I can't reach over. >> You can't hear me? >> I can't reach over. [Music] >> Yeah. That's me. I know. >> How much is the bill? >> How much is the bill? >> Excuse me. >> Excuse me. >> Uh, how much is the bill? >> Wait, how long is this [ __ ] going to take? Cuz uh I need to start looking for a lawyer. Good lawsuit. Pretty tired cuz I got to work tomorrow. So, hurry it up. Drive. You drive a little fast. Speed it up. Good lawsuit. I think you guys dislocated my shoulder. Actually, we have a serious convo or no. You got kids or no? You got kids? Hey everyone, it's Trent, prior deputy sheriff, patrol sergeant, and K9 handler. All right, so this girl was driving 117 mph in a posted 45 mph zone, over two and a half times the legal limit, which is incredibly dangerous for obvious reasons. And this officer is 100% correct. If a vehicle had just pulled out in front of her at those speeds, there's no way she would have had time to stop or maneuver around it. And if she had caused a collision because of her speed, there's a very high likelihood that she would have severely hurt herself or others. And in the state of Illinois where this incident took place, if you're driving 35 miles an hour or more above the posted speed limit, then that changes it from just a regular ticketable traffic offense to a class A misdemeanor, which is an arrestable criminal offense at that point. Either way, law enforcement has discretion deciding whether or not to arrest somebody like this girl and take her to jail. A misdemeanor offense was committed in this officer's presence, so he's legally justified in doing so. And some will just automatically make that decision right away based on whatever their reason is. However, some look at the driver's age, their driving history, how many tickets they have, if any, is this the first time they've been pulled over, their attitude on scene, and then make a decision from there. Either way, if this girl went to jail or not, she would have a future court date regardless for this incident. And when somebody is arrested in a situation like this, there is another licensed insured driver on scene or in the vehicle, especially if they're the owner of the vehicle, then common practice is to turn the vehicle over to them if the driver is arrested. So, this is another discretionary situation where law enforcement does not have to tow this vehicle. I'm not entirely sure why this guy was not driving his own car, but as long as he's not intoxicated, which I do not believe he is and he's licensed and insured like I stated, then again, common practice would be to give the vehicle to him. The officer stated this vehicle was utilized during the commission of a crime, which is technically true. However, in the state of Illinois, specifically fall under much more serious felony level offenses, and they're pretty specific. But if he is legally justified in towing a vehicle in this situation and the owner of the vehicle is getting in the way of that, preventing them from conducting an inventory search, which is what you have to do before you tow a vehicle or preventing the vehicle from getting towed, then he could be justified in getting arrested for obstruction at that point. However, you can tell that the owner does not understand and it's not being properly explained to him everything that's transpiring. This officer definitely has an attitude from the very beginning portion of this video. And I'm not entirely sure if he's been to prior calls or collisions that were a result of somebody's speed and now he's looking at that scene differently, which I can understand that part. However, there is no reason to start off with a severe attitude like that and maintain that attitude and anger as a cop throughout the entire duration because it is just going to lead to more frustration, confusion, and potentially escalate a situation into something it does not need to be. But like this male suspect said halfway through the video, he said, "Let's all just take a break. I don't know why we're getting so heated. And I agreed with that 100%. Maybe this could have been resolved better if there was more mellow communication about this and they potentially could have made a resolution that did not involve arresting that suspect. But I don't know. He still could have been arrested regardless. It's just not the best approach in my opinion. And that's going to be it for this one. See you guys in the next one. >> The teen driver was arrested for aggravated speeding and the male passenger was charged with resisting arrest and obstructing a peace officer. Both are presumed innocent until proven guilty. Yes. [Music]
