Ryan, he just grabbed a nail gun. Show me your hands. Show me your hands. KEEP YOUR HANDS OUT THE DOOR. With your RIGHT HAND, ROLL THE WINDOW ALL THE WAY DOWN. ROLL THE WINDOW ALL THE WAY DOWN. >> DON'T TASE ME, PLEASE. >> ROLL THE WINDOW ALL THE [screaming] WAY DOWN. >> ROLL THE WINDOW DOWN. >> SLOWLY OPEN THE DOOR. >> DON'T TASE ME. >> SLOWLY OPEN THE DOOR. >> DON'T tase me. Please. Please don't tase me, dude. Don't tase me. >> OPEN THE DOOR. >> DON'T TASE ME. >> FACE AWAY FROM ME. Let me see your hands. FACE AWAY FROM ME. STEP OUT OF THE VEHICLE. >> On March 10, 2023, in Lake County, Florida, a deputy responded to a residential trespass call. The subject refused to leave, retrieved a nail gun from his vehicle, and pointed it at the officer. He was charged with four offenses and sentenced to 36 months of probation. The trespass warning was legally valid. Under Florida statute section 8109, remaining on property after a warning from the lawful occupant is a criminal act, regardless of any personal relationship to the people who live there. A prior well-being check at this same address 7 days earlier had already established that the subject did not reside there. >> What's the world? Nice to see you, too. What's your name? >> This is my home, dude. What do you want? >> Do you live here? >> This is my wife's home and my son's home. Yes. >> But you don't live here? >> Yes, I live here. My address is here. >> But do you live here? >> I own this property. Yes, sir. >> Would you like to calm down? >> All I did was pull up. You don't have to have an attitude. So, take a deep breath before you make a mistake. Calm down. >> Yeah. >> The person mouth off to. >> Why? >> You trespass. You don't live here. >> Yes, I do. >> No, you don't. address. >> You don't live here cuz you called me for a wellbeing check last week >> and you didn't make it. >> I did make it. >> Then why didn't you call me back? >> Because she's already spoken to you. >> What? >> 211041. That's what I do. >> I'm out of here. >> All right. You're being trespassed. If you come back, you'll be taken to jail. >> Okay. >> Thank you, sir. I'm a carpenter, bro. >> Okay. Kick rocks. I >> started my own company. >> Kick rocks. >> Mailor made custom carpentry. He's highly right. I believe he's going to be taking a tent here now. >> Trying to find my keys. >> You're fine. >> Find your keys. Come on. The faster you get out of here, the faster I don't have to deal with this more. Come on. >> I don't have my keys. >> Okay, then walk. You're being trespassed. I'm not trying to hurt you, dude. I just want to ask her to marry me. >> Okay. She doesn't want to marry you cuz she wants you to trespass. >> But I like Batman, man. >> Trying to give her stuff, dude. Just relax, okay? I'm not doing anything wrong. >> 54. He's not just extremely. >> I'm moving out. I don't want to live with her anymore. I don't want to be married anymore. Okay. >> Okay, >> that's it. So, don't shoot me or anything like that. >> I don't plan on shooting you unless you do something I'm really really stupid. >> What would I do? >> Come at me. >> Why? >> Cuz you're extremely agitated. All I asked you to do is leave. >> I'm happy as I just got a new job. >> Fantastic. Well, let's go be happy somewhere else other than here. >> I found a gun. It's a rigid. I was going to give it to my son. My bachelor party, dude. >> Okay. >> Are you going to look for your keys or are you going to walk? Which one? [clears throat] >> Thanks, Steve. >> Don't walk up on me. Walk away. >> What? >> Walk away. >> Why? >> You're being trespassed. >> Why? All my little here. >> You don't live here. You don't live here. >> Yes, I do. I live here. >> No, you don't. I was out here last week. >> Five years, bro. You don't live here anymore property. >> Okay, take a deep breath and calm down again. >> Thank you. Don't arrest me. >> I don't plan on arresting you unless you stay here. >> I'm not doing nothing wrong. Don't arrest me. >> All right. I just got put my son stuff there. All right. I'm joining army. I'm out. >> No problems. >> Fantastic. No problem. I don't want any problems. >> Forget half of this is Palooa County. >> This is Lake County, >> but down there is Valuchi County. >> Down there is Lake County, too. >> But down further is Valuchia County. >> You got to go about 10 miles down 44. >> Start pushing me then. >> I'm not pushing. You can get out or you can go to jail. >> What? >> You can leave or you can go to jail. Those are your options. How am I going to leave? >> You got two feet that work just fine. You've been walking around here the entire time. >> You can call a tow truck for your property. >> Don't pull Don't pull that gun. >> I'm not pulling my gun. My hands are on my chest. You're fine. >> She tried to shoot me. She smacked me in my house the other day. >> Did you hear about that? >> Where was that at? >> Pearson. >> Did you call the police? >> Yes. >> Okay. Did they file a report? >> No, cuz you said I made it up. >> I don't work for Pearson police. You say I'm making [ __ ] up for >> What are you yelling at me for? >> Because she's lying to you, dude. >> Listen, dude. I haven't even talked to her. I came out and did your well-being check last week. I know you don't live here. You've already lied to me and said you do live here. So, I'm going to give you two options now. And one option one is to leave. Option two is to go the to jail. >> All right. Don't do it. >> Try my get the out of here. All right. All right. Look, >> give me the channel. What are you doing? >> Stop dumping all your on my property. >> We can trash that later. Just call my son. Dude, >> you need to get out of here like now. >> When the subject retrieved the nail gun, the legal category of the encounter changed under Florida statute section 784.07 subsection 2C. Assault on a law enforcement officer with a deadly weapon is a thirdderee felony. Florida courts define deadly weapon to include any object capable of causing death or great bodily harm when used in a threatening manner. A pneumatic nail gun meets that standard. The subject claimed he was trying to hand the nail gun to his son. Under Florida statute section 784.011, assault is defined by the threat created, not the intent behind it. If the act produces a wellfounded fear of imminent violence, the statute is satisfied. The subject's stated motive does not override what the law requires in response. The stalking charge rests on a documented pattern. Under Florida statute section 784.048, stalking requires willful, malicious, and repeated following or harassment. One well-being call at this address the prior week, followed by his return 7 days later and refusal to leave satisfies the repeated conduct element. Resisting without violence under Florida statute section 843.02 02 requires only obstruction of an officer in the lawful execution of a legal duty. His extended refusal to comply with departure commands repeated across several minutes meets that threshold without further analysis. >> Ryan, he just grabbed a nail gun. Show me your hands. Show me your hands. KEEP YOUR HANDS OUT THE DOOR. With your RIGHT HAND, ROLL THE WINDOW ALL THE WAY DOWN. ROLL THE WINDOW ALL THE WAY DOWN. >> DON'T HAZE ME, PLEASE. >> ROLL THE WINDOW ALL [screaming] THE WAY DOWN. >> ROLL THE WINDOW DOWN. >> Slowly open the door. >> DON'T TASE ME. >> SLOWLY OPEN THE DOOR. >> DON'T tase me. Please. Please don't tase me, dude. Don't tase me. >> OPEN THE DOOR. >> DON'T TASE ME. >> FACE AWAY FROM ME. LET ME SEE YOUR HANDS. FACE AWAY FROM ME. STEP OUT [laughter] OF THE VEHICLE. >> STEP OUT OF THE VEHICLE. >> DON'T TASE ME. PLEASE >> STEP [screaming] OUT OF THE VEHICLE. >> I'M REALLY SCARED. DON'T TASE ME. >> STEP OUT OF THE CAR. >> DON'T TASE ME. PLEASE, DUDE. DON'T TASE ME. Don't [music] tase me. Please. Please. Please. Please. Please. Please don't. I'll leave. I'll leave. I'm leaving right now. >> STEP OUT OF THE CAR. >> I'M SORRY. >> STEP OUT OF THE CAR. LAST WARNING TO STEP OUT OF THE CAR. FACE AWAY FROM ME. >> DON'T TASE ME. Please don't tase me. >> Face away from me. >> Taylor, you need to step out of the car and face away from me now. >> Don't tase me. Please. Please don't tase me. Please. Please. Please. Please don't. >> Place your hands behind your back. >> What? I do. >> Place your hands behind your back. >> DO NOT MOVE. DO YOU UNDERSTAND? >> Do you understand? >> Yes, sir. like he's detained. You can clear it. >> Don't tense up. >> Sorry. Sorry. Sorry. Sorry. Sorry. Sorry. Sorry. Sorry. Sorry. Stand up. >> I'm sorry. I'm sorry. I'm sorry. I was just trying to get my just trying to get my son some stuff. That's all. Stand up. >> It's his birthday. >> You're going to walk over here now. >> It's just It's his birthday, dude. That's all I was trying to do. >> Okay. Well, you're done up now. >> Why? >> Really? Grabbing a nail gun and pointing it at me is all >> I didn't. I was trying to give it to my son. Buddy, >> that's not what you did, bud. I was trying to get >> You opened that passenger door and pointed a nail GUN AT ME. >> NO, I DID NOT. >> It's not even No. >> Don't tense up. >> What are you doing, dude? Why are you doing this to me? >> Because you pointed a nail gun at me, buddy. >> You did. >> I did not. >> I watched you do it. >> I did not. >> You're a liar. >> I'm not lying. >> You're lying. >> I watched you do it. >> You're lying. >> All you had to do is leave. That's it. >> That's all I'm doing is leaving. >> You weren't leaving. And you were pushing stuff out of the car after several times I told you to leave. >> I just want to give my son his birthday gifts. That's all. >> You have anything on you I need know about? Anything that would poke the curtain in any shape or form? >> I don't think so. >> Just trying to say bye to my son. I was going to go join the army. >> Who is it? >> My son's nail gun. It's not my son, dude. It's for his mother. He started quiet >> relaxed for my son. Relax. Okay. Ram. I'm fine. >> He started jumping on the passenger seat. >> I'm fine. I'm fine. >> When I came around the corner with my taser at you, you pulling that nail gun at me. >> Hey, did I tell you to get up off your chest? >> I'm sorry. Sorry. I'm sorry. I'm sorry. >> I just She freaks me out, dude. She always takes my son and makes me freak out. I don't know why she keeps doing this to me. >> You got anything that's going to poke me, cut me, stick me, stab me? >> No, dude. I don't do drugs. >> You got any razor blades, knives, anything like that? >> No, man. I don't think so. Roll up around to your right side. Sit up. You're getting ready to stand up. Undo these hands. Take your hands. >> I told her she does this every time. She makes me freak out and splits my son and you guys take me to jail every time. >> See clear. >> I'm perfectly fine, dude. >> I have >> Okay. >> Thank you. Double lock it, please. >> That's what I'm trying to do. >> Uncclas your hand for me so I can do it. >> Sorry. >> Hope you're good. >> Thank you. >> All right. There you go. >> Thank god I'm falling. >> All right. Have a seat. >> I'm finally free from her. Dude, >> she's such a horrible person. >> She's such a horrible person, dude. She's so >> She takes my little boy away all the time. >> There's no reasoning for it, dude. >> I think it's stalking at this point. >> Yeah, I agree. >> I was on the way up here. >> I unwanted, repeated. >> The well-being check, she said this isn't the first time. Last when I did the wellbeing check, she said it wasn't the first time. >> Okay, so >> I'll uh photograph this. >> I'll go as far as even getting a statement from her real quick. Um, see if she wants to. All right, we'll walk down here a little bit in the shade. I like the shade a little bit more. >> Oh, yeah. I had my adrenaline going. >> Me, too. Not every day I get a nail gun pointed at me. Um, as far as it goes. Hey, puppy. Thanks. Um, as far as it goes with his vehicle, what would you like to know? We can tow it. Um, we That's We can tow it or we can leave it. none of our options unless you have private arrangements that you'd like to specifically do for because you know family or something like that can come pick it up. Um >> I think he stuffed his key under the gate. >> Is that the key to the truck? Well, the thing's binging when you open the door. It's binging like there's a key in there. Where is the cat at? >> There's no cat. It's >> doing It was doing that last time I was out here and it >> um Okay. Um as far as it goes, um >> I tried to do what you suggested. I went through the county. No, the exparte and I I went to Bay County and they said, "No, you have to go through his county." So, I was like, "Great." I printed out all the the text messages of him acting crazy and wrote my statement, had it typed out, printed it out. >> Which county was this that you had to go through now? >> I guess his >> Did you have a chance to file it with them or anything yet? >> No. I've been so mentally exhausted. I haven't even I had so much stuff that I needed to do today and I'm just kind of like I didn't think that he was going to come out here. >> Is Is there a child custody agreement in place? Is it like you get 100% he gets like zero? Is it he gets the second court weekend? >> We never went for custody at all. I just let him take him every Friday and he bring >> it was kind of a mutual verbal agreement. Okay. So it had gone to court. >> Yeah. >> Okay. >> He brings them back Monday. He goes to school and then he comes and takes him to scouts. He was everything was fine. It was great. And then he just has this mental snap and I don't know what triggers >> I remember you said that last time that he has mental snaps. >> Um >> and this is the first time I thought he would be long gone by the time you guys got here. >> So as far as it goes, I'm going to have to review the statute, but I I do know that he called in the wellbeing check last week. Was there anything between the wellbeing check and today? >> No. >> No. Did he I I know he blew up your phone that day of the wellbeing check. Has he still been blowing up your phone? That's why it's like he he knows >> he just disappeared. >> Yeah. And then he he ends up over here in in my woods and I hear Jack saying, "Okay, I'll be there in a minute." And I immediately was like on guard. But I mean, as far as the truck, I'm sure uh his family or somebody would come. >> Are you able to contact his family for him to come pick it up or >> they're already coming here uh tomorrow to pick up my kids? I I got >> So you just want to leave it so they can pick it up then? >> Yeah. >> Okay. Today he's going to be going to jail. Um, and >> and that's that he did >> aggravated assault on law enforcement when he decided to point a nail gun at me. >> Um, >> he he kept claiming he was going to leave. He was going to follow the trespass and he just kept going and kept going. >> Maybe he didn't know he put a key underneath my gate. >> He wasn't even looking for the key anymore. He was just dumping crap out of the car. That's all he was doing. He was doing a mess uh a mass exodus purge of everything out of that car. >> I don't understand that either. >> He kept claiming everything was his sons. The dictionary is his. I'm pretty sure the purse is not my kids. >> Yeah. Um, as far as that goes, would you be able to fill out a statement, a written statement for the event that occurred today? You seeing him in here in the woods, stuff like that? >> Yeah. >> Um, if a crime can be determined on the fact that you are the victim, do you want to press charges? >> Uh, as far as trespassing, he's going to be trespassed. Uh, he refused to trespass. Um, on top of all the stuff with that, uh, you're possibly looking at snaring. I would have to review the statute to be 100% certain for you. >> I don't want to, >> but >> you know, put the bear anymore. >> Let Let me Let me put it this way. This isn't something that you're doing. >> Yeah. >> This is him doing actions and these are repercussions. >> As far as the statement goes, the statement is just to document the events that occurred today prior to me showing up. And I everyone that's around him, we all try to like cushion him from like this, you know, let him be crazy but not get out of line. But now and then when he get starts getting out of line, then we try to intervene and fix it. But >> what about you sent me calls? >> Oh, yeah. He sent me I have all the I think I have them on my car. All the the text messages that he You want me to show you? >> Well, can you tell me about them first? Uh he was just saying like how we're still technically married, that we're common law married, that he we reside in Laurel, that we both technically still live at Laurel. Um he asked like, "Will you marry me? Your name should have been Jennifer." Just craziness, just nonsense. >> Okay. >> Do you feel threatened by him? >> No. I would smash his face. Like without a doubt, I do not feel threatened by him. But he's unpredictable. I just I just don't need the the crap, you know? Like I just don't need it. Uh when I went to pick up >> Do you feel like he's harassing you in any way? >> I picked up Jackson Sunday or I mean Monday of school and I had to go pick him up over at Taylor's house and when I show up he's erratic. He's throwing stuff at my car and um I told him I said I'm getting him and I'm leaving. And I said don't don't contact me. leave me alone and when you get fixed then you come you call me and he just >> he left you alone but then today is what what happened. Okay. >> Set up. >> That's I got COPD. Dude, >> what are you doing? Sitting up. >> What are you doing? >> I have EMS coming to check your oxygen. Just stay sitting up. daylight cannot act. I just want to see my son. >> But we're not doing that no more. >> Sorry. >> That's out of the options. >> I can't see my son anymore. >> Well, we're going to jail. We're not going to a daycare. You do realize that, correct? >> No, I thought I was going to see my son. >> No, we're going to the jail. That's why you're in handcuffs in the backseat of a marked patrol car. >> Why? aggravated assault on law enforcement, stalking, >> resisting without violence, and trespass after warning. Those are your four charges. >> What are you talking about? >> The whole incident back at that house. >> What house? >> The house that you were trespassed from like 10 minutes ago. >> What are you talking about? Where am I at? >> You're inside of a Lake County Sheriff's Office patrol car. >> What happened? I thought I was dreaming or something. I was in my bed a minute ago. What the is going on? What happened? Is Jack's okay? >> Jack's fine. >> I had a dream and a gator ate him. He was down in the springs and he was down by the water. I wasn't there to protect him and the gator came and ate him. Bad dream. It's a bad dream. It's all a bad dream. It's got to be a bad dream. I'm not a bad guy. I swear I just woke up and I just was going to get my son. I don't What the happened? Did I hit my head or something? >> No. You uh you pointed the nail gun at a deputy. >> A nail gun? >> You pointed the nail gun at a >> The orange rigid nail gun I was giving my wife. I was trying to give it to her. >> You pointed it at me. >> Who? >> At me? >> At you? >> After you shuffled around in your truck for a minute. After I specifically told you to leave, you opened the door, started throwing everything out after you ran at me. >> Dude, I I must have blacked out. I'm sorry. >> I'm more than happy to refresh your memory. >> I smoked some weed up the road and it it was it just messed my head up. I'm sorry. >> I I just want to be a good father. That's all. Like my dad was. He was such a good dad. I remember when I was like 17, some lady got hit by a Mexican beard and he ran out and he saved her life. It was so horrible. The glass smashed her face and threw shards of glass all over there. My dad was picking it out. He's amazing. >> The deputy receives a B+. His vehicle extraction sequence was correct. Hands visible, window down, door open slowly, face away. His immediate radio advisory to his partner the moment the nail gun appeared reflects proper contact cover protocol. Under Graham versus Connor 490US 386 1989. Force is judged from the perspective of a reasonable officer on the scene. His taser presentation rather than firearm was proportional to the threat level at that moment. One note against him. The language he used around lethal force, telling the subject he would not shoot him, quote, "Unless you do something really stupid, is not a recommended communication practice." Conditional framing around deadly force creates legal exposure in any post incident review. It did not affect the outcome here, but it is the kind of phrasing that gets examined. The subject receives a D. He retrieved a nail gun from his vehicle after being ordered to go, pointed it at a deputy, and later admitted to smoking marijuana before arriving. His visible remorse in the patrol car did not change what the law required in response to what he did. The department receives a B. The deputies calibrated force appropriately, documented everything on camera, and directed the occupant toward formal legal remedies. The gap is in follow-through between contacts. The subject had been at this address 7 days earlier. No documented outreach occurred in that window and he returned. This footage makes five points clearly and they apply whether you are the officer, the person being told to leave or the person who made the call. Lesson one, a verbal trespass warning is legally binding the moment it is issued. Under Florida Statute Section 810 Z09, remaining on property after that warning is a criminal act. A personal connection to the occupant does not create a legal right to stay. Lesson two, any object retrieved from a vehicle after a departure order will be evaluated as a potential weapon, regardless of your stated purpose. The legal nature of the encounter changes at the moment the object is visible in your hand. Intent is a defense for trial, not a protection at the scene. Lesson three. Spontaneous post arrest statements are fully admissible without a Miranda warning. The subject admitted marijuana use without being asked. No advisement was required because the statement was voluntary, not the product of interrogation. Anything said on camera after an arrest without being questioned is usable in court. Lesson four. A verbal custody arrangement provides zero legal protection. Without a court-issued order, law enforcement cannot enforce parenting time. Any dispute that reaches the police will be handled as trespass or harassment, not as a custody matter. If it has never been before a judge, it does not exist in a way officers can act on. Lesson five, a protective injunction only works if you file it. Under Florida statute section 74130 and injunctions requires the petitioner to initiate the process. The occupant had the evidence prepared but had not yet filed. The court cannot act on evidence it has never received. 36 months of probation means court supervision, restricted contact, and a felony record if the terms are violated. The path to that result was not complicated. It was a trespass warning, a nail gun, and a set of decisions that could have gone differently at almost any point.
