Get out of the car. >> Pocket. Pock it. Pock it. On the ground. Get on the ground. Don't fight us. Don't fight us. >> Obviously, I saw you naked. >> Only Cams provides body cam footage for transparency and educational purposes only. On January 29th, 2025, Santa Fe, New Mexico. A quiet winter night near Cerillos Road. >> Sir, put your hands up. Guests at a Double Tree hotel were settling in, unaware that chaos was about to unfold just outside their doors. >> At around 900 p.m., a bizarre and alarming scene began to take shape involving a naked man, a handgun, and a confrontation that would end with beanag rounds, a police K9, and a crash into a wall. Officer Fernando Cruz was refueling his patrol car at a nearby Shell gas station when a man approached him, identified as 54year-old Carson McCoy. McCoy said a man had just pointed a gun at him and others in the parking lot behind the Double Tree Hotel. >> Yeah. So, I was airport putting gas. This guy comes and knocks on my window. I roll my window down and he's like, "Hey, there's there's a guy over there with a gun. He's he's naked and he's in a in an older car and he's like he's wearing like a little crop top but he has absolutely nothing else. He pointed a gun at me and I was like, "Okay, cool. Are you guys okay?" Like and he's like, "Yeah." He's like, "I don't want to make a police report or anything, but uh just I'm just letting you know." And I was like, "Cool. Stay in the area, please." I took off immediately, came over here. Um when I got here, I was looking at the vehicle to see if I could see any movement. And next thing you know, this guy naked, fully naked, um, begins to hop the wall behind the Dollar Tree. And he I see him put a gun on the wall. He hopped the wall pretty much all the way. And once he saw me and I think he realized that it was my unit cuz I didn't have my lights on yet, uh, cuz I was trying to wait for backup before I actually approached. And at that point, he realized it was me. He hid behind the wall and next thing you know he uh he was able to run across the wall and there's like a big bus that's kind of like blocking the wall area and I don't know just because he was out of sight. He was able to make it to his passenger seat, started digging around at that point. I I got out of my vehicle. Uh I tried to give commands because I pulled out my firearm. He hopped in his car and took off. >> And he looks like he slid on some ice back here in the in the parking lot. And >> how far did he go? just like >> it's it's like it's like a 100 yards. >> Okay. >> And he Yeah, he he crashed into looks like a brick wall here on the property. >> And then after that, did he he was still trying to flee, right? >> Yeah. So he he got back in the car. You can hear him gassing it and trying to get the the car to to move. >> Um but it it's completely high centered and inoperable right now. >> Okay. Yeah. Yeah. >> Um and then he was digging through the car. He he actually started putting his clothes back on. He was fully clothed, you know, putting his hands in his pockets. >> And you guys just found the gun in front of the in front of the car. >> Yeah, it looks like Norris and Old might have found the gun in front of the in front of the car. >> Cruz immediately drove toward the hotel. >> Let me see hands, bro. >> As he arrived, he spotted the man. >> Santa Fe police, put your hands up. >> You're going to get on the ground. >> Get out of the car. >> Show your hands now. You'll be hit by a canine. You're going to get bit. >> You're going to get bit. Get on the ground. >> Later identified as 59year-old David Gart attempting to climb a wall near the Dollar Tree next door. In his hand, the same gun McCoy had described. But before the officer could issue commands, Ghart vanished behind the wall. Moments later, he reappeared. >> Inside your vehicle? >> No. >> How did you crash? How >> Ghart started the engine and tried to drive away. >> But after speeding just a short distance across the lot, his SUV slammed into a concrete wall. Immobilized, officers from multiple units swarmed the scene. With guns drawn, they surrounded the vehicle and shouted commands, "Step away from the car." Ghart refused. As the situation escalated, officers fired less lethal beanag rounds and 40 mm impact munitions. >> I don't have a good shot with the heads up. Follow my command. >> But Ghart didn't flinch. >> I'm here with you. >> He stood there, still defiant, still refusing to comply. >> Surfy police, put your hands up. After repeated warnings, Sergeant Nick Chavez authorized a K9 deployment. >> Officer Julian Norris released his police dog, Zeus. He lunged and bit Ghart's arm, taking him to the ground. >> Grab his right arm. Grab his right arm. >> Right arm. Go. Right arm. [ __ ] [ __ ] >> Even then, Gart continued to resist. >> Officers moved in. One deploying a taser, another securing his legs. I'm done. I'm done. Don't fight us. Don't fight us. >> Dog back. Watch out. Straight back. >> Straight back. Pull him back. >> All right. >> Give us your arm. >> Your arm. >> Give your arm. >> All right. Grab him. >> Don't move. >> I'm fighting. >> Got it. Yep. Got it. Cool. >> Got contained. >> All right. Send in the meds. >> Finally, after a tense struggle, Ghart was handcuffed and taken into custody. >> Paramedics with the Santa Fe Fire Department treated him on scene before he was transported to Saint Vincent Hospital for medical clearance. >> Real quick, medical stuff. All right. Real quick, could I get your name? >> David. >> David. What? >> All right. Good. I'm Gart. >> Can you spell that? >> GT. >> Oh, no. He wanted me to take his mask off. >> Do you know where you are right now? >> To let you know, I do have an ambulance coming. They are going to check you out. Okay. >> Thank you, sir. >> How did that happen? Well, and so I went to five to run the bike that we had for evidence >> at the crash site. Investigators found the weapon, a black pistol marked M1911A 167, but on closer inspection, it wasn't real. >> It was a rubber prop gun, the kind used for training or display. >> Yeah, this [ __ ] plastic. Pull the trigger just to make sure. >> Oh, I can't, Dude. It's plastic. >> It's entirely. >> It's It's It's all plastic. >> Look. >> Wow. >> Oh, there you go. >> Okay. >> Thank you. >> Crime scene technicians recovered multiple pieces of evidence. Spent bean bag rounds, taser cartridges, and casings from the 40 mm launchers. Ghart told officers he pointed the gun to help someone, >> insisting it was fake and that he'd bought it at a local thrift store called Savers. >> But officers noted his erratic behavior and the fact that he appeared to be under the influence. >> I think he's fine. He's just >> Lieutenant Roberto Rodriguez confirmed that the rubber gun was the same one seen in Ghart's hands earlier in the night. >> No real firearm was ever fired. And remarkably, >> no one was injured. >> I'm here with you. >> Ghart was booked into the Santa Fe County Adult Detention Center on charges of aggravated assault with a deadly weapon and resisting, evading, or obstructing an officer. >> Police later confirmed that the supposed victim, Carson McCoy, never returned to provide a statement. >> Stay in the area, please. >> And that the bizarre encounter lasted less than 10 minutes from start to finish. Well, you were trying to get back in your car and I heard you pressing on the gas and revving your engine like you were. >> As officers secured Ghart, one of them read him his rights. >> Okay, I'm just going to advise you your rights real quick before I >> The officer asked him why he did the things he remain silent >> and Gart quietly replied that he only wanted to help. >> Evidence against you in a court of law. You understand that you have a right to an attorney before and during questioning and at all times. You understand that if you cannot afford an attorney, one will be provided to you without cost to you or your family. You understand that if you decide to answer any questions or make any statements, you still have the right to stop answering at any time. Do you understand each of these rights that I've explained to you? >> Yes or no, sir. I just need to hear a verbal yes or no. >> Yes. Okay. >> Having these rights in mind, do you agree to speak to me if I if I ask you questions? >> Yes or no? >> Okay, >> sir. So, I was at Obviously, I saw you naked >> with a gun. I saw you. I had a homeless individual advise that you >> pulled up on them and you pointed a gun at them. >> That what they helped them. >> Okay. Is Did you get that gun? >> Is there any other weapons inside your vehicle? >> No. How did you crash? >> How? >> Why were you not listening when we were giving you commands to put your hands in the air? Well, you were trying to get back in your car and I heard you pressing on the gas and revving your engine like you were still trying to run away from us. Well, at the end of the day, >> I'm I'm glad you're okay, man. Okay. >> Cool. Cool. >> I will be back. Moments later, he was transported to Saint Vincent Hospital for treatment of his wounds before being taken into custody. >> Few steps. Let's go. >> All right, we're going have a seat right here.
