Welcome back to the Donnie Rapture channel, where I always bring you fresh, never-before-seen body cam footage from the police. Well, specifically, fish and wildlife officers. It's pretty much all I upload these days. Today's body cam video takes place May 26, 2023, and it kind of picks up right as the officer boards this 33-foot cabin motorboat. I'm not entirely sure how he justified boarding the vessel, since the vessel wasn't actively fishing or displaying fishing equipment, but who knows? Maybe they invited him on board before the recording started. We will never know. After boarding the vessel, the officer observed the trash bag overflowing with empty alcohol cans, as well as several bottles of liquor on the ground near the port gunnel. This is the port gunnel. I had to look it up. Captain, he was driving. Captain, please. Okay. This is your boat, right? Yeah. Cool. Perfect. So you have one, two, three, four, five. Okay. So you have four there. Yeah, we have four, but we have more over there. Okay. Now, let me see, um, you have a whistle or horn? Yeah, it's on the life jackets. Them? Why, you know them? Fuck them, man. Why? This is my mechanic. Oh, is it? Yeah. And I see your license and registration. We're going to tie off real quick, and we're going to go over there to the out-of-boat traffic. No, no, hang on. We're going to tie off. He's going to take us over there. So everything that you asked for, we have, correctly? You guys know Jay Malone? Who? Jay Malone? No. No, you're fine with the contacts. All right, so the reason I'm asking you, because I do get an order of alcohol. I want to make sure you're okay during the boat. Okay, before you were driving, I want to make sure you're fine. Okay, so you mind doing the task for us? We just want to make sure that he's still good to drive. If we smell alcohol, it could just very be from this bag. It's obviously not our bag. We just want to dismiss our concern and make sure he's still okay to drive. So do you want somebody else to drive then? No, I need you. You're driving the boat. I need you to sit down so I can do my task. Sir, I'm talking to him right now, okay? You want to go sit over there? No, I don't. Okay, well, I need you to be quiet. I'm not talking to you. I'm not going to ask you again. Are you going to go over there? Are you going to go over there or not? I need you to go to the front of boat. I'm not talking to you. Sir, I already told you. I already told you. I'm not asking you again to go to the front of the boat. I'm not talking to you, I'm talking to him. I do not have to go to the front of the boat. Legally you do because right now you're interfering in my investigation. Do you want to go to jail for that? So if I were you, I'd go to the front of the boat and sit down there calmly. Let's go to the front of the boat. Is that an entry fee? There you go. Let's call 9-8 right now. If you sit down, I'll call 9-3. If you don't sit down, I'm going to call 9-3. 9-3, 9-8, 1-8. 5-10. We're doing our job. We know 100% you're doing your job. So we just want to dismiss... You can be perfectly fine. We just want to make sure that you're safe to take your family home. So we're asking... Do you want... We're asking you to do some tasks to make sure you're okay. You don't want to do it? Okay, give me one second. We're on a boat right now. And the boat's moving. So it's not... It's seated. I'm going to have you sit down. And you're going to do a task sitting down. You're not moving around. You're not doing walking turns. Everything's sitting down. I'm going to make sure he's seated. Arthur? Hello? Who is Arthur? My brother. I don't even talk to your brother, sir. I'm talking to you right now. I don't even talk to your brother. Arthur. I just got pulled over on the... Yes. We checked everything out. We had the life vest. They said everything. But they say they have alcohol on my breath. Arthur. Investigation. Yeah, I know. I'm going to be... Okay, I'll talk to him. How are you doing, sir? I'm Officer Montero of the BC. Is this your brother? Hello? Yeah, I can hear you now. Hi, Arthur. I'm Officer Montero of the BC. Is this your brother you're speaking to? Yeah. I stopped him to do a safety inspection. I do smell alcohol on his breath. I want to make sure he's okay to drive. So I'm going to do some seated battery on him. And make sure he's good to drive. He's with a lot of people in his boat. I want to make sure everybody gets back home safely. So that's why I'm trying to get... I'm trying to get to the point of call where he called you. So, I mean, if you could... I can hang up with you so I can continue my investigation. Because he can't keep talking to you while I'm trying to do my investigation. Okay. There's no one else on the boat you can call? I have no idea. I'm not there right now. The point is that he was driving the boat so I have to make sure he's fine to drive. Okay, but he's not driving anymore after the safety inspection, right? After? No, because I'm stopped. He's with me. So he can't be driving on his boat. He's not driving anymore? Yeah. You stopped him for a safety inspection? Correct. I'm Sergeant with Miami-Dade Police. Hang on. I'll put my captain on if you want to talk to him. Okay. He's a Sergeant with Miami-Dade Police. Hold on. Yeah. Oh, yeah? I don't recognize you. So the officer mutes his camera for about four minutes. I don't know why he did this. It might have been a mistake. But during that time, the captain refused to perform SFSTs. And the officer arrested him for suspicion of B.U.I. Who are you? What the fuck? Shut up! Don't fucking talk to me. I don't care. Who the fuck is driving your boat right now? You guys don't know who Dave Marvin is. Who cares? Don't ask him a question. It doesn't feel like somebody fucking doing a European shit. You know who Dave Marvin is. Hello! Can everybody just shut the fuck up and sit down? Sit down. Okay, go! Who cares? Listen! You know who Dave Marvin is, right? That's my husband! That's my husband! And if you fuck it up, you get him to jail. Sit down. Sit the fuck down. I don't give a fuck. Sit the fuck down. He's my husband. Joseph! Joseph! 9-3-4-7, Manny. 9-3-4-7. 9-3-4-7. Show subject to 15, reference signal 1. Show subject to 15. 10-4. Is anybody here capable of driving this boat? Hey, I'm talking to Dave Marvin. Ben! Is that Dave Marvin? Please talk to him. Please talk to him. Here you go. Everybody here Everybody here knows what they're doing. I know you know what you're doing. I know what the fuck I'm doing. I know who Dave Marvin is. Shut the fuck up! You drank, but you good though? I'm fine. You sure? I know, but you good though? I'm fine. You can see I've been drinking, but you're good. Go through a whole thing. Hey, sit down. Let her check your eyes real quick. While the officers returned to the patrol truck, where they had an Intoxalizer 8000 ready for them. 9-3-4-7, 23-1. 10-4. Do you understand that you've been arrested for voting under the influence? Okay? At this time, I'm requesting for you to submit to the law for testing your breath to determine the alcohol content. Will you take the test? Alright. It's a choice, but a choice with consequences. Okay, so I'm going to read to you what those consequences are. Okay? If you refuse to submit to the test I've requested of you, it will result in a civil penalty of $500. Additionally, if you refuse to submit to the test I've requested of you, and you have been previously fined under Section 327.35215 of the Florida Statute, or if your driving privilege has been previously suspended, for refusing to submit to the lawful test of your breath, urine, or blood, you will be committing a misdemeanor. After refusing the breath test, the man was transported to the Miami Dade Jail, where he was charged with operating a vessel while normal faculties impaired, and refusal to submit a breath test. Actually, this appears to be his second time doing this. Anyways, I hope you guys enjoyed today's BodyCam video. I'm doing my best to crank out 3 -4 videos a week.
