You got me most >> because I have to give you the opportunity to do it and I have to read your rights pertaining to it because if you refuse to do it, there's repercussions for that on top of what the DOI would be. >> And I think that's important. And don't you don't you agree it's best to be informed? >> Of course, >> properly. That way you can make a proper decision. >> I don't have um it's do I have Itch itch. >> What? >> Could I I'm not a flight. Can you undo this, please? >> Here. Look. We do not have one at our headquarters. >> What? How do they not? We used to have one, but they moved it to a central location for all the police departments, so it was easier for one location. >> Agreed. I don't want to drive all the way up there either, but that's what I got to do. Call who and ask. I'm sorry. >> Call Lambertville. >> I am Lambertville. >> I know who you are. >> You want me to call Call my department to ask them if they have one? >> It wasn't meant to be. >> No, no, no. I'm trying to understand your question. >> Doesn't make sense. >> Agreed. >> We We do not have the Alcatest instrument to get a breath sample. I mean, why? >> Because I still So, you can um you can thank attorneys for this. So, I have to make sure the instrument is available to you and I have to read you your rights. What's >> that? >> I can't hear you. >> Why' you do that right there? >> What? The turn on the Alex Hawken Creek. because I have to get the 202 north to go up to uh Flemington. >> Pull over. >> No. >> Oh. Oh. Oh. Okay. Gotcha. >> [snorts] >> When I get where I'm going, >> I'm going to read your rights pertaining to providing breath samples. Give you the opportunity. If you deny >> if you do, uh, deny to take them. Um, >> why would I deny? >> Okay. And at some point, um, you're going to be released with a court date. It's a It's a traffic ticket. I mean, it does have repercussions, but it is a traffic ticket. A record of the taking of the breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. After you provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you'll be issued a separate summon for the refusal. A court may find you guilty of both refusal and driving while intoxicated. If a court finds you guilty of the refusal, you'll be subject to various penalties, including license revocation of up to 20 years, a fine of up to $2,000, installation of ignition interlock, and referral to intoxicated driver resource center. These penalties may be in addition to penalties imposed by the court for any other offense of which you were found guilty. You have no legal right to have an attorney, physician, or an illness present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Any response from you that is ambiguous or conditional in respect to my request that you provide breath samples will be treated as refusal to submit the breath testing. Even if you agree to take the test but then do not follow my instructions, do not properly perform the test or do not provide sufficient breath samples, I will charge you with refusal to submit their breath testing. I repeat, the law requires you to submit samples of your breath for testing. Now, will you will you submit samples of your breath? >> Of course. >> Okay. Can I have the pen, please? No, we're not. >> Why? >> We're not vampires. >> I'm asking why. >> I just sort of we're not vampires. >> Yes, you have to in a job like this.
