whose car is this tell me whose car is this cuz it's going to go to the impound and I don't give a how you get around are we clear better keep your mouth shut I'll make your life a living hell from this day forward there's two people saying that they saw him punch you we just independent Witnesses by moonflower well tell be honest I lit him first where'd you hit him I said I'm knock my five get arrested slowest ones the ones that don't run yeah the ones that don't he hit you I [Music] was yeah how many times did he hit you step into the raw unfiltered world of real life police encounters captured in these four gripping cases where the Thin Line between Order and Chaos is pushed to its limits from a high stakes domestic dispute in Moab Utah to a wild outof control party Invasion and a controversial traffic stop turned volatile in Athens Georgia each case reveals the intense challenges officers face as they navigate unpredictable human behavior legal mandates and split-second decisions how's it going how you doing good hey we got a call about a male hitting a female and the two of them getting in this vehicle and taking off so I I I I just I don't want to trying to defend myself by saying I didn't hear but I pushed her away she she gets really worked up and when she does she swings and she had her cell phone in her hand so I just trying to push her away but um but in Moab Utah police responded to a domestic dispute involving a young couple on a road trip tensions were high as officers questioned both individuals and a witness trying to piece together the events hey how are you good U my name is Eric I'm with Mo police what's your name Gabby Gabby how old are you I'm 22 what happened what's going on I'm is having a stress very stress morning yeah is this your husband or boyfriend my fiance fiance see a pretty good guy yeah what happened over at moonflower um well and I was just really stressed this morning trying to get a lot of work done and I was apologizing to him I had thrown a bunch of stuff in the back and all our bags are back there I was just apologizing I was like I'm sorry that I get so stressed out cuz I have OCD and I was just like organizing something and sometimes I just have a mean attitude but I'm not trying to be mean about straightening things up and stuff so I was just apologizing but I guess I said it in like a mean tone and not really frustrated with me and he walked me out of the car and told me to go take a breather but I didn't want to take a breather cuz I wanted to get going we're we're out of water so it kind of made you more upset it didn't help calm you it made you more upset yeah so then what happened and um so I I'm our goal was to come here and come refill our water are you guys living out of the van right now on travels yeah okay um and uh so it was just it was just really so what happened after you locked you out I told you to take a breather well he walked away to go take his own breather and but I wanted to sit in the car because there was all my stuff was in the car I had one my bag and I had I was working on something at the moment in the car and he told me to just relax for a second and I I didn't want to relax so I got got feel mad and I mean I don't need to be mad yeah it happens then what happen and then I told him to drive get yeah is there something on your cheek here looks like did did you get did you get hit in the face kind of looks like something like hit you in the face I don't know and then over on your arm shoulder right here there that's new huh it's kind of a new Mark oh yeah I don't know can I see the other side of your face so what happened here and here um I I'm not sure it was a I was Tiny get in the back of the car back so the backpack got you so there's two people that came to us and told us that they saw him hit you there's two people saying that they saw him punch you we're just independent Witnesses by moonflower let tell be honest I definitely hit him first where' you hit him I slapped him you slapped him first and then just on his face get kind shut up how many times did you slap him Romeo India Al a couple and then what and his reaction was to do what he just grabbed you yeah did he did he hit you though I mean I mean it's okay if you're saying you hit him and then I understand if he hit you but we want to know the truth if he actually hit you I guess yeah but I hit him first where did he hit you don't don't worry just be honest grab my face like I guess uhhuh um he didn't like hit me in the face like you didn't like punch me face or anything did he slap your face or what well like he grabed me like with his nail and I guess that's why it looks I definely have a cut right here like a PE okay so has he been drinking no we don't drink okay what was up with his driving I this officer said he hit a curb I I I hit while you're driving well he was driving while he was driving you were hitting him well I'm not a lot but yeah and that was distracting him while he's driving are you only for like a second because I saw him I saw the like come on and I like so stupid did you already tell him all this I didn't get that far into it she was she was hyperventilating she saying they they don't drink but at the point when you lit them up we don't drink or anything I just I was yelling at him and then when you start light I like got up on like there she thinging was why he hit the curb he said Gabby I'm sorry I'm really bad name was Gabby yeah okay you okay Gabby do you do you have um medication for anxiety you take or anything no you take do you take any medication for any I just do you good try to meditate stuff but you tend to have a lot of anxiety and stress have a lot of anxiety and what's his name is it Brian is he usually pretty patient with you but I can it just makes me upet I know that he definitely gets frustrated with me a lot because I have a lot of anxiety and he definitely has anxiety too well that could be a bad combo if you both have anxiety you know I have anxiety too and you know my girlfriend uh together my girlfriend's really really calm and she has a way of taking my anxiety and bringing it down but my ex-wife that's why she's my ex-wife I'm just sharing I know it's a little personal but to help you understand we would feed off each other's anxiety and it would spiral you know what I mean and it doesn't matter how much I loved her it may be a bad for your soul just saying and I'm not telling you what to do with your life but if you know you have anxiety look at the look at the situations you can get in you know what I mean and we're not here to be mean to you anything well you know they never there's a first time and then it usually let's just we'll go see what Brian's saying but I think you've heard everything now from Qui question you said you were hitting him in the arm during the investigation multiple perspectives were sought officers interviewed both parties and an independent witness which is a standard practice in domestic violence cases where the situation is inherently subjective Gabby admitted to initiating physical contact by slapping Brian while Brian's account suggested a defensive response this difference in narratives necessitated a careful evaluation of the evidence including the injuries and witness accounts to clarify whether the actions taken by either party were defensive or aggressive hey we got this van stopped and we we've separated the male and the female and we got both of their stories um now that we're not looking for them so intensely I was just wondering if you had a minute to just kind of repeat to me what it is exactly you saw no problem sir yeah so I was watching my friend across the street near the for service building and I just noticed that this couple uh was sort of arguing a bit and you know I wasn't staring at them but it did CCH my attention and what I noticed is it seemed like they were sort of squabbling over a phone I want to say that he was trying to grab her phone and I'm not sure exactly why and then it seemed like uh he had sort of loed to one side of the van and sort of wasn't letting her in and and then the male was stepping into the driver's seat and she was trying to get into the vanand I think she said something about why you being so mean something like that and um I I remember she sort of hit him um a few times and it wasn't like slugs in the face but just kind of like kind of like two kids kind of fighting they they reminded me of very mature I don't know children sort of fighting um but there seemed like something was off and like a weird vibe and um yeah eventually it's like you know she crawled into the driver te sort of like got into the vehicle over his lap um sort of first her way in I guess and then they were in the car and then they just drove away so um I wasn't sure what the nature of the argument was or West it just seems like there was some sort of disagreement and some sort of like shutting I don't know why she would have entered through the driver's door I thought that was strange and um and yeah so I thought about calling it in but I as soon as I walked the this bar there was another gentleman who was already calling it in so I was like oh good on you that's the B off to do in that situation but um that's what I saw and if there's any other specific questions I'm happy to try again did you ever see the male strike the female I um I would say that I think I saw maybe a push or a shove but not like a full on TCH to the face or anything was the shove like in was the shove or push an aggression towards her or was it a defensive maneuver away from her or to get her away from him that's a that's a good question it was unclear what was going on to me uh but it did seem like he was um I it was like he was trying to close off the passenger side of the vehicle and close things up it almost seemed like he put that backpack or something on the back of the vehicle I'm not sure and then he was stepping in and she was out trying to get in okay I I don't it was the whole thing was off and so no I didn't see anything that was like him taking after her or hitting her or or vice versa there was a very there were it was kind of light and they were almost kind of laughing and I wasn't sure if they were just joking around to be honest but then it got more strange as he was the vehicle about to drive off but you you did see her slapping him though it sounds like yes but it yeah it was like my memory is he was in the driver's seat and he has the driver's door open and he's like kind of hitting him either in the arm or maybe on the face Maybe with an open hand like hey let me in lucky and don't be a jerk something like that okay well you know your story is really really helpful because you're an independent witness and we've just interviewed both of them and what you're saying is making everything make a lot of sense so I really appreciate that I ran into you and that I was able to get your number and talk to you so thank you very much in terms of legal obligations Utah's domestic violence laws require officers to act with little discretion once there is evidence of physical injury in a domestic context under Provisions found in Utah code officers are mandated to file charges when clear evidence supported by witness testimonies and physical findings confirms that a domestic assault occurred this mandate does not allow the police to Simply issue warnings instead they must enforce a no contact order and in cases where separation isn't feasible as with the couple living together in a van additional measures may be required to protect both parties Brian unfortunately in the state of Utah we don't have discretion on some things like for example if I pull over for Speed and I want to give you a warning I can do that because it's under a Class A it's a Class B or under if I want to give you warnings for all kinds of stuff I can but there's a few things I can't when I say I the police I'm not in charge of this one of the things that the state legislature doesn't give us discretion on is charges when it comes to a domestic assault and it sounds like you guys are living together so you you meet the statute for domestic partners and you do have injury and both an independent witness probably the next one we're going to talk to is well which we haven't talked to yet but one the one we did talk to and your own companion have made it clear that she was the primary aggressor and that she was striking you and you was received injuries you haven't admitted to striking her she has not admitted to you striking her the witness did not see you strike her so at this point you're the victim of a domestic assault that even if you even if you didn't want to pursue this we don't have a choice the best thing we could do to not the losses we have to charge or doesn't say we have to put her in jail okay but it also says we have to separate do a no contact order and then we have to put her in jail if we cannot separate and there's a little problem here is you guys out of Florida living in the van together how are we supposed to separate you guys now I don't want to take this small 20 what is she yeah a 22y old 22y old fale jail that you could definitely defend yourself against but at the same time we can't say because you're a male and she's a female we can't treat this different than if you were the male hitting her we got to treat it the same he know so she's kind of in a tough spot so unless you have an idea about how she cannot go to jail and be separated do you have friends in town somewhere she can stay tomorrow if you want to it's up to you you can go go to jail you can't because we don't have a charge for you now tomorrow if you wanted to be with her again tomorrow I'm going to take your radio if you wanted to if you want to be with her again tomorrow because it's after 5: so our office is closed you can go to the police department and fill out a waiver to dve dropped the no contact order so you guys can still be together but she's going to have a court date online in a week or two she's going to have to show up her a court date online and answer the prosecutor might drop it they might say you're if you for example if you're not willing to pursue it if that's your decision any I want to say it definitely is I'm not going to pursue anything much my fiance I love her it's just a little swabble I'm sorry that I had to get so public um but so I just want to get like the checklist of things I got to do to get rid of it so want back dat well she'll get a paper with a court date get rid of it well the court dat has to be attended in order for them to decide whether they need to continue or drop it legally once a domestic violence incident is recorded and charges are pending any subsequent reconciliation might influence prosecutorial discretion but it does not nullify the initial enforcement of protective orders I'm recording and the society and the judges and everyone can can judge me for this I looking at 110 lb female and her fiance who have no means to be separated he doesn't want to pursue she's not a threat to him more than slight abrasions from her fingernails I I don't care if if we use the actual letter of the law to to not charge but I also don't care because it literally does possibly make perfect sense to go fullon domestic assault and do the whole thing this is uh your opportunity to make the decision let's let's do this I support you either way let's do this taking your advice let me do a crime report on this won't charge right now won't cider report right now we'll send it off to the county attorney City City attorney because it is send it off to the City attorney let them screen it and make if you send it to the City attorney and they strongly disagree with your decision and they throw a complete fit you might hear about it in a very negative way right so I would make a decision yourself I'd rather be ding for a decision I made than a decision I didn't make especially if they think you were completely negligent in your decision why give it to them the only way to reason to give it to them is if you're not sure if you have enough for something and you want them to decide if they have enough so I I support you I I'm not joking if we need to go all the way to jail or whatever we need to do all the way down to out go ahead I better go on that you got this I'm making this decision I'm going to site them I'm going to go would you feel more comfortable handling that guy yeah go handle that guy then handle that guy I handle that okay if you're more comfortable well I'm it's six one way half doesn't the up it's up to you I mean it's a headache whether I go left or it's a headache whether I go right another option is to not charge them but separated for the night if they find themselves together again what is it to you you separated him you provided for his safety if he doesn't have enough sense to stay away and you you got him separated it's on him can't all night in jail you can separate him and say don't don't let this go off till tomorrow if if they don't let it co off and we hear about it we'll hear about it they're camping in the park tonight we'll let you know and if there's some fighting going on you already was Mr Nice Guy you already gave him a chance what you can't do by law is separate someone and say if we hear from you again we're going to arrest one of you because then if one of them really needs help they may not call police and get help the law says you cannot literally you may not say we get more problems with you guys tonight one of use you want to you can't threaten them like that it's true because it will stop someone from wanting to call the police to get help that make sense so go full or nothing or in between and separate them and kind of give them the nod the wink like hey you know just stay separated it's up to you I'm going to go handle that you got very capable help with you here and I trust you all right call me if you have any problems Gabby would have most likely faced a court date where she could present her side however 3 weeks later she was mercilessly K by her fiance who then also sh himself over it's it's undone just the gates open okay you they're uh they haven't left yet they are under contract their dad is under contract for the house in the corner over there Phil Ramos this house belongs to Linda Elmer Lind somebody broke into your house and they're throwing a party in the backyard I got the cops over here but they won't go back there yes is that her here here they are here's the cops hi is this Linda so you're the owner 1642 I am up I'm in California right now Brian's my good friend well there's about a 100 people that are in your garage out in the backyard oh my gosh are they supposed to be there no they're not okay do you want them to go to jail for being there yes Linda yes Linda Linda every one of these every one of these people need to be prosecuted right now okay yeah okay yeah they no I mean that house is under contract somebody's buying it okay but you're still the owner of the house yes you have G through yeah okay she ignore my VOA I all right uh the the case officer left your voicemail so um we'll give you a call back after after we uh resolve this phone number for her Okay can there the onville but times 100 even more yeah absolutely in a small house back they this house there got to be a relative of her that knew about it somebody come over here do some it or something like that during hey so am I but we'll see what they're getting ready to scatter out of there they're going to be in my backyard here in a minute so if you want to just hang in your house sir and we'll deal with this okay police respond to reports of a massive party at a house that hasn't been sold yet finding over a 100 people packed into the garage and backyard as of officers arrive partygoers scatter leaving behind a scene of chaos with the homeowner demanding prosecution officers weigh their options ultimately deciding to clear the property rather than make Mass arrests however the discovery of a broken indoor raises further concerns adding another layer to the unfolding situation I'm knocking them out anybody my Pence is going to get hurt okay Jesus I great I don't know there's no way to arrest everybody in five of them and those five get arrested slowest ones the ones that don't yeah the on I he's encouraging her to say oh I want prostiution dude be quiet he want knock them all out that's what he just yeah like 10 of them all surround they see if he knocks all the cars were starting to flip uies so I'm sure they've already started jumping the wall there was a that took off when me and M rolled up initially to I'm just I don't run anymore so that's a one and done I kind of want to see you run I'm not running no I think D was run wait for him you want to run you warm up then I'm cool oh [Music] you're right they don't care they just walk right on in Don't Give A I'm sure they were here for the party too oh yeah oh absolutely and join the presid presence of property damage and evidence of forced entry introduces potential criminal elements such as burglary or vandalism which require separate investigation and potentially different legal proceedings the broken door not only indicates unauthorized access but also increases the risk of additional criminal activity or property damage did you guys get paid uh he sent me but I don't know probably not going to get you have IDs on you that you have IDs on [Applause] you no one's supposed to be here yeah so they got an abandoned house it's not abandoned but the homeowner is not here and doesn't want people here gab going you guys the last on here you know what you get to help us do clean all this do I'll be for real man cuz the people that own it want everybody arrested and you're the last three here for real yeah so you can pick up make it look nice or get arrested I'm going to go give this dude her garage door openers get him on my D up buddy how are you the watch Commander you live here yeah here the guy I'm trying to come to talk to I'm understand you want talk to me she wants you to have those there the garage door open it was locked what everything was locked up I know they kicked in the door but those are the garage door openers sitting in there yeah cuz it's for sale everything was locked up there's I can't believe who who wants them to have this the owner look the owner does yeah look thank you yep broken glass everywhere you can't find this amount on his backyard he was yelling around he was he was very excited oh he was running back and forth all over the place and then he pulled the the ultimate option these are million dooll houses I go and who cares a $200,000 home still some this property right like trust me buddy I would love to arrest all of them we don't have the capacity thanks for help us out all safe brother hopefully they pay you they hired them and we're supposed to pay I'm going to figure out how to shut this now [Applause] see that ninja the exchange between the officers the homeowner and the partygoers demonstrated both the challenges and the importance of clear effective dialogue in rapidly evolving scenarios balancing the legal imperative to uphold property rights and the safety of all parties involved against the Practical challenges of mass Gatherings remains one of the more nuanced aspects of police work she doesn't have a license Jack just she doesn't no what did I do hey what did I do you're not doing anything to him J A you mother right man yeah he's still running WB he pass the gas station on six the situation began when officers pulled over the miner for speeding only to have an adult occupant flee the scene inadvertently dropping a loaded stolen handgun this unexpected turn significantly heightened the stakes of the encounter demanding a careful yet prompt response from the officers on scene with you stop ping stop doing me I'm not doing nothing myom call my mom please I'm not even doing nothing I will sit down I will sit down just get off of me you down sit down I don't even know why he get off breath take a breath on the way to the hospital the only reason I was I'm scared up SC my you don't understand my son I'm 1 I'm 17 please call my mom where is list the core issue here centers on the proper use of force and the maintenance of professional conduct during law enforcement encounters officers are trained to manage situations calmly and respectfully even when faced with uncooperative or agitated individuals in this case while it is understandable that the discovery of a loaded stolen hand and a fleeing suspect could trigger a heightened stress response the excessive aggression and derogatory language used by Sergeant akuti exceed what is considered acceptable under standard police protocols you don't care that's what you do are you serious what do you want me to do that's what y That's act like an adult and he'll talk to ad then shut your mouth help help help help help stop jumping around help help help help help help me this is what y'all do this is what y'all do y people I'm sorry I'm just scared take a deep breath and relax okay there's nothing to be scared about my son I'm scared about son okay we're going to get we'll get info on your son just relax Mom please can you call my mom why won't you'all just do the simple thing of calling my mom y'all can't do that for me I'm doing my job don't tell me how to do my job [ __ ] you Fu you you're crackers and this is what yall do K people please call my mom please help help help help help me help help help help help me she'll go to jail for obstruction help me help me please why in his head you're old enough to drive a car without a license you're old enough to have a son act it you think I'm out of here playing games you're out of your mind and I'll tell your mom the same thing I'm sure your mom will be real happy that your man's got a in this waistband running around town right whose car is this tell me whose car is this because it's gonna go to the impound and I don't give a how you get around are we clear better keep your mouth shut I'll make your life a living hell from this day forward you wanted it you earned it I don't care how the old you are let that sink in a police have been under scrutiny since the 2019 death of Elijah mlan a 23-year-old black man after his arrest gained widespread attention during protests over police brutality and racial Justice last year okay um so she's actually driving around her friend wasn't in the car her her baby's father was in the car but she said he has no license um and she was going 67 I believe 68 uh down airport in a 40 mph Zone so I pull her over um and ask her to step out of the vehicle because she has a permit um I was planning on Towing the vehicle because neither of them have a license uh we took her out but then when we when we took her baby's father out uh he ran from my partner my sergeant as a fell out of his pants unfortunately no unfortunately thank God nobody got hurt but he ran from the police with a coming out of his pants as the cop was trying to grab him and take him take take him down and your daughter started freaking out started screaming trying to pull away from me she didn't get thrown down or anything like that we put her in handcuffs sat her down she started screaming that the cops people um and started yelling F you at my sergeant as loud as she could over and over again so we tried calling you before but she just wouldn't calm down um but she's finally a little bit more calm and that's why we were able to call you she wasn't even able to give me your phone number she was just yelling at you to my boss no way yes ma'am speeding yeah she was going 68 in a 40 flew past us so she she is her yeah she's going to go get processed at the gel and get charged so you're you're going to have to come pick up at the jail what is she in charch uh the driving obstruction um and uh license status what is she get charged with obstruction for me so she started pulling away and resisting when I tried putting her in handcuffs and two cops were chasing her baby's father who just dropped a on the sidewalk so she started pulling away and trying to prevent me from putting her in handcuffs isn't that I'm Str a very S charge uh so there's Municipal charge which would be failure to OB mom say anything about the ownership of weed I'm guessing not no she said her friend was supposed to be driving not there's two phones in here I don't know which one's hers that will take his another officer reported Audi's behavior and after viewing the footage Aurora police chief Vanessa Wilson ordered an internal affairs investigation police said in the statement aoui was placed on paid administrative leave and will remain on leave pending the outcome of the investigation last year Aurora officers were investigated but cleared of criminal wrongdoing after detaining four black girls at point on the ground two of them in handcuffs after pulling over a car wrongly believed to be stolen hey how you doing good good good so what's going on out here good you're good that's not what I'm getting told what's going on out here we're good minor what's going on everybody just up there on the curb what's going on out here what I'm being told is not a minor situation so I can hear it from another person or I can hear it from you which one do you want to tell me well I mean just we to drive I drive okay and at what point did someone get snatched out of the car sned out of the car no no I didn't nothing happened like that we're good yeah we're fine well I got I got to figure out what's actually going on how do youall know each other keep my okay y'all live here no he here yeah we just just where do y'all live I live in I okay yeah yeah we're not I'm not juding that's why I was like all right but we're good gotcha well we got to figure out what's going on first in September 2022 in Athens Georgia officers arrived at an apartment complex after a neighbor reported seeing a man hitting a woman and attempting to drag her out of a vehicle it takes persistent questioning but the girlfriend eventually reveals what happened you tell you why we're out here arguing if I'll talk to you over here sure and then I'll talk to you okay so what's what's going on gotcha but the problem is people told me otherwise so so I got to I got to go off of the totality of things we're we're child friends okay and wanted to drive he was I want to drive and stuff I was I don't want you to drive and then he just got mad kind of like just slam my door he didn't do anything me I started crying yeah just yelling screaming about he wants to drive and you said it's not smart yeah just cuz he's he's he's been through stuff before and I just don't through the bus with did you put your hands on him did he put his hands on you no cuz we're getting phone was saying that he'd put his hands on you so why would random people call us and lie to us what I'm being told is that someone got snatched out of a car snatched out of a car took a purse and then hit yeah that's what I'm being told and got hit yeah nothing like that okay we can get our caller back online I don't listen i' I've been through this a lot okay I understand you don't want him to get in trouble I understand 100% I get it I swear it wasn't like bad to the point where like I mean it was to the point where people called 911 which I figured yeah he he my so that was one of the things they said I try to get that back yeah so what exactly cuz we got a document one way or the other so what specifically did he do as far as the physical aspect did he hit you with a he was TR he was hitting the he slammed the door yeah that's it um he didn't really hit me I try to like hit him a little bit just him off right there he snatched it I was putting it back and then I guess cuz I saw people looking so I figured that was off yeah yeah but I'm okay if I just see your hands real quick yeah back of your hand through persistent questioning the girlfriend eventually admitted that during the heated exchange the boyfriend had indeed slammed the car door and attempted to put his hand on her and she in turn tried to push him away although she downplayed the physicality as only a couple of light smacks the evidence of even minimal physical contact in a domestic setting carries significant legal weight even if it's just like a one time smack upside the head I'll be honest with you yes okay so what exactly did he do oh no I I box yeah I I didn't hit it I I don't hit a girl I I don't don't do that St that's not me I a man are you at the marathon this morning Marathon gas station this morning no I didn't work at the marathon oh okay which one oh no I work on West Side town no man we're I I practice boxing I do boxing with him too okay and we have a football player in our house okay my cousin too got got 254 Central can you try getting our caller back online again he just hand on me slap me acoss my face okay did he successfully do that yeah okay so again if I call these people they're going to tell me he was trying to hit her but he didn't he SN my first oh yeah yeah that's yeah he in Georgia the Family Violence act mandates that if cause exists supported by witness accounts physical evidence or even contradictory statements officers are required to arrest the suspected perpetrator rather than leave the decision solely in the hands of the victim This legal framework is designed to prevent further harm and to ensure that cooling off periods can be enforced even if the victim later expresses reluctance to press charges you which apartment you live in which apartment do you live in what happened out here why why are we being called out here I don't know they just go into like argument they say nothing else they boyfriend girlfriend they just know each other since like four or five years so she didn't hit him no she did he hit her no not nothing like that okay so we have we had people call us saying that he put his hands on her and that you broke him up is this accurate or are people calling us and telling us stories they didn't got in this got argument with them yeah that's it nothing else so if I call back to people that called us they're going to tell me what you said that nothing physical happened to it's just an argument yeah just an argument this is my cousin is your story going to be the same as their story cuz what if their story is different usually how this goes man nobody wants anyone to get in trouble yeah nobody wants if people been drinking argument heart starts they lose their temper and they do something they regret nobody wants anyone to get in trouble so when we're called usually they tell us a story and say Noah nothing happen when in reality something did happen you just don't want to tell us I get that happens all the time but we're also not foolish so we are able to see through the lies that are told to us the officer's approach here reflects a careful balance between Gathering all available information and fulfilling their legal Duty under Family Violence statutes they had to consider both the girlfriend's reluctance to escalate the situation and the obligation to intervene when there was any indication of physical aggression within a domestic relationship yeah nobody's going to know that you talk to me I just need to know did you see the male actually hitting the female or did you just see an argument I think he was hitting her with a F and the me man I think the great shirt manting between them yeah yeah yeah what do you remember what they were wearing what the female was wearing yeah the pink shirt okay and what was the uh the aggressor the male what was he wearing um I think the black okay all right sounds good thank you very much he hit you no I was trying to snatch yes how many times did he hit you Twi in the face and the chest on the head okay let me see the top of your head can you move your hair just to see if there's any redness did he smack you or punch you okay it wasn't hard or anything so his hand is open not closed okay was this when you were in the car or outside the car okay does he usually act this way towards you this is the first time he's ever hit you put hands on you all right so he is being arrested okay why give me a favor Buton put your hands find your back for me [Music] take off all your bracelets and stuff before we go to jail right jail yep wait why it's Family Violence y'all are dating y'all lived together it's no longer your decision it's our decision it's a state arresting him not you arresting him did I hit you they to Family Violence Family Violence we'll explain easiest way to explain that D did I hit you no but look we got people that caught us man I mean you can sit here and lie to us all you want but I don't it doesn't matter anymore so this is how the state works okay the way the Family Violence act works in the state of Georgia if we can as the state develop probable cause that a certain Family Violence crime like battery assault stuff like that has occurred the state has to pick up the charges so she's not the one pressing the charges we develop probable cause so we're just taking action I haven't done anything to okay well that'll all be in the report okay you're not you're not convicted you're just being charged right now one of the main reasons the law is written this way is to help provide cool down uh kind time period usually what'll happen is you try squeeze your hand together for me get bonded out with the so I can get this one out set B Ian I old okay so it may not be coming off do you want your cousin here to hold on to your watch can hold he can hold on to it yeah okay he want you hold on to his watch I went ahead called you got anything on you want need to know about I mean I have my phone I have my okay no drugs no needles no knives I just got to ask before I start putting my hands in Pockets I mean I didn't I didn't really do anything to her got you let's step over here to the back of this vehicle the moment it turns into a more physical altercation if you guys were just yelling then that's your decision if you don't want to have him arrested but since he put hands on you and you guys have a domestic relationship so that means like you've been dating You' been uh you live together I don't think dating um it's dating or sorry live together married have K kids together something like that so since you guys live together is now our control and you no longer can make the decision that he's going to be arrested it's now our decision the judge is going to call you in the morning okay keep your phone on and this is your time time when the judge calls you if you want to be like no I don't want to press charges um he stay in there no he'll be able to talk with a judge in the morning yeah so you'll he'll be able to talk to a judge um most likely be able to bond out in the morning but just make sure you have your phone on they usually call around 800 or 9 when they open and they'll just ask if you want any bond conditions you don't want them around you so tpos um that's just a temporary protection order so you don't want him around you um other than like to get his stuff or you can request that an officer's here to get his stuff stuff like that is for a TPO F condition is like no cut and dry he's not allowed around me you can work that out with a judge or you can say I want to press charges it was a mistake or something whatever you say but you can tell the judge no you don't want to press charges you don't want a bond you don't want TP yeah she's not pressing charges man but what about like I don't understand like have a seat please my phone it's back there I'm going to get everything I'm going take it with us to the jail so you have your numbers and stuff ultimately the decision to arrest the boyfriend was based not only on the physical evidence and the witness reports but also on the statutory mandate that in cases of domestic violence the state must take charge of the situation this approach aims to protect both parties from immediate danger even if it means temporarily overriding the victim's Wishes the incident underscores the complex interplay between individual narratives and the broader legal standards that govern domestic disputes highlighting the challenges officers face in ensuring both Justice and the safety of all involved [Music] [Music]
