2024 an officer was on patrol and observed a vehicle speeding on Ocean Avenue the officer noticed the vehicle swerving and failing to stay within its Lane the officer then turned on his emergency lights to pull the vehicle over the driver complied and stopped question I wish I knew 1,000 okay you can do 100 I'm a Psychology major I'm not good at math okay I can I can B I was a cheerleader though I was a cheerleader you can pick whatever foot I can I am really good with B okay as the officer approached the vehicle he asked the driver for their registration insurance and license the driver explained that the car wasn't theirs but their friends the driver said they were headed to Jackson with their friend when asked about their destination how you doing man hey you have your license registration Insurance yeah I have my license right here where you coming from um I'm coming from the bar I'm coming from Point Pleasant Point Pleasant yeah JS bar okay is a registration registration insurance this isn't my car this is my friend's car whose car is this this is my friend's registration who's your friend Kelly hickey I'm her son you're her son yes sir okay I'm who you heading to we're going back we're going to Jackson Jackson yeah okay who lives in Jackson I both of us okay all right the officer informed the driver about their erratic driving behavior in including speeding and swerving across Lanes the driver responded by claiming they were trying to catch up to the officer and were driving at 65 mph despite the speed limit being 35 mph the officer checked the driver's documents and confirmed everything was in order you take this back you can take that what was the uh you you were driving erratically all over the road and you were speeding speed okay and you I was C trying to catch up to you I was going 65 65 on 65 on what it's 35 35 on what road this road so you don't need the registration no I got it you had two copies okay so here this is all good too thank you and then I'll be right with you all right thank you thank you sir no problem the officer asked the driver to exit the vehicle and perform field sobriety tests to assess their level of impairment the driver was cooperative but admitted that they struggled with math though they highlighted their cheerleading experience to assert they were physically coordinated the first test involved walking Heel To Toe along a line a standard exercise to evaluate balance and coordination the driver had difficulty performing the test as they could not maintain a straight line and showed signs of imbalance myth are so should I back up yeah get her over here yeah you want to just go to that officer yeah here stand right all right diona is that is that how you say now di sorry about okay it gives you like a guide so if you you want to stand on that yeah yeah if you want to stand on that line you want to back up a little to your car oh okay so you give yourself more room actually isn't my car but oh well your friend's car so you're going to stand like this with one foot in front of the other with your hands on your side and then I'm going to explain to you the instructions okay yeah so if you want to get like that right now one foot in front of the other Hands by your side okay so what you then do is you're going to take nine to toe steps on this line so I'm going to demonstrate it okay so it's going to be 1 2 3 not yet don't start in oh I'm sorry all good all good so it's going to be 1 two three heel the toe steps yeah okay on that ninth step you going to take a series of small steps turn around and go one 2 3 nine steps back so count to nine and then count to three no count to nine count to nine I did three you're then do nine all right okay so I just did three for a demonstration I got you but you then count the nine count the nine nine nine heel the toe that was nice okay next the officer instructed the driver to perform a one-legged stand lifting one foot off the ground and Counting aloud the driver chose to lift their foot but they struggled to maintain their balance and accurately count despite the driver's claims of athletic ability they failed to complete the test correctly exhibiting signs of instability do I no no that's nope so the next test put your feet to together Hands by your side then whatever foot of you're choosing you lift up 1 foot about 6 in above the above the ground okay and then you then count 1 1,000 2 1,000 3 1,000 you then you got a question I wish I knew 1,000 okay you can do 100 I'm a Psychology major I'm you want I want you to count out loud too okay one two three four all right we're not five six these failed tests and the driver's overall lack of balance raised the officer's suspicion of impairment the officer observed enough physical evidence to believe that the driver could not operate the vehicle safely which ultimately led to the arrest on suspicion of driving Under the Influence at this point the officer arrested the driver on suspicion of driving under the influence the driver repeatedly tried to explain that they were sober and even requested to call their mother to explain the situation the officer however remained focused on the procedure and informed the driver they would be processed and that they could contact their mother once the paperwork was completed seven put your who initially claimed to be fine also faced question Ing and the officer was concerned about their driving ability after some discussion the officer decided the best course of action was to tow the vehicle the passenger who had previously denied driving acknowledged they were not in any condition to drive either the officer suggested that a sober individual should come to pick them up and explain the procedure for getting the driver released after a certain period during the arrest process the driver continued expressing frustration and confusion they admitted to not being the one behind the wheel but still insisted on being sober I mean you Lally just said was I driving said I wasn't even driving why would why would he drive how you doing sir how's it going man good good good uh you're saying that you're good to drive you didn't enjy I'm I'm good if you want to run tests whatever you want to do where you coming from Js Js yeah so what it is under anyone that we lock up for driver well intoxicated it's called johnzo so we technically have to unless like you were like straight up sober but like technically we have to tow the vehicle and I know it sucks is there any way you can find a ride I can the only listen I'm not trying to trust me I'm not trying to tell you how to do your job I'm I'm not trying to give you a bonus for me or whatever she's yeah she goes to school there she's been there for the past whatever was four years at this point she she's never around here yeah it's my fault that we got a situ I I promise you right now I am as so as sober as can you think two hours yeah yeah probably around there process or whatever when I'm done with my process so the sooner I get back and started doing the paperwork I'm going to do it right now so like I'm I mean I promise I am as good to the drive as possible I said I knew she was coming down from from Arizona I knew she was home I'm not trying to pull a fast one on you I'd rather you get a ride I feel all right that'd be perfect as the driver was processed they cooperated with the officer acknowledging her situation even though they still felt wronged by the arrest the officer clarified that they would be held for DUI suspicion and the vehicle would be towed So eventually he was taken to the police [Music] station you right back there 41 C 1011 uh start mileage once he gets in the car 1 12826 once he get why am I back here again Leona right that's your name Diana Diana uh Diana you are being arrested for the suspicion of driving while intoxicated and I was tested for that and I there was
