tell me I'm not looking at what I'm looking at on December 23rd 2023 a police officer observed a vehicle operating erratically weaving in and out of lanes without regard for Road Rules the officer decided to pull over the vehicle to investigate the situation further the driver's erratic Behavior raised concerns about their potential impairment or other issues hello how are you good I'm Sergeant M New Mexico State Police reason I stopped you is because you're failing to maintain your decl you're signaling but it's not continuous until like you actually switch like you signal and then it stops and you s so technically it's not really signaling sorry uh and then you're going uh kind of fast yeah so do you have your license insurance yes where is it that you're headed to I'm just going to my house on okay and U upon stopping the vehicle the female officer approached the car and began an investigation with the female driver she asked for the driver's license and registration while assessing her behavior and demeanor the then in the in the um are okay I just picked my friend up okay do you mind sipping out with me no fine and then to my front passenger tire if you would okay fine Sor right here where my tires at so you're picking up your friends from canvas yes were you at canvas yourself no but I was going to go but everyone got kicked out oh okay so what time did you get there uh I don't know I wasn't paying attention to the time okay but my friend said they got there at 10:00 they got there at 10: yeah you have any problems with your vision uh just one of my blood sugars high but have you checked it recently yeah and what was it at and was that pretty normal for you or it's not normal but it's kind of high just because I ate dinner late okay oh what time did you did you eat dinner the female driver admitted she was heading to her friend's house and began offering additional details about her journey the female officer requested the driver's registration license and ID card for verification about 7:00 I would say like 7:30 but okay 7 and you typically eat what like about 5 4 in the evening no I typically eat about 7 8 just because I work late kind of oh okay okay what do you do for a living I work so New Mexico independent audit uh the so they they kind of like work with the all the the dealerships so like they work with titles as MBD okay do me a favor traffic's kind of crazy but you're a little taller than I with the shoes I know well the boots cuz I was planning on going to cavas but right you got kicked out okay do me a favor and sit on my push bumper will you if you can yeah lean on it okay there you go so what you're going to do is you're going to follow the tip of my finger with your eyes and your eyes only okay and going to remain at your side yeah okay so it's going to look like this based on the driver's physical appearance and the condition of her eyes the female officer suspected that she might be intoxicated the officer instructed the driver to step out of the vehicle and moved to a safer area on the road to conduct a more detailed investigation they discussed the situation further and proceeded with field sobriety tests to assess the driver's level of impairment 2 3 again to I'm going to take three you take nine okay leave that LE foot you're going to take a series of short steps then explained the walk and turn and oneel leg stand tests which are commonly used to assess sobriety the police officer informed the female driver that based on her performance in the sobriety tests she would be taken into custody the officer arrested her and secured her inside the patrol vehicle so there's like a button that opens your dash no or it's underneath and it's right there glasses case Okay so walk with me this way do you have somebody that can come pick up the vehicle or should I do I need to tow it uh you can call my mom okay your phone is where uh it's in the car okay what does saying 30 minutes so it's because it was far far from me right now yeah so it's trying to connect again okay so help me help me try to understand this with you having signs or like so with your um no sorry let me let me ask the question with you having that and it being far or whatever and it's going to show that um so the nail Clash remover is going to it's going to be similar symptoms of liquor because anytime you are high or low the blood sugar So Below 80 or over 250 it's going to come up as like high or low and it's going to be similar symptoms of having liquor in your system or nail plush remover so like it's going to like I don't know how to explain it to you like like so okay so if you pull someone over and they have liquor in their system their mouth is dry right right okay so that's the same thing as pulling someone over and the blood sugar being high or low and their mouth being dry because of the similar symptom that's okay so what I'm saying is you also showed signs and clues during my test and Performing poorly as far as walking um yeah and things like that and it's similar because as a you're going to show similar signs to similar signs to someone with like alcohol in their system okay and give me one second okay it's fine sorry no you're good um so the adrenaline rush is going to make my blood sugar go high just so you know okay so do me a favor again we're going to look at the tip of my finger okay that's fine your eyes and your eyes [Music] only she was then transported to the police station for further investigation upon arriving at the police station the female driver was asked to take a breathalyzer test but she refused to comply this refusal prompted the officers to scrutinize her identification further okay so the other officer that I called um does DW ice for a living like that's his bread and butter okay so I called him to verify cuz I did read what you were telling me it's accurate right it is however he says if you still exhibit signs of nagus after 2 seconds then there's alcohol on board so if um was in a a place where it was exhibiting signs that would show me like the alcohol I mean symptoms like similar to alcohol right so um that's the way that I can verify it um we're going to go from now from here right now okay so I cannot force or I cannot force you to take our test but if you refuse you will lose your new medical driver's license or non-resident operating privilege for one year if you are convicted in court of driving while under the influence you may also receive a greater sentence because you refuse to be tested do you understand yes okay so just cuz I have to read it your right to speak to an attorney or remain silent does not apply to the can I use tell me I'm not looking at what I'm looking at you're not a fake ID that was B for me and you have it within your possession Sor and you have it within your possession it was I could put it in there in your wallet no where you pulled your other ID from my other ID wasn't in there okay what you need water can I peat yes later the female driver was presented in court where she faced multiple charges reckless driving for her erratic behavior on the road failure to follow traffic laws and maintain proper lane discipline driving under the influence of alcohol and using a fake ID card each charge reflected a serious breach of legal standards
