on September 16th 2023 an officer noticed a vehicle driving erratically swerving across Lanes without maintaining a consistent path hi ma'am hi what's going on was it my lights yeah your lights are off and took a while to stop and you hit the curves multiple times is there a reason for that and I see that you've been crying so what's going on just stupid stuff off I don't I don't know I don't want to like get into it but just stupid stuff I shouldn't I shouldn't have beening about where are you coming from before this it was um upon stopping the vehicle the officer approached the driver and immediately noticed signs of severe intoxication the female driver appeared disoriented and unsteady concerned for her safety and that of others the officer initiated an investigation by asking for her identity driver's license and vehicle registration the female driver complied and provided all the necessary documents to the officer after reviewing her papers the officer requested that she exit the vehicle and step onto the road for safety reasons shorties and then nuckies okay nuckies closes at 12 so well was n and then shorty for now okay and where you trying to get to right now now I'm going home to benas all the way to benas okay you want to STP out for me real quick I turn off whatever you want to do and nothing in your pockets correct no just my phone okay you've been drinking haven't you yes just a a little bit I think more than a little bit let's let's step back over here right right over here just because of the traffic right behind your car there you go I'm going to pat you down just just to make sure you don't have anything on you as she moved the officer noticed her unsteady gate and the strong odor of alcohol emanating from her these observations combined with her physical appearance confirmed the officer's suspicion that she was indeed intoxicated recognizing the seriousness of the situation the officer prepared to conduct further assessments to ensure the safety of the driver and others on the road how much have you had to drink now St they had two Dr that's it and the first two drinks at nuckies um how big were they you can turn a strawberry margarita and then I gu another strawberry margarita how big are those margaritas more or less I'm not sure how big they are are they like this big this big smaller like this yes well I had straw marar strawberry margarita and then I had another um like smaller Margarita okay that makes sense and then shorties you said two two was it another two margaritas yes okay and were those a little bigger or a little shorter or smaller smaller okay any shots in between I think one one green tea but that's it okay so four margaritas and one shot okay how long ago was the last one it's about little past 2 o' the shot was kind of a wild B okay but that was your last drink the shot yes okay and how long ago is that like 30 minutes an hour maybe like 45 45 minutes ago and did you eat in between or any time before that no you didn't before at home okay so when was the last time that you ate at home claiming that her drink choices were not significant this admission complicated the situation as it indicated a level of intoxication that she was unwilling to acknowledge her refusal to accept any responsibility or potential charges made it clear that she was not cooperating fully with the officer's investigation prompting the officer to consider further actions to address the situation appropriately okay and when what time was that3 through Thea like it's repeatedly going up and down the roadway check area that one more time like 7 something 7:00 was the last time you actually ate okay so we're going to step over there because I am going to have to do some Stander field toy tests on you cuz you're obviously drunk the way you're driving showed me that you're drunk you hit the curb multiple times so if you want to set your wallet down right here or in your car you're more than welcome to if that's something that you want to do okay and we'll go under there just so the rain doesn't doesn't affect anything okay give me a second go over there now or give me a second I'm going turn off my lights and then walk over there let's go there um yours is probably better unless you can move my unit you do right here okay I'll back my unit up there and okay right here's good something5 case number 2749 repeating 2749 do you wear glasses or contacts no no the officer escorted the female to a well-lit area to ensure visibility during the assessment there the officer informed her that they would conduct a few tests to evaluate her level of sobriety after briefly explaining the purpose of the tests the female agreed to participate 19 [Music] do you want to um you want to put these down real quick your your wristlet and um whatever you want to take off your jacket you can do that too so what you're going to do you're going to put your feet together and Your Arms by your side feet together Arms by your side and then you're going to stay like that until I tell you to do otherwise you understand you want to get under this one right here so the rain don't hit you cuz you're going to have to be looking with your eyes for this one are you okay like that yes okay okay so stay like that until I tell you to do otherwise do you understand okay so what you're going to do you're going to look at the tip of my pen with your eyes and your eyes only do not move your head whatsoever do you understand don't move your head you're still moving your head this cooperation allowed the officer to proceed with administering standardized field sobriety tests the officer began the evaluation with the horizontal gaze nystagmus test he instructed the female to focus on the tip of a pen that he held in front of her face as she followed the movement of the pen with her eyes the officer observed her eye coordination and tracking ability the test aimed to identify by any involuntary eye movements that could indicate impairment due to alcohol consumption okay I'm going to do that one more time cuz you're you keep moving your head every time I move my pen all you have to do is like look to the side you don't have to like look right at the pin just as long as you're like you're looking to the side where it goes okay hold on it's really hot okay okay get in the same position arms together feet by your side and then just just don't move your head okay just look with your eyes still moving ahead man [Music] okay so uh the female individual was observed standing in a public area visibly intoxicated and in distress despite her desire to leave her level of intoxication made it unsafe for her to do so um go ahead get in the same position feet together Your Arms by your side and then this one I'm going to tell you and I'm I'm going to show you how to do it in case you have any questions so what you're going to do uh first put your right foot in front of your left foot heel the toe for the starting position the other way switch your feet wait you said right in front of your left and then put your arms by your side can you do that I just have to throw up okay go ahead and throw up right here I I have to pee no I have to pee so bad and I don't want to pee out here I don't want to pee out here I really don't I well I I can't help you as far as that you know so I mean I have you pe somewhere else you need to throw up throw up just throw up here right here are you okay do you na a minute I just want to throw up and like in front of you like it's it's not trust me it's not going to bother me it's not going to bother me you want to throw up on the side right here and if you don't want to throw up in front of us I can't just not watch you so I know if you want to throw up right here on the side you can do you need a little bit before we do this next one she said throw up recognizing the potential danger she posed to herself and others Law Enforcement Officers intervened they assessed her condition noting the signs of her intoxication particularly in her eyes which indicated a high level of impairment she want to throw up right in front of me oh you want to walk to where the light is the light pool is you want to walk there and do it I'll help you come on walk walk to the grass I don't want you to make a mess for them right here right where the light pole is just tell me when you're ready 5 say no down she's the driver here is about to throw up she's pretty intoxicated you have like an actual restroom every everywhere is closed and we can't leave this traffic stop even if you have to pee so if you need to make yourself throw up to make you feel better char [Music] Evelyn to ensure her safety and well-being the officers decided to escort her back to a well-lit area this action was taken to provide her with a safer environment while they conducted an investigation into the circumstances surrounding her intoxication chy if you're too drunk to do these last two tests just try your best okay like I said I'm giving you some time to so you can throw up so you're not stopping during the test and making yourself feel more sick okay can I like stay with someone here you cannot stay with someone okay but let's finish these last two tests and then we'll get to what we get to all right cuz you're I still get charged to something right as of right now you are intoxicated you are driving okay so let's finish these last two tests I just want make sure that you're not going to throw up on yourself while we're doing these tests okay M but either way when yall like let me go I'm still going to get charge something as of right now to tell you the truth you're you're not you're not going to leave because you are intoxicated and no one's not I'm not going to let anyone pick you up so if you could do these last two tests for me if you think you're able to cuz you look like you're kind of falling asleep I have to pee like really like I have to go to the restroom I I understand but I there's I can't take you to a restroom there's no restrooms close by if this was open I let you go in but how do I like actually go to the restroom like I don't think you can go to the restroom out here so what do I do like to go to right now I'm worried about the the test okay cuz I was giving you a little bit for you to throw up up so are you okay to continue continue last two tests M okay okay come on go to the same spot where we were at just to this third one right here right there where you're at you're going to need some some room for this one right there's good so so once again put your feet together Your Arms by your side and then for the starting position put your right foot in front of your left foot heel to toe and stay like that until I tell you to do otherwise and try not to landan on that wall okay the goal was to ensure she received the necessary support and assistance during this difficult time the female officer detailed the series of sobriety tests administered starting with the walk and turn test she explained the instructions clearly emphasizing the importance of balance and coordination so what you're going to do for this first test you're going to walk nine hiler toe steps in those nine heer toe steps you're going to count out loud one 2 3 and so on until you get up to nine in those nine H toe steps you're going to keep your arms by your side and then you're going to look at the tip of your feet and on the ninth step you're going to turn around in a series of small steps and return nine little toe steps back so it's going to look like this this be the starting position this is going to be your first step one 2 three and so on until you get toight and then you're going to turn around like so I want you to watch this I want you to see this you're going to turn around in a series of small steps and then return nine heel little toe step steps back so this going to be a first step one 2 3 and so on until you get to 9 do you understand do you know how much it's going to cost I know I know I'm going to fail I know it's it's not a p or fail type of thing it's it's not that kind of test going have to pay for a lot as of right now uh fines fines shouldn't be your issue and go ahead and get back in that that starting position all right don't don't start yet don't start yet Put Put Your Arms by your side Arms by your side please okay so one more time nine hit or toe steps look at the tip of your feet in an imaginary straight line can out loud to where I can hear you and keep your arms by your side you understand do you have any questions for this test I don't think so okay so you understand it yes okay so you can start however during her own demonstration she struggled significantly exhibiting noticeable imbalance and failing to complete the test successfully you can start go ahead one keep keep going two three 5 I don't know what else to say or like okay so did you understand the test I don't think I okay so I said nine hit or toe steps and then on your ninth step you're going to turn around in a series of small steps and then when you turn back around you're going to return nine little toe steps back Keep Your Arms by your side count out loud to where I can hear you look at the tip of your feet okay and you're going to walk in an imaginary straight line okay M you want to try again yes all nine and nine nine nine front forward and nine back do you understand it now yes okay so get in the starting position with your right foot in front of your left foot and Your Arms by your side and Arms by your side there you go and then start whenever you're ready you done with the test that was N I don't know this highlighted the challenges of accurately assessing sobriety Under Pressure following the walk and turn test the officer instructed the female to perform the one- leg stand test although she agreed to attempt it she was unable to maintain her balance and failed to complete the test so this is going to be the last one nine and n n and n yes ma that that's that's okay that's okay you you already did the test so we're going to go on to the next one so it's going to be the same thing I'm going to tell you and then I'm going to show you how to do it so continue to put your feet together and Your Arms by your side and then stay like that until I tell you to do otherwise you understand okay so on this one you're going to choose whichever foot you're going to pick up that foot and you're going to point it straight Point your leg straight and then point your toe as if you're pointing it to a wall okay so you're going to pick up your leg approximately 6 in and then you're count going to count out loud 1,1 100002 13 and so on until you get until and so on until I tell you your stop okay and then while you're doing that you're going to look at the tip of your the tip of your toes and then you're going to keep your arms by your side so it's going to look like this whichever foot you're comfortable with it's going to look like this 1,1 1,002 13 1004 and so on until I tou to stop do you understand okay you can go ahead and start try not to use the wall too much I I haven't told you wait wait so if you put it down just pick your leg back up and I'll tell you when to stop okay just keep going okay the results of both tests indicated significant impairment confirming that she was highly intoxicated while driving Under the Influence after failing the sobriety tests the officers arrested the female and placed her in the vehicle for transport to the station okay you can stop so you are going to get arrested for DWI okay do you have someone that can come pick up the car if not it's going to get to you do have someone that can pick up the car that's close by 30 minutes I'll check with my supervisor on that but who's uh who's 30 minutes away my mom okay you want all your stuff to go with you yeah I'll come back she said her mom's 30 minutes away if that's okay 30 minutes 30 minutes okay okay get get my stuff yeah I'm going to get it I'm going to get it I got you okay that's fine got a inbound sheets and a booking sheet so I have booking sheets too just I didn't fill up on pound sheets I got you okay uh you want to start your booking sheet out here that way you don't have to do it out there at the jail you want I usually do it when I'm waiting perfect yeah cuz they they take a while anyway so it's going to be get pounded right it's up to you this is your stop I just thought I figured because she was by herself right and she lives in Benz yeah we wait 30 minutes from Mom yeah so that's that's why I said it's so roll the record if for some reason or other mom gets here first um so you're leaving it up to me you your call if you want to wait that long no no no no no supervisor's call however long it takes cuz I don't want something to come pop off and then you're here waiting with a recer so yeah exactly so cuz I know this time it's a lot goes on we called for a recer already okay and um if mom shows up first then you okay by releaseing tomorrow if she shows up first that's fine I don't it's that's why I'm asking you I don't know who this is they're coming in I don't let me get her stuff yes sir upon arrival they completed the necessary documentation and conducted a breathalyzer test the results revealed that her blood alcohol content was above the legal limit further substantiating the charges of driving Under the Influence what is your question no I was I um I have her location it said that she was here M so I was just making sure she that she was okay uh I mean if she's welcome for one of y'all to release a vehicle to cuz if not it's going to be impounded okay are yall sober yes ma'am okay these are her friends you want me to ask her if it's okay to release the vehicle to one of them they said they're sober okay how how many of y'all are in that other vehicle two of okay so where y'all leaving from yes ma' we we were working okay cuz if y'all had one y'all cannot take the vehicle we were we haven't had any okay so let me ask her if uh it's okay to release the vehicle to one of y'all uh your friends that were working the bar right here mhm is it okay if one of them drives your car if not it's going to get impounded who's driving my car who's going to drive her car I will yes that's fine okay where are your keys right here you see yes anything else you want to take off from it okay Che
