going to go home go home okay on March 2024 sheriff's deputies were called to a highway in Santa Fe County New Mexico after reports of a wrongway driver so what I'm going to do is I'm going to give you a series of three tests okay have you had any head injuries lately he's hit me in the face possibly okay have you had any concussions or anything like that you don't know he's hit me multiple times okay he's hit me but but a doctor says you haven't had any major head injuries or trauma or anything like that okay after arrival deputies talked with a bystander who reported a deputy found a woman in her minivan which had veered off the road into the desert the deputy approached the vehicle and noticed the woman was asleep in side the deputy began a DUI investigation after finding the situation suspicious she still in there yeah she is yeah is she okay uh the last time I mean so that the first people that stopped so she came I don't know if she came out of out of Lamy but she was in the wrong lane and almost hit these people and then she went over to the Divide there got into the right lane came down and then went off the road there um so I turned they turned around I turned around um and he talked I went down there she's like she's either drunk or high on something okay she's she's not in a good head space I don't think here are keys well we'll put those right over here for now and then we'll make sure she's okay okay first and then we'll get your information you have your driver's license with you okay hey open up Sheriff's Office open hi how you doing good huh good you're doing good yes what's your name terara terara m okay the deputy learned that the woman had swerved onto the wrong lane nearly colliding with other vehicles she then corrected her path only to Veer off the road when questioned the woman said she didn't feel well but did not mention any other reason for her behavior she claimed she was coming from an exit and didn't know how she got off the road initially she denied consuming drugs or alcohol but when further pressed she admitted to drinking beer earlier she stated that she had consumed about three beers when asked about the time she was uncertain but later clarified she had taken one shot of alcohol about an hour before the encounter I saw her in the wrong lane and the people in front of me um so then she went into to the median there do you have any medical conditions or anything like that no what's going on today how'd you end up over here I so feel well you don't feel well right about where that me right right at the L exit yeah and I don't know if she came out of the ly exit or not I don't know if she'd been coming sou you know anyway what's going on today I don't know my body doesn't feel well today you don't feel well today no I don't feel well today why don't you feel well I don't know why why you why you doing that I okay she missed the other people got into the right lane came down there she was swerving around a little bit and then she went off down do you use any drugs or alcohol or anything don't alcohol well maybe yes what what kind of alcohol did you drink beer a beer beer how many beers did you drink maybe three what time know let me go get with my partner and then we'll I think you can probably go if you have any other questions we we'll give you a call Y all right what time did you drink those beers how big were they be no no no put your pants back up okay I got hit okay how'd you get hit from a person from a person yeah all right well this Deputy is going to talk to you okay which Deputy this Deputy right over here he's going to talk to you okay okay the woman appeared disoriented and Her speech was unclear due to the wind and ongoing distractions from the surround surroundings when further questioning was asked the woman continued to deny causing the accident and stated that her vehicle had just been parked off the road she had no medical conditions nor did she claim to me please [Applause] okay to well we're going to run some tests first and then make sure that you're okay to drive have you do you have any medical conditions I don't know you don't know do do you take any medications that might make you drowsy make you sleepy maybe you're not supposed to drive when you take them maybe can't you just take me back to my baby well let's let's get some of these tests done and then we'll and then we'll go from there okay okay when asked about her children she mentioned having three kids but they were not with her then she f further clarified that her children were at home with her husband the deputy proceeded to assist her out of the vehicle and explained that they would be conducting a series of tests to ensure her ability to drive during this time the woman expressed distress mentioning that she had been physically assaulted and hit multiple times by another person though she did not specify the details she was asked if she had suffered any head injuries but she denied any major trauma and stated that she had not been diagnosed with any specific conditions where are your kids I have no kids you don't have any kids no okay is this your vehicle no okay all right the deputy then asked the woman to perform field sobriety tests as the tests were conducted the woman struggled with the instructions and became visibly frustrated she was asked to follow a pen with her eyes but had difficulty understanding and following the task so what I want you to do I want you to put your feet together okay you go ahead and lean up against there keep your hands to your sides okay and I want you to take a look and at the top of my pen okay bring your head down just a little bit okay okay open your eyes wide how about down here okay let's do try okay let's go right here okay okay I'm doing my best I'm sorry I'm doing my best okay I understand I understand okay so what I want you to do is keeping your head straight and keeping it still I want you to use your eyes and your eyes only okay is is something wrong I don't know okay okay so let's try to get through this tests okay can you focus for me cold I I understand I understand so take a look the woman that based on the observations of law enforcement and the information gathered she would be placed under arrest for driving Under the Influence she was told she had the right to refuse certain tests but the deputy explained the need for a breath test under New Mexico's implied consent law the woman was then handcuffed and placed under arrest as the deputy prepared to transport her the woman complained of the cold but was reassured that the vehicle would be warmer okay so here's where we're at okay here's where we're so based off of what I've seen so far based off of folks that are talking um that called you in um and based off of of what I observed right here it looks like you do have some open containers of uh alcohol in your vehicle you are going to be placed under arrest for driving while Under the Influence okay please turn around put your hands behind your back it's okay it's three four sign up fa 11015 okay I have to read something to you okay go and face him okay go ahead and turn around go ahead turn around gets the car if you need to okay okay we don't want you to fall okay I need you to listen very carefully okay you are under arrest like I told you for driving while Under the Influence okay the Mexico implied consent act requires you to submit to a breath test to determine the alcohol content of your blood after you take our test you have the right to choose an additional independent test do you understand that yes I do okay yes sir I'm cold okay we'll get you in the back of the I'm cold wait hold on that hold on I'm I'm stuck together I'm stuck the person who had assaulted her had hurt her tailbone the woman was directed to take a deep breath and blow as instructed and she complied the test was conducted successfully though it was unclear if the woman understood the full implications of the tests did you just throw up no I did not all right ter think should come sit right here for me please now okay listen like this Deputy here explained keep going perfect just like that following this the woman was advised of her rights and the charges against her she was arrested for driving under the influence of alcohol and her vehicle was noted
