On April 25th, 2025, while patrolling a shopping plaza just before midnight, an officer noticed a white sedan parked in the travel lane with its lights off. Inside, the driver was slumped over, unconscious, with his right hand submerged in a large bowl of spaghetti and tomato sauce. Some of the sauce had spilled across his shirt. Here's how the events unfolded that night. How's it going? What the hell? See the police? You pass out behind the wheel of your car. You all right? Sorry. Are you okay? Yeah, I'm fine. Okay. What? So, right now you're behind the wheel of your car and your speech is slurred and I think you might be impaired. No, not normal no normal person just pass out behind the wheel of your car. No, no, I just was the number four. No, maybe I had um but uh I work 7 days a week there cuz they open up the store and I work uh at Karavas. Okay. So, I get tired. You had you had a a drink or so. I mean, I can smell it from your breath. No, you might smell it on my body. I mean, I sp I spilled uh alcohol. Yeah, I'm tired, man. I'm just tired. I mean, honestly, the fact of the matter is is that I work seven days a week at my store and I work. I'm tired. I'm a tired person. That's all it is. So, why would why would you spill alcohol on you? So, I need to advise you if you don't do what I'm asking you to do, I'm going to base my investigation. Right now, it's a DUI investigation. I'm going to base my investigation on my observation. What's your observation? You went behind the wheel. You pass out or No, no, I didn't pass out. Your spit is slid and I can smell alcohol from your breath. No, you can't smell alcohol. So, how you going to get home? I I I can leave my car here and have somebody pick me up. If you're if you're worried about it, I'd be happy to leave my car here and have somebody pick up. Why would you leave your car here if you Cuz if you're worried about it, I mean, you know, I mean, you say you're worried about it. I'm not worried about it, but you say you are. If you refuse to take the test, I requested of you. Your driving privilege will be suspended for a period of 1 year for a first refusal of 18 months. If your driving privilege has been previously suspended or if you have been previously fined under statute 327.35215 for refusing to submit to a lawful test of your breath you are blood. Additionally, if you refuse to take the test I have requested of you and if your driving privilege has been previously suspended or if you have been previously fined under statute 32735215 for a refusal to submit to a lawful test of your breath in blood. You will be committing a misdemeanor in addition to any other penalties which can be imposed by law. Refusing to submit to the test I requested of you is admissible into any criminal proceeding. Do you still refuse to take the test? I refuse. You are aware that you have a car with so you will be charged with I don't have prior. Okay. At the jail, the driver was read implied consent and declined to submit to a breath, urine, or blood test. A records check revealed that his Florida driver's license had previously been suspended in 2008 for refusing a lawful chemical test.
