I get that you think that you were traveling, at your operating, whatever you want to call it, but you were driving a motor vehicle on the roadway. >> I've been taught this by attorneys. >> If your attorney told you wrong. >> Have you ever heard of the Black's Law Dictionary? You have literally kidnapped me and thrown me in a cage. >> Welcome back to the Van Balion Channel, guys. Today we head to Georgia, where another traveler tries every pseudo-legal trick in the book in a lame attempt to avoid jail when he gets pulled over at a license checkpoint and refuses to identify. The video begins after the initial interaction with the suspect already detained in handcuffs. >> All right. Remind me of the call I was on with you that I helped you out on. >> I don't I don't honestly I don't remember. I mean I know you look familiar, but I don't remember the call. >> I was picking up my son and I was supposed to meet uh them at Waffle House, but I was helping his mom out so she didn't have to go all the way to Ringgold. And he had just started school. He didn't want to go with me cuz he said he was tired. And >> Okay, I do remember this. I do remember this. All right. >> I went to court and I caught her under oath lying and I told the judge I had body cam footage. >> You took her like to like civil court or >> It was already a court case that she was >> Like for child custody stuff? >> Yeah, cuz they were saying that he didn't want to go with me. >> Okay. >> A softie embroiled in a custody case where the child allegedly doesn't want to spend any time with his dad. What a surprise. >> So listen, Kyle. I understand that you feel like you have the constitutional right to refuse identify yourself on a license checkpoint. But under an approved license checkpoint, if I ask for your driver's license, you have to present it to me upon demand of a law enforcement officer. Do you understand that? Do you understand that? Okay, I get that you think that you were traveling, that you're operating, whatever you want to call it. But you were driving a motor vehicle on the roadway. When a law enforcement officer gives you a an order to present your driver's license, you have to present that. Do you understand that? >> I get what you're saying. >> What Where's the disconnect? Can you explain that to me? What's the disconnect? >> If I'm honest with you, are you going to take me to jail? >> I'm just I'm Like I said, you're detained. I just want to know what the what What the I'm I I did not threaten you with jail or anything. I have not one point said that I'm threatening you with jail. Have I Have I Have I Have I said that? >> Mr. Boyd >> Okay, so you're in handcuffs and you're detained. So, I'm just asking a general question. It's not incriminating or anything. I just want to know what the disconnect is. What's the issue? >> What I've been taught by multiple attorneys is that we have the right to be secure in our persons, >> Okay. >> our personable automobiles. >> What's a personable automobile supposed to be? Also, if these attorneys of yours are telling you that that's how the Fourth Amendment should be interpreted, you need to either find better legal counsel or stop listening to individuals who claim to be attorneys online. If not, I would start getting used to those handcuffs. >> Have you heard of the automobile exception? >> Uh What is that? >> I would encourage you to read into it. I would just encourage you to read into it. Do you understand? So, you you showed up to an approved checkpoint. And I gave you an order. I asked you for your driver's license. You refused. You have to present your driver's license. You've been arrested before? >> Yes. >> How many? >> Three. >> Three. For Don't mind me Don't mind me asking for what? >> Uh Let's see. The first one was a altercation between me and my ex. >> Okay. >> They were charges were dismissed. Second one was Uh again with my ex. She brought drugs back or she was getting rid of pills that I didn't know she had. I was involved in that, but I didn't know it. They just brought Charges were dismissed. And the third one was uh traffic. I got in an accident. I got a concussion. And I got tickets. I forgot that I got tickets cuz of a concussion. I didn't go to court. I don't want to go. They were dismissed. >> So, three previous arrests. One for what sounds like domestic violence that got dismissed, a drug-related arrest, and one for failing to attend court. And now you are in handcuffs again because for some reason you're convinced that Georgia law doesn't apply to you. You sound like a fine, upstanding member of society. >> So, I I'm still not quite understanding. Okay? Your driver's license is valid. Your driver's license is valid. You're legal to drive. >> Yeah. >> To do whatever or travel, whatever you want to call it. Okay? >> It's been ruled on in the Supreme Court. >> Okay, so So, why >> You're right, the Supreme Court has ruled on the right to travel many times. But, what they've also ruled on is the distinction between traveling and driving, and the state's right to enact and enforce traffic laws. Unfortunately, you or the people you get your information from conveniently ignore that fact. >> So, if you're legal to drive, why is it such a issue just to be compliant and not just Hey, man. Here's my driver's license. You know what I You know what honestly, I would have looked at it, verified that it's a valid driver's license and that it's not expired, verified your tag is good and in date. And guess what you've been doing? >> Going to play Frisbee. >> You've been going to play Frisbee. But, now you're hemmed up right now and you're detained in handcuffs because you just wouldn't comply for just a few seconds. Do you understand that? Do you know how this how this has went from just a a a super small situation where all you had to do is present your identification, your driver's license, and you're on your way? >> Yep. I believe in the Constitution. >> I and I do, too. I do, too. >> I'm not a slave. >> I'm not a slave, either. I'm a firm believer in the Constitution, as well. >> We have the right to travel freely. >> Okay, but you also have to comply with a law enforcement officer when he gives you a lawful command. >> If I've done something wrong or illegal. >> So, I'm on a proof checkpoint and I've asked you for your driver's license. Then, I tell you to get out of the car. That's Pennsylvania versus Mims. >> I didn't even have a chance. You guys just pulled me out. >> Because I had already asked you to. >> I don't I don't recall that, but it it could be possible. >> Luckily, we didn't have to use no force or anything. You was compliant for the most part. >> Yeah, I wasn't going to do anything illegal. I wasn't doing anything the whole time. >> You >> you technically were. You got to demand your Yeah, for the for the for the entry of your vehicle. >> Supreme Court >> Okay. That's what you That's what >> I mean, I've read I've read that law. >> Well, I encourage you really to go look up Let's see. OCGA 40 -5-29. That's the law since it's been applied. Upon demand of a law enforcement officer. >> If you're a commercial driver I'm not You're not getting paid to drive. >> That's the disconnect between law enforcement >> I don't know where you learned this. >> been taught something that's untrue. I've been taught this by attorneys. >> Your attorney told you wrong. >> You've been taught law school. >> Okay. >> So, if law enforcement personnel are being trained incorrectly, then why are there no successful legal cases based on your arguments? Also, spoiler alert, Georgia code section 40-5-39 contains no language specifying that the requirement to present a driver's license to law enforcement applies exclusively to commercial drivers. >> I I still haven't done anything illegal. There's no >> This is This is marked on this license right here. Give me just a second. What's your name? >> Brittany. >> Brittany? >> Yes. >> Okay. So, Brittany Have I been rude and malicious to him at all? >> No, I >> So, Brittany I I don't really understand the disconnect here. If all he had to done was just show me hand me a driver's license and you're on your way and you're done. And if he wants to argue and complain and say this is unconstitutional or unlawful or whatever he wants to say, that he has a right to travel freely. He can go about his day and say that all he wants. Okay? This is an approved checkpoint with the Georgia State Patrol. We're here to assist. >> Right. >> I have an approved checkpoint form. He has refused to present his driver's license to me. And now he's out of the car in handcuffs. >> Right. >> So now he could he could he could potentially go to jail for what he just did. >> Yeah, I know. >> Do you understand that? >> Yeah, I'm yeah, I'm I'm right here. I'm witnessing it all. >> So I don't know what the disconnect is. And I do appreciate you to telling him back down there, hey, you know, that's just you know, give me your license and you're out of here. That's all it took. But now he thinks that he has the right to travel or whatever he wants to do. And that's not that's not true. It's not true. >> He's just a very firm believer >> Do what? >> I said he's just a very firm believer. >> And I understand that, but what he's reading is very very false. I would encourage him to read something that's a little more up to speed than what's really going on cuz that thing that's not nothing that he's reading is or saying is true. Okay? I didn't hear what y'all were talking about while I was talking to her. >> Well, all I said to him is that his his autograph that he called it is right underneath his picture on the Georgia driver's license, which means that he was aware of the fact that driving on the highway in the state of Georgia is a privilege, it's not a right. And that's all I said. And then I kind of explained to him why we asked him to step out of the car cuz you get some of these folks and they get aggressive like that with guns and knives and grenades and bombs, things like that. And people can be so >> And do you understand that? >> I wasn't being aggressive. I was just trying to talk to you. >> I understand. >> Cuz I want peace. >> So do I. >> I want >> You know what peace would have been? >> I was getting to it. >> You know what peace would have been? >> Talking like adults. >> Present your driver's license and move on about your day. And if you think if you >> I showed it to you. >> Okay. >> Dude, presenting your driver's license after initially refusing to do so does not absolve you of the offense of refusing to identify. That's like, I don't know, like putting the safety back on after you've already shot yourself in the foot. >> Look, man, I'm trying to give you the every benefit of the doubt, but you're not helping me out here. Do I want to take you to jail? Do I think that you're a bad guy? No, I don't. Honestly, I don't. Does he think you're a bad guy? No. Not at all. But this could have been completely avoided if you just simply would have complied. >> To be honest, I I've probably made I mean, six, seven contacts today. They used to maybe eight. I'm not even going to write a citation. I didn't write a citation, man. Nor did I put anybody in jail today. I write twice as many warnings as I do citations, man. And I've never in my entire career I've never pulled somebody over who refused to give me their license. In my entire career, man, I've been doing this for like 10 years. Nobody has ever said, "I'm not giving you my license." No. I've even had guys pull up today who didn't have a license and go, "Hey, man, sorry about your luck, but I ain't had a license in 15 years." You know, "Okay, man, get out." "Okay." No problem, bro. Ain't nobody trying to go to jail today, but Yeah. >> Well, I just want peace and uh I'd really uh really like for us to have a conversation that's not me in handcuffs and me possibly going >> Well, we could have a conversation right here. I mean, please tell me what you would like to say. >> I just wish I could show you what I've learned and you could show me what you've learned and we could be on the same page. >> Okay. >> How can law enforcement be on the same page as someone who is convinced that the law doesn't apply to them? That's like asking a cop to try and play a game of chess while the other person insists the pieces are actually Pokémon and they've just captured a rook with a Pikachu. >> Well, I promise you the stuff that I'm taught they would not send me out here with arrest powers if it weren't the truth. Do you agree? >> Here he he he was just shutting the door. >> Do you agree? >> I know that you've been taught on commercial the uniform commercial code. That's what you've been taught. >> Uniform commercial code. >> That's the UCC. That's what all traffic laws are. >> Okay. >> What do you do? >> So your traffic means here for today. What do you think? Kyle? >> Yes, sir. >> Here is the here is the deal, okay? We're going to agree or disagree? >> Yeah. >> But >> Absolutely. >> You agree or disagree? So I mean as of right now you did refuse a lawful order to present your ID. So you're going to go to jail today for obstruction. >> Just cuz I said the uniform commercial code? >> No, I'm just telling you that's what you're going to go for today. >> Yeah, I think it has more to do with the fact that you obstructed a police officer and refused a lawful order to present your driver's license. But, doubling down on stupidity doesn't help the situation, either. >> So, if you have any pockets going to poke sticks down there. Where is it at? I'm sorry. I'll cut you off. Where is it at? Yeah, I don't even have her number memorized. I'll write it down for you. Just grab a seat. >> So, there's no way to let me loose? >> No, sir. He didn't have her total. >> I really don't have >> Believe me, I'm out. >> I don't know. Maybe use my debit card. I don't know. Chime card? >> 87 cents. >> The deputy now turns his attention to the suspect's vehicle to take a tint reading. >> This your vehicle? Will you please roll the vehicle up, with the window up, just a little bit? >> My tint's off. I've already paid a ticket. It was a $100 ticket, $200 to take the tint off. >> It's good. >> I know it's going to be off. I just paid the ticket last night. >> So, 15. You can't have 15%. >> Yeah, I know. The ticket was $100. It was $210 to take the tint off. So, it was either take the 10 off which I didn't have money for or pay the ticket so I didn't get in trouble. >> Okay. All right. Well, I'm sorry. I mean this could have been completely avoided, but uh I have no choice. >> What's he being charged with? >> Uh obstruction. Uh failure to provide his driver's license so it's a traffic charge and then the window tint. >> Why would he even get a the window tint? >> He was driving at the time. >> What's my >> I mean I can write you the ticket if you want to take it. So. All right. >> And now for the ride to jail where our self-sweet friend continues to whine, refuses to take responsibility, tries to shift the blame, and of course continues to misunderstand the law and his rights. >> Were you about to let me go if I said I'm sorry? >> No. >> You were going to take me to jail the whole time? >> Yep. >> Cuz it seemed like you were trying to get me to apologize so you could let me go. >> I was just trying to get you to explain the disconnect. I don't know what was going on. I tried to to explain everything to you, man. And I mean if you want me to be absolutely technical, that's what me and her were just talking about. Her window tint is 100% illegal. I mean I tested it. And she admitted that she just got a ticket for it. >> You guys have been treating me very wrong. I didn't commit a crime. >> I didn't hurt anybody. There's no victim. You're literally kidnapping me and throwing me in a cage. >> How about me letting you out of the custody and out of the jail? >> And I didn't commit a crime. So, how did I obstruct? Isn't that a physical act? >> No, it's not. >> Everything I've been taught is uh physical act. That's obstruction. >> Obstruct or hinder me in the lawful discharge of my duties. A physical act of obstruction will be a felony. This is a misdemeanor. >> You're taking an innocent man to the cage. When I didn't hurt anybody. Speeding. I wasn't doing anything wrong. Did absolutely nothing wrong. I'm trying to go play frisbee. Now you're taking me to a cage. You guys are trained to hate freedom. You are trained to hate freedom. So, why did you laugh when I brought up the UCC? The Uniform Commercial Code. That's what all traffic law is. The Uniform Commercial Code. Have you ever heard of the Black's Law Dictionary? That's what the court uses as their dictionary. The words in that dictionary do not mean the words that we were taught in school. The word to drive is means to be paid while driving a motor vehicle. I was not getting paid to drive. I'm traveling on a free way. Here. Everything is commercial. That's why it's called the Uniform Commercial Code. You're taking an innocent man to jail. You're going to throw me in a cage for doing absolutely nothing wrong. I didn't hurt not one person. Completely innocent. 100%. Do you feel right in doing this, Ferguson? Is this the right you know, when we were little we were taught what's right, what's wrong. What is it? Is it wrong? This is totally 100% wrong. You do know the Constitution trumps all statutes and all traffic laws. The Constitution is the supreme law of the land. I have a right to be secure in my person, places, things. That's my God-given right. You just violated my God-given right and you're throwing me in a cage for standing on my God-given right. That's what this is. You have literally kidnapped me and thrown me in a cage for standing on my God-given right. >> Hate to break it to you, but there is no God-given right to obstruct police and refuse to identify during a lawful encounter. Also, the ignorance of citing the Constitution while claiming laws derived from the 10th Amendment is amazing. >> I'm not a slave. I am a free man that harms no one. >> Need help? Next. Do what, buddy? >> And that's pretty much where the video ends. He was booked into jail and charged with misdemeanor obstruction and refusing to provide his driver's license.
