[Music] on April 30th 2023 Florida Fish and Wildlife officers were on water Patrol at Lake bokeh when they observed that vessel north of the inter Coastal Waterway with several passengers on board seeing that these officers needed absolutely no probable cause to stop this vessel they did for some reason the officers didn't activate their body cams right away so the video starts a mid safety inspection and if you guys like my content or you're just vibing right now hit that like button because I me that's at you know 10:00 in the morning it keeps a lot of people that shouldn't be out here out here gra that one bil and then I got three more in the console all right pull them out let me see them uh 7978 box Trot Golf good good good good good good good good oh you got the commercial one too all right let me see a throwable fire extinguisher and a sound produc device you guys got a lot of people on the boat and this is a bait boat too there like you canect it from but this this is an operator's cognitive function instead of the balance and in my opinion designed to show impairment and incriminate yourself in court the first test will be horizontal gaze hgn it's fairly boring and officers never catch the eyes on their body cam so I'm just going to steamroll past it sit at the edge of your seat all right shoulder width apart okay are you comfortable feel stable you're going he allegedly showed signs of impairment during the hgn test but it's generally inadmissible in court so let's move on he bombed the finger to nose test by not initially closing his eyes and not touching the tip of his nose like ever giving him a high score of 13 clues of impairment nine clues or more is a fail on the palm pad test he didn't increase speed and he rolled his hands ultimately scoring him two clues of impairment and you only need two two to fail lastly the hand coordination test which is in my opinion a fail safe designed to fail the operator he didn't start counting 5 6 78 until the second step-like fashion during the return step motion I'm not even going to try to explain that and then he didn't return his left fist to the memorized position then he forgot to put his arms to the side at the end of the test giving him a high score of three clues of impairment which isn't too bad but anything over three means he's impaired according to nasbla anyways so let me know normal activities on the boat okay but he did these tasks and it wasn't just normal activities on the hold that for me okay so that's the reason why we're at this step now I don't believe you guys are bad people I just believe it an accident happened all my stuff is on video it's all being recorded everything will be there no that's a boat number after his arrest the man was transported to the Spanish River Park where he provided two Brett samples of 0.16 and 014 and he was charged with boating under the influence and a few other citations like not having a boter ID card and some safety violations although when this case went to court something interesting happened a charge was added called willful and wanting Reckless operation which I'd imagine is because he had multiple passengers on board and he was over the limit but it seems the disposition changed to adjudication withheld sorry I'm a incompetent reader and a few other things were dismissed too when it comes to the boat Under the Influence charge it ended up no press I don't know if I'm saying that right so it looks like this guy lawyered up and gets a probation anyways I hope you enjoyed today's video make sure you
