Anything you say can be used against you in a court of law. You have the right to speak with a lawyer and have him or her present with you while you're being questioned. You cannot afford to hire a lawyer. One will be appointed to represent you before any questioning if you wish. You have the right to stop answering any questions or giving statements at any time you wish and do not have to give a reason. >> Okay. Do you just understand those at least for now? >> I understand. >> Okay. Do you mind just initialing? That's just each line that I read and that's all it is right now. But I'm not going to ask any questions about uh pertaining to the case. All right. >> All right. I'm a firm supporter. >> All right. So, this is what I'm going to read. It's called the attorney general standard statement. All right. This is going to be pertaining the alpha test and if you refuse your penalties and and such like that. All right, it's a little bit lengthy, so just bear with me. If you need me to reread something for you, I have no problem doing that. All right, >> understand. >> All right, Eugene. You've been arrested for driving while intoxicated. Nisa A394-50. The law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. I repeat, the law requires you to submit samples of your breath for testing. Will you submit the sample egraph? >> Can you repeat that please? Because I didn't understand. >> I think it was the middle third. >> Okay. If the court finds you guilty refusal that one. >> So you said that if I'm not mistaken, pardon me for one second if you're not if I'm not mistaken. I need to submit my breathalyzer without review. >> All right, I'm going to read you >> the third. >> If you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. A court may find you guilty of both refusal and driving while intoxicated. If a court finds you guilty of refusal, you'll be subject to various penalties, including license revocation of up to 20 years, a fine of of up to $2,000. >> Well, why would I lose my license for 20 years? >> Up to 20 years if you refuse. These penalties may be in addition to penalties imposed by the court for any other offense. And I'm going to go back to when I asked you yes or no to submit samples. This is continue this. Your answer was not acceptable. The law requires that you submit samples of your breath for breath testing. If you did not answer or answer with anything other than yes, I will charge you with refusal. I ask you again, will you submit bre uh to breath testing? No, I'm not going to submit to breath testing. >> Unfortunately, I don't >> understand why. >> Does not matter. >> I understand, but I don't understand. >> I just read it for you three times. >> No, no, I get what you're saying. I just don't understand. >> Okay. >> Not arguing. >> It's not arguing. just keep saying the same thing and my answer is not going to change. >> I'm with you. I understand. >> Okay. >> As you were trying to leave from where? >> To go meet Jen and >> Oh, my car is sitting on the side of the road. >> It's not. >> Yeah, it's wherever they put it, but the groceries are in there. >> I will see you shortly. >> All right. I love you. >> All right. Love you, too. >> Bye. >> Bye. Well, that's good. You got her out of going out to dance tonight. >> Going to dance tonight. >> She dances every Saturday. >> That's all she does. >> Where does she dance at? >> She dances at MJ's. >> At MJ's? >> Yeah. She just goes out and dance for and dance. That's what she likes to do. >> Hey, nothing wrong with that. >> She's a bodybuilder. >> Oh, wow. >> So, like we take care of our bodies. Mhm. >> I have no choice. >> Yeah. You got forced into it. >> And she's really good, you know, like, >> hey, it's not a it's a good thing to be into, right? Staying healthy. >> I do a lot of meal prepping. >> A lot of um you know, figuring things out. We're 51 years old. >> Yep. >> So, it' be a lot worse things to get into. >> 100%. you know, so we try to take care of ourselves, the community, and help benefit the kids. And Saturday night, she's like, "Oh, I want to go dance." I said, "All right, >> go ahead." >> Dancing since you were 12 years old. Go dance. >> You're a thing. She said, "I was on my way to go meet up with so and so and so and so and I saw your car on the side of the road." >> Oh, that's how she found it. >> So, the one benefit of this, if there is any, >> um, is it's not criminal. So, it's just motor vehicle tickets. Like there's nothing no >> I just I can't lose my license, bro. >> That is for the courts to >> I I live and die by my license because I drive I'm a I'm a sheet metal worker by trade. >> So where is that? In the city or just up north? >> Excuse me. >> In the city. >> Local 27 which is um Kate May all the way up to Piscato. >> Oh wow. >> And I work for um Incorporated. >> Okay. which is a uh sheet metal workers union obviously. Um they also are pipe fitters union and surface union >> for HVAC. >> Um but I'm a foreman for them and I run work. >> You got a good you got a good job. >> Well, I really try hard, you know, and I've tried hard for a long time. Um I'm I'm about eight and a half years out from retirement. >> Mhm. Um, I joined out of this company in a threemonth stint and I've been there for 12 years. >> 59 to 36. Was your court date the 2nd or the 9th? >> Use the second. >> So I, you know, when I came on, they said, "Oh, we got three month hit for you." and I've been there 12 years. >> It's pretty good. Now, >> you know, so I think I prove myself over and over again. I've never done bad things. >> I don't do bad things. That's not my world. And I donate back to the community. >> Like I said, this doesn't make you a bad person. >> I know it doesn't, but at the same time, I've never been here. I don't want to be here. >> I don't blame you. I don't want to see you again under these circumstances. I I I don't know that there's any circumstances that make me want to be here. >> I would I would say none. >> I know a lot of um a lot of guys and uh they all say the same thing. Well, you've been very professional. >> Thank you. I appreciate that. >> I can't appreciate that anything more than me being professional back here. >> 100%. It goes a long way. >> Yeah. >> Makes just makes it a little bit easier. >> Well, you're just doing your job. What you feel is right is right. Like I said, I wasn't the one that stopped you. So, >> no. But I don't understand. Like, I was told that I was um hitting the left curve and hitting the right curve, but that's not true. >> Okay. >> So, I I'm I'm a little taken back by that and that's why I was, you know, refocusing on the situation prior to me being excuse me, me being here and me being with you on the sidewalk. Yep. I hope my wife got the groceries out of the car. >> They're going to go back. >> I was saying at least it's cold out, so we're not. >> Not that they're going to go bad in some uh >> I was supposed to be doing laundry tonight. >> All my laundry for next week. >> I was say laundry never ends. >> No, it doesn't. >> Every day I do I do mine >> every day. >> It's terrible and I hate it and my wife hates it. That's the worst part. So, so here here's a little input, right? So, my wife will do my daughter's separately and then she'll do herself >> and then hers. So, she does probably easier, I guess, to >> but the girls and my wife all use the same socks. So, she'll there's a community sock drawer for them, right? Which I blow my mind because it would it would kill me. So, then I just say, "All right, listen. You guys do whatever you want to do. I'm gonna do my own laundry when I want to do it and I just take one day out of the week and I just do all my laundry. >> Yeah, I try I'll try to keep up with it every day. But >> good luck. >> Yeah, it's Trust me. I hate it. I'm not a laundry guy. >> You guys are supplied with, you know, your uniform for what? Four days, five days out of the week. >> Yeah. Yep. All right. So, I have a high viz shirt for every day of the week and I have a dark blue shirt for every day of the week. And I just wash whatever I need to wash once a week. My old laundry. >> Yeah, I tell you four days, but sometimes it's uh >> stuff, right? >> Just depends how the day goes, you know? >> Yeah, I have my own laundry bed. I take that laundry bin. I go down the laundry. I wash what I got to wash. >> I'm lucky. My uh [clears throat] my washer is on my second floor. So, it's nice. >> All right. >> Cuz I would definitely be doing it a lot less if it was downstairs. I'll tell you. >> Like stair master is good, bro. >> It is good. >> It is. I go to the gym and I hit it 30 minutes. >> Yeah, I do too. I like to get up at 4:00 a.m., but I just can't seem to break that 4:30 Clark. >> Either way, it's tough to dude. >> My eyes, the alarm goes off and my eyes just don't want to open. No matter what time I go to bed, it doesn't matter. >> Like, you get seven hours of sleep. I'm like, yeah, but I just can't open my eyes. >> I need I need to sleep for 12 hours. >> I need the eight. I need the eight. You know, >> I couldn't tell you the last time I got eight, which sucks. >> I need the eight. I I'll go to bed at 9:00 a.m., wake up at 5:30. >> Yeah. >> And I'm good. >> I get I get off at midnight and then >> You get off at midnight. >> I got a newborn and he screams and cries and I'm lucky. >> God bless you. >> I'm lucky if I get like 5 hours at >> Newborn is so awesome. >> Yeah, it is awesome. He's a good kid. He's a good kid. >> God bless you. I remember when my daughters were newborns. My first >> That's cold. I know. I know what you're talking about. >> It's right at the tip of my tongue. I can't get it out. Anyway, my wife wouldn't leave the hospital. >> Mhm. So 48 hours I'm up straight. >> Oh yeah. >> At the hospital >> and those beds they have >> they finally they finally let her go after being under the blue lights. We got to take her home. >> A little bassinet, right? >> Yep. I wake up after 48 hours of non-sleeping and I wake up after 5 hours and I bring my daughter down to my mother who is sitting in the dining room or living room. My wife wakes up screaming at the top of her lungs, "Where's my daughter?" This is 17 years ago. Where's my daughter? I'm like, I run up the stairs. I'm like, she's with your mother-in-law. She's with my mom. Relax. >> Yeah, it's uh that's the mother. >> Holy [ __ ] >> That mother's tree comes out and >> Holy cow, dude. >> Look, God bless you. >> Yeah, thank you. >> It's an awesome thing, you know, with these kids at 13 years old. Do you have a son or a daughter? >> I got a son. >> Oh, he is going to push your button. >> He already does. [laughter] >> You ain't seen nothing. >> I know. I know. My daughter at 14, she uh my youngest, I thought she was cool, right? >> Like I've taught her everything I need to know and everything that she needs to know, >> training, soccer, basketball, whatever I can give her, I give her. Right. >> Yep. >> She is a pimp. Holy >> age, too. >> Holy attitude. 14 years old. I said, "Listen, I said your dad loves you." And this is exactly This was last night's conversation. So, you really need to back off on the dad. >> I don't know if it's going to change for a couple years. >> Because your dad really loves you, right? So, if you want to talk to me, you can talk to me. You don't want to talk to me, that's cool, too, but just tell me. Don't those all mine? >> Yeah, I'll explain. Uh >> Oh, jeez. All right. What do you got there? >> I explain them to you. So, the officer that stopped you wrote you reckless. So the DWI comes comes with X amount of tickets. It's you have a driving points careless all automatic. Then you have >> is four points. Careless is two points. >> You go to court and like I said you figure it out there. Um let me see what else. Then you have failure to keep right and failure I guess have your vehicle inspected. And then you have two refusal tickets for refusing the alcohol test. Your court date is going to be February 2nd at 9:00 a.m. You'll get something in the mail. They might push it back. Um if you can't make that >> February 2nd. >> Yeah. It's like the initial >> where um >> it's going to be here. >> Where are the rest of my documents? >> In your car. >> In my car.
