[Music] welcome back to the Donnie Rapture Channel RI bring you fresh neverbe seen body cam footage today's body cam video is another boating Under the Influence video this one's a little bit different though in today's video Florida Fish and Wildlife officers noticed a pontoon boat navigating the Dora Canal the captain appeared to be a total Noob and was getting coach from a louder male passenger this would activate some sort of Spidey senses in the officers so they followed the vessel see him dance you see him dancing yeah he's he's he's telling them how to operate the boat he told him how to come through the bridge I've never made one like that before you got blue lights on according to the report because I honestly didn't catch it in the video the officers claimed that the vessel was heading straight for the concrete pillar without making any effort to correct the speeder steerage throughout this portion of the video you'll note that the officers observed the other man touched the helm several times and in the eye of the law makes him a second operator which is not good if he's impaired can you put it on he's tell him how to do everything he's dropping the boat right now we just hey Captain how are you yes sir sorry what's up guys all right we were just trying to get your attention yeah how are youall doing today good how are youall so thatc the reason we're pulling you over is uh conduct a butter safety inspection on Your Vessel okay yes sir you have the registration on board sir driver's license I need your driver's license and yours okay do you have pulled you over for a boater safety inspection what caught our attention at first was your instruction to him on everything in operating the boat so turning approaching a bridge throttle maintenance well I was work CU I know now they did they finally say go right you remember how everybody used to go normal like right down the middle crowd I love how they did this right so that's what drew our attention at first and then you know you're missing your safety Decon you know we we can lawfully you know stop any but we want if you're missing that safety decal perform voter safety inspection yes sir but you're you're basically you're telling this guy everything you're basically guiding his hand without being physically behind the wheel but then but then we pull up next to you and we see you put your hand on the wheel and your hand on the throttle and drive the boat into the side of the wall to dock it okay cuz he's never docked I got you're right I got I am teaching but you're driving a boat in front of us like I saw we we both witnessed that yes sir okay so the elephant in the room now is I I'm seeing some indication of impairment from you and possibly even from you okay we've had to we've had to asked for several boting boating items safety items several times been very clear with you guys we've been taking it very very slow um there's a strong odor of alcoholic beverage coming from your persons from The Vessel um I can that I can only safely assume that's an alcoholic beverage there um probably there's probably a bunch of empties and stuff in the cooler and I can see beer cans in the trash can yes sir so you came from The Sandbar right I know I get I we just want to make sure that you guys are not impaired beyond the ability to safely operate Your Vessel yes sir okay we have had a bunch of accidents we recently had some that died out here I don't know if yall do that no yeah I see like word of mouth and all that that's part of our job and that's scary cuz I grew up on the water I grew up living on the water that's part of our job is just make sure people are completely understand that's why I was not not even hesitant and going yes sir yeah and that's what officer self is describing is that he believes that wants to make sure you're safe to operate yes sir okay um you know where you guys dock at by the way I'm in Little Lake Harris I'm right across the bridge okay when you hit the bridge I'm like bu Beach uh ramp there just up the way here yes I got you I got you um so would you mind doing some quick uh check of your eyes make sure you're safe to operate get you out of here well I'm not operating but sure so you were operating you number one you were instruct so hold on hold on let me talk Mr Troy talk I'm not arguing I'm sorry I'm sorry so I'm going to lay out again another time because I just laid it out I'm going to tell you again we saw you coaching him in every manner of operating this vessel yes sir that alone puts you in control of the vessel in command of the vessel the term is in command and then as we're pulling up to you I physically witnessed you put your hand on the steering wheel and a hand on the throttle and drive the boat to the side pull he's never P so so so in the term in the term of I got you so in so Mr Troy in the term of operating a vessel in a term of operating a vessel I can't unsee that okay I understand we understand age with so that's that's the second time I've explained that so now so now do you understand sir after explain that again sir so that's why I'm asking you if you'd be willing to submit to volunteer fi sobriety exercises to disprove my suspicion that you're under the influence of on some you know some unknown intoxicant beyond the ability of you driving your we know everybody's had a drink out here literally everybody we just want to make sure you haven't had too much to drive that's literally it we just don't want to make sure you're past the point of impairment that's legally all that I'm just helping because he has it same with you same with you we understand so would you would you be willing to perform some exercises to show me I don't know why I should we just explain it literally just explain it three I got you so you can refuse so so you can refuse so it's I can't force you to do feel soety driving the boat you are driving the boat as I've explained twice now you can you can say no yes sir okay if if you if you're choosing to refuse I then have to it's called tailor warning I have to let you know that hey man you're putting me in a place where I some a couple things that we want to we want to see what level you're at compared to him by maybe just briefly checking your eyes and then maybe moving forward with other exercises based on what we see would you be okay with with allowing us just to briefly check your eyes fine with that and depending on how you do with your you know we we may give you other um chances to continue there's some other exercises that we can does your motor have any issues so no okay do you mind killing the motor no not at all please thank you not at all start aess I'm sorry guys I apologize okay you want to speech you're you're heavy footed when you're trying to grab stuff we've had to repeat things like three or four times to Flat footed when you're walk yes sir you're unsteady when you're I cannot disagree with going to disagree with you whatever you say we're trying to give you the opportunity to show us that you're safe to operate I I am because like like officer self said if you refuse which is your right you're going to make us make a decision on what we've observed to this point I agree with that I understand you understand that the decision that we have to make based on what we Seely I mean depending on how your eyes are right here I may just say hey man you're good go have and sit back on your yes boat for you okay you're fine hey Angel look at me thank you for being honest with me okay thank you for for letting me check your eyes by you letting me check your eyes I'm going to send you on your way man you're not putting me in that difficult position I can smell an odor off of your breath and your person naturally just because of the environment you're in you're not impaired beyond the ability to operate the boat you may not know what you're doing but there's a difference between not knowing what you're doing and then being drunk driving you see what I mean so we're not even I'm not even going to ask you to do the rest okay I've already deemed you sober enough so are you comfortable have they had anything to drink today sir these two women the yeah they had drinks already here okay honestly man just by talking to you I feel more comfortable you driving the boat to your final destination um do you know where you're going did they at least know where they're going yes he tells me where to here's your driver's license if you just want to sit tighter go talk to telling somebody how to do everything with the boat with steering throttle maintenance as I've said I mean everything you are correct that's not something that I typically see do that wor with Y so so so so that is something that I I I would clue in on on thinking that it's you know um I get it that's something that's different I wouldn't say it's it's wrong it's just yes and then we notice that you're you know of course there's not a safety decal on your boat so that's another reason we wanted to stop and check your safety GE I was born before the A8 I didn't have to take that course actually I did well that's the safety ID card I'm not talking about that I'm talking about the safe the safe the Coast Guard required items that every vessel needs that day the man was charged with boting under the influence and refusal to submit a breath sample at the time of making this video the defendant had pled not guilty and given that he didn't take the sfsts or provide a breath sample
