on April 13th 2024 a routine traffic stop became a significant legal situation for a woman involved in a minor car accident the vehicle she was driving had sustained visible damage with smoke coming from the engine drawing the attention of an officer nearby what began as a basic inquiry into the accident quickly escalated into an investigation for potential impaired driving as the officer approached the woman her demeanor raised concerns she appeared visibly nervous and admitted to having urinated due to anxiety hi there nothing appears to in the lot vehic on theth side is your door open or is it is it busted it doesn't it doesn't work like that what do you mean your your your door doesn't open oh there it is what's happening your car is all messed up yeah okay what's going on on yeah she get into an accident yeah okay she have little bit to drink maybe no no nothing okay you're all right your your your foot is bleeding a little bit everything else okay I'm fine this initial admission and her apparent distress led the officer to ask her to step out of the vehicle for further assessment the officer wanted to ensure her safety and address the smoke emanating from the car and began questioning her about the circumstances of the accident uh you on the phone there yeah all right can you can you hang up for meop let's just step out of the car cuz it's it's smoking a little bit okay step out for me have a little chat 3 you want to put your purse down put your purse back in the in the car you can set your phone down too all right let's go we're going to go get on the sidewalk so we're not in the street did you pee a little bit a lot of bit well I was a little nervous so okay okay so you got into an accident right that did happen yeah um so would you be willing to go through a couple you know tests with me just to make sure that you're okay to drive not that this is going to be drivable but you know it's not going to be drivable when asked if she had consumed any alcohol the woman firmly denied drinking however her behavior and physical condition led the officer to suspect otherwise noticing that her foot was bleeding slightly the officer grew more concerned about her ability to drive safely the the officer initiated a series of field sobriety tests to confirm or dispel these suspicions the first test involved tracking the officer's finger with her eyes while keeping her head still okay would you be willing to do some tests with me really quick yeah want to do some test with me okay um I understand but I understand hey I got to do my job and you know from what I OB okay so is it is it a yes or a no on those tests yes M okay can you uh kill my lights a little bit thank you PR one would you let me know when I'm at 15 please what would you like me to do so on this first test I'm actually going to grab a different flashlight that one's a little bright I'm going to have you stand over here on this flat ground okay stand with you can just stand right there stand with your feet together hands Bound By Your Side just like that what I'm going to have you do is I'm going to have you follow the tip of my finger with your eyes okay so you're going to follow with your eyes and your eyes only you're not going to move your head at all do you understand okay do you have any questions for me no okay so look at my finger finger you see my finger right here is my finger this you're going to follow that okay all right is this your is this your car it's registered you yes okay very good the woman passed this test without difficulty which initially seemed to support her denial of alcohol consumption however the second test a heel to toe walk proved more challenging so on this next test I'm going to have you do is um yeah I'm gonna have you get into this position for me okay okay I'm going to have you put your right foot in front of your left foot with your heel to your touching your toe arms down by your side okay you get in that position for me m and stay in that position for me you so yep so just like I'm doing just like this okay he heal the toe okay and if you fall okay hold on wait wait wait wait so you want hold on one here I'll turn to my side and that way you Sor I'm sorry I'm sorry so what do you want me to do so here it's going to look like this yep so see how my my heels in front of my toe and my arms are down by my side just like that yep just stay in that position for me if you fall out of it just get back into that position for me okay can you do that for me here we go no so don't start don't start yet I just want you to get I just want you to get in that position and then listen to what I have to say Okay you can do that so there we go if you fall out of it just kind of get back into it for okay despite her efforts she struggled with balance and admitted having difficulty performing the task her performance raised further doubts in the officer's mind okay what do you want me to do I want you to stay in that position for me while I explain the test okay okay all right so I going to have you do for this test is I'm going to have you take nine Heel To Toe steps when once you get there turn around take nine Heel To Toe steps back counting your steps out loud okay keep your arms down by your side the entire time if you step off the line or step out of position just get back into position and continue the test okay it's going to look something like this one two three oh you can't do it well my balance is terrible but oh but you is your balance okay you expect me to do I'm doing it I'm doing it once you get all the way to so I just did three there out you're going to go all the way to n you're going to go all the way to nine and once you get to nine you're going to take a series of small steps get back into the position like this one two three all the way to nine okay do you understand the test give any questions for me okay you can begin keep back in that position and then start over and you can and then you can go when you're ready [Music] turn out loud for me four five 6 7 8 9 and then you want to turn around yep get back in the position okay of California four five six s n why okay 68 the third test required her to balance on one leg while counting aloud before attempting the task the woman voiced her concerns about her naturally poor balance but agreed to proceed so for the next test what I'm going to have you do is get into that starting position that we had for that test with my finger remember that one that you had your feet together and your arms down by your side can you get to that position for me sure okay so when I tell you to begin what you're going to do is you're going to lift whichever fo what you want 6 in off the ground you're going to look at your toe and you're going to count out loud like this 1001 1002 1003 1004 so on and so forth until I tell you to stop okay toe do you have any questions for me do you understand the test okay you can begin keep your arms down by your side yep if you fall if you fall down if it falls down just bring it just lift it back up okay if you put your foot down it's fine just let it back up and continue okay yep either foot either foot is good okay all right 1001 1002 1003 1004 1005 1005 1006 she could not maintain her balance confirming her earlier statement about struggling with such tasks this further heightened the officer suspicion that she might be impaired whether by alcohol or another substance I have bad balance too I'll take okay yeah my balance is also bad I I will consider that don't have I will consider that don't worry I'll take I okay I don't have good feel I don't want uh you don't want to continue that then I mean I I kind but I literally I don't have good balance it's I'm not good okay so I do have one more test for you all right this one I I do need you to take a seat in my car and I'll read something to you and then we'll take the test okay what so on this last test I need you to take a seat in my car so I can read you something no I don't want to do that okay how let you stand next to my car then do that can you stand next to my car then so I can read you something sure thank you let's go over to this side over here okay hey uh just come over here okay stand right there Michigan law requires that you submit to a preliminary breath analysis upon request of a peace officer that's me and that's him your refusal to submit as requested shall result in you being charged with a civil infra ction do you understand that so basically if you say no to this breath test I'm going to write you a ticket for it okay and then I'll have to base my decision off of what you performed in that test okay so would you like to take a uh preliminary breath test for me it's the thing that you blow in that you see on TV yes or no can't do a shing it we need a yes for no I please just let me know oh well I have to I have to do my due diligence right in this investigation I passed on your test as the investigation continued the officer requested that she submit to a breath test to measure her blood alcohol content the woman hesitated citing her belief that she was not intoxicated and her history of passing similar tests in the past ultimately she refused to take the breath test even after the officer explained the potential consequences of refusal this refusal added to the Situation's tension and became a pivotal factor and then would you take that preliminary breath test I passed all of them I don't have to take that it's totally up to you I passed all of that okay and so if you don't want to take it like I said I write you that ticket IE I write you that ticket and then I based my decision on whether I believe you're intoxicated or not based on my interactions with you based on those tests that we took I know so will is it is it a no then okay will you take a pro PR preliminary breath analysis for me yes or no no no okay so I'm going to have you face my vehicle then ma'am Jenna face my vehicle just don't do this I'm going to I'm going to grab your arm here and you're going to face my vehicle and then you're going to place your hands behind your back you're going to your fingers palms palms palms together and interace your fingers so so if I now if I read you are you going to let me no we're past that at this point unfortunately can you put your palms together like you're praying you put your pals together J but if I if I let you know you please let me that please please I didn't do anything so you are going to be placed under arrest for operating while I couldn't do anything under the influence of alcoholic liquor I you don't even have I pass only your do you have any Pockets or anything that's on you besides your clothing no despite her protests and visible distress the arrest proceeded she expressed significant concern about the impact this situation could have on her life particularly her job and financial stability all right but I I didn't know anything hold for a sec she she urinated so I'm going to put gloves on why are you doing that I'm just going to go around your waist to make sure you don't have any weapons on you or anything no why are you doing this thank you why are you doing this like I said um I believe that you are under the influence of alcohol and you drove a car and you CR I already passed your test I wouldn't say that exactly but okay so like I said I'm going to go around your way just make sure you got no weapons on you all right I oh yeah should be then I'm just going to go down the side make sure you got nothing here okay going to have you take a seat now take a seat watch your head getting in okay you do got to put the seat on you really quick please don't do all right sit tight for me [Music] yeah do you want your window down or anything but I pass over your P I promise you I will die well you already said no so then let me give me let me he all right hey Jenna you will get another chance okay her vehicle rendered inoperable due to a missing wheel remained at the scene and required Towing adding further complications to the incident the preliminary breath analysis conducted by the officer revealed a BAC nearly three times the legal limit Jenna Jenna you're Jenna listen to me listen to me listen to me you're going to get another chance to blow Jenna you're going to get another chance to blow in the machine okay don't worry about it if you blow if you blow under the legal limit you'll be released from our custody okay did you hear what I said you're going to get you're going to get another chance no that's not true because I've done this before you've done this before yep and I've already pass before and they could okay it's I'm saying if you blow under the limit and on the second one did you blow under the limit yes I did okay well that that's not how it works with us here if you blow under the limit here you get released you understand okay is there anything is there is there anything in your car that you need to take take with you you don't want your phone or your purse or anything your which one phone or purse or both all of it all of it any my purse it has a bit in okay is there anything else in the car besides your phone and purse no take my purse understood thank you all right Jenna so what you're going to do is you're going to wrap your lips around this part can you please let me undo me uh yeah all right so like I said you're going to wrap your mouth around this plastic limit is in the state of Michigan 8 8 all right you're at a 22 so pretty close to Triple the Leal limit okay this result in her refusal to undergo further testing solidified the case against her so like I uh like I thought you you've been drinking a little bit it's okay all right so what we're going to do is we're going to slide your feet back in okay and we're going to we're going to slide your feet back in I'm going to get you buckled and we'll go take take care of this all right so do that do that for me now I got the for you too there's uh two tall boy uh trules underneath the P open everywhere all right okay 9:30 wanted to see yeah I'll run over there in a sec I'm going to be fired from my job no you're not why is your job going to fire what do you do what do you do for a living I'm a waitress you're a waitress you're not going to get fired for this put put your feet back I mean I don't know your B I guess I can't say that for sure but I know a lot of people who um have have have not gotten fired for Worse offenses right I'm going to be fire from my job' ma'am slide your feet back in hey major I got to put the belt back on her all right thanks please I can't afford this please I can't afford this but ma'am you know what you did wrong right I yes I okay then there then there's then there's nothing else there's nothing else to talk about well you sure could have cuz you crashed into what I was told a house and a curb and you lost a tire doing so you know what I mean no I didn't all right really is that is there a tire on there watch there is there is not a tire on there yeah there is your front passenger side is completely missing a wheel there's still entire all right okay I just why do you have so it's missing a tire it's missing a wheel it is so it's not drivable at all can I to do what to do what it can't sit there it can't sit there what does that mean what do you mean someone someone pick it up I will have it doesn't have a tire they can't drive it I will have my she now faces charges of operating a vehicle under the influence of alcohol as well as potential additional penalties for refusing the subsequent breath test in many jurisdictions refusal to comply with breath testing can result in civil infractions fines or even license suspension further complicating her legal situation also she was charged because of a suspended license this
