- Not all heroes wear capes, but sometimes being a savior in disguise gets you into more trouble than it's worth. - Today, Detective Dale is going to take us through four cases where cops arrested good people for the most ridiculous reasons. - In the United States, you've got the constitutional right to remain silent when questioned by the police. But when an officer gets a bit too entitled, exercising this right could land you in real trouble. - [Policeman 1] Put your hand behind your back now. - No. No. - [Policeman 1] You're being wrong. - [Preston] What are you f*****g with me for? Loveland police officers in Colorado rushed to the scene of an accident. They tried talking to a guy who had just helped the injured man get up. The good Samaritan didn't want to talk, which unfortunately made things spiral out of control. (sirens wailing) - [Policeman 1] Where is the bike at? - The bike's parked down the side. - [Policeman 1] The blue one? - [Preston] Yeah the blue one there. - [Preston] We pulled it off. - [Policeman 1] Okay. You mind coming and talk to me? - [Preston] I don't know what happened. - [Policeman 1] Well, you pulled the bike off him. - I'm not talking to nobody. - [Policeman 1] Really? - These guys saw what happened. I didn't. - [Policeman 1] Okay. If you're not talking to anybody, you can leave. - Well, you can leave. You're dismissed. - We can't leave. - We can't leave. I'm not leaving. - [Policeman 1] Okay. Then come and talk to me. - No, I'm not gonna come talk to you. - Just- - I'm not gonna come talk to you. - It's a police officer man, just- - I know. - [Policeman 1] Did you pull the bike off of him? Did you pull the bike off him? - I'm not gonna go talk to him. - [Policeman 1] Did you pull the bike off him? - I did not. - [Policeman 1] Okay. You just told me you did. - Has nothing to do with me. - [Policeman 1] Okay you're free to leave. - [Preston] Yeah you're free to leave. - [Policeman 1] What's his name? - Preston. That's all I know. - [Policeman 1] Preston what? - I don't know. - [Policeman 1] You got an ID on you boss? - Nope. - [Policeman 1] I'm gonna get an ID now. - [Preston] No ID. - [Policeman 1] Okay. 177, I got an uncooperative witness. Come on over here. - Constitutional right. - [Policeman 1] I need to talk to you. - Constitutional right. Nope. - [Policeman 1] I need to talk. - I don't wanna talk to you. - [Policeman 1] You have to talk to me. - I don't wanna talk. No, I don't. - [Policeman 1] You do. Okay you've inserted yourself. - I came down here to help them. I don't have to talk to anybody. - [Policeman 1] So this is gonna go one or two ways. - I don't have to talk to anybody. - [Policeman 1] This is gonna go one of two ways. - I don't have to talk to anybody. - [Policeman 1] Okay. Either, you're gonna sit here and talk to me, we'll just have a short conversation. - Nope, nope, nope. - [Policeman 1] Or I can arrest you for obstruction. - No, you're not, I'm not obstructing either. - [Policeman 1] You are. - You're right here. - [Policeman 1] Okay. - I'm not obstructing nothing. These guys are taking care of it. - [Policeman 1] Please just come talk to me. - Nope. - [Policeman 1] Okay. Turn around. - I don't want to talk to you. - [Policeman 1] Turn around right now. - Nope. Nope. - [Policeman 1] Turn around. - Videotape this Sherry. - [Policeman 1] I'm already doing that. It's right here. Turn around. - No! No, no. You're wrong. - [Policeman 1] Turn around. - My constitutional rights. - [Policeman 1] Turn around. - I don't have to talk to you. - [Policeman 1] Turn around. - I don't have to. I don't have to ID myself. - [Policeman 1] Turn around. - [Preston] He's being a d**k. - [Policeman 1] Turn around - F*****g (indistinct) cop. - No he's not. - I came down here to help. I don't know what happened. And I'm telling him that. I'm telling him that. - [Policeman 1] Put your hand behind your back. I'm not telling you again. - [Speaker 1] You're being a little bit of a d**k man. - [Policeman 1] Put your hand behind your back now. - No. No. You're being wrong. - [Policeman 1] Put your hands. - [Preston] Video tape this Sherry. - [Biker] He's gonna get you if you don't listen. - [Preston] Videotape this s**t. - What are you f*****g with me for? What the f**k are you f*****g with me for? I have nothing to do with this. This is f****d up. (Preston screaming) F**k you! Video tape this Sherry! This is f****d up! I'm not obstructing justice! I didn't wanna talk to you! I didn't have to talk to you! - [Policeman 1] You did. - [Preston] That's my f*****g rights. This is b******t. This is b******t. This is total f*****g b******t. - [Policeman 1] I gave you plenty of opportunities. - [Preston] No, I didn't wanna talk to you. I didn't have to talk to you. - [Policeman 1] I'm gonna sit you up. - That's my constitutional rights. - [Policeman 1] I'm gonna sit you up. - That's my constitutional rights. This is- (Preston screaming) I don't know what happened. He came over. We saw him down. I came to help him get his f*****g bike up. - [Policeman 1] Okay. And that's why I needed to talk to you. - That's right. - [Policeman 1] So if you've inserted yourself. - Uncuff me and f*****g let me go. - [Policeman 1] You've inserted yourself, you need to talk to me. - I don't need to talk to you. - [Policeman 1] You're obstructing an investigation. - I'm not obstructing anything. - [Policeman 1] You're under arrest for obstruction, and now for resisting. - I wanna talk to your f*****g supervisor. I wanna talk to your supervisor please. - I'll have him meet us at the police department. - [Preston] No. I wanna talk to him right f*****g now. - [Policeman 1] You can talk to him before you go to jail. - [Preston] I'm not going to jail for s**t. - [Policeman 1] Yeah you are. - [Preston] I didn't do anything. I helped the guy get his bike up. - [Policeman 1] And that's why you need to talk to me. - And I'm obstructing? B******t. B******t. B******t. - [Policeman 1] Go ahead and have a seat. - Nope. Let me go. I'll get in. You don't have to force me. - [Policeman 1] I'm gonna double lock your cuff. - [Preston] You don't have to force me in. I'll get in the f*****g car. - [Policeman 1] Go ahead. - While the poor helper was brutally detained and stuffed into the back of a police car, the accident victim was whisked away to the hospital via ambulance. The officer then turned off the sound on his body camera while chatting with his colleagues, likely discussing what to do next. - [Policeman 1] Yeah. (gurney whirring) Okay. You're here. - Yeah. - [Policeman 1] I need statements from the guy in the blue black shirt. - [Policeman 2] Okay. - [Policeman 1] The guy in the Black Eagles thing. - [Policeman 2] Okay. - [Policeman 1] He was the one who moved his bike over there or was moving it. - [Policeman 2] In the Eagles jersey and moved it over there? - [Policeman 1] Yup. - [Policeman 2] Okay. - [Policeman 1] Then I still don't even know who this is. Still don't even know who this is. - [Policeman 2] Okay. - [Policeman 1] And then the girl in the silver Jeep is his wife. - [Policeman 2] Is this guys wife? - [Policeman 1] Yep. - [Policeman 2] Okay. - [Policeman 1] That's it. - [Speaker 2] Muted? - [Policeman 1] I will mute to talk to my supervisor or one of my supervisors. Sir. - [Preston] What? - [Policeman 1] This is a paramedic with Thompson Valley. - [Preston] Yeah my shoulder's f****d up. - [Policeman 1] He's gonna check you. - [Preston] Yeah thank you. - [Policeman 1] Okay. - There was no reason for you to throw me f*****g down like that. - [Policeman 1] Well, I gave you plenty of chances to- - [Preston] I didn't wanna talk to you. - [Policeman 1] Got yourself under arrest. - [Preston] That's not resisting. That's not f*****g anything. - [Policeman 1] You'll explain all that at the police department. - [Preston] Well yeah, right. I know my rights. I wasn't- I didn't need to talk to you. - [Policeman 1] Yeah you did. - I didn't ID myself. I had nothing to do with what happened here. - [Policeman 1] You told me you moved the bike. - I came down here. I came down here to see what was going on. And you're asking me questions. I don't know what the f**k happened, but you f****d up my shoulder and you're gonna have a f*****g on your hands. - [Policeman 1] Like I said, this is my partner Shane. He's gonna check you. - [Preston] Yeah, thank you. - The officers doing their duty, a person who knows their rights is a blessing. But when that officer doesn't follow the law, someone who knows their rights can become their worst nightmare. - [Policeman 1] I'm gonna go talk to the wife real quick. Just let her know what's gonna happen. (P1 speaking indistinctly) - I got an ambulance coming (indistinct). - [Policeman 1] Which one? - Hospital. - [Policeman 1] Probably take him to Key. - I'll just make sure. Yeah, when I felt it it's- - [Policeman 1] Okay. - [Shane] It's goofy. - [Policeman 1] Okay. Are you the wife? I didn't get your name, I'm sorry. - Girlfriend, wife. - [Policeman 1] One of the above? - Yeah. - [Policeman 1] Okay. So he's gonna go to the hospital and get checked and then I'm gonna take him to the police department. He's gonna be booked in for obstructing and resisting. And then he'll be transported to Larimer County Jail. - Okay - [Policeman 1] Do you have any questions about that? - I've been through (indistinct). - [Policeman 1] I just needed, I mean, two seconds you would've talked and we would've been done. - Well, the thing is, he has seen so many videos on Facebook about not having to give your name, you know? And so that's why he did that. - [Policeman 1] Okay. And so my whole thought on that is if he told me right away that he helped move the bike off the guy. - No he didn't. - [Policeman 1] That's what he told me, okay? - I didn't hear that. - [Policeman 1] Okay, and then at that point in time, he's inserting himself in the accident. I'm just trying to figure out what happened today. They got on the bike. - No, I understand. - [Policeman 1] So I do need to talk to him. So at that point in time, he does need to talk to me. Okay? - But he didn't move the bike. - [Policeman 1] Well he told me he did. - He didn't. - [Policeman 1] Okay. - The other guys did. - [Policeman 1] Okay, well he told me he helped move the bike. That's what I'm just trying to figure out, is what happened to the accident. - Yeah. - [Policeman 1] So - We came up, all these guys were already over there. They got the bike up, they moved it. - [Policeman 1] Okay. Why would he tell me he helped move the bike then? - I don't know. - [Policeman 1] Okay. So that was my whole thing. I just need to know what they did to move that bike so then I could move on to the next part of the investigation. - No, I understand. - [Policeman 1] Just dealing with him. And if he would've just told me that you guys would be home already, probably. Okay? - Like I said, it's all Facebook, the videos. - [Policeman 1] I understand. I just, you understand where I'm coming from? - I do. - [Policeman 1] Okay, okay. I'm sure he'll give you a call as soon as he can. - Okay. - [Policeman 1] Okay. Do you have any questions for me? - I don't think so. - [Policeman 1] Okay. Well other than that, I think you're free to leave if you want. Or you can stay for whoever else is here. - I'll wait. - [Policeman 1] Okay. Just wanna let you know, okay? - [Shelly] Alright. - [Policeman 1] Thank you. - [Shelly] Thank you. - Hey. I'm gonna tell the medic. - [Policeman 1] And what's going on with the actual accident? - So apparently- - [Policeman 1] I'm gonna mute and talk to the officer. - What's gonna happen with the bike? - [Policeman 1] The bike's gonna be towed. - [Policeman 2] Gonna tow it. - [Policeman 1] Preston's gonna go to the hospital and get checked because he got a couple injuries during the scuffle. And then he'll be transported to Lambert County Jail. - [Policeman 2] Which side of the bike was he was laid down? Do you remember? - Right side. - The right side? - Yep. - Okay. - [Policeman 2] They're both misdemeanors. There's no felony charges or anything like that. - Does the bike have to be towed? We can take care of it. - [Policeman 2] Yeah. Yeah. - It's just part of our policy. - Okay. - He'll be able to get it out right away. - [Policeman 1] There won't be a hold on it. - Alright. - [Policeman 1] All right? - Alright. - [Policeman 1] Do you have any other questions? I appreciate you not trying to jump in there. - No, he's an a*s so. - [Policeman 1] Well, I mean, if he would've just talked to me for two seconds, it would've been over and you guys probably would've been gone by now since. Yeah, that's all it was. - Alcohol, stupid things. - [2] Yeah, unfortunately. All right. - Thank you. - [Policeman 1] Do you have any questions for me? - Nope, I do not. - [Policeman 1] Okay. We do appreciate your guys help. Sorry it went to where it went to, just- - Yeah no problem. - [Policeman 1] All right. - Just let me know what I gotta do. You got my number so. - [Policeman 1] Alright, thank you very much. - The officer strolled over to the police car where our unfortunate detainee was receiving medical attention and you guessed it, within minutes, he muted his microphone again. Classic move. Never let a little thing like accountability get in the way of a good cover up. (police crew speaking indistinctly) (wind rustling) - [Policeman 1] Alright. - [Policeman 3] Okay. (wind rustling) - [Policeman 1] All right. Belt's on the way sir. - Can we loosen this up please? My hand is like totally freaking numb. (wind rustling) (police crew speaking indistinctly) - Simple question. - [Policeman 1] I'm gonna mute since I'm really not talking to anybody at this point. - The man who was later identified as Mr. Sal and he had committed no crime. He was eventually released. However, according to a civil rights lawsuit, Officer Mutty Tone had twisted Sal's arm behind his back and forced his face into the ground. Sal even claimed he needed shoulder replacement surgery after the incident. - Right behind us there. Right behind us. Come on, go right here, okay? Stand right here for me. (crew speaking indistinctly) - [Policeman 3] You said you wanna go to Key right? - Well, that's closest. - [Policeman 3] Okay. - All I know my shoulder's freaking hurt. - [Policeman 3] The change in your pocket can I give it to your wife? - [Preston] Absolutely. - [Policeman 3] Perfect. (door slamming) - [Policeman 1] Oh. - [Dispatcher] Lincoln. - The city of Loveland, Loveland Police Department, and four Loveland police officers settled the lawsuit with Sal for nearly $300,000. The city admitted that the detaining officer had breached three department policies and procedures. Sadly, many more officers still need to learn the art of restraint and avoid overstepping their authority, especially the cop in the next case. - [Policeman 4] Look man, lemme see. Lemme see. - [Tom] No, no. - [Policeman 4] Just calm down. Michael Jennings found himself in quite the pickle. The Childersburg officers detained him for what can only be described as a crime of epic proportions, watering his neighbor's plants. - [Policeman 4] Howdy. - [Michael] Hey man, how's it going? - [Policeman 4] Pretty good. What you doing here man? - Watering flowers. - [Policeman 4] They're saying that, is that your vehicle? - Nah. - [Policeman 4] It's not? - It's the neighbor's vehicle. - [Policeman 4] The neighbor's? - [Radio Officer] 314. I'll be on 13. - [Policeman 4] Okay. (dispatcher speaking indistinctly) Do you live here? - No I don't live here. - Okay, they saying that this vehicle is not supposed to be here and you're not supposed to be here. - Who's saying that? - [Policeman 4] They called about it. I don't know who called. - I'm supposed to be here. I'm Pastor Jennings. I live across the street. - [Policeman 4] You're Pastor Jennings? - Yes. I'm looking out for they house while they gone. - [Policeman 4] Okay. - Watering they flowers. - [Policeman 4] Okay, well that's cool. Now do you have like ID or not? - Oh no man, I'm not gonna give you no ID. - [Policeman 4] Why not? - I ain't did nothing wrong. - [Policeman 4] Well look, listen, I'm not saying you do nothing wrong. There's a suspicious person. - Look, I used to be a police officer in Goodwater. Don't come here with that. - [Policeman 4] Look man, don't do this to me. There's a suspicious person in the yard. And if you're not one to identify yourself- - I don't have to identify myself and it's not a stop and identify state. That guy know me. He came to my store that got broke in. I live right over there across the street. Who called y'all? - [Policeman 4] That's what we gotta figure out but first. - Who called you? - You live here? - There's a black man watering his neighbors flowers. You think- - [Policeman 4] I'm not saying nothing about- - You have no right to approach me if I ain't did nothing suspicious or nothing wrong. I told him I'm a pastor. I pastor at- I don't wanna hear it - Sir. - If you wanna lock me up lock me up. - Nobody wants to lock you up. - [Michael] Lock me up. I'm not showing y'all anything. I'm gonna continue to water these flowers. - We got a call. - I don't care who called y'all. Lock me up and see what happens, I want you to. - [Policeman 4] Hey man, just come here and talk to us. - Watering these back flowers is what I'm gonna do. Who call y'all? - [Policeman 4] Well if you would let us talk to you we can figure stuff out. - [Policeman 5] You're gonna catch an obstruction charge if you keep walking away. - [Michael] You can do whatever you want. Do it. Do it. - [Policeman 5] We're just trying to talk to you man. Come here. - [Dispatcher] 314-344. - [Policeman 4] (indistinct), we got one that's not listening to us. Look man, lemme see your phone. Lemme see your phone dude. Just calm down okay? - No, no. - [Policeman 4] Stop. - I like this. - [Policeman 4] Okay. We're just trying to talk to you and see. - I don't wanna argue with you, okay? - I know you gotta do whatchu gotta do. Do what you got to do. Go ahead and lock me up. - [Policeman 5] Look, just have a- - So I'm not locked up. You're just got a lawsuit. - Yes sir, yes sir. - [Michael] It's already a lawsuit. - [Policeman 5] Just have a seat, okay? - [Michael] Okay, y'all have a lawsuit. - [Policeman 4] 313 (indistinct) street. 1026, one black male. Sit down. Sit down man, just- - Okay, lemme call my wife. - [Policeman 4] You're not calling nobody. - My son just got racially profiled in Michigan. He's got his master degree. He's the athletic director. Three policers profiled him, came in. I was ex-police officer, a good one. I told you I'm a pastor. - Okay look man. - Who called y'all? I'm trying to (indistinct). - [Policeman 4] You will not listen! - I have a call on you. You have to identify yourself to me. You understand what I'm telling you? - No I don't. You can wait all you want. Take me down, boot me. Go do what you need to do. Go do what you need to do. - [Policeman 4] I think it's gonna be. - Can you please call my wife right quick? - [Policeman 4] We're gonna wait off. Will y'all sit with him Jeremy? I'm gonna go over here and assist people over here. (indistinct chattering) - 3-3. (dispatcher speaking indistinctly) - [Policeman 4] Can we have the 72 that called? Step out, talk to us? (dispatcher speaking indistinctly) (Michael speaking indistinct) Hey, you know what? You know what? 10-15. 10-15. 10-15. I ain't gonna sit there and have that dude. - Will you (indistinct) my wife? - [Policeman 4] No, you ain't letting nothing. - [Michael] Appreciate it. Okay, I will. - [Policeman 4] 3-13. You show me 10-15 one black male. - [Dispatcher] Alright. - [Policeman 4] I gotta get gas so he needs to go on someone else's. - Just call it the jail, I call it the jail. - Hop on this car right here. - [Policeman 4] All right, I mean I don't know if they called. - We'll look on the log and see who called. - [Policeman 4] I mean I saw the gold SUV and I saw him outside and all I did is say, "Hey man, do you live here?" "No." "Is that your car?" "Not it's the neighbors." So I'm finna go over here and run the tag. - [Policeman 5] Okay. He's not gonna cooperate. - [Policeman 4] Oh no, sitting there hollering. - [Policeman 5] I'm trying to explain to him that we got a call, we have the right to identify him and he says I'm talking to him like a child. - [Policeman 4] If you're a pastor and you're here watering a neighbor's yard, that's fine if you got permission. - [Policeman 5] No trespassing. Private property. - [Dispatcher] 3-13, 10-72 stepping out. - [Policeman 4] 10-4. 3-13 swapping director. - [Dispatcher] Copy. - [Policeman 4] 3-13 on record. - [Dispatcher] Hi you're up. - [Policeman 4] 3-13 can you run a 28 for me? Thank you. A golden color Chevy Tahoe. This is 505? - [Policeman 5] Yes. - [Policeman 4] She says she's stepping outside. Can you talk to the 72? You know that gentleman back? - Yeah. - [Policeman 4] You do? - Yeah. - [Policeman 4] Does he have- - He lives right there. - Okay does he have permission here to be watering flowers? - He may because they are friends. - [Policeman 4] Okay. - And they went outta town today. - [Policeman 4] Right? - He may be watering their flowers. - [Policeman 4] Okay. - It would be completely normal. - [Policeman 4] Okay - Now this was the police officer's cue to make things right. The woman had clearly told them that Jennings and the people he was watering the plants for were friends. But as sometimes happens, ego can get the better of even those tasked with upholding the law. - [Policeman 4] If he would've said, "Hey, I got this." Gave his identification 'cause he's a suspicious person. He said that's not his vehicle, it's their vehicle. - Okay. - We were called. We're here because we're called here. I don't know who called but somebody did. - [Policeman 4] Did you call us? - [Dispatcher] 3-13. (indistinct) on the Childersburg on a 2004 Chevy Tahoe. No color listed. Registration is valid until 6:30 of 22. Negative 29. - [Policeman 4] 10-4, you did say their name's Roy Malan. - [Dispatcher] 10-4. - [Policeman 4] (indistinct) thanks, Wamacks out. - [Dispatcher] 10-4. - Yeah, he lives right there. And he would be watering their flowers. This is probably my fault. - [Policeman 4] Okay. Do you know who Roy Malam is? That's that's the person that owns that vehicle. - [Policeman 5] Roy Malam? - [Policeman 5] Roy Malam. - That's him who owns the house. I don't know the guy's name. I don't know who owns. It's probably, it could be their vehicle. - [Policeman 4] Step out. - Sister Connie and- - [Policeman 4] What's wrong with you? - [Michael] My cuffs a little bit tight if y'all don't mind loosen them up. - [Policeman 4] Listen to me, man. Is that better? - [Witness] I actually was about to go over to his house. - [Policeman 4] Listen, lemme talk to you. Who is Roy Malam? That's you aint it? - I'm Michael Jennings sir. - [Policeman 4] You're Michael Jennings. Who is Roy Milan? - I don't know. - [Policeman 4] Okay that's who that vehicle belongs to. - Yeah all I know name is Roy. - [Policeman 4] That's who lives here. - That's Roy. I call him Roy and call his wife Connie. And I've been dealing with him for seven years that I've been living here. - [Witness] They are friends. - [Policeman 4] Okay. - So you called not because of a car, but because you thought you saw someone besides him? - [Witness] Right, I didn't know it was him. - Yeah, I gotta keep their flowers watered. I gotta keep their flowers watered while they gone. You okay. And by the way, I won't get the cops to the (indistinct) but we're gonna give your son something. - [Witness] No don't- - Yeah. - [Policeman 4] Listen to me man, listen to me. Anytime the police come out and they say we want to identify you, you have to identify yourself because there's a reasonable suspicion, there's a reasonable man, there's a vehicle. There's a reasonable suspicion that you're here. That's not a crime. - [Policeman 5] Yeah. - If you would've said, "Yeah, here's my name, here's everything." We were like okay. - No, I told him my name. - [Policeman 4] You didn't tell me your name - Yes I did. He asked me who I was, I said, "I'm pastor-" - [Policeman 4] You didn't give it to me when I first asked. - Pastor Jennings. Pastor Jennings. That's not a name. That's a pastor. - Yeah, the way y'all handled this situation was totally wrong. - [Policeman 4] Well listen- - You racially profiled me. - [Policeman 4] We're not racial profiling. - Yes you did. - [Policeman 4] No sir. No sir. We're not about that. - I told you I was here watering the flowers. - [Policeman 4] How do I know that's the truth? Anybody could- - Because I had the water hose in my hand. I was watering the flowers. - [Policeman 4] Anybody can pick a hose pipe up. - He is going to be so pissed when I tell him I got arrested for watering his flowers. Seven years we've been friends. - [Policeman 4] Look, we got that. Look, let's sit back in here. - You got it? - [Policeman 4] You can sit down. Give me so we can get this going on the ball, all right? What is your social? - I'm not gonna give you my social. - [Policeman 4] You need to give me your social. - I'll give you my name. That's all I'm gonna give you. You're not gonna run no 27 and 28 on me and get me in the system for no reason. - [Policeman 4] Alright. Where should- - The girl went and told you who I am. - [Policeman 4] Okay yes. - I'm Michael Jennings. That's all you gonna get. - [Policeman 4] Michael Jennings. - [Policeman 4] Spell your first name. - M-I-C-H-A-E-L. - [Policeman 4] A-E-L? - That's it. - [Policeman 4] Jennings. J-E-N-N? - Yes, sir. - [Policeman 4] I-N. - G-S. - [Policeman 4] G-S. What's your date of birth? - 1/17/66. - [Policeman 4] 1/17/66. Alright, sit in the car for me. - Yes sir. - [Policeman 4] We'll handle this in just a second. - Can you (indistinct) it's hot? - [Policeman 4] Yeah. Can you let the windows down a little bit for him? What are we going do with him? - We'll see the charge of, I guess disorderly conduct, the failure to obey a police officer. He refused to give any information. - [Policeman 4] I got it. He said he's not gonna give me his social, but he gave me his name and date of birth. - And she's saying the same thing. She won't give her name. - [Policeman 4] Her? - [Policeman 5] Yeah. Because he got arrested. - [Policeman 4] Jesus Christ. - [Policeman 5] So we'll just go by the computer on there. - [Policeman 4] Okay. - [Policeman 5] I'll write a statement with you. He told me, I tried to explain it to him. - [Policeman 4] Right. - [Policeman 5] And he said I'm talking to him like a boy. I said, if you'll just listen to me, you're being audio and video recorded. What we're trying to do is identify yourself and what's going on here. He wouldn't even let me. He wanted to yell over me and say we're racial profiling, I'm talking to him like he's a boy. - [Policeman 4] Nobody was doing that. - [Policeman 5] Mm. - [Policeman 4] 3-13 swapping back director. 3-13 on records. (dispatcher speaking indistinctly) (foot steps rustling) - The officer took to watering the plants himself possibly in a bid to clear his head. Yet he remained resolute in his opinions and continued to pin his failings on the helpless pastor. (foot steps rustling) (water splashing) - [Policeman 4] The water was on. - How about, I mean- - [Policeman 4] All he had to do was identify himself. - That's exactly, that's it. - [Policeman 4] Jesus. (officer speaking indistinctly) - And there's no problem calling the police. I hear you, there's no problem. Pull him up on move? - [Policeman 4] No, I got his old in now. - Yeah. I'm doing the same thing. But her name and phone number's gonna be on the notes. - [Policeman 4] Is it now? - [Policeman 5] It will be. She's already called 911. - [Policeman 4] Brandon knows her pretty well. Where's it at? Suspicious view - [Policeman 5] Amanda and here's her phone number. - [Policeman 4] Yeah. - [Policeman 5] If we have to get her last name, all we gotta do is go by and run her tag. - [Policeman 4] What's she running for? - [Policeman 5] I have no idea. - [Policeman 4] Shouldn't be anyone at the residence. - He's getting his wife just so y'all know. - [Policeman 4] Okay. I mean this could have been all avoided if he would've just- - Well I told her that and every time I try to tell him, he says, you good man. I appreciate this, appreciate that, you know 'cause- - All he does, racial profiling, he's suing. That's all he would say. You couldn't talk to him. - Well I wasn't gonna detain him until he walked away, started coming to the front yard saying he's coming to water these plants. And then he gets his phone out and he just keeps speeding, walking away. And I said, "Okay fine. Come here." Because at that point I realized he's not gonna do anything to help us out. - [Policeman 4] What's the charge? So just obstruction? - Just a little obstruction. - Obstruction. - [Policeman 4] I'll just do obstruction. - Obstruction, governmental operations. - [Policeman 4] Yeah. We're here to investigate a call and he wouldn't give us his name or any- - Yeah we told him I was trying to call the owner, but still I need his name. You know we gotta have his name. - [Policeman 4] Yeah. - I'll take him over to the PD for you. - [Policeman 4] Yeah, I'll go get gas. - If there's no- In the bond book, if it's not listed, you just do the lowest one, the 500. I dunno if it's gonna be in the bottom book or not. That way we won't be overcharged or anything like that. - He seems like a reasonable nice guy. I don't understand. - [Policeman 4] Yeah. - [Policeman 5] He shouldn't, he asked me- - [Policeman 4] If he's a Goodwater police, he said "This aint a identifying state". Yes it is. - Well, I mean, it doesn't matter he's pastor or if he's a pastor or not. Like (indistinct), nice enough, reasonable guy. (dispatcher speaking indistinctly) Just talk to us man, like (indistinct). (dispatcher speaking indistinctly) - [Policeman 4] 10-4 we're 20-4 stat. (dispatcher speaking indistinctly) Did you get his phone? (hand thumping) (car chiming) (engine revving) (dispatcher speaking indistinctly) Aw f**k got the whole cul-de-sac. (car door chiming) (Mariah speaking indistinctly) - [Michael] They don't have no crime. - [Mariah] Are you kidding me? - [Michael] It's okay. They're working it out. It'll all work out. - I can tell you what all happened if you like ma'am, real quick. - Okay. - [Michael] That's my daughter, Mariah right there. - You're good, you're good. So we got a call. - [Michael] Tell Mariah. - [Mariah] Hold on his wife is coming, so you can do this once? - Okay. That's fine. - [Mariah] Come on. I looked out the door daddy. I was wondering where you were. - [Michael] Yeah. - [Mariah] I thought you was outside doing- - [Michael] They tried to make me identify myself. I told them I don't have to identify myself. I aint commit a crime. She came over and told them that I was, she made a mistake and they still wanna try to do something to get an obstruction charge because I wouldn't listen. - Okay I'll tell you what's going on, okay. And, so we got a call here, okay? Yes ma'am. Okay, we'll need his ID. - [Policeman 4] You want us to take his whole wallet or- - I just wanted you to know who he was. - [Michael] No ID. - [Policeman 4] That's fine, okay. - Okay. - If he don't give me an ID and we don't have a way to identify him, I will have (indistinct) John Doe. But if he's got it then that's fine, okay? - Yeah he's, okay so he's been identified, he's identified himself, she's identified him and verified who he is and where he lives. - I'm the missionary sir. - [Policeman 5] So when we get here, of course we're going to immediately investigate the call. - Yes. - [Policeman 5] Find him on the scene. All he's doing is watering the plants and that's not a problem. - [Mariah] What do you want us to do? - [Policeman 5] We say, "Hey sir, we have a call here, we need you to identify yourself please." "No, I'm not identifying myself. You don't have to identify me" and so on. And he begin to walk away. He just, wasn't listening and walking away, so we detain him. We don't know what's going on. - Gotcha. - After that we radioed for them to contact her and have her step out and talk to us what she does tell us is it's a mistake. - Yes. - And all that stuff. At this point, he's already collected the charge. Once we place him under arrest, we can't unrest him. Does that make sense? - This is so simple. And the neighbor just told him this morning, "Please, water the plants." - And he said that but afterwards. It was all afterwards. And all we told him was like, if you're here to water the plants, that's okay. Just please identify yourself, just your name and let us call the owner. And he didn't wanna do that until he caught the charge. - Oh my God. So What do we need to do now? - He's gonna go to the (indistinct) Police Department. We're gonna process an arrest report. It's gonna be one charge for obstruction of our investigation. He'll go to the jail. He can bond out immediately. We can give you a bondsman it'll be 10% of bond. - [Policeman 4] So it'd be like $50. - We're not investigating a crime. We're investigating a call and we have a right to identify anybody involved in that. - [Witness] He didn't identify himself. That's it. - [Policeman 5] He's walking away and yelling at us and telling us we have no right and we have a call there. But if he wants to fight in court, that's fine. - Is it okay if I talk to him? - [Policeman 5] Yes ma'am. Go ahead. - Is it okay? - That's fine, no problem. You both, can if you like. - We need to clear up. - [Policeman 5] Huh? - Clear up. - [Policeman 4] We need to clear up? - Yeah. - [Policeman 4] All right, (indistinct) we gotta go. - As a former detective, let me tell you, if a law enforcement officer claims that once someone is under arrest, they can't be unarrested, then that person clearly hasn't got a clue about their own job. It's no surprise that the charges against Pastor Jennings were dropped. - [Host] Imagine being a thoughtful neighbor, watering your friend's plants while they're away only to get arrested. If only the officer had spent more than five seconds deciding to make an arrest, maybe things would've turned out differently. But while state laws might allow some rooms for such behavior, it's quite something to see officers acting as if their authority surpasses that of medical professionals who have dedicated years of serving others. - [Nurse] Oh my God! Stop! - [Policeman 6] Hey! - Stop! a bizarre incident unfolded at a Salt Lake City hospital. The hospital had a policy not to allow blood to be drawn without a warrant or the patient's consent unless the patient was under arrest. However, detective Jeff Payne was adamant about obtaining a blood sample from an unconscious patient despite the nurse politely explaining this wasn't allowed. Little did the nurse know that simply doing her job was about to spin things out of control. - [Nurse] What I've been told to do. - [Jeff] Okay. - [Nurse] So I'm not Okay. Can you cut the corners a little bit? Like touch, like just shave down the edges? Hey. (Nurse speaking indistinctly) (speaker 1 speaking indistinctly) - [Speaker 1] And watch command (indistinct). If this is the deal he told her if I don't, if she interferes in any way of me getting the blood drawn she is to be arrested. So this can't be the first time this has ever happened. So why is it weird now, you know? - I've ran into something similar but they ended up with- I've never got this far. Where's her boss? - [Speaker 2] Oh she been talking to her head call. - [Speaker 2] Hi. - [Speaker 3] Here they are guys, black? Will you get one coming up or is there more? - [Speaker 3] As far as I know, I'm the only one. (speakers speaking indistinctly) - [Jeff] No problem. I'm recording. - [Brad] Hey, it's Brad, I need your help. I need it down in the emergency room. - [Speaker 4] What was that? - [Brad] I think I need you to come in if you can, I have officers who (indistinct). (speakers speaking indistinctly) - [Jeff] This can't be the first time. I mean, seriously it can't be the first time we have to draw blood on somebody that's unconscious. - I've seen it be done. - [Jeff] I mean, this has to happen all the time. (indistinct) three or four times. (policeman speaking indistinctly) - [Jeff] Oh upstairs, yep. Where's she at right now? - [Speaker 5] So did he cause the what? Did he kill somebody? - We don't know about that but yeah, they just called her. He was trying to (indistinct) their friends. So that's why. - [Speaker 5] Oh. - We're trying. - [Speaker 5] Sure. - That's why we brought him. (Jeff speaking indistinctly) - [Jeff] Exactly. So at what point do they understand they're violating life. You gotta click, click (indistinct) go through this. Especially if you eat a lot. Oh, that the lady (indistinct) because it's sides. Yeah (indistinct). (indistinct) application. (speaker speaking indistinctly) - [Policeman 6] You know what? Maybe it'll prove a point. - [Jeff] We had one of our guys like employees. (nurse speaking indistinctly) - [Jeff] For interfering I guess. Yeah for obstruction. Cool. (nurse speaking indistinctly) (policemen speaking indistinctly) (policemen speaking indistinct) - Hold on Brad, so I printed this off. This is what I was told to print off. (healthcare worker speaking indistinctly) Brad I'm just putting you on speaker so you can- So I have this, it says obtaining blood samples for police enforcement from patients suspected to be under the influence, okay. This is something that you guys agreed to with this hospital. The three things that allow us to do that are if you have an electronic warrant, patient consent, or patient under arrest. And neither of those things, patient can't consent. He told me repeatedly that he doesn't have a warrant and the patient is not under arrest. So I'm just trying to do what I'm supposed to do. That's all so. - [Jeff] Okay so I take it without those in place, I'm not gonna get what? Is that- Am I fair to surmise that? - [Brad] Alex, you're not represented. You're not represented, (indistinct). - Yeah. I don't know. I have no idea why he's blaming me. I'm just representing. - [Brad] Why are you blaming her? - This was the moment things started going south. Detective Payne showed no respect for the nurse or other hospital staff who are simply abiding by their policy. - [Jeff] She's the one that has told me no. - [Brad] Sir you're making a huge mistake. Like you're making a huge mistake. - We're done. We're done. No, we're done. You're under arrest. - [Speaker 5] Hey. - [Jeff] We're done. - No, no, no. (nurse screaming) Somebody help me. - [Speaker 5] Hey. - [Nurse] Stop! (nurse screaming) You're assaulting me. You're assaulting me. Stop! Stop! I've done nothing wrong. - Ma'am I understand your (indistinct). Oh my God, I've done nothing wrong. Yeah but it's wrong what is happening. (men speaking indistinctly) This is crazy. This is crazy. (men speaking indistinctly) Why is he so angry? - It's fine, okay? I'm leaving. - Tell Brad to help me. (men speaking indistinctly) - He will be taking that. Okay? So take your (indistinct). (men speaking indistinctly) - Sir. - [Policeman 6] You can talk to him. Let him take her to the car. (nurse speaking indistinctly) - [Jeff] Ma'am walk. - [Nurse] No, I don't need to walk. (nurse speaking indistinctly) Please I can't believe this. What is happening? What is happening? - [Speaker 4] Where do you (indistinct). (nurse panting) Brad. (men speaking indistinctly) - [Nurse] Brad what is going on? - Now let's call him Calm down okay. Calm down. So I'm trying to get (indistinct). (alarm blaring) Perfect. So right now- (man speaking indistinctly) Officer can I get your name? (Jeff speaking indistinctly) - E-A-Y-N. - E-A-Y-N. What's your badge number sir? - [Jeff] H630. - H630. Okay, no I know (indistinct). Brad, I got another (indistinct). - [Policeman 6] Is that her phone? - Yes. - [Policeman 6] Leave it to her. - Damaged by- - [Speaker 5] Yes. - [Nurse] Please take my phone. - [Speaker 6] I'll take it. Do you want- You don't want it? (police siren blaring) - I want him but I don't know what (indistinct). - Well I can put it on your lap or, you'll want it. - What's happening? I don't understand. (nurse speaking indistinctly) - [Jeff] Hi sir. Would you like to speak to this young lady? - Well, I need to talk to you first and I'll talk to her. - [Brad] Hi, this is Brad supervisor again. Hey, they have arrested (indistinct). I don't know I have, absolutely. Thank you (indistinct). - [Policeman 6] Hey, they're busy. Give him a second. - [Policeman 7] You give a second. - [Speaker 7] Connecting with the call you're on. - [Policeman 7] Hey, can you give him a second? He will talk to you, I can promise you that. Give him a second. (men speaking indistinctly) - (indistinct) the problem is this. You're telling me what your problem is and I appreciate that you have (indistinct). - [Nurse] It's not my fault. - No, no, no. I know. I understand that. You're telling me about a policy (indistinct). I appreciate that. What I was trying to tell you on phone is the law. And what I'm trying to say is (indistinct). - [Nurse] It's not an issue of me taking it up. I'm also obligated to my patients to protect them. - Okay, the person that you're trying to protect is the victim. (indistinct chattering) - [Nurse] No my point is he's already been given medication, to make him uncomfortable. So any of that information would be a good point. - No, no, no. The hospital records will clear that the level that it was given, okay? You're trying, no, you're trying- - [Nurse] But that's not gonna help me. - You're trying to legal defend. - [Nurse] No, I'm not trying to do anything. I'm being told what to do and what I've been told. - Okay, and what I'm trying to tell you is we wanted blood from this guy now. I have talked to people and there's probably a much better solution we could have come to, okay? But, but all we had- (beep beep) And my point is if we're breaking the law, if we're doing wrong- - [Nurse] Please call Carl Miller. - [Policeman 6] Just listen to him. - Listen to me. If we're doing wrong, there are civil remedies, okay? It's called (indistinct). If we took this blood illegally, it all goes away, alright? So there's still remedies. What I'm telling you is you're not taking, okay? I've done this for 22 plus years. I know what the law is to search and seizure, alright? And what you have done because your (indistinct) has been to permit this officer who's called out to do a job, to do his job without obstructing each other. Okay? Okay. I understand you're not trying but you're succeeding. That's the problem, okay. And so what we wanna do is, tell me this, you practice (indistinct). Did he come in unconscious? Okay. So you can't even answer my question. I know, of course. Okay. But see if, do you take (indistinct)? Yeah. as soon as they come in, right? Okay. I understand that. Okay. If I knew that beforehand, I would've just had told Logan to come and get a warrant and access that blood that you guys have already drawn. Okay? But this is stuff that we could discuss. Not when you are telling me no, no, no, no, no. I'm not gonna do it. - [Nurse] I didn't say no, no, no, no, I said- - Yeah but I tried to explain my point. You said it fight what you say, I'm not letting you do it. - [Nurse] No, don't do that. - Another officer was now trying to reason with the nurse insisting that his law was different and held more authority. Well guess what, officer? That has to be the most abhorrent explanation ever. - And I told (indistinct). - [Nurse] I just wanted to clarify it (indistinct). - Right. - [Nurse] And the people that were trying to be there. - Does this person, do you know if this person is arrested that we're trying to get blood done? - [Nurse] I have no idea. - Another problem, okay. Why are you involved in this? You don't have anything to do with this. (nurse speaking indistinctly) - [Policeman 6] (indistinct) I can give it to her. - You're not trying to understand. You're trying say (indistinct). That's all you're doing because I'm trying to explain. And all I'm doing is, well I can (indistinct). I can't, I can't. No, no, no. And I'm trying to tell you, I understand that that is the policy (indistinct) but your policy doesn't affect (indistinct). - [Speaker 6] Sir yes, there are people coming. And I have, Tracy's coming. Brad is coming. Colleen is coming. Sir I have the hospital privacy officer (indistinct) right now. - [Policeman 7] And what does he know about this individual that I've tried to get blood from? - It's what we've told him. - Okay so he has no idea, I don't need to talk to him. Okay. 'cause he's gonna tell me what your policy is and I understand what your policy is. I'm trying to tell you what I need legally, okay? And your policy right now is contravening what I need legally, okay. Which I may not need if you have blood then I can get Logan to come and get a warrant and test for later, okay? But this is all stuff that we should have a conversation with before I'm told no, no, no, no, no, no, no, no, okay? There's a very bad habit up here of your policy interfering with my law, okay? I am trying to conduct a criminal investigation step through the process, okay? And you guys are trying to prevent liability coming off the hospital and I appreciate that. But those sometimes don't meet and they don't match up. And so I gotta decide what we gonna do with (indistinct). I need to find out if this guy has driver's license. If he does- - [Speaker 6] Do we know his name? I can start looking into it. - [Policeman 7] William Gray, yeah. - [Speaker 6] William Gray. About how old is William Gray? (men speaking indistinctly) You attached to his log? (beep beep) - [Policeman 6] It's on. - [Speaker 8] On the top of my what (indistinct). - [Policeman 7] Hold on. - Hello? - [Brad] Hey where'd you say at what? - [Jeff] See my blood drop yet? - [Brad] Do you hear me? - Yeah. (indistinct) it should be right there. - [Policeman 6] Yeah. Yeah, I got it. (policeman speaking indistinctly) - [Policeman 7] Thank you, bravo. (dispatcher speaking indistinctly) - [Policeman 7] (indistinct) take that burglary, fourth offense. - [Speaker 9] Roger (indistinct). - Bravo 237. - [Dispatcher] Bravo 237. - [Speaker 9] I can take a fight at Fairmont Park - [Dispatcher] (indistinct) started that way. If you'll see, check the guy out over by the bike park. (indistinct) about 35 minutes. The group of people are just in the area there. One piece of the guy on the ground. (dispatcher speaking indistinctly) (policeman and woman speaking indistinctly) - [Policeman 6] Hey, I'll put this back for you. Hey, 10-14. I'm not seeing cut (indistinct) if that change. - The nurse who was so rudely arrested settled with the city and the university that owns the hospital for a tidy sum of $500,000. Fortunately, the officer didn't escape unscathed either. The Salt Lake police department fired Detective Jeff Payne. If officers can act so poorly towards those protecting fellow human beings, it's no surprise they act petty and take offense at people helping stray animals. - It's gonna get ugly if you don't stop. - [Speaker 10] Can I please say one thing? officers from the Wetumpka Police Department in Alabama pulled off the ultimate crime busting feat by arresting 61-year-old Mary Aulston and 85-year-old Beverly Roberts simply feeding and trapping feral cats to have them spayed or neuted. This is how the arrest unfolded. - [Policeman 8] Good morning. - [Speaker 11] 350 green in color status is currently (indistinct) negative. - [Policeman 8] How are you? - I'm good. How are you doing? - [Policeman 8] Good. Alright. What are you doing? - Trying to trap some cats. - [Policeman 8] Okay. Alright. Well we got a call that somebody was out here feeding the cats and stuff like that so. - I'm trying to trap them. - [Policeman 8] Okay, you have your driver's license with you ma'am? Where do you take 'em once you trap 'em? - Okay, wait a minute. I got three. Y'all have three cop cars because I'm feeding cats? - [Policeman 8] No we always- - Wow. - [Policeman 8] We always do this, it's fine. - It's unbelievable. - [Policeman 8] Thank you ma'am. Alright, gimme just a second Ms. Aulston. - [Mary] Okay. - [Policeman 9] That would be a good one. - [Policeman 8] Why don't you come up here and learn how to do this. (policemen speaking indistinctly) - You have formally trespassed from this area right here. So if you come back, when we catch you out here, you go to jail for criminal trespass third. (Mary speaking indistinctly) - No ma'am. - [Mary] This is public property. - City property. (Mary speaking indistinctly) Yes ma'am. - [Mary] Which makes it public. - Yeah and the city does not want anybody feeding the animals around here because they're becoming a nuisance. - I'm trying to help that nuisance by catching 'em. I mean they should be thanking me. I've got a trap set right there trying to help catch 'em and get 'em outta here. - [Policeman 8] We have animal control so they're certified for that. - I know that and Terrance knows that I tried to help him catch them. - [Policeman 8] Okay. We're telling you no. Okay the trespass stands. Just don't be around here trapping 'em anymore, okay? All right you have a good one. What are we doing? - Stopping to see if I was okay. - [Dispatcher] Are you 10-29 or 10-28? - [Policeman *] Delta Victor 57701. Well ma'am we told you to leave this area. (Mary speaking indistinctly) - [Dispatcher] 10-28, return to Beverly Robert. - [Policeman 8] (indistinct) going jail. - [Dispatcher] (indistinct) gray and color 29 negative. - I'm teetering on going to jail for feeding cats. - [Policeman 8] Well, for trespassing. We told you to leave and you haven't left. I could take you to jail now. I'm not trying to do that. Ma'am, do you have your driver's license with you? - [Beverly] Yeah. - I mean, we're trying to do a good thing. - [Policeman 8] Thank you ma'am. - I don't, we're trying to help, we're not- (policeman speaking indistinctly) - [Policeman 8] You wanna handle her? She's still not leaving. If you wanna take her to jail too, go for it. - [Policeman 9] Alright Ms. Roberts. Okay, apparently they've had an issue with you out here before with the cats. - Not here. - [Policeman 9] Feeding the cats out here, right? - Well, I feed them, we've been trying to trap them and we get them neutered and then get them homes. - [Policeman 9] Okay. - So we're trying to do the city a favor. - [Policeman 9] Okay, well the city has asked you multiple times. - The city? - [Policeman 9] Yes ma'am. Not to do this, okay? And they have trespassed you, okay? And now you're trespassing. - I'm sitting in my car, I'm not- - [Policeman 9] Well ma'am, you're on the property. You've got cat food, okay? It's pretty, I mean, all in the back seat. It's pretty clear what your intent is, okay? All right so because you've been trespassed and you have returned yet again, we're gonna have to take you to jail, okay? - Jesus Christ. - No, no, no, no. - No! - You can go too. - I'm just- - No. - So I'm not allowed to talk? - No that doesn't involve you. - As if stopping someone from feeding stray cats wasn't bad enough. The way the officers treated the elderly lady and her companion was nothing short of appalling. - [Policeman 9] You've been told at least 25 minutes ago. So you were trespassing here. - I will call a lawyer, alright? - [Policeman 8] Yes ma'am that's fine, you can call. You can call a lawyer as soon as you get to the jail, okay? - Yes, exactly. - [Policeman 8] Yes ma'am. - Go ahead and get in your car. Go ahead and get in your car. - [Policeman 8] Ma'am go to your car before you get arrested. I guess you want it too. - No, I just wanted to say something. - [Policeman 8] Okay get in your car. - You can go ahead and get in your car. - [Policeman 8] Get in your car. Alright, Ms. Roberts I'm gonna have to get you to step out, okay? - I'd be trespassing if I did. - Well ma'am, you're already trespassing. - S**t you all are unbelievable. This is what you're wasting city gas on? Jesus Christ. - [Policeman 8] Step up here for me, okay? - Now wait a minute. - [Policeman 8] I'm not gonna, listen to me. - I'm not listening. - [Policeman 8] Hold on where are you going? - I'm gonna give her my car keys so she can get my car to my house. - [Policeman 8] Here, give it to that officer right there. He'll hand him to her. - [Mary] I do wanna say one thing to you. - Hey, it's gonna get ugly if you don't stop. - [Mary] Can I please say one thing? - [Policeman 8] Okay now you just got another charge. - [Mary] Can I say one thing? - [Policeman 9] Get out, get out.
