Shut up. [screaming] PLEASE, >> PLEASE CHECK MY DAUGHTER. THAT'S my sheep over here. [laughter] >> I'm sorry. >> As soon as I said that, she in my face. >> Get on the ground now. Ground. >> These adults [music] still believe they're in control even as things around them start to go off track. >> And they diagnosed her with a moderate concussion, which is an escalation from yesterday. >> She was here, but she was acting super weird. They may not notice the issues immediately, but the safety systems are already alert. And once activated, there's no time to wait. These witnesses each shared what they saw. Their accounts gradually revealing a picture the mother had tried to keep private. >> Flew the red light and then she was coming good cuz she had the green and she her and her car went two three times and it finally landed like this. On July 14th, 2024, police were called to a highway after reports of a traffic incident involving a woman driving with a young child. At the scene, the mother appeared overwhelmed, concerned for her child, and shaken by the unexpected events. >> Please check my daughter. Of course, >> does she see it? Step over here. I'm sorry. I'm >> Did she have any loss of consciousness? >> As soon as we got hit, she cried. And that's amazing. >> How old is she? >> Oh, you're in too much. I can't breathe. >> Okay, so far we have uh one oneyear-old female. [snorts] Um appears to be okay, but if we can keep a messing around just to check her out. Which vehicle is yours? >> The [ __ ] orange truck. >> Okay. [laughter] I can't right now. I'M SO >> this guy ran around. >> I can't. >> Okay. >> I tried. I'm like I know. He told me it was okay, but I just fine. >> Are you okay? Are you the only ones in the vehicle? >> Are you okay? >> Okay. >> But these two little witnesses that the light turned green as soon as I went. This guy I know maybe >> as soon as they kind of got her out of the vehicle because that's my main concern is my daughter. And I'm glad these guys caught the cops and called them because I don't know what that car did. >> So these people these people stopped and they saw what happened. Okay. Who's in that one? Do you know? Oh, I don't know her. >> You don't know her? >> But she helped me. And this is like I'm thankful that they stopped iting help me cuz right now I can't like I'm so emotional. >> I know. Me. >> I know. It was traumatized cuz I like that car. She started like crying a lot, you know. >> I can't like Sorry. That guy like literally ran the red light and scared me. >> Do you know this individual? >> No. She's dude. This car was like a scarfy and like dude I can't >> either her aunties her grandpa. >> Okay. Was she in her car seat? >> Yes. >> Front or rear facing? >> I just unbokeled it as soon as I could. As soon as we got that >> Did her airbag go off or >> not that I know. >> Did yours go off? >> No. >> Okay. Were you wearing your seat belt? >> Yes. >> We all were taking off. >> So it's just her and her vehicle. >> But my heart is like nonstoping right now cuz my daughter Yeah. She's fine. >> I know who she is because as soon as they hit that car and thankful for these guys in that orange truck. >> I know. >> Yeah. She's fine and you are fine. Okay. >> This guy brought a red lion and I needed real quick. >> She said yeah. And no airbag deployment on her side. >> The airplanes have been deployed. >> So I know it's up, but at least hopefully that guy has her insurance and Sana hard. Like she cried as soon as I just want to make sure she's okay. I don't care if I'm okay as long as she's okay. >> Once the initial confusion settled, a new phase began, the investigation. Witnesses [music] described what they observed and the mother, initially seen as a victim, gradually became the focus of questions about her ability to safely operate the vehicle. >> Okay. Are you okay? >> Yeah. >> Okay. Um, were you wearing your seat belt? Looks like it. Okay. >> Um, what happened? >> I was coming this way. I had viewers on >> me and the car just me and I play. >> Okay. So, you rolled over. Okay. By chance, do you have your license? >> Yeah. Was anybody else in the vehicle? >> No, no, no. We We're just witnesses. >> Okay. >> Yeah. She the woman over there. She ran the red light and >> Oh, was she driving the truck? >> The truck? Yeah. The woman over there? Yeah. >> So, you guys seen her run the red light? >> Yeah, she ran the red light and then she was she was good cuz this light was green. >> Yeah. >> She was in front of us. >> She was in front of you guys. >> No, she was coming this way. The red truck was in front of us. >> Okay. >> So, the red truck flew the red light and then she was coming good cuz she had the green. >> Yeah. and she hit her and her car went two three times and it automatically landed like this. >> Okay, we should be okay for right now. >> Okay, I just want >> 47. Um, I'll be at New Mexico Robert William 401. You >> need an ambulance? >> Did you block out or anything? >> Yes, I'm in. >> Now I can say I spoke to you guys. So you guys were >> she was uh was she stopped at the light originally? >> So was she she was coming from over there, right? >> Yeah. Yeah. >> The light on here was red. >> Yeah. >> Me, her, the that truck over there, we we were stopped right here cuz it the light was red. >> So all three of you guys were stopped. >> Yeah, we were stopped. So she she flew the red light and she heard. >> So for whatever reason, she took off through the red light. >> I couldn't do but she smells. And then now she's like, "Let's go ahead and run." And as long as I behind this guy. >> So Oscar's here, so unfortunately he's going to have to take it. Unfortunately for him. >> Um, so witnesses all say they were all three stopped here. >> Uh-huh. Who all three? >> Her. >> Okay. >> And other cars. Okay. >> We're all stopped there cuz they had the red light. >> Okay. >> And she said a truck randomly took off and this white car rolled like three times with the silver car. >> Um, and that's when we all pulled up. She she definitely ran the red light, but she was stopped at the red light >> and decided to go. >> Police asked her to complete several onseen assessments of focus and coordination. It was a tense moment. Someone already shaken by [music] a sudden incident. Noise and flashing lights now had to follow detailed instructions. >> Ma'am, sorry. >> So, who was driving through the tire? >> You were driving. >> Okay. Come over here with me. Okay. >> No, not yet. Okay, cool. Stand right here. Just stand right there. >> Sorry. I'm so right now. >> You don't need it. >> No. >> I don't have this driver, but I don't have >> in the car if you want. Maybe you first want >> Clissa. >> Clissa. Okay. closer. Let me ask you a few questions. Do you know if I okay physically wise? >> My head hurts a lot. I feel a little bit dizzy after. >> Okay. After he you >> or he or she? I don't know. >> So today uh you're just coming out of work because I can't say since the word. Yeah. You going you going home? Do you have anything to drink today? Nothing to drink at all. Okay. Do you take medication? >> I do take I mean birth control patches. >> Okay. >> What other than Okay. >> Okay. Yes. Are you diagnosed with diabetes and anything like that? >> I'm supposed to get ultrasound tomorrow for like anything that's going on cuz I've been experiencing some mental issues, but other than that, nothing. >> Okay. Do you use any kind of anything like that? >> No. >> No. Okay. No matter. >> No. >> Okay. You can do anything. I'm going to ask you something. You can refuse it. Okay. But right now, because of the crashes and stuff like that, I'm going to be asking if I can do some field sobriety test. That's fine with you. >> Sorry, my heart's just going really fast. I experience anxiety. >> Okay. Do me a favor, then that's what's going on. Take some deep breaths. >> Hold on. >> I can help out a little bit. Relax. Okay. >> My cousin works for you guys. >> Yeah. Who's your cousin? >> Derek. >> Derek. >> Derek Solano. >> Oh, Derek Solano. Okay. You call him Derek? >> Derek. >> Derek. Oh, Derek. Okay. And your name again? >> Clarissa. >> All right. Clarissa. Okay. Go ahead. Are you going to go ahead and take your glasses off? >> No. >> You have to take your glasses off. I can't see without my glasses. >> You can't see at all. But what about if I put my finger about 12 in of the width, but you still can't see my finger? You have to have your fing your glasses with lifted >> for now. Try to take them off. Okay. I actually insist to take your glasses off. >> Okay. >> All right. Thank you. Appreciate >> Can I tie my hair up? I don't have a hair tie. I thought I did, but I don't. It's cuz the wind is go ahead and stand forward like this. Hands to the side. Feet to the side like this. Okay. So, I'm going to give you some simple instructions. Okay. I'm going to put my finger right in front of you. Okay? Can you see my finger? Here we go. You're going to follow the tip of my finger. Okay? That's it. You're not going to move your head. You're just going to move your eyes. >> My mom has seizures. So, can you turn off the lights? I know. Like, >> can you turn off the lights? Thank you. >> My mom has seizures. So, like the lights, >> you got them, too. >> I've had them twice. >> Okay. Boom. >> It's okay. >> Better. >> Yes. >> Okay. >> Thank you. >> Okay. Can you see the tip of my finger? >> Yes. >> And when we get simply remember, pull your hands to the side. >> Oh, sorry. >> Just give them to the side. Do not move. The only thing you're going to be moving is your eyeballs. Okay. With your eyes and your eyes only, follow the tip of my finger. Okay. Sorry, I blinked. >> No worries. You can blink as much as you want. Okay. So, Clarissa, I want you to be honest with me, okay? You spoke to me a little bit, right? And we're close now. I was able to smell something. >> Okay. So, I'm going ask you one more time. Do you have something to drink today? I did after one. >> After what? What you did? >> I drank out one. >> What did you drink though? >> A margarita. >> A margarita. That's one. Just one. >> Just one. >> Okay. What kind of margarita was it? Like one of those with a fancy glasses. A simple cup. >> Uh spicy guava. >> Okay. How many ounces do you think? >> Eight. >> Eight. So you only had one margarita. That's it. >> And like I said, these people witnessed it. I think these guys went on. Like I was just trying to go home after picking my wine out. >> We're not talking about the trash. >> No, I know. >> Okay. We're talking about >> But I'm explaining. >> Okay. That's fine. You can explain to people why I'm talking about something. Okay. You want to continue doing the field soriety test? Yes. Okay. But go ahead and do me a favor. Okay. Put your hands to the side. Feet to the side again. Okay. So, we're going to do today >> I'm a little shaky cuz like I said, I have no way. It's okay. If you don't want to do these, it's fine. >> That's fine. I know you have one. >> No, but I still breastfeed you. That's the point. Like, I'm not trying to go >> like you are. I don't care how I >> Okay, >> I'm ready now. I have to. >> So, you ready to take the test? Okay. So, go ahead. Put your feet to the side like I was telling you. >> Can I put on with the glasses on? >> Yeah, you can put the glasses on now. >> Okay. Go ahead and put your feet to the side. No, no, no. Hold on. >> I'm giving you instructions. Okay. So, go ahead. Put your feet to the side. Just like I'm going to give you a demonstration. Okay. Okay. I got to do something different than I am. All right. Okay. So, what I want you to do is you're going to put your feet to the table. What I want you to do is you're going to put your right foot in front of your left foot to just like this. Go ahead and put in that position. >> Okay. Try to hold it. Okay. >> You feel a good st a good stance. >> We got to be doing these tests. Okay. >> Are you ready to take the test? You told me yes. I'm going to take it up there. Okay. You ready? >> So, go ahead. Put your hands to the side. Okay. Put your right foot in front of your left foot from heel to toe. Just like that. I'm going give a demonstration. I'm going to be taking three steps. You're going to be Go ahead and stay in that position. Don't move at all. YOU HAVE A NICE LOOKING. OKAY. SO, what you're going to do is like this. Take a few steps like this one. Take a n step. Do a small circle just like this. Okay. >> Uh-huh. You're going to remember, just listen to what I'm telling you, okay? Don't move. Don't move. Okay? And then you're going to come back to the same spot you were. You're going to take another nine steps. Okay? I'm taking three. One, two, three. You're going to be taking nine. Do you understand the instructions? You need to repeat again. You got it. >> Okay. >> After multiple requests for more time, to contact [music] family, and to calm herself, the mother still had to meet her responsibilities under the law. >> I have 10 seconds here because you may not believe it, but I really have anxiety. >> It's not about me believing it or not. Okay. But that's why I asked you. That's why I asked. No, I asked you if I >> This is the second time. >> Okay, now you can have water. >> This is the second time that I've asked you that if you're ready, then you say yes. >> Okay. Can I call somebody? >> Huh? >> Can I call somebody? >> You're done with the test? >> No. But can I call somebody? >> No, you can't call somebody. We're doing test. That's why. So, right now I'm going to ask you one one more time, Clarissa. If you keep on saying like, "Can I take Can I do a call? Can I take 10 seconds?" I'm taking as a refusal. Okay? Cuz I keep on asking you, keep on making pauses. Okay? So, one more time. I'm I'm the one who got hit. >> Okay. So again, you want to take these tests or no? >> Oh, why? >> So at this point, you're this I'm taking as refusal, okay? Cuz I'm not going to be going back and forth with that, okay? I'm making a pretty simple instructions. We'll keep on saying, "Okay, so do me a favor right now. Turn around for me. Right now, you'll be arrested in front of DW. >> Sorry. >> I left my Thank you. All right, Clarissa. Anybody can take your kids. >> Can I send my >> Oh, is your mom here? >> No, they're my mother-in-law. >> Okay. Your mother-in-law? >> Yeah. >> Let me double check these real quick. Hold on. Hold on. >> You have any gum on you? Anything like that in your mouth? Any minute? No. I'm up. >> Okay. Let me see it though. There you go. Thank you. You should go ahead. You can't go over whether you're with me. Okay. I'll talk to your mom or your mother-in-law. >> No. >> Go. We're going to this one. Okay. >> This one to your left side. The verification process continued [music] and she was taken to the station for further procedures. There she mentioned her anxiety as a factor affecting her performance. >> Coming this way. >> You went forward over here. >> Oh. >> I said forward forward. Forward. Like my >> down this I mean up this. No. To the left. Right there. To your left again. We open the door. To your left. To your left. Over here. Over here. >> Okay. So, um, my partner is is taking care of, you know, this whole situation right now with the DWI. Um, but I'm investigating the crash portion of it. Um, so, um, because you're already under arrest, I have to read you something. You have the right to remain silent. Anything you say can or will be used against you in court. You have the right to have an attorney present before or during questioning at any time. Um, if you cannot afford one, one can be provided to you at no cost to you. And while I'm talking with you at any time, if you want to stop answering questions, you can do so. Okay. Do you understand your rights? Are you still okay with talking with me? >> Yeah. >> So, um, when it came to, uh, I guess the crash, how did everything happened? So, I had one drink after I left work and I was on my way to pick up my daughter. And as soon as I got to my daughter, I picked her up, buckled her, the usual, buckled myself, and we're on our way. >> Okay. >> As soon as we hit the rules for passing that light and as soon as we passed the light, it turned green. >> As soon as it turned green, this car ran it. And as [clears throat] soon as we kept going, like I pulled over and luckily those two witnesses like luckily they stayed. >> Thank God for them. that white Dodge Challenger and the other car. I'm honest. I can't take a sobriety test because I have anxiety. I have all this I can't I can't even be in this. It's paranoid me right now. >> Like it gives me so much anxiety that I want to eat at it. >> Okay. I mean, unfortunately, we can't do a lot about it. >> No, I know. I pick out my nose for it. Like, it makes me want to cry. >> But as long as my daughter was safe, I don't care that I'm here. >> By the time I got there, did she already get picked up by someone else? Who picked her up? >> Uh, her grandmother. grandmother. Okay. What's grandmother's name? >> Anna. >> And Anna's last name? >> Uh, her last name goes by Sapium Pettis. >> Sium. And do you know her date of birth by chance? >> I don't. No, no worries. No, that that'll work. That way I can just not on my side as well. >> And I don't know if she called my baby daddy or whatever and they picked he picked her up or whatever, but the crash and I was like, I can't right now. Like I'm going through so much like like as right now my head still from the crash and all this. Like, >> okay, >> I just can't do the spray because I'm only going to do a breath one like at home. I don't care. >> Like, I made it. I had one, >> but I just can't deal with all that lights and this it gives me too much anxiety. >> Okay. And just to verify, you were going you didn't stop at at the red light because it had turned green and kept going. >> So, it had turned red. >> Okay. >> And I had stopped. Okay. >> And then once it went green, I >> That's when you went forward. Got it. >> All right. Sounds good. Um uh so based off all the information we're getting right now, I still have to go and speak with the other individual in the vehicle. Um after which time the officer that placed you under arrest, he'll do the charges for the crash and the DWI portion of it. Okay. >> What about water? I've been asking this since I got >> Let me Let me see if I can find you a cup real quick. Thank you. >> No problem. >> The mother may face charges including DUI, DUI with a minor in the vehicle, and child. Under New Mexico law, she could face up to four years in prison and fines of [music] up to $6,000. When you take the wheel, especially with a child on board, [music] there's no relative safety. Risk comes not only from the incident itself, but also from how the law ensures protection for everyone involved. What happened that night was not a random event, but the breaking point of a relationship long strained by ongoing instability. >> Who said something about a gun? Any other gun? >> Um, no. Our first incident, he pulled a gun on you. On January 28th, 2022, police received a report about a man whose behavior toward his girlfriend had crossed boundaries. Two children witnessing the tense situation ran outside to seek help. Concerned for their mother's safety, officers responded quickly, approaching carefully due to potential risks inside the home. GET OFF RIGHT NOW. GET OFF HER. GET OFF HER RIGHT NOW. GET ON THE GODDAMN GROUND. GET ON THE GROUND NOW. GET ON THE GROUND. Get on the ground now. Get on the ground now. GROUND. >> GET ON THE GROUND. >> GET ON THE GROUND. GET ON THE GROUND NOW. HANDS BEHIND YOUR BACK NOW. >> All right, stand up. >> Get up. >> I can't stand up. I can't stand up. >> Act like an adult. Hey, I can't say hello. What you doing? >> Let me put some gloves on. >> Damn. >> Plenty of time here. >> There's a knife in the ground. >> You all right? >> Over here somewhere. >> You all right, kid? >> I'm good. [snorts] >> Young lady, >> no. >> Aside from you, apparently. >> He chased my kids off the window telling them they were they were dying, too. >> Hey, there's two kids out here. Grab up the kids. Come up here. What actually you just chas Superintendent. Are you all right? You did all that for nothing. >> You're the one who >> You did all this for nothing. >> You're the one who didn't get on the ground. >> For nothing, bro. >> You're the one who had it. >> You did all that. >> You did all that for nothing. You did all that for nothing. I ain't got nothing on I ain't got nothing for I'm lucky. I ain't getting nothing for nothing, bro. You see what I'm saying? I ain't get nothing for nothing. I ain't get nothing for nothing, bro. for nothing, bro. >> All right, let me get in. Can I get in? >> Get in. Get in. >> The mother later described a long period of living under intense psychological pressure, including serious in a relationship she felt should have ended much earlier. Is that knife on the ground? Have we collected that yet? >> Oh, incredibly. Almost got himself shot. >> We're not allowed to do that. >> No, we're not. All right. Well, if two kids meet me at the corner, they're like, "Get in there. He's going to stab her. He's gonna kill her. He's gonna kill her." Door's wide open. He's over top or has a knife like this. >> Are you serious? >> Yeah. And as soon as I came in, he like stood up a little bit, dropped the knife, but then like refused to get on the ground. So I'll tell you, I can't find my other cartridge. So you're digging around for my bag. Did you guys witness this? >> No, I just heard screams. >> Are you related though? >> No. So, the kids just ran over to you and you guys were >> Yeah, I got two of her kids smaller. >> I have to talk to her. What's her name? >> Ashley. >> Ashley. >> I don't know. Come in here. No, he came. He when he left, he looked mad. Like he was just mad. When he came back, I was I heard the door shut, but I was asleep. >> Man, I don't know what the hell happened. And he just ran in. >> Miss Bryant, would you mind if we uh put all your kids with the neighbors for the moment while we talk with you? >> Okay. So that way we can, you know, get get them away from all this. I don't want to say >> no one witnessed the physical fight with you. >> Nobody until here. >> Yep. >> Yeah. >> Are your kids in? >> Well, I don't mind. Is it only? >> Who is he to you? >> Who is that gentleman? >> You guys live together or anything? >> Can you look your hair up a little bit? I just want to make sure. >> Have you guys lived together before in the past? and stuff like that. >> Are you currently pregnant at the moment? >> No. >> Do you guys have any kids together? >> No. >> I'm trying to make sure. >> That's just going to be assault. >> That's definitely going to take a day. >> How did he get in the house? >> Cuz we I mean my kids we've we've known him for two years. My kids will let him in thinking he's getting off of work or all types of things. Like tonight I we were all sleep. We had no idea he came here. We had I don't even I can't even tell you what the hell the argument even start over. He said something and I'm like how would you like it if I called you a stupid something? He like called me stupid and I'm like okay well man just go on cuz ain't nobody about to argue with you or have to call you and I was just saying how would you like that's when he started. So, I grabbed that's something my dad gave me. So, I grabbed that. Listen, if you hit me one more time, I'm going to cut you. And I kept poking him in his chest trying to get him off of me and he snatched it from me and started it on me. But I was lucky to block a couple. But then once the knife fell out of his hand, he I guess he decided to swing on me. No. >> Someone said something about the other. >> Um, no. Our first incident, he pulled a gun on me and I should have let it go then. And I open. >> Not only the mother, but the children as well were placed in risky situations. At one point having to exit through a window to get help. I'm >> all shot. You're goddamn hero. Did you realize that? >> He was over top of her with a knife. >> If he hadn't gotten out by this close, >> ma'am, did we get what school you go to? >> Middle. Did she ask that? No. >> Okay. We just got a whole bunch of paperwork to do. I appreciate it. Thank you. Are are you I saw some on your arm. >> It's just I got chopped in my head. >> How did that happen? Is that from running? >> Yes. He was chasing me. >> Do you mind if I get pictures of that real quick? Just cuz. >> Yes. Uncle is on his way. He said he not that far away [snorts] >> at Quisha's house because I had >> He ripped that arm. There we go. Thank you. So, you're just running out the house trying to get away from him. You tripped and you fell. >> I jumped out that window. I was the last one to jump and my little brother kept trying to stay with my mom and I kept trying to tell him to come on. So I jumped last after my siblings jumped and he jumped after me and kept chasing me. >> Did he say anything to you? >> Yes. He kept saying hang up now. You don't hang up. And just kept on chasing me and that's how I failed. >> And you were on the phone with 911 when all this was happening? >> No. After that he kept asking me questions. I was just like he's saying this, he's saying that, he's saying that. And then the phone hung up with the police. So, I've been on the phone with my auntie this whole time. >> Okay. All right. So, he was saying, "Hang up with hang up with the police or I'll kill you." >> Yes. >> Okay. >> Cuz I had when I fell the second time, it was right in the middle of that street. And my phone fell and it hung up with the police and I called back. He kept saying, "Call fail." I called my aunt. It said call fell. I called my auntie. She can hear him in the back saying, "If you don't hang up, I hang up." He was telling him, "If she don't hang up, I'll >> Would you mind filling out a statement for me? written statement. It doesn't have to be perfect. It's just short, sweet, to the point kind of what happened. I appreciate it. Thank you. I'm I'm so sorry you had to go through this. I'm glad you're okay. >> Thank >> No, it's cold out here. If if you want to sit inside or you can sit in my car. It doesn't matter where you sit at. I just need you to start here at the X and whenever you're done, if you can just sign it for me and then if you could print your name, okay, and just uh kind of tell me what happened. All right. More detail the better. I appreciate it. Footage from a doorbell camera recorded the entire incident, both video and audio, allowing police to document the situation and take the appropriate legal steps. >> Hi. >> Hi. I'm so sorry to wake you up. Um, >> fine. I just don't want the dog to get out. She's just crazy. >> I saw you had a Ring doorbell and it faces that way. We had a couple of kids jump out a window here during an attack and I was wondering if your camera caught that. >> Um, give me just [clears throat] a second. >> Okay. It should have happened maybe by this point, 20 25 minutes ago. >> Thank you. >> Thank you. You're I'm not sure if it would have caught it cuz of this post, but it should have caught him running away. So you said about >> I love these cameras. They are lifesavers. >> So maybe around 3:30. >> Yeah, that that sounds about right. If anything, it would have caught me running up to the door. >> I know that we caught one cuz my the kids screaming woke my husband up cuz we didn't know what it was. And I caught we caught him on the front door because we got one on the front of the house, too. >> Yeah. Okay. Rewind that a little bit. >> Are you able to preserve these videos? >> Yes. Um if you have a cell phone, I can send it to you. >> Yeah, that'd be great. Or you can text it or email. >> Um >> I can give you my email. Um okay, so share um just whatever you got. Um, even if it's the front door camera, any footage you have, call us forward. It's all of our detectives. >> Okay. And I'm just going to video from Grove. [snorts] >> Yeah. You just >> All right. I sent that one. And if you want, I'll look at the other ones and if I see anything with the kids out here, whatever, I'll >> That' be great. Thank you so much. I appreciate it. Even if it's just audio, I'll take whatever you got. >> Okay. >> Thank you. [snorts] >> This Do you remember do you remember exactly what you said when you said >> when he fell >> when he fell I just stay asleep cuz I'm like >> you did this one >> you did you mind if I get your just saying that you completed this like man why don't you sit down you being weird I'm like you already fail and I guess what The man was taken to the Montgomery County Jail on charges of felony aggravated assault and felony. Under Ohio law, he could face 3 to 12 years in prison and fines of up to $25,000. This story reminds us that women and children need access to knowledge and support, a clear understanding of their rights, and a community willing to speak up and help when it matters most. When teenage curiosity clashes with an adult's strong emotions, the conflict is no longer just a private family matter. >> I'm not going to keep letting you be disrespectful to me. I am your mother. You're not going to disrespect me talking to me like I'm some little nappyhead kid on the street because I'm not that. >> On August 11th, 2025, police responded to a call from a 16-year-old girl reporting concerning behavior by her mother. The situation began when the mother discovered her daughter had hidden inappropriate content on her phone and escalated as emotions ran high. >> My eyes hurt really bad. >> Okay. Well, feel free if you need to cuz I know it's a lot. Have a seat. Okay. Let me take a look at you. All right. You said your eyes hurting for me all over my face and dragged me by my hair. >> Let me take a look. But your eye though, why? Which eye? >> It was this one. This one might already I had got into a fight at school. So, this one might already be messed up. >> Maybe not really. Okay. >> But I know she hit me all like she I have >> We're going to get in all the details. It's not a video, but I have the recording of it. >> Hold on. I want to go step by step, dear, cuz I want to get this right for you. Okay. And I know it's so upsetting, so it's real easy to just get going so fast, and I don't want to miss anything. Okay. Anywhere else that you got, you might have visible. >> Um, I'm trying to like really think about like everything happened so fast. Like, I was I was standing in the corner. Oh, there it is. Right. I was standing in the corner and she basically cornered me and she first thing she did when I had my desk. I I have a desk in my room. >> Hold on. I want to know where you were hit. that might have visible injury right now. >> She dragged me across the floor. So really just my face. >> Were you in >> I was She was outside the door. >> You were the one locked out. >> I was the one. >> Where did she grab you in your hair? >> I literally my hair was I had to have my hair back in the point cuz like my hair like it literally like she really grabbed. >> I'm just trying to see if anybody was if any was like yanked out or if there's any visible patches. >> I hope not. Like I don't want no size. My hair have school next week. >> Hold on one second here. Okay. Okay. Where's mom right now? >> Which apartment are you guys? more like two or three >> on the bottom though. All right, let me get some information from you and then we're going to go talk to mom. Okay. You did you guys say she's drinking right now? Is that >> She was drinking while we was talking and she was having after she had her heart attack. >> Okay. I need to know what happened when you got here that was physical. >> So when I got there talk right and then she started yelling at me and my she was drinking as she was talking to me. So she started yelling at me. I didn't want I was yelling at her. So I walked upstairs so I could pack my clothes and leave. That's all I wanted. She come running behind me. She's like, "No, you're not getting none of your clothes. You're not getting your clothes." I'm like, I'm going to start school. So, she started grabbing me by my hood. I'm like, can you like go on me? Like, can you please like go on me? So, she finally like go on me. I was get the rest of my stuff and put in my book bag. She literally like she threw everything off my desk and broke everything. My TV broke and everything. The way my desk like you see my way my desk set up. I was kind of in the corner and she was in front of me. She So, we were I'm like, "You just broke all my stuff. You broke all my" And she was like, "Son, you're not going to distract me. I disrespect you." She goes, "Keep distracting me. I want to the hell out of you." I haven't like recorded >> and you were recording for all that. Not like not like on the phone but like the voice, you know, voice messes. I was pouring like the rest like conversation. So I was like, "Yeah, I'm gonna take you to jail because like don't me." So as soon as I said that, she me in my face and so much like in my face like literally on my face like >> I know. But where on your face? Because the face like there's like Did she Is that when she hit you on this side? >> In my eye. Yes. >> That eye. The the right eye. Yeah. So she hit me. So >> closed fist. Open hand. >> It was a closed fist. Like she literally like you could hear the So she punched me and I was trying to get her off of me. So, like I tried to hit back and then that's when she pulled me to the ground. >> Okay. >> And and she got on top of me and she was just hitting me in my face and then she pulled me by my hair. >> Where was she hitting you? >> She's in my head at first and then she pulled my hair up and then she hit me in my face like that like my head. >> I don't see any markings on your face at all, but where she pulled your hair out. Do you have like You said she did hit you back here. Do you have any kind of goose eggs or anything back there that you felt come up yet or anything? >> My head just really bad back there. Like she like she's a head. >> But you don't want an ambulance to come and check you out though. I honestly don't know like my like I said my head really do she she's a heavy hit and everything. >> Okay. Um All right. So just cuz your sister and maybe you know you guys can chat. We got to go talk to mom at some point here too. Kind of got to see where we're at. You know obviously just since there was a couple people and maybe mom's been drinking. I just wanted somebody with me just in case to make things easier. But she's saying that she got hit in the back of the head several times and in her face several times. I know I don't see any markings or anything. Sometimes it can take a second but I mean she's not wanting an ambulance to come check her out either. If you're saying that your head is still actively hurting right now, >> I would feel better if they looked at your eyes. Make sure people's your same size, things like that. Because then, you know, if they say it's nothing, better safe than sorry to me, it's not like it's wasting their time. This is what they're supposed to do. Okay. So, you're okay if I How old are you? >> 16. >> 16. Mom, have any kind of weapons in the house or anything like that? >> I mean, she has a BB gun like she has a rifle, but it it's not loaded. Like, it does. I don't know who I forgot who to her, but it doesn't work enough like that. >> Okay. Um, >> what's mom's name? >> Latoya. Even without the mother's explanation, the conflict seems to stem from the daughter's defiance [music] and disrespectful attitude. At this sensitive age, children can easily develop misguided thoughts and behaviors if not guided properly. >> You're not getting in there to knock on the door. >> Hi there, Miss Hayes. Sorry about the double knock there. Wasn't sure if you were able to hear. >> I said sorry about the double knock. Wasn't sure if you were able to hear. Are you okay today? >> I'll be okay. >> It sounds like stuff was going on. I'm sorry you guys are dealing with this. What can you uh can you step out here and talk to me real quick? Just kind of tell me what you know. >> Would you like to step in? >> Whatever you're most comfortable with. Yeah. Whatever you're most comfortable with is fine by me. It's no problem. >> I don't like dragging dirt into people's apartments, but it's fine. >> So, what Oh, you're fine. What can you tell me about what's going on today? [clears throat] My daughter >> is entitled. She's a brat. She got caught up doing some things she wasn't supposed to be doing in her phone um as far as racy pictures and things like that. This was about two weeks ago. This is when it all basically started. So that night I was going through her phone as any parent has to do because she's only 16 years old. >> So I'm going through her phone and she has a lock on a group of with a face ID. I told her to unlock it. She didn't want to. She tries to raise up at me. Started getting disrespectful. I just had a heart attack. >> I had she had mentioned >> I just had something I don't want to be in all of this. So I sold her her sister literally lives right there up the hill. Not even >> in that other like the highrise up there. >> Yeah. The same apartment complex. She literally lives right up the hill 30 seconds away. Just walking up the hill. She's in that first building right up the hill. I told her to leave and go there because I wasn't going to put up with the disrespect and I wasn't going to stress myself out. This has been 2 weeks ago. Like I said, since then we've barely talked, you know, trying to time Exactly. Trying to give her time to cool off. Trying to give myself time to cool off. You know what I'm saying? They text me earlier today. They've been texting me out, you know, just random days throughout the week or whatever. She asked for her things. I gave her her things. I gave her her things a week ago. She's concerned that because school is starting, she wants more things. I've already tried to explain to her, you are still a minor. You still live here. You may be over there cooling off, but you still live here. I'm not giving you anything else. You have enough to get you through. They text me today. Oh, with the intention of her coming back here now that things have cooled off and being where she's supposed to be. >> Exactly. I understand my intention. Yep. I'm checking. Well, today they both texted me, you know, and I told her, "I'm not going to keep texting you and going back and forth, and I'm not going to keep letting you be disrespectful to me. I am your mother. You're not going to disrespect me talking to me like I'm some little nappy head kid on the street because I'm not that." So, I went on my break, I worked from home. On my break, I went to the gas station to get what I needed to get. I came back home, that's me sitting outside on the stairs. When I got out the car, I already knew it was going to be something. I felt when I got because it was something when we was texting. I said, you know, just leave me alone. I stopped texting. I stopped responding cuz I didn't want to keep taking it there with them. You know what I'm saying? So, when I got out the car, she's sitting there. I'm like, what are you doing here, Destiny? >> She was like, I just I'm just hi. What you doing? I walked to my door. I unlocked it. >> She saying she was hi? >> No, she was saying hi. Hi. >> She said hi. She might be I don't know her sister smoke. She might be seem that way but she's 16. You know what I'm saying? Kids do things and I'm not trying to push or anything like that. So when I walk to my door, I open this. I have to unlock this. My screen door is already unlocked. I literally stood right here. I said, "What do you want?" Because I'm not in the mood. I don't have time for that. You know, I got to go back for work. I just came to talk and all this. I said, "I'm not in the mood." D like, "What do you want? If you want to talk, fine. Come in." I told her to go downstairs. That's my office/bedroom down there. Okay. So, I told her to go down there. I told her to sit down. I knew something was up because she didn't want to sit down. Sit down and talk to me if you want to talk. She didn't want to sit down. She decided to run up the stairs and thought she was going to go in her room and get some stuff. I said, "No, that's not what you're doing. You're not taking nothing else out of here because you still live here. You want to be over there to cool off until school start?" Like I said, it's literally right up the hill. That's my other daughter. I don't have a problem with that. On top of the fact I already gave you clothes. I already gave you your stuff. When I'm back there, she grabs her book bag and starts thinking she's going to just throw stuff in there and run up. You're not going to do that because you're not going to disrespect. So she start I'm going to get my and I'm going to do all of this getting real disrespectful. I put my hands on her. I did. She needed it. I mean there's a level though that's not illegal here. I mean like so corporal punishment not illegal, right? But like you know that's kind of what I wanted to get to the bottom of is like what kind of level are we talking? Like what happened when that started? >> Well, I put my hands on her. >> Yeah. Like describe to me. I guess >> I don't want to touch you. >> I grabbed her like this first. You know what I'm saying? She swung at me. And from there, >> did she make contact? >> Yeah, she did. >> Open, close, like hand. >> I don't know. I just know she touched me. She hit me. And from there, I'm her mom. You're not going to disrespect me. We got to I mean, >> where did she hit you at? >> Here [snorts] in my face. I'm okay. It doesn't hurt anything like that, you know. But like I said, it just it just went there. >> Okay. What happened after she and then you know you kind of had her here she and then what happened like what did you do? >> I can't really remember. I mean I know I swung her to the floor and I tried to pull her up. >> You put her down and you tried to get her out of here. Where did you grab her? Like what? >> Before all of that even started again. I'm not trying to do anything. I told her to I said Destiny stop. Just leave now. And I tried to pull her yes by not I mean I touched her her clothes. I said you need to just leave now. I'm going to get my being there disrespectful. You're not insult to me like that. >> So when you ended up actually having to kind of remove her, you're saying we're like, what did you grab a hold of at that point? >> I I couldn't even tell you, ma'am. I don't >> Did you grab her hair at any point? >> I probably did. >> The mother's account reflects a common struggle faced by many parents. Discipline itself is not wrong, but once boundaries are crossed, it can no longer be seen as simple guidance. >> Any other like any other that you recall like actually striking her like I don't know where I hear it. I just want to get >> I mean, listen, you know, corporal punishment is not illegal, okay? I just need to That's why I need to come here and just talk about it and figure out like where do we kind of end up on this spectrum. Um, so I appreciate you kind of describing everything for me. No other at no other time did she put her hands on you or make contact with trying to kick me and things like that. Yeah. Sister, sister was out here. My door was locked, so she was out here banging on the door. And I kept telling her, even when she was on the phone with 911, I kept telling her just leave. I told her to leave before anything even started so that would not have gone there. I told her to leave because I felt it. I felt I knew it was off because they both been on, excuse my language, but some [ __ ] for like she's 16. You got caught doing some things that you weren't supposed to be doing. You got something in your phone that you want. I don't know if it's only fans or new pics or anything like that. No, I'm not. No, >> I'm not intoxicated. There is nothing wrong with me. I'm just a mom, a single mom at that. I've been a single mom their whole freaking life. I gave, like I keep saying, they're entitled. Like, I gave them every freaking thing. My oldest daughter has a daughter. Do you know who got her stuff for her? Me. I did everything for that baby. I did. I did. >> You know what I'm saying? She didn't I let her come here with that baby. I helped her get that place. I helped her put the furniture in there. I helped her get a car. I helped them do everything. That's the point. Like they I I do everything for them. And so now all of a sudden when you get caught lying, you won't know how to handle your emotions or your feelings and you think you going to caught. No, you're not going to disrespect me in my own house. I paid the bills here. She doesn't do anything. >> Take two deep breaths if you can. And I know I can't. >> They're freaking brats. >> I can't imagine how frustrating it is for you, but I can tell you I grew up with a single mom for much of my life. And you know what? I didn't know it then, but I I know now how hard it was. And it is. >> And your job is not an easy one. Although the girls sought legal intervention, officers initially found no clear evidence, acting as mediators to calm the situation. >> I'm I'm documenting what both of you guys tell me. As of right now, if I walked up and and I'll kind of tell you how this this works just so that you understand cuz I think the documentation piece is very vital as well. And the fact that you were cooperative and letting us have medical check you out, those things are important. Okay? If anything like this were to ever happen again, you did the right thing. Okay? Right now I don't have visible but I do have statements from both sides. So it doesn't >> and the sound >> and sound. I'm going to see what he says but you know obviously he's listening to that. So as of right now with what I know not anything tangible to a point where I can pull a thread, you know, in terms of charges or anything like that for you. When I listen to audio I'm going to have to listen for and audio does make it tough, but I understand like sometimes that's all you got time for. I mean it is what it is. Stuff happens fast. Sometimes it may not rise to a level of where I can determine without being able to see it, watch it, see it, it may not rise to a level of beyond corporal punishment where it's like actually criminal. Corporal punishment is legal. And so it when it comes to, you know, speaking with juvenile, speaking with parent for domestic violence, sometimes that does come into play. Okay. >> Um I will say the way that the law is written and kind of what we're left with, and I know that this is going to be frustrating to you. I have empathy with that. But juvenile has no expectation of privacy or no rights to privacy. So when it comes to things like a phone, a parent has every right to be in that. Not sure. Right. Obviously when we got here it was okay. And I'm glad that you're okay and that she's okay honestly. But but I want to make sure that I equip you with kind of the understanding of why the situation unfolds that way. Okay. I don't want to just leave you in the dark thinking nothing happened. Nobody wants to help you. We do. And part of that help is documentation. And that's important too. So I'm going to get your statements documented as well as hers. I did not have any indicators of intoxication while I was speaking with her. Those things usually we can pick up on. Speech was not slurred. Amb, you know, she was perfectly ambulatory. I I didn't see any drinks laying out anywhere that I could visualize. So, in terms of what I can, I don't know, you know, in terms of what I can prove, I don't have but I can still, you know, I can still document that you're saying that as this was happening, she was drinking. I just am telling you that I don't have any indicators that would allow me to leverage anything for you. Okay. She's 100% okay with you still going back up to your sisters in terms of the clothes and things like that. Her expectation and and I'm just the messenger here. This is this is because you are 16 and this is something she has a right to say at this point in time. Her expectation is that by the time school happens that you're back home, she does want things to calm down. She does want you guys to be able to talk. She understands that whether by her fault or not, things are not in that place today. >> I'm not going. She just I'm not going back in here. >> Okay. >> However, the situation did not end there. The next day, police received the girl's follow-up report and contacted the mother. The findings indicated more serious concerns requiring officers to take legal action. >> She is. >> Hi, Miss Hayes. Um, your reference just called from yesterday. Can you step on out and talk to us real quick? >> I'm working. >> Okay. But I need you to step on out and talk to us real quick. So, I want to talk to you about Destiny today. >> You can step in. >> Okay, that's fine. Can you step on out here real quick? >> Are you going to arrest me? Well, yeah, unfortunately at this point, but I wanted to explain everything to you first. Okay. At this time, >> go ahead and place your hands behind your back for me. You can set the phone down, but we'll let you do that. All right. Okay. >> Wait, I'm still working. Can I at least log out of my computer? >> We'll get all that taken care of for you. Okay. We'll help you figure it out. >> I'm being arrested. How can I do it? >> Cuz we'll go turn your computer off for you. Basically, Destiny went to, pardon the cuff there. Destiny went to her normally scheduled doctor appointment today, and they diagnosed her with a moderate concussion, which is an escalation from yesterday. Unfortunately, it it kind of just is what it is at this point. It it corroborates what she was stating. I'm going to have a bond. >> I don't know about the bond piece, but we'll talk about all that. They'll probably do arraignment court in the morning, okay? We'll help you out with out or anything, but come on out here first time period. Come on. >> Okay. doesn't really unfortunately change what we have to do here today. >> All right, come on up here and have a seat. All right, we'll secure the house for you. If you would like him to go down and power that off so that it logs you out, we can we can absolutely do that. >> Okay, so I know when we spoke yesterday, I know this sucks for everybody involved, but I know when we spoke yesterday, you had talked about, you know, kind of not really remembering what was going on. You know, just trying to get her off you, trying to get her out of the house, trying to get her out of the room. You said you knew you her. You said you knew it might have been in the head area. You really weren't sure how many times or where. I I remember those statements and that's okay. >> Yeah. She also fell to the floor. So, I'm pretty sure that's how she got a concussion. She's still my child. >> Sure. But and and like I told you yesterday, same still stands. You know, corporal punishment is not illegal. But then when we escalate to the point where somebody has a concussion like that, that kind of ties my hands where I have to take action on that. It's not a situation where I have a lot of choice. So, I'm sorry to put you in this situation. I'm sorry you guys are dealing with this, but this is kind of what I I have to do at this point. She is at Children's at the moment. I did have to contact CSB. They are doing a what's called a juvenile rule six where they're going to take temporary custody of her for the evening since she will not be here. Um, if they're able to release her to her sister, they will. Um, I don't I can't guarantee that that's what will happen. >> No, she needs to stay. >> That's what I was already in the process of doing because all of this is her fault for not I'm not mad at you. >> You were completely cooperative with me yesterday. I know this sucks and yet somehow you're still being cooperative with me today. Okay. I'm not going to make a bad situation any worse than it already is for you. Okay. Um I'm sorry that you find yourself in the spot. Is there anything that you need me to know in addition to whatever happened yesterday? Otherwise, I'm just using the statements you gave me then. >> No, because that was everything. >> I trust that. >> She did get a concussion cuz she >> not because I Okay. I'm not, you know, I'm not asking any investigative questions or anything at this time. Okay. I just I do have to send you this evening. They did get your keys in your wallet, so we should be okay. They should have arignment court for you first thing in the morning. They should be able to take care obviously of the other needs there for, you know, female necessities. Okay. And we'll we'll get you through this as quickly as we can. All right. >> Shut this for you, G. >> I'm assuming you would like the windows up with the whole neighborhood. >> I can crank the AC, try to get you to >> The mother was charged with domestic violence. Under Ohio law, she could face 1 to 3 years [music] in prison and fines ranging from $2,000 to $10,000. Good intentions to correct a child's behavior do not remove the consequences. Once certain boundaries are crossed, discipline can quickly become a serious legal matter. A closed apartment, non-stop crying, and a mother at [music] a friend's house. That was how the story began. >> Oh, I was at a friend's house. He was asleep. >> Okay. How long were you at a friend's house? >> Just for a couple hours. >> A couple hours. On July 24th, 2024, police received a call about a 1 to2year-old child left alone in an apartment for nearly an hour. Nearby residents hearing the continuous crying contacted authorities to check on the situation. Upon arrival, officers could hear loud noises from inside even before reaching the door. >> Hello. >> Hi. >> How are you doing? >> Good. >> Is this your apartment? >> No. >> Do you hear him? >> Oh, yeah. I can see him as well. >> That's my friend. >> Oh, I thought you were asking me. See, where is she? >> Do you know she left? >> Do you know what car she drives? >> She don't drive. >> Okay. >> She's been crying for like an hour. >> Do you know what her name is? >> Tiara. >> Tiara. >> I just talked to her. >> Hi. Can you open the door? >> No, he's like one. I think he's over one. Can you open the door for me? >> I don't think he can reach the lock. Oh, it's a small lock. He might Do you want us to We know him. Do you want us to try a game? >> Sure. All her kids play together. >> Come on, baby. Open the door. >> Open it. Can you get it open? >> When was the last time y'all saw Tiara? >> I saw her. I came home around like 10:30. >> Mhm. >> She was here. >> Open. >> But she was acting super weird. >> Okay. 10:30 in the morning. >> No, tonight. I got like 10:30. >> Is this out of the norm for her? >> I think she has a like mental disability. >> She was acting super weird. What do you mean? >> Like super hyper. >> Can police, you don't have Tiara's phone number? Yeah, we did. Would you like call to her? >> I'm going to call her sister. >> I'll go get her sister's My sister's best friend. >> Okay. >> She has to be asleep cuz her phone's on. Do not disturb. >> Okay. >> And you have her sister's phone number. >> I'm trying to call her sister. Yeah. >> Do you guys have contact for a uh landlord or like maintenance? >> Um maintenance I think is there's one guy that has keys. >> Okay. What's his homework? >> I don't think it's D. They have packages delivered to D101 in the corner. I think she might be able to help. I don't know. checked out. >> He's still crying. >> No, I think he's in the room. >> Where's his room at? >> Kenowick Police welfare check. >> That's what she just called. She's >> Hello, it's the Kwick Police. It's a welfare check. Can you come to the door? Hey, Carter. How are you? >> Yeah, I like your doggy. Where's mom at? >> Yeah. I'll be right with you. Okay, kiddo. I have a friend of mine. >> Hi. Hi, buddy. Come here. Where's mama? She went bye-bye. Where's mama? >> Are you the one who called? >> Yeah. >> Okay. And you've attempted calling her yourself. And your sister? >> My sister and her sister are best friends. >> Okay. No answer from anybody. >> My sister answered, but she's trying to contact her sister. >> So the mom to him is >> my sister's best friend. So her mom's name is Tiara. >> Um, his diaper. Okay. >> No, it's Do you babysit him sometimes? >> No. >> No. >> No. All of our kids just play together. I have a seven-year-old and a four-year-old. >> What led you to call today? >> He was screaming for like over an hour. She's not there. He's by himself. I think she wants to talk to you. >> Hello, this is Officer Contra with Kenwick Ped. How can I help you? >> Hi, this is Donna from the Grantwood Apartments. >> Hey, Donna. Don't you worry I didn't cause any damage to your doors or anything like that. It was just unlocked. All righty. >> Okay, perfect. >> All right. Thank you, ma'am. Thank you, ma'am. I appreciate all your help. Sara is your sister. Sierra, >> her twin. So, Tiara lives here. Her sister Sierra. >> Do you know where she lives? Can you call your sister and maybe find out? >> Yeah. >> Please leave your message. >> I feel bad. I'm like, I know she works early. I work early. Let me see if I can find her husband. Have you seen Tiara or heard her? >> I seen her like around 3:00. I went for a run earlier after work and it was like 3:30 and then I seen her. She didn't have him yet. He goes to the same day as my kids. >> Okay. Did you hear Tiara anytime in the apartment? Were you able to hear her voice, TV, anything like that? >> No. >> No. >> That's the mom. >> She's coming yesterday. >> You coming down? >> The estimated time the child was left unattended, nearly 2 hours. The mother returned only after a neighbor reported [music] hearing the child. Meaning without the crying, the situation could have lasted even longer. >> Hello. >> Hey. >> Your name? >> Sure. >> Tiara, can I talk to you right out here? >> Sure. >> What's going on today? >> Oh, I was at a friend's house. He was asleep. >> Okay. How long were you at a friend's house? >> Um, just for a couple hours. >> A couple hours. What friend's house were you at? >> Up there. >> Up where? >> That building over there. >> What time did you leave at? >> 10:00. at 10:00. Do you know what time it is right now? If you had to guess without looking >> Well, actually it was 11. Sorry. It was 11 actually that I left. >> Without looking at a clock right now, could you guess what time it is? >> 12. >> Around 12. What? How did you come back here? >> My neighbor came from there to the door and said that my son was crying. >> Okay. And you said you left your boy here asleep? Yeah. >> Is that normal for you to once he falls asleep to go visit a friend for a little bit? >> No, I won't sleep. >> No, today was just an outlier day. >> I just thought he would be okay. >> Okay, I get you. Did you have a way to check on him? Like maybe like a a camera. No way to check on him or know if you need anything. No. What's on your mind right now? >> I'm scared. >> You're scared? What are you scared of? >> Loy. >> Okay. Why would you think that? >> I feel like a buffalo. >> Okay. Well, I'm not going to disagree with you. Give me one second. I'll be right back with you. Okay. >> I'm so sorry. I wish someone would have called me. I was so unaware of the situation. >> So, what do you what it's okay? Everything's okay right now. But what do you know of the situation? I don't know. Maybe assume maybe he was asleep and she went over just to hang out for maybe 20 minutes and then extended the time. I don't know. >> Okay. >> I really don't I know she doesn't leave him like that a lot. >> Okay. But she does. >> I don't know that. I'm sorry. That could be the is the you know scenario, but I don't I'm not aware of that. But I what I can tell you is that I can I can try to be there in the next 20 minutes to get him. I don't take him. It's >> okay. >> I don't know the extent of the issue. I don't want him to go to CPS. I would prefer him to come with me if that's an option. >> I don't mean no disrespect, but how long has your sister been battling what she's battling right now? >> I don't know. What is she not fully mentally there? >> Okay. What do you mean by that? >> She is mentally if that makes sense. >> Okay. So she does things that [laughter] she makes it make sense to her that's not completely okay at all completely at all. >> In reference to the child, what have you seen her do that you don't find to be normal or find to be out of the ordinary? >> Nothing really. The only thing that really concerns me is sometimes, you know, when she gets over stressed, you know, she just be like overly loud with him. Like she'll yell at him. >> Okay. Not like just because she has a hard time like getting rid of her frustration. Like she's never hit him or she doesn't hurt him. She's a really good mother. I just understand. >> Can you help me by calling CPS and finding out if she has any history? >> Okay. Okay. >> And I've told her like, "Dude, if you need help, reach out to me. We have older sister. She knows that if she's struggling [laughter] for help. I don't understand why she would do this. And it's so upsetting. I already have I have my whole situation. You know, I have four kids. I have one who's has special needs. >> Mhm. [snorts] >> I don't know. I'm so sorry. I'm so sorry. I just I made a >> Do you know if your sister has ever struggled with um any or anything along those lines? >> No, I don't. >> All right. So, give me a couple here and then I'll give you a call back and give you an update as to what we're doing. Okay. Okay. >> I won't keep you out the loop, though. Please just >> I mean even if you guys are able to bring him to me then I can send I can give you the address. I'm just >> reports indicate the mother spent most of the evening outside with only limited time with her child. She believed the child's ability to eat and drink independently was enough to be left alone at home >> wanting to be there. I didn't realize I was there longer than I should have been. I should have been there just for like 20 minutes and then went back home. But I I did not. >> So you arrive here at 9:19. your friends Kelly and Brandy come over, >> right? You and they help asleep. You guys talk after fell asleep, I'm sure. And then you you decide that was asleep to go to their place. Do they have kiddos as well? >> No. Well, not living with them. No. >> Right. So then you decide to go over to their house across the way. Are you able to hear anything? No. How old? >> Two and a half. >> Two and a half. Being there is 2 and 1/2. Does he have like a phone here at home to where if he needed something he could call or call 911 or anything like that? No. Even if there is a phone in at here at home, is he able to use that phone to call for help, not to play a game? >> He might. I'm not sure. He probably would call my mom or my sister or something. >> You think he has the ability to actually call someone and he knows how to use the phone? >> Probably not. No. >> I mean, he done it on accident, but >> I mean, I was right there with him, so different >> accidentally. Yeah. But purposefully. Could he? >> Probably not. What about food? Is he able to feed himself if he if he's hungry? >> Yeah, he probably could. >> Probably could or can? >> Yes. >> Yeah. What do you think he would have been able to feed himself? >> Probably would have been able to eat some yogurt that's in the fridge. >> Can you show me >> the yogurt? >> Yogurt. That's the brand new yogurt that still has aluminum on it. >> That is a peach. Yeah. >> Do you think he would have been able to remove the lid and remove the plastic from it and know to grab a >> He knows how to get a spoon. Yeah. But then he probably would cuz he grabbed me that earlier. We were out there with the dogs. >> Did he open it though or did he just grab it and bring it to you like saying, "I'm hungry. Can you open this?" >> He told me he wanted it. >> There's a difference, right? Yeah. In a child. >> Are you You can disagree with me. I've been around children myself and I know that sometimes when a child wants something such as a drink of water, peanut butter, yogurt, whatever it may be, they bring it to you and then you assist them in opening it, right? And making it easier for him. Is that at the point that that he brings you a product and needs assistance in getting it? >> Yes. >> So, do you think that he could have grabbed it and helped himself to it or fed himself that product? >> Not exactly. I don't think >> does he have access to water? >> There's water right there. >> And can he bite it off? >> Yeah, he bites it off to drink some. I bet there's also some in >> What about if something happened inside the home? Well, we'll make it something minimal that it it would have been crummy, but really no to for the most part to him. What if the toilet started overflowing and he need and he wanted to leave? Could he have been able to leave the apartment? >> No, cuz you have struggle. >> Can you speak and ask for help? Like, let him know who you are. Let him know who he is. >> Can you say your name? >> Probably not, but he would know who I am. >> He can point you out. Yeah. All righty. Where is Sierra? >> I'm Sierra. >> Perfect. Hi, Sierra. I'm officer Contrarus with Katawake. We spoke on the phone. Yes, we can speak outside if that's okay. >> Do you need to speak to me outside? >> No, but we can talk inside. I just wanted to have the update outside just so I can talk to you about the situation. >> Okay. >> When the mother's sister arrived to care for the child, police confirmed the situation was stable, but legal responsibilities still apply. >> Just to see where we're at, you know, I >> what's happening right now is that she is going to be placed into custody for filler supervised child. But with that said is that traditionally with CPS's involvement, if she agrees to it, you can have temporary custody of the child or she can transfer it for now because you are biologically related and it's okay with her. If she says no and that's her decision, then we go the other route. So that's the conversation I was about to have with her. >> Okay, that's okay. Um I try and call my older sister cuz yes, I do want to take him tonight. No, I do want but she'll probably take over custody of you know >> for now you are. >> Yes, I'm fully I She has the car seat for him. >> Okay. Where's the car seat inside? Perfect. >> She has too. >> All right, that's perfect. >> I mean, I assume that she was going to get arrested, but um if we can when she does get arrested, if I could just take Carter so he doesn't see that. >> I was going to have her step outside then you can stay inside with him. Any other questions for me? >> Well, do you guys know how long he was left? >> How long he was left alone? At least an hour. That's at least how long he'd been crying. That doesn't determine how long he was alone cuz he may have been sleeping during that. Woke up at some point, found out he wasn't nobody was home with him. That's when he started crying. So, at a minimum of an hour. All right. Well, let me speak to >> Tiara. Tiara, can I speak to you here over here, please? I'll speak to you right outside. Okay. So, I'm be very frank with you, okay? You're going to be placed under arrest for fail to supervise of your child. Why? >> For failure to supervise your child. My question to you is is, are you okay with Sierra taking custody of your child? >> Yes. Do you have questions for me? >> No. Placing into custody. Let's walk over here. You're okay. You don't need to walk away from me. Have you take a seat in here? >> The mother was charged with failing to supervise. Under Washington law, she could face up to one year in prison and a $5,000 fine. A child's safety is not the responsibility of one person alone. It requires attention from family, the community, and society as a whole. Awareness, support, and timely intervention can help prevent unnecessary risks. >> Oh, and her knee as well. Here you got something on your knee. Oh no. >> On October 17th, 2024, police went to a home in Brelton, Georgia after reports of a mother acting vi and her kids. Inside, three children 8, six, and [music] 13 witnessed daily. One began to reveal the terrifying secrets they had suffered. >> That's right. >> Hello. Hello. What's going on today? >> Okay. Hey, what's going on today? >> Sorry, I'm a little shaken out. Okay, tell me what happened. >> This part is kind of usual. She was just like complaining how I'm like in responsible and I'm like not watching stuff like that. That's normal. >> Yeah. >> But then she kind of started face to like try to walk away. Then like she started face and that's when like she did this like that and that's how I got the cut. >> Is your dad at home? >> No, he's at work. He should be >> She called him and he said to her off. >> Has your mom been drunk again today? >> She has. >> It's really obvious. You can tell whether she's drunk or not. >> Sorry. He's friendly. >> I know. You smell my puppy dog. >> And so yeah, that's how I got the cut. Makes me >> Where's your cut at? >> It's below the lip. >> Oh, >> and it's her knee as well. >> You got something on your knee. >> Oh no. Where did that happen? >> I think she like pushed me down. I didn't mean to kick her, but like I kicked her. So she went again and then right when I was at the door cuz like you think Leo opened the door. My little brother um she like pulled my hair and that's when I kind of screamed. What do you think made her mad? >> I I I don't know. I mean, after she was like complaining how I was irresponsible, I told her, "How come you have like a bunch of trash around your room?" And that's when she like started to get in my face and stuff like that. >> Well, just hang tight here. We're going to go over there and talk to her. And y'all called her dad. >> He did. He's on his way. He actually is in law enforcement. Okay. He is in route. >> Any other brother's sisters still there? >> My little brother Liam. My little brother. As far as I'm concerned, my mom has a test. I know that. >> Okay. >> My little brother Liam, he just saw everything. So, he might be a little shaken up. >> And how old is he? >> I'm eight. My little sister is is uh six. >> Six. All right. Well, just hang tight right here if that's okay. >> Yeah. >> We'll be right back. Okay. >> When police raided the mother's home, she flatly refused to cooperate and resisted fiercely, forcing them to use a taser to make her comply. >> Hello. >> Hey, ma'am. Please step outside for me. Okay. >> I'm not even stepping outside. You can >> step out. Step outside, please. You said I can come inside. You can walk in here, but you have no reason to knock on my door anyway. >> I do. Okay. I'm not going to I'm not I'm not going to get >> I already got obstruction. >> All right, cool. There's one. >> Your dogs don't bite, do they? >> I'm about 5 7 minutes away. >> Can you hear me? >> I'm about five seven minutes away. >> She knocked the door on us. What's the code to get into your house? >> About 5 minutes away. >> Okay, I heard you. Can you tell us what the code is so we can come in? Cuz she won't she won't let us inside the house. Can you hear me? Hey guys, I'm about 5 seven minutes away. Can you hear me? >> I I can. >> It's okay. Come open the door. Okay, come here. It's okay. Unlock the door. 1358 radio. I've got two children. I'm crying again here in the back. I got to open the door. You would uh 25 back the back door. Okay. >> Ma'am, where's your mommy at? She upstairs. >> That's you. How are you? Who let you in my house? >> Step downstairs now. Come downstairs now. >> Who let you open my door? Cuz I'm going to get you. >> If you move, I WILL TASE YOU. >> Turn around. PLACE BOTH HANDS. Turn around. Place both hands back. Hands are back. >> I've done. >> Put your hands behind your back. >> Put your hands behind your back. Put your hands BEHIND YOUR BACK. YEAH, >> YOU'RE GOING TO get my sweater on first, please. I GOT [screaming] >> OKAY, your back. >> At the same time, cries of panic echoed through the house [music] until one officer gently spoke. I know your daddy. Just to calm the children at making an entry through the garage. >> [screaming] >> It's okay. It's okay. I know your daddy. It's okay. It's okay. It's all right. Listen. I know your daddy. It's okay. Come here. Y'all come over here. Come here. Listen. Y'all want to come outside? >> YEAH. >> WHERE'S your shoes at? Hey, come here. Let me get your shoes. Come here, honey. Come here. Come here. It's okay. Y'all want to sit over here for me? >> Yeah. >> Sit over for me. It's okay. >> Yeah. I used to work for your daddy at his sheriff's office. Look at that. >> Dad. >> Yeah, I know your dad. You're me. >> Put your hands behind your back now. >> I'M TRYING. YOU just taste me. >> Put your hands behind. >> I just want to put my sweater on. >> Put your hands behind your back now. You're under arrest. >> WHAT? WHY AM I under arrest? My old Let me >> So my husband called and said to her, "No, ma'am. >> I didn't do anything." >> You obstructed a lawful investigation. Ma'am, >> I DIDN'T DO I'M IN MY HOUSE. >> Y'ALL GOOD? >> We're good. Hey, did you tase? >> Yep. Tas deployed. >> You want a med unit? >> Can I put a sweater on? >> I'm not going to jail like this. >> Yes, ma'am. Go. >> I have no shirt on. I CAN'T GO. YOU JUST teased me. My go. I need to put a sweater on. I don't go outside like that. >> Who's that? >> Yep. >> Me or you? >> I think both of them. >> You just step in dog poop. >> No. Can I put >> No, YOU CAN'T. >> NO. [screaming] PLEASE WORK WITH US, >> MA'AM. Please work with us. >> Walk down the stairs. >> NO, I NEED ONE. >> You are GOING TO FALL. >> NO, YOU'RE THROWING YOU JUST TASED ME. OH MY GOD. >> On this side, even after being tased twice. The mother still refused to cooperate, turning an already chaotic scene into complete turmoil. >> We're going to stay until daddy gets here. Okay. >> Okay. Mommy's mommy got in a little trouble. >> Our sister. >> Who's your sister? >> I'm She's 13 years old. >> Where's she at? >> Like next door. >> Oh, I'll get her. Okay. It's okay. It's okay. She's not She's just being loud. She's acting like that. >> She always say bad words to >> She always says bad words. >> Okay. It's all right. >> It's okay. She's not getting She's not okay. She is in trouble. She's going to Thailand. Sergeant, >> you okay? >> I need my sweater number. >> You must like jail, don't you? >> No, I don't. >> If you don't have a seat, we will pick you up and place you in this car. We're not placed. The taser should have indicated that. >> Have a seat. >> Left foot up. Come on. Left foot up. Come on. >> Oh, yeah. Try not to. Okay. Right foot up here. Get out. Let's take the bite over. >> You just taste me twice. Like that's funny. >> I need a sweater. I'm not going to drill like this. My husband's a cop for a reason. >> It wasn't even good. Okay. Have a seat. >> I What a sweater. And you >> step in, please. Have a seat. >> Everybody's laughing at me. >> Nobody's laughing at you, ma'am. >> How dare you tase me? >> Have a seat. >> You obstructed again. >> I didn't obstruct. >> Have a seat now. I'm trying to, but I don't want to. >> No, you're not trying to, ma'am. Left foot. >> I can't. No. DON'T. >> There we go. >> Even so, the children's safety remained the top priority. >> Should we stay at the hotel? >> No. No, you don't have to stay at the hotel this time. I remember when y'all stayed at the hotel last time. Look, I'm Officer Andy. You can call me Andy cuz it's hard to say my last name. I'm going to call your dad, okay? He's at work probably. All right. And I'll call him Come straight home. >> You okay? I know those prongs got you for a second, dude. What the hell? >> I got about 3 seconds of it. >> Oh no. All I did was I re-energized and on that re-energizing, that's why I was like, I cut it off. I [laughter] was like, oh no. >> That freaking dog poop. >> I think I fell in it. No crap. >> I don't see it on you. >> Huh? God is good. Cuz we were both down there in the ground. Oh. >> All right. Let me go talk to your sister. Okay. Come back home. Okay. >> All right. Yeah. Y'all just hang out right here for me. >> Victim in here. >> Victim right here. >> Okay. All right. Her dad does want her to check on her siblings. >> No problem. I went to the front door, told her to step out. She closed the door. I'm not stepping out. Obstruction. We walked to the back door. One of the little girls let me in. Open the door for me. So, I opened the door, went upstairs. I grabbed her by her wrist. She pulled away from me. Taser. Taser. All right. So, she's okay now. >> She's in the car. >> Mhm. >> Emma, you can go check. >> She was placed under arrest. She's going to be placed under arrest today for the first degree. >> Obstruction through the children. Not only that, she put she calls in front of the kids. >> Yeah, because Yeah. >> First degree now, I believe. >> So, for the first and second degree, >> I'm sorry, but this has got to stop. >> I don't see why he's still here. Why he Why he keeps these children around her? >> Cuz he has nobody else to help him. >> But come on, man. You're leaving the children with this lady who's stays intoxicated. >> She's got an issue. She needs help. >> She does need help, but she don't want to admit it. >> These poor little kids. >> The mother. She kept leaning on my husband's a sheriff for 22 years, yet acted no better than a child. What am I going to jail for >> when I did not do anything wrong? And my husband's a sheriff for 22 years and I tried my best. What am I going to jail for? I'm not doing anything wrong. And then you came and not only tased me once, but twice. >> So you hindered a lawful investigation right off the rip. Ma'am, this all could have been avoided if you would have stepped out of your house and spoke with me. So it's first for girl and then two seconds. >> First of all, I never hit a girl. Just wanted a sweater. I can't go to the police department like this with no sweater. >> As things slowly calmed down, police began discussing and reviewing the mother's behavior. >> It's okay. Don't cry. It's okay. Make sure the dogs don't get out. Y'all just stay inside. Okay. >> Okay. >> Okay. It's okay. >> All right, brother. She's going to jail again today. We had to tase her. >> Good. >> She was resisting us saying through the door. We told her, "Don't shut the door." She the door in her face. >> Step outside. Let me speak with you. Right. >> Like she always does. You've seen her do this before. >> One of the daughters let me in from the back door. Me and Sergeant Bagwell here walked upstairs. Did you? >> I attempted to go hands-on with her. I grabbed her by the wrist. You're being placed under arrest. She pulled away from me. Taser. Taser. >> 13year-old. I think she's 13. >> The kids didn't see you. I kept them downstairs. >> She in the face with a with a open hand, busted her lip. She's her. She's got claw marks across her chest and she's got scuff marks on her knees. >> I'm going to tell you right now, this is probably a felony, right? >> It is. >> Okay. So, that means she's going to Jackson, correct? >> Because Wagman will have a field day with her. So she's going to jail today for the children in the first and then two counts of the children in the second because the other two juveniles witnessed. >> They were witnessed to this >> and of course obstruction. >> You can't blame yourself. >> It's been going well. >> She stopped you. This is all alcoholic lady. >> Oh absolutely. She's drunk right now. >> I told her, "Hey, just chill out. We're going to get you help. We're going to do all these things." And she steps over for about like 3 weeks cuz I've been out of the house. The kids and I, we've been just trying to stay away from that. >> Yeah. They asked if they're going to a hotel tonight. I said, "No, no, >> no, no, no, no. I'm staying here." Tuesday, I think it was Tuesday, she had an episode. I didn't want to deal with it. I ended up leaving with the kids again and it just fired out of control. She sounded good today. I was like, "Listen, I got to work late today. I'm going to come home, settled it, and then this happens." Resources card. >> Oh, trust me, man. I got >> I just I just want to make sure we're giving you all the resources we can. >> I have all the only resources right now that I have is uh black law right now. What we need to do is I'll let you get in there with the kids. Calm down. They want to see you. >> Oh, yeah. I know. >> So, and I come in there. I'll come in a second and get their information. What's the video footage show on the ring? >> It's just showing. >> Does it show us making contact with it at the moment? >> I'm the one who opened up the the garage. >> You to open the garage door open. >> Okay. Yeah, cuz I was last >> cuz I was trying to talk to you and I guess >> I was trying to get the >> I'm like doing like 90 miles an hour driving to pull me. >> I was wondering how the garage door opened. >> I thought y'all did it. >> I have everything. Well, that's why I made entries through the garage door. >> And I grabbed the had the kids come to me the best thing for her. >> It is unfortunately >> if it if it helps her get sober. >> It's a reckoning for sure. >> While also discussing strategies to provide emotional support for the child, baby. All right. >> Hey, they're going to check you out real quick. Sweetie, where would you hurt at? >> It's not that bad. >> It's all right. Don't worry about it. It's going to be all right. >> Come here. Come here. You sit down. >> You just got a scrape. >> A little bit of a scrape. >> And where else did you get >> here? And I cut under here. >> Okay. >> What happened? >> She was like getting my face and so I walked away and that's why she did this to me. So she got her hand in my face and that's when I got the cut. I think she like pushed me down like that and that's why I kicked her. So she hit me and that's where I got the knee straight and then she somehow got the scratch >> right here. >> No, I'm fine. >> I don't think that's all that happened. It seems like it's superficial. Nothing problems, right? >> Oh, yeah. >> I was at work when all this happened. >> You don't want transport. >> No, I just finished paying a $2,200 transport medical bill, man. >> Yeah. I mean, I'll be honest. If we did, there's nothing we're going to do anyway. >> I don't care. >> Helpless, the mother kept dragging her husband in as a shield, throwing out. I'm going to file a report on you. >> I need my handcuffs are too tight. You tased me twice. I'm going to file a report on you. And my husband is sheriff. He's outside talking. You need to let me go now cuz I did nothing wrong. >> He is extremely upset but not at me. >> You're not doing this. You can't by law. This is why you guys are like half like >> ma'am. We Let me Let me Let me walk Let me walk you through this. Finish. Okay. >> My husband to get me out. You locked it. YOU TASED ME TWICE. CAN YOU OPEN THE DOOR so I can get a a sweater? >> No. >> This is so tight. My my my I can't even move my my breath. >> And the police facing aned mother. They had to consider using an alcohol monitoring device on her. >> She's going to be forced to uh that steel cell sobriety, you know, >> you know, at least put one of those alcohol ankle monitors on her. >> Is there such a thing? >> There is such a thing. It's an ankle monitor to detect if you drink alcohol. >> She doesn't do meds. She doesn't do that I'm aware of. >> She just drinks. >> She just pounds it away. Tito's vodka and truly slur. >> I think the last time I was here, which has been a minute, it was there was truly cans everywhere. >> Probably Truly cans upstairs right now. >> Yeah. >> Let me go thank my neighbor now. >> Okay. >> Hey guys, thank you. >> Hey, you okay? >> No, but >> anything we can do for you? >> I'll be here for probably the next two weeks. And if you guys know daycare, cuz she's going to be gone for a little bit, which is probably the best thing. But um if you guys know any daycare for the meantime, mainly for like after school. >> Yeah. in a couple hours after. >> Thank you. I'm really sorry that you guys have to go through this. >> No, you know, we hate hate the situation, but I'm glad and it's okay. >> If there's anything we can do for you, man, just let us know. We'll do our best. >> Man, now I just have to get past the the humiliation part. And then I know it's no reflection on me, but still when we've had officers come in and you know, they do stupid stuff or their wives because, you know, this is not unheard of, of course, right? It's one of those things that you have to kind of have to >> deal with when it >> deal with it >> when it raises his evil head. >> Unbelievably, the wife of a deputy blurted out an insult at law enforcement. How dare you be even white after running out of excuses. >> I need a sweater. I'm not going in jail like this with a tank top on. You tase me twice. >> They will provide you clothing at the jail, man. >> No, that's not funny. >> I'm not laughing. I When have I once laughed? >> You tase me, mother. How dare you be even white? >> WHAT? BUT that was the most outlandish statement I've ever heard. >> Cuz you're racist. >> I'm racist and you just called how dare I be white. >> TAS ME TWICE. I'm going to get you fight. I swear to God in the Holy Bible as God is my witness. >> Don't put it on my God. >> You had no reason to tase me in my house and then you bang my door open. >> I gave you the opportunity with that too. [screaming] [laughter] Oh yeah, you tased me twice. You're going to get the punishment for it. I'm caught material, but I'm married to a sheriff for 22. Don't have that. You're not even 30. And if you are, I feel sad for you cuz you taste me twice. I feel bad for you cuz you're going to get fired. When I have more on my hands, you're going to pay the price. I guarantee you. You're hurting my wrist and I'm telling you to open it and you said no after you tase me twice. OPEN IT NOW BEFORE I KICK THE DOOR. This is not intolerant. You my wrist after you taste me. I move my wrist my fingers and I'm going to have and that's another law on you. That's another I know judges like the back of my hand. You think I'm stupid. What you did is you you I can't even move my wrist and I have this now. And that's funny cuz you tased me. My husband doesn't know that now, but he will. And then he stormed in my door for me doing nothing. Can you at least release this a little bit? It's hurting me really bad. The good news is police stood their ground and followed procedure, granting no special privileges, even as she kept invoking her husband, their fellow officer, to beg for leniency. >> And what's your first and last name? >> But my husband's here. >> I'm not putting your husband's name. Your husband's not arrested. >> Why did you feel the need to burst in my door? You had no reason to do it cuz I have heads next door to me. We don't do >> um What's your first and last name? >> Dana. How old are you, by the way? >> Doesn't matter. It's irrelevant. >> It does matter. >> No, ma'am. It doesn't. You're drunk. >> Cuz you're the one that tased me twice on the floor when I did nothing wrong. You're going to have a hard time trying to tell convince a judge. >> Likely this will be the easiest case I've ever worked. I >> I promise you. I guarantee you know it's the truth. >> Likely this will be the easiest case I've ever worked. >> Oh wow. Like I believe it. Tasing me twice, throwing me down the staircase. >> I didn't throw you down the staircase, ma'am. I have no shoes on and then I couldn't get a sweater. Yes, you're going to be fired. I don't care how long you've been on law enforcement a lot more than you do. And I wish I would have done the opposite. >> You know more than I do. So you know that shutting the door in my face is a bad thing. >> And then you burst in my door. And >> yeah. >> All right. You know more than me. That's why you're in the back of a cop car. >> You got tased. >> No, I will tase you. You won't tase me. >> Oh, I got tased twice. No, you can't turn your video camera off cuz I have that on video footage. >> A >> Go ahead. You're going to end up getting arrested yourself. >> I might even get a letter of commendation for this incident, ma'am. >> I need to make a phone call because my phone was left there when you burst in my door. No, I'm not playing. I didn't say you were. I'm not playing. >> I don't even have my phone with me. Okay. >> You keep saying okay, but you're lying. >> How am I lying if I'm saying okay to deal with liars in law enforcement? >> LOL. LOL. That's all I got to say. >> Everything. >> Okay. >> It's not funny cuz you >> laughing again. >> YOU TAS ME. SO GO AHEAD AND PUT EXTRA CHARGES. I SWEAR TO GOD BY THE BIBLE they're going to fire you. Not to mention you wouldn't pull over to take my cuffs loosened. >> They're not going to fire me. I can promise you that. Okay. >> I don't need your name. >> I'm not going to I mean, >> you're you're you're no different than anyone else. >> Cool. I'm sorry you feel that way. >> I'm sorry. You're like like going on 50, but you're like a little kid. >> Like not even mature. >> That's the only time I've laughed this entire conversation. >> I I want all these on my hand. You're gone, dude. >> I'm not gone. >> Yes, you are. Oh, no I'm not. I can promise you. Hey, >> you have to authority to to tase me. >> I'm sorry. I forgot you know more than me. I completely forgot about that for like 5 minutes and so I spoke out of turn. My apologies. >> I know you're driving around. I want to call my husband. >> That's unfortunate. Unfortunate. >> I'm hurting and I have no shoes or a sweater and everyone stares at me cuz they know who I am. I'm my sheriff's wife. Oh, how would that be funny to you? >> It baffles me that you think you can >> It baffles me that you >> I'm sorry. Middle of my >> extra charges. I know judges like the back of my hand. >> You'll get reacquainted with him when he gives you one felony and two misdemeanor. >> A felony for a felony? >> Yeah, a felony. >> Laughing about that. >> Crazy how I haven't laughed yet. >> You're actually You're actually You're actually ticking me off. >> I even let my hand go a little loose. >> Okay. and it's black now. >> That's only because you know more than me. >> I wanted to become a sheriff long many years ago and my husband always told me no. And he does it because he's very supportive and protective like I am. And it hurts me to see people hurt. What you're doing is not the right thing. >> Okay. I thoroughly apologize for that. Ma'am, >> can you at least call the EMS? >> No, I can't. >> Yes, cuz I have this. >> I'm not going to. You at least call my husband for me. 005. >> You're charging me for the wrong charges and I never >> What's the right charges? >> No, it's not. If I'm married to a sheriff for almost 17 years. >> Oh, so you're above the law. >> It's above the law. I know my law though. >> Oh, you don't. If you did, you would have stayed at the front and talked to me. But no, you don't. You tased me twice, echoed like a haunting refrain, repeated all the way until she was taken to the station. >> Hi, ma'am. Go ahead and step out. Everything's okay. I just need to remain calm. All right. >> I'm fine. I just have look look. Okay. Look at this. There you go. >> I'm not laughing. >> I mean, people know who I am. >> Ma'am, come with me now. >> My hand is pro. People see me. I can fit my entire pinky in these handcuffs. I can also fit my entire pinky in these handcuffs. I can't even. >> That's way more than I should have even given you. It >> hurts. Look, I'm >> Cuz you keep twisting your wrist. That's not smart. >> That's not funny. >> Give me your leg now. Give me your leg now. Come out. >> Give me your leg now. I do not want to have to force you out. I've already had to use force. I do not want to use any more force. You're doing good. Come on. Come on. There you go. I got you. >> I have shoes on. It'll turn into a sweater. >> That's fine. They're going to take care of you. All right. I've got you. You're not going to fall. Okay. >> You have this too tight and it's me. You chase me twice. I'm trying to get out. Can you let >> There's a There's a step right here. >> Can you move so I can walk before you tased me three times? He tased me twice. My husband is scared. >> How dare you? >> You're going to be fired. >> Listen, we're not talking. >> It's the truth. >> Can you at least open it? >> We're going to pat you down. We're going to get you out of these handcuffs. Okay. Whatever. Okay. I'm not I don't do >> the mother was arrested and held on charges of to children first and second degree and willful obstruction of law enforcement under Georgia state law. These charges carry potential prison sentences ranging from 7 to 30 years with bail set between $16,000 and $37,000. No personal power, status, or marriage can cover up and irresponsibility. The phrase, "My husband is a cop," can never be a shield against guilt, especially when the victims are children. Just one careless nap and a three-year-old went out of the car. Apparently, seat belts and child seats were just for show. While were the real must have on this family road trip, >> he falls out of the car. >> It just came out of it. Slide rolls all the way over. >> The car took off. On September 15th, 2021, a man witnessed a young boy suddenly fall out of a moving car and tumble along a road in Florida while the vehicle kept going. He immediately rushed to rescue the child, carried him to safety, and called the police. Flaggler County deputies quickly arrived to take statements, but the incident left far too many questions unanswered. >> What happened so quick? >> I've never seen anything like that. The silver car, best I can tell, it's silver. rolls around and I see the damn doors open and this kid come rolling out of it. >> He falls out of the car. >> He just came falling out of it. Slide rolls all the way around >> and the car took off. Which way it go? Silver SUV pickup. >> No, just a caravan. A car. Just a car. >> Did it car or >> nothing like that? >> My problem is I was just I saw him. I was in disbelief and I just >> I'm in disbelief right now. >> Yeah. >> Hey, are you all right, pal? >> He's got He's got a little cut. Let me see, buddy. He's got a little cut on his finger. Hey, do you know your name, big guy? >> Can you tell us your name, bud? >> You know your name, bud? >> You can tell us. What's your name? >> Chu. >> Chu had a hard time telling me about anything. >> He or she made a U-turn. White car is over there. I'm sitting first one in line over there. >> I thought it was a dent in the door. That was the damn door open. >> He folded the back >> and he just signal 14. Subject says he may have. >> I just looked at him. I say I just silver car is all I can think of. And I just got I kind of >> Did the door close when it kept going or did you not >> No, it was it was still open. I even tried to ask him, "Did anybody know that you were out of the car?" >> That's what I'm wondering. They don't know he fell out. >> Yeah. Were you riding with your mom? Were you riding with your mommy? Was daddy with you, too? >> Just mom. >> The mother eventually came back after realizing her child was missing. Yet, [music] her face showed not a trace of concern. >> I might possibly have a vehicle pulling up right now. >> Where's my son? >> He's in the front seat of that car. >> How? >> He fell out your car. >> How? Oh, he fell on my car. >> Copy tag for the parents just showed up. Matt, >> how did he fall? >> You tell you tell me that. Was he buckled in? >> Sleeping. >> Where was your son at? >> I was sleeping. He was on his side. >> Who was driving? >> My brother. He said he he said he heard the door open, but he didn't he didn't think like >> you want to come get him out of this man's car. >> He's got a little cut on his finger. He's okay. When did y'all realize he wasn't in the car? >> Right now. Like right now. We got him to the expressway. My daughter was like, "Where? What? Why you >> Don't yell at him. Just >> I know. You want to you want to pick him up? He's scared. His hand. Okay. >> The more police investigated, the more stunned they were. Both drivers were under marijuana and the car was in alarming condition. >> Sir, Carol went on the way. Do you have your your ID? >> No. >> You don't have anything? Have y'all been smoking? >> Yeah, I've been smoked once. >> When? Like 20 minutes ago. >> 20 minutes ago. And you're driving. Four kids in the back seat. >> I I had windows down. >> You had your windows down. Were you smoking in the car? >> Yeah. I had one time. You were supposed to get in the car with them in the back window. >> Do you have any more in the car? >> Were you driving? >> Yeah. >> Get your ID, too. ID. >> Say it again. >> You don't have a ID locked in your doors or >> Oh, goodness. >> Where's everybody's car seats? >> They can wear a seat belt, right? >> Um, well, you have this four kids. >> Only three seats. So, how many four kids with three seats? >> With three seat belts, >> they all fit there. >> It doesn't matter if they all fit there. How many seat belts are there? There's three seat belts and every juvenile needs to be in a seat belt. So obviously someone's not in a seat belt if there's four kids. >> I mean I just got this car. I used to have a big van but I >> So just saying if I just get this car I'm going to sit four kids in the back seat. I'm going to make sure there's four seat belts. >> I have six kids. >> I know. But I understand that this what I was I didn't think that my son would ever do something like that. Yeah, I know. But under state law, every child needs to be in a seat belt at least. Certain >> age locks on now. Where are you guys coming from? >> I'm coming from Florida. >> We're in Florida. Where you I mean, where are you coming from in Florida? >> Trying to get to South Carolina. >> Okay. What part of Florida you guys coming from? >> Very far. Where far are we? Trying to get >> my name. >> His dad. >> Okay. So, you're going to be detained for now. Okay. While we >> investigate. So, you said you were smoking in the car with them in there? >> Yeah. >> Is there any more weed in the car at all? >> Like probably a joint left. >> A joint? >> Do you have a medical marijuana car? >> Oh, no. >> You don't have medical marijuana card. My question is is how do you not realize that the door opens and one of the kids fly out and then we get on 95? >> Cuz I ain't I ain't here. >> You didn't hear the door open and shut. >> I kind of did hear something that was like >> and see a kid fall out of the car. >> So, if there's four kids in the back of that car and three seat belts, how does everyone have a seat belt on? I think they they did. >> My question is is if there's three seat belts and there's four kids, how do you get three seat belts on four kids? It it's impossible. And obviously the kid that didn't have the seat belt on is the one that flew out the car and road, right? >> He said there was probably a joint left. If >> I'm not mistaken, I think he has multiple suspensions. >> The curtain hiding the truth about an unprescribed Xanax was lifted. >> All right, ma'am. I'm going have to talk to you for a little bit now. Okay. You might come over here with me. We're going to go back to the beginning of what happened. So, where were you guys coming from? >> Coming from Miami, Florida. I was coming to South Carolina for him to see his dad and I was sleeping. What woke me up was when my daughter said, "Where is um Chris J." They thought that he got out of the gas station and went into the bathroom without my brother knowing. But that's not what happened. He didn't even notice that my son fell out the car right here. Like I didn't even like then when I went crazy and we was like right there on the e-way. So we had to hurry up and turn around to get off and come back to the same gas station that he said he my brother said he was at. >> All right. And the pills I found in the glove box, the Xanax bars. >> The Xanax. Yeah, those are my anxiety pills. >> Okay. Are those Do you have a prescription? >> I don't have it in my bottle. No, I don't have my prescription. >> Do you have a prescription for Xanax in particular? >> They give me um some type of pills like that's for like that. >> Has a doctor prescribed Xanax bars to you is what we're asking. We can check that. We can go on the record. >> No, but they they prescribe me with pills that are like in the Xanax family. >> In the Xanax family, but he hasn't prescribed you those those pills. cuz I have bad anxiety really. I mean anxiety problem. >> Where did you get those pills from? >> My friend gave them to me. >> Your friend gave you those pills? >> Yeah. >> Does your friend have a prescription for the pills? Is it his prescription? >> Probably have a prescription of them. >> Okay. >> At the same time, signs of and violations became increasingly clear. >> The secondary concern that I have is when you guys left Miami, okay, you got four four children in the back seat. Their ages are in the back seat right now. Is that five or 9, five, four, and three? That's her ages in the back seat. That's the concern that I have. The secondary concern is um who was the male that was driving the car? >> My little brother. >> Were you awake when your brother was smoking marijuana in the car? No. >> You weren't awake when he was >> sleeping. Okay. You were sleeping when he was smoking marijuana. Did you know that he had marijuana on him? >> No, I wasn't aware that he had marijuana on. >> Okay. So, now he is driving under the influence with four juveniles. One of them obviously not in the seat. I can't I can't say that they all weren't in seat belts. I know that when we came up to the car, they weren't in their seat belts, but um two of them were supposed to be in car seats. >> Which one? Said I thought you said the four-year-old was supposed to be in a car seat. >> So, anybody under the age of five needs to be in a car seat. >> Five and under. >> Five and under has to be in a car seat. >> Basically, that means I can't drive my car at all because I have six kids. >> Yes. This would not be a vehicle that would be suitable for you to drive. >> Car for now to get around. >> You would have to have a vehicle that would seat sets two miles. >> Yeah, I know. I always used to have vans and stuff like they cared cuz my I lost my car and this is the only option that I had to have a park for now. >> I understand. Like I said, there's other options that you as a mom have to take for the safety of your children. A better option would be finding somebody to watch your juveniles >> so that you can fit up there. That would be stuff that I would expect a parent to do. Do you have any family that's in the area here? Where is your family at? >> Far away. We don't live here. >> But where would your family be at? Where would the nearest relative be at? >> Miami, Florida. And nobody have a guard. And nobody has a car down in Miami. They don't know anybody that could. >> No. And this car is not even under my name. I was going to do all the registration and everything. >> So your younger brother, does he have a license? >> He never had a license before. >> Did you know he didn't have the license? >> I think I Yeah. Yeah. We didn't know. He didn't have a license. So >> Okay. You're putting your children in the back of the car who don't have seat belts on a non-licensed driver. >> Listen, I love all of my kids. >> This isn't a question if you love your kids or not. >> I know. What happened was a mistake. I understand. You know, I don't know what you want me to do. There's there's a lot I want you to do as a mom to for the safety of for your children. >> I can I can go by >> pushing police to the point of no delay, forcing them to cuff immediately. >> At this time, we're going to detain you. All right. >> Over here. >> No. Do this. Do this. Walk with us. Walk to the back. Walk to that car. I don't want to do it in front of your kids. Go ahead. Put your hands behind your back. >> I was sleeping. >> Cuz there's many things going on here. Many things. Many things that put these kids lives under danger today. Not just one thing between too many kids in the without seat belt without the car seat. No one realiz that kid fell out in the car. There's a lot of things going on right now. >> We'll discuss that later. >> Come talk about it in one second. Okay. >> I said with these rights in mind, are you willing to talk to me? >> No. >> You don't want to talk to us? >> I'm going to jail >> right now. We're It's still an investigation. So, we're still doing an investigation into it. Okay. All right. If you were to go to jail today, your charges would be driving with no driver's license. Okay. I don't know how many suspensions you've had possibly driving under the influence not and also child for having in the vehicle with the children on there and then also failure to for due cause to make sure those children since you're the driver you're responsible to make sure that they're in car seats and they're in seat belts. You basically drove off and let one fall out of the car. So you you'd be charged with child. >> Like I said we we're still doing an investigation. That's why we wanted to talk to you. Still, [music] they had to follow a maze of procedures, protect the child, complete the hold order, and prepare the file for DCF. >> We just got to see if this stack comes back to the car. You guys are doing okay in there. That's your puppy. >> All right, Desiree, a few more questions for you. Okay. Do you have like a next of kin to so to speak for that you'd want contact for your kids? Someone that you'd want contacted for them. >> What? >> Uh, just for DCF because DCF has to be notified because your child fell out of the car. >> The father. Is the father local or is that's the one that's in South Carolina? >> The one in South Carolina. >> At this point, the brother's being placed under arrest for driving a spend driver's license felony. Possession of a child. You're also being placed under arrest for child possession of the Xanax pills if they turn out to Xanax. Okay. The two of you had every reason or right to either one put those kids in a car seat or make sure they're properly buckled in. But the two of you failed. I mean, you put your children's life in danger by letting them slow driving like that. Okay. Well, >> all right. Let me call somebody so they can come give my kid. >> Here's the deal. I Right now, I can't sit with your kids while someone comes from Miami. So, I did call Department of Children and Families. They are on their way to take possession of your kids. If you give me that name, I will give that name to them. I'm going to take your oldest child, put him in one of these cars, and I'm going to drive the car literally from here to the parking lot and get them off the roadway. Did the kids eat this morning or anything, man? Did the kids eat breakfast? >> If I was going to McDonald's and get them some read, anybody have any allergies or anything? All right. So, I'll go in McDonald's, get them some food, and the investigator should be here in the next half hour, 45 minutes. Okay. Step on out, and they're going to walk you over to the other car. And then there's a puppy in the car, too. Correct. >> Yeah. Those are my puppies. >> All right. There's more than one in there. All right. They're going to go to We're going to turn them over to I can't to our animal control. >> Hey, can I pick them up? >> Yeah, I'll give them your name. >> My car, not under my name. >> Well, here's that's the problem. The car is going to get towed. It's going to go to the local towound. You won't be able to get it out until you bring a valid registration insurance for the car cuz the car is not registered and the car is not insured. So, you shouldn't be driving this on the road. Okay. >> Okay. All right. It's all right. I see everything you guys are doing. >> Yeah. >> Not everything that we're doing. Everything that you the choices that we selected today. >> Hey, everybody got a seat belt on back there? Can you guys scoot over here and put your seat your seat belt on? >> J. No. She's uh going to go try to find some car seats. Okay. Everybody has their seat belt on. >> I ain't got no warrants on there. >> Um are you supposed to have a warrant? >> No. >> No. I didn't see any warrants on you, but we'll double check that when they do your fingerprints at the jail if you have anything like this. >> Things a little bit differently when you're arrested for child. That's why the department of children families neglecting my children. >> It's not what it's not what we think. It's the evidence that shows you we'reing your children. Additionally, you're also being charged with possession of a schedule four narcotics. >> Desiree Rodriguez, the mother, was arrested and taken to the Sheriff Perry Hall inmate detention facility on charges of child and possession of a controlled substance.
