so I spoke with two witnesses one girl had said that she was with the 2-year-old found the 2-year-old walking all the way down I know I'm sorry you got to stay she walked all the way back down here and then saw the wagon and the two other younger girls sitting outside the ride right there she said that she doesn't know how long the girls were by themselves but there was another witness that was in the line of cor crew and these uh him and his oldest were right behind him and he said that he was in the que line for 20 minutes cuz they had the ride St okay and um so I'm thinking he had to have at least left him alone for more than 20 30 minutes and then had the 2-year-old and the 4-year-old and the 8-year-old sitting outside ride um by themselves while he was going to ride the ride who where's the witnesses they walked away okay I got their info you did I did yeah did it was I got the girls info and then the guys info that was in line and their families I didn't really worry about all their info but yeah but I did get their information hi officer barteski police do you know why I'm over here yes ma' so did you leave your kids unattended they were right here we were in line we got in line it had already been shut down there for May 6 7 Minutes the ride we were waiting we got right off but who was watching your kids you're 8-year-old are you are you here with some are you left the 8-year-old in charge um the these two and by herself as well and then the 2-year-old ran off that's what okay so when you came back was the 2-year-old here yes with the witnesses they were outside the ride waiting I saw when we came when we came back on the ride I could see them all sitting there and my my 8-year-old smiled CU at first I thought something wrong she smiled and everything where are you from I'm from uh just 45 minutes we live by F okay um how I mean how many times have you left them today to ride rid we did one at the beginning and then what would happen like if those two were riding I'd stay so this isn't the first time you've left the 8-year-old in charge did you ever leave these two by themselves no never absolutely no we I I always had eyes on them where wherever we were so how many rides did you get on with with leaving them yeah this one in Gate gate was at the beginning of the day which was around 130 my 9-year-old I got right on I could see them in the que line okay so the rest you couldn't see them in this que line I could not no you're right so and then how long were were you in line for I texted a friend when we just got in line of thech time stamp so was 7:53 okay what time did he get off the ride um I don't know what time he got off the ride he was already off the ride by the time I got over here but the woman that said that she picked up the girl all the way down by Magnum said that they when I got here um it was like 20 minutes since they called so what's your name do you have your ID on you I do let me see it so Dad here has been riding rides with the oldest thank you in the pink but the 8-year-old in charge of the twoy 2-year-old ran down to Magnum and somebody brought her back said he's only done it for two rides where's he from Kansas Ohio Kansas he's here by um he said he did it on the gatekeeper earlier today and he just did it on this one um but he said the 8-year-old was watching the younger ones how they have are the guy all right have fun what's a good phone number for you so we are going to charge you okay relax but since you're here alone with your four children we're not going to take you to jail no getting charged you can't leave children and I'm not even going to be try to be polite about it that's ridiculous you don't know who's here I mean what if what if someone would have taken one of receive a copy of the summon okay you're going to have court on Monday morning at 9:00 a.m. since Friday today okay so court is up there it's 10:24 right along that line right there pretty much that whole Spiel is what it says in the Ohio Revis code and then it's saying that you obviously left children to supervise other children and you created a substantial risk to the health and safety of the child that ran away okay obviously it's a mistake but it's kind of one of those mistakes you can't just like have a good night s hey how you doing what is the uh what is the degree of it's a misdemeanor of the first degree okay what is that essentially boil down to your uh you you'll have to talk to the judge for that that's that's not like my area of expertise I can't tell you you know it's 6 months in jail on a $500 fine I I I don't know that kind of stuff and misdemeanor in the first is the highest misdemeanor if that's what you're asking I mean I would say this as long as you show up the court and you don't not show up the court absolutely be there your chances of ever spending an we're in jail for it highly highly I mean it's a mistake people make mistakes our judge
