Welcome to the dark side of family ties, where out of control adults demand control over children. >> I definitely want her in jail for domestic violence. >> Oh god. Oh no. No. My butt. My butt. >> 23 42. >> He got his 11year-old daughter to lie for him. >> Never get out of my house. You're hurting me. >> Please turn around. Place your hand behind your back. My husband isn't home with my kids. >> From Ohio to Illinois, from a stifling basement to a fateful turn, two mothers, two tragedies, and one haunting question. Who truly poses the danger to these innocent children? Welcome to Ohio, where the truth is distorted, love turns into violence, and children are stuck between two adults who have yet to grow up. >> I've been trying to get her to stop eating Xanaxes. >> August 3rd, 2024. An emergency call brought Dayton police to the scene of a tense domestic dispute. The man accused his girlfriend in a panic way, the mother of his children, of driving while high, physically attacking him multiple times, and even becoming violent in front of their two kids. Mixed were underlying tensions over a property dispute. >> What's going on, brother? >> Coming from upstairs. >> Okay. What happened, man? >> She's on bars and she's extremely up. She's driving intoxicated right now. You'll see it as soon as she looks in her eyes. She has my truck. She bought it, but it's in my name, so technically that's my truck, right? >> You guys are married? >> No. >> Have you guys lived together for a while? >> Yeah. >> You got kids together? >> Yeah. But even >> my law, it's actually both of your trucks, >> but it's in my name. >> In Ohio, that doesn't matter. If if you're uh in like a common law relationship, which is basically you guys have lived together for a while, you have kids together. >> Well, I have two kids in the house and she's being like that in front of two kids. She's on her third domestic violence charge. I would like her to go to jail tonight for domestic violence. >> Yeah, we'll try and find her. Uh, >> and before you get here, she's going to say that I kicked this bookshelf over, which I didn't. And I have my 12-year-old daughter in here that can come down here and tell you the exact same thing. But I'm not bullshitting my lip. >> Yeah, I see it. Yeah. Okay. >> You got a red mark in there. >> And she's going to tell you that uh I put my hands on her and my daughter will definitely tell you no, I did not. >> So, tell me what happened tonight. Tell me like a like a story. I've been trying to get her to stop eating Xanaxes for 3 days. She said she was going down to her grandma's to do something, which she went and got more Xanaxes. Then she said she was going to go do something. Then she went and got more Xanaxes and then hid them from me. When I told her it was either the Xanaxes or me, she went I rate. Like I said, I can show you the bookshelf that she kicked over. What's today? Saturday. >> Yeah. >> Oh, yeah. She'll be in there all weekend. I definitely want her in jail for domestic violence. Do >> you know where she might be going? >> No, she's running around hiding from you guys. >> If she does happen to go to jail, is there any way you can possibly get my keys and bring them to me? >> Yeah, if we uh if we get her, um we'll give you a call and then >> because I have two sleeping keys in the kids in the house. I can't get to them. >> We could drive the keys back to you. We could probably like park it somewhere and then drive the keys back to you. I can like drop them off at your house and then you'll just go get the car later if you need to. >> I mean, you you throw them right in the backseat of that car. I don't care. She thought I was playing, but I'm not. This is the third time she's put her hands on me. Any man, even you. I know you're a cop, but if a female puts her hands on you three times very violently, you're going to do something, right? Professional question. >> Yeah. What's up? >> If she does go to jail for domestic violence, does that qualify me to get emergency custody of my daughter? >> Could you just have to talk to a judge about it, but we can't really give you like a guess? >> She's looking at 6 plus. This is her third violation. >> We can't give you >> We can't say that. You would have to speak to a judge cuz they can only make they can only tell you that you can have emergency custody. Did she hit you in your mouth? >> Yeah. I want domestic violence charges. >> She hit you with like your fist or hand. I mean, >> how many times did she hit you? >> Three or four. >> In your face. That's your Oh, I can I explained it to you. It's a witness statement. So, you'll put your name. You'll put her name on this next line and then you'll explain to us what happened like what started tonight for you to call us. >> She has narcotics on her and pill. >> Okay. And when you see her, you will literally see how intoxicated she is. >> Well, if if you don't find her and she comes back, don't open the door. Call us back and then we'll come back out and she can be arrested. >> I hate doing this to her, but she needs help. I'd recommend any rehab instead of jail time. >> The next morning, they came back. The father was still shamelessly lifting his shirt to show an old wound. And the woman, she was dragged up from the basement, her face blank, saying, "He beat my with a cigarette in her hand and a baby beside her." Hey man, where's she at? >> Still back at it. >> Where's she at though right now? Hold on. Hold on. Where's she at? Where is she at? >> In the basement. >> Lead us to her. You don't have any weapons inside, do you? >> I mean, yes, but none on us. Do >> you have any dogs? >> Out back. >> They're out back. They're not inside. >> No, but apparently I'm the one going to jail cuz I'm the aggressor. >> We'll deal with that in a second, buddy. >> I know. >> No. in the basement. She has access to >> Hey, Destiny. >> Yes. >> What's going on? >> Okay, so he will not leave me alone. >> Okay, >> I'm sorry. >> Who's he to you? >> Um, he is my fiance. So, this is Well, I don't want to You carried to see my boobs. So, this is what um he did to me. It's kind of easier to >> That's okay. We can we can deal with that with the medic. >> We have a medic waiting for you. Keep your shirt on right now. Okay. >> You can see right here the bruise. Oh my god, it hurts. >> It's just on your bruise. >> My legs right here. >> Okay. >> Okay. Go ahead and put your cigarette out. Okay. >> Oh, sorry. The back of my leg right here. Hold on, baby. I know. I know. Come here. Come here. Come here. Hold on. Hold on. Hold on. >> That's okay. We're going to be your handcuffs right now. Okay. >> This is why we're figuring things out. >> He's the one who attacked me. >> We'll get that first. What? Take a drink. >> Hurry up. Take a drink. >> Set that down. Set that down. >> You see my bag, right? >> Yeah. >> See how I lit, right? All right. We had an accident yesterday and it's all in a report. All her marks are from the accident. What she says was from me. She's highly intoxicated with what? >> Xanaxes. And if you look at her, you could tell. >> She's smoking marijuana, too. >> Yeah, I smoke marijuana. Yes. >> Oh, I I don't care. But I was just wondering if she did as well. >> No. All she used is Xanaxes. >> She prescribed them. >> No. All right. >> Can I please put everything in my purse, please? >> I don't want to have anything in my purse. >> Okay, we'll deal with that. But in the meantime, >> sorry, my finger thingy. Look right. >> There you go. Okay. Okay. >> That's That's why I say Yeah. There you go. >> Can you please put my purse my phone in my purse? >> Hang on. Let me double walk this first so it doesn't get too tight on you. >> Everything went exactly as the father had planned. Destiny was handcuffed and taken away. >> Hey, Trembley. I'm going to take her up real quick. I know, baby. >> I know, baby. Hey, sir. >> Yes, sir. >> Will you come here for a minute? Will you take your child, please? >> Hey, Jesse, can you talk to this officer for me? This is the other This is the other. Give it to him. The cops are here, and I need you to explain exactly what's going on. >> Can my baby please not stay with him? He's very violent. >> He's dad, right? He's the biological dad. >> Yes, but I have five other people ready to come get her. >> Okay. Well, we're going to figure that out in a minute. Okay. >> Yes, sir. Yes, sir. >> Okay. Is that her stuff? >> Yeah. >> Keep walking. >> Oh god. Oh god. Oh god. We just had physical therapy back like for eight days in a row. We got some big settlement and like hit us. Oh, I can't. Can you help me? I'm sorry. >> Yep. Keep going. >> Oh my god. No. Okay. Go. >> There you go. >> Can I see how one second? >> No. We're going to keep moving. Come on. >> Cuz we have a seat for you. We want to get you checked out. Okay. >> Thanks a lot for you being my >> We're going to have one. >> Will you do me a huge favor? Move to that side of the bed for me. >> Just leave it. Move to that side of the bed. >> I'm sorry. Come on. >> I got it. >> I'm just going to >> Can I call my landlord? >> You guys both stay in here, right? Once >> we don't have a lease. Like our landlord, our last >> But that doesn't matter right now. Okay. Cuz you guys are both staying here. So there's an occupant residency. >> But I'm not understanding why I'm going to jail when he >> You're going to jail for a separate incident. You're not going to jail for this >> for what am I going to jail for? >> We're going to explain that to you in a minute. Okay. But Destiny's statement told a different story. While complaining of pain and saying she couldn't walk, she accused the father using both her and the child. These two grown-ups are only good at blaming others, causing the investigation to slip away from its focus. >> Is there any way they could be cuffed in the front? Like, I promise I won't run. >> We can't cuff it in the front. I got to do the same thing every time for everybody. But if you have a seat, medics will come take a look at you. >> So, I'd be in jail. >> No, I'm going to explain it. We're going to figure We got a bunch of things to figure out. Okay. We're going to look at a few things. Okay, ma'am. Medic's right here. I'm going to have you sit down and then you can talk to him and tell him what's going on. Okay. >> Butt first or >> just Yep. Butt first. >> Yep. Bring your leg up. >> Oh god. Oh god. Oh god. I can't. I can't. I can't. Okay. Oh my god. My nail. My nail. My nail. Oh. Oh no. Oh my nail. Okay. Okay. >> There you go. You're fine. >> Okay. Okay. Okay. >> Explain to this officer what's what's going on. You requested one, correct? Pretty much I was trying to get away from the situation and my fiance took my daughter out of the stroller. So if you're back in the house, I was gone all night taking care of my grandma because she has asthma. She was having a very bad episode. All he said was, "If you don't come home, I'm calling the cops. I got videos. If you doing this and he doing that, no, he doesn't. There's only one camera and I unhooked it and I took the wire with me." He said, "If you don't come home and talk to me right now, then I'm calling the cops and you're going to show blah blah blah." He literally said, "If you don't come home right now, blah blah blah, then I won't call the cops and then we can just sit down and talk." He's acting like a big child. But he literally did this to my leg. What's up with your neck? Do >> you want me to stand up and show you? Like, >> well, you can just show us right here. Just start pointing. >> Put on this shoulder right here. It's very bruised all around my neck. Like my back is very scratched up. Like, and he did all of this. The only thing I did to him when he pushed me into a corner, like he face pushed me into a corner. The one in there as soon as you go in where the crystal shelf is, he like grabbed my face and pushed me into the corner. And then I like pushed him back from me. And my hand did like push his throat. And I said, "Get the off of me." So that is the only time I ever touched him. But other than that, he literally just like would not stop touching me, throwing me on the bed. No, you're not leaving. and like you're not driving off in the car. That's our car. You're not doing this. He like literally just would not let me leave. And I was like, I just need time away from you. I need time to think. I don't want to be with you. >> When did all this happen? >> Last night was when it got really bad. But the day before was when I had to go spend the night with my grandma. And he was like, "Really? You're going to spend all night with your grandma instead sleep in bed with me?" His daughter that is like 12 years old. Really quick, Destiny. Okay. Hold on, Destiny. Hold on. What do you need these gentlemen here to check on? You called them here. You requested >> like my back, like my legs, like they just hurt so bad. Like I can barely walk. Like my toe right there, my pinky, like everything hurts so bad. I'm in physical therapy. We're supposed to go today. We're supposed to go eight days in a row for like a company truck hit us and we're supposed to get like a big settlement. They do the water bed thing and the massage thing and everything else. It's getting like a little bit better, but like it hurts so bad. like my fat 16 her. >> The climax came when she shouted, "He made my daughter lie." Both tried to play the victim, yet neither bothered to see the toxic storm they had just unleashed on their child. >> Hey, have you taken anything today? >> No. >> You haven't taken nothing? >> No. >> No pills? Xanax? You haven't been drinking? >> He keeps saying that, but no, he has taken Xanaxes. He has drinking. He's taking pain pills. His mom gets pain pills and sandexes, the peach footballs, cocaine, and he goes over there every day and snorts them with her. Is there any way you can look at my bag and see if it's really bad? Okay, just please be easy. Easy. Easy. >> Step on out. Okay. >> Okay. Oh god. No. No. My butt. My butt. Oh god. Oh god. Okay. >> Well, I mean they are hard plastic. >> Sorry, little wedgie. Ow. Ow. Ow. Okay. Go ahead and face in. Okay. This this gentleman here is going to look at you. >> He's not going to jail too if he's the one who beat my So you just got a little soft abrasion right here. It's going to heal on its own. You don't worry about that. >> But can you look at his back? Like his back is way less worse than mine. Mine's way worse. >> Okay. >> Like the whole thing is is I was I was gone last night and he got mad that I wouldn't come home and he called the cop. He got his 11year-old daughter to lie for him and say that I smacked him and she was sleeping. >> So right now you're going to take a seat back in. They can't do anything else for you right here. Okay. >> Is there any way going to explain all this? Okay. There you go. >> Oh god. >> Yep. Go ahead and move. >> Is there any way? Oh, I can pee before I go. >> No, you're going to have to hold it. >> Okay. >> Okay. I'll make sure we get this through. Okay. >> But can my Can you please go with my my family and not him? He smacks the baby and throws her in her bed and like he's very abusive. >> We're going to double check. Okay. We're going to look at like I said, we're going to look at a few things and then we'll see what we're doing. >> Threw her across the room. >> Okay. Hang tight. Okay. >> But in this battle, the father held the advantage with a statement from their 11-year-old daughter. While Destiny had only bruises and tears to defend herself. >> Excuse me. Excuse me. Excuse me. I'm so sorry. I'm just listen for a second. >> Is there Is there any way you can turn the air up? >> What? What? >> Just hang tight with her. >> Yes. >> So, you guys both living here together? >> Yeah, but I plan on moving. What happened this morning? Why did you call us here? >> Because she came back home and she was still IRA. She was still on Xanaxis. She told me to call you. She said she said she was going to call you guys because I beat her. >> So nothing physical happened between you guys this morning. All that stuff happened last night. She just came back. >> No, this this happened this morning. >> Okay. What's that from, buddy? >> Her pushing me away and me trying to walk away. >> Okay. What's that from? >> Her punching me in my mouth >> this morning. >> Yes. Okay. >> And last night, >> your other officer should have documentation of it. >> Yeah. Yeah. Yeah. I'm I'm going to check that. >> They took pictures because I tried to get her put in jail last night. >> Okay. >> God damn. >> I can't hear you, ma'am. What? >> I This is hurting my shoulder. The seat belt. Can you pull it down just a little bit? >> I don't understand what you >> like. Can you pull it like over like just down like right there? And can you please turn the air on? >> The air is on. >> It's all the way up. >> Yeah, it's running. >> So, he's going to have custody of mying baby. Was your daughter or your older daughter awake for everything that happened this morning? >> Yeah, that's why I would like you to talk to her. >> Would you mind going up and speaking with her real quick for me? Yep. >> Okay. [Music] What happened last night before she left? >> Oh, she she put her hands on you and there was like a big like red mark on your back and I was in front of you. I was like right there and there was like a bunch of yelling and stuff. >> Did she also throw the fan at me? >> Yeah. >> Did I put my hands on her whatsoever? >> Nope. And there was a shelf that she kicked outside that she broke. >> They stalk me. Okay. >> We're We're leaving the day, baby. You don't have to deal with this no more. >> Thank God. >> Mom's probably going to go to jail. >> Okay. >> After all the tears and begging, the mother stood alone in the cold grip of the law. The moment she heard her abuser got custody, she started screaming wildly. And oddly, all her back pain suddenly vanished. >> Why the does that abusive person get to get my baby? The person who beats the out of me. I go to jail because y'all want to believe him because I wasn't here. Excuse me. >> Can I be going to teach you or something? Say bye to my baby. >> Hold on. We have a lot of things we're figuring out real quick. >> Okay. But I'm like drooling everywhere. >> Okay. Hold on a minute. Okay. Talked to the daughter. She said uh both last night and this uh this morning, mom has been physically attacking him. Threw a fan at him. uh yelling and stuff like this. Stop. >> Are you taking him to jail, too? >> No, he's not going to jail, too. You're going to jail. Stay in there. >> Stay in there. No, don't put your leg in there. You >> put your leg in there. >> You're hurting me. >> No, I'm not. Stop. >> You're going to get charged with vandalism. You're going to get a felony. I want to see my baby. That's all I want. I want to give her a kiss crying. >> Maybe as in no you won't because I mean I want to say one thing to him and I want to see my baby before I go. >> I will never be with you again. Yeah. >> They must not have been tight. Hold on a minute. Hey, >> I'm not putting a mask on until I see my baby. >> So, here's the deal. This is going to No, >> I want my baby. Ow. No. I want my baby. >> Turn around and face me. >> No. >> Are you really going to go this route? >> I want you to give my baby a kiss and then I will cooperate. >> That's not how this works. Okay. You're going to jail for incidents that happen. >> I will never be with you again. Never. Get out of my house. >> Stay right here. Stop. You want to see your child or not? >> Ah, you're hurting me. >> No, I'm not. Yes, you are. You are hurting me. My shoulder. It hurts. >> Do you put it on your stay off of the shoulder? God damn. Justin, don't ever have to deal with me again. Go to your mom. >> Stop. >> I just want Ow. Can you untie these, please? >> No. >> Because of the way you're acting. >> I just want to get my baby. He's already beat my but I go to jail because I wasn't here last night and y'all believed him. Like are you kidding me? Like because he said I beat his and he put marks on himself. I go to jail. How is that right? Can you loosen it just a little bit? It's too tight. >> Show me your hands. >> Look at them. >> The struggle ended with a plate. I just want to kiss my child one last time. If you're going to continue to act like a child, then no, I'm not going to. We're just going to go >> out of the car and let her give me a kiss. >> We're going to bring her to you just like we did. You can give her a kiss. You can say bye. I'll see you in a little while. That's all we're going to do. >> She's going to know I'm crying and she's going to cry. >> She'd like to uh kiss the baby before she goes. >> Do you want to bring over as well? >> Can you wipe this off my nose? >> Yeah. >> Come here, baby. I love you. Oh. Yeah, I'll wipe it off. >> You happy? I never want to be with you. Come here. Give me a kiss. >> I told I told this cop if you start I'm going to take her from you. You don't have to be with me again. >> Give me a kiss. Give mommy a kiss. Take her big. >> You have her scared. >> Because of you. I never want to deal with you again. Do not be here when I get back. >> I won't. Neither will my kids. >> Yeah. Neither will Joe. Joe will find out. >> I'm getting emergency custody of my daughter. >> No, you're not. I will. >> No, you're not. >> I'll be in jail for a day. door, please. Can I get >> Yes. >> Okay. Your food stamp card. >> I want that with me. >> You want it with you? You don't want it with him so that way he can feed your child? >> No. >> Okay. >> He has no salt. >> Okay. She said no. >> Okay, that's fine. >> Turns out Destiny still has two active warrants. A child raised by a mother like her. Sooner or later will follow her path, becoming a distorted version of her. And when a child is a victim of domestic violence, the psychological wounds may haunt them for life. >> So, this is the deal. Yes, you're being arrested today on not only whatever they called last night. I wasn't here, so I can't attest to that, but you did have a broadcast with us for your events last night, but you also have two warrants, which are both confirmed. One out of Minera, one out of Montgomery County. So, you're also going to jail on those two. Your daughter is going to stay with dad here where you guys have been living. When you get out, if you decide you guys are going to separate >> in 2 days, >> well, if you guys are moving in 2 days, that's fine. You can take daughter, but you can't be living together if you guys are going to act like this. cuz it's look it's it's going to get it's pretty soon it's going to get child children services involved. >> So we've already had >> Okay. So you've already you've already had it. So you understand >> the hand. >> Okay. So you understand. >> I'm sorry. I don't mean to be difficult but I'm having a panic attack really really bad. I'm having a panic attack really really bad. I can't breathe. I'm just having inhaler. Where at? >> It's in my safe. My bruise on my left shoulder. It's just hurting me so bad. Ow. Ow. Oh my god. Oh my god. Sorry. All right, let's go. The mother, Destiny, was arrested and charged with domestic violence. Under Ohio law, this charge can carry a prison sentence of 9 months to 3 years and a fine of up to $10,000. Bail for this offense can also reach as high as $10,000. But what do you think? Is this father truly a good one? With so many red flags, should the police dig deeper? Share your thoughts in the comments below. Though Destiny was arrested, the story is far from over. Somewhere else, another mother leaves her child home to go drinking. Degree in hand, excuses on her lips. >> Deep breath. >> Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. >> On January 23rd, 2025, Illinois police received an emergency call about a serious crash at an intersection. Shaken. Witnesses said a woman lost control of her car, took a wide turn, then drove straight onto the sidewalk. When officers arrived, she tried to appear calm and cooperative, but they quickly noticed signs of instability. >> Hey, uh, do you have one that's uh, more current? >> I know you dropped one. Is that >> No. Um, >> I'm so sorry. What is that one? >> This one is from December of December of 24. Do you have one in your name, too, or No. >> No. >> Yeah, I saw the name. Let me Let me take a look at the other cards. >> 23. Um, this is my husband's. Okay. >> Can you want to see if he can send you a picture? I'll give it back to you for now. >> Yeah. No. No. Is he at home? >> He's not. I I don't have my part like my phone at all. >> Okay. All right. Okay. All right. Just sit tight for a minute. >> I give you my like I can give like the phone number. >> But for him? >> Yeah. >> Yeah. Go ahead. You want me to tell him that you're okay and I just need the insurance? >> Yeah. >> Okay. Yeah, I can do that. >> Okay. All right. So, I'm wrapping up most of the paperwork right now, but I got some questions and stuff I want to talk to you about. Okay. Can you turn the car off for me? >> Yes. So, you're coming from >> Prairie. >> From Prairie. And that's where you live. >> Yeah. >> Okay. And you have kids at home? >> I do. >> Okay. How old are your kids? >> Two and three. >> Who's with them right now? >> My husband. >> Your husband. Okay. You said he was at work, but he's at home. >> Yeah. He works from home. >> Oh, got it. Okay. Does he know that you left? >> Yeah. >> Okay. All right. Uh, what were you doing before you came out here? >> You're at home? Okay. What were you doing at home? >> My kids. >> Just with the kids today and the family. Okay. Have you had anything to drink today? >> No, sir. >> No. Recreation? You smoked marijuana or anything like that? No. >> Nothing. Do you take any prescription medication? >> No. I mean like what prescription? >> Like anything that Do you take any sanex? No. >> No. Like anything that they tell you to be careful if you're driving or operating heavy machinery? Nothing like that. Okay. What's your highest level of education? >> Bachelors. >> Bachelor's degree. You have college? >> Yeah. >> Okay. So, I'm going to ask you to do two things for me. Okay. First one, I want you to say the alphabet for me. I want you to start at E and I want you to end at W without singing. Okay. Okay. E F G H I J K L M N O P Q R S T V W X Y Z. >> Okay. All right. And then for counting, I want you to start at the number 67. And I want you to count backwards down to 43. 67 66 65 63 64 63 62 60 69 58 57 56 59 54 52 52 51 50 49 58 57 56 59 54 53 51 50 49 48 57 46 49 >> 48 44 43 42 41 48 tools. >> All right. Do you do remember what I asked you to stop at? >> I don't. Sorry. >> 43. >> And so the DUI test began in the bitter cold. But from the very first step, she already struggled to keep up. >> What I'm going to do is I'm going to have you step out of the car. Okay. Come stand here for me real quick. >> This is my uh my burn officer. He has my other partner officer. >> He's our community service officer. So he's just he's here just in case cuz didn't know if there's injuries. Step right here for me. >> So I'm just going to make you face me. Just stand just like this. Put your feet and heels together and your hands on your side. Okay. Do you wear any glasses or contacts? Nothing. Do you have any eye injuries or abnormalities? What I'm going to do is I'm going to take my finger and I'm going to move it from side to side. And I want you to follow it with your eyes and your eyes only. Don't turn your head. If you need to blink, you can blink. Okay. So, I'm going to start out. Just look at my finger. Just a tip. Don't turn your head. There you go. All right. Can you see my finger clearly? Yeah. Okay. All right. That's just to help you so you just kind of get an idea on how it feels. Okay. All right. Okay, now we're going to go up. >> Keep your chin flat for me. >> There you go. Okay, we'll try it again. Don't move your chin. >> All right. >> All right. So, what I want you to do is I want you to stand face this way for me. >> Stand just your hands on your feet and heels together just like this. What I want you to do is I want you to take your right foot and I want you to put it heel to toe just like that. It's just instructions for me. Okay? So, stand just like I am now. Your right foot, you're gonna put your heel on your left toe. >> Don't. Yep. You're just hold it like this for me. Okay, Alissa. Step back for me. >> Oh, no. >> We're not going to start yet. I'm going to give you instructions and I'm going to show you how to do it. Okay. You understand what I'm saying? Just stand there. Just watch me. Don't do anything. >> I'll tell you when to move. Okay. >> Okay. >> You understand? >> Yeah. >> Okay. Feet together like mine. Go ahead and move. Now put your right foot in front of your left foot and just hold that position. Yep. Stand just like that. Hands down at your sides. Okay. Just put your hands at your side like that. Just stand just like that. Okay. When I say begin, you're going to take nine heel to toe steps in a straight line right in front of you. The width of your foot. You're going to count your steps out loud in the following manner. 1 2 3. When you get to nine, you're going to take a series of small steps back. And you're going to do nine heel to toe steps back. Okay? It's okay. Take a deep breath. So, just like this. Don't start yet. Don't start looking at me. >> Don't start yet. Just like this. You're going to go one, two, three, all the way until nine. Keeping your lead foot on the line. A series of small steps. Look at my foot, please. Just like that. >> And then turn around to do nine. One, two, nine. Right. >> Once you start, don't stop. You're going to look at your feet while you walk and count your steps out loud. Do you understand? >> Yes. >> Okay. You may begin. One 2 3 5 6 7 8 9 1 2 3 4 7 8 9. During the next test, she barely made it to 1,11 before suddenly collapsing. Yet, despite all the signs, she denied drinking, blaming it instead on her anxiety and antid-epressant meds. >> All right, one more. Okay, >> you feel like just just like this. You want to put your hands in your pocket for a second? I know your hands are cold. >> No, it's okay. >> Sure. All right, stand just like this. >> When I say begin, you're going to pick a foot, either foot of your choosing. You're going to raise it 6 in off the ground. You are going to look at your toe of the raised foot. You're going to count out loud in the following manner. 1,00 1,002 and so on until I tell you to stop. Okay. All right. Are you ready? >> All right. >> Let me begin. >> 100100. >> Just pick your foot back up and keep going. >> 100 1 2 1 4 1 5 1 6 1 7 1 >> Uhoh. >> I'm okay. No. No. It's okay. No, it's okay. No, no, it's okay. >> Okay. Are you hurt? >> Nope. I'm not hurt. >> Go and put your hands in your pocket for me. >> No, it's okay. >> No, no. Put your foot back down. We're done with that. We're done with >> I have a question for you. Okay. >> I'm going to be very honest with you. Have you had anything to drink today? >> Nothing. Zero. Okay. Have you taken any anything that's in Have what you have? >> I have Xanax and I have like moose stabilizers and I have >> So, you're on medication right now? >> Yes, I have. cuz I can see it in your eyes. Okay. >> I took a Xanax and I took other drugs earlier and I am so >> What are your other drugs earlier? >> You have a pent. Okay. >> What do you take that for? >> Anxiety. >> And probably depression. >> Depression. Do you have any of those on you right now? >> No, I don't. >> When's the last time you took your meds? >> Um, no. >> How often are you supposed to take them? Um, take like and I take as needed, but I took it at like 11. >> Okay. 11 in the morning, right? >> Yeah. >> Okay. >> With no other option, police had to bring out the breathalyzer and the truth came out. Not only did she exceed Illinois's 0.08 limit, she blew 2.5 times over the legal threshold. With that number, the law had to step in. >> All right. Okay. What I'm going to have you do, this is for alcohol only. Okay. What I'm going to do is I'm going have you take a deep breath and you're going to blow it up like a balloon and you're going to blow until I tell you to stop. Okay? You're going to refuse. Okay? Cuz I'm going to tell you that I can I smell alcohol as soon as I talk to you in the car. Okay? Your speech is slurred. Your eyes are glassy. I'm getting a lot of eye movement on my gaze. I stagmus. Okay? I would like for you to do this. Are you refusing to do this? >> This thing's not going to go to court at all. As far as that part, it's a prelim preliminary portable test just to help us gauge where you are at. If you're like a 0.07 0.08, you're having conversations with us, but I do smell it too. Okay. And it is noticeable. So, of course, maybe I mean it depends on it gives us a better accurate reading. Otherwise, if we don't have an accurate reading, we have to go off of what we see and we have a strong odor. You know, as you saw the tests, we're not exactly one for one the best. So, this gives us a better understanding at where you kind of are at. That's why it's I would say it's beneficial if you did. The ball is in your court. Okay. >> So, can you give me what if I did and what if I didn't? So, I have to make a decision. If you don't do it, if I don't do it, no. No. If I don't do it, what? >> Then I make a decision based on what happens next based on what I've observed with my perception of the odor of alcohol, your eyes, and the test that you conducted for me with your counting and the alphabet. This just is part part that helps me make a decision. Are you willing to do it? >> If I don't, if I'm not willing to do it, what are my options? >> Well, he'll have to make a choice whether or not to arrest you or or arrest you. >> So, if I don't do it, he will arrest me. But if I necessarily I'm not saying that's a guarantee answer guaranteed answer depends on his choice and what he wants to do as a primary officer. >> If I was I'm not the one here here's the thing I genuinely want to know >> here how about this I'm not the one making the decision decision okay but I'm his backup officer if I was in his position I would arrest you if I don't have a PBT accuracy >> if I don't have an accurate number. So like obviously we have problems if we're like 0.1 right like triple the legal limit we have problems. I don't think you're there. I can only see and observe based off the fact that I see a hand. Does that make sense? No, >> this gives us an accurate reading as far as that happen. >> So, Alyssa, okay, >> it's cold out here. I know you're cold. I know they're cold. I need an answer. Yes or no? >> Yes. >> Deep breath. >> Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Good job. >> All right. So, the vehicle limit Illinois is 08. All right. You are a 207. We're supposed to be at 08. You're two and a half times. Please turn around. Place your hands behind your back. You'll be under arrest for DUI. Watch your head and I'm going to blast you. >> Tension erupted when she suddenly confessed, "My husband isn't home with my kids. She had left two small children home alone for over an hour with only two dogs just to go drinking. A tragedy born from selfishness and irresponsibility hidden behind a degree and awkward lies." >> Melissa, correct? I have to do a search before I get to the car. >> My husband isn't home with my kids. >> He's not? Where is he? >> He's working. >> He's working. Okay, we'll try to give him a call and see where >> No one is home with the kids. >> No one's home with your kids. Where's your kids at right now? We'll see. We'll see what we can do to uh accommodate until your husband gets there. In the meantime, just like I said, we have we have extra people if if you want. >> All right, I'm going to go through your real quick. Do you have a house key? >> Um, yes. In my um >> Was it one of these by chance? >> Yes, probably. >> This is your house key. >> Yes. If you went through my gate, you would probably get to my kids. >> The gates. >> I have a white gate. >> Okay. >> And if you went through there, through the back door, that's how you get into my house. >> Okay. Through the back door, you said? >> Yeah. Um, and I have two dogs, but ignore them. >> Do they bite? No, they don't. >> The two kids are probably asleep, though. >> The The back door is unlocked. It It is literally unlocked. It It's unlocked. >> It's unlocked. That's all right. We're having an officer go out there and they'll they'll hand it off. Okay. >> Okay. Did anyone go to my house? >> Yeah, we have officers going right now. >> Okay. Thank you. >> They're going right away. >> Okay. Thank you, sir. >> On the way.
