So if I had a breathalyzer, it would you would come back at zeros. >> 10. >> Okay, I got you. >> No, I got you. Do you have insurance on the vehicle? >> I do. >> Okay. On a scale of 0 to 10, zero being sober, 10 being the most impaired you've ever been, what would you put yourself at right now? >> Why a one? >> Okay. So, you did smoke today? >> All right. Your license is invalid and everything. >> Uh, I would assume so. >> Okay. I got you. Just Just stay in the car for me. Okay. Okay. Um, so where you you said you're coming from where again? >> I'm coming from my address. >> Okay, I got you. >> Yeah, that's your ID. One second. >> Um, my flashlight. Can I look at your eyes quickly? >> You uh when when's the last time you smoked? You said 5 hours ago. Uh about 7 hours ago. >> Okay. So, what time was that at? >> I'm sorry. I have um pink eyeliner on. >> Oh, okay. >> So, it might look like I'm high, but I'm not high. >> Um I would say like >> And nothing to drink at all today? >> No. >> No alcohol. Um, would you be willing to do field sobriety for me? >> I would love to. >> Okay, I gotcha. Um, and no cannabis or anything in your vehicle? >> Um, no. >> Okay. Um I got a little bit of weed up there and then um I'm going to push with him. He seems fine. So once he's ready to go, um if you want to, we can probably tell him to move up here if you want to keep a better eye on him. >> Okay. >> Um I'll go tell him to do that right now. >> Okay, cool. >> Um so I'm going to search your car in just a second. Well, if that's the case, I'm I'm >> If you want to do a >> I I'm still going to do field sobriety on you. Just with everything I found along with the THCA, along with the admission and driving and everything, I'm definitely at the level of asking you to do field sobriety. >> Yeah. >> Uh hey, Ryan. >> Yep. >> Can you show off your front red and blues or Yeah. >> Is that possible? Thanks. >> Um >> God, this is so fun. If if uh if it turns out that you're not impaired or anything, we'll leave it be. Um you probably just get a citation today. So, where were you guys coming from tonight? >> Um, we were coming from the zoo. >> Okay. Were you drinking at the zoo? >> No. >> Okay. Were you drinking before the zoo or after the zoo? before. >> Okay. How much have you had to drink all tonight? >> Um, two four locos. >> Two four locos. >> Mhm. >> Okay. Uh, the tall boy ones. >> Tall. >> The the bigger ones. >> Oh, the bigger ones. >> Yeah. >> Uh, I split. So, basically one because I split two of them with my friend. >> Gotcha. Did he drink at all? >> No. >> Okay. I gotcha. Um, well, based on >> I want to make it very clear like he was not drinking at all with me. He was >> Was he trying to get you not to drive? >> He was trying to come to Hoy with me because we were going to come smoke. >> Gotcha. Okay. >> So, he has not taken anything. >> That's good. Um, I'm going to place you under arrest for OWI. So, the process for OWI, I'm just going to explain to you because you're 18 probably not been arrested for this before. I do have to put you in handcuffs. I do have to put you in the back of my car. I do have to do further tests, but before I do that, I have to read you a document. >> Okay. >> Okay. I told you tonight I wasn't planning on taking you to jail or anything, and that's true. The only reason you end up at jail tonight is if we cannot find a responsible party to release you to. If someone that's sober can come pick >> be taking like if I call my mom. >> If you call your mom and she comes to pick you up, that's great. I can release you right to your mom. >> And where will my car >> Your car can be parked right there? >> Right there. >> Yes. >> Okay. >> Yep. All right. I >> So, >> yeah. Go ahead. Question. Can I grab my phone? >> We'll grab your phone for you. >> Okay. >> Yep. Can you go ahead and put your hands behind your back? >> 6735. >> Can you show me out at 609 Parkland Drive? I'll be making contact with >> You don't have anything on you, right? Just >> nothing in your pockets or anything. >> Okay, I'm good then. Let's put you in the back of my car. >> Where is your phone? >> May I come with you to get my phone? >> Uh, sure. >> You can point me into the right. >> Yeah, he's going to grab it though. >> Sorry for pulling. >> No, that's that's honestly how I mean you're not >> just tell me where your phone is. >> 5630 95 55. Okay, >> hold up. >> Yep. Here. He'll find it. He can go look. He can look through your vehicle. He'll find it. Okay, we're going to go back. >> Are you sure that he's going to get it? >> Yeah, he's a smart he's a smart guy. >> We're going to go to the left. >> Left 45. >> How much? >> Just the phone. >> Uh, and the >> vape. Where >> the vape? >> Just leave the vape there. You're 18. Technically, I own it. Just the phone. >> All right. I'm going to have you take a >> seat. Okay. >> Bottles. >> I'm going to toss the bottles. I'm not going to have keep those in there. >> Not back. >> That's a safety issue. >> Excuse me. M cross you. >> What was the question? >> What was your question? >> That I can call my mom. >> Yeah. We'll I'll let you call your mom and just >> cuz the last time I went like it took like 5 hours to call. >> Where does your mom live? >> She lives in court. >> Okay. We can give her a call in like 15 minutes. Okay. >> Is that okay? >> 588. >> And I'm a pretty chill guy. As long as you're cooperative with me. >> If she lives on Lake, I'm willing to drive you over there. Okay. >> Yeah. So, we'll go get we'll try to get you home. If no one answers and you can't find a responsible party, that's the only way I'll take you to jail tonight. Okay. >> Very responsible. Perfect. That's good. >> So, just to confirm, you're taking me to jail, right? >> No. So, I'm going to I'm going to issue you a citation for OWI first offense. You have a court date. >> Okay. >> After that, um I got to >> You just like I'm not going to >> I have to read you a document first and then I have to go and >> Thanks. >> I'm going to go talk to him. What do you need? Do you need anything? >> He did not drink anything. He has not smoked. He has not drink. >> He can He needs to be cut loose. I'm not going. >> You can breathalyze him. I'm >> not going back to jail. That [ __ ] is so dead. >> Have I been compliant? >> Yeah, you've been fine. >> Okay. Fine. >> Yeah. Hope I was well cuz like I'm not going back to jail. >> Treat you like a dog. I can't. >> What? >> They treat me like a dog. I can't I don't know why I was only in there for like a couple hours, but they treated me like a dog. >> Oh yeah. They're uh the jail. You got to remember the jail takes everyone from >> Yeah. >> Do not want to go back there. >> Well, that's good though, right? >> Yeah, exactly. That's the point of it. >> But like I like I didn't do anything purposely to go back. Like >> so my car will not be towed. [music] >> Nope. It's legally parked. So as far as I'm concerned, I'm not towing it. >> Okay. >> When did you turn 18? December. >> Do you have my ID? >> I do have your ID. I don't want to pay for anyone. >> I I got you. I got your ID. You've either been arrested for an offense that involves driving or operating a motor vehicle under the influence of alcohol or drugs or both. Or you're the operator of a vehicle that was involved in an accident that's caused a death of great bodily harm to a substantial body harm to a person or you suspected of driving or being on duty time with respect to commercial motor vehicle after consuming intoxicating beverage. This law enforcement agency now wants to test one or more samples of your breath, blood or urine to determine the concentration of alcohol or drugs in your system. If any test was more on your system than law permits while driving, your operating privileges will be suspended. If you refuse to take any tests that this agency requests, your operating privileges will be revoked and you'll be subject to other penalties. The test results are the fact that refused testing can be used against you in court. If you take all the requested tests, you may choose to take further tests. You may take the alternative test that this law enforcement agency provides free of charge. You also may have a test conducted by a qualified person of your choice at your expense. You however have to make your own arrangements for that test. If you have a commercial driver's license or operating a commercial motor vehicle, other consequences may result from a positive test result or from refusing testing such as being placed out service or disqualified. In addition, your operating pill should be suspended if a detectable amount of restricted control substance is in your blood. Will you submit to an evidentary chemical test of your blood? >> Sure. >> Is that yes? >> Is that at jail? >> No. No. This would be a murder hospital.
