Florida Fish and Wildlife as well as the U.S. Coast Guard were conducting traffic with their emergency lights on for the Blue Angels Air Show when a pontoon boat with multiple passengers was observed traveling on a plane within 300 feet of an emergency vessel. Seeing that this is a safety violation, the officers initiated a vessel stop. Hey Cap, it's getting real shallow. You need to go to deeper water. We're going to pull up alongside you once you get deeper. We're going to pull alongside you when you get to deeper water. Go to starboard. Starboard! Turn right! Right! Starboard! Captain! Starboard! Starboard! Turn right! Do you have to go to the beach? That's fine too, yeah. Yes. Hey, no hands, no hands. Keep your hands inside the boat, okay? All right, I'm just trying to help you. I got you. All right, I'm Officer Land, okay? First thing, I want everybody else to be quiet except for the captain. I'm just going to talk to one person at a time, makes things easier for me. Got it? Yes, sir. All right, everybody be quiet, okay? I got you, all right? Captain, do you have your vessel registration? Yep, underneath the seat. Okay, and the only person I want moving is the captain, okay? I got you. I'm just saying, I don't want other people picking stuff up or going into hatches while I'm on here. How long have you had this boat? About two weeks, maybe three weeks. All right, could you take your glasses off, please? Captain, can you nose your vessel up to the shore right here? Right here, captain. Listen, do what I say, okay? You got your glasses right here. Hey, I asked everybody else to be quiet whenever I got on board. Do you remember that? I'm just going to talk to the captain. Do you have seven life jackets, captain? All right, I need to see seven of them. The only person I want moving around is the captain. If you need to ask somebody to stand up, that's fine. I need seven wearable life jackets, a type 4 PFD, a whistle or a horn, and a fire extinguisher. Sir, I ask you to sit down, please. No, I don't want you to do anything except for the captain, all right? Just let him move around. If he asks you to stand up, that's fine. Okay. Yes, sir. The other equipment that I asked you for, remember a type 4 sound producing device and a fire extinguisher, okay? A type 4 square throw cushion or round throw ring, all right, and can I see your fire extinguisher? Make sure the gauge is good. Ma'am, could I ask you to sit over here, please? Captain, I want you to come sit up. Sit right here, please. All right, can you take your eyes off him or your sunglasses? Okay, I asked why you guys pulled me over against all these other guys. Because, hey, I asked everybody else to be quiet, sir, because while everybody else is going slow speed, you're on plane. We've got blue lights on. You're not supposed to go more than slow speed. Within 300 feet, while these blue lights are activated, you have to proceed at a slow speed. I'm going to ask you if you're willing to do some task, okay? I need a verbal response. Yes or no? What kind of task are you asking for? I'm going to ask you to do them right now. It's a seated sobriety task. No, I won't do that. You will not? No, because you don't know me from Adam. You can ask me after I've been on a walk on a rocking boat to walk 10 steps in a straight line. I've been on a rocking boat. Hey, you need to go sit down. You need to go. Excuse me, sir, go sit at the back of the boat or I will put you in handcuffs. Do you understand me? Do you understand me? Go sit where you were seated before. Get out from the helm. Do you understand me, sir? All right, so these are seated tasks. All right, can you move your glasses? Remove your glasses again for me. Ladies, could I ask you to go sit at the back of the boat for me? All right, sir. Excuse me, sir. Hey, I asked everybody to be quiet, okay? Can I grab my hat? I'll grab it for you. Stay right there. Hey, hey, I asked you to be quiet multiple times. Sir, I told you to be quiet. Yeah, I'm doing what I'm doing. Look at me. Look at me. Okay, do not move your feet until the test. Sir, I've asked you multiple times. Make a fist with both hands, extend your index fingers, and turn your palms forward like this. Remain in this position while I explain the task. Do you understand? When I say begin, tilt your head back to about a 45 degree angle and close your eyes. I tell you to touch the tip of your nose with the tip of your index finger and immediately return it to your side. When I tell you to when I say right, you must touch your right index finger to your nose. When I say left, you must touch your left index finger to your nose. Do you understand? Yes. Begin. I'll do it with my right hand. That's what she stated first. Tilt your head back and close your eyes. Left. Right. Left. Left. Left. Open your eyes and straighten your head. Place your hands palm to palm with one hand up and one hand down like this. Remain in this position while I explain the task. Do you understand? When I tell you to begin, turn the top hand over and count out loud one, then turn the hand back over and count out loud two, counting only when the hands make contact like this. One, two. Make sure to keep your hands and fingers parallel during each pat like this. One, two. Speed up. Keep going and speed up. That's where you're going to find the fault because your identification of a fast speed and my identification might be a different thing, but I'll do it. Here's one, two. One, two. One, two. One, two. Make fists with both hands. Place your left fist at the center of your chest and your right fist against your left like this. I'm going to show you. I've showed you every task. I'm going to start over. Make fist with both hands. Place your left fist at the center of your... Hey, no. Back over there, man. Like, I'm... Work with me here. Back over here. You're asked to get in the water, so over there behind... Hey, I'm spinning back here, so if you'll go... My props are spinning. Make fist with both hands. Place your left fist at the center of your chest and your right fist against your left fist like this. It's going to be left fist against the center of your chest. Got it? Left fist at the center of your chest and your right fist against your left fist. Got it? When I say begin, you must perform four tasks. The first task is to count out loud from one to four while you move your fist in a step-like fashion, making contact between your fists at each step. One, two, three, four. The second task is to memorize the position of your fist after you've counted to four. Clap your hands three times and return your fist to the memorized position. One, two, three, four. The third task is to move your fist in a step-like fashion in reverse order, counting out loud from five to eight and returning your left fist to your chest. I'm not going to do that. Five, six, seven, eight. I wouldn't do that even if I was stone cold sober. The fourth task is to open your hands with palms down and place them in your lap. Do you understand? I understand. I'm not going to do that. My memory does not let me take on that task. I can do what you tell me to do, but when you give me repetitive motions, I cannot. All right, so you're... Don't believe me, ask my wife. Okay, you're refusing to do this task? Yeah, I can't remember all four steps. Okay. I'll do them once each time and you tell me what to do the next time. I can do that. Yes, sir. That's not the way this task works. I'm going straight off the instructions. I don't get to make up rules. I'm going straight off instructions. I will not do it because I know I'll fail it because I know how I am. Okay. You're giving me four tasks to do and I can't keep up with that. But did I ace all the others? All right, just stand by, okay? Now I'm asking you now, didn't I? I did, but you're giving me something to do with my brain. You're trying to memorize four different objectives or whatever and I cannot do that. 10-15. Hey, no, ma'am. I asked everybody to sit down until I get done. You put the gatorade back. Put it back. How do you want to transfer? Okay, all right. I've got one more. You need to walk to my boat for me. We can walk over the bow right here. Step over on this boat and then I'll explain it to you. Okay. Sir, I'm asking you first and I'm going to tell you and then I'm going to make it. Get in this boat. Yes, sir. Yes, sir. You are. Yes, you are. Stand up. No, I've asked you three times. I'm telling you now. Stand up. Matt, hand me the paperwork. Matt, hand me the paperwork. Yes, sir. Yeah, we're going to make sure of that. Okay, but right now you're going to listen to me. Stand up. My nephew is broke down. That's why we came over. Stand up. Okay, stand up. Do not pull away from me. Do you understand? Get on this boat. Turn around. Hey, turn away. Step away from me. Just so it doesn't get ugly. Get on this boat right now. But you turn me loose and I'll walk over there. My God, you're asking for resistance. I'll walk over. You are resistant. Let him go, Matt. Let him go. Let him go. Step down. Hey, step down. Hey, listen. Don't make it worse, okay? I ain't. But work with me. I'm a normal person. Okay, turn around. Turn around and face that way. Put your hands on top of your head. Hands on top of your head. Keep looking away. Hey, on top of your head. Listen to me. I've got a family here. I've got another family over there. I understand. All right, so what are you arresting me for? Well, he's gonna tell you, but it's put your hands back to back. Top of your hands back to back. I understand. I mean, you guys, it's your choices. Because because the boat was operating beyond slow speed in that zone, we make that zone slow speed with blue lights and he was on plane and came through. So that's what started. That's what grabbed our attention. And then it was some of the basic instructions. So at this point, okay, there's probable cause that he's voting under the influence. So that's what the arrest is. The rest of it will work itself out in whatever in whatever way he is jail. Listen, no, you get out, get, get to the back of the boat. You're going to get crushed in between these two boats. Get out. Matt, would you help me out with this? Then do what I tell you to. Okay. Right now you're interfering. Okay. That is not a safe spot for you to be. You need to get back on your boat. In the end, the man was charged with voting under the influence and resisting arrest without violence.
