Turn around. Put your hands behind your back right now. Turn around. Relax. You don't want to listen to me. Stop. Relax. Relax. Relax. Relax. I don't care. Relax. Relax. Relax. Stop tensing up. Relax. Relax. You're going to go to jail if you don't relax. Relax. Relax. >> On May 30, 2024, in Pensacola, Florida, a sheriff's deputy pulled over a driver clocked at 66 in a 35. She did not immediately stop. That one decision set off a legal chain reaction that is worth understanding in full. Florida Statutes section 316.1935 requires immediate pull over when emergency lights and sirens activate. There is no exception for driving to your driveway first. A delayed stop satisfies the elements of failure to stop as written, regardless of how short the delay. >> Stop the vehicle. Stop the vehicle. STOP THE VEHICLE. STOP THE VEHICLE. You're You're going to go to jail. Stop the vehicle. I do not care. Stop the vehicle. Shut the car off. Shut the car off and step out. >> 174, let me get another unit, normal police. >> Get out of the vehicle. Get Yes, ma'am. Stop the vehicle. Listen. Ma'am, listen to me, please. Understand. Do you want to go to jail? Please stop the vehicle. Put the vehicle in park. Get out of the vehicle. Ma'am. That's fine. Get out of the vehicle, please. Ma'am, right now. Right now. Get out of the vehicle. Ma'am, get out of the vehicle. Ma'am, get out of the vehicle. Officer, you will not do that. get out of the vehicle or you're going to go to jail. >> I am telling >> Then get out of the vehicle, please. This is your last warning. Please get out of the vehicle or you're going to go to jail. Thank you. >> go anyways, right? >> Put the dog down. Put the dog >> I have to get out first. >> Put the dog down. >> I PUT HER DOWN IF I CAN'T GET HER OUT OF THE CAR? >> GET OUT OF THE vehicle then. >> Exactly. The [ __ ] are you talking about? You don't even know what the [ __ ] you're talking about. Shut up. >> All right. >> You want to be mad for something. >> Step over here for me. >> No, I'm going to stand right here. >> Step over here. Step over here. >> Why do I have to go that way? >> Because I asked you to. And I'm telling you to. >> you why because I >> want you to step over here. Step away from your vehicle. You're going to 66 in a 35. That's That's a reason. >> no such thing as a 35 after you pass that. After you pass that sign, I know my rights. >> Okay, ma'am. Step over here. That's fine. Step over here. >> Yeah, I know, so I'm not. >> Step over here. Step over away from your vehicle, please. Step away, ma'am. Ma'am. Turn around. Put your hands behind your back right now. Turn around. Relax. You don't want to listen to me. Stop. Relax. Relax. Relax. Relax. I don't care. Relax. Relax. Relax. Stop tensing up. Relax. Relax. You're going to go to jail if you don't relax. Relax. Relax. Relax. It's not how that works. You do not pick when you get to stop. That's fine. I have a camera on right now. Stop. Stop. Show me the thing. I I I >> Listen to me. Listen to me. Listen to me. >> me right now. >> to me very carefully. I do not care what you think. >> Okay, and that's fine, but your car is very hot, sir. >> That's fine. >> I cannot stand right here. >> You're going to come in the back. >> Okay, but you don't have to handle me like this. >> You were You were >> You were really mishandling me. >> know what resisting is? >> No, sir. I don't know. >> Okay. Okay. You are not complying at all. You have not complied from the very beginning. >> Once the vehicle stopped, the exit order was automatic. Pennsylvania versus Mims. US Supreme Court, 1977, gives officers authority to order any driver out during a lawful stop with no additional justification. Refusing is a violation of law, not a personal choice. Florida statute section 843.02 defines resisting without violence as knowingly resisting an officer in the lawful execution of a duty. Refusing the exit order, stiffening during handcuffing, and blocking the patrol car door with a leg each satisfy elements of that statute. On use of force, Graham versus Connor. US Supreme Court, 1989, holds that reasonableness is judged from the perspective of a reasonable officer on scene, not in hindsight. Soft empty hand control during active resistance is within the accepted continuum. No excessive force claim holds here. >> Okay. >> And what Do you know failure to stop >> what a felony >> Do you know what failure to stop is? It's a felony. >> Okay. >> Are you trying to catch a felony? >> Okay, are you going to listen, or are you going to lie to me? >> going to listen, because this is not a conversation. I am telling you something. >> Why don't you ask me a question if you don't want to hear the answer? >> How much marijuana is in the vehicle? >> No, there is not. Going to do that. I have a card. >> Okay. >> Yeah. >> Okay. >> So, let me go. So, let me go. >> You're going to get in the Get in. >> Okay. So, you know you going to You know you going to go to the precinct that's going down, right? Cuz you arrested me for being a fool. >> I'm not arresting you. >> You are. Cuz like what do you have me right here for? YOU'RE NOT GOING TO GET IN MY CAR. YOU DO NOT HAVE THE RIGHT TO GO IN MY CAR. I AM TELLING YOU THAT RIGHT NOW. >> RELAX. STOP TENSING. You're going to turn >> I'm going to jail for what though? What am I going to jail for? Why am I being arrested? You have to tell me before you put me in a car. >> I'll tell you the 14 in a >> I being arrested? >> I'll give you the 14 in a second. >> I would like to know why I'm being arrested. So you're going to arrest me for no reason. >> Stop. >> No, I want to know why I'm being arrested first of all. You don't understand it. >> Jesus Christ. >> What's she doing? >> Not stopping. One. Then she wants to back in, say this is her house. Telling her to get out of the car. I'm not getting out of the car. My dogs, yada yada. She was 66. Car reeks of weed. >> Oh yeah, I can smell it. >> You good? All right. >> 10-14 is the one I need. >> Can I get my dog? Please. Please don't take my dog. >> We're not taking your >> Can I at least put my dogs in the house? >> Yes. We're I I'll work with you. You haven't listened at all. >> This is really bothering me. I don't EVEN KNOW WHY I'M HERE. I DON'T EVEN KNOW WHY I'M IN THE BACK. YOU CAN'T TALK TO ME BACK HERE. CUZ I SAID I HAVE ANXIETY. HELP ME. >> YOU KNOW WHAT DOESN'T HELP? You not complying with my orders. >> I'M CLAUSTROPHOBIC. I CAN'T >> OKAY. RELAX. 10-15? I'm going to go knock, see if anyone here can get the dogs, if you're good with it. Okay. >> Right now I can't even talk to you, so how "How I let you out?" Okay. >> I'm sorry, I don't even understand why I why why you do not go in my house. >> If he tell >> I'm not going in my house. >> He's not going in your house. >> Nobody's in my house. Nobody's there. There is nobody there. My husband is at work and it's just me and my husband that live here. And I don't >> 10-4. >> why I mean why why now >> No one's harassing you. >> You are harassing me because you put me back here when I told you >> Hey, I have nothing to do with Hey, stop. I have nothing to do with any of this. Hold on, let me talk. >> No, no, no. >> Let me talk. Is there anyone here who can get your dogs cuz you are not going to be the one that secures your dogs? >> There's nobody >> Okay. >> here. >> Okay. Is there anybody that I can call to come get your dogs? >> It's just me and my husband. I don't even know what to do. My husband works at a military base. I don't even know WHY Y'ALL ARE BOTHERING ME RIGHT NOW. I'M SO CONFUSED. >> SO, OKAY. >> I'm scared. >> Okay, how you're acting. This is not This is not how a normal person acts. >> I have anxiety. >> That's why I'm telling you take some deep breaths. >> I'm trying, but it's hard back here. >> Okay. For right now >> It's really hard. >> Okay. >> I told you I'm sorry. >> He he had He asked you to step out of the car, you didn't want to step out of the car. Okay? >> What I said was I was trying to put my dogs up because I didn't want my dogs to be hurt. That's what I was telling him. Ask him. I said, "I'm trying TO PUT MY DOGS UP. THAT'S why I opened my garage. I was trying to put my dogs up and he was like and THEN HE ACTS LIKE I WAS going to run. I was like, "I'm not going to run." >> He doesn't know you from Adam. He doesn't know anything about you, okay? >> I get that. >> Nobody's trying to be malicious to you. >> make sure that my dogs didn't get hurt and run over. >> Nobody wants to hurt your dog. Nobody comes to work and wants to hurt their dog. >> So, that's why I was just trying to put them up because I I love my babies. >> I'm seeing what you're saying. >> And let's see, she can't see and she can't hear. She's scared. >> Okay. So Which dog which dog is the one you're talking about? >> one that's the one and you can't see her right here. >> Okay. >> So she gets scared. >> Do you have a medical marijuana card? >> Yes, I do, sir. >> And that's what I told him that too and he said sure and laughed about it and I don't even understand. He said, "Okay." and laughed and I >> Listen to me. Listen to me. >> I don't even understand. >> We're going to we're going to try and get a little bit calmer each time, okay? We're going to get calmer. We're going to take some deep breaths. This is right now The calmer you are the better it's going to be. >> I cannot do this right now. It's too many lights. Please turn your lights off. Can y'all turn your lights off, please? They They They They don't They don't They They really don't help me. >> Okay. >> The lights don't help. Please. Please turn your lights off. >> Tanya. Hey, Tanya. Tanya. Can you look at me, please? Lose your phone. Look at me. Okay. Here's your phone. >> Oh my god, the lights the lights don't help. >> Would you like us to call your husband? >> No. I just want to go. >> Okay. So here's what's going to happen, okay? >> What What What am I Oh, my husband What am I >> Because we need somebody to come get your dogs. >> Why? >> Because Yes. Okay. You're going to be placed under arrest. >> What? >> So, obstruction right now. I can charge you with the felony fail to stop. Listen to me. Hey, listen to me. I don't care about the charges. What I want to What I want to know >> Y'all really doing this? So I can't get that [ __ ] on my name. Y'all really with me. >> Okay. So either Okay. I'm going to try to work with you about these Okay. I'm going to work with you about these dogs. No. No, you cannot. >> Can I get out? Can you just open the door? I don't need to I just need to breathe. >> You can Okay. So >> if you can't listen to me, I'm just going to call animal control. >> Then do whatever you need to do. >> Okay, I'll call animal control. >> I I'll let you I can't breathe and that's all I need to do with you. Do you want to take the mask off? No, I can't. Sir, I can't. >> Okay, ma'am, this Okay, I have the windows down for you. >> No, you I'm just I'm Are you Are you going to calm down? I'm sitting right now. It is so hot because I'm sweating because of my anxiety. >> All right, listen to me, Tonya. >> Okay, can you please listen to >> you to take a deep breath and relax. I have tried to talk to you from the very beginning and you are not You have not though. >> I did. >> Do you know that the worst you would have got was a ticket? >> For what? >> For speeding. >> I wasn't speeding, sir. >> You were going 66 in a 35. >> you look at my camera, you can record You can rewind it, sir. >> That's fine. >> When I saw you, I was past the the construction site. >> I had already clocked you. I had already clocked you. >> No, sir, I was riding with traffic. >> I don't care if you were riding with traffic. You were going 66. That's fine. That is fine. I I do not That's fine. >> That is really recorded in my car, sir. >> That I I do I do not care. That's fine. I I'm We are going to go to court. >> Sir, I have a serious question. Do you really want to do this? Do you really want to do this? >> want to do this? >> I Listen, I know >> what you want to do? >> Tonya, relax. >> I'm telling you because if you look at this camera right now, you'll change your mind. And don't worry, y'all can try to delete it. It's already on my phone. >> one's I'm not touching your camera. I'm just telling you I'm not touching your camera. I do not care about your camera. I know what I observed. I observed your vehicle traveling at a high rate of speed. >> Yes, sir. Yes, sir. >> I turned on my radar. All right, and I had you at 66 within the 35 zone. >> Yes, sir. And I And I And I I >> I had to catch up to you with my lights and sirens. And this I caught up to you at Woodbine, okay? Listen, at Woodbine when that construction zone started, all right? >> I didn't stop at all. >> On Woodbine, right here where the construction zone, right around There There is, right past right past this. >> you got up to me on Woodbine, right? >> And you did not stop. >> my question, right? >> You When you caught up to me on Woodbine, was I in traffic? >> You you >> Did you have to break through traffic to get to me? >> I did. >> Okay, so that means I was driving with the traffic. >> That doesn't mean just because traffic could be going could be going over the speed limit. >> So only I get pulled over with the traffic. >> I already had your vehicle. You're being way more confrontational than this needs to be. The problem The problems that you're having can be addressed in court, That's the No, here's what I need you to understand, ma'am. Okay? The problems that you have with him right now, they're addressed in the courtroom, not on the side of the road, okay? So just understand that. Okay, you We have air, you have a mask on. She won't take the mask off. You were driving with the windows down in a convertible without the mask. Okay, that that has nothing to do with allergies then. Put on the allergies, man. Okay. We You cannot, no. Listen, ma'am. We're going to You're not I'd rather get the husband on the phone so we can get the animals because there's four of them. I already have them en route. Yeah. Just let me know, but yeah. She said just do what you have to do. If you don't want to work with us, I've given her I've given her two or three attempts and she just won't talk to me about Cuz yeah, I would love to. One's already growled at And then her vehicle is just I keep We can't how you We're about to. And then you started acting up. That's the guy on the street. You can't can't how your anxiety works. >> Okay. >> That's not how anxiety goes, right? >> but I understand it, but that's not an excuse to do that. >> I didn't do anything to him. >> Okay. >> I haven't done it. What have I done to him? >> But listen to me. >> What did I do? >> you failed to stop initially because I Listen to me. I get it. You wanted to You wanted to get home. I understand it. I'm fine with that. >> I I did a safe stop. >> Okay. >> And that's all I did. And I didn't do anything else. >> What bothers me is that you're like you're you'll go down and then you'll amp things up. So I'm sorry. My medicine only works so much. Okay, let's just keep it down. Let's all talk. >> I didn't do anything wrong. I really just came to a safe space. >> Okay. >> And I did wave him in to say, "Oh, you're pulling me over cuz I pulled over first." >> Yeah. >> And I noticed he was pulling behind me. So I was like, "Oh, you're pulling me over? Okay, well, come on." And I waved out the top. >> I'm just letting you know that the argument that you're having with him in speed The speed the speed and stuff that's all for court, okay? >> I'm not worried about the speed. It's the the the fact that he said I was not stopping for him, but I waved him here. >> This is his perspective, okay? You have a different perspective than him. >> And we always do. Everybody Four sides to every story. >> Oh, yeah. Okay. So just understand that. So let's talk like we're all grown up. Let's be respectful. He's going to be as cool with you as you let him. That's how it works. >> But I'm still going to jail, so it doesn't even matter. I don't want to kiss ass. >> There's a differ- There's a difference in going to jail for resisting an officer without violence and failing to fail to obey a LEO's order to stop cuz that's a felony and that's a misdemeanor. Okay. >> Either way you guys win. >> Nobody wins. >> I want that charge off of my name now. >> We We don't get a commission from an arrest. You're in handcuffs because of your actions. Okay. Thank you. Your actions. What's your option? >> Can we call your husband so he can come take possession of your car and your dogs? If not, I'm going to have to tow your vehicle and your dogs are going to be S-M- Go ahead. >> I have a issue right now and I really need to know who's what. Okay, I'm going to ask you. >> Go ahead. >> Can I please take off and let my butt dry because it is sweaty? It is disgusting and it is very embarrassing. >> Here here and I understand that and here's the thing. >> Yes, I want to call my husband. I want to call my husband right now. >> Well, you're not going to We are going to We're going to Is your husband Raymond? >> Yes. >> All right. Do you understand? I asked you to step away from your vehicle. And you don't want to listen. I don't know who you are. >> Because I got very aggressive because I was scared. And that's no excuse. >> And and listen, I don't know why I've never met you before. >> It's not an excuse to be and to do it but I was I was scared. I was upset. And I I did I did act out of that. Whatever. But please just let me let my butt dry. I don't care about nothing else. I need my butt to dry. >> All right. You are not going to run. You're not going to do anything. Okay? Okay. Well, that I don't It's like you can't see anything. It's It's just the All right. I'm not looking at that. All right. Just stand right there. Relax. Okay? Just relax. Okay? What is your husband's number? >> He's going to be so mad at me. I really need to blow my nose. There is so much snot in here. Oh my god. >> about that. >> There is so much snot under here. >> Hi, is this Raymond? >> This is a receipt. >> Hi, so this is Deputy Zoldak at the center of the Sheriff's Office. Is your wife Tonya? Okay. All right. Right now she's under arrest for resisting without violence, okay? Right now I have your vehicle or the the Mercedes is halfway in the driveway running with your dogs in the car. Are you able to come take possession of the car and the dogs so I do not have to tow the vehicle and have animal control and come take your dogs cuz I do not want to do that. What was that? 45 minutes? Tracking. Good to go. Okay. All right. Good to go. He said about 45 minutes. >> For him to be here? >> Yeah, he's all the way in NES Pensacola. >> That's up to you. Uh that's I need to know if I need to cancel animal control. >> I'll I'll work with you. I'll work with I I'll >> So cancel it? >> Yeah. >> What is it? >> Hold on. You Where's your Which neighbor? On Funwood? Okay, is that the one directly across from your your driveway? Okay, let me I'll ask her What's What's the name? Jacob? >> You know that them dogs don't like My dogs don't like anybody. Can I just put them in the house? >> Where's Jacob or Jeremy? >> The house or this house? I can just put them in the house. That would be easier. >> You're not coming You're not coming out of handcuffs. >> No, you can walk with me, but they don't like these people. They bite everybody. >> at us. >> Right, that's what I'm saying. They bite everybody. These are These are my anxiety These are my my my my protection dogs. >> So, here's where we're coming from is everything you've done this far earns nothing for our trust. So, you're not going to come out of handcuffs. We're going to work with you. Okay, hold on. We're going to work with you the best of our ability, but we're going to wait for your husband. Does that make sense? >> Yeah, we can wait for my husband because they they are not going >> We are going to wait. You're most likely going to be here >> That's fine, but they they >> Where does Jeremy or Jacob >> They are not going to go with them. >> Your husband is telling me >> I know what he's saying, but he knows that they're not and that's what They live right here. I'm What I'm trying to show you right here. >> Okay, is that Jacob or Jeremy? >> I have no idea. And there's one right here. I'm sorry. I'm sorry. I'm sorry. My bad. >> Just have a seat. Have a seat back in the car. >> Oh, my bad. >> Okay, I'm going to go across the street and ask one of them. >> I just I haven't been in my house for a whole week and a half cuz I couldn't even walk. And the one day I leave my house, all of this happened. >> Well, this is the consequences of our own actions. I mean, there's >> I I'm not I'm not blaming you for anything. I am really just trying to replay my life. Please ignore me. I just need to elevate my butt. I swear. >> Tonya, do you have any guns in the car? >> No. >> Huh? You You know you're prohibited from having a firearm? >> No. >> Okay. >> Why? >> Do you have a medical marijuana card? >> No, I didn't know that. >> All right. >> I didn't know that was a thing. >> Who said that? >> I apologize. I didn't know that was a thing. Who said that? >> You advised that she was prohibited or denied a CCW. >> I don't have The only thing is it said oh god >> Okay. So you were denied a CCW, right? That means that you cannot have a concealed firearm, all right, in your possession. You're you're a prohibited >> in Florida even though it's a >> You have >> a carry state? >> Yes, ma'am. Because you you The only time that constitutional carry applies is if you were legally able to have a concealed weapons permit, which you are not able to have. Well, I I I I don't know how >> I know I know you don't have to tell me that. It's not your job to make me understand that. >> the law. That's what the law is, okay? >> All right. Tanya, listen. >> Yes, sir. >> All right, I want I want you to understand something, okay? >> I have the receipt, sir, please. If you don't mind. >> I understand that you have a medical marijuana card, okay? In the state of Florida, all right, you cannot smoke in your vehicle. You have a medical >> smoking, sir. >> So there that smell that is emitting very strongly from your vehicle with the windows down in a convertible, all right, is a very strong smell. >> okay. >> All right, it's burnt marijuana. >> Okay. >> Okay? >> It is the smell >> I am not crazy. I've been doing this all a long time. >> it was not. It smelled of burnt marijuana, sir. >> Okay, and you you are not legally allowed to smoke marijuana in your vehicle even if you have a concealed or a a >> I I was not. I was not. I was not. I was not, but okay. >> Okay, that's one of your stipulations, okay? >> Yes, sir. Yes, sir. I'm sorry. I'm not trying to do that to you. I'm sorry. I keep getting sick to my stomach because I keep swallowing snot. I'm sorry. It's so gross. >> You You can take the mask off. >> Even if I took the mask off, the snot wouldn't go away, sir. Where's the snot going to go if I take the mask >> You can use the mask. Yeah, blow your nose. That's >> Can I get another mask out the car then? >> We can't They're going to take your good That mask is coming off, okay? >> No, I'm not. >> When you get to the jail, that mask is coming off. It is. I'm >> They don't because I've been arrested before, and I've had my mask because I can't. >> All right. >> So, just please don't take my mask. >> You're 45 minutes out. >> Okay, is that a 45 minutes? >> that was you. Oh god, you guys are so funny. >> Okay. All right. Listen. >> Yes, sir. >> You're going to get the ticket for your speed. >> Yes, sir. >> Okay, you're going to get arrested for obstruction, resisting without violence, okay? >> Can I get out on my own recognizance without going to the jail? >> No, you're going to You got to go to the jail. >> Can I call my lawyer then? >> You can call your lawyer when you get to the >> Well, I don't know his number. It's in my car. >> It's in your phone. >> No. >> I >> It's in my car. His card is in my car. >> going to You're the only thing going to jail with you is your phone. Do you have a wallet or purse in the car? Okay, is there any marijuana in that in that purse? >> Um I can't think of anything. I know there's a lighter in there. >> Okay, I don't care about the lighter. All right. >> Okay. >> All right, have a seat back in the car, please. >> Ooh, he's so mad that I lied. Now, can I get up? My butt is so flammable. >> Okay, have a seat. >> Can I get the um outside my butt? Can you speak English? Can I dry my butt? >> No, have a seat. >> I'm so embarrassed. Cuz the car lets off so much heat. And I don't know if y'all know how much heat this thing lets off. >> Have a seat. >> I'm dry. Can I Can I Can I just >> No, you can sit on the seat. >> Okay. Well, yeah, can you help me up, please? I'm sorry. It hurts. >> Okay, have a seat. >> I should have listened the first time, I guess. >> Thank you. All right, you can get your feet up. >> Oh, why are they so close to where you're Wait. Wait, wait, wait, wait, wait. >> The firearm question has two answers. Florida Senate Bill 150 effective July 1st, 2023 allows permitless carry only for those who would qualify for a CCW permit. A denial removes that protection. The officer who explained this applied the statute correctly. 18 U.S.C. Section 922, subsection G, prohibits firearms possession by unlawful users of a controlled substance. Marijuana is still schedule one under federal law. The ATF has confirmed this covers medical marijuana card holders. A state card does not cancel a federal disability. The biggest liability here is not the arrest. The subject named a medical condition and asked for her inhaler. That request was never addressed. The 14th Amendment requires officers to respond to serious medical needs in custody. That documented failure supports a civil claim under 42 U.S.C. Section 1983. The phrase "I do not care." said directly to a medical disclosure, is a timestamped exhibit. In civil litigation, that language establishes deliberate indifference, the constitutional threshold for custodial medical liability under the 14th Amendment. That is not a tone problem. It is a legal record. The initiating officer receives a C+. The stop and arrest charge are legally supportable, but the unaddressed inhaler, the delayed arrest disclosure, and dismissive phrasing during medical disclosures are professional deficiencies that create documented civil liability for the officer and the department. The second officer receives a B+. He arrived mid-encounter, de-escalated effectively, explained the charges accurately, and resolved the vehicle and dog situation by calling the husband player and canceling animal control. The only gap is the unretrieved inhaler, which belongs to the record of the entire scene. The subject receives a C+. Failing to immediately yield was the triggering problem, and every charge that followed flowed directly from that and the resistance that came after. The speed dispute may have merit, but the roadside, while in handcuffs, is not the venue to win it. This encounter reflects five practical principles that apply to any driver in any traffic stop in any state. They come directly from the statutes and case law cited here. Let's go through them. Lesson one. Stop immediately. Florida statutes section 316.1935 has no proximity exception. Every second of continued driving after emergency lights activate adds an element to a criminal statute. Pull over to the nearest safe location the moment those lights come on. Lesson two. Comply first, contest later. Pennsylvania versus Mimms makes exit orders legally non-negotiable on the scene. If the stop was unlawful, document everything and challenge it in court. Physical resistance converts a traffic citation into a criminal record that does not disappear. Lesson three. Make medical disclosures specific. Name the name the medication. Say where it is. Officers are constitutionally required under the 14th Amendment to respond to serious medical needs during custody.
