Stop. Police often ask individuals to exit the vehicle during traffic stops for officer safety and to facilitate the investigation. However, when a person has a disability, such as being paraplegic, officers are required to make reasonable accommodations under the Americans with Disabilities Act. Forcibly removing a disabled man from a vehicle and throwing him to the ground raises serious concerns about excessive force. There's also a three-year-old child in Clifford's car, which only adds an additional layer of concern. Witnessing such an incident can be very traumatic for children. You're making this worse than it needs to be. I'm a paraplegic. I gave y'all. That's fine. I gave y'all everything y'all asked for. Cooperate. Yep. You call whoever you want. I'm a paraplegic. These mother is doing me wrong. Now you're How the I can't do nothing. You got my arms behind my back. I'm a parapolgic. Okay. Well, you made this worse than it is. I didn't make worse. How can I call somebody? I I'll call for you. I'm just saying y'all asking me questions now. What do you mean asking you questions? I got somebody that's supposed to been coming down the street. If y'all going to let the baby go with them, you can take the baby with them. Y'all just Who' you call to come down here? Y'all just jack me up. Who' you call to come down here that can take this kid? A family member. All right. and they're okay with taking this kit. I'm not sure yet until they get here. How much do you think, sir? Five. No, more than that. Um, these 20s are in stacks of thousands, so you probably got almost 10 grand. They just beat me up, bro. They just beat me up and dragged me up out of there. Pants all down and everything. Hey, you want to talk to your dad, little man? Geron. Geron, you want to go with Uncle Sean? Can you go with Uncle Sean? Can you go with Uncle Sean, please? I own that building down there. I collect rent money. So, the money is yours from rent money. Correct. What's the address to that building? 1954 West Grand Avenue. I own more than one property. Okay. Mr. Owensby, do you have your own business? Correct. Huh? Yes. What's it called? CJ and CJ Home Improvement LLC. I also have a lawn care service. The officers questioned Clifford and as he provided swift and clear responses. They began to realize that their conduct might have been significantly wrong. Clifford is a businessman, not the criminal they initially suspected. The direction from which he came corresponds to the location of his real estate properties from which he collects rental income. And now a supervisor is arriving at the scene of the incident. So let's see how he will react to the situation. Hello sir. Sergeant McIll. What's your name? Clifford Owensby. Clifford Owensby. How can I help you today? I heard you requested my presence. I was trying to get your assistance before they snatched me out of my vehicle. Well, out of the vehicle I was driving and and and embarrassed me and beat me up in front of the public. Well, now let me explain something to you. And you may not like the way this is going to sound, but we are allowed to remove people from the vehicle. There's case law from the Supreme Court. What if y'all would have broke my legs or something, man? They just snatched me out anyway. They didn't care how I landed on the ground or nothing. I told them. Are we going to have a conversation or are we going to yell at each other? I'm I'm frustrated. I don't if this would have happened to you then I would be able to understand your your frustration. So I guess it ain't happened to you so you can't even feel me. Why? Why? Why? Why? Why? You're making this scene for no reason. Man, I want to have a conversation with you so we can resolve potential issues. It ain't no nothing to resolve, man. They already they didn't It was inhumane what they just did. Sit on it for me. Now, when they go to remove you from the vehicle, obviously you're in a special condition here. And I was trying to explain that to him. They wasn't trying to hear that. They said they got the right to do whatever they want to. So, that's what they did. I'm sure they didn't say it just like that. That's what he told me. You can you can look you can listen to his mic. He got a mic on. Absolutely. And this will be reviewed. Now, when you don't go along with the program, you're being resistant. I was asking for a white shirt. I wasn't I I had cut the car off everything. I couldn't run. I couldn't get out, do nothing. I'm a paraplegic. Listen, you can request a white shirt and that's what I am. But we ain't going to we ain't going to just snap a finger and get here. Okay? A traffic stop is an investigation. And if the person that we're doing investigation with doesn't go along with the program, then they become they're resisting us. That's that's a crime. We don't make those laws. We didn't write them. We just enforced them. Okay? Now, they're trying to remove you from the vehicle. They understand your condition. And then while they're trying to help you out, he said he didn't care about my this. Okay. Okay. But if they go to remove you from the vehicle and they assist you getting out of the vehicle, but you you're not going on with the program, i.e. hanging on the steering wheel, not complying with what they're doing. Cuz I didn't want to get hurt, man. Why would we Why would you think we were He was snatching me out. He had me by my hair. He was pulling me out by my hair. The sergeant emphasizes that it's standard to remove someone from a car who is resisting. However, once again, it's important to remember that Clifford is a paraplegic, making it clear that such a person cannot offer substantial resistance. At one point, an officer even hit him with a knee and dragged him by the hair. So, Clifford has substantial grounds for a lawsuit. I don't know. I haven't seen the video. Okay. If you don't want me to ask, sir, how did you get into that vehicle? I had help. My kids helped me get in the vehicle this morning. Cool. So, how would you have gotten out of that vehicle? I was going to get help from my kids after I picked them up from school. Would it have been possible for the officers to help you the same way that your kids? Not without a chair. Well, those are some big strapping dudes up there. They could have helped pick you up. Yeah, they helped me. All right. They help they help snatch me out that B face down on the ground and was beating me and telling me they was going to tase me if I didn't They told me they was going to tase me if I didn't let them smash my head into the concrete. Sir, so you're saying you're describing beat up. describe what what happened as far as that. Man, just review the footage, man. Just review the footage. If you're if you're alleged that the officers used force against you, they definitely did. Sir, one last question for you. Do you have any injury that you want to describe? Yes, I do. What's that? I can't tell what further injuries, but from when they grabbed me, I might need medical attention. Okay. I I I don't see anything that would require medical attention right now. Do you have any Can you I'm injured. I'm hurting. My legs hurt. Well, you can't feel your legs. They hurt. Okay. That that's just some might be broken. I don't know. Okay. It feels different from what I did before they snatched me out the car. I'm hurting it. Okay. Well, I don't see any injury on you at all. Uh you're not making any specific allegation of injury. Can we just finish whatever it is? So, thank you. Absolutely. Can you tell him my back is hurting? He asked for any specifics. Tell him my back hurt. All right. All right. I don't see anything immediately apparent. Okay, he's good to go. You have any other allegations of injury, sir? Nope. Okay. After all this, Clifford received citations for failing to restrain a child in the back seat and having tinted windows. He filed a lawsuit against the aggressive and inappropriate conduct of the police, and the court ruled in his favor. He received $125,000 from the city of Dayton for the suffered trauma. So, the vehicle's continuing westbound. Driver, roll the window down. Put your hands out the window. Put your hands out the window. Turn the vehicle off. Put your hands out the window. Let me see your hands. How many occupants are in the vehicle? What's going on? How many occupants are in your vehicle? It's only myself. Why are your weapons drawn? What's going on? Open the door slowly and step out. Open the door. I'm not getting out the vehicle. What's going on? Get out of the car. Open the door slowly and get out. What's going on? Get out of the car now. Open the door. Get out the car. Hold hold hold. Keep your hands outside the window. Keep your hands outside the window. My hands are right here. What's going on? Get out of the car now. You're not cooperating at this point right now. You're under arrest for a traffic. You're being detained. Okay. You're being detained for obstructive traffic violation. I do not have to get out the vehicle. You haven't even told me why I'm being stopped. Really? Get your hands Get out of the car now. Get out of the car. Get your hands off me, please. I'm trying to get Can you please relax? Can you please relax? Get out of the car right now. This is not how you treat a vet. Yo, I'm actively serving this country and this is how you going to treat me? I didn't do anything. Whoa, hold on. What's going Hold on. A4C just deployed. Get out of the car. You have just witnessed an excessive use of force that resulted in one Windsor police officer losing his job. The victim of this police action was Second Lieutenant Karen Nazario, who was driving through the town in his new vehicle when officers attempted to stop him because they believed he was missing license plates. Since they were in a dangerous part of town, Karen continued driving to a nearby gas station to ensure they were in a well-lit and safe area. The officers then drew their weapons, sprayed him with OC spray, harshly threw him to the ground, and unnecessarily pressured him. Let's take a look at what exactly happened. Get out of the car now. Get out of the car now, sir. Just get out of the car. Get out of the car now. I I don't even want to reach you by seat belt. Can you take your seat belt and get out of the car? Can you please get out of the car now? You're going to do as you're told. Get out of the car. Look, take your seatelt off and get out of the Take your seatelt off. Look, my hands are out. Take your seatelt off and get out of the car. My hands are out. Don't reach in there, Daniel. Don't reach in there. My hands are out. Please, please. Look, this is really messed up. My dog is in the back. My dog is choking right now. Get out of the car. Take your seatelt off. What are you, a specialist corp? What are you? I'm a lieutenant. Lieutenant, get out of the car. Take your seatelt off and get out of the car. You made this way more difficult it had to be. If you just comply, get out of the car. I'm reaching for my seat belt. Fine. Take your seatelt off and get out of the car. Straight on the ground. Straight onto the ground. Ma'am, it's your command. Let's go. Is your command available? Get on the ground. Get on the ground. Can you please talk to me? Get on the ground now. Get on the ground or you're getting sprayed again. Get on the ground. Can you please talk to me about what's going on? Yes, sir. You're not. Can you please talk to me about what's going on? Why am I being treated like this? Why? You're not cooperating. Get on the ground. Why am I being treated like this? This is really messed up. This is really messed up. Come on, sir. Sir, just really This is Sir Lay on the ground. Just lay flat. Lay flat for me, sir. Just work with us. Lay down flat. Lay down flat. Lay down flat. Lay down. You're going to get up. This is up. Put your hands behind your back. Put your hands behind your back. This is up. This is up. I agree. All you got to do is listen. What kind of dog you got? He's mixed. He's a service animal. Why did you just do it in the ass, sir? Why didn't you just do this? I'm flying. My hands are out. No, you weren't. You were not. My partner put his blue lights on. Yes. You didn't stop. I was pulling over to a well-lit area for my safety and yours. I have respect for law enforcement. No, you don't. No, you don't. No. Wrong answer, sir. If you did, we would not be in this situation right now. Can you get some water, please? Absolutely. Set set right on this curb right here. In this situation, each side claims to be in the right. Karen insists he simply didn't want to stop in an unsafe part of town in his new vehicle, which the officers interpreted as non-compliance. The immediate drawing of weapons by the officers significantly escalated the situation as Karen began to fear for his life. The use of pepper spray and physical force in a situation where the individual is not being aggressive or threatening may easily violate departmental use of force policies. This body cam footage was a crucial piece of evidence here. And now let's see what each side had to say in their defense. Do you want another one? If so, just let me know. I'll be okay for now. Thank you. Why does this simple dark over there? Those areas are dark. I did not feel comfortable. Those areas are dark. A cup of water for you. Pour it on my face. It's gonna make it worse. You know that, right? All right. So, if it's going to make it worse, don't do it. Yeah. It's going to react and it's going to make it worse. I didn't do I didn't commit any crime. I'm leaving tonight. I'm not going to jail. I need something to be done for my eyes. Nothing I can do to help you. Wipe my face. I know this doesn't make a lot of sense to you, but the more that you blink, you're it's going to cause your eyes to tear and it's going to get that burning out. Okay? So, blink for me. You understand what you're saying? The more that you blink your eyes, it's going to cause tear tear up. Your natural tears my nose. Can I please blow my nose? Go ahead. Let it out. Can you please take the cup? There's nothing going on. There's nothing wrong. Come on. Opposite risk is you wouldn't compartment with us. All we did is ask you to get out of the car and you refused. He said, "No, I'm not getting out of the car." I was asking what was going on. So that's how long does this take to um to wear off? You just come out of rookie school. How long is pepper spray activate? Yep. It'll take about 20 minutes, man. The police officer who held Karen at gunpoint the entire time was actually a rookie. Just saying. 20 30 minutes. The more I'm telling you, I know it doesn't make sense, but the more you blink, the better it's going to be. I didn't believe the guys when they told me either. Okay. But the more you blink, the better it's going to get. Can you please take the cuffs off me, please? I need to No, I need to relax. Okay. Police station, Mr. Nar, I'm coming from um your pocket. Your zipper. Oh, zipper. Okay. I'm coming from a medical event. I'm a medical officer. Mr. Lazario, look, you want to stop in a well lit area because you're nervous. Yes. the whole BLM movement. You're probably nervous and all that. They feel the same way. They're nervous for their jobs and their lives. I get where you're coming from. They get where you're coming from. Let's let's let this pepper spray kind of wear off and stuff and then just just have an intelligent conversation with them. Coming here was not the problem. That was not the problem. The problem is when you refused to get out of the car. Okay. You refused to get out of the car. Had you when we got here and you stepped out of the car, I can promise you this would have been over by now. Tell what happened. Why would you comply? I looked out the mirror and I saw guns drawn. I put my hands out and we told you, we identified ourselves. We told you to step out of the vehicle and you wouldn't. All you had to do is comply and we'd have been done by now. Okay. Karen Nazario filed a lawsuit seeking $1 million due to the suffered trauma and damage. But the court awarded Nazario only $2,685 for the assault with pepper spray by officer Gutierrez and $1,000 because his car was illegally searched by another officer. At the end of 2023, he requested a new trial. What the hell? Hi. Hi. How are you? Fine. What are you guys doing here? Uh, waiting to go to Starbucks in a second. Why are we have Is there a problem? We can't here. Well, actually, let me tell you why I'm here. Okay. I've been having auto breakins in this parking lot every morning around this time. Thank you very much. So, I've been So, I've been driving around here. Okay. And I noticed that you guys aren't doing nothing but hanging out. Yeah, I just got in from Okay. Well, that morning. I've been driving all night. That's my reason why I'm talking to you. I come here. So, I'm This is a We're in a car from the Bay Area from Oakland. Okay. Just cuz it's got um Nevada place. It's not a It's not a Nevada car. No, I'm not Nevada. I'm not. Do you have your ID on you? Yeah. Okay. So, wait a minute. Now, why are you asking for my ID? You just explained to me about the breakand, right? Okay. But why did you explain to me about the um my ID? What's that about? What did I do? What kind of crime did I commit? What kind of crime did you commit? Yeah, I'm asking you I'm asking you for my ID. Yeah, you have to give me your ID. Why do I have to give you my ID? Why? I don't have to give you my ID cuz I haven't did anything. You you started talking about a breakin. I thanked you for tell informing me that. I informed you that I'm resting because I'm about to go into Starbucks, right? I formed driving all night. Right. Well, Starbucks has been open for about 2 hours. It's actually been open since 5:00. I check my um GPS. Okay. Are you doing anything wrong? No, I'm not. So then what's the big deal? I don't have to give you my ID. I'm not doing anything wrong. Yeah, you do. No, I don't. No, I don't. No, you don't. I know the law. I don't have to give you my ID. I'm not doing anything wrong. I have not did anything wrong. I'm not did anything wrong. So, what you're doing now is leading me to believe that you might be doing something wrong. No, I'm not doing that. So, don't try to trump up no charges. I I saw Get your phone out. Start recording. Start recording right now, honey. Get on the phone. Get on the phone. Why? Why? Why are you getting so worked out? Cuz I got to have protection cuz I don't know where this is about to go. I got to have protection. Well, it's not going to go anywhere if you cooperate. The officer explaining that he's checking the family due to recent car break-ins is an attempt to provide context for the investigation. In some states, police may ask individuals to identify themselves under stop and identify statutes if they have reasonable suspicion to believe criminal activity is in progress. However, the mere presence in an area where crimes have been reported without more specific behavior linking the family to criminal activity typically does not constitute reasonable suspicion. The mother will now continue arguing with the police officer who will soon arrest the entire family without a valid reason. So, you see this thing right here? So, this is my camera. Everything's being Everything's being recorded. Exactly. And I'm not doing anything. That's what you hear me tell my daughters. Start recording as well. Start record. Yeah, that's fine. They can record all day. Yep. So, why are you making this a big deal? Because I haven't did anything. You said you're a local resident or you're from here. I said I'm originally from here. That's what I just told you. Well, this could be a completely positive encounter. Exactly. I'm not going to give you my ID cuz I haven't done anything. Um, call Anukica right now. Do you have a valid driver's license? Yes, I do. Yes, I do. I wouldn't be in this car if I didn't. I can't rent a car without a valid driver's license. Yes, I do. Okay. Well, I don't know that if you rented this car, right? So, are you going to refuse to give me your ID? I am because I haven't anything. Call your superior. Call your supervisor. I don't have to do that. Yes, you do have to do that. That's crazy. We're being harassed for nothing. We're being harassed for nothing. It's not harassment. Yes, it is harassment. Yes, it is. I have not did anything. Hold on. Could you explain us the situation about the breakins? We told you we just got in town and you're still trying to tell us about an ID for what? Right. You haven't done anything. Did they break into something? No. So, a call to say that this car broke into that something. No, they didn't. Did someone tell you this is a part you need to look out for? Exactly. No one did. Well, guess what? I I'm not in any rush. I can hang out here till you want to give me your ID. I'm not I want you to call your sheriff. I want you to call me or call your um superior, your supervisor. I'm my supervisor right now. You rush them cuz you I um um Hold on, hold on, hold on, hold on. Call 911. Call 911. What is going on here? I'm going call the police. I'mma call the police. Okay. No, no, we're not. We're not doing that. Okay. Everyone in this car is detained. You can go back in the car and wait or or you can go in handcuffs and go in my car. She's not going to go. I tell her just get in the car. We're not detained. I'm calling the police right now on you. I'm calling the police on you cuz you came up here and harassed me. This is why the police exactly. We haven't did anything. Sit down. Just sit in the car. Hi. I police officer being a sheriff contact for no apparent reason. For no apparent reason. You can't even I Yeah, I don't even know if they are or not. I'm I was sitting in my um vehicle. I had dozed off for a second, was going to go into Starbucks. I get a knock on my window and the individual starts talking about breakins and I'm like what? And then I was like, okay. Okay, sit in the car or you're going in handcuffs. I'm not dealing with this. I'm going to handcuff and I have to use the rest. You can sit You can sit coffee from Starbucks. You can sit in the car. You can sit in the car. What am I taking? Last option. Last chance. Sit in the car. You're going to handcuffs. Handcuffs for what? Handcuffs for what? She start. That was one of the things. That's one of the reasons why we stopped here, too. For me to get coffee and I was telling her to get up and she'd go to the restroom. Oh, no. You're not going to do that. You're not going to violate or victimize us. Huh? I am in Castro Valley Starbucks. I just spoke with somebody and I got hung up on. Do you have an answer for my question? You do not. Okay. They don't want to listen to us. So, let's go ahead and detain these two. Okay. No. No, you're not going to detain them. No, you're not going to detain them. We haven't did anything. We haven't We have not did anything. Start the car. Get out of the car. I'm rolling the window down. Rolling the window down. No, I'm rolling the window down. I'm not I'm rolling the window down. Get out of the car. I'm rolling the window down. Get out of the car. I see us rolling down. Get out of the car. Get out of the car. No, I'm not. Get out of the car. I don't do anything. I'll get out. Just don't pull on me. I'll get out. All right. Get out of the car. Many things are wrong here. Simply refusing to provide identification without a legal basis for the request, especially if there is no reasonable suspicion is generally not grounds for detention. An arrest requires probable cause to believe that a person has committed a crime. Since the family has not committed any criminal acts, the arrest might be easily considered unjustified. Also, preventing someone from exiting their vehicle and using the restroom can be seen as an unreasonable seizure or detention, which could be considered a violation of their Fourth Amendment rights. But it is not over yet. Get out of the car. I am. You don't have to pull me. I'm getting out now. Get out. Stop it. Get out. Stop it. You're going to go. You're going to get in a lot of trouble.
