[Music] on August 12th 2023 FWC officers were conducting a routine resource inspection near the intra Coastal Waterway when they observed a vessel with an operator wearing a wet suit since this vessel was actively fishing the officers inspected their live well and coolers only to discover a lot of beer and alcohol how yall doing today just leave it in neutral for me going to do a quick life jacket check Offa Gilmore got five life dragonss one two three four all you're good yep all right you guys have any luck today got to take a look one yeah and then uh you pop the live well in the back hatches for me all right and then just the cooler you got what from there let me what the lobster yeah the lobster and then think I got I got but light's been in there for a few weeks all right let me get your license registration I don't have all right give me your registration oh man you got your M ID card yeah all right open up these back hatches for me real quick okay other hatch over there oh you're going to have what's called a PBT done to you all right if you blow it's a it's a portable breath test to see where you're at wait wait wait wait let me finish this and then we'll go on to the next thing okay so the reason I'm doing that okay is because you're under the age of 21 you can't consume any alcohol you can't be in possession of any alcohol okay and you obviously cannot operate a vessel above a 02 okay so it's kind of a mulligan in the sense that instead of running the Bui route I'm going to run this route okay still a court date but it's an infraction instead of a criminal okay so you're going to blow into this okay if it's above a 0.02 you'll get a citation that's a court date okay wait wait we got I know you have questions and they're running through your head because you're trying to lawyer this so hold on so and you'll have a you'll be an infraction with a court date an infraction okay with a court date if I run it the other way okay the other way is a criminal way is a Bui okay it's voting Under the Influence okay um I don't want to run it that way I can kind of see it okay and I have enough physical evidence to say that you were drinking okay so this is cuz you're the captain of it so you got a warning for The Possession okay instead of the misdemeanor with it okay so that's what I came to out of all that there's only two beers that are open I mean two beers that not open okay so you just he was diving and I saw him so I went to go an inspection and open a cooler and there's beers said he wasn't at he he wasn't driving stupidly there's nothing that brought me to him thank God but was he drinking oh yeah yeah that he had a he okay so he blew a 024 and a 02 uh 22 I know about the suspended license and the reason for that this is probably not going to help that situation um what does that mean it it's probably not going to help that situation because this is another alcohol event I'm sorry to put it that way to you but that's what that meant when I said that I was trying to subtle with it okay I justes want to understand yeah I understand I don't know if you have the kid I do I have four of them about going to get me a nervous [ __
