in today's episode get ready for police officers who like to get in your face don't get any closer to me or else what you're invading my personal space or else what those who mix professionalism with personal matters you're looking at our Patrol is that is that breaking the law or is that just you don't like it no I want to know who you are and those who run away when they realize they've made a mistake from the federal law you don't know the law so let this be our first case for today shall we this video was recorded by a YouTuber named stiggs Persian cousin who had an unpleasant encounter with the police during his visit to the USA but he managed to come out of the discussion as the absolute winner he educated the police officer on all the things the officer wasn't aware of and in the end the officer literally ran off the mentioned YouTuber came with his vehicle from Dubai to take a tourist drive across North America while passing through Albany Oregon even though he was following the traffic regulations and respecting local laws the following happened reason I'm stopping is because you don't have any license plates on this car oh the reason for that uh I'm from Dubai it's my license plate right there okay but you're not in Dubai you're I'm visiting as a tourist well no you're not visiting as a tourist if you brought a car with you okay you have your driver's license with you yeah of course so how it works is uh we ship uh the cars we get a permit and you don't have a permit what you need is a Carne what's that a Carne it's a very rare thing I know you're confused but uh I'm not confused we uh get a EPA exemption pardon me a EPA exemption and then uh a carnate the massage do you have any of that of course yeah I'm gonna provide everything you have something that says you can ride this car on the road yes sir let's take a look at that of course so it's gonna be a lot of documents I'll give you one because I think what you're talking about is the ability to import this and what I'm talking about is registering it no no well uh you have your driver's license with you yeah yeah I'm just trying to answer your questions the officer claims he isn't confused but in reality he simply doesn't understand what the driver is talking about so let me explain in this context there are two key terms carne de passage and EPA exemption carne de passage on Duan or simply CPD is an international Customs document that permits the duty-free temporary importation of a vehicle for a limited period it is essentially a passport for your vehicle which ensures that you temporarily import your vehicle without having to pay customs duties and taxes then about the EPA exemption the Environmental Protection Agency has standards and regulations regarding the emissions of vehicles if a vehicle doesn't meet the EPA standards it generally can't be imported into or driven in the U.S however there are certain exemptions for example non-resident tourists can temporarily import a non-conforming vehicle without having to adhere to the EPA standards as long as they agree not to sell it and to export it when they leave the situ situation seems straightforward when one understands the context and regulations let's see how the officer responds to this information it's a temporary import it's a lot it's a temporary import it's not a perimeter we fly our cars here we do our trips and we fly them back that's how it works I know it's confusing but no it's not confusing it's very simple if you have some sort of import yeah that that's to get it into the country okay let me see what you have that says you can drive it on the road in Oregon you'll understand a second pardon me you're gonna you're gonna understand in a second I'm pretty sure I know what I'm talking about right now so this is my permit it's an international Federal agreement okay and I'm gonna provide you with a driver's license in a second do you have your insurance with you yes sir so this would be the international driver's license which they come as a package there you go the other part is inside as well this would be the registration of the vehicle what is this the registration of the vehicle okay yeah what I need is proof of insurance this is so the uh it says this is Canada okay this is a UAE I need your insurance all right why are you so defensive I'm trying to make why are you so defensive I'm trying to I'm just asking for these documents and you won't quit talking about other stuff no sir I provide you everything about your insurance okay I don't need anything else right now sure sure you just asked me for the documentary you just asked for a document I provided you and I'm gonna provide you the insurance in a second sir there you go the officer says he didn't take a defensive attitude he certainly did as it's evident he became irritated when he realized he had no knowledge about these permits and certifications this is not Insurance sir on the bottom you can read it it's Insurance the policy number is there as well where are you taking this car I'm going to Canada we're going where I'm going to Canada Vancouver where where did you where did you import the car into from Canada I drove it in here I do a road trip every two years you do a what trip imagine you want to drive your car in Europe what do you do you ship your car there you drive it for a month and you ship it down that's not that's not what I do okay look you what is your question officer I can answer your question look yes sir here's your stuff here you got to get a temporary permit okay I have another call I have to go to Sir federal law you don't know the law and that's that for this police officer we're not justifying his behavior and lack of knowledge but he was probably perplexed by the mere fact that the vehicle came from such a distant country as the driver aptly pointed out the situation would have been the same if he for instance came with his car from the U.S to a European country to summarize vehicles with foreign license plates can be driven temporarily in the U.S if they are properly documented and meet U.S standards or have the necessary exemptions how you doing I'm all right brother whoa who are you I'm Sergeant McNeely Cleveland County Sheriff's Office we got it right to know who you are and I have a right to tell you I don't want to tell you unless I've been legally convicted of a crime but you got some idea why would you need your idea cause I'm gonna see who you are that's not how the law Works sir no and this is not a stop in ID State can you take more crime I've committed what crime yes you're looking in our Patrol is that is that breaking the law or is that just you don't like it no I want to know who you are but sir that's not the law that's a person who are you these two officers from the Cleveland County Sheriff's Department are about to be embarrassed by a civilian who knows his rights the person behind the camera was filming the parking area behind the Cleveland County Courthouse in Shelby North Carolina when two officers approached and asked him for his ID saying he was recording their patrol car the cameraman immediately refused to provide ID and stated that they have no right to ask for it as they are not in a stop in ID state in North Carolina police officers can approach anyone and ask questions they can ask for a person's name or any other query but that is a consensual encounter and the individual approached is free to leave or refuse to answer North Carolina does not have a broad stop in ID law that mandates people to identify themselves to law enforcement whenever asked in short cameraman doesn't have to give his name but let's be real these officers already know that did you ask me who I was earlier but you have to identify yourself and you should know that how long have you been on this job how long a long time and you should know that obviously yeah I do so you got any idea no I don't yeah and I don't consider any to any searches of seizures either not unless I've committed a crime and I haven't committed one and you should know that law officer like I'm surprised that you've been on this job and you don't know that long I haven't committed a crime so you don't understand yeah and you're really I'm gonna take a step back the second thing is you're not going to tell us what we're going to end up doing and not do no I'm just you're on our property you're looking in our vehicle it's public property and my take dollars property and this is public accounting so if you want to take a picture with your phone you go out there not sidewalk which is public so are you telling me that this is a public property no it's not it's a problem it's a private County property this is a private company we want to know who you are then we have a right to find out who you are does tax dollars pay for this property yeah so which means I have the right to be here so what you're saying is tax dollars pay for this but I'm not allowed to be here that ain't got nothing to do with it no no that's what he just turned around everything that's what he just said obviously investigate because you're on our property can I have your name officer officer you're not gonna tell me your name is that what you would tell the judge no my name ain't my name is that what you would tell the judge yes most courthouses and their immediate grounds are considered public property funded by taxpayer dollars and maintained by government agencies it's not common for a courthouse's exterior or general grounds to be considered private property but there may be restricted areas or designated zones especially for security reasons if the man's sole activity was filming the courthouse from a public space it might not be enough to constitute Reasonable Suspicion and ask for ID card while people have the right to film in public there are situations where security or operational concerns could warrant officers to ask individuals to move to a different location if there's a legitimate security concern like filming security measures checkpoints or jurors officers might direct someone to film from a more distant location but in this case no are y'all trying to intimidate me to tell you who I am I haven't broken along let's find out who you are I just wonder who you are we have a ride to find out who you are but I'd like to say you're free but I don't need any more friends sir I got a really close why are you here because I want to take pictures and film because it's my constitutionally protected right of anything I can see so why don't you because I want to be over here well I don't want you to be here but then that's a personal request that's a personal it's not lawful I haven't broken a law I what's wrong with that okay so I can go I can go do whatever I want to do if you haven't broken all you're free to go do whatever you want to do and you should really oh she know that you can't just walk up there man you're making stuff up man what's to stop and identify statue here what's the Stop and identify yeah this isn't a stop and identify State it's it's not I know this I've been doing it for a long time yeah so what's your requested information from you you have to you have to provide if I don't give you my name are you taking me to jail if I don't give you my name are you taking me to jail I'm not necessarily am I thinking about you you're the one talking about I'm just trying to figure out I'm trying to figure out my safety here y'all are really aggressive how is it how am I making it hard y'all want to know my name I tell you what I tell you what tell me expect me having a war I don't know who's in charge here we lose a charge here who has higher rank your supervisor cast your question are you yo what I'm going to are you detaining me no thank you bye thank you I'm doing well what's your name sir who are you I'm sorry it's not that that's not the way this goes who are you I'm Sergeant Barrientos Fort Wayne Police Department how are you good what's your name I didn't give it I know I want to know what's your name I don't care what you want well that's that's not the policy Secret Service then why don't why don't they come out here and talk they will okay go ahead am I being detained what's your name am I being detained what is your name am I being the thing I'm gonna assume no what's that I'm gonna say hey don't you touch me don't you touch me public servant don't touch me look public servant you don't touch me all right you don't touch me or else what you don't touch me or else I will file a complaint you can file a complaint don't touch me identify you you're being live streamed nope yes you are and by being detained identify who you are that's not the way this goes well I don't care what you think okay well officer barrientes you should care because the man behind the camera is right it doesn't work like that on November 5th 2018 this man was filming the area around the Allen County war memorial coliseum it was right before a trump rally so Secret Service agents were nearby they allegedly asked the police to check on a person moving around with a camera and that's when the argument you just watched began all right let's immediately emphasize the most crucial thing for this discussion which is the first amendment and then we'll analyze the remainder the First Amendment provides that Congress make no law respecting an establishment of religion or prohibiting its free extra exercise it protects freedom of speech the Press assembly and the right to petition the government for a redress of grievances and this man was simply exercising his first amendment right I haven't brought what ordinance have I broken what's your name what ordinance have I broken have I committed a misdemeanor am I being detained yes you are for under what probable cause okay what is what is your Ras your reasonable articulable suspicion that I've committed a crime you have your face covered it's cold outside Reasonable articulable Suspicion is a legal standard that requires less evidence than probable cause but more than just a mere hunch it is used to justify Terry stops or brief investigatory stops in which a police officer can stop and briefly detain a person based on a reasonable suspicion that the person is was or is about to be engaged in criminal activity probable cause exists when facts and circumstances within the officer's knowledge are sufficient to Warrant a person of reasonable caution to believe that an offense has been or is being committed remember these two definitions we'll need them later he's refusing I'm not refusing the ID I'm I'm saying I haven't broken a law he is not complying with our uh request for ID am I being detained under what probable cause the secret Services Under what probable cause I haven't committed a crime I haven't put it doesn't matter you have to if you have to detain me then I'm leaving why am I being detained you haven't given me probable cause for me to be detained a second I don't need a problem yes you do you need reasonable article of Suspicion that's right yes what is it what is it what what crime have I committed of what crime right now of what crime you can't hold me for you're not sure don't reach in my pockets that's not part of the Terry frisk unless I feel something that could be Contraband or a weapon then I can no you can't sure that's not a Terry stop sure it is nope it's a cursory search how dumb do you think the public is I don't think they're dumb at all Sergeant barrientes is now regretting stopping and detaining the gentleman behind the camera that man is bursting with knowledge and has a really hard to break character we previously explained Reasonable articulable Suspicion and probable cause and it's clear that in this case there is neither the police are holding the gentleman without reason and not allowing him to proceed the officers haven't provided a valid reason for why the cameraman is detained and are just evading the issue by saying they are waiting for the Secret Service to arrive based on their body language it's clear that they are uncertain in the responses they're giving when the cameraman asked which law he had broken all that can be seen is that they are operating on assumptions and are essentially shooting in the dark couldn't have got your pictures across the street I can get it from right here it's the same public sidewalk so I could get them from Google Earth but I didn't I got him from over there that's not a crime it's not a crime certainly raises suspicion it doesn't matter if it raises suspicion it's not a crime no it doesn't it's not a crime it's not it's suspicious activity is that a misdemeanor or a felony sir suspicious activity misdemeanor or felony either that's right it's neither so I haven't committed a crime you don't touch citizens I couldn't hear you don't get any closer to me or else what you're invading my personal space or else what what do you think is going to happen you tell me you tell me if I touched you that way even with a finger even if it just touched your clothes I'm going to jail you already did that I did not going to jail I did not you touched me no it's all on camera I did not what crime have I committed what crime have I committed am I being detained or am I free to go you're being detained until the Secret Service what reasonable articable suspicion do you have you can't do that you have to have Reasonable articulable Suspicion what crime have I committed what crime have I committed what crime have I committed it's a broken record it's going over and over no well because I need to know you can't articulate a crime okay I just got uh advised am I being detained or am I free to go thank you sir I don't care to hear your lip I'm not on the sidewalk how's that no you have a terrible day because I'm going to file a complaint with your department wouldn't be the first as a general rule people have a First Amendment right to film public areas and government officials including police officers carrying out their duties in public this means if the man is on public property like a public sidewalk he typically has a right to film The Man's sole activity was filming and there were no other factors creating Reasonable Suspicion of a crime the officer likely did not have grounds to demand identification based on the act of filming alone thank you
