on June 24th 2024 officer biner from the fort Meers Police Department stopped a driver speeding at 59 mph in a 40 mph Zone you clearly didn't learn your lesson the first time you got a dii scoot over more thank you do you have anything when the officer approached the vehicle the driver admitted to going over the speed limit and explained that she did not have her driver's license she confessed that her license was revoked but explained that her car was under her mother's name the officer issued two tickets one for speeding and another for driving with a revoked license hello my name is Officer biner I'm with the fort Meers Police Department Traffic Unit the reason I'm stopping you is 59 M hour and a 40 okay I'm going a little too fast all right have your license on you it there huh I do not you don't have it okay do you have one I'm in the process of getting it I I'm just being H okay I recently got A1 okay you know how expensive it is to get the f444 uh-huh this is under my mother's car mhm and I'm just being blond onut with you okay and I don't have one okay so is your license currently suspended okay all right Goa for that no well we're going to have to work that out but uh I'm being me Hest yeah you're being cool with me so I'm like I'm not reason lie to you yeah so I just need your information okay what's your first name okay all right just give me a minute okay all right give me your name one more time yeah is that how you spell it a s t r i d do yeah go ahead like I don't have nothing like you this is under my mother's name okay her name is okay under her name yeah I have her information I just need your information okay I don't you well I appreciate you're not lying to me as the interaction progressed the officer became suspicious of the driver's Behavior suspecting impairment he asked her if she would submit to a field sobriety test to determine if she was under the influence of alcohol or drugs but the driver refused this led to the officer arresting her for driving while her license was revoked and suspected [Music] DUI I decided my daughter does want to the and where's your daughter at school okay but you have the H it oh gotcha Landon so Typhon Cruise what Landon oh got you oh no wa except Brandon thank you okay any who can come pick you up and pick the car up uh the car nobody can have something to pick me up yeah do that here in the parking lot here once I'm done I'm going to ra you a couple tickets and we're going to be on our way all right me a ticket I got have to give you two tickets yeah you're driving while your license is revoked and you're doing 59 and a 40 so yeah you're going to get two tickets but that's better than a 40 though but you're allowed to go 5 miles on the N you're going 5 miles you're going almost 20 M over the speed limit so call somebody right here not yet you wait anymore okay so you're going to come with me all right cuz I'm going to take you to jail so set up why you you're being arrested for knowingly operating a motor vehicle while license revoked all right you've already gotten a I was going to give you a citation for it and have you go on your way but I already see that you've gotten a citation for that before so I have to take you to jail now okay so come on Che out the officer informed her that her refusal to take the sobriety test would be considered a refusal to cooperate which would add to the charges while processing the arrest the officer asked the driver if she had anything on her person that could be considered contraband as no female officer was present to search come on and step out ma'am come on step on out let's go she's going to jail it's all good license is revoked her license is revoked and she knows it so no no cuz you're not the registered owner neither is she can I get my phone [Music] yeah can you give him my stuff take yeah you can take come come with me can he get up why you Tak me I told you driving my license v m say can he take my stuff yes that's what I said and he take my Stu and now while we're at it okay now I have multiple indicators of impairment so I'm already taking you to jail for this I'm going to add DUI to it all right do you want to do you want to do you want to conduct a um the test yes of course all right great so we'll do that at the jail fa for that huh a that do you want to do you want to take the do you want to do Fieldy exercises to determine your ability to operate a motor vehicle I will plead a fifth for that so is that yes or no you're taking ja all right so I'm going to take that as a refusal I'm going to arrest you for driving while license revoked knowingly and I'm going to arrest you for DUI no problem how you going not [ __ ] arrest me for D cuz you have multiple indicators of impairment now we're good to go I don't need to go take a seat can my stop ma'am take a seat now sit down stop trying to pull away for me he also warned her that if she brought any Contraband into the jail she would face felony charges the driver maintained that she had nothing to hide but continued to argue that the officer had no right to search the vehicle stating that it was her mother's car and that she had not consented to the search thank you you clearly didn't learn your lesson the first time you got a dii scoot over more thank you do you have anything on your person cuz I don't have a female with me that's going to search you and if you enter the jail with Contraband you're going to be charged with felonies with that too do you have anything on you that I need to know right now no sir okay well you know what what can I get my phone and he get my stuff anything you need me to do B I'm going to do to can you do Tock please yeah all right Che yep oh we're good now dude she she so she's going to jail for revoked license and DUI so she's good yep don't have to let's see no no got got going well my thing is she told me that she was going to pick up her kid do you know anything of that yeah okay are you able to pick up her kid I got that's why I was trying to give her information okay although the driver protested the officer continued the arrest and explained that he had valid cause to search the vehicle based on her past offenses and current behavior as the arrest continued the driver mentioned needing to pick up her child from school the officer recognizing the situation asked if anyone could pick up the child on her behalf the driver responded angrily insisting that she was being treated unfairly and that there was no reason to arrest her what's that correct uh you're being placed under arrest for operating a motor vehicle while your license revoked knowingly because you already Yes revoked revoked taken away and then now because you know why to have a k okay so do I thankfully I took you to jail so you don't kill your kid so do me a favor and plead keep pleading the fifth and also use your Fourth Amendment right to be quiet you're arting me for no reason yeah I guess right you have a reason for that but gu what I you lock and not [ __ ] take to you a uh not when you're drunk now listen here's my question to you are you going to provide a breath sample are you willing to provide a sample of your breath to determine it's alcoholic content no all right perfect what's that I didn't slam you on the door man you were trying to pull away from me okay I SL like I'm still a woman at the end of the day whether you know me all right well listen to law enforcement next time okay huh I don't care all the [ __ ] chares you want but don't me like that I don't touch my wife man oh but you got to touch me well I told you to get in the car and you failed to listen because doing it for no reason the officer remained calm and emphasized the safety concerns of allowing her to drive under the influence especially since she had previously been cited for similar offenses the driver continuing to argue claimed that the officer had no justification for the arrest and that she was being mistreated that's my [ __ ] don't have to huh I do not have to I don't have to but guess what if I get a lower I do half the year going to lose because guess what you have no Pro that [ __ ] is mine okay this thing stupid and I don't know my l oh I had you arrest me without even reading my mar don't need to you don't have to of course you have to I'm not asking you didn't tell me I was drunk when you pull out to my window it'll all be in the report ma'am you will all be in the report yep go ahead I believe the B you D there because I don't feel guilty for nothing you had no cost to go in my car you went in there without permission so put that [ __ ] in there too not your car huh it's not your car that's my mother what and I'm mother you're bullshitting because there's plent of people they get pulled over without that car bleeding their name and if you had no problem C you didn't go in that car and you didn't act you just went go on cuz I'm going tell you one thing I don't I don't Doone of that still thaty all was while you going to jail 3 what people for what they what wrong so why didn't you tell me this [ __ ] when you lock in the window like an actual professional officer hey guys I'm going to head out um I'm going to call her disorderly cuz she's a little getting a little heated up there so we'll just take her in and then I'm going to knock out the report so I appreciate you V man thank you appreciate you all right yeah and really got alligator up ultimately the driver was charged with operating a vehicle while her license was revoked and DUI and she was taken to Jail the officer planned to charge her with disorderly conduct and would complete the report despite the driver's protests the officer remained calm and
