TO JAIL. SHUT UP. WHAT? >> WELL, you guys are cussing, SO IT'S DISORDERLY CONDUCT. YEAH, you guys can shut up. >> Tell her to leave. She pulled up the police. >> Okay, I'm trying to resolve the situation. She's not I'm trying to, but you keep screaming. >> Dear, what are you guys doing here? >> My son is in there. HE HAS MY TEETH. >> HE WON'T GIVE me my teeth. HE WON'T >> SHE CAME HERE TO FIGHT ME AND SHE HAS Who's this? >> This is my baby mom. She came here last night. I I called the police on her cuz she hit me up on camera. Do you guys or do you guys do you guys have shared custody? >> No, we don't HAVE CUSTODY OF MY SON. >> She doesn't have full custody. We don't have no legal agreement where the kid did you let him get the kid. >> No, he came here climbed over her son. >> My kid, she's not even supposed to be here. She has a warrant for my son. >> She came here to fight me again. She just came fight me last night. I called the police last night. They told me if you see her again, call her cuz she has a warrant for domestic violence. >> Yes, I have the camera. I have the video right now. >> Yeah, sure. This is what happened last night. >> What's What's her name? >> And you already showed the docs. >> Yes, they showed us. Yes. >> All right. >> Earlier, the mother had an unresolved matter with authorities. And returning at that time did not appear to be a constructive choice. Instead, bringing her into direct contact with that issue. >> I I don't know. I guess she pulled up to fight him and they're just all yelling and screaming. >> Officer, >> she's talking about about her keys and my son, but the officer came last night like they told me. She came she came back to get her keys last night, but she was driving crazy with my son. So after a situation where she fought me, I heard took her keys out my car out her car, right? They came back, the officer told me like that's a civil matter. Like you got to go to court for the keys and as for my son, she pulled up here to fight, but my baby's in the car. Like so I grabbed him out like you you trying to fight. my other day. Mom, like it's it's all trash. >> Hey, dear. I'm have you step out the car real quick. >> Face that way. >> You put me in jail. >> Put your hands on your Stop. Stop. >> Now, get back up. Get back. >> You got shoes? >> He took them. >> Okay, I'll get We'll try and get those for you. All right. >> Okay. >> You know you got a warrant from last night. >> We should pro probably not came back here if you knew you had a warrant. >> I don't care. Stupid. >> Shut up. There's a woman with TV. They probably last night. >> Yeah, it's probably >> Can we not leave till my mom get here? >> She's coming to get my son. >> Well, he's the father, so it's >> But I don't want him with my son. I want my mom I want my mom to get him. He can't stay here with her. >> Well, he stays here. He >> doesn't live here. No. No. Why can't my mom take the seat? Why can't >> Sorry. Sorry. I'm keeping your son. Sorry. Hi, son. Thank you. >> Where's your kid at? >> This is the dad. >> Solve the problem. Just send her >> for a warrant. Uh, it sound it sounds like they signed a warrant on you for domestic. >> Okay. Well, you probably shouldn't have came back here cuz now we have to send you to jail. >> Going to roll her window so mom can talk to her. Hey, mom. >> Well, they ain't going to give him to me because she has nowhere to go. Like, how can he take my son? He don't have no >> What? Why is it brown and stuff on your hair? >> Cuz he put his hands on me. I have bruises all over. >> So, you still can't get your keys to your car? No, they're not getting nothing for me. My keys, my phone, nothing. >> This is absolutely crazy. So, he's just going to be out here just riding around in your car. >> Exactly. Like, where's that car? >> Where's the car at? >> It's parked at my friend's house on Eastland. >> Am I able to get my phone to tell my friend like my >> She's supposed to be the girl supposed to be on her way over here. That's what >> Where's your phone at? My friend, >> we can take We can send your phone to county if you want. >> Okay. >> If you want it, >> they taking you. >> Yeah. warrant for last night before my hand. >> Do you have a warrant for uh EV? >> Yeah, I know. But see, that's what I'm talking about. >> Kind of that was that was >> that was dropped. >> That was uh that was a >> whatever happened last night, they signed a warrant on her for domestic. >> Um with domestic, we don't have any leniency of not the center county. If it was something else like or like a theft or something, we could give her a summon. But by law, we have to ship her. >> Okay? Because if if we say we let her go on that, she comes back and dust arm, we're at fault for that. We we could get fired. >> There's no there's no gray area with >> I can I can see what I can do. I can't guarantee, but I definitely get your phone. Okay. >> Even a relative noted that both adults were struggling to regulate their emotions and step back from the conflict. When no one makes the effort to calm things down, family disagreements can easily grow beyond what anyone intended. Do you have her phone? Her cell phone? >> Dude, I'm going to She's going to take it to county with her. Okay. >> So, what about her keys to her car? >> I can try and get those. I mean, >> cuz how is he able to keep her keys? >> It all depends. Like, if she lets him drive the car all the time or they live together and they share the car, it's kind of for us for determining if he's allowed to have it or not. >> That's crazy, right? Even though it's in her name, >> right, >> he can still keep the keys because he drives. >> Wow. >> Does he even got license? >> I don't know. I can I can try and get the keys from him. >> Yes. Because I don't think that's fair because then what if he purposely do something to her car just because of the situation? >> Well, then she could file an insurance claim and go from there. But like I was telling mom like with domestic there's not a gray area that >> Yeah. They don't play about that. >> You know, just cuz you know you live with somebody and creates a a conflict. You know, >> you can't just go back to that person after you know they at each other. >> Right. Right. Got to stay away from each other. >> Right. Yeah, >> which doesn't sound like they're very good at doing, >> especially if she lets him drive the car. >> Just saying away from car. >> She knew she she knew she had a warrant. I don't know why would you come back here. >> Yeah, that's what I told her. I said, "You should have pulled off." >> The best bet would to have like a third party like you or grandma come and try and convince him to get the keys back, >> right? >> I'm like, "Did you know you had a warrant?" She's like, "Yeah." >> I'm like, "How should come back?" She's like, "Yeah, I know." That's what my mom told me. >> She knows she she literally said I shouldn't have came back here. >> Yeah. So he can't even stay here or come here because it's a it's a family basically is what I'm saying. But he said he tried to avoid that. So he's trying to see what they can do because she need to go out cuz he don't even got no one to stay. >> So do he even know said they about to go to CSV? >> So what we'll probably do we'll call CSB and they'll let us and they'll determine that if dad's on scene and he has them all the time. You know what I mean? I don't see why. But that's up to them. That's out of our hands. As the mother needed to address legal responsibilities and the father did not have formal custody, [music] an immediate question arose. Who would take responsibility for the child's care? >> 16. >> No wipers, no milk, no wipes. >> Come here to fight. He bring nothing. No. No. Nothing. My son doesn't have nothing. >> Sir, come. I I just got to talk to you real quick. You want to come over here so we can talk? >> All right. Um, so here's the thing. You don't have custody of the kid. Okay. >> So, go mom. This is what we're going to try. Um, do you have like a clean record or whatnot? >> I don't have no felonies. >> Okay. >> And mistake her tickets. >> Okay. Cuz what has to happen since she is getting arrested for domestic to the family offense. We have to uh send the kid to CSV. But listen, just hear me out. If you have if we if you're cool, cooperative, CSB is going to come out here. They're probably going to talk to you since you're the dad. You could try to get emergency custody of the kid. That that's that's a route that we can go. That's what my sergeant said we had to do. I know it sucks, sir, but like I'm just trying to give you the benefits of if we do that, you could get emergency custody. >> They gonna come today? >> Yeah. So, we we call them. They're going to come out here. >> That's crazy work. So, I can't take my kid. >> No. >> All right. I I just want to inform you so you can try to get >> So, what will y'all take care of? Y'all take him? Y'all take care of y'all taking him? So CSB is going to come out and if if they're they're going to want to send the kid with a parent or a family member to to give emergency custody to. That's where I was trying to say if you work with us and you work with CSB, you get custody of your kid and there will be no problems about it. Does that sound cool to you? I'm I know it sucks, man, but it's it's she made a dumb mistake and that's that's where we're at and that's what we got to do. >> Okay. So we'll wait on them and >> just hoping I just I raised three kids by myself. I'm 53 years old to be in a relationship with somebody just to raise your kid if that's what y'all call yourself doing and let it go to still hate each other and still come to the point you got to put your hands on somebody. It's time to walk away. That's these young generations before I tell you >> different for sure. Like I said, my oldest daughter is 32. Kayla's my youngest and my son is 30 about to be 31. Like >> people don't people don't care about the cops. >> Hell no. >> I can tell you that first thing. >> I get nervous. I know I did the damn thing. >> Okay, listen. I'll pull up like Okay, that's that young stuff. >> Yeah, that's what I that's what I told this young generation something else. >> Me if she your daughter never wor. We tell her to leave and that would be it. But you know that's out of my hands. >> We was trying. She was trying. I was telling Shut up. You got to argue with people. Let people talk to her. She just pulled up. Yeah. He going to be yelling out the window. They going they going to hear you going to be out there. >> Yeah. Oh, he going to be waiting. He going to get a ride to that car and he going to be out here riding in that mother car. Guaranteed. >> The mother was charged with domestic violence. Under Ohio law, she could face a sentence [music] ranging from 6 to 18 months in prison. The child may not have said much in that moment, but witnessing intense conflict between parents [music] can still be deeply unsettling. Experiences like these can have lasting effects on a child's emotional well-being and development. Imagine one day your child has an uncomfortable encounter with a stranger at the park. How would you [music] respond? >> Yeah, but it's nothing it's nothing like >> on March 13th, 2024, officers responded to a park after a report of what first seemed like a small disagreement between a woman and a family, but it quickly grew more serious. Witnesses said the woman made comments [music] described as inappropriate toward a young girl, causing the child to run back to her mother and setting off a chain of tense reactions. The woman later followed the family toward their home, which added to the concern. >> Nobody's daughter, nobody's son. >> Cuz boy, oh, you got abs. >> Calm down. >> Why the [ __ ] you care about my abs? I don't care what kind of way. I'm I very trapped. >> Please stay away from me. >> Calm down. Did she give you stuff? >> Yes, of course she did. She has to. I'll call my people. I think the child is going to put pressure on my face if you can't see what I see this on camera. You want the recording and I'm out for the fact >> cuz you don't want to go to >> How can that child How can a baby be so old? Can you write that sense? >> Write it. >> I'm trying to put some logic in your head cuz I don't know where you going. Are you a wife or a mother? >> No. >> Okay, then you you still have yet to throw up. >> Yeah. Okay. >> Exactly. >> Can you write your statement, >> officer? That's the only last thing you ever have. I'm in school for psychology. I could never be crazy. I'm upset. >> All right. Can we write a statement? >> University. Check that out. I'm watching. I'm paying attention. I'm standing back. >> You got three kids. You barely got any. Watch yourself. collecting government check running your come over here. >> Who is this kid's mother? That's the only thing you need to ask for real cuz who's raising that stupid girl? Who is kid mother? Then she makes sure she circes her child. Then she makes sure going to take me. She snatch that child then walk towards me calmly cuz by that time I'm already off the swing cuz I asked twice I think who the is this kid child. Oh yeah I forgot. She steps on my purse. Child steps on my wallet. Why you want to steal your mama's money? Do you know how hard she works? Are you talking to yourself or you going to >> I'm talking so they can hear those boys. >> They're not listening. They're talking. They bet they need to. >> So, can we get the They need to start listening. I see where you're coming from. >> All right. So, you're done with your statement, >> dealer. >> Are you done with your statement? >> You don't see that? You don't see the trap house? >> Are you done with your statement? >> No, I'm not. If I was, I would sign it off. Thank you, officer. >> You're doing a lot of talking. Not enough. >> I can if I want to. I can talk all day and you can sit here and get your hours in. >> No. No. >> Okay then. All right. She then walked towards me. Oh, you're not going to talk to my child like that. I'm talking to you. I said, "Who the child is this in your pajamas?" Right out of her bedroom, probably some right next to the park being jealous of whatever she think is giving her a child a little piece of I don't know, mind, chilling, having fun in the park like any kid should. Jealous mothers of people and the benefits. That's why they push kids sometime. They don't care about none of that [ __ ] for real. They just want the government and the roof over their head. >> So they'll keep and stealing kids and snatching kids and hate the next woman or man cuz this is my entitlement. If I get that right, I'm gosh child. and walk towards me and says, "You're not." That little boy had the nerve to ask me, "Oh, is he my twin?" You do. You see what those music are doing to these people? I'M LIKE, "NO, I'M my own twin." That's what I mean. Take them tablets, them technologies away from them. >> Where do you live? >> Good, Georgia. Both my phones. I have to run because I'm Oh, hell no. They are not about to take both my phones and my cuz I'm still going to make it home. But I'm like, whatever phone I have, I'm recording and I'm going walk back home. But I need to know where they about to head because there's only so much you guys can do at a certain time or at a speedy rate. I need to help you help me. >> Do you have the last street? >> Get in. Make sure y'all know. I got two attorneys. >> I just need your address. >> I just want y'all to know when I walk I'm protected. I got money. Money talk. >> Pajamas. Get her name for me. I need her name cuz you're not about to be the only one with my information. Put her name on there. I need her name on my report. I need her name on my police report. Whatever it is, I need to as much protect >> I'll go down the rabbit hole if I have to to come up top. But my protection is best for me. I don't know. I don't know these people. >> Are you going to I I >> I hope so. I think so. I'm waiting for for all of them to come back. >> Age. And then this is how when I know the little boy is getting too clever. I have a son. You know where my son is with his father respectfully cuz I'm not raising a man. I did that. I I raised him for a few a few years. Then I'm like, you know what? Your father said he's you were best with him. That's fine. Let me see how the flip this flips. >> Both sides felt they had been treated unfairly with different versions of what happened. The matter couldn't be settled at the part. >> Yeah, but it's nothing. It's nothing like the notification is not anything negative on y'all. They're going to call y'all ask y'all >> and then it'll come. We don't even >> I know, but it's part of it's part of one of our policies that we have to I been through that [ __ ] my whole life but it's not just for situation. It's like any other situation too. You know they just don't investigate what they open. >> So what we're going to do is this is what we're going to do. Been documenting the report. You were not at the house. Like they're not coming through your house. It's happening in a public place. The issue is with her. >> She accosted the kids or >> So if I wanted to help my kid, y'all wouldn't call DC up basically if I would have just let her keep my baby. If the kids weren't present and it was just we wouldn't got into this you and her if it's two adults. Our policy is the department policy anytime there's kids. >> At first, no one was taken into custody. Instead, the woman was formally told not to return to the area. A clear boundary meant to help everyone feel safer. >> You done with that? >> No, I'm not. All right. Do you need an extra side? >> Where are you going to write? You need another paper. We >> We fill out the top part. You don't have to fill out the top part. I just need you to sign down here. Are you done? Just sign right there. You swear to affirm everything you said was the truth and nothing but the truth. >> Yes, I swear. >> All right, sign. >> Too much skin. I don't play with you. >> All right, we'll take the pen. All right, grab your stuff. Just so you know, the security wants to trespass in this property. You cannot come back to all right. You can't come back to this property, including the copy. Here's your copy. So, once you leave, I need you to get out, make left, and be out of the property. Okay? You hang out in the sidewalk, but you can't hang out in here. >> So, where's my citation? that cannot be at the park cuz the park is over there. Who's the security? Show me the security because I like that public security is right there. >> Person that can't be at the park singing whatever I be they be listening to >> because you caused a disturbance so they no longer >> I did. I did. >> So grab your stuff. You're trespassing. >> I'm showing them how they're raising children in future homes, not wives. My baby can grab your stuff so you can the future. It's about to be women taking over. Don't trust her either. Try to sit down and protect from men and women. No man is going to come and say he's gay and then trying to ruin his future by running him around. I got good reason. Someone ask another black man. I don't care if you don't protect me, but don't come at me cuz I can protect myself. I don't trust [ __ ] >> All right, we're not so long in this. You trust me and start leaving the property. I already gave you what it says cuz I can read. Hold on. Let's read it together. Uh, Bthoon Drive. What? This is Bthoon Drive. >> This is all >> says who? 624 is their office. This is all of their property. 624 Bathoon Drive. If you go there, right? But they're technically back over there. I belong there. >> No, you don't. You're trespassing all the property. If you have any questions, you I just told you you could call them on the phone. >> Who are who? >> Google Lake Man office 624. >> That's not Lake Man. Oh, Lake Oh, Lake Man. >> This is Lake Man. >> Okay, that's Lake Man King Park. This is a property. Can you grab your stuff so you can leave and now you'll be searching for us? I'm not playing. Grab your water bottle and start leaving. Go walk all the way till you pass that yellow sign. Pass the sidewalk. >> Actually, I'm walking back over here. >> Trespass from there. So, if I were you, if you want to go to jail, you want to go to jail. You don't >> If I were you, I would walk that way. Go to that street cuz you're trespassing. I'm like, man, if you want, you'll be subject to arrest. >> Now, I'll listen. Thank you. >> Cuz I sometime I have a hard time trusting the police officers. You know what I mean? >> Have a good night. It seemed like things were over, but the situation became more complex as officers spoke with more witnesses and reviewed the full timeline. >> We're trying to figure it all out. We got something over there, but we were sitting here fishing. The girl, we came, my girlfriend came up here. >> She made like, see my girl, she walked off to the swing. >> The girl in the purple pants, she seated the swing. The girl in the pink daughter came running past her. She said something about to the little girl. >> Okay. And I can't remark. I can't make out what it was, but it was something serious cuz the little girl was like, "I'm going to tell my mom." >> She looked mad already. She was scared for a reason. >> Yeah. She look mad. She ran to her mom. The mom came and got her. Boom. By the time she even got over there, she asked the child what was going on. She asked her. She was like, "What did you say to my child?" >> Okay. >> The girl in the purple pants walked up on her. >> She got hostile >> and she was walking away. >> She started walking away with her daughter. the woman. >> So she said, so she made the baby push the the stroller and she was like, "You know what? I'm not going to cuz now the girls are following her." >> So she walked over. >> She was like, "You don't know me." She like, "You don't." She like following the lady. I promise I'm calling my people for you. He was like the dude, her boyfriend, he had nothing to do. He was coming up to, you know, just to see what was going on cuz at that time the girl in the purple hadn't already had the girl in. >> That's why you outside with I'm going let you know now. I don't feel that the girl in the pink or the dude should be be involved in anything. But they're doing that purple. She did she she she escalated all that. >> Did you um because the problem we're having is the girl in purple saying that she was hit first. The other one, but then the other girl said that she's claiming that girl pushed her daughter. I don't know if you saw that. >> She knows. Where did she push her at? Like what? >> Right there by the swing. >> She came right here to the little girl. She was like this. Literally the camera touch >> on her phone on that second on that second movie. >> No, she didn't. She didn't show us video cuz she was showing >> she was harassing those people in front like literally like this to the little girl all in their personal stuff. >> She's on the man like >> the lady like please move away from my daughter. Please move away from my daughter. And the lady was like no no no. And to the husband like >> when when she pushed her was it like a hard push or it was a sh and she was with her daughter. So what the girl with the pink is like more of a self-defense cuz you over here all my girlfriend why you argue with >> that's what she's saying because one story what she has the girl in purple and then the other one saying like she was pushed. So that's why we're trying to debate whether she did put her hands on the one who instigated it >> started with and that started with the push of the lady in she kept saying stuff like she was like oh that's why you got on pajamas that's why you got pajamas. The lady still walking with her stroller and the lady over here all in her like you know trying to like get her to like >> she walked back this way like trying to go over there. >> Yeah. She like pushed her but like it's like a push to like Yeah. You know like >> like kind of like go back who did that? >> The purple that's when they got >> Do you think like the second go when actually adults were going at it was the first person who you guys saw was the purple and then the other girl was defending she had sat down sat down and she turned like >> she put her stuff down. She said you don't know me and stuff and proceeded cuz the lady trying to get her daughter >> depending on what she the victim which will be her wants to do with it. But if we have to back it because the other girl is insisting that she's the one that is a victim and that she got the purple. That's what we're trying to figure out. She was the aggressor but she thought she was going to win cuz the little girls were slightly smaller than her. >> Witnesses identified the woman in purple pants as the one who started the confrontation. Officers then asked her to stay at the scene while they sorted things out. However, the interaction remained tense as emotions continued to run high. >> Give me my police report card. I need a report of this whole thing. >> Yep. We'll give you a case number. Just have a seat. >> Don't worry, ma'am. Little girl. >> Hey, >> here. You wanted the case number real quick? >> Thank you. >> Yep. Let me get it for you real quick. >> You got to stop walking so I can give you the case number. >> Just put your hands behind your back. >> What's going on? Stop. Stop. Stop. >> Give me your hands. What's going on? Put your hands behind your back. >> Give me your hands. Give me your hands. What? Give me your hand. WHERE ARE YOU GUYS GOING? >> PUT your hands behind your back. >> Give me your hands. Hang on. Hang on. >> Are you going to put it or put it? >> Just put them on. I got it. STOP. >> OW. OW. MY LEG. >> You hurting me. >> Stop. >> Watch when I told you to stop. >> I told you to stop. >> Ow. Stoping. >> Stop. Stop. Just stop. I told you to stop. >> Just stop. trying. He's my leg. >> You're going to be detained. Penny investigation. Okay. >> Touching your leg. >> Nobody's even touching your leg. >> I know, but I have a messed up leg already. That's your >> Which is why I asked you to stop. Stop yelling. >> You're just yelling to yell. >> Ow. >> All right. >> Roll over on your side. >> Sit up. Okay. >> Sit up. >> Nope. Just where's your on your leg at? >> Cross your leg. How >> does your leg actually hurt or you just >> Yes. >> Where's the your leg at? >> My knee. >> Okay. >> Okay. We have to look at You're saying your leg's hurt? >> Yes. We have to see. >> No. I think it's him that stepped on. >> Okay. So, which leg is it? Cuz you're pointing at this one. >> This one. >> This one right here. So, we have to look at it, >> right? Is there any That's an old scar. >> You have anything? >> Just some bedding. No, my knee, sir. >> Okay. Ow. Uh, >> so what's wrong with it? >> There's no >> What do you mean what's wrong with it? I already have >> pain in my leg. >> So you already have pain there? >> Yes. And he just stepped on it. >> I mean, you should just listen to him when I said >> that's why we told you to stop. >> Stop. I'm trying. >> So you stop and put your hands behind your back. >> I didn't You DIDN'T SAY THAT. NOBODY TOLD ME TO PUT MY HANDS BEHIND my back. Nobody told me to put my hands behind my back. Sir, >> I told you that. I told you that Madson. >> So you're going to be detained on the investigation. have witnesses at the park who witnessed the incident take place. So now you're not free to leave. Leave whatever is in your pocket. In your pocket. >> No, I need all of my stuff. >> Okay. >> And I need my water cuz I >> No. OW. >> I So stop doing that. I don't know. You're [laughter] You're doing that. >> I'm trying to sit up because now this thing is behind my >> You keep reaching in your pocket. So >> I'm not reaching in my pocket, sir. I'm trying to stand up because you're telling me I'm being detained. And why are you taking this thing that I just gave? You just got to make sure you have nothing that can happen. >> I'm noting anyone >> because you're not listening. If you would listen, this would be completely different. >> I am going to be listening until we get statements from the witnesses at the park cuz they they witness everything that occurred. Right now, you're not >> What statement? Because the only witnesses at the park are those same people lying to me. I'm lying on me. >> Two guys. Apparently, there's two guys at the park. So, we got to figure that out. >> Can you bring my belongings a bit closer, please? >> Yeah. We'll grab your word cross, >> my work, my work search, my wallet, my water. have if I don't have the energy to argue with people. >> In the end, the woman rejected the witness's statements, calling them inaccurate, but that did not stop the case from moving forward. The family left with an experience that was difficult, especially for the children who had seen everything unfold. >> The only witnesses on camera, they're all liars. The only witnesses, they can't be all the way from down here, ma'am. >> But I'll just do trespass. >> They can't be all the way down here. The witnesses ARE AT THE PARK. THAT'S WHERE everything happened. The only thing I did is follow them all the way here because so you GUYS KNOW WHERE THEY'RE GOING. Do you have books myself? My cell phone. >> They're both sitting right there. You can look at them >> in my word search. Please don't dirty my book. Thank you. >> Where do you live at? >> 15 minutes away that way. That's why I don't want >> How did you end up over here? >> I walked from home safe here. I didn't want to walk that way when she asked me because I didn't want to have to pull out the GPS. I just I know the the direction from my house. >> Where's your house at? Like what neighborhood or what street? >> It could be way less. It depends on >> What made you come in here? >> Because sometimes I come here. I don't like to I'm not a party person. I party when all my friends drag me out. >> I'm not saying party. I'm just saying the park to relax, to get some fresh air, to enjoy the scenery, to be by myself, listen to my music. That's why I come to the park and do my word search puzzles. Then if children or or adults feel the need to speak to me, I don't have to be rude and ignore them. But nobody has the right to have their child who is not well raised with no home training. >> Do you know that kid? >> I don't know that child. >> So how do you know all that? >> Because I know that I asked where's that child mother and she stepped up. So she must be her mother. But all I know is that child who [music] is not my child cuz I wouldn't raise no child like this. >> So it's not your child. It's none of your business. Right. >> What is my business is the fact that I need to know who hit me and I need to make sure the police knows who just beat me up. That's why I followed them because she me up and I didn't want to really fight her back, but I'm not going to lay in. I tried my best to protect myself, but I did not hit her. She lunged at me and she bit me and I stayed like this with my hands. My hands can't go forward because I'm in handcuffs. >> I know. >> But I went like this. >> She bit me in my stomach, but I was already sitting like this on the bench. I'm tall. It doesn't mean I'm out here trying to fight people. >> Did you mess with her kids? Is that why she was upset? >> I did not touch that child. I swear to God, I did not touch that child. I was literally sitting on the swing. How can I touch a child with both my hands on the swing? >> Okay. >> And I don't even know if that's her child. That's what I keep repeating to you guys. Do you know if that's her child? How do you know that's her child? >> Cuz she's saying it's her child and the father is saying it's her child. >> All I do know is that's not my child. >> That's all I know. Excuse me. >> Going back. >> Bring your legs in. Bring your legs in. Walk this way. >> What about the rest of my things? >> Yep. We're going to get them. It's right there. >> So, I'm being detained. You guys are not reading my rights. >> Stop. Just stop. >> She ripped all my clothes and like whatever she >> can stop for a few seconds. >> I'm trying. You guys are all over me. That's not correct. >> Um, I think so. I would say correctly. I stand corrected. >> Yeah, yours. >> Just if you can just do your please just follow instructions. Move your feet. >> Just keep your hands. Just >> face the car and stop me. >> Which car? >> It's a very The car right in front of you. Very simple instruction. Car is right here. Just face this way. >> Keep your leg down. She's good. >> Walk this way. >> Have a seat. Have a seat. Have a seat. Have a seat. Sit down. >> Have a seat. >> Yep. Use the door. Push off the door. Ow. Yep. It's a seat belt. We're going to put it on. >> There you go. >> Yep. You got to slide in. >> Okay. I'm trying. >> Yep. Your feet right there that you're not moving. Just slide that back. >> I'm trying. Sorry. There's that thing behind my back and my arms are like this. >> Yep. You got to slide in. There you go. >> Oh. >> All right. Now, turn your body. >> How? I can't. >> Just turn your legs. Turn your legs and you'll be okay. brother. >> The woman could face charges including disorderly conduct, harassment, resisting arrest, and child instrument. Under Florida law, if convicted, she could face a sentence of up to 3 years in prison. This story is a reminder to put children's sense of safety first. Adults play a key role in offering care, protection, and stability, and in helping build a community that feels safer and more respectful for everyone. >> Here we are. >> Wow. The child's [snorts] excitement revealed that he was unaware of the serious situation involving his mother. On the night of May 18th, 2025 in West Palm Beach, Florida, a passerby found a young boy alone on the street at night. The child led them to his apartment. But when they knocked, there was no response. Concerned for his safety, they contacted the authorities who promptly responded. >> Where's somewhere down there just >> somebody just came and grabbed him and the lady came? >> What apartment? That's where she took the baby. Yeah, that's where she >> come now. >> Uh, you have the camera footage? >> Yeah. >> You have the camera footage, right? >> Yeah. My mom my mom got it. >> What's up, man? You don't come back to my job no more, huh? >> Nah. >> Where's the child? >> Supposedly a female who who were shooting the mom can take the child up to you guys. Mind standing here. >> Don't leave. Thank you. >> Don't go with the video. West Palm Beach Police. Hello. Speak English. >> Yes. >> Okay. It's How many people here? Is it just you and him? >> Yeah. >> Is it anyone else? >> No. Not for now. >> So, it's just you two? >> Yeah. >> Okay. You have your ID? >> Sure. >> Yeah. >> Some officers approached witnesses to gather more information. Community concern again showed that protecting children is not just a parental [music] duty, but a shared societal responsibility. >> You don't want to call by any chance? >> No, I didn't. >> Did you see anything? >> My son just woke me up, but I have the footage. I'm the one that woke everybody up, man. >> Oh, you have the footage? >> Yeah. >> Okay. Do you mind if I see it? >> You got the footage? Yeah, cuz camera. >> Yeah, I know. That's why I'm not knock on your door cuz I I saw your camera. I'm like maybe maybe I probably got to record and see like what happened on my camera see everything. >> I know. That's why not cuz I'm like oh that's a perfect camera. >> She has cameras. >> There's a sister apparently this lady sister somewhere here in a car or she was out here. >> The kid told me the kid been telling me a car but I don't see no car. >> That's not You noticed a baby walking around by himself. >> Notice a baby standing outside while I'm coming from the gas station. my little stuff and I just like >> You said after 12, right? >> Yeah. 12:30. The guy showed me 12:30 on his ring camera. The other guy that was outside didn't even realize where he was at. >> He went back inside. >> He went back inside. >> Okay. So, he did go back inside. I guess the door was open. >> Yeah. >> Mom was probably sleeping or something. >> Oh, he is your initial complainer. >> Okay. >> And he said he initially saw the child out on executive center on the sidewalk. >> Thank you for calling cuz No, he could have been abducted, you know, >> by a car. >> Yep. >> I had to. I got a child. [laughter] My daughter is three. My daughter is literally three. >> I have five and I'm like, >> they riding everything? No, >> I'm good, sir. So, you were coming from the gas station. Which gas station is the one? >> The marathon right there. >> Marathon. Yeah. >> Where did you see that? >> I just saw him right the outside the fence on the >> on the sidewalk like but outside the community, right? >> It looks like looking for somebody >> cuz he keep pointing at the car, but I don't think he knows the car. >> Did you see him walk back on his own? >> He shows me the way back. He He walked me. >> He walked you upstairs. >> Oh, yeah. Picked up your camera. He got it too cuz he showed me he told me the same thing. He say he saw him like walk by his stair came out. >> Is that the correct time? >> Correct. >> Okay. So 12:57 a.m. he was out there. >> That dude right there he was a kid walking around the streets and he he seen him and we were trying to look for like guardians or parents or whatever. We didn't find him cuz we didn't want to call the police at first to see like you know if we could find them but it took too long. So we was like you know we just going to call the cops. >> Okay. Where did you see the kid first? He said he seen the kid outside the gate like toward the street area. >> So by the main entrance. >> Yeah. By the man. >> So they said he was >> something like that. >> Beyond the gate um close to the street. That's what my understanding was. >> The man who called to report the incident provided a statement both assisting the police [music] and ensuring the child's safety. >> All right sir. My name's officer with the West Palm Beach Police Department which is going to be a case of child neglect. Do you swear the testimony you're about to provide is the truth, the whole truth and nothing but the truth? Yes. >> So, you see the kid walking on executive when you come back to the gas station. You bring them over to try and see if you find somebody, a parent or somebody nearby. You don't find anybody. Kid walks you up to the apartment, which is apartment upstairs. Door is cracked open. You bang on the door real loud. Nobody answers. Yell inside. Hello. Hello. Nobody answers. You come back downstairs, right? Obviously, you knock on your neighbor's door since they had Ring cameras. While you're down here trying to find somebody cuz the kid kept pointing you in that direction for a car. Lady shows up from this side of the street. Calls the kid's name. came and grabbed the kids and >> she said to you, you told her obviously that you had called the cops already. >> I called and I called you guys back and said, "Don't come." I told her, unfortunately, they even if I called, they said, "Don't come here." I still going to show up. >> Okay. It is now 2:48 a.m. Is there anything else you want to tell me in regards to what happened today or any questions you have for me? >> No, no, nothing. Honestly, I just honestly myself, I could probably whoop that person, I would have, but I can't. That's all I can >> I appreciate. I myself >> is now 2:40 a.m. That is going to end your statement. Thank you. I appreciate you. >> Then it was the mother's turn, but her unclear answers did [music] not satisfy the officers. The child had been left unattended for hours, demonstrating concerning situation that put children's well-being at risk. >> I was told the other officer, Reggie, Miranda, do you want me to reread it? So, you have a full understanding of your right. Okay. Can you tell me what happened tonight? >> Uh, I was supposed to go somewhere and my close friend was supposed to come watching the baby, but I just noticed that he was by himself. I trusted someone else to watch him. >> Okay. So, you said you were supposed to go somewhere. Did you go somewhere or did you stay here? >> No, I went somewhere. >> Okay. About what time did you leave? >> To be honest, I don't have the exact time. I don't remember. But it was at night. Like it was recently. >> I'm sorry. What did you say? >> It was recently. It was at night. >> Was it dark out? >> Yeah. >> Okay. Now, you said your friend that you trust, you asked them to come over watch your son. >> Yes. >> Okay. Did they ever show up? Were they here? >> Uh, they were supposed to be here supposedly. That's what they said and they were here. >> But did you ever see them in the apartment before you left? I rather not answer that question. I'm sorry. >> You text your friend, you ask her, "Hey, can you watch my son? I want to go to out tonight." >> Uh, not out, but yeah. >> She agrees to. >> Yes. >> Okay. Did you guys plan on like a time her being here or are you leaving? >> Not really. >> Uh, was there any sort of agreement of how did the conversation go of her watching the child? >> Uh, it was in person. >> So, it was not over text. So, you just mentioned it one day and was like, "Hey, do you mind watching them?" >> How long ago was that conversation? >> How long? Sorry. >> How long ago was that conversation? >> It was today in the morning. So, you guys had this conversation. You intended for her to be here to watch your son. >> You then left and went to dinner and he was by himself. >> Supposedly, she was outside already when I was already eating. >> Okay. Did you see her or her vehicle outside? >> Uh, I didn't. >> So, you go out to dinner, you come back. What happens then? >> He was outside. >> Okay. Where was he outside? >> By the stairs. >> This building? Another building? Was he with anyone at that point? >> Uh, with the neighbors. >> What did you do when you saw him outside? >> Just grabbed my son and came upstairs. >> Do you mind setting him down for me? Can I jump? >> Yes, ma'am. Based on what you told me, you left him unattended at the house. >> Due to the severity, police had to gather information from multiple sources. >> Let me just run right back through this real quick. Just make sure I got all the facts right. What you told me you were at work. You got ring notification on your phone. You looked at it. You saw this kid running around running in front of your apartment, which was at 12:49 a.m. You arrive home at 2:00 a.m. from work. When you arrive, you see the group of people here with the kid that you witnessed on the phone. So you asked them what's going on and they were trying to find out where this kid lives. Yes. Okay. Cuz he was lost obviously. Kid walks you guys upstairs to the third floor apartment. The door was open. The guy knock had knocked on the door. May try to make contact with somebody inside. Nobody came to the door. You guys come back downstairs. The other gentleman, he calls the police. Right. Um while you guys are waiting for the police, a Spanish lady, light-skinned, long curly hair, wearing jeans comes up to you guys say, "Hey, my sister was supposed to be watching us her son." And then she ends up taking the kids back upstairs to the apartment. Is there anything else you want to add? >> No. Okay. It is now 2:56 in the morning. That ends your statement. Thank you, sir. >> Once the full statements were [music] given, the mother faced legal responsibility. >> It's going to be a 15. We're going to have you call her mother to come pick the kid up. Okay. So, I'm going to put her in the back of the car. >> No, you never give me your mom's phone. >> Sergeant B and texted it to you. >> Yeah, I get a >> Okay. >> Okay. >> Um, if she doesn't answer, can I call her? >> We'll we'll make sure that we attempt everything to get in contact with her. It's going to be the back car. Just do me a favor. Set the water on the hood of the car. Go ahead and put your hands behind your back. If you put them together like a crane, they'll go on a little easier. All right. Do you have any weapons on you that I should be concerned about? Have you spread your hands a little bit? Are these like stretchy ones or they clut or they got to come off? >> You need property? >> Yeah. If you go to property, bag, I'm going to let her take them off. >> I have to take all my jewelry off. >> All of them. >> Listen, ma'am. We're all on camera. Is this your apartment? >> Yes. >> Okay. Whatever you don't need, I highly advise just leave it here. We can put it somewhere the top of the counter for what we care. >> Like all of this? Yeah, you can go. You give us permission to >> It's all on camera. So, you're going to see it. It's going to go on your counter. >> The one that can stand in is this one right here. >> Can you get a hold of my mom? >> She didn't answer. >> Can I Can we call up on my phone? Cuz she's going to ask. >> We will in a minute. Let's just get everything off. >> This one's probably pretty easy to take off. >> You should have nothing else on you, right? >> No. >> You're going to have to wait like 10 minutes. So, here's what I'll do. Put your handcuffs. I'll take you to the station. I'll type everything. You can use the bathroom there. >> So, we got all the property. Any earrings? >> No. >> No. >> You're going to give us permission to call your mother off of your phone? >> Yes. Come on, please. >> Siri, can you call me M on speaker? What was your mom's name? >> Okay. Is there someone else that we can call? >> Yes. My my stepdad, her husband. >> Can you call him? I'm I'm going to be honest with you. We need to try to get someone here quick because uh really can't get a hold of them in a timely fashion. We got to call these yet and they going to have to take him. >> Want to give this back to Allan. I'm going to keep trying. I'm going see what we can do. Okay. >> We're trying to contact the mother, the 15 father or mother to come take the child, but we're not getting any luck. Can you 65 uh an address open me a 17? More than like it's going to repeat. Oh, please I'll wake him up. >> Police [music] contacted family members immediately, but before they arrived, the child needed care. Officers took on this duty attentively. >> Okay, wait for us. >> So, we can show you. You see this light? >> Where's mom? >> She's at the police station. I'm going to help you. >> Can I pick you up? Is that okay? It's just easier to go down the stairs cuz you have short legs. >> Just hang on before I leave. It's going to be sunrise. It's It's got to be sunrise. >> What's up, buddy? >> Hi. >> Look at this. You want to ride in this big seat? >> What do we do now? Seat belt. Do you wear your seat belt? Yeah. >> Yeah. >> Here you go. You're such a big boy. We're going to go for a ride. I was I'm going to drive. Okay. I'll see you in 5 minutes. >> Here we go. Here we are. >> Wow. >> Wow. >> Hey, so you dropped one car. >> Yeah. >> Yeah. It's McQueen. Here he is. Let me unbuckle your seat belt here. I'll help you get down. You're such a big boy. You did very good. Okay. Can I carry you? Okay. What do you want to do? You want to go inside? >> Yeah. >> You want to see my friend? Have you ever been here before? >> Yeah. >> You did? >> Shortly after they successfully connected with the person who would take care of the child. >> He left his phone on an Uber lift and we tried getting in contact with her several times, a couple times, and she just won't answer the phone. She blocked my phone number. Like I said, like he left his phone in her car and she just won't respond. >> When will your friend be able to call us back? >> I'll call him right now and let him know that you guys called him back. It's just a little iffy just because, you know, he's home and it's the lift was ordered through my phone, so it's kind of like a three-way call, you know what I mean? So, it's kind of a little iffy, but I'll call him right now and I'll let him know that you gave us that you gave me a call. >> Listen, uh lost lost properties. So, we we typically just document the incident. Okay. Do you know like a make or model? >> Yeah. So, it's a it's an iPhone. It's a newer model. It's white. Uh we did try and get in contact with her. We did try and call her several times. We called her and the first time she was just very like she was kind of like standoffish. Like she just didn't want to talk to us. Like she was kind of disrespectful. He was very respectful on the phone. He told her that he'll pay her whatever price. it doesn't matter because I guess on Lift it's a $20 fee or something like that for a store or um a lost item for her to come back and she was just like not having it. She was going back and forth on the phone that she was not going to come back and all this back and forth. But like I said, I'll have him give you a call so then he can give you more details on it. >> When will be >> like literally right now? Like as soon as I get off the phone, I'm going to call him. He's up right now, so he'll he'll take care of it. >> I'll try giving him a call. The caregiver quickly arrived at the station to pick up the child. >> Yeah, man. We're just going to have a conversation, bro. This is your good address. >> This my actual address. >> All right. I'm not getting ahead of ourselves here cuz I got to make phone calls probably while you talk. >> Is this where you're going to be and the baby's going to be at? >> This This right here. >> I got to call DCF and let them know cuz they're going to come out and check them out. >> The mother faced charges of child lacked with [music] great bodily. Under Florida law, she could face up to 15 years in prison and fines up to $10,000. Children cannot choose their living environment. Adults are their primary protectors. Even [music] a brief lapse in care can have lasting effects. And importantly, community vigilance can help safeguard [music] a young life. The woman initially stated that she had left her child for just 5 minutes. >> I wasn't even in there for more than 5 minutes. >> But only a few minutes later, the time frame changed. >> 5 to 7. Not even close to 10. I don't even think at most maybe 10 minutes. On May 3rd, 2021, an incident occurred in a public's parking lot in Flaggler where a child was briefly left unattended in a vehicle. The incident quickly drew the attention of passers by and police immediately intervened. >> No, she's totally fine. >> Okay. >> She wasn't crying whenever I came out. She's >> I just wanted to ask to make sure. >> Yeah, she's okay. I know she's fine. >> Would you mind? Would you mind? Hey, >> I mean I give a second the door. I did check on her. >> Would you mind just sitting by my car? >> Yes. I just would prefer to keep her in there because it's the air condition. >> That's fine. That makes sense. I just I just want to make sure before I talk to everybody. Okay. Hi there. I just don't want everybody to hear each other. That's all. >> No, you can come here. >> M Eminem M&M's are the best. >> Um No, I wish I could take one. I'm sorry, sweetheart. I can't. So So what happened? So what' you see? >> So I the car is very loud. So I took notice of the car. I went in. I did my shopping. I came back out and when I was coming this way, I noticed there was movement in the car. And I was looking and I'm like, there's a baby in the car. How much time had passed between >> I had gone in done some shopping I don't know something like that. I was in there at least 15 minutes. She read a book came back out noticed the baby in the car and then I was I looked tried to look in the cart enough to see if there was anybody else in the car. Then I got the people from Publix over here. They went in and got their manager and then their manager So I mean it's been a while. >> How long do you think? >> At least 30 minutes. >> Okay. >> You know since I got here at least. >> Okay. I mean, you just cannot leave your baby in a car. >> I understand the concern. Absolutely. >> You would get in more trouble with a dog. You don't leave them in the car either. >> How's your day been, sweetheart? >> Good. I like school. >> Is school good? >> Mhm. >> Nice. Yeah. Mondays aren't very fun. >> Worst thing is when she came out, she was all happy and excited and like like you know, hi, everything's fine. And it's like, >> do you do that at a bar, too? Do you you know, do this often? I'm like, this is the concern area of the world. You don't leave your child in a bar. I understand your concern, >> but isn't it also illegal? >> Yeah, there's very specific statute on >> Oh my god. >> So, I'm still trying to figure everything out. Okay. >> Who was the uh public's employee that helped you out? >> Uh the manager lady, not him. That's the other manager, but it was the blondhaired manager lady. >> Okay. All right. But you think it was about 30 minutes of your guest? >> At least 30 minutes. Yeah. >> You said the car was running during the >> car is running, but she's also drinking a bottle, >> maybe. Anybody there to help? >> Well, it shouldn't have been left alone in the park. Not at all. But >> I mean, her speaking is so young. >> I could imagine your frustration. >> Do you have >> The mother repeatedly said she was going into the store for [music] 5 minutes, not realizing even short absences may raise child protection issues. >> Uh, do you have your ID with you? >> Yeah. >> If you want to check on her, you don't have to stay by the car. I just like to keep everybody se separate to avoid arguments. >> Thank you. Yeah, I definitely was not trying to argue with her. >> No, you're fine. Yeah, if you want to check on her, that's fine. All right. I appreciate it. I've got some work to do, but in case I need a statement or something from you, I'll reach out. Okay. >> Okay. Not a problem. >> Thank you very much. >> Not matter. She just got a notification. >> Yeah. >> Bye. Good luck. >> Um, really quick. Um, so how long do you think you were shopping for? >> I wasn't even in there for more than 5 minutes. Like it really was not that long. I watched her come out. Like I literally watched that lady come out and then I ran in and I just got a handful of things. I was not in there that long. >> 5 minutes is like your best guess. You're thinking >> I had like five to seven. Like not more than not. close to 10. I don't even think like it was not that long. So that's why like I genuinely didn't think anything was going to happen. But I also didn't know that it was against the law. So >> well it's not that simple. >> But there is statute against obviously um >> like in my head I'm like okay the car's on the AC's on I know she's good. Like so that's what I was thinking. I parked close to the store. I was trying to go as fast as possible. >> Take a deep breath. We'll cover all this in a second. Right now, I'm just getting everybody's contact information, but we can go over we'll go over what happened, what could have happened, and what should have happened in a second. Okay. I just hit tight. >> The investigation, aided by witnesses and public staff, confirmed how long the child was left in the car. >> How's it going, guys? >> Good, man. How are you? >> I'm doing okay. >> I don't know how long the baby was in there or not. One of our associates was the one that called, but just FYI, she actually knows the girl and there's potentially a DCF case open already on her, so that might be something. If you had to guess what that was had to do with, what do you think that was? >> All I know is that it's most likely like her baby daddy's family is like coming out to get them. So, she can't like post anything that has to do with the baby. >> Okay. >> You know, saying that. >> But we can we have cameras. So, maybe we can give you a timeline of how long. >> That would be helpful cuz I was given two very different times. >> My assistant's in there right now. I'll go get with him and I'll get a time. >> Yeah. Roughly what time she went and what time she came out. Yeah, absolutely. >> That would be very helpful. >> They were arguing. So, I guess the associate called the lady that witnessed it, said, "Can you please call 911 right now?" She baby in the car. So, >> all right. All right. >> Timeline real quick. >> Thank you guys. I really appreciate it. >> Oh, absolutely. Good news. Our partner has not many of them do. >> We appreciate it. It helps us out a lot. >> When the parent was informed of their legal rights, authorities clarified that the timeline of the child being in the car did not match the initial statement, highlighting a discrepancy. I want to ask you about what happened in detail. Okay? >> And because of the nature of this call and the potential for it to be criminal, okay? >> I want to read you your rights before I ask you anything. All right. Well, that's just how these things go. If there's any chance that a crime could have been committed, we can't talk to you about it unless we read you your rights. Okay? All right. All right. So, you have the right to remain silent. Anything you say may use evidence against you. You have the right to talk to an attorney. Have him or her with you now or anytime during questioning. If you cannot afford an attorney, won't be appointed to represent you. If anytime you wish to stop talking or have an attorney present, all questioning will be stopped at your request. Do you understand these rights? With these rights in mind, are you willing to talk to me? >> Okay. >> Yeah, I guess. I mean, is that what I'm supposed to say? It's just that >> it's entirely up to you. I >> I mean, I understand the aspects of everything, but it's like I don't think it's enough criminal to take me to jail. So, it's like I >> But it's important that if I ask you about any of this that you understand these rights. You understood what I what I read you. Yeah. >> With those rights in mind, are you willing to talk to me about it? Yes, I am. >> Okay. All right. So, I understand when I got here, you said you just ran inside really quick. You were doing some shopping. Walk me through. You came here. I don't know. What did you come for? What was going on? Would you mind walking me through it? >> I picked her from daycare. I just needed to pick up some pasta and some another option for dinner. My fianceé wanted some pasta, so I picked up some pasta. And then I was getting something for dinner as well. He does construction, so he just wanted something to fill up his stomach. So, I was just getting pasta really quick and then I was getting something for dinner. I just ran in there and I was um figuring out what I was going to get for dinner after I got the pasta. I figured it out really quick and then I was waiting at checkout for tour just a little bit to for a line like just waiting to see clear up and then I went to the checkout line. >> Yeah. How much time do you think the whole thing took? >> At most maybe 10 minutes. And that's like really like I wouldn't say anything more than that. I was thinking less than 10, but it's like I'm saying maybe 10 just like with waiting like waiting for a spot and stuff. >> What would you guess would be a reasonable amount of time if you had to leave your kid alone in the parking lot like that? What do you think would be a right amount of time? >> I try and like I would like want it to be like at least like not less than 10, like five at most, you know, like nothing like really quite in and out. >> You understand the vulnerability of I understand the car is locked. I can tell you right now if that car was locked and I want to get inside. I'd be inside that car in less than 10 seconds. >> And that's why I know I mean if anybody wanted to take her, of course they would have if with it being locked, they would have found a way 100%. But it was locked and the air condition was on. I did try and make sure it was as safe as possible. >> But you understand why someone driving by would be concerned. >> 100%. >> Okay. >> I 100%. Whenever she was talking to me, I mean, you saw she was coming at me very aggressive and I wouldn't argue with her cuz I understood where she was coming from. I totally get it. >> All right. That's why I'm a little emotional right now because the idea of anything happening to my daughter is obviously very like traumatizing. So, a scary thought. >> Authorities emphasize the importance of parental responsibility, reminding that caring for children requires attention and safe actions. >> Okay. Um, so you picked up from daycare. You came here. >> Yes. >> You needed another ingredient for dinner is pasta and something else. Parked here. You immediately walked inside. You were in there, got what you needed, went came to the register. You think it was no more than 10 minutes? >> No more than 10 minutes. >> Is that what you planned on? >> I planned on being planned on it being less, but I wasn't sure exactly like everything that I was going to get. So, as soon as I figured out what I was going to get, I had to run to the other side of the store. I got chicken for fajitas, the stuff for that that is on this side of the store. So, I had to go all the way back to this side and that's what took me the longest. Yeah. I just ended up having to go all over the store. >> And what was the condition of the vehicle when you left? I left it on with the air conditioner on locked and I had her cocoa melon playing and she had her sippy cup. So that's all and it was on parked right here. >> So you kept So there the key was turning the ignition and you had your own backup key. >> I don't have a backup key. >> So how were you to unlock it? >> Um this this door doesn't lock. My front door actually doesn't lock. >> So if you Is it broken? >> It's a little messed up. Yes. So there there's not an option to lock the front door. >> Not this one, but the rest of them do. >> All right. So me painting this whole picture together, just to be clear, she was in a car and the car was running with the front door, the driver's seat unlocked. >> Yes, sir. >> So essentially at any moment, anybody could have got in the car and drove off with a brand new car and a child. >> They could have. >> For all we knew, maybe they just wanted the car and not even realize that she's in the back seat. >> That's happened before. >> Yeah. I'm sorry. I'm not trying to be emotional. Do you understand the picture I'm paying to have? How this could have resulted? >> I know 100%. >> Did anything change from your conversation? >> Okay. All right. You said your fiance's at home. >> No, he's not. He's at work right now. >> Till till when? >> He's been her since her birthday's in June. He's working late hours. He was going to have me make the pasta and he was going to pick it up and go back to work. >> While addressing legal responsibility, police also contacted family members to ensure the child was safely cared for. >> That's fine. We can figure that out. >> He's probably wondering why I haven't called him. Why the >> We got to contact them. For now, I need you to put your things down. >> Okay. >> I need to put your bag and your drink on the car. Okay. >> Okay. >> Including your your bag here. I need you to put your hands behind your back. Someone's going to die. >> We'll figure that out. We'll figure that out. >> All right. Do you have anything on you besides your phone? Is there anything sharp on you? >> No, sir. Only my phone's on me. Oh, well, my earrings, of course, but that's it. >> Okay. All right. Who can take care of her if you come with us? >> My fianceé can come home from My fiance will have to come from work. Like, I don't have anybody except for him. >> All right. I need you to come back this way. Okay. Would you mind just sitting with um with her? All right. I just need you to lean up against the back of the vehicle here. All right. Spread your feet, please. Yes, sir. >> I'm going to take your phone out. Yeah. >> All right. All right, I'm going to get the AC moving back here. It may be hot right now, but it's not going to be in a second. Okay. >> I don't know his number by heart. So, >> is it in your phone? >> It is, but it's on 2%. So, if you want me to unlock it, you can write it down real quick. >> Oh, it's about to put a mine. >> That's it right there. >> Yes. >> All right. Just sit tight real quick. They work to reassure the child, helping them feel safe and not alone in this stressful situation. >> Hey, sweetheart. You're okay. You're okay. You're a pretty little lady. >> Hello. Hi, this is Deputy Summers of Fire County Sheriff's Office. Hi there. I believe I'm here with your fiance. Um, I'm sorry, sir. Can I get your name? This is uh Deputy Summers Fire County Sheriff's Office. I'm calling a reference to somebody we arrested moments ago. She has a child with her and this is the number I was given this contact about who may be able to pick up the child. Uh the reason we arrived was because the child was unattended in the vehicle. Um after reviewing the footage for the store, it was determined that she was going to be charged with child. It is we're here with the car and we're here with the little one. I'm sorry. No, we're at Publix. Uh it's going to be by Belter and Palm Coast Parkway. 5 minutes. Okay. Thank you. All right. What did you ask? She's doing fine. Yeah. Yeah. She was crying for a second, but she's she's happy. Your fianceé? I just spoke to him. >> Yeah, that was him. He said he's going to be here in 5 minutes. All right. >> The mother was charged with child. According to court records, she must undergo 18 months of supervision before trial and follow the DCF plan along with court orders on parenting. The case highlights the importance of prioritizing children's safety. Loving a child is not just words or feelings. It requires responsible actions and legal awareness. When substance use affects family life, children are often the most vulnerable. A recent case in New Mexico illustrates these risks and how authorities respond to protect them. >> I don't know. I want to talk to someone that understands I don't understand. >> May maybe you can break it down for me. On October 21st, 2023 in Los Cusus, a mother was involved in a traffic incident requiring emergency response with three children in the car. Emergency personnel, including police, firefighters, and medical staff, responded immediately to ensure everyone's safety boy. So, I guess this is three miners that were in the car. >> Can I go? >> Yeah. Are you in it? >> Crash. No, I was just doing the chest compression. >> She almost she almost hit three other people. She's doing circles all the way up here. She almost hit me here. I hit my brakes. She slammed in here. Before she slammed, I saw her just hunched. When she hit, I only saw was a face in this window. I pulled over too long ago. >> And then all the little the littlest one, his chest harness, he wasn't even arms in it. Just buff him up. >> I did. I just pulled in here, filled the engine after I put the hazards on. I grabbed the kids out and they me before I could get her >> two kids and mom everyone else. >> She does have an bracelet on so she's probably already >> Yeah, I think she's awake in the back. So, let's try and keep your kids. >> I'm going to have to call CFD CF. >> I have another unit in route. I'm just waiting on them. Okay, we can hang out. I did. I left my wallet in my car. I had my card. I had it. >> All right. Take this out. >> Let's take the IV out if you're going to get out. >> Can't leave that in you. Get this out. Okay. Anybody here? >> Initially, authorities faced challenges while ensuring cooperation, which required police intervention. >> Hey, yes, man. There's some stuff that's going to have to happen before you take off. All right, you understand that? You're going to come sit right here. You're not going to >> Central 1126. >> Yes, man. >> You're going to sit down. >> Okay. And they're fine. You're not going to go toss all your check it out. You're going to cooperate or you're going to get detained. You're the one smoking with your kids in the car. You're going to get no sympathy for me. So, you're going to sit down and cooperate with this. >> See me anyway? >> Yes. >> Okay, then. It doesn't matter. >> Get turned off. >> No, I Hey, I don't get You >> want your kids to see you if you're falling to the ground? >> No, you're not. I'm not resisting. I'm not resisting. I told you. Stop. Why are we coming tomorrow? Get the kids. >> Let me call myself. >> Get up. >> Let me call my mom. >> Get up. >> Let me call my mom. >> I will give let you call your mom when you start cooperating. Get up. burst into your girlfriend. >> Still, police [music] acted humanely, communicating gently while explaining the legal consequences to gain the mother's cooperation. >> Check it out, Yasmin. I'm going to be super blunt and very honest with you. >> You wear blind together. >> Cool. You don't start cooperating. I have this I'm one of the officers that carries this thing called a wrap restraint. You refuse to go in it, you're going to get placed in and it sucks really, really bad. >> You're going to call my mother >> and I told you once you start cooperating and then you said that you were just a kid. I just need you to call my mother. >> Get up and we will work on that. >> Kids are okay. >> Get up and we will work on that information. >> How can I trust you? >> What? >> How can I trust you? >> Cuz I don't want you sitting here laying with your face in a great and I really don't think you want your kids to see you like this either. >> No. >> Cool. So, let's work towards a common solution and you start getting up. >> Perfect. >> Put one of your knees in. >> There you go. >> Yeah. >> Coming over here. >> You have anything else on you? Oh, >> take a seat. >> My mother. >> What's your name? First of all, we have some other information we need to get. She has me being correct. >> Yeah. >> Y A S M I N. >> What are you on paper for? I'm going to find out. So, we could just do it easier. The more you cooperate with me, the more I'm willing to work with you, Miss DUI. >> It's for DUI. Who's your PO? >> What? >> Caesar. >> Caesar. What? >> Dig your feet all the way in. >> A top priority was keeping the children safe and ensuring they were cared for while the situation was addressed. >> Are you comfortable with taking her to the hospital yourself or do you want her to go with us? >> Hang tight for that. >> Okay. Cuz we're probably going to have to have a DR come out for it since it's dope. So, I don't know. We'll probably take her. She's fine though. So, I don't see why. So, it could go either way really. She's fine now and she could stay that way or she's got enough in her system that our Narcan's going to just slowly start wearing off and we could find her starting to I mean basically overdose again. >> How many uh narans you guys give her? >> So, we gave her two of >> the two. >> No, we gave her two, but it was an IM shot. So, it takes a little bit longer to kick in, but it could it could work. She could be good. You guys could have no problems with her. She could stay pissed off the way she is or she could slowly revert back to >> slumping over. >> Yeah, we'll hang for a few minutes if you want. >> If you don't mind, just cuz I have a soup on the way. >> Okay. >> Um and I think he's down with Dr. I I hate dope when it comes to DWI. So, >> okay. >> We'll see what he wants to do. >> We'll hang for a few minutes. You got us. >> Kids were good though. They complain about >> kids were fine. All right, brother. We'll be here. >> Sorry it went in front of you. >> No, no, no. You're good, man. You okay? >> Yeah, we're all good. Just annoyed. The mother was then taken to the police station where she received thorough guidance from officers. >> What's going on? Your mom's on the way. >> She's coming from Esa Grande, I guess, up there. Today's going to take about 30 minutes or so. We're going to have an off hang out here with your kiddos. Obviously, we're going to go to the station, fill out all our paperwork, and go from there. You have any questions? >> What did I run through? >> Huh? >> What did I run into? >> A bus stop. Luckily, no one was sitting there. But you hit a bus stop. So fix your feet for me real quick and we're going to get going. All right. Help out. It's got to be locked. I'm going fix it. At the station, authorities learn more about the situation, raising concerns for the children's well-being. Such circumstances could influence their overall development and daily experiences. >> Can we read Miranda? All right. Cuz I was going to ask you some very direct questions. So, this just the Miranda warning. I'm going to read up from our card. says, "You have the right to remain silent. Anything you say can be used against you in the court of law. You have the right to talk to a lawyer and have him present with you where you're being questioned. You cannot afford to hire a lawyer or one will be appointed to represent you before any question if you wish. You decide at any time to exercise these rights and not answer any of the questions or make any statements. You understand these rights as I just explained them to you with these rights in mind. Do you wish to speak? >> I'm just going to ask you. I have like I have obviously there's in there, but is it okay if your mom takes pictures for your house?" Yes, >> she says. Yes, sir. >> They're in my purse. >> So, the father of the children is there. Is it okay if the 2-year-old goes with their dad? >> Yes. My memories. >> She says it's okay, sir. >> Okay. Okay. Thank you, sir. So, Mr. Like I was saying, it was just a Miranda warning, right? I only have a few qu I have just a few questions. I saw the when I pulled up on scene, it was in plain view and passed out several times. There's witnesses saying that you're just doing circles slumped over on the in the driver car. How many did you smoke? >> I had just I I dropped some off at just half. >> Just a half of them? >> Yeah. And it was down the road. >> It was Where did you smoke it at? >> Um I was I dropped some off at the coach. >> You dropped some off at the coach site? >> Yeah. >> Are you slanking to it? No. You just dropped some off to friends some friends or what? >> Yeah. >> So when you hit the coach, did you go through Aanita or you went through lakeside? Through the back? >> I went through the back. >> Through lakeside. Okay. [clears throat] And then you smoked a blue at the cooks light or in the car? >> No, in the car. >> Not in the car. >> No. We got down, we smoked and then I smoked half of it and then we can have the rest. Um, and then I just left. I had to go to Walmart. Smoke anymore. >> Do you huff? There's a lot of air dust in there, too. >> I don't know. I'm not going to answer that question. >> You're not going to answer? I'm just asking cuz I mean I mean obviously you admitted to the I was just wondering about the if you huff cuz there was all that air duster in there. You don't >> I'm not >> Oh, okay. That's fine. You don't have to answer. Um >> I don't want to answer any more questions. >> That's your right. >> The legal process [music] proceeded step by step. Police took the mother to the hospital for a blood test while still respecting her right to consent or refuse. pretty. Yeah. Hopefully they check you out and make sure everything's all right. >> Thank you, man. Appreciate it. How are you? >> Good. See you in this chair. Here you go, ma'am. I better >> Hi. >> Hello, ma'am. How are you? >> Good. What's going on? >> This is She was involved in a motor vehicle accident uh in front of the comfort suits. Um basically, witnesses said that she was unconscious at the wheel and that the car was rolling at 10 mph and that it did two circles out a mess on Lakeside and the car went into oncoming traffic where it did another circle, hit a curb, and then rerouted back and hit a bus stop. Yeah, bus stop. >> So, where they sit? Yeah, where they say. So, yeah, that was it. And >> um we attempted to do a breathalyzer test. However, it came back that there's some sort of interference. When I asked my sergeant, he says that's usually some sort of medical condition going on. So, we just want to get her medically clear and checked out. And I'm also going to read the consent. See if we can drop it. Um M I just have to read you something. So, listen to me. I'm about to tell you something important, including a right you have. You're under arrest for uh driving while under the influence. I'm requesting that you consent to have your blood drawn and tested to determine the alcohol energy content of your blood. You have the right, Miss Pacheco, to refuse to to my consent and to my request. If you refuse to consent, you cannot face criminal penalties for your refusal. Do you understand that right, M? Okay. However, refusing consent has other consequences in accordance with the New Mexico Implied Consent Act and state law. Those consequences may include losing a New Mexico driver's license or non-resident operating privilege for one year. Additionally, the fact that you refuse consent may be used as evidence against you in a court of law. Do you understand this consequence? S. Additionally, if you consent to have your blood drawn and tested, you have the right to choose an additional independent test. If you choose to take this additional independent test, you have the right to a reasonable opportunity to arrange for a physician, a licensed nurse, or a laboratory technician of your cho your own choice to perform an additional chemical test. The cost of this additional test will be paid for by the law enforcement agency, which is us. Knowing your right to refuse consent, the possible consequences, and your right to an independent test, go. Do you give consent to have your blood drawn and tested? >> Just a breathalyzer. >> So, since the breathalyzer uh it came back invalid, ma'am, and it came back there. We're just requesting that we get your blood drawn just so we can know what's actually going on. >> Oh, when you fix your machine, I can do that. I'm not. >> So, you're refusing the blood test? >> I we accepted the other one. >> Correct. But this is just for further additional testing so we can see what's going on. Just cuz the breathalyzer came back inconclusive. >> That's all right. Oh no. But >> so you're refusing. >> I don't know what to do. I need an attorney. I don't understand. I understand. I understand. >> Okay. So I'll repeat my question. Knowing your right to refuse to consent and to have your blood drawn and tested, the possible consequences and your right to an independent test. Do you give consent to have your blood drawn and test? If you continue to remain silent, I'll consider you have refused my request. >> I don't understand. >> No. Yeah. So, basically, when we had the breathalyzer, it came back uh that there was some sort of inconsistency with it, that we needed to get you medically checked out, that there is something other than alcohol in your blood. That's why we came here to Three Crosses. One, to get you medically cleared, and two, to see if you would be willing to get a blood test so we could see what's going on inside your system, cuz it's not alcohol that you consumed. So, we're trying to figure out what exactly was. That's why we're requesting a blood test. >> I talked to my officer and I don't understand. The good news is that after explanations, the mother agreed to the test. >> I don't know. I don't know. I don't know. I don't know. I want to talk to someone that understands. I don't understand. >> Maybe you can break it down for me. >> So, you have you did the breathalyzer test, right? >> Glue in the thing. The results said that it was inconclusive, which means that they couldn't get a reading of yes, no, or whatever it said to give them an answer. The answer was not there. there's a medical issue as to why it's not coming up with an answer. So, they want to know if they can do the blood work to do that. >> But it's an alcohol machine. >> Correct. >> So, that's why we need a blood test to further see exactly what's in your system. >> No, you said because it was saying No, I don't feel comfortable with this. I'm just I just cuz you said it was detecting something else. >> Correct. >> But it's an alcohol system. >> Correct. So, there's something else besides alcohol in your system. >> But you wouldn't be able to detect that. I can't give them a a for sure answer level cuz there's something indifference that's not letting it >> correct. >> So that might be why that might be why the machine came out. But that's why we need to go ahead and that's why >> that's why they want to check your blood to see what is in the system that was causing it. >> Your Yeah, the noran probably. >> Correct. But that's why we wanted a blood test to go ahead and see. >> That way we can have to finish. He just wants to know if you want to have the blood test to say that or not. >> I Yes, she was unconscious. >> Correct. >> At scene. >> So >> was given narciss. This will be my last request. Do you consent to a blood draw? >> Wait, why am I I'm here so you can get the drugs in my system >> so we can know exactly what's in your system and one medic get you get you medically clear cuz you were in a motor vehicle accident and two get you a blood test. That way we can see exactly what's in your system cuz we don't know and our machine said that it's something else besides alcohol. That's why we just want to check. This will be my last request as much. >> And I guess they narc I don't know. Yes. >> So I need a Yes, ma'am. >> Yeah. >> She then returned to the station [music] to complete the remaining procedures. I have one for you guys. >> You already got one? >> Yeah. >> Okay. >> I stapled it to the >> I'll take the mag. >> It's stapled uh to the back of that one. >> Love too, man. >> Huh? Just the >> Yeah, that's everything. >> Okay. This can go with her. What did she go for? >> Just the clearance. She went to memorial for a blood draw and then she went to Three Crosses for clearance. Uh cuz she was in an accident. She was Narcan by fire on scene. >> She's been good ever since though. >> Yeah. The mother faced charges of DUI, resisting arrest, and child endangerment, and was taken to Dona on a county jail. Under New Mexico law, she could face [music] 3 to 5 years in prison and fines over $6,000. The case shows that substance use [music] can affect not only the individual, but also those around them, especially children. Each situation in this video is different, yet they share one common thread. Children can end up at the center of circumstances they never chose. Legal standards focus on actions rather than feelings. And when those actions may impact a child's well-being, some form of intervention is [music] often necessary. Even so, many of these moments could be avoided if adults paused and reflected a little earlier.
