[Music] on July 3rd 2023 three FWC officers were on vessel Patrol in P County Florida when they were contacted by a marine Deputy from P County Sheriff's Office stating that he had a vessel with a potentially intoxicated operator on Lake Illinois shortly after arriving officer Carter observed a nearly empty bottle of liquor and a strong smell of intoxicants coming from the operator's mouth you know your license suspended partner that's suspended you can't be in possession of your driver's license once it's suspended man never knew I had my it's suspended no way are you kidding me I I promise you I don't I don't to make this stuff up yeah you're you're suspended how long y'all been on the water today an hour or so hour live here I mean literally I live been here a longer hour pass you several times I went wouldn't have some um some okay evidently it doesn't matter all right and I guess you said uh you're short some life jackets or hey hey okay how many how many life jackets did did you have on board three I think instead of four okay yeah three right there one two three okay and is this your boat yes it's my mom's boat it's your mom's boat okay yes sir okay so it's registered to to your mama yes yes sir I'm just trying okay yeah that's fine you're good I I'll let you get that all right um so one uh just see if you'd uh do some task make sure you're safe to drive um I am okay would you mind doing would you mind doing the tasks some tasks for me tasks yes sir no no I mean I'm not going to do that you're not going to do that no sir okay I don't think I need to I mean be honest with you I mean okay well well here's the thing I I'm So based on my observations so far okay slurred speech having having issues fumbling around with your fingers things like that okay um I can smell the odor of an unknown Al alcoholic beverage from all well I'm I'm sitting right here talking to you and I can smell it off your breath right here okay um and then based off the observations that this officer made um when you were coming up here how long have you been driving this boat nothing like a day or two or I don't say okay all right that's that's fine all right um So based off that I believe that you're you're impaired past normal faculties from alcohol okay so with that being said if you refuse to do the tasks that I asked to dispel those fears so to to show to me that you you are not in fact uh impaired Pastor normal faculties if you refuse to do that then I have to base any decision I make on what I've observed and what this officer has told me okay can I do one thing let me get dog that's a whole different situation right here I I mean my dog's in there on y'all's boat oh yeah we're staying right here I understand that but I'm saying I mean I mean that's a whole different situation okay well so let me just finish no I haven't no no I'm not I haven't been drinking I have not done that I mean okay well again let me just finish what I'm saying I'll tell you what just call us call your superise if you don't mind I appreciate that okay well I'm not going to do that right now cuz I'm in the middle of this investigation okay so again so if if you refuse to dispel those uh those fears that I have those beliefs that you are in fact impaired then I have to base any decision I make on what I have observed personally so far up to this point and what this officer has relate to me okay beyond that if if you refuse to do it then that refus hold on that refusal could be admissible in any criminal proceedings if they were to happen okay yep okay so I was going to say with that in mind would you mind doing the task dispel my fears that you are intoxicated okay you're still refusing to do so I'm not I I'm not t Okay so that's well that's why I'm asking if you would do those tasks to dispel those fears cuz right now based based off my observ based off of my observations so what I understand that and we already went through that but I want getting through as far as my animals and my people right here get my dogs going okay well I live right lul I mean literally I live right here on L Lulu and not trying to be blad or anything I just you
