[Music] on August 31st 20124 an individual was involved in a car accident when the vehicle ended up in a ditch according to the individual control of the car was lost while making a turn which caused the crash the person mentioned that they had just dropped off some friends and were heading home when the incident happened crash into the ditch I know I went on a turn and then my car went like [ __ ] crazy bro you know like yeah I know it went in like totally in the ditch like it's Lally Stuck Like My Bumper going to come off if anything all right well I promise you I'm not drunk I promise you I the crash the officer instructed the individual to step out of the vehicle for safety and the person complied I'm so mad right now you don't even know who is like I'm fine I promise you all right give conducted a series of field sobriety tests first the individual was asked to perform the horizontal gaze nagus test where the person was required to follow the tip of a pen with their eyes while test the officer noticed signs of impairment following that the individual was asked to perform the walk and turn test which required walking nine he he to toe steps along a straight line turning and walking back with the same number of steps the individual struggled with this task taking 11 steps instead of the prescribed nine and failing to count the steps out loud as instructed step on this line right here absolutely so you're going to put your left foot on the line then place your right foot on the line ahead of your left with the the heel of your right foot against the toe of your left so you're going to be like this okay like okay good don't don't don't don't start don't start okay I'm okay okay okay I'm sorry I'm sorry so mhm and then keep your arms at your side okay so you're going to be like this okay and then you're not going to start okay yes absolutely okay you tell me whenever and I'm ready yeah I'll tell you okay I'll tell you when to start okay so do not start until yellow line yes and then completely on the yellow line okay and then you're going to take that small series of steps to turn and then take nine steps back like this okay one 1 2 3 do you understand okay yes sir okay so and then turn on your nin step keep your foot on the line and take us several small steps with one foot all right like I demonstrated to you absolutely absolutely and then keep your arms at your side at all times wash your feet and count each step out loud absolutely once walking begins do not step until you have completed the test you understand of course abolutely [Music] 1 2 3 4 okay so the last one the last test the last exercise is going to be the one leg stand okay absolutely so with your feet together and arms at your side like this like how you've been doing yeah raise one leg whichever you choose so either your left or your right you know what we're going to we're going to forgo that because she has that injury right there to her leg so we're going to foro because like I did go out with them and I do want to let them know like I am okay I do want to let call you can call them but right now let them they're going to absolutely like I'm fine okay stand with the car and reiterated that there had been no intention to drive under the influence she said she had a couple drinks right she said she's like going back on her statement she said that she went out with her friends they had a couple drinks and then they went had cou um but she she filed that me yeah and uh when you get the maximum deviation you got to hold it and you got to come out further like that but that's her eyes were immediately the sness was there immediately so anyway um to call her you had to go forward so now you got to make sure you do the walk and turn and all that stuff that she absolutely didn't even was no heel to toe before she went 11 steps and then turned around so yeah and she didn't count them out so you got to make sure you got all that noted down so you have your little notepad start writing that down now so you don't forget all right [Music] God um so we're going to have to get a 32 operator because the dispatcher is in there by herself nobody else here so um but prior if there's one available at the county we'll go do the breathalyzer but then you still got to take her to the hospital she's got to get cleared so if there's somebody available at the county run up to the jail do to the breath and then run over to Waterman cuz at this time should be in out pretty quick all right it shouldn't be that bad and then go back and finish up so this is going to run you into a so might as well when I just get out of the gym to go yeah exactly go do your thing and then there's your take this way um and I'll have Rodriguez come in at 5:00 so you can would need to take a breathalyzer test to determine their blood alcohol content well based on your observations mhm okay all right all just put your hands back rest DUI all right so now what's going to happen is uh well your car is going to be towed we're going to take care of that okay um and uh you're going to go up the officer is going to go ahead and uh you up to have another another test on it's the breathalizer okay and when he gets up there you'll explain all that to you and is going to read a bunch of information to you okay all right so put your ID back here with your you have shoes it's not that to provide you something for JA all right I'm sorry sir okay you don't have any weapons anything on you come over here you take a seat absolutely watch out it is kind of okay yeah okay test was administered and the individual was asked to blow into the device until instructed to stop to ensure accuracy the test was repeated the individual was cooperative during this process but formally charged with DUI the officer explained that the legal process would involve a court appearance where a judge would determine any further penalties such as mandatory DUI education classes or fines or like yeah they they'll let you take even if I don't on the phone call like is that am I able to look yeah yeah yeah I mean at the jail they'll let you go through your they also let you go through your phone to get phone numbers abolutely but like right now they when you do get there they're going to book They're going to wait for my paperwork to be done and then all the that's I'm now requesting that you submit to a lawful breath a test of your breath for the purpose of determining its alcohol content will you do will you take this test absolutely okay I said that's it so yeah got
