Hello. >> How are you? Do you mind uh rolling down the other window, please? >> Hello. How are you? >> What's going on today? >> We are just having an argument. >> Sir, can you Sir, can you speak to me? You can speak to my partner. Can you speak to me? >> Ma'am, >> what's going on today? >> Ma'am, >> I'm sorry. >> Okay. All right. First, first of all, >> sir, >> why are we being >> What's going on today? >> Who? >> Us. >> You, too. Okay. You mind stepping out of the car for me? >> No, you're not stepping out of the car. >> You don't have to. >> Just so I can talk to you over here and not in front of her, >> ma'am. >> Nope. I know my rights. >> Okay. >> Okay. >> So, we're law. Okay. And you right now are being detained. >> So, we're trying >> detain us. I'm not going to argue with you. >> To make this easier, he's just going to step out >> to talk to my partner. That's open the door to investigate what's going on. >> Investigate what? >> Just step out of the car and speak to me in the back of the car. >> No, no, no, no. You're not you're you're leaving the car. We haven't done all we have done was stay here because we have having a family issue. >> Okay. >> And then we just came here. >> No, you're not. You know what? You're listening to the car. >> Just step out of the car so I can speak to you. If you did nothing wrong, I'll literally talk to you and then you guys are good to go. >> Well, you guys stay here. >> Understandable. But listen to me. I already told you. Right now, we're conducting an investigation. Right now, the both of you are detained. >> No, you cannot detain us because we have something wrong. >> Listen, you are not going to interrupt me again. >> First of all, sir, >> you're not going to interrupt me again. My property. You're going to make this a whole lot worse. I didn't say you did anything wrong. I'm just asking if you could speak to me with >> So why am I being detained? >> I'm asking for you to speak with me. If you're good to go, I'll let you get back in the car and you can leave. >> I'm good to go >> right now. That's not for you to decide. >> Oh, it is. >> Okay. >> Cuz you have no grounds. If you prove any grounds, by all means, then say it. We have been here thinking about different things. If we have broke any law, then prove it to us. >> That's what court's for. >> No, but you're here because somebody called you. >> Yes, that's correct. >> Exactly. So, if we have broken It doesn't matter. If somebody called you, we have broken any law. >> That's what we're here to investigate to make sure that there is no crime being committed. We got called here for a reason. >> I need to know what's going on. And in order for me and my partner to do that, we need to speak with you separately to ensure that both of your stories add up. >> No, you don't. >> I know. >> I know my rights. >> Okay. You went to law school. >> Are you doubting my my my law? >> I'm asking a question. >> No, no, no. Are you doubting my >> Are you doubting mine? Sir, step out of >> Did you go to B? Do you have bachelors? >> I do, actually. >> You have masters? >> I do. >> Oh, can you prove it? >> You want me to pull up my diploma? >> Go ahead. >> Can you? >> I can. Okay. Oh my god. Step out of the car, please. >> No, you're going about your right now. >> Okay. Can you Can you tell us exactly? Can you tell us? Correct. >> Can you tell us what did we commit other than just being on the parking lot talking amongst ourselves? What law did we >> Yes. >> What? Which one? >> Sir, step out of the car, please. >> No, he's not. >> I'm not talking to you. >> It doesn't matter. Step out of the car. He's not going to step out of the car. >> He's more than capable for talking for himself. >> Okay, then go ahead. You tell her that you're not going to step out of the car. >> I broke no lawsuit, sir. Step out of the car. >> Nope. There is no reason. Show us the reason why any of us >> You can call your captain. You already did. You can step out of the car. I'm giving you a lawful order to step out of the vehicle. >> Nope. There is no reason why. >> All we did was just park here. We have not done anything wrong other than talk about our business. What our business are is our business, not your business, not his business. >> Her business. You said his. I'm a female. >> Pennsylvania vims is a federal case law that requires you to exit the vehicle when provided with a lawful order from officers. Step out of the car. >> You can look it up on your phone. Step out. Step out of the car. >> Step out of the car. >> Step out of the car. >> I'm not stupid. My law have I broken. >> You're acting stupid. Get out of the car. >> Oh, no. We're not acting stupid. >> I'm not talking to you. I'm not talking to you. Step out of the car, sir. >> Saying that. No, you haven't done >> Step out of the car. >> We're not The car is not moving. The car is not moving. We haven't done anything. We can You can actually put the windows up right now. Quart the car. Let's go. >> There it is. Obstruction. >> Get out OF THE CAR. >> GET OUT OF THE CAR. >> Step out of the car. >> NO. NO. NO. HELL NO. Hell no. >> You cannot do that. >> Step out of the car. >> Hell no. >> You can smell it. Step out of the car. >> Close that door. >> Step out of the car. >> Close that door. >> The car is not moving. >> How you doing? Okay. So, we have a call for driving. You're not driving. >> Let me explain to you why we're here. >> Okay. >> Thank you. You have you have a process of explaining why you're here because they have >> Well, I also have to explain to you that when an officer tells you to step out of the car, you're walking required to do that. >> Yes. So, that that is a requirement. >> The vehicle was on when we got here. >> Okay. We we can talk about the issues, but what I'm telling you for your knowledge is very important to hear this right now. When an officer tells you to step out of a car, you have to step out. So that's the second time I said it. I'm sure these officers told to you. This really isn't the place to play court because we have the authority to remove you from the vehicle. We prefer not to do that. We prefer you to step out so we can continue in a conversation. >> Why? Why? This is a public place. Be quiet here so we can have a conversation. and I having a conversation. >> Okay. The reason for the stop is suspicion of driving while intoxicated. >> Well, we haven't been driving. We've been >> Well, this vehicle got here somehow. Uh we have that information, but we don't. Again, this doesn't need to be a back and forth right now. >> We're doing our best to be professional. And this is the third time I'm going to say when an officer tells you to step out of the car for an investigation, you're lawfully required to do that. If you want to deny that, that's on you, but you're mistaken and we can remove you from this car with force if need be, which we're doing everything we can to prevent that. So, the smart thing to do would just be to simply stand on the pavement instead of going all that route, right? So, let's just move to that one step and then we're going to continue speaking like adults. >> Honestly, they said they were arguing. >> So, it's also an obstruction for the people. the grounds for anyone saying that we are here for you just show us that >> no whatever grounds I'm trying to say that we're here in whatever show us the proof and then but I'm going to tell you right now you have no right to get into my vehicle and do anything to us have no right at all I know my rights and you have no right to step into my vehicle allow a warrant to take us out of this with no friends. All we have done was just here and talk about our issue. Yes, we do. Right now, we're going through something. So, we work here to talk. So, what are the grounds that you're coming here to actually do this? And I >> to be honest with you, I've explained our grounds three times. >> You have not? >> Three times. It's on camera. I've explained our grounds three times. Any further any further speaking is only delaying what's going to happen to 201. >> I wanted to show you because then I have >> because right now you are on me and you're causing stress. >> Head over to >> We do actually, but unfortunately we're here. >> Yeah. No, not us. Right now we have a family issue. >> We only here to talk. >> Okay. So the additional issue is the suspicion of driving while under the influence of >> we have an order of alcohol >> right now. We can smell. >> Have you been drinking anything? >> Just hold on a second. Have you been drinking anything, sir? >> Do you have any Do you have any alcohol beverages in the car? >> No. >> Uh no, thank you. So, there's no alcohol in this car whatsoever. >> No. And unless you have a warrant to start this car, we're not going to look for anything. >> Ma'am, listen. You're >> Do you have a warrant? >> Do you have a warrant? >> So, I'm going to say the next thing. He's the driver of the vehicle. You're a passenger. >> But I'm the No, I'm the owner. >> At this point, >> I'm the owner of >> We haven't driven anyone. He parked here >> because we haven't The vehicle was on So the vehicle being in activated the engine running counts as being in operation. >> Right. >> He turned it off in front of us. >> So >> I don't understand. I don't understand. >> I think you don't I think you don't want to really laying it out as clearly as I poss. >> Sir, I'm asking you to listen to reason. We don't want to use. >> Yeah, they said they were arguing. So at that point, we were investigating DW and DB. >> So after rolling up the window after ordering him out, she was telling him >> roll up the window. Don't get out. >> I'm just going to take a minute to speak with you. >> The call is for suspicion of correct. And do we know who called? >> Her sister. >> Okay. Did they say like why she thinks that she might be inside? >> We tried to get as much as we could out of Pinto, but they really didn't give us much. But when we did come up on them, the car was on. When we started talking to them, you could smell the alcohol right away, >> delays, movements. >> As she was talking to him, he put the he turned the car off. He hit the the button. The car turned off. while we're talking to them. She repeatedly said, "Sir, we're investigating something. I want to talk to you privately. Step out of the car." >> This was also after he said that they got into an argument. >> Yes. >> From your observations that we're good to go with the DWI investigation. And we have the sister calling. >> Yep. >> We have your observation. Your vehicle running. >> We have the male in the driver's seat displaying signs you can articulate as suspicion of being intoxicated. Correct. the order, the service, everything like that. We're going to move forward with that, we need to have them step out of the car to conduct the suspicion that we >> Yeah. All right. And the next thing is if it really gets to the point where we have to remove him, I'm going to explain to them first that refusing the verbal order allows us to begin to remove him with physical contact. >> Okay. We ask them for anything. No, not say anything. >> We're being polite, but they're trying to be abusive in the way that they're saying that they're going to force you out. No, you're not being polite by saying you're going to force them out. >> I'm No, that's not That's not If you don't have a warrant, if you DON'T HAVE A WARRANT, YOU CAN >> That's just wrong. >> If you don't have a warrant, you cannot take him out of the car. >> That's just not true. >> It is true. You're going to get you're going to get arrested by what you're saying. It's going to be it's going to be your fault because I'm telling you exactly how it works. I'm saying what you're doing right now. If you're persuading them to not just stand outside, he's going to get arrested because of you. It's going to be your fault. >> Okay? >> It's going to be your fault, too, because you should be listening to this. Okay? So, you need to listen to what I'm about to say cuz you're the driver. And if you're saying you're not driving, you're in the driver's seat, the vehicle's not, that means you're the driver. Okay, >> the car is not on. >> Okay, you turned it off. Just stop it now cuz it's getting ridiculous. Okay, >> the car is not on. >> It was on and I saw you turn it off. My facility, right? >> You saw us. You have >> Yes, we all have video. >> You do it. >> You can get a notebook. Okay. So, the next thing is your sister called and told us that she suspected that you were intoxicated. >> All right. So, do your master. I listen to your >> Okay. I hope you're listening. That's why the officers approach this vehicle. Based on their observations, the operation, the vehicle is being operated. You're in the driver's seat. They immediately smell the odor of alcohol. They notice other displays of behavior that indicate to them that you might be intoxicated. That's more than enough for them to conduct field tests called standard sobriety tests to determine if you might be intoxicated or not. You're completely lawfully required at this point to step out of this car so we can conduct those tests. If you refuse, >> if you refuse, you will under arrest for obstruction. >> I want my lawyer. >> You want your lawyer here? >> Okay. So, when you're arrested, you can contact your lawyer. All right. Do you understand what I just said to you? >> Do you understand what I just said? >> Nobody wants me in front but Alex. Can you do this? >> So, you did this. >> You will know. Were you here? >> Sir, do you understand what I said to you? I said as courteously as I can. >> I'm sorry. >> You do not understand. Okay. Well, the next thing we're going to do >> is we're going to have you step out of the car. If you physically if you physically resist us, >> you will be placed under saying that >> we are going to have you step out of the car since you're passively resisting. You're not listening to verbal commands. >> No. If you resist us as we guide you out of this vehicle, you will be placed under arrest. That is how it's going to work. You are passively resisting. You are refusing a lawful command to step out of this vehicle. Step out of the vehicle. That's a law. Now you're passive resisting. Now we're authorized to remove you from the car cuz you're not listening to us. If you resist us physically as we get you out of this car, you'll be arrested. We're going to proceed with that if you do not step out right now. >> To use physical contact from the car. If he pulls away, then use minimal force. >> Wait, wait, wait. Who's pushing the car? Get out of the car. Come on. >> Don't stop. Get out of the car. He's not driving. >> Get out of the car. Get out of the car. >> Get out of the car. >> He's not driving. >> Resist. >> Get out of the car. >> He's not driving. >> Get out of the car. >> HE WAS NEVER DRIVING. HE WAS NEVER DRIVING. >> Get out OF THE CAR. I'M GOING I'M GOING TO SHOOT YOU. DO NOT do this. >> Holy [ __ ] >> Stop tensing up. >> I'm not I'm not sure. >> You're hurt. >> He's my assistant. >> All right. >> We're handcuffing him. That's all we're doing. >> Why? >> Why? He didn't commit no crime. >> He committed no crime. >> Watching the way throwing my glasses. >> No one's touching your head. >> Keep coming in. >> All right. Well, come on. Stand up. >> Bring your legs up. >> Okay. Okay. >> You got to bring your knees up. Sit up. Now you got to sit up. No, it's not okay. >> Can I pull my pants up? >> I'll pull it up for you once you get >> Keep walking the car. Spread your legs out wide for us, please. >> He's nothing on Check his step my arms. >> So listen, face us. Go butt first and it's easier. >> Can you do me a favor and stand here with him? Thank you. >> Come on. Let's step out of the car. >> Oh, hell no. You're not going to no >> Come on. >> No. No. >> Ma'am, the same thing that happened to him is going to happen to you if you don't get out of the vehicle. We're giving you the option to step out of the vehicle without us putting our hands on you. So, step out of the vehicle. >> Okay. Thank you. >> You want me to go to You want me to follow you? I'll follow you. I'll follow you, but you're not touching me. Get out of the vehicle. >> You're not You're not touching me. >> Get out of the vehicle. >> We just went over this. You don't want me to touch you? I'm telling you to step out. Step out on your own. Then >> someone asked you who's giving you the right to touch me. >> I don't need rights to touch you right now. >> YOU HAVE TO TELL ME WHY you're touching me. >> We already went over this 100 times. >> No, you're not. >> No, you're not. >> Ma'am, I'm going to give you one more time. It's either you're going to get out of the vehicle on your own by you. >> You're going to get out of the vehicle on your own or we're going to help you get out of the vehicle. >> When he was being placed under arrest, you put your hands on him. >> Why? Why am I being placed under arrest? >> Explain to you >> why. >> He's explaining it to you to you. >> Why? >> When we were putting him FROM >> THEY ALREADY THREW THEY THEY THREW LOU ON THE GROUND, ALICE. And they're threading me cooperate. >> AND THEY'RE THREADING ME AND THREW ME ON THE GROUND NOW. >> TAKE Alice's advice and cooperate, please. >> You know what? You must >> It's not I WANT TO COOPERATE, BUT THEY'RE TELLING ME THAT THEY'RE GOING TO take me out of my car. You could step out of the car. >> I HAVEN'T DONE ANYTHING WRONG. >> THEY ASK you Listen, if they ask you to get out of the car, you must cooperate >> and do what? >> Why? >> Get out. Step out. >> I called the lawyer. But you have to cooperate. Okay. You cannot fight the law. >> THEY THREW LAW ON THE FLOOR. I HAVE A VIDEO OF WHAT THEY DID. >> Tell them, "Listen, I hope they're listening. My son is ill. He has a bad heart and he has a bad >> Yeah. AND THEY THREW HIM ON THE FLOOR. >> MA'AM, WHEN ALL I SAID WAS WHEN HE AND I WERE TALKING, >> hang up the phone. THEY ALREADY DID THE CAR. >> They already did. ALICE, YOU BETTER CALL SOMEBODY. >> ALICE, WE'RE GOING TO ASK YOU TO HANG up now. We've been asking her to get out of the car for 5 minutes. >> Get out of the car. >> Yes. >> All right. Come on. >> CALL THE AMBULANCE. NO. NO. NO. DO NOT TOUCH ME. >> COME ON. OH, NOW THEY'RE NOW THEY'RE PUSHING ME. NOW THEY'RE PUSHING. >> I got this armor. >> You don't have to anymore. >> Get on your stomach. See if you can unpop. >> I have to put that on the report that something was stolen or taken off. >> Put your feet up on the floor. >> I can put your feet on the floor. Okay. Give me one second. Give me one second. Give me one second. I had three surgeries on my one, two, three. your car. All right. >> All right. We're going to walk now. >> Okay. Let's go. >> Walk this way. >> Do not push me. >> I tell you to walk. Walk. >> You [ __ ] [ __ ] >> Wait for my Stand right here. You're going to get searched. Stand right here. You're going to get searched. Who's searching me? Who's searching me? Who is searching me 347? What's your last name? >> Sorry. >> Yeah. >> No warrants on my car. No, nothing. They have >> No, you have my my doors open in my car. I have stuff there for my baby. You have no reason to arrest me. No reason. >> Okay, >> she's good. Have a seat. Oh god. >> My purse. >> Have a seat. >> My purse. >> Get in the car. >> My purse. >> Get in the car. Have a seat. >> Put your foot on that and push yourself up. >> I'm trying. Give me a second. >> Oh my god. >> You knew the law though. >> I knew the law. Yes. It was my property, not yours. THEY'RE GOING THROUGH MY STUFF. YOU GUYS HAS NO WARRANTS FOR MY CAR. Is it necessary that I have these handcuffs on me? >> What did I do wrong? >> Excuse me. Okay, I need a lot of explaining >> cuz I was disrespected and my property was unlawfully inspected without my permission and I'm going through a lot of pain right now when I have two means that are very bad ill. Do you have your necklaces, any earrings, any jewelry that you have has to go in this bag? >> I need to first understand why I'm being >> once once it comes, I'll explain it to you. But for right now, >> no, I need to understand why. You vibrating my rights right now. >> If you don't take the off, I'm going to take it off for you. >> You will? Yes. >> Then you will owe me a lot of money. >> Then take it off yourself. Let's be grown-ups. Okay. >> You want to be a grown up? >> Yes. >> Tell me why we detang. >> Who's the ladies that arrested you? >> They didn't even tell me an explanation. I said why they were dragging me out of the car. So unless somebody is going to tell me that and you guys are going to get more force on me cuz you already have. >> Can I have my mono back on these? >> No. No. >> Sure. I don't have my green. That's great. And I still don't know why I'm being >> You're not being thinned. You're under arrest. >> Yeah. Why? I still don't know why. >> You want to come in? >> Yeah. I don't know who they is. >> I have a heart condition. I have a heart condition. Why was I thrown to the ground like a aing dirt bag criminal? Officer. Officer. >> Just calling you, but I didn't look to >> Officer. I have a heart condition. >> You need immediate medical attention? >> Yeah. My heart My >> heart. >> I can't breathe. My heart hurts. [snorts] My heart hurts. >> My heart hurts. My heart hurts. I can't breathe. >> Sir, the ambulance is on its way. Okay, sir. >> Sir, we're getting a lot of calls on it. We're not talking. >> Can you sit up? Cuz the ambulance is pulling up right now. >> I can't sit up. >> You can't sit up. Okay. >> Can I move? >> I said sit up. You said you couldn't sit up. >> I can't I can't breathe. >> Said he has a heart condition and needed medical attention. He was just saying he had Yeah, he was just saying he had difficulty breathing. What's up, bud? Hey, bud. Were you just talking to the cops? I'm a firefighter. I'm here to help you. >> What's up, bud? How you feeling? >> I can't breathe. >> You can't breathe? You just talked to me, so that means you can breathe. >> So, uh, >> I'm I'm having a hard time breathing. >> You're having a hard time breathing? >> Yeah, I could I could talk, but >> ma'am, we're trying to make sure your son's okay. All right, just take a step back. Watch the cars, okay? Be careful. It's okay. She has a job. She has a job to do. Okay. Just let her do her job. >> Okay. >> All right. Um, >> so what's going on, bud? You want to go to the hospital? If you go to the hospital, this process is going to take extremely longer than it should. Bud, you got to answer us or you're not going anywhere. Where's your last name? What's your name, bud? You want to go to the hospital? Get checked for your breathing difficulty. You want to try and sit up? All right, bud. Come on. Sit up. Sit up. Okay, bud. Come. Sit. Sit. All right. There you go. Little more. >> Try to sit up. Okay. >> Good. >> Do you want to go to the hospital? >> Come on, bud. You want to sit? Sit up. >> He's talking. He's drunk. >> Completely blast. >> I'm going check your oxygen levels. All right. >> What's going on here? >> Can't move these [ __ ] handcuffs. >> What happened? What's going on? >> Nothing. I I was sitting in the car talking to my wife. >> You having difficulty breathing though? >> No, I am. Yeah. Like what are you feeling now? Is your chest? >> Yeah. I have a heart condition. Are you inhale? >> Yeah, I can. So, >> you want to go to the hospital then? >> I mean, that's all we can do for you at this point, right? Because I mean, your oxygen is good. Your heart rate's a little high, but the oxygen levels are are where they're supposed to be, too. 97 right now. And then your heart rate's at 92. So, um, you want you want us to take you? >> I just want to go home. >> You got to sit up a little bit. That's another reason why you probably the cops, right? >> Yeah. >> I just Okay. Um, >> I'm not a criminal. >> Like, I don't think you are. I don't, you know. Um, I'm just asking. Do you want to go to the hospital? We'll take you. >> I don't know. To be honest, >> we'll help. >> I can't move. >> We're going to help you. >> There you go. [ __ ] You [ __ ] threw me on the ground like a [ __ ] piece of [ __ ] >> I can't move. >> All right, I'm going to help you. >> Do you know? >> Can they loosen the cuffs? >> I don't know if they can, man. >> I don't I don't think that they're going to do that. >> Oh my god. So, you have to >> I'm supposed to fall on my face again? >> No, no, no. Shoot me out. There you go. going to get sold >> unfortunately. Yes. >> Fire, but we're I'll let them know as soon as we do. >> I don't care. >> So, I have to do the report. >> This this one cup, please. I just you have room here. I can stick two fingers in it. >> Take a seat. >> When we get when we get him in the ambulance. Yes. >> Listen, no one's saying that right now, but I tried to explain it to your mom. and tried to explain it to you. I don't know your relationship with that other the female that was with you and I'm not going to sit here and like comment on that cuz I don't know who that is to you. >> But you don't have my nose though. I'm just going to switch places. >> Yeah, that's fine. That's fine. Um, just so you are aware, you can kind of >> Yeah, I I told her >> honestly it's the easier route because now that he did that, when he comes back, she can bring the form that allows him to be released to your guys' custody. So we don't have to he doesn't have to come back to headquarters with us. We get this done here, we can send him on his way. Okay. So we'll try to make it quick. I believe we have a kit at the headquarters right now. We'll get she'll go grab that. She'll come back. Bring the paper paperwork with her. Your wife is with us right now. She she was okay. She didn't need to go to the hospital. again, which I was going to get to. The the initial reason for us being there was because someone called, which I'm sure my supervisor explained to you, with concerns about one of you. >> Yeah. >> Um, if he's going to get released, can I get your ID so I could get literally all of that done? >> I'll explain that to you.
