on July 9th 2023 just past midnight an officer noticed a vehicle with malfunctioning tag lights and initiated a traffic stop hello hi you are officer Smith Police Department reason I stopped use your tag lights are out oh okay where are you guys coming from um we're coming from Tampa we were just visiting some friends okay this is a V car so this is my um temporary registration okay do you have a met marijuana par no sir did you smoke weed at all the night no I did not I smell weed coming from I smell alcohol and weed have you guys been drinking no upon approaching the vehicle the officer engaged with the driver asking for details about their destination and purpose the driver explained they were coming back from Tampa after visiting friends when asked for documentation the driver presented a temporary registration for the rental vehicle we have yet let's be honest with you no sir all right so at this point I do smell marijuana coming from the vehicle so I'm going to need you guys step up my de detain sir as now yes hang up there with a the officer then inquired about the presence of a medical marijuana card and whether the occupants had consumed alcohol or marijuana the driver denied [Applause] both there's open huh driver there's a ton of open containers back there yeah there's there's a lot back there Sho the officer mentioned detecting the scent of marijuana and alcohol from the vehicle and asked the occupants to step out for further investigation during a search of the car open containers were discovered prompting additional questions guys having a party in there we don't so I know look we've had like so many people with us and they're like oh stop so we can get alcohol it's not all of us just bringing non-stop like we're crazy I know it looks so bad we're going to go to that end that's good all right so the first exercise I'm just going to be checking your eyes all right do you want to take your sunglasses off or can I keep them on yeah if you want whatever you're comfortable with I just don't want them to fall down or anything no we them all right so I am going to have you uncross your arms and put them flat against your side you're going to put your feet together heels and Toes touching as best as you can solid all right have you ever done field suppiy test before no ma'am no all right no problem I'm going to take you step by step I just need to know do you wear contacts glasses of any sorts no ma'am no all right you don't have any type of like medical illnesses I need to know about glycom the driver explained the presence of containers attributing it to having multiple passengers earlier who had brought alcohol the officer noted the situation and conducted field sobriety tests to assess the driver's condition seizures epilepsy um no nothing okay nothing along those lines all right do you see that blue light all right go ahead and try and touch that blue light all right you can put it back all right so looking at that blue light you're going to follow that blue light with your eyes keeping your eyes on the blue light keeping your head still do you understand M all right we're going do it one more time all right all right this time is going to go up okay all right can relax you feeling all right yes ma'am all right just a little nervous yeah I just I just never been pullover before so I'm like especially with like a r the sobriety exercises began with the officer checking the driver's eye movements ensuring their head remains still while following a light I got you I got you is the rental under your name or your it's under my name it's under your name all right so the next do you want me to hold those yeah go ahead yeah let me hold this all right so the next exercise is actually going to be a walk and turn um are you going to be able to walk in those yeah I'm good okay all right so I'm going to put you in a starting position you're going to stay in that starting position while I explain and demonstrate the exercise do you understand that yes ma'am all right can you I need you guys to kill your lights yeah all right so you're going to start with your left foot on the line M all right you're going to put your right heel touching your left toe in front arms flat against your side all right are you able to do that yes ma'am all right so you're going to stay in that starting position with your right foot in front of your left foot on the line all right arm slide against the side you're going to stay like that as I explain and demonstrate the exercise do you understand yes ma'am all right so the way the Exercise Works is when I tell you to begin you're going to take nine Heel To Toe sets forward as such 1 2 3 feeling nervous due to the situation the driver tried to comply with all instructions the officer confirmed that the driver had no medical conditions or visual aids that could affect the test so on until you get to nine on your ninth step you're going to keep your front foot on the line take a series of small steps to turn around and then you're going to take nine Heel To Toe steps back as such one 2 3 so on until you to n all right all right throughout the entire exercise you keep your eyes on the tip of your toe arms flat against your side and you have to count out loud all right all right do remember the starting position yes like this not like that remember your left foot mm your right foot in front heel touching your toe arms SL against your side all right ma'am all right when you're ready to do so you may begin all right 1 2 3 4 5 6 7 8 9 turn around one 2 3 4 5 6 okay all right do you understand the exercise yes ma'am all right all right so we have one more exercise you still the next exercise involved walking in a straight line with specific steps and a turn which the driver completed as instructed doing all right yeah all right so I'm going to put you in your starting position the way it works is you're going to put your feet flat together arms flat against your side all right and you're going to stay like that as I explain and demonstrate the exercise to you all right all right Ma so the way the Exercise Works is any foot of you're choosing for me personally I'm going to pick up my right foot I'm going to pick it up 6 inches off the ground parallel with the ground I'm going to keep the eyes on the tip of my toe arms flat against my side I'm going to count all loud as such 10001 1002 1003 so on until I tell you to stop all right all right if at any point you drop your foot just pick it right back up and start where you left off okay all right do you understand everything yes ma'am all right give me one moment all right when you're ready you may begin awesome 1001 1002 1003 1004 1005 1006 17 1008 1009 a third exercise required the driver to balance on one foot while counting aloud demonstrating focus and coordination the driver managed to follow the steps though nerves were apparent 110 1001 112 12 13456 1789 1220 1021 1022 1023 1024 1024 I mean 1025 you're good all right feeling all right yes ma'am all right so let's be honest have we been drinking tonight no ma'am you have not been drinking tonight no ma'am I had some friends in the car in Tampa that did okay all right what about your cousin or best friend back there yeah a little bit she's been drinking tonight yes ma'am all right she's aware that she's not a 21 correct yes ma'am okay so as of right now I'm going to read you your rights the officer asked if any drinking had occurred and the driver admitted to having two drinks earlier in the evening while mentioning their passengers had also consumed alcohol okay cuz I want to ask you more questions of course in order for me to do that I want to make sure you have a fair Shake here okay all right ma'am I find it I got it all right you graduated high school right yes ma'am English is primary language yes ma'am I just want to make sure all right so after everything I say just say yes or no if you understand okay all right all right you have the right to remain remain silent you understand you got to say it yes okay anything you say can will be used against you in the court of law do you understand that yes all right you have the right to talk to Atty have him or her present with you before and during questioning do you understand that yes ma'am the officer clarified the legal drinking age and the driver acknowledged awareness of the law upon being informed of potential charges the officer read the driver their rights to ensure fairness during further questioning if you cannot afford to hire an attorney one will be appointed to represent you at no cost to you be foreign during questioning if you wish you understand that yes ma'am all right you can decide at any time to exercise these rights and not answer any of my questions or make any statements do you understand that yes yes ma'am all right having these rights in mind do you wish to talk to me now no no okay so at this time Miss I'm going to place you under arrest for suspicion of a DUI all right you are showing signs of intoxication okay so at this time you're in put your hands behind your back is your phone in the car or yeah all right you want us to get it so that way is it possible that I could exercise my M well you already said no so you I mean you're more than welcome to make whatever statements you would like at this I mean I can talk to you you want to talk to me yes ma' all right that doesn't change the fact that I'm still placing you under ARR for DUI all right the driver initially declined to speak but later chose to cooperate admitting to drinking two alcoholic beverages that night no okay just want you to be aware of that um Germaine we're going to take whatever you need with you right now where's the car going to go the car is going to get towed okay all right um once I know who's getting it I'll let you know okay okay all right so go ahead and have a step inside all right so here's the situations right now you are being detained the officer asked additional questions such as who had purchased the alcohol and the driver revealed that companions who were of legal age had stopped to buy it are lawfully detained because you are under the age of 21 and you are in possession of open containers okay all right I do I I'm going to ask you questions in order me for to do that I have to read you your rights okay are you familiar with your rights are you familiar with the Miranda Rights like every cop show you see I've heard them on TV yeah all right so all this is is for me to ask you questions it just protects your rights it protects me just to make sure like however all right I just want to make sure graduated high school yes English is your primary language yes all right so I'm going to read everything to you after every question I just want you to verbally say yes or no if you understand okay all right so you have the right to remain silent do you understand that yes the officer explained that open container laws and alcohol in the vehicle created legal issues meanwhile the driver's friend also present in the car was informed of their own legal implications due to being underage and around open containers all right anything you say can and will be used against you in the court of law do you understand that yes you have the right to talk to attorney and have him or her present with you before enduring questioning do you understand that right if you canot afford to hire an attorney one will be appointed to represent you at no cost to you be for and during questioning if you wish do you understand that yes you can decide at any time to exercise these rights and not answer any of my questions or make any statements do you understand that yes all right having these rights in mind you wish to talk to me now yes all right so were you drinking tonight yes yes okay how much do you think you've had to drink tonight got two drinks got two drinks was your friend drinking back there no the officer noted signs of intoxication in the driver and explained that a breath test would be conducted the driver agreed to this procedure she wasn't dream all right so you do know you're supposed to be 21 when you're drinking correct yes are you aware that you are being placed under arrest right now for being a minor in possession of an open container yes all right and I do have an off are on their way right now to do a breath test on you and if you are over the legal limit of an underage Drinker meaning if it's over 0.2 that's another charge so have you been drinking a lot ton I really haven't okay so where were you guys Che where's back home the officer also clarified that the car would be towed and outline the next steps including requiring the driver to spend a minimum of 8 hours in jail concerned about the process the driver's friend asked several questions and the officer reassured them about what to expect it's Sarasota I want to say okay I'm not from here I'm sorry no you're fine that's fine I just want to know where you guys are heading tonight where were you guys coming from tonight uh she had some of her friends down here and we went and hung out with them for a little bit and then after we dropped them back off we were heading back to our aunt's house okay all right so who bought all the alcohol uh well we were with the people we were with were 21 okay and they're like oh let me stop and get alcohol so we stop for then okay all righty all right so like I said you're just going to have to hang tight for a little bit um once we figure out the bre balizer all right it comes back not over the legal limit the officer finalized the situation by confirming that the driver would be taken to jail for further processing on suspicion of driving Under the Influence I'm going to write you a citation and then um we'll figure out what we can do with the car get you someone to come get it okay but I'm not making any promises that's all going to depend on what the test says what the test says yeah okay all right all right do you have any questions for me right now what's Wonder with her right now she's being placed under arrest for a DUI she's showing signs of intoxication so I know you guys are saying she's not Jing but she did do something and her body's showing the signs of it okay okay so unfortunately she is going to take the ride tonight okay so what happens like with that I don't know how all this works well she's going to go to jail she's and she is over the age of 18 so she is going to jail she's going to spend eight hours in jail for the night eight eight of them eight whole hours in jail until someone comes and picks her up okay after the 8 hours she'll be able to make make a phone call and someone can come get her the driver was charged with being a minor in possession of open containers the female driver faced additional charges for driving Under the Influence all right in regards to the car that's just something we're going to have to play by ear okay all right so just hang tight close this all right hey hone all right so the car is going to get towed okay okay all right as of right now your friend is placed under detainment all right with her being under the age of 21 she is going to get cited for open containers in possession of a miner all right you at this time right now are being taken to jail under arrest for a DUI okay okay in regards to the citations you two will be getting cited for being a minor with open containers in the car okay okay I'm just letting you know what's going on all right when we get to the jail I'm going to ask you if you're willing to do a a breath test are you willing to do that um I mean yeah okay all right the reason I have to ask you is cuz um when you sign off to get your driver's license you agree to all tests under investigation that the UI so when we get there we'll take a step by step breath test is all it is is you're going to blow into a machine two times once we get the calculations that's it all right when we get you set up there it's going to be 8 hours so you have to stay there for 8 hours that's just the minimum when a DUI and then you'll be able to make a phone call you'll may be able to make a phone call when you get there but you'll be able to make another phone call when
