I want you to hold this position while I explain and demonstrate the test. Don't begin until I tell you to do so. When I tell you to begin, you're going to pick a foot, either foot, and you're going to elevate that foot about 6 in off the ground. It's going to look like this. Keeping both legs straight and your arms out at your side, you'll look down at the elevated foot and count out loud. 1,00 1 1,002 1,003. And you'll continue counting until I tell you to stop. Do you understand? >> Do you have any questions? >> When you're ready, you can begin. >> Just keep your foot off the ground. >> 1 2 >> and your arms down at your side. Keep that foot off the ground. Anything you say can and will be used against you in a court of law. Actually, I'll have you step on in here. Just turn in here. Get some paperwork. All right. Open your mouth for me. Turn towards me and open your mouth wide. Uh, and lift your tongue to the roof of your mouth so I can see under it. All right. All right. Now, we're going to come back out and make a left. We'll go to another room. Turn in here. Straight ahead. All right. Have a seat on that bench. All right. So, like I explained, there's some things that we need to do while we're here. I heard that you mentioned that you want an attorney, and that's fine. I'm not going to ask you any questions that would require an attorney. Okay? There are questions I have to ask you that are procedural for processing. They will not be related to anything incriminating. But I do have a form that I have to read you. It's called the attorney general standard statement for motor vehicle operators. It explains the legal requirements and your responsibilities in this situation that you are not entitled to an attorney for. At the end of it, I'm going to ask you a yes or no question. So, please just listen carefully. You have been arrested for driving while intoxicated NJSA 394-50. The law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. A record the taking of the breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. After you've provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. A court may find you guilty of both refusal and driving while intoxicated. If a court finds you guilty of the refusal, you'll be subject to various penalties, including license revocation of up to 20 years, a fine of up to $2,000, installation of an ignition interlock, and referral to an intoxicated driver resource center. These penalties may be in addition to penalties imposed by the court for any other offense of which you were found guilty. You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing. Even if you agree to take the test, but then do not follow my instructions, do not properly perform the test, or do not provide sufficient breath samples, I will charge you with a refusal to submit to breath testing. I repeat, the law requires you to submit samples of your breath for testing. Will you submit the samples of your breath? >> No. >> Okay. Your answer is not acceptable. The law requires that you submit samples of your breath for breath testing. If you do not answer or answer with anything other than yes, I will charge you with refusal. Now, we ask you again, will you submit to breath testing? >> Is that a no? >> Okay. You do you understand what I just read you? >> I >> No, I'm not. >> Just listen to me for a second. >> No, I'm >> just stop and listen. You're >> I can't even wipe my >> Listen to me. You're going to get another charge that is more severe than the DUI if you don't provide breath samples. >> That's fine. I'm not doing it. I'm not drinking. This is crazy. >> You are intoxicated. >> No. Go ahead. >> So, you can provide breath samples. >> I'm not. what you are required to do or you're going to get additional charges that are going to make this a whole lot worse for you because it is my belief that the only reason you're refusing is to conceal how drunk you really are. >> I'm not. So, I'm fine. Let's go >> to provide breath samples. >> No. >> Okay. I'm going to charge you with refusal. Understood. Hang tight for a second. I just need to talk to my supervisor. Let him know what's going on. 78 extension. Yeah. This is crazy. You Hey, I just need someone to pop back here for a second so I can come out there and talk to you. All right. [snorts] location. >> Uh, just so that you're aware, your car is being impounded. You can get it back after 12 hours. You have to come here to the police department anytime after, it'll be about 3:30. I'm not sure what the exact time of the arrest is. I'll find out for you, though. 12 hours after that, you come back here. We'll get you the paperwork to get your car back. That aside, do you know who is able to come and pick you up? >> Sure. >> Who Who can we call to pick you up? >> My husband. >> Okay. All right. And where is he at? Home. >> Home. >> All right. This is Officer Younger. He's going to hang with me for a couple minutes while I go out and speak with the supervisor. Uh while he does that, or while he's here, he'll help you make a phone call to your husband uh and tell him to come and pick you up. >> Okay. Uh she's a refusal. >> Uh she's still handcuffed. There was a knife in her bra. I'm trying to get a female officer to search her. >> It's not in my bra. >> I said there was. >> I told you it was. >> I know. We have it. But until I have someone here that can do a more thorough search, the handcuffs are going to stay on. >> All right. Uh, this is her purse. I haven't done a property sheet yet. There's a lot of cash in there, so we're going to need to do a property sheet. Uh, also, just so you're aware, you had a bunch of cash in your center console. >> I'm a sucker. >> Just I It's not I'm not accusing you of anything. I'm telling you about having your cash. I didn't want Since your car is being towed, I didn't want to leave it in there. I put all of the cash from your center console in your purse. >> Okay, you can turn around me and act like a petulant child. That's fine. Um, you're not making us any better for yourself. >> Like an hourish. >> Uh, so she's a refusal. There's not going to be any processing. I just have to talk to the sergeant to see if we're going to do two C's. >> This is Officer Younger. He's going to hang me for a couple minutes while I go out and speak with the supervisor. Uh while he does that or while he's here, he'll help you make a phone call your husband uh and tell him to come and pick you up. >> Okay. Uh she's a refusal. Mhm. >> Uh she's still handcuffed. There was a knife in her bra. I'm trying to get a funeral search. >> They have It's not in my bra. >> I told you it was. >> We have it. >> But until I have someone here that can do a more thorough search on >> uh this is her first. I haven't done a property sheet yet. There's a lot of cash in there. So, we're going to need to do a property sheet. Uh also, just so you're aware, you have a bunch of cash in your center console. I'm a server. >> Just not I'm not accusing you of anything. I'm telling you have your cash. I didn't want Since your car is being towed, I didn't want to leave it in there. I put all of the cash from your center console in your purse. >> Okay. You can turn around and act like a child. That's fine. Um you're not making any of yourself. >> Um what do you think is like hours? >> So she's a refusal. There's not going to be any processing. I just have to talk to the SA two C's. Uh, and then so I would say less than half hour. >> Okay, >> man. What is your husband's number? >> She has a phone. >> Do you know what's up here? >> Yes. >> All right. >> Hey, listen. It happens. It's officer Younger with the Meford Police on a reported line. Your wife's okay and everything. She was just arrested for DUI and is going to need a ride home. Are you able to come pick her up? >> Yes. >> So, she is at the Meford Township Police Station. It's 91 Union Street in Meford Township.
