Hands at your sides. >> god. >> don't have any weapons. I don't have any weapons. I have nothing. I have nothing. >> I have nothing. >> Sides. >> Morale, did you call for help? >> Morale, your help is here. >> I know you're not my help. >> the top of this pin? >> Oh my god. >> Maybe if you stop being racist for a second and listen. >> racist. I'm afraid for my life, dude. Why are you behind me, sir? You ready to take me down? >> Today's body cam video is a reminder that sometimes you can get yourself arrested just because you never stop talking. This was just a simple speeding stop and it quickly turned into one of the most exhausting DUI investigations that you'll see. Instead of helping herself, this driver spends nearly every second making her situation a whole lot worse. Get comfortable because she's going to show us how exactly not to handle a police investigation. >> Good evening. I'm Officer Flannery. My name is Gardens. The reason I pulled you over is you were going 71 miles an hour. >> Oh my >> Do you have your license, registration, insurance? >> I'm so sorry, sir. >> Where are you ladies coming from tonight? >> I got to go to the bathroom so bad it hurts. Oh my god, it hurts so bad. Oops, wrong thing. I'm sorry. >> All right, give me one second. Miss >> Yes, sir. >> If you would go and step out with me real quick, I want to make sure you're all set to drive and I'll have you on your way home, okay? >> What do you mean set to drive, sir? >> Make sure you're not under the influence, okay? >> Oh, I'm not under the influence, but I'm scared right now. So, why would you think I'm under the influence, sir? Hi. >> Hi. Make sure you're not under the influence, okay? >> Oh, I'm not under the influence, but I'm scared. He's looking in my purse. >> I'm not. Cuz I can smell it, I can see it. >> You can see it and smell what? >> Well, your speech is slurred, your eyes are watery, I can smell it coming out of the car. So, if you would go and step out, we'll make sure you're all set and we'll have you on your way home, okay? >> Literally, right up there. Calm down. We're going to record it. You say >> We're we're recording it, too. We got two cameras and the one on the car. >> You can see and smell alcohol on me? >> I already I already told you that. Come on out, ma'am. If you're If you're all right to drive, you'll be on your way home, and there'll be no problem. >> Exactly, but what are you trying to do to me right now? >> I'm trying to make sure you're all set to drive, that you're not driving under the influence, just like I told you before. >> Okay, can you call Jimmy or somebody to come here? >> No, no, don't call anybody to come here right now. >> No, I'm calling my my little brother, and I have the right to do that. >> Tell them to Tell them to keep their distance. All right, I'm scared too that you're not getting out of the car, so go ahead and step out, please, okay? >> I'm calling so I'm turning on the light. My hands are up. I know I'm blessed. Um my hands are up. I'm a woman. I'm not I'm not not a threat. >> I'm a police officer, and I don't know why you're acting like that. Nobody's hands are on their guns, so please go ahead and step out. >> are on the wheel. I don't have anything >> We can see that. Our hands are up, too. Let's go. Please step out, man. >> Wait, wait, I'll come out. I'll come out. >> You're not doing it, though. You're not doing it. >> I'm just afraid. I'm just trying to I'm >> Come on out. You've already got two cameras on you. Go ahead and step out. Let's go. >> Oh my god. >> Come on back over here. >> Where Where do you want me to >> Where my finger's pointing. Do you see my finger? Do you see where it's pointing? >> god. >> Please go ahead and stand over there. Let's go, right over here. Okay, do you have any medical condition with your eyes not corrected by glasses? >> I don't have any medical condition at all. Oh my god. >> Okay, are you able to walk a straight line? >> I can walk whatever you want. I'm because you're white, I'm black. I I don't >> My first observations, again, I'm not in law enforcement. I'm just making observations as a civilian. I know that I wasn't in the police car. I know that I'm not there in person. Depending on how exactly she was driving, whether it was erratic or she ran stop signs or something like that, I don't know. We didn't see anything before like they walked up to the car, right? She seems genuinely scared to me. And I'm not completely convinced that she is under the influence. Like she doesn't seem belligerent. I didn't really hear her slurring her words. I don't know if it's just because we're so used to watching these drunkards like slurring their speech and acting all belligerent. She's acting pretty normal to me, and she's acting pretty afraid. And you know, I can understand why she's afraid. You know, this is late at night. She's a black woman with another black woman in the vehicle. These are obviously two white officers. She's probably a little bit afraid. She might have never been asked to exit a vehicle before at a traffic stop. She She could be a little intimidated, a little afraid. She wants to call her brother, which they said that she can't do that. Can she do that? I don't think you're supposed to be able to do that, to like call people to the scene, because that can make police officers pretty uncomfortable, you know, having a whole bunch of people show up to to potentially cause problems. So, I don't know. This This entire traffic stop so far is making me feel a little uncomfortable. I don't know. What do you guys think? Let me know your first initial instincts down in the comments. I mean, she This whole thing could flip. This whole thing could flip. But right now, I feel very uncomfortable by this entire traffic stop. Clearly, these police officers are not being confrontational, but she seems extremely uncomfortable. Okay, well, she escalated that pretty quick. >> [laughter] >> Okay, I After After watching a few more seconds, she's clearly over exaggerating a little bit. >> [laughter] >> These police officers are like trying to be kind to her and she's like, "I'm married to a white man." >> [laughter] >> MY HUSBAND'S WHITE. MY HUSBAND is white. OKAY, BABY. WE'RE NOT making this about race. There is a reason why these police officers stopped you and pulled you over. And given the climate of a lot of the world right now, I understand her being a little bit fearful, okay? I get that. I can respect that. I would probably also be pretty fearful if police officers asked me to get out of the vehicle. I'm not going to lie. Like it's intimidating being approached by police. It's a little scary, especially if you feel like you're a minority that could be targeted, right? I get that. I am sensitive to that, especially being a woman. You're a woman, you got two police officers coming at you that's a different race. I get it. But you don't think you're going a little above and beyond LIKE WITH ALL YEAH, MY HANDS UP. I GOT MY HANDS UP. I walked OVER HERE. I WALKED over there. Just calm down and just listen to the police officers. It's already seeming like she's making this into a much bigger deal than it needs to be. >> Bring your feet together. Hands at your sides. >> Oh my god, I have no weapons. Please. I don't I haven't done anything. I had to go to the potty really bad. I had >> know, listen. Are you listening? Are you listening right now? >> I had to go to the potty really bad. >> Listen to me. >> I told you to stand right here. >> here. No, I told you to stand right here. >> I said do a Why I got to come so close to you? I'm afraid to come close to you. >> Okay, listen. I'm going to advise you of a thing called your Taylor warnings, okay? >> Oh my god. >> I suspect that you're driving under Stop talking. STOP TALKING. YOU'RE NOT LISTENING. YOU GET BACK IN THE CAR. YOU'RE NOT LISTENING. You get back in the car. Get back in the car. Get back in the car. We're trying to deal with it. Listen. I will tell you >> you to get back in the car because you're interfering with our investigation. GET IN THE CAR. WHY ARE YOU ACTING LIKE A CHILD? WHY ARE YOU acting like a child? Stop acting like a child. You get out of the car again, you're going to jail for resisting and obstruction. Do you understand? Well, first of all, you were speeding and I believe I want you to stop talking. >> Please >> Baby, I hear you. Man, she's probably so close to pissing herself. [laughter] If she's scared and she's really spun up and if she has had a couple of drinks, she's probably going to end up peeing in her pants. So, I I can understand, but my god, she is freaking out. They have Okay, they have literally given her no reason to be acting this way. They really haven't. They have been kind. They have been courteous. They just simply asked her to step out of the vehicle. Her sister was starting to try to come in and start sticking her nose in because clearly she can hear her sister is in distress. So, I can understand the sister wanting to get out of the car and come and approach the situation, but she needs to sit there and keep her mouth shut, too. Otherwise, she's going to end up in trouble. This woman is losing her [ __ ] and I honestly don't understand why anymore. They didn't do anything to you, honey. I understand you got to pee, but they didn't do anything. Please, my hands are all over What do you want me to do? To stop talking. Stop talking. Stop talking. Stop talking. Stop talking. Lower your hands. Put your hands down. Follow instructions. >> Okay. >> Time out. You need to listen right now, okay? You are being advised of your Taylor warnings. If you do not cooperate and participate in these exercises, you are not going to dispel my concern that you're driving under the influence of alcohol, chemical, or controlled substance. >> Taylor warnings are specific to Florida case law and help build a case if a suspect is not cooperating with a drunk driving investigation. >> I did not tell you to walk the straight line. >> me to walk the straight line. >> No, I asked you if you could walk a straight line. >> Next, your your inaction to participate in these exercises will force me to make an arrest based on the totality of the circumstances as I know them to this point and it will be used against you in court. Are you willing to do these exercises? >> know what you said. I'm so afraid right now. >> Okay, so I'm going to tell you one more time. Not doing these exercises is going to force me to make an arrest based on the totality of the circumstances and it will be used against you in a court of law. Are you willing to DO THESE EXERCISES? >> EXERCISES, SIR? JUST don't kill me, please. >> So, place your hands down at your sides. >> I'm scared. I'm scared. >> Place your hands down at YOUR SIDES. >> WHY? I want to let you know I have no >> understand because she is under the influence. >> I am not under the influence, ma'am. >> hands down at your sides. Put your hands down. >> TO I'M AFRAID. I DON'T WANT you to think I got weapons. I DON'T HAVE NO WEAPONS, SIR. >> DID ANYBODY say you had a weapon? >> Oh my god, I'm afraid. I'm My hands are up. I have nothing. >> Ma'am, listen to me. Listen to me. >> Ma'am, you accused me of drinking. I know >> She didn't accuse you of anything. >> She said she must be on the influence. What exercise you want me to do? What exercise you want me to do? >> I want you to stand right here. >> I'm afraid to come close to you. I don't want to >> Well, if you don't come close to me, I'm going to come close to you. >> Okay, what do you want me to do? What do you want me to do? >> hands at your sides, hands at your sides, hands at your sides, hands at your sides. Nobody said you have a weapon. >> I have nothing. >> You see the top of this pen? >> Oh my god. >> You're not listening. >> Okay, if I see the top of the pen, sir. >> hands to your sides. >> Marilla, did you call for help? >> Your your help is here. >> I know you're not my help. >> top of this pen? >> Oh my god, you got to >> Maybe if you stop being racist for a second and listen. >> racist. I'm afraid for my life, dude. >> Why? Because you're being racist. Because you are being racist. >> you behind me, sir? You ready to take me down? >> You're making this more. Come on. >> I don't want to die. I didn't do nothing. I don't want to get hurt. I just I don't want I'm going tonight. >> You're going to follow >> Okay, she's overreacting, but I I feel bad for her. Like she truly does sound terrified. Whether she's under the influence or not, she very well could be. I mean, I know that I get extra emotional and and a little, you know, erratic when when I have a drink or something. So, I I understand that that might be fueling her terror because she sounds terrified. I I'm sad. Like this makes me sad, you guys. Like I I can't even make this funny. It makes me sad. Like let me know down in the comments your thoughts. The police are supposed to be there to help and to keep order and to serve and protect. And she is absolutely terrified that they are going to kill her. In any position of authority, there's always going to be bad apples, right? But she is absolutely terrified. They're just trying to make sure that they don't have a drunk person on the road that is going to injure people because if you're drinking and driving, you could literally kill somebody. And those people need to not be on the road. They need to have some sort of consequence. They need to be punished in some way. And they're just trying to make sure that you're not one of those people. And she's literally terrified that they're going to take her down for no reason or they're just going to use this as an excuse to kill her. Now, whether or not all of these feelings are fueled by alcohol or some sort of substance abuse, I do not know. But it is very sad that it appears that she has been conditioned to feel this way towards law enforcement. That's just it's I find it very very sad. >> You're going to follow this, wait to >> want to die tonight. Please, don't kill me. >> of his pen. You're going to follow this. Stop talking. >> I don't want to die. I promise you I didn't do nothing. >> 10-15. You're under arrest for driving under the influence of alcohol, chemical, or controlled substance. >> I'm under arrest for what? >> Because you failed, he killed you a couple times? >> No, I'm so afraid. >> Well, you shouldn't have been. There's no need. >> Oh my god. Morale, I got to go. >> even have tears, ma'am. You don't even have tears. >> It's all an act. She's being racist out here. >> Morale, can I ask for the supervisor? Can I have the supervisor? >> Sure, you sure can. I will call the supervisor for you. >> Draft 13, may I have a supervisor? Individual's not happy with my police service. >> Morale, come get my drink. Ooh, she threw my stuff on the ground. She threw my stuff on the ground. >> Yes, I threw it. >> Taking it up, gentlemen. >> There's no need to yell like that, please don't. >> I'm so afraid. >> What did my sister do? What did my sister do? I want to be safe. >> You're the safest person in the city. You have police officers with you. >> No, sir. No, it's too much going on. I don't feel safe. >> nothing going on. >> OMG. What are you doing? >> connected? >> MY GOD, are you Are you taking my wig off? It is >> They tried to take her wig off? Are they taking her wig off? Are they just trying to make sure she's not like concealing razor blades or some [ __ ] in there? >> [laughter] >> NOW, AGAIN, WE CAN'T REALLY SEE, IT'S DARK, YOU KNOW, WHATEVER. Is she really crying with no tears? Is she faking this entire thing? Did she get me? Did she get me? Did she play to my sympathetic side and make me empathize with her? Did she get me? Did she fool me? Or is she really this scared? I don't know. Let me know your thoughts. I don't know how to feel about this one, but it is kind of funny that she's concerned concerned that they're taking her wig off. >> [laughter] >> 5 seconds ago you were worried about them ending your life, and now you're worried about losing your wig. Really? >> If it's sewn in, then they'll take it off at the county. >> Oh, ew. >> I'm being arrested. >> You are being arrested because you did not You didn't participate in the exercise. >> Sir, I walked a STRAIGHT LINE. >> I DIDN'T tell you to walk a straight line. >> a straight line. >> I didn't tell you to. >> OMG. I got to pee so bad. >> I wonder why you got to pee so >> I was drinking a lot of water. I had sparkling water. >> Then you should have done the exercises. You would have no problem. >> I'm so in, sweetie. >> I need to check to make sure you don't have any It's I feel metal, ma'am. So I have to make sure you don't hurt my officers. >> Oh, I'm I'm in cuffs. How am I hurt an officer? I'm in cuffs, ma'am. I cannot hurt somebody. >> How can you do all that and not have tears? That's what's interesting to me. It's interesting that you that you're trying to cry without tears. >> I just don't want to get hurt, dude. >> You're acting like a child the whole time. That's why you're acting up. >> A child don't I don't want to get hurt. Morale, look at my wallet. I have my attorney in the wallet. Please call my attorney right now. >> Well, we're not going to talk to him. >> No. Morale, just call the attorney. Please Please don't break that, ma'am. >> I didn't. I've been taking very much care of your items. >> Thank you. Morale, please call my attorney right now. >> Okay, she's right now she's under arrest for suspicion of DUI. I just want to confirm you just you just took a necklace? >> That's my twin sister's necklace. >> Okay. Okay. And here's a bracelet. Ma'am, can I speak? I'm talking I'm talking to you calmly and respectfully, okay? >> I'm a 45-year-old woman and I'm not an idiot. And I'm an educated woman. >> I'm a 40-year-old >> So don't talk to me like an idiot. >> I'm a 40-year-old man and I'm talking to you with the same respect that I get from here. >> Okay, he's not He's being very respectful. Why do people start to think that police are coming in an aggressive way and you automatically have to be on the defense? He's bringing you your sister's jewelry. He's acting very respectfully. He's trying to explain the situation. He's not talking to you like you're a child. Congratulations on being 45 and well-educated. Seriously, your sister didn't do a basic instruction, okay? For that reason and the reason that she was making a big deal out of literally everything, for that reason she's being put in handcuffs. Now, don't you go getting arrested, too, sister. Mm, don't you go getting arrested, too, by trying to stick your nose in. As it stands right now, you might be able to drive the car home, unless you've had drinks, too. I am dying to know if she's actually under the influence. They said that they smell alcohol. They said that the eyes were bloodshot. She's crying with no tears. I want to know the truth. [laughter] I WANT TO KNOW WHAT'S HAPPENING RIGHT NOW. >> SO, PLEASE don't talk to me. I'm not dumb, cuz I may be very, very smart. >> All right, I'm trying to explain to you the process on what's happening. Sergeant Leffler, for transparency purposes, this discussion's going to occur on body-worn camera, sir. >> Okay. >> I pulled this vehicle over because I observed it traveling 71 mph in the in the outside through lane. Vehicle slow-rolled to a stop right here. Upon contact, I made contact with that woman in the driver seat, Miss identified by Florida driver's license photo. Upon contact, I noticed that she had glassy eyes, slurred speech. I detected the odor of an unknown alcoholic beverage coming off of her breath. Gathered her information, went back, conducted my records check, waited for 94 to arrive so I could resume my investigation. Asked her to exit the vehicle. She starts pulling out the phone. She gave me a little bit more of a hard time going back and forth with me about getting out of the vehicle. Finally, she exited the vehicle on her own accord. I tried to ask her if she had any medical conditions which would affect any of the exercises performed. She started yelling, walking with her hands up, saying that she was scared. I asked if she could walk a straight line. She proceeded to start walking down the white fog line without being told to do so. I then got her to about where she's standing with uh Officer Rigney over there. She stood like this with her hands up. I kept telling her, "Please lower your hands." She kept saying she doesn't have a weapon. At no point was a weapon drawn on her. At no point was my hand on my gun. At no point was she accused of having a firearm or any kind of weapon that would harm us. She kept saying she was scared. I attempted at least two times to advise her of her Taylor warnings, to which she kept yelling and talking over me. Then she said she was willing to do whatever that we needed to do, but kept her arms in the air and would not approach me because the HGN has to be conducted within 12 to 18 in away from the person. As I held the stimulus device in front of her face, she would not look at it, would not would not participate. She was instantly placed under arrest and you can hear over there still hollering. She requested for her supervisor. >> Okay. >> That's where we're at. >> And so you're making an arrest based on your observations and her refusals to >> Yes, sir. >> she did not dispel my concern that she was driving under the influence and I tried to explain that to her. However, she kept talking over me. >> Why must I be arrested though? >> I'm I'm trying to explain that to you, but you keep cutting me off. >> like less than 5 minutes away. >> I'm It doesn't matter how far which We've arrested people in their driveway before. >> Well, she was speeding and we believe she may be under the influence. >> I'm going to be honest with you. The attorney attorney's not going to be able to do anything at this point. All right? What's going to happen is she's going to be transported to Palm Beach County Jail where she'll be released after 8 hours from right now. Okay? All she had to do And if she And if she wasn't intoxicated or impaired, all she >> Why do you think she was intoxicated? Because of something you believe? >> Because of >> That That's a belief. That's not true. >> It's because of whatever Officer Flinch saw. He's the DUI officer. He's the one that pulled you guys over. Hi, I'm Sergeant Lafler. What can I do for you? >> Sir, he pulled me over. He accused me of being intoxicated and he could feel smell alcohol or whatever. I have to go to the bathroom really bad and I I was being and I never denied that cuz I was trying to go to the ladies room, okay? >> Okay. >> But when he pulled me over, he accused me. As soon as he accused me, it made me defensive and I was afraid. And I said, "Sir, I got my hands up. I'm touching the wheel. I'm not doing anything." He said, "Come out and walk a straight line." I walked a straight line with no problem. Then he said, "Okay, I need you to do additional things." And then he said, "No, you're not complying. I'm going to arrest you." For what? I don't know. I've never been in trouble. You check my thing. I don't want to die tonight. That's all I told him. I got out. I walked this straight line. Now I'm in handcuffs. >> All right. Well, there's a series of tasks that he has to ask you to perform. >> mind. I had my hands up cuz I was afraid to let him know I have no weapons or anything. >> major things in those tasks is listening to instructions is one of the major points of it. >> I'm trying to understand why I'm being detained. >> Well, you're under arrest now. >> I'm under arrest for what, sir? >> Suspicion of DUI. >> Suspicion of DUI? I don't have any DUI. >> Sir, when I came up she was yelling. He was trying to give her the instructions. She just kept yelling and >> I want to make sure I don't die. I don't get hurt. Please, sir. Please, I will listen to anything he tells me. Mom, I'm not going to run at all. >> Are you done, sir? >> I don't need to >> What what do you want me to do then? >> We're going this way. >> Please don't hurt me. Please. >> Nobody's going to hurt you. >> I'm not I'm complying, ma'am. >> Okay, you're going to go in here. >> Please don't hurt me. I'm complying. >> Turn around. It's better that you put your >> I'm complying. Okay, I'm complying. Please don't hurt me. >> head. >> Please don't hurt me. I'm complying. I'm totally compliant. >> I understand. >> For what it's worth, calling an attorney right now is not going to do anything. She's getting released in 8 hours regardless. An attorney's not getting her out. All right, you do you. You do your thing then. >> I can't believe I'm being arrested. I'm 45 years old being arrested for what? >> Driving under the influence. >> I'm not under the influence. You could Can I get a drug test? Can I get a alcohol test or something? >> You get all that at the >> Do the test. It's not going to say I'm under the influence at all. >> That that will be explained to you down there. Officer Franklin will explain everything to you, okay? >> Brothers and other family members arrived to take the twin sister home. >> When I came out the officer, the driving the DUI officer, was trying to give her instructions and gave her Taylor warnings and kept trying to explain to her, "Listen, if you don't do this, I have to go on what I have." She refused. She was given a Taylor warning and explained basically saying this is in summary we're going to take you on what we have right now if you if you're refusing to do these these tasks to show and she just she wouldn't listen. She just literally just kept screaming and you don't get near me and you don't get near me and I'm afraid and so >> Everything we do is standardized. >> She'll be able to call you when everything set. The first part of it she will be given the breathalyzer which she kept saying she wanted to take. If she wants to take a drug or alcohol she she can do that at her own expense for the blood. >> And you can do it right on the spot. You know. >> We couldn't even get her to do any like basic tasks. Like she wouldn't do anything. The only thing she kept screaming at us was don't hurt me. You're going to kill me like all this stuff and that's where we're at. She didn't want to participate on the test that needed to be done. So you know, it just you can't just go okay, you don't want to do them so drive off. >> You guys have anything else for us? Let us know when you're coming to pick up the car. We didn't want to tow it. Gentlemen, thanks for coming. Take care. >> This suspect was charged with driving under the influence and resisting obstructing. At the jail, she blew two samples on a preliminary breathalyzer test, both of which were consistent with illegally driving under the influence. Court records indicate she ultimately pled guilty to one of the related charges and her driver's license was suspended. >> I think she fooled me. >> [laughter] >> She she totally got me, man. She got me. She she was driving under the influence. It didn't look like she blew very high, but she she blew above the legal limit to you know, get her driver's license suspended. She had me fooled. See, that's why I'm not a police officer. >> [laughter] >> There's lots of reasons why I would never be a police officer just because I don't have the cojones to do what police officers do every single day, but it's because I can be fooled. Like, I I really sympathized with her. Man, she got me. Now I'm angry. Now I'm angry. She really seemed like she was afraid. She But, you know what? Almost overly afraid, like she was trying to distract from something. You know what I mean? But, I mean, those cops' spidey senses were tingling. Their spidey senses were tingling, and they did their job. Good for them. Good for them. She got arrested for DUI and resisting. Dang, man. I can't believe she got me.
