I'm not going I'm not coming in here. >> No, this is it's nasty and it stinks. On November 18th, 2024, police were called about a 4-year-old boy alone in a motel parking lot while his mother rested. Witnesses said he had been outside for about 10 minutes and guided officers to the room. What they found inside was unexpected and left the officers concerned. >> How's it going, guys? Where's this child at? >> He's in room 22. >> How long uh >> Yeah. How long How long was >> forever to wake her up again? >> That's you. >> Yes, she was. >> Come on down there. Come on. Let's go. Wake her up. I wasn't at her for >> Who? Where's [clears throat] the kid at? >> 225. Okay. Ain't >> mine. How long was the kid out here for? >> For about 10 minutes. >> All right. Your kid was gone for 10 minutes and you didn't know. >> No, I didn't. And the door was locked. >> Where's the kid out? >> Here. He's fine. I don't want it roasted. He's >> He's four. >> Your four-year-old was out here running around for 10 minutes and you was in here sleeping. >> He was by the door when I FELL ASLEEP. COME HERE. I'LL SHOW YOU. >> You work? >> He was right by the door. >> Where you work at? >> To Door Dash every day. I pay for this room every day. What time? What time do you go? >> I do it all day long and I take a break. You can come in the room. >> This is disgusting. I'm not going I'm not coming in here. >> No, this is it's nasty and it stinks >> because of >> this is disgusting. >> It's clean every day. >> He's like, "Oh, cuz I just used the bathroom." >> I am. >> My room is clean. I'm >> My room play. >> My room is clean. >> You should have seen my trailer. My trailer was worse than this. My room is cleaned every day. I do work. I work all day. I do the workouts all day long. >> This is disgusting. Are you >> I take the poop. I haven't >> Not just not a poop smell. This >> farted when I walked in the room. >> The room is dirty. >> They just got out of my life. >> But there's probably a reason why. >> CUZ MY TRAILER WAS A MESS. I'm not the reason why this looks like this. I'm not the only person. >> All I hear so far, and I've been here a total of about a minute, is the blame game. >> I'm not the only person that lives in this place. I'm not the only person that lives in the trailer. I'm not going to take care of him. I'm telling you. That's what I just said. >> You're here now, right? Okay. So, he's your responsibility. >> I'm just trying to relax. But she needs the gun because she wants to fight with me all the time. She doesn't like me. That's why she called the cop. >> No, because your son got out and ran around. >> Yeah. She always fighting with me. She wanted to fight with me about my daughter. >> Well, I'm not worried about that today. I'm worried about him. >> I'm sorry. I got him. Please don't comment on me. >> Yes, absolutely. >> I went right to school today. He fell asleep. He got and he got to school. He's possibly autistic, BUT THE DOOR WAS LOCKED and he pulled it open. We can't get a lock until Thursday. Wednesday. >> So then don't you think that you should be up watching him? >> I didn't mean to fall asleep. >> Not twice in a week. >> I'm going to do that. >> Can you not hold his hand and walk to your car at the same time and get it? Are you not capable of that? >> Yes, I am very capable. Well, obviously you just asked me how you were going to do that. >> Who all lives in the room? So, it's just you, your husband, and >> was my daughter, but my daughter kicked out the hospital right now. >> How old is she? >> 17. >> It's striking that a similar situation had happened before. Yet, the mother had not found a practical way to improve the circumstances. >> Oh. >> Oh my god, honey. Oh, Lord. >> You're good. >> You know that me off my head, my feet >> hitting the pinky toe when it work. >> I wasn't shutting it on you. >> I want to put a play. Wait, he got some clothes. >> You're the one that kicked your daughter out the one night. Ladly, the door shut. She was unable to make it back into the room. >> Yes. I didn't kick her out. He shut the door open. >> He's the one that doesn't like her. >> So, you don't even want to be a parent. >> I do want >> That's fine. We'll We'll get somebody watch your kids. >> What's going on with his diaper? Does he need another diaper? >> No, we're just We'll get clothes on them. >> Get some clothes on them. It don't look like it. You got your four-year-old out here running around in the parking lot. Hey. Hey. And you can't you can't even control him. He's out here running around in the parking lot. >> Come here. COME HERE. >> DADDY'S GOING TO WORK, TOO. >> I'm trying. I look behind you. >> Shoes, socks. What are we doing? >> You get shoes and socks on them. >> I don't know what that is. >> Find it. Look. >> My whole life. >> You just your whole life. You'd think you'd want to be better and take care of your kids then. I hate my listen. >> Get shoes on them. Get shoes on them. Get shoes on them. Anybody want to sit in the back of the car? You want to sit back in the POLICE CAR? >> I GOT WHAT'S going on? What's going on? >> We call CPS. CPS [clears throat] has to get involved cuz you can't watch a kid or take care of your kid. >> Yes, I can. >> No, you can't. >> No, you can't. >> Yes, I can. It was an accident. >> If it was an accident, would I mean, it happened last week. >> I left him in the sitting by the door. >> You got to be able to control your kids, and you can't, obviously. >> Yes, I can. >> No, you cannot. >> Yes, I can. He has health problems, too. have a problem. >> Run around in in the field in the parking lot where cars are driving around. >> My thing is WHY DID HE CALL MY HUSBAND WHEN HE GOT OUT? AND MY DAUGHTER, >> you know what day that was, Nick? >> You remember what day that was? >> Did you call Carrie? >> Yeah, >> I called today. >> Who called the other day? >> Johnny Wednesday. >> Yeah. >> Okay. And I know when we left, Charlie told dispatcher radio that she was told what the officers were next time we came out here. I don't know if they long that in there. He was almost to that building over there when we got here. >> I saw here running. >> Yeah. >> Previously, her home had also faced issues with cleanliness and safety. [music] Instead of addressing the lessons from that experience, the mother maintained her untidy habits, saying [music] she was simply overwhelmed. >> Nothing, but I did leave my phone number just in case. >> Kids hipster. >> Honey, I got four babies and none of them. They were very explosive, too. >> How many times? >> But we make sure they >> They got little knocks. Did you find out once? >> I appreciate I'm assuming. >> Everybody around here was like watching where he was going, you know, because um they told us, you know, just call >> how many times, right? >> This has been Today is number eight. And I'm not playing. This started right around the time they put that on. >> You know, I've been stuck here for two years. I've been stuck in this place for 2 years. They're great. They're playing basketball. >> They've Is he working? >> Yeah. All right. Are you down there right now? >> Damn it. Really? >> Yes. So, you're familiar? Yes. >> Yeah. Now, we know Sherry very well. Sherry Showwater. >> I guess it took them about 10 minutes and they yelled at her five times through the window for her to wake up. >> How old are you, ma'am? >> 38. >> 38. You used to live in Bloomingberg. What brought you here? >> She condemned our trailer cuz it was messing us. >> This is on its way. This it stinks and it's disgusting. >> You live here? >> No. She has a daughter, too. She kicked out in the middle of the night. >> All right. How do you care? >> [cough] >> Sherry, where's his dad? >> He's at work right now. >> What? >> Sherry. My god. >> This has been nonstop since you've had your kids back. >> I DON'T HAVE MY DAUGHTER. MY DAUGHTER. >> WHERE'S SHE AT? HOSPITAL. >> She went by the >> because she was sleeping with the Hispanic men around here. >> And my mom said, "I HAVE NO SAY OVER IT." >> You were in charge of her. So, you didn't know as a 17-year-old, she was sleeping with a man. >> No, I didn't. I JUST I TRIED TO GET SHERRY. >> HEY, remember what we just talked about is >> I'm not trying to always. So, where's dad? >> I have to go get into How can he get out when he's in a room that's 250 ft? >> This door does come open. >> But where are you? >> I was right over there. >> They said it took them four times to knock on your door. You know, I work all day long. I told you this morning when you guys know 2:00 in the afternoon. I'M DONE WITH THE EXCUSES. >> I MIGHT I'M TRYING TO CAN I EXPLAIN, PLEASE? >> YOU DOOR DASH DURING THE DAY. >> YOU DON'T NEED TO BE SLEEPING AT 1:00 in the afternoon. >> I need to call the >> I'm just Did you tell him that you're going to jail? >> You're going to jail? >> Would your mom take him? No, she doesn't want that to play. I DON'T WANT TO fight your grandparents that live over on Jameson. >> No, you have to abolate. >> Okay. Well, then he's going into foster care. So, you either give me a name or a family member or I'm putting them into foster care. Like, those are your only options. >> It doesn't work right now. >> Then you I would suggest you call his work. >> You're making the situation SO MUCH WORSE. >> HE'S CRYING. >> I know. So be be a mom and cover. >> I DON'T WANT TO DO IT. >> So what's going to happen tomorrow while your husband's or while your boyfriend's at work? Sherry, do you trust him with Alan without you? >> Okay. So you don't trust him without you. So then what do you suggest we do? We're just going to leave him here and hope that >> Please don't take me. I take him to school. There is no >> Where do you take him to school at? >> Somebody's going to have to take him tomorrow. >> Please don't take him. I said please. Well, I'm not I'm not taking anymore. >> I can't afford to go to jail. >> Sherry Josh, stop. >> Cedric already got orders from his sergeant. >> I'm Ashley Ward from Children's Services. We were called out here because this happened multiple times. >> If I'm here, why are you taking him? >> I'm not taking him. >> We should be. We should be taking them. >> Believe. Hey, I was at work. So, >> come on. >> Give him the boy and then come on. Let's go. >> Just do it. >> Step on out here. It's nasty in there. I'm not going in there. Come Come on. >> Richard. So, listen. He gave you a walk order. If you don't come here right now, we'll arrest you for >> She's coming. She's putting her flip flops on. >> All right. Come on. Let's go. >> WHAT DO we say? Come here. >> I get it. I get it. I know. >> Going to do >> pull your pants up. Let's go. >> I know. >> Over to the car. This way. This way. This way. >> Why are these people going to sit down and stare at me? >> They can sit out here if they want. Going to do in the front. All right. Cuz I don't >> What do you got on you? The phone. That's it. >> My phone has been dreaming. >> The mother was charged with injurement. Under Ohio law, she could face up to [music] 6 months in prison and a $1,000 fine. Additionally, she may be subject to 2 to 5 years of probation along with other penalties. Parents must act responsibly, evaluate [music] risks carefully, seek support when needed, and always put their children's safety and well-being [music] first. an unusual sign on the child's body and immediately the doctors realized they were facing a very serious situation. >> My boyfriend had dropped a piece of fentanyl on the bed and I didn't know if he had gotten it or not. You know, >> on March 24th, 2025, Espanola, New Mexico police received a call reporting that a young child was at risk due to an unsafe environment. The 18-month-old was promptly admitted to the intensive care unit for assessment. Meanwhile, police began investigating the home where the parents provided information about the child's care. >> What's up, Matthew? How are you, bro? I'm >> good. >> Have a seat, brother. Matthew, you got anything on you, bro? >> No. >> Have a seat, Big Duck. I know you're stressed out right now. So, um, my name's Officer Bars with the Smile Police Department. You obviously know I were called, right? >> Yeah. >> So, what happened, brother? >> I don't know, bro. The >> talk to me. said that something that he that he might have uh swall from the friend, but she wasn't sure. >> The mother. Where's mom at now? >> She left in the car. >> She took off in the car? >> Mhm. >> What's mom's name? >> Uh Caitlyn. >> Caitlyn? What? And where is mom staying at? >> On the streets, bro. >> What car is she in right now? >> Nissan Ultima. >> What color? >> Blue. >> Blue Nissan Ultima. Where would you be going from here? >> I have no idea, sir. I have no idea. >> Do you have a an ID on you? >> I don't. I don't, sir. You recognize me? No. >> Okay. All right, bro. So, from >> Yeah. So, from beginning to end, tell me what happened. I know I know you're stressing out right now, brother, but I got I got a job to do right now. Okay. >> Yeah. The mother came and said that uh >> that he was that he was playing over there with the other kid and uh that her friend started freaking out about I don't know what the So she got all scared and brought him and I was watching him. I gave him some milk and stuff and he started to like fall asleep, bro. So I panicked and I just want to make sure he's okay, bro. >> So your baby's okay right now. He's responsive. Okay. They they narcanned him and he's he's okay. I got to get to the bottom of the story. Where were they at? >> I have no ideas. >> So how did you how if you didn't know where they at? How did you come into contact with your with your baby again? Did >> you buy the house? >> Where's your house at? Uh the trucks trailer park. >> Which [snorts] house is it, bro? Which number would she be back over there now? >> Possibly. >> One 7s meal. >> She doesn't have keys or anything. >> Hey, if you can send one of the units over to Cook's Mobile Home Park, check and see if that vehicle [snorts] is located at uh what was the house number on house. So basically, bro, she your girlfriend or whatever. Mom, the baby's mom had the baby. They were hanging out somewhere. You don't know where. They were playing. They were playing and then somehow this kiddo got a hold of what a blue or what? >> I have no idea. So I I started ying at her and freaking out on there, bro. >> So when she brought him to you, what did she tell you? >> She just said that she was worried. >> Tell You got to be a little bit more specific with me, bro. I got to find out that he was worried that she thought that her friend thought he might have took something. >> And what what was her reasoning to that? I didn't ask that. >> And so then she drove you up here with the baby or what? >> Yeah. >> And then took off as soon as you guys got in here. >> I didn't even know she left. I was the one that drove. >> Does your girlfriend >> I saw the keys right here, too. I didn't know left in it. >> Does your girlfriend or or wife um is she known to use blues? >> Yeah, but she was supposed to be clean. >> Do you use blues, too, or no? >> She was supposed to be clean, though. Do you use any other sort of products there, bro? >> Just uh strips, bro. >> Suboxins. >> Yeah. >> So, I see I see your uh your work, right? So, you're you're a west loco. What do you go by on the streets, brother? Cuz I'll refer to you that just out of respect. You know what I mean? [clears throat] >> He's okay, bro. He's >> They're treating him right now. When I came in, he was screaming and crying. Okay. So, that's a good thing. That's a good thing cuz what happens with fentanyl bros they stop breathing and then they have a heart attack and they that's that's how the overes happen. Okay. So you did the right thing bringing them in what was your first what was your first and last name again? >> Matthew >> one I got one for you by name and date of birth when you're clear. Name date of birth when you're clear. >> Here's the thing. I got a couple questions bro. >> So so your your chick is she homeless and not with you? You guys together? You guys like working on it or >> it's like off and on, bro? >> Off and on. So here and there >> because so she's living in she's living homeless and then how's the how's the child custody go bro? How does that work? >> She h she has custody. >> She has custody of him. >> She has Yeah. >> And what was her first and last name again? >> Kayen >> one 7s. I've got another one for you by name. >> Yeah. I can't keep >> approximate age when you get a chance. >> She's the one that has custody. >> So she has legal custody over month. Are there is there documents docu uh court documents legal documents with that? >> Yeah. The investigation gradually focused on the child's mother who was using a vehicle with unverified ownership. >> What's his is Well, obviously he might have asked you. So, is he have you have custody or you >> So, we have like joint custody with uh >> Yeah. >> Go ahead. Go ahead. So, is it like a 50/50 or what? Or >> Yeah. And then my mom >> Blue Ultima shows up, call us out there right away. >> Real quick, I need you to run one more. What was your mom's name, bro? >> Marie. It'll be Marie. How old's your mom? >> Uh, I have no idea. >> Give me a guess. >> I'm going to say, let's see. >> Does she live here? >> 52. >> Around 52. Does she live here in town? >> She lives in Cordova. >> She lives in. And she'll be out of Cordova. Um, run her and attach her to the call. And when you do the reverse search, the vehicle that the mom took off in from here belongs to this woman. And if you can bol out that 28 and just advise >> serious >> he's gonna panic. He's gonna panic. I'm telling you. >> Hey, so for for for your for your baby's mom, that vehicle, is it a key fob or is it a key? >> It's a key fob. >> Okay. So, she can only get so far cuz you have the key fob with you, right? So, she's going to have to come back or wherever she shuts the car off, she's screwed. >> Yeah. >> Okay. Ma'am, um, who has custody? Cuz the understanding is is he has full custody. >> Him and mom have custody. >> Okay. Him and mom have custody. They they split it. >> Yep. >> Okay. >> And like I told you, I go with me on the weekends because I pick him up every weekend to spend time with >> my my big question is mom is or grandma does she do you guys have a way of contacting her, calling her? >> Yes. Can we do that so we can get we need to get her here >> or >> there's a baby overdosing in the next room and we need to verify the stories because somebody's going to end up having to go to jail. >> Let me call her. Let's see if she can make it here. >> Um, give me one second. Let me talk to my sergeant cuz if she sees the police cars outside, she might [snorts] refuse to come. So, give me one minute. Okay. >> Given the concerning signs, it became clear that the father could also face legal responsibility. >> All right, brother. So, just for the time being, I'm going to cuff you from the front. Okay. You are being detained right now. Okay. Somebody, we've got to figure this thing out. Turn your wrist like this for me. Like that. Yeah. Let me double lock those for you so they don't push up on you. >> Oops. I'm not cuffing you from the back, bro, because I know you're stressed out right now. >> Can I get some more water, please, bro? >> Yeah. Yeah. I'll grab you some water. Um, this the thing, bro. Nothing matters right now that baby. Okay. Nothing that matters right now that baby. The baby's the only thing that matters. Okay. Yes, sir. >> There's an 18 year old 18month old baby in there that's fighting for their life, basically. You know what I'm saying? >> Yes, sir. >> It's one of those things, bro. You got This is why you It's not worth the risk, Doug. And And those that fentanyl, bro, is something else. You know, I I know you don't know what it was, but you know, lately in law enforcement, bro, when we have drugs, it on babies, it's they >> they eat the they eat the blues thinking it's a candy and >> that's it, bro. you know. Yeah. >> So, you want me to take you >> and see what the story is. >> So, we're going to go up to we're going to go up to the jail. >> If his story checks out and she says, "Yeah, you know, whatever." Well, then we know where to go from there. >> Go ahead. Go into this one here, brother. Right here. And I'll have them come take off those cuffs here in just a second. Okay. >> Outside, the mother shared details about caring for her two children, noting that she had observed unusual signs on the younger child. >> I'm going to read you something real quick. Okay. You have the right to remain silent. Anything you say can and will be used against you in the court of law. You have the right to talk to a lawyer and have him or her present with you while you're being questioned. If you cannot afford to hire a lawyer, one will be appointed to represent you before any questioning if you wish. You can decide at any time to exercise these rights and not answer my questions or make any statements. Do you understand your rights if I explain them to you? >> Yes, sir. I understand. >> Having these rights in mind, are you willing to answer my questions? >> Yes, sir. >> Okay. So, look, >> quick question before you start. Are you going to question her out here in there? >> Out here. Let her have a smoke. Do you want one of these guys to pick up the warrant arrest? You have to do an additional report. >> No, that's fine. >> Just going to add it to the report. They're going to sub it then just on the stop. >> Cool. >> And you can take care. >> Sure. >> Hey, I'm going to do your sky report now. >> Thank you, sir. >> Okay. So, >> I I'll talk to you. Okay. So, let's just start with this, okay? From beginning to end, tell me your perspective. What happened, where the baby was, where you were, like what what's the deal with all this tonight? >> I had my six-month-old with a little backpack on my chest and I was cleaning the >> Where's the sixmonth old at now? with my mom at the hospital. >> Okay. Okay. So, so this is the baby that >> No, no, >> no. This is the other baby. >> Yeah, this is my other son. Okay. >> So, I had my other son in a little backpack. >> Same dad or no? >> Yeah, same dad. >> And um I was cleaning the stove and uh >> Matt, big Matt, not little Matt, not my son, was like, "Hey, dude. Is he throwing up or what?" He was on the floor and he was crawling and I was like, "No, what is wrong with you, dude? Like, he's not throwing up." Cuz we were already like kind of arguing. And then I was like, "Why, dude?" Like, so I went and I picked up my older son and he's all because like I just found this and it's wet. And I was like, "Well, why the was it on the bed, dude? Like be more careful with >> And this and this is about this is about the baby that the 18-month-old >> that was throwing up." >> Yeah. Well, he but he wasn't throwing up. So, I picked up my son. I checked on him. I went and washed his hands. I brushed his teeth. And then I was like, "Okay, well, he seems all right." You know? So, I put him in I think this was at like 8 8:30. He's usually in bed by 9:30. So, I put him in a bath cuz our regular routine like every day, you know, before bed, he was fine the whole time in the bath. And then when I got him out and I was putting lotion on him and putting him in his pajamas, I noticed that his lips were like kind of discolored, rubbing his nose and starting to get tired. And I told him, "Dude, I'm not I mean, like not going to let nothing happen to the baby, dude. You need to take him to the hospital. Dude, we can't just sit here and wait for something to happen to him." >> And why did you want to take him to the hospital? Just because he was throwing up or >> No. Well, because like he thought my boyfriend had dropped a piece of fentanyl on the bed. And I didn't know if he had gotten it or not, you know. And I told him like it's not about us. I don't care if I have warrants. Like I don't care if you don't want to go to jail. Like we need to take him to the hospital. So we took him and from there me and my six-month-old went home and then my mother-in-law wanted to just let him here. >> Okay. >> But when I took them, like my 18-month-old was still like awake and responding and was still okay. I just wanted him to take him just to make sure that he was going to be okay so that there wasn't >> So at any point did you leave the house with your babies? >> No. >> And this is the house down at Cooks. >> Yeah. I didn't leave the house at any point until I took them to the hospital. >> Okay. So you didn't go with a friend today? >> No. I haven't gone anywhere today. I've been home. >> My other question is why did you leave the hospital when your baby was? >> I didn't know if he wasing or not cuz I had my six month. >> Well, here's the thing. You just told me that your husband said that he thought he left a piece of fentanyl on the on the on the bed. So you thought he was over, right? >> Yeah. I had my 6-month-old with me and he was still like him crying and like I was just going to go and get him and his I knew his mom was going, >> you know. >> Okay. And so at that no point you let you did not leave the house at all the day. There was no friend that came and picked you up. No. >> And you stay there at the the the home and cooks. >> Yes. >> Okay. She described the father's lifestyle, emphasizing that she herself tried to maintain a tidy and organized environment, yet allowing the children to be in a potentially unsafe setting contradicted that effort. >> Did you ever see a a piece of fentanyl on the bed? Did you see anything like that? >> I was cleaning the stove, like I said, like before Matt had gotten on the bed with them. Um, it was clean. It was fine. I had just had my baby, my six-month-old on there with all his little toys. Like, >> and do you or Matt use? >> I am like, so I went to jail for 30 days and I got clean and like I don't like fully fully use like I like obviously relapsed a couple of times, but I still like do myself often, but yes, I relapse. >> Okay. So, you're you're so you're using Blues again? >> Uh like not all the time, >> but you use Okay. How often do you say you would use? >> Um >> how often? All day, every day. But he's like going to go get clean. He um has um an appointment on the 31st to uh go to a treatment in Rio Rancho. >> Like another one, >> please. >> Yeah. >> Don't pop it. Don't pop. >> You want to pop it? Okay. >> Thank you. >> Yeah. So, inside of your house, is are there any inside of there right now? >> No, there's not. Like, um obviously he does use it, but I'm like usually pretty good about keeping everything clean and picked up. Where do you guys use that when you do use >> um I smoke outside at the back door and like when he does he either smokes outside in the back door or in the car or in the back bathroom, but never around our kids and like they have their room like I mean there's dishes in the sink but the house is not trashed or anything. >> So he uses all day all the time and the babies are with you guys. >> Um well he's not ever really like always around us. He's usually like doing his own thing and I take care of our kids like and he >> but in the house. He's doing his own thing in the house. No. >> No. And I'm not saying he uses all day long. >> Well, I mean you told me he uses pretty much all day. Just a little like a few seconds ago to like to sustain himself. I'm not saying that he sits there and gets high and does like hundreds of moves all day, but yes, he has to do it. >> And how often do you say you use? >> Um like once or twice a day. >> And you guys have the babies from Monday through Friday. Is that is that correct? >> Monday through Thursday. >> Monday through Thursday. And then who? And then grandma takes the babies from there. And does grandma use it all? >> No, she looks at the lab. She's a good She's a good support. >> Okay. >> When we had our 18-month-old, we had a case that was CRA that had openly only stayed open 45 days. And >> what was that for? >> For uh exposure for him, obviously, and I was using at the time. >> So exposure, the baby getting exposed. You're 18month-old. So this isn't the first time this has happened. No, not when he was born, like from me having him like cuz I was the one that was pregnant. >> Okay. Okay. So, at the hospital? >> Yes. Okay. >> With my 6-month-old, like I was able to get and there was never any CIP case open or anything like that. But the one with my 18-month-old had closed within 45 days and we've had custody of him since. Like, okay. And I mean like >> statements from both parents contain contradictions reflecting the stress and anxiety they experienced while navigating legal questions and caring for their child. >> And so this is my thing. So your your husband's story isn't lining up with your story. And I and my job here my job here is to get to the bottom of and find what's actually going on. So from my understanding is earlier today your husband was playing the PS5 and you went with a friend, right? And then you came back the your friend was telling you that she was worried that your son was playing with another kiddo with her kiddo and she was concerned that the baby had found something at her place and the baby had over. >> So there's some hesitation there. So you're obviously thinking about something. >> Well, I'm just I don't want him to be mad at me, dude. Like I >> Well, I mean, here's the thing. >> And I don't care. I know you don't care about this. This is what I'm telling you. >> I only care about myself. That's why I'm telling you. That's why I'm >> Well, I'm trying to figure out why you hesitated and looked around to think about what you were going to respond. >> I don't want him to hate me and think I ruined my family. >> This is This is what I'm going to tell you. You're going to have to >> Do you have any evidence to support what you're saying right now? Because right now the baby is all that matters. >> I know. I honestly, dude, I have just you taking my word, but like I hadn't left anywhere all day, dude. Like I know it's a long shot, dude. And I don't know if you guys are willing to do all the work, but dude, there's plenty of businesses across the street from our house. You could go look at their cameras. I know for a fact my neighbor that owns that shop across the street has a camera that faces towards our house and his cameras face towards my house. And you'll never see me leave house. Like I'm not trying to lie to you about anything. I just wanted to make sure my son >> So let me recap. You were around what time did this happen initially? >> I think at like 8:00 >> and dad was in the bedroom with the babies. >> No, he was out. He was Okay. So, in our living room, there's like a bed on the floor cuz right now we're redoing our back bedroom and our bed our bedroom is like not clean. We're in the middle of getting everything picked up and it's just not a place where I want my kids cuz there's no room on the bed or anything. There's clothes everywhere. >> And do you guys use in that bedroom? >> No, we don't. There's no familiar or anything like that in there. It's just there's clothes all over. >> Okay. So, he was in the living room. >> Yeah. And then Okay. So, when you walk into our house, like to the right is the living room and then there's our couches and then we have a little bed on the floor and then to the left is the kitchen and the dining room and then there's another room right there and that's my kids' room. They have their beds in there. >> Okay. >> So, I sleep in the living room and I put my boys to sleep in their room cuz I'm able to see inside the room like where they're at when they sleep. >> And so, your your husband was in the living room on that bed or what? >> Yes, >> with the kiddos. >> Yes. >> Not with the kiddos. I had my six-month-old on my chest in the living room. >> And where was the 18-month-old? the 18-month-old was playing on the floor and like on the side of the bed by his dad. >> Okay. And so you're doing the stove and then what happened? >> Like I said, he uh was like, "Hey, is Matt throwing up?" And I was like, "No, dude." And I went and picked him up. I was like, "Why, dude?" Like, "What the's wrong with you?" He was like, "Um, because I think he might have got something." Like, and I was well, dude. >> And did he indicate what that something was? >> No. >> Cuz when you first told me, you said it was a piece of a blue. >> No, I said it was fennel. >> Okay. So it was a piece of >> So fentanyl powder. Uh, I don't. Yeah. >> So, like China White. >> Mhm. >> And you guys just keep Does your husband keep that in baggies or what? >> I'm sure he does. I mean, I don't pay attention to what he does with this. You know what I mean? But like he usually has it in a bag and has it put away in a box so that it's out of reach. Where's that box at? Outside underneath the steps or in his car? >> Okay. And so he's So your Did your husband indicate that he thought that he got a hold of the fentanyl powder? He wasn't sure if he did or not, but like I said, I went >> Did you see any Did you see any white residue on on the baby? >> I didn't see any white. >> Did he see any white residue on the baby? >> He didn't tell me he did, like I said. And then after he had said that and I picked up my son and went and washed his hands and I brushed his teeth and I put him in the bath to get him ready for bed. I had looked on the bed and I didn't see anything or anything like that. Like >> Okay. And so did dad ever [clears throat] give him like milk or water or anything like that? >> He drank two like little cups of milk cuz his cup's about that big cuz he's starting to drink out of a cup. And so the baby was throwing up. No, he didn't. >> Oh, but you guys thought he was. >> Yeah, he had thought he wasn't. He asked me if he was and I told him that he wasn't. >> Okay. And so then dad gave the baby some milk. Two bottles. >> No, he didn't give him milk. I don't know why he thought he was throwing up. I was cleaning the stove and he asked me if he threw up. Okay. So I told him no. Like I didn't see him throwing up. I went and picked him up. I checked on him and he was like, "Well, I think he might have gotten something. I don't know if he did or not." >> So I'm just trying to clarify this cuz dad said that he had gave him some fluid. What fluid did he give? gave him milk when he was in the bath, but before that was after he had thought he fall. >> And so so then he puts him in the bath. >> I put him in the bath. >> Okay. And so he gets him >> and I started getting him ready for bed cuz he didn't it didn't seem like there was anything wrong with him. >> While it remained uncertain whether the child had been exposed to unsafe substances, other issues within the family dynamic began to surface. >> Dad said that while he was giving the baby milk that he was talking to the baby and the baby started falling asleep, which is outside of the norm. So, is your b is your baby normally pretty pretty hyper? >> Yeah, but like he's on a really good schedule, so like he's in bed every night. >> So, did you see that? Did you see the baby falling asleep? >> No. Can I finish telling you? So, it'll try to make sense to you really. >> Go ahead. Go ahead. Go ahead. >> After I had picked him up and checked on him, it didn't seem like there was anything wrong to him. And like from previous people I've seen before, like I would think if an infant was going to get something like that, he would have like fallen out or whatever red weight, you know? So, I didn't think there was anything wrong with him. And that's why I got him in the bath and started getting him ready for bed. And then he probably stayed in the bath for about like 45 minutes, which is like the norm time that he does. I said he goes to bed at 9:30. And when I got him out of the bath and I started putting lotion on him, like I told you, I started noticing like a little bit that he was rubbing his nose. His lips look like a little discolored. >> This color doesn't like was it changing blue, purple, just white? >> No, just like a little white and just not the regular color that they usually are. >> And so the and the nose that's like a typical thing when people do opioids, right? Yeah. And so like from dad saying that he think he got something. I didn't want anything to happen to my son and my son is or anything. So I told him you need to take him to the hospital with you like just to make sure that he's okay so nothing happens to him. >> So then he rushed him to the hospital, dropped dad and baby off and then >> and then I went back in >> and then obviously now we're here with all this other stuff. >> Okay. Okay. Well, I think that's all the questions I have for you right now. And then >> I mean I don't want my husband to hate me and I know he's I know. Can you just hear me out please? Like I know like I know you don't give a about us and you probably think we're pieces of >> That's not what I'm saying. But what what I am saying is my my concern is the baby. >> I know. And I I know he and somebody will be held accountable for I'm just trying to get you to understand where he's coming from and because he's been in prison before and I don't want my family to end because I told you the truth. I know obviously you're going to go back and tell me, hey, this is what was said and just I just want you to tell him that like >> Well, right now you got to be worried about the baby and the baby only. And that's got to be your only concern. But I care about him. Him and his mom and my kids are all I have. I don't have my parents or any family. Dude, like >> I understand that. I I get it. You're in a you're in a tight spot. But you know, if you're being honest with me, I appreciate the honesty and and at the end of the day, the baby is what matters. Period. Period. Okay. And you have two babies riding on this, not just >> I know. And like honestly, like that's why like in my eyes like I wanted him to take him because I didn't want anything to happen to my son. And then at the same time, I still wanted to be able to be there for my kids too, dude. Like >> Yep. So, I'll have to talk to dad, but we'll figure it out as it goes. Okay. >> And I know I'm obviously doing jokes on my arms, but like what else is like happening or >> I'll let you know that as it as it transpires. Okay. >> Both the father and mother was charged with firstdegree child resulting in great bodily and thirdderee child. They were booked into the Rio Aribba County detention center. Under New Mexico law, they could face up to 21 years in prison. This case highlights the importance of close supervision while also showing the challenge of balancing personal responsibility, legal obligations, and family care. This man was not directly facing legal responsibility, but the way he handled certain information raised concern among others. >> Uh, if you take that phone, >> the phone is ceased. We're going to get a search report if that's the way you want to do it. >> He's going to turn it off. >> On March 27th, 2024, police were dispatched to a family following a report of a dispute during a divorce. At the scene, officers recorded conflicting accounts from both the father and mother of the children. >> You say who the complainant's name was. >> Come in. Please come in. >> Please come in. Dog's not going to hurt you. >> I'm not worried about the dog. I'm just >> What's going on? >> He's upstairs sitting there texting, lying, doing the usual [ __ ] that I've had to deal with. Pulled all the body. I don't want you. Don't face me. Don't record me. >> You know that's our policy. >> I have to record. turn away from me because I'm done with y'all. I'm a nurse. I'm about to lose my license because that [ __ ] He's upstairs with his daughter and they have >> cuz he already moved out. >> He moved out. He moved back. I found out somebody else now. He moved back in. Now I have evidence he's been his ex. I want him out of the house >> and he won't even get out of the room. >> Does he live here? >> He does live here unfortunately, but he won't even get out of the room. He's doing everything he can to antagonize me to try to elicit a response and I just want him away from me. Be like, "Don, this is was a long time coming when he had me arrested a year ago and you pulled me in and his buddy pulled me in despite the fact that I was RN and now that my RN at out of risk because I had a couple of cocktails I made >> talk to you outside. >> Yes, please. >> Oh, look at that poor little scratch on my husband's twice my size. Poor baby. >> No, I'm not going to press charges. But >> I'm I'm not going to I'm not going to >> No, I'm not I'm not going to do anything. What? What? We We What? What's going on? >> Oh, she's just lost it. She's telling me to get out of my house and I'm like, "No, it's my house, too. I don't have to leave. I'm just here to keep the peace. I'm just trying to figure out what's going on." >> Yeah, that's that's what I know about peace officers. >> It's so peaceful doing because she doesn't. We're in a bad place. I admit. Okay. I've already called my paper before going back in. We should have been divorced in January, but she fought it. I managed to get thrown out. Long story short, we're going back through this and I'm excited about it because this kind of just is not going to work for me. >> And again, I'm not pressing charges, so I don't >> And you know how that goes. >> I'm not doing anything. So, she's not going to be taking that. That's not happening. >> Okay. Cuz I didn't report this. >> It It doesn't matter. We ended up >> No, I know it's not being in that case. >> I'm not doing this. Look, bottom line is she is losing her temper. I can go to my parents house, but what I told her is I don't inconvenience my daughter who has school tomorrow. It puts her in a bad situation and you stay away from me and away from her. >> Do you mind if I talk to her? >> Yeah, that's fine. >> You need EMS? Should we call bus? The mother was hesitant to cooperate due to past experiences with law enforcement. While the father frequently referenced personal relationships to explain his actions. >> So I was like I heard them arguing. So I stepped out of my room cuz I was across the hall. And I like the only thing I saw was I saw her like walk around the bed and she had like a Stanley cup in her hand. You can see like the marks on the floor from when she was like where the water went everywhere and she was just like hitting him with it and then she started like clawing at him. >> She had like >> No, I didn't. That's Daisy. >> Daisy. >> Ellie. I You are >> Shut up. >> Let's not do the back and forth. >> I I don't want to. >> So, let's not. >> It's called Get Out. >> Dad was like, "She lives here, too." I was like, "I live here, too. I need my stuff." She like charged at him and I have it on my phone. >> I'm looking forward to not only getting a divorce, but suing you on top of the damages that you've done to my children and your own child. And because of it, you're going to lose custody. >> Ma'am, the back and forth. Let's not do that. Let's just save it for >> You know what? I don't want to save it for because you know what? between you and your buddies, him and his other buddy, which I'm grateful has been termed since then. He had no reason to put me in cuffs. I'm losing my RN license. And all I did ringing that mother. >> I I didn't want I'm not the one that put you all. >> I'm not the one that put you in cuffs. >> Doesn't matter. I had on my hands for weeks and I'm losing my damn license. And I'm loss because of that. >> But going back and forth is not going to solve the situation either. So >> just get THEM OUT OF HERE. >> YELLING AT ME IS NOT GOING TO SOLVE THE SITUATION. >> PLEASE. I'M NOT MAD AT YOU. IT'S NOT YOUR FAULT. PLEASE KINDLY UNDERSTAND. My frustration is not with you. It's with him. AND NO ONE'S SOLVING THE PROBLEM. >> Double up. >> Double up. >> Okay. I'm sorry. >> Come on. >> What? What? What? No. What? For what? For what? >> Ma'am, chill out. >> For what? No, you're not putting ME IN CUFFS FOR ANY REASON WITHOUT A WITHOUT A REASON. I WANT a reason. Why are you putting me in c Why are you putting me in cuffs? YOU'RE THEY'RE PUTTING ME IN CUFFS. YOU ARE NOT. >> YES, THEY ARE. BUT YOU'VE GOT ME PUT IN CUFFS. YOU PRICK. YOU PRICK. >> I'm not arrest. >> GET AWAY FROM ME. GET AWAY FROM ME. >> Get out of here. >> I'm right here. >> I'm not. Just get away from me. [laughter] Oh my god. HOW MANY TIMES HAVE I CALLED FOR A SOUL AND NOBODY'S PUT HIM IN? >> Please don't do it. Don't do it. I'm not already explain it. I'm not >> I'm not telling you to leave. I'm telling you come outside. >> I'm not I don't want this. >> You got to come outside. >> I'm not going to do I will not come outside until it's I'm in my house and I will not come outside until you stop this. >> I will leave. LISTEN, OFFICERS. >> I'M NOT LEAVING my house. >> We're not telling you leave. >> I'm not. But what I'm telling you is I will leave her here. I will go to my parents if y'all will leave now. She called. No, I'm not doing this again. Okay. I'll call the mayor who's a good buddy of mine. >> That's fine, sir. Go ahead and call the mayor. You don't understand domestic is it's not in your hands. >> That's fine. I'm not doing domestic. I DIDN'T CALL. >> DOESN'T MATTER WHO LIED THE FIRST TIME AND HE LIED THE FIRST TIME. >> WE'RE NOT DOING THAT. >> I'M NOT doing this. I'm not pressing charges. I will not do anything >> at this point. It's not up TO YOU, SIR. >> NO, THERE WAS NOTHING. OKAY. >> I DIDN'T DO ANYTHING. >> NO. And let us let us handle this. >> Okay. No. No. >> You're not arresting me. >> No, you're not arresting her. Then both of y'all going to go to jail. >> No. >> That's right. If you're if you're going to arrest both of us, GOING TO ARREST YOU. >> I'M NOT OBSTRUCTING JUSTICE, SIR. Unless she did something to you, I'm not saying she did anything. I We're getting a divorce, okay? She doesn't deserve this, and I'm not doing this. I provoked her today. I should be have. >> Okay, I understand you're saying that. >> Okay, so just leave it alone. >> But here's the problem. >> No, state law says that we cannot >> I know what the state law says. I went through this before, >> okay? >> And I'll call the cab county and I'll call the mayor and I'll I'll I'll raise a real stink cuz I can. Not because I care about this, but because I just want this over. If you will just walk away. >> But there there is video evidence of of >> No. He didn't see any any video evidence. There's no video evidence. I didn't show him one thing. If he said that, you're >> No. No. Go ahead. No. No. I No. That could be from the dog. You don't know, >> sir. At this point, it's it's out of your hand. >> No, it's not. So, >> this is a domestic situation. >> I'll make it ugly. >> It's a domestic situation. >> Call my dad and then he'll call. He'll call. Don't worry. We got plenty of ties. I got ties all the way up to C. >> That's fine, sir. Tucker precinct named after my great-grandfather. >> That's fine, sir. >> The parents statements became increasingly inconsistent. Fortunately, their daughter had recorded key moments capturing tense interactions and gestures. >> There we go. >> No, stop that video right now. Give me that phone. I own that phone. Do not do it, >> guys. I'm not dealing with it anymore. I'm not even >> She is >> Okay. I don't want to deal with this. >> I don't want to deal with her. >> Okay. Officer, you just coerced my daughter. I told you. >> No, he didn't. I'll do it. No, I will gladly say that I gave him the phone. >> No, no, you coerced him. >> No, he didn't. No, he didn't. >> I'll tell my mom. >> How old are you, man? >> I'm 13. >> Look, we can either do this the easy way or the hard way. I'll leave and that's fine and y'all can leave with it and she can send her crazy ass here and that's fine and everything goes away. We'll be divorced and she'll eventually be out of this house and everything will go away and y'all will never be called to this house again cuz I won't have a reason to [ __ ] and I'd like to get along with y'all since I'm going to live here. >> You do understand that what she did is battery. >> Okay. >> Any charges and this was the dog. I mean you can see the claw marks >> sir. It's domestic battery. >> I know. >> Yeah. be your word against mine, but that coercion you just did to my daughter. >> That's not >> Well, yes, it is. >> And it's on video. >> Yeah, it certainly is, sir. You You have four different body cams. >> I know. >> So, yes, it is on video. >> I know. And so, you'll see that you just took her phone from her hand and told her to show you the video. >> No, I didn't. >> Yes, you did. I stood right here. >> Okay. >> Okay. So, like I said, let's just let this go amicably be done. I'll go home. She can stay here. >> Sir, it does not It does not work that way when it comes to domestic. Understand? >> I antagonized her. >> Can I go to the restroom at the top of the stairs, please? >> When I'm done with this call, I wet my pants. So, I'm going to sit here in my own I'm sitting here in my own piss because of my own stress. Jean, thank you very much. Hey, I've got a bunch of cops in my house because I called on my soon to be ex-husband and they are insisting that on picking me up on battery. Can you please help? I'm in a ball in my corner in my kitchen. I used to be a commissioner in Aenddale for 4 years. I know how all that works. Okay. I know all all of it. All I know who funs it. I know how it works. >> So then you understand that the domestic you have no say in >> uh No, that's not the case. >> Yes, it is, sir. >> No, it's not. >> No, it's not. >> Frustrated with the explanations, police decided to temporarily detain the mother, which added to her stress and anxiety. This was reflected in her expressions and words, showing concern over custody and work responsibilities. And then there's video because we were we were arguing, but I'm not I wasn't showing any of my video. Nobody wants to see any of that cuz I'm not trying to get my soon to be ex-husband arrested. So, it's either me and him or can you please help? I'm just being honest. Do you have nothing better to do? >> Will you please >> I'm asking, do you all have nothing better TO DO? >> NO. NO. NO. NO. NO. >> I'M JUST KISSING MYSELF. GOD'S SAKE. >> GET OFF ME. GET OFF ME. GET OFF ME. NO, I'M WETTING MY PANTS. I'M WETTING MY PANTS. >> HEY. NO, YOU JUST TOUCHED ME. YOU touched me. DON'T. >> YES, I DID. >> I'M WETTING MY HAND. I DID. NO, YOU TOUCHED ME. I DID. >> I JUST asked you to step back. >> Relax your hands. >> What do you want? I don't >> Why do I need >> Relax your hands and put >> anybody you are anyone? And I'm NOT GOING ANYWHERE. >> CHRIST ALMIGHTY. THANK YOU. THIS IS YOU. >> YOU CALLED THEM. >> I DID THIS. >> YOU CALLED THEM. >> I DID THIS. YOU CALLED THEM. >> CHRISTY, >> GUYS, come on. >> And they've never ARRESTED YOU. AND ANYTIME THAT YOU WHY AM I STANDING UP? >> Did you go into the back of the car? >> Oh my god. My pants are wet. >> Listen, guys. No, I'm I'm No, sir. You're not. >> It's my home. You are on my property. You are on my property. No, you are on my property. No, >> she's in custody. >> I'm in my house. >> You going to move out the way or you going to go to jail, too? Point blank. She's going to jail, too. >> We're not doing this. SHE'S GOING TO JAIL. >> WHY THE WOULD I NEED TO GO TO JAIL? DO you understand? I'm going to lose my license as a nurse and my children are ALREADY GONE BECAUSE OF HIS LIES. >> OH, SO NOW YOU'RE GOING to obstruct justice on me. >> You're obstructing. [screaming] >> I didn't do anything. >> Do you think >> I didn't do myself? Can I please her pants? My god. >> I want to make sure and videotape it all. Yes, sir. Please. >> I'm going to jail BECAUSE OF YOU. PLEASE CHANGE MY PANTS. THIS IS, BY THE WAY, this is a false arrest. What's your number, sir? Ma'am, >> I got my purse. >> How do I get that? >> Officer Branch. >> Yes, sir. >> Jonathan Elmore know. >> Okay. >> Why do you need to take me in? >> Why? >> It is domestic battery. >> I didn't do anything. Would you like to see his >> leave? Where's your purse? >> It's in the house. Would you like to see his battery so you can cuff his too? Would you like to? >> Please. Please. >> It's in the house. >> Okay. And the son of a has had me locked up. This is now the second time it I have urine down half of my pants because of the stress. >> Where's your purse and some of your a pair of shoes? >> I don't I don't know. But you're obviously not going to let me back in the house if my hands are >> We'll get you a pair of shoes and your purse. Okay. >> We'll get your shoes. We'll get your purse. We'll get all that. >> You have nothing else to do but put me in a goddamn car. You have nothing else to do. >> Really? >> In the vehicle? >> No. I want to stay outside at the very least. I'm I'm Yes. I don't want to sit down. Please. I'm not even trying to be disrespectful. I just don't want to sit. I'm not >> saying you are. Okay. [panting] >> The other [snorts] officer gets your shoes. >> Why don't you want to see his evidence? Why don't you want to see my phone? >> What do you have on your phone? >> Him doing screaming at me, arguing at me, text from last night of himing me. It's on and on and on and on. He has plenty of places to go. I have no want. I'm just trying to move back to New York after we're divorced. But I don't have any family here and I don't have anywhere else to go and I'm but he's got plenty of options and he's doing it he's again he's doing it to just be to antagonize me and I don't understand why. I don't understand why I'm ins. I've called at least three times. >> Think you'd either put on the shoes or you need to get in the car. There's only two options. >> Am I I'm not getting asked. You're going to take me You're going to take me down. You're going to take me downtown to You're going to book me, aren't you? No matter what I do, no matter what he says, no matter what I say, you're going to book me, right? >> You're under arrest. I'm not I can't be any clearer than that. >> I would appreciate if I can at least change my pants since I pissed myself and I've asked multiple times to change my pants because of the stress. >> We're in a public. >> Understood. I don't care if I do it over there next to the bush. I just don't want to be in wet pants anymore after the stress of the of my husband. But none of y'all care about any of that. You're not going to hook. You're not going to cuff him. >> If you want to deal with the pants situation, you have got to calm down. >> What else would you like them to do? All right. >> I'm trying to be as calm as we're not going to take you back. That's fine. >> Okay. We don't I don't want to do it out here. >> I don't care. I just don't want to be soaked in urine anymore. >> So, ma'am, can you just put on the shoes? You going to get you back in the car. We're going to take you to PD. You can change your pants there. >> We can do it there. >> But you're not going back inside house. So, if you can, can you put your shoes on at least? We won't mess up your feet. You get back in the car. We'll take you to PD to switch your pants. Okay. >> Thank you. Watch your legs. Even after the mother was restrained, the father intensified the situation by taking his daughter's phone to prevent access to information. >> You can hold the phone. >> Do not talk to her. Do not talk to her. >> I'm not going to I'm not going to I'm not doing anything. >> I know you're coming inside. Come on. I'm your legal guardian. Come on. >> We can hold the phone to get a search. >> Uh if you take that phone, >> the phone is seized. We're going to get a search for it. >> If that's the way you want to do it. >> He's going to turn it off. >> Uh no. No, sir. You cannot do that. >> No, sir. >> It has evidence on there. You can do that if you want. evidence on the phone. We can seize the phone. >> No, you can't. All right. Tell you what, I'll stand here with her and give me the phone back. Well, he's an alcoholic and we're not married and we just You mean like as of right now or throughout the >> Just throughout right now, whatever. >> We don't really I'm gone most of the time and he's at the house and I just feel like we're two separate people living under the same roof. He has his life and I have mine. >> Do you work or >> Yeah, I work. >> Where do you work? >> With media? >> Yeah. Is that okay? The is that the uh caretaking? >> Yeah. >> Okay. Okay. So, um how often are you guys at home together? And would you estimate? Mainly I get up in the morning and he's still asleep and I leave and I do stuff with Ted and then I usually come back maybe like 4:00 and then I leave again with my daughter and do what she needs to do around town and then we come back at like 9 or 10 at night. And does uh James work? >> No. >> No. Okay. And I'm just taking notes that way I can remember what's what's being said. We are being recorded and everything but that way if I need to go back and ask you something further. Okay. And what are what's uh I guess James relationship like with his his kids and whenever the kids both your daughter and the uh two other kids get in trouble what kind of discipline is issued? Mainly I talk to them and I tell them, you know, you did this, you can't do that. And that's it for my daughter and Jonathan. He's an adult, so we can't stay or do anything. >> Okay. What about with Georgia? >> Georgia mainly James is the one who talks to her and tells her to sit in the corner. >> Any any other discipline? >> No. Okay. I mainly just leave his kids alone. >> In that family [music] mess, Trisha's child and James' daughter also got pulled into the conflict. But the spotlight stayed on the stepmother, Trisha. She called Georgia hard to handle, selfish, trouble, dirty, while her own child was always perfect. >> And what are the sleeping arrangements like at home? >> Well, Georgia and Jonathan, they used to share a room, but then Georgia started doing stuff to Jonathan. She broke his computer for school and was just getting into his stuff. So then we tried her with Jazelle and the same thing. She would lie about Jazelle, steal her stuff, break it. So we put her downstairs. We call it the kitchenet because there was a a sink down there. >> Mhm. >> And she's been staying down there. And is that the uh room with the pull out bed? >> Yeah. >> Okay. Okay. And then that's in what proximity to your guys' room? like right across the hallway. >> Okay. Tell me a little bit about Georgia, what kind of kiddo she is. And >> honestly, I really don't know. I know like when my daughter and I used to go up there to visit. Um she would get with my daughter like when they were playing Barbie, she would like her and tell her, "You better do it like this." And my daughter right away she was just like, "I don't want to have anything to do with her." >> Mhm. >> And she would run and tell James. And James would tell my daughter, you know, he would get on her and tell her like he would get more on my daughter than Georgia. But then over the years, he started to find out that it was Georgia. And the same thing with Jonathan. Jonathan, he wouldn't really talk. And um sorry. >> No. If if you need stopped, you don't feel well, we can >> Jonathan he um wouldn't really talk. But we found out that she would do things and then she would blame Jonathan. It's like any way that she could stay out of trouble, she would just blame whoever. >> She still doesn't have good hygiene. She's very egocentric. Like if she doesn't get the attention or somebody else is getting more attention than her, she gets upset. >> And when she gets upset, how how does she express that? I guess >> she steals, she lies, she um she just acts out. >> And tell me more about her her hygiene. Um well, when I met her, she was always in her pajamas, didn't brush her teeth. She had a bunch of that um plaque, I think it's called, all over her teeth. Her breath really smelled. She wouldn't brush her hair. She would just wear pajamas. just run around like crazy. What's the What's she do throughout the day? Does she go to school? >> See, that's another thing. She has a She had a counselor, Jackie Sandival, and she was working with her, trying to get her to take a shower. We made a schedule for her and visual schedule, decided on what day she would do it, and um like her chores and then going to school. And because [snorts] of that, Georgia was forced to do all the housework. But what's notable is how skilled Trisha was at blaming others. Georgia didn't go to school. Her fault. Poor hygiene. Blame the illness. As for Trisha, naturally, she was innocent. >> Okay. And where did she go to school? >> She went online K12. >> Okay. >> But she wouldn't I would always tell her, "What time does school start?" And she would say 8:30. I said, "Okay, that means you have to go to school at 8:30." But the chores, she her her hygiene, she would take excessive amount and not even do her hygiene. I would say maybe an hour to an hour and a half. And then the chore, her chores were um the cat litter and the dog poop and feeding the animals. >> And she would take anywhere from 45 minutes to an hour. So she would miss like I don't know >> maybe like the first period but during that time I was at another job and I would be gone out of the house by 8. >> Mhm. >> So that's just what I heard like from James that she's not going to school. And then recently I mean the school has given her so many chances and she just will not do it. She will not go to school. So they kicked her out and we talked to her home room teacher and James and I and the teacher kind of decided that maybe let her get her GED. >> And who was that? What teacher or was that through the K12 or was that >> Yeah, the K12. I don't remember her name at all. >> And the counselor, who was the counseling through? >> It was through PMS. >> PMS. Okay. And when was the last time she attended counseling? >> I think maybe a year since she saw Jackie. But Jackie, she just said, um, I've been here counselor for three years. I have not seen any improvement. You don't want to better yourself. I can't justify my services and I have to quit. And then she referred us to uh Priscilla Rothol like she would tell I had to start sitting in in the counseling with Jackie because she would lie right to Jackie's face. And I said, "No, Jackie, that didn't happen." So with Priscilla, it was the same thing. She would go in there and she would act innocent like she didn't do anything. And Priscilla was like eating into it. >> And what kind of things would she lie to Jackie about? >> Like she would tell Jackie, um, yes, I'm going to school. Yes, I'm listening. Yes, I did my hygiene. >> And what would she go into counseling for? >> Um, I'm not really sure. Okay, >> I know it was just mainly maybe behavior. Things got even messier when three psychologists gave [music] three completely different diagnosis. >> Is she diagnosed with anything or not to your knowledge? >> Well, she is, but she have medical issues or anything like that. Well, see, I'm I'm confused on that part because Jackie said ADHD and then Priscilla said fetal alcohol syndrome and autism and I think ADHD, but then she saw another psychologist, his name is John, and he said there's nothing wrong with her. >> And where was John at? Um, he's from I think social security or he I don't know if he's I I don't remember what James said. Either there was nothing wrong with her and she didn't get social security or her condition wasn't didn't meet the >> Yeah. wasn't extreme enough. >> Okay. Okay. So, I don't really know. It's like there's three different people and they're all saying something different. But then we had her tested for um IEP here in Farmington School District and they said she's capable of doing the work. So it's like James and I we don't really we don't know if she's playing us, if there's something wrong with her. We just we don't know. >> Okay. >> Georgia [snorts] was expelled, abandoned, locked up, and [music] finally had to ask for help the only way she could by telling the truth in an investigative interview. But that truth [music] was quickly twisted as the stepmother blamed everyone except herself. This time [music] even the therapist took the hit while she kept playing the role of the perfect stepmom. >> So the allegations that were brought up was she said that she is only allowed to use the restroom at certain times. Mhm. >> Okay. If she wants to use the restroom outside of those time out of those times, she has to get permission from both you and James in order to either shower or use the restroom. Is that accurate or no? We were just told, well, see, it goes back to Priscilla. >> Mhm. >> We're like, how do we do this? >> You know, and she just said, you can't force her. Just let her do it by herself. And so that's what James and I were doing. And then there was also allegations of um having to actually being locked in the chicken coop out out back. Okay. >> Tell me about that. She said that every every morning from about 6:00 in the morning until 10 to midnight at night, she would have to be locked in the chicken coop. I'm not aware of that. I know that her chore was to feed the chickens and give them water and that I caught her a couple of times in there and she was busting eggs. She really messes with a lot of stuff like what? Just everything. The more detail you can give me um the better. Just so I can kind of >> Well, she as far as the chicken coop goes, she's not doing any chores because she won't do them. She will not help with anything. The only time I've caught her in there is when she was playing with the chicken eggs and busting them and doing whatever. >> Did she say why she was busting them or >> Because she likes to watch the ants eat it. >> Oh, >> she's like I don't know curious about things. Like she has to see how things work. >> But I did see her in there doing that. And have you ever made her go out there for discipline and sit in the chicken coop or stand in the chicken coop? Okay. >> We just send her to her room or put her in the living room and tell her, you know, you're in timeout. >> Do you guys ever um or anything? >> I don't. James, it's it's his kids. He disciplines them. >> Okay. Have you ever seen him? >> No. >> Okay. >> I've seen him yell at them. And kids can be a handful. I get it. So sometimes parents lose their cool. They don't know how to handle things. Have you ever got so angry that maybe you did something that probably shouldn't have done and you realized that, but you just kind of lost control? And >> the only thing is just raising my voice and frustration. >> Okay. What about a belt? She mentioned that there was a belt that was used on her. It's a black and silver studded belt with belling wire on it. >> In 2024, nearly 20% of American teens aed 12 to [music] 17 struggled with major depression with a significantly higher rate among girls. Bullying and lack of emotional support are leading causes. In a pressured and isolated environment like George's, the risk of developing mental health issues is extremely high. >> Hello, I'm from Clova. Sorry to keep you waiting. >> That's okay. >> Want to have a seat? We'll try to get you out of here as quick as possible. Be very good on water. >> Well, I'm going to pee, but I'm fine. >> Okay. >> So, um I'm the assigned worker for the uh the case we're following up on. Okay. Through CYFD. Um were you advised of what's going on exactly? >> Not really. >> I know. I just talked with um Tanisha. >> Mhm. >> Um it was earlier today and a few days ago. >> Okay. So, I will fill you in on the allegations and what's going on exactly. And if you want to talk to me, tell me your side of what's going on or maybe clarify some stuff for me. Great. If you decide you don't want to talk, that's your right as well. I know you've been advised of your rights already. I'm going to advise you of them again. And if you decide to talk to me, I'll have you sign this paper. If at that point you decide, no, I'm not going to talk, then I squirt you out. Okay. >> Okay. Well, they said something about me being on arrest, too. Oh, I I guess you have a warrant and I could check in on that. I They just told me that they found a warrant that was signed today or yesterday. So, I'm not too sure. So, we can get clarification on that >> cuz I I don't know. They just told me that there was. So, real quick, let's go over this and then I'll Well, let me go over the allegations a little bit. So, so the report came in. I received it Monday. I believe Monday or Tuesday and it was for um allegations of a 15year-old girl who was being locked inside a chicken coupe. So that's what that was the allegations and the female is identified as Georgia who is your daughter I believe right? >> Um she did get a safe house interview a forensic interview completed and during that interview she did disclose that you know there was um I think we're about done. Let me go and check with my supervisor real quick. Just make sure I'm not forgetting anything or need to cover anything and uh we'll get you out of here. >> All right. >> All right. Do you need any more water or >> maybe a little bit? >> Okay. >> Grab that real quick. >> All right. I'll be right back. >> Yeah. [snorts] >> James even tried to justify himself. [music] I thought I was allowed to leave. He clung to someone's vague comments and a dropped restraining order. thinking emotions could excuse him from obeying a search warrant, but in the end, it earned him a pair of handcuffs and a direct ride in the back of a police car. >> All right, here's this and I'll ride back. Oh, so I guess the warrant was for a attempt of court for a restraining order violation. >> Patricia said she's filed a dismissal. >> This was just issued. Have you guys had a restraining order before previously? >> Just a little while ago, but she says she dismissed it. >> I guess that's what that one's for. And then um I guess the officers told you the resisting today or not. >> Yeah, but he said he said I was fine to just walk away. And then he asked if I wanted to Well, he asked me in the beginning if I want to come up here and visit. I said, "Well, I don't know why because I'm already dealing with Tanisha and see." >> Mhm. >> He said, "Okay, well, you don't have to go to the interview or nothing, >> right?" >> He welcome to walk away. >> Do you know which one told you that? >> I'd directly see his face. He says, "But you're welcome to walk away." I said, "Okay." And then next thing I know, I said, "Well, can I just go in the house?" >> Right. >> He's down until the >> search warrants completed. >> Yeah. I said, "Okay." So, I just said, "Okay, I'll stand here." And then [clears throat] >> one of them came over and you >> because I didn't want to come and talk right away. >> Okay. >> And he said, "Well, he's turn around and arrest for um >> the resisting, debating, not that." So that portion was for us giving announcements, saying we were there, search warrant, all that good stuff, and you didn't come out until after the fact. So he'll handle that. I don't have any part of that. I was just letting you know what what that the arrest warrant was for and that sort of thing. So, but okay. Let me talk to the officer who's going to transport you and we'll get you out of here. >> All right. >> [sighs] [clears throat] >> Just >> how you doing, sir? >> I'm good. >> So, you going to turn right for me? >> Good. [clears throat] >> And Georgia, she's already suffered enough from her family. Yet now the systems again, treating her like a criminal, reading her Miranda rights, seizing her phone as if she were the one who deserved. >> Hello, Sergeant and I Police Department. I think we left our bag here. A black camcorder bag. >> Yeah. Can I grab that for me, guys? >> Perfect. Thank you so much. >> Is there any update on my phone? >> Go. I can't hear you with the dogs. >> Any update on my phone? >> Yes. We're going to have to draft a search form for it. So, it probably won't be till Monday that we can get it back to you. Okay. Yes. >> Yeah, sure. >> I have a question. >> Yes, ma'am. >> I feel like the lady who interviewed me >> Uhhuh. >> she didn't ask. She didn't tell me my Miranda. She didn't sign a phone. >> Yeah. You're not a suspect, right? >> But I really need my phone for my medical. >> I really need it. >> Okay. Okay. >> Have a phone. contact. Unfortunately, when there's a crime like this that's alleged, right, we can see those, right? Yeah. And it's to call your doctor. Is that what it is? >> I have to update her. >> Okay. >> On if I'm going to have she has to know if I have my allergy attack, if I need a refill, my epipen and everything. >> Okay. Okay. Let me see if the they'll authorize people to come in to do search warrants on a Saturday. It's very expensive, right? Um and see if they'll because we have to we have to prove it. there's an agency exency to to do that, right? I don't know if they'll prove that. >> I just feel violated, honestly. She just said, "We need your phone." She didn't show me the warrant for it. She didn't ask me my Miranda right. >> Well, Miranda rights only go into place when you're a suspect, right? >> She treated me like one. >> Yeah. Yeah. Well, it's like I said, if if the judge if we can >> I have to use it for school, too. >> Yeah. I understand where you're coming, but these are the type this is a that's the problem with these types of situations, these crimes. every one of these situations. My dad's ex-wife me and this whole system failed me from her who's a liar who lies about everything and she and that's the thing is we have to it's not >> failed me. I'm an actual victim of child from my dad's ex-wife and you guys just let her go to Colorado scotfree. >> Well, I'm sorry. I don't I can't answer for that case, right? I I wasn't on that case. What I do know is I'm on this one and we have to make sure and investigate thoroughly. That's why we're doing what we're doing. >> Even [snorts] so, when George's statement completely contradicts her families, proper investigation is a must. Let's wait and see how the police will untie this knot. >> I'm sorry it's like that, but that's how it is, [music] right? So, that' be the only other way that we'd be able to do this like now, right? And it's totally up to you. If you guys want to do consent, we can do that. And how that would work is we go down to the police department. I called Detective Mlo back in so she can plug your phone into that into the computer. You would have to be within a certain area for we're dumping it to at any time you can withdraw withdraw consent. And that's what the law and our policy states. If at any time that you say, "Okay, I want you to stop downloading it." We seize the phone, we get a search warrant, we're done. We just wait till we get a search warrant. And that's how that's how things work these days. That's how the law is written and that's how our policy is, right? The only other way, you know, for you guys it would be to get like uh either emergency phone. I think Walmart has them for $19, $20. >> I had a little pink phone that was old, but they took The warrant covered every single device in your house. >> So, how are we supposed to if you said get an emergency phone? If we had it here anyway, they would have took it. >> But I'm saying now get a go emergency phone. That's what I'm telling you. Okay. >> That's what I'm telling you. Okay. That's the only way we can do this right now. Okay. You guys have any questions at all? >> I guess not. Okay. >> Just that I'm still in my head really. >> You take care of your yourself, okay? Take care of your body. If you need to go to the hospital, please get seek attention for that. Okay. If you wish to file a complaint about the domestic situation, I would urge you to because if they told you you can't come back and there I mean there there's especially with children. If I was a sergeant, I would have said no, the children are coming back home. This is their home. He can leave. Yeah. >> His son who was me was 18. They wouldn't have him move because it's his home. But they made me stay out here. >> That's why I'm saying if you >> said it's my home, too. That's why I'm saying if you file a complaint, they can look into it to make sure that that that officer abided by our policies >> too by a homeless man and we didn't even have a phone to call for help or nothing. >> I'm sorry that happened. >> We've been through a lot. >> I'm sorry. >> Like 3 days, 4 days. >> Sounds like you have. All right. I'm sorry for that. You know, but we we have to investigate these claims. We have to. >> Okay. You guys have a better night. And if you guys change your mind about doing the consent for for your phone, I'm going to I'm sorry. We're going to have to get a search warrant. But for yours, we can we can work off consent. Okay. If you change your mind, you want to do that, just call dispatch, say you talk to Sergeant Annayia and about the phone and and I'll come out and we'll do this. Okay. All right. Just let me know. Okay. The 59year-old father and his 39year-old girlfriend were charged with 14 felony counts, including child and [music] conspiracy to commit child. They were booked into the San Juan County Detention Center, but on February [music] 19th, 2025, they were released on bail, awaiting a preliminary hearing on February 26th, [music] 2025. What do you think about this outcome? 14 serious charges, yet they walk free. Do you agree with how the authorities handled it? Leave your thoughts below. Welcome to New Mexico, where a mother caught between the chaos of work and life turned to alcohol for relief and left her children for society to take care of. And then your son's with some drunk driver. >> Yeah. >> And you and your sister are out partying at the park. >> On January 31st, 2024, an emergency call sent Farmington police rushing to a scene where a car was parked awkwardly on the roadside. Inside was a mother under the influence of alcohol. And somewhere out there, children whose whereabouts were unknown. Where are the kids? A simple question, but it left Chelsea confused, stuttering, and silent. >> What's going on today? >> Nothing. >> Okay. Where are your kiddos at? >> One of them's over there. >> One of them's over there in that car. >> Yeah, one of them over there. >> Okay, one second. Let me get all this figured out. Okay, I'll have you just hang out over here with me for a second. So, what's going on, bud? I'm not fully aware of the situation. >> No, the mother had took my names first cuz I was exiting out of there and it felt like they were like retalating of not me, whatever. Like, I don't get it. Like, I'm a real I don't get it. >> That's what I'm here trying to figure out. But y'all having like one like four cars pull up then is that serious? What the? >> Well, when they're up with that >> when we get a call about kids being in cars with intoxicated drivers, we take it pretty serious. Who took your Who did they >> Damian has my car? >> Okay. >> That's my mom's car. >> Oh, okay. >> If y'all going to take it, then just let me know where the going to take it so I can take it back out. Y'all let me know what's up. You're like, that's all I want to know. Let me know what yall going to do with the kids. That's smoothie on you guys. >> That's my sister. >> Okay. Can I just have you stand over here until I could talk with her? Thank you. >> Yes. The mother was a recovering alcoholic. She had been sober for a year, but then the pressures of life led to a relapse. A sincere confession, but unfortunately, sincerity doesn't exempt you from criminal responsibility. >> So, who's the registered owner of the car? >> My mom. >> Your mom. Where is she at? >> She's in the rest. >> On the res. Okay. How far away? Uh, >> she's in the rest. I don't know where, but she's in the arrest. >> Okay. Well, I mean like which one? Arizona. That way. >> Yeah, that way. >> So, a few hours away. >> Yeah, about >> about. Okay. Yeah, gotcha. >> I mean, I can't like, you know, black. >> No, I get you. Yeah, no worries. Just trying to figure out everything that's going on. It sounds like we have a lot of different issues in different areas and they just told me to head down this way and try and talk to you to see what was going on. >> Damn. You should talk to the path people. >> What happened over there? the fact that I want to exit out of there. It seems like they want to stop me from exiting out. >> Okay. >> But yeah, I understand that I was intoxicated, you know what I mean? But why is that a problem? You know what I mean? Like I'm exiting out of there issue then like I never did it before. You know what I mean? Like I didn't go or drink or whatever before. But they have a problem for me exiting on that day, me drinking, you know? And they're saying that to me and I kind of feel like I don't know. I really don't know. Like unreal. I don't know. like they're making it more difficult than it needs to be. >> Yeah, because they should know it's a home a homeless shelter. You know what I mean? But I had to get on my feet. Me personally, I am a manager at KFC in the East Main. I'm a shift manager or whatever over there. My boss right now is like she's trying to give me more hours too, but she can't give it to me because there's other people that are coming into the crew right now. Gotcha. >> So, she cut my hours from there, you know, so of course it's decent, you know what I mean? >> But I feel like I don't know. I just kind of feel like she just they want me to look for another job. They want me to look for another job. >> Like they're trying to push me out. That's her sister. >> They want me to They want me another job and it was too hard for me. I can't do that. Especially out here. You know what I mean? Especially me raising uh my niece and my boy, you know what I mean? And I'm single. I'm not I'm not married. Whatever you know, like I'm trying to do my part and get an over day with, you know, but tell me this, you know, tell me this. Tell me this. Okay. Say you're workingh >> 823. >> Uh-huh. you know, and you have another job to go to, you know, from 4:00 to midnight or some know who to watch the kids from that point to that point, you know, if they want me to look for another job. >> That's just why I confronted him about it and it got me stressed the out and it kind of got me relapsed because I've been sober for a year, you know, and I kind of relapsed over that cuz it got me stressing as >> So, you said you raised your son and your niece. >> My niece, >> where are they at? My niece is at the I myself over there. >> Obviously, >> I myself that car my niece is over here and she's getting held back over here at the path. So, I'm pretty sure that's how everything got tangled over there. >> Who's holding her at the path? >> I'm pretty sure they contact you guys >> like the employees of the path. >> Yeah. >> Oh, okay. Get at the path. How does the kid? >> I think uh 315 might be over at the path. >> Yeah. So, there's already somebody over there, I think. And it's just >> let me call Mis cuz I think she's running this whole thing. >> Perhaps Chelsea still hasn't realized this isn't a vacation and the police aren't here as companions. They're here to put an end to her reckless game. >> All right, Chelsea. Sorry for the confusion there. So, they're almost finished over there. Okay. So, I'm going to drive you back to the path so we can finish everything over there. Okay. And then you can be with your niece and then we'll get the kiddo over there, too. Okay. >> Let's head on over this way. and we'll get you back over here. >> The lottery is still going to take the kids anyway. What's the point of me going that way and then me walking back over here again? >> Can you tell the future? >> No, I don't. >> Cuz if you can't, I won a lottery ticket. Okay. So, you can't tell the future. So, let's not put that on us, right? We're not taking anything and telling people. >> You guys are still doing I know the system. I don't know. >> It's not us. It's not us that's going to take any time. We don't make those decisions. Somebody else does. >> Okay. The thing, the ultimate thing is we got to get your kiddos in a safe spot. We got to get you back to a safe and then we go from there. But you're like, "Who's going to tow it? This is what's going to happen." You don't know what's going to happen. >> It's going to happen. >> How much? How much? >> Let's go promise. I mean, let's go bet them. Oh, let's go bet then. >> $1. >> Okay, let's go bet that. >> Okay, >> you guys will take my car and the kids. >> We're probably going to take the car >> because you got drunk people driving it. >> Really? So there's a consequences for actions and unfortunately we're living breathing consequences. >> Your baby's in two. >> So we'll take care of your baby but you need to go with this officer back to the path. >> Okay. >> It's the first step. >> Yeah. We're just going to the path. >> You want to take me to the >> I'm not even going to put I'm not even going to put you in handcuffs. Let's just come on over this way. >> Let's go back. >> Get your title to the right. >> That was rude. Babe, >> you really got to >> You need to tuck your your [ __ ] >> She like >> my sister all the sisters. >> Oh, your older sister's mean to this officer. You put your seat belt on to your right. Right there. >> My credit card tonight. >> You want me to get the other kiddo and get them back to >> Well, I need my credit card, too. How am I going to survive tonight? >> Um, I'll talk to you. >> All right. >> What's that? >> Can I get my credit card? >> One step at a time. We'll We don't know what's going to happen to the car yet. It may just end up back over there, right? >> Yeah. Give me a ticket now. >> So, just give me just a minute. Okay. >> Everything immediately turned chaotic. Chelsea sped off from the shelter, leaving her niece behind. She showed total disregard for the child's life and the of her actions. >> So, she's going to be 15 for abandonment. >> Oh, okay. We lost the bed. >> From what the guy was saying, he's like, I was scared for the welfare. Like, I'm not going to let anyone talk at me. So, we kept her here and called you guys. And then mom took off and and ended up finding Correct. And they said, "I don't know how to watch him like >> Yeah. And then so I followed up with that and Pat said, "We don't have any type of dayare like well and then her son is with so Jones has the 47 and that's guys, I guess." Did she say anything to you or No. >> Yeah. So she said that she was moving out. >> She was stressed about work, so she relapsed. It seems like the past is trying to stop her from leaving cuz they took her 12-year-old me. And she was like, "And then I hope my son's over there." and she points to the traffic stop. I kind of hope he isn't. I would prefer that he was at the path, too. But did they say yay or nay at being a 47? >> Um, they're doing it right now, but they have kids. So, >> guys, these guys said that the other chick was drunk. I guess she had her sister here and then the boyfriend. >> So, sister walked up on me when I was talking to her. >> Okay. >> Go away. She was like, okay. Basically left. >> So, they told sister, "Can you get out of here like you'll get sickly?" And then they were worried about the kids welfare. She's drunk. And so they kept her and called us and then she took off in that Tucson with whoever got dumped off up here. She walked and that's when we got off. >> It is probably worth to note in the report that they're like the kiddo is over there and that driver is intoxicated and she just laughs. She's like, "Oh, he is." >> As soon [snorts] as the Miranda writes ended, she switched to I don't know. Didn't know what happened. Didn't know where her niece or child was. And the most infuriating part, she acted like it had nothing to do with her. >> If you can't afford a lawyer, the court will appoint one for you if you wish. If you wish to answer questions now without a lawyer present, you have the right to stop answering questions at any time. Do you understand your rights? >> Yes. Should I do a question? >> I don't know yet. I haven't decided. So, what's going on? >> I don't know. You know, I don't know. I don't know. I'm moving out of this place like the the path. >> Yes. I'm moving out of there. And then this morning, I Okay. But the get go when I got up and I was like I told Megan or the main or the suitcase worker I was moving out yesterday and I don't know it just feels like to me I don't know why they have a problem with me moving out. You know what I mean? All of a sudden they brought you guys involved and like I don't get it. Like I just don't get it on the >> What happened when you guys were moving out? >> Nothing. Nothing didn't happen. Like there was no loud noise or nothing. All we were doing was just moving our p moving our boxes and get out of there. >> What do you mean loud noise? I don't know what you mean by that. I mean, I don't know if we're making loud noise by moving like moving our boxes or moving furniture or whatever. There's not much to move because you can see yourself too, but um I live in 2020 204. That's where I was staying at. And as you can see, if you can go into your south, like we were packing our you know what I mean? Okay. >> But I just don't get it. Why they have a problem now? Like I'm exiting the program. Why they have a [ __ ] problem drinking? And then they're like, "Oh, okay. You left your sister, you left your niece behind." I'm like, "Yeah, but she has adult with her, but yeah, she won't be intoxicated." Whatever. But with your niece right now. >> She's in there, I think. >> You think? Do you know where she's at right now? >> No, I think they took her. I don't know. >> Who took her? >> I don't know. Damn. They have her in there. I'm pretty sure she's in there. And I'm pretty sure you know what's up. You know, don't say that to me. But I'm pretty sure she's in there and everything, you know? And I don't know. I'm puzzled. You know what I mean? So, who did you leave her with to watch? >> My sister. Where's your sister? >> Uh, she's she's walking around because they told her to exit out. They tore to leave the premises because it was trespassing. Even though they run her background check and her ID's here and she signs in here and there, you know, but I didn't let her sign in today because I didn't thought it would be a problem for her helping me with my the pack. Get the out of here, you know. >> Well, I know your sister was down at the park with you, right? >> No, >> this officer cuz she walked up on you guys. >> Oh, yeah. I mean, just now. Yeah, because I have to I have to go find her and see what's up. You know what I mean? >> Menise was here. No, no, no. THEY TOLD HER. NO, they were with my sister. Girl, they were my sister from the ghetto this morning. >> This morning. So then what happened when you left? Where did your niece go? >> She was here. >> Okay. >> But I don't know what happened. That's what I mean. I don't know what happened to that time. To that time because when you leave your niece to as far as a responsible sober adult watch. >> Nobody I know concern because I know you already told me what's up because my sister was under influence too. >> Okay. >> That moment. Where's your son? >> He's with my boyfriend right now. I think you go all over. Whatever. I'm pretty sure you know what's up. this guy there by Dollar Tree, I guess, whatever. You know what I mean? Yeah. But he has my mom's right and everything. So, you know, I trusted him because he's not really influenced, whatever. Maybe he is. I don't know. But >> she blatantly abandoned her 11-year-old niece, handed her son to someone who might have been drunk, then casually took her sister to a park to blow off steam. Yes, that's how she defined her role as a mother and guardian. >> How much did you guys all drink today? >> Not that many. Yeah, not that many. But I don't know. I don't know why it's a problem, but >> Well, the issue we have is that's your niece, right? >> Yes. >> So, where's her? Are her parents in the mix? Like, once >> I had her with me for like 2 years now. >> Okay. So, parents are not involved? >> No. Okay. So, you're supposed to be the responsible adult, right? >> Yes. But then the mom, I called her and I told her what's up. You know, she's >> So, who has custody of the niece? >> Me. Yes. >> And so, you're supposed to be the responsible role model, right? >> Yes. The garden. >> I supposed to be, but you know what I mean? So, >> okay. So, I'm glad we're under that understanding. Right. >> So, our issue is your 11-year-old here by herself when this No, listen. This isn't a daycare facility for you to go get drunk in the park, >> right? >> It doesn't matter. So, the issue today is you and your niece and now your son got pulled over with your supposed boyfriend, ex-boyfriend, and he's possibly drunk, too. And so, now your son's driving around in a car with someone who's drunk. We just had a fatal right down the street where someone rolled and got for drunk driving. and your 12-year-old kid is with this guy. How is that responsible? >> I know it's not. You know what I mean? [ __ ] That's just why I [ __ ] up because I've been sober for almost >> and that's great. A year, you know what I mean? But I up like I don't know. I don't know why I did it, but I did it in I don't know. It just happened. You know, like everything just happened like in a heartbeat. And in a way, I do regret it, you know? Like [ __ ] >> I hope you do because they're 11year-olds in there upset. You guys are living at the path right now. Okay. >> I up like on the real bad. >> Okay. And then your son's with some drunk driver. >> Yeah. >> And you and your sister are out partying at the park. >> We're weren't partying. >> Whatever you guys are doing. You guys are drunk and your niece is here. >> We were just trying to figure out what the [ __ ] we doing next. You know what I mean? Like >> maybe take care of your niece, right? An 11year-old who is counting on you. >> Yeah, we tried but we it didn't it didn't happen. So >> no. Okay. >> To this day, I still can't figure out what that smile was supposed to mean. >> You can't tell the future. [laughter] >> One step out for me, please. Yes. Okay. So, you're being arrested. Okay. Your child. We're going to go to the front of this vehicle. Okay. Cuz you're going to go in our car. This is this officer. Okay. And then step in front of this car. We're just going to do a quick search. Okay. Right here. Okay. Right here. Okay. Separate your feet. Do you have anything that's going to poke sticker? Nope. No. You're just wearing leggings, right? Okay. I'm going to grab your phone after the >> I don't know why this is a laughing joke, ma'am. Okay. You're going to jail. >> Oh, no. Been there at all for you have anything else in my bra? No, I don't. No. Want check? Not really. Hold on. Okay, let's go this passenger side over here. Actually, I like Let's go to the driver's side. I don't want you falling. >> Love you, Mia. Tell Tell >> Care. Where did you >> I love you. >> Okay. I love you, too. Sorry. >> Oh, sorry, baby. >> Are you case worker? >> Case manager. >> I'm sorry. I didn't know who you were. I was like, she's just She's going to We had to contact CFD. >> Yeah, I know >> what's going on. So, she cas a little bit. Oh, there she said her grandma's numbers are in she has a phone. >> Oh, okay. >> And she's going to try to call grandma. >> If she can get phone and then the phone number so we can call that way we can get Thank you. I appreciate it. >> The mother has now been charged with child and is being held in jail.
