like a warrant or something arrest for your a warrant for your arrest and stuff and I was just like well I'm gonna run my name so you should have to do it he was just like being an [ __ ] checking my pockets and like you sure you don't have enough if you put your hat if you like I put my hand he's like put your hand behind your head after I hug you like if if you Flinch I'm gonna ask this guy to tase you did all that for me did he ever identify himself he never said I'm a cop I asked him what had happened because I seen him in cups oh you were there too I seen him when they had him he had his hand behind his hat back he was cuffed sitting on the curb and asked him who are they because I thought it was security because I don't have an authority to um because I thought it was him he told me no they're Bail Bonds only they I'd like already yeah so he told you he had a warrant before you gave him your information yeah and then did he ask you for your name and your date of birth and all that and you gave it to him and then did he ever put you in the back of his car no no a truck or his truck yeah didn't even Explore it was an Explorer yes okay like was it like like this size or bigger it was just the regular uh Caravan like the regular one the small one what was unmarked it didn't happen anymore he didn't have his did he have red and blue lights on no he's had like regular lights what was he wearing square like this jeans like this regular uh cargo pants and a regular shirt and he had a vest he didn't look like law enforcement he had a cap on it too you didn't have beer he was wearing a vest yeah like a vest like these yeah but it was black okay did it say anything on it did you notice anything on it it was uh that's what I was looking for I didn't see any kind of identifying marks Did you ever see a badge no so he never had a badge he never identified himself as law enforcement no did he ever say I'm a bail bondsman no he never said anything he just he immediately came up to you and told you to put your hands behind your back and put your handcuffs yeah I think did you feel like you were free to leave at that point not really I didn't feel comfortable because she was kind of being an ass to me you know he couldn't leave they had him on right so by being handcuffed succeeded did you feel like you were detained yeah you're not entertainment right now you are arrested but right now so he had you in handcuffs he told you you weren't detained yeah but he said that you were under arrest yeah he never did he tell you his name or anything like that right on the side you're like right outside yeah we're gonna go over there and talk to them and the security that the tall uh black guy okay yes uh works that night he seemed at all too okay he'll be talking a lot of [ __ ] like like he's hard or something like I understand he has to be a little bit you know like formal with everyone and and tell him you know to get off property and all that right and he goes off too far like you know he goes too much like to to have a conflict going on you know we were going over there to talk to him unlawfully detained you and a crime was committed against him like I said if he he don't like admitted a crime against you would you be willing to Aid in prosecution against him as a victim yes you would be willing to end prosecution okay so he's gonna get your name and your date of birth and we're gonna put you in as a victim okay just in case if we have to do an investigation obviously so if we see him we're not just gonna go arrest him right we have to do some investigating get everybody's statements and then if and if an arrest is made on him if we identify a crime has been committed you would be willing to prosecute against them yeah all right cool if you just want to give him his name we'll get you out of here all right yeah that's fine I'll give you my ID what do you mean Prosecuting the state yeah so we just have to trespassed from the Circle K before security guard to ask him to leave uh and then I guess he called somebody while talking to the security guard basically making a threatening call or threatening calls like hey this guy's gonna come do this uh and then he kept saying the security guard was saying it so it was like up in the air and how did you know something was going on well I was at the Q2 with security basically I just drove over with them yeah we were looking for somebody to skip on them on let's go over here just helping them out basically how did you introduce yourself to uh guys at have any authority to do that I mean if you take somebody into custody based on his authorities a bail bondsman I'm sure he can run for warrants but he doesn't have any authority to just go run any Joe Blow for a warrant so his his authority doesn't extend to what he was doing right and that guy doesn't have any warrants yeah and he's saying he had a misdemeanor right so I mean even even if we get the initial hit we can detain and handcuff people right but in order to actually arrest them transport them book them you've got to confirm they got the warrant so we can't even do what he's doing just running up on people and detaining them playing security guard when he's he doesn't have a security guard license so just uh what are you thinking man all these I think it's strange I didn't even know that you could do but it seems like he's talking about an independent contractors what what would it sound like to me that he's saying it's like independent Contracting for everything I didn't give you the sergeant stamp that I spoke to in Glendale I can give you the few places Phoenix as long as I call you guys if I make any sort of arrest or anything like that and I call DPS to verify like once that's all I've heard and that's encourage you to verify if an individual s the once division yep and I tell them who I am and they and they've all right what's your information all right give me a second okay warrants or yes Edwards and then if they have warrants if you guys aren't any out there I'll call you guys out call Phoenix out about lend out or whoever out just so that they can verify that hey you guys would end up taking taking over at the end of the day so you have a badge number yes 24701 yes sir [Applause] yes sir [Applause] I mean I've called you guys out plenty of times I'm sure you can get through the recordings and hear exactly what I say when I call you guys like I had I just I had you guys just booked somebody ITR last week so and how does the whole warrant with the bonds company because I'm not familiar with that either can you just look for any more because I don't choose I don't choose my one so how do you get your warrant they choose my ones they send me the information either from the courts or from the state so so if they don't give you any information on uh who has a warrant you just take it upon yourself to go Patrol and and look for people drive around I don't really stop anybody like it's [Applause] entity why can we run them it's like in my purview I can verify people at once or not what review you just said that they only they assign you your warrants so you know what you're looking for so I can also still verify if people set warrants like say I was just talking with somebody and they gave me their name I can always be like hey dude and I could just be walking down the street and get something I mean I can always verify like if somebody's got a warrant that is like strictly my all anything to do with warrants is like and like I mean I contact the Warrants Division for you guys Phoenix like I make it very known like what I'm doing just so it's like not this whole confusion thing so that guy that just rode by on his bicycle if you wanted to you could stop and detain him and run him for warrants I'm not gonna stop cause I can't and he can't do that so why can you do this so well I'm just asking you the way that I have to hold on to explain this what was the what was the crime that was committed that night that gave you Reasonable Suspicion or probable cause to detain that person and run him for warrants just making definitely a threats to the security guard did you hear this what did you hear them where's your probable cause that would be my problem because the security guard was saying that he what was he doing when you got there arguing with the security guard did you hear any death threats no I'm just sure is it a crime to get into an argument no he wasn't even on the on qt's property people it was in the alley when you detect him he was in the outlet right he wasn't on QT property and then uh another thing that I heard you say is that you have the right to detain somebody as long as you call law enforcement first so after you put the handcuffs on that on that guy and you told him he was detained did you call us you call DPS to run him yeah did you call them to tell them that you had him to change I told him that I was out with somebody did you tell them that he was detained and that you needed a an officer to come out here and help me with a 10 I didn't say I needed an option do you see the issues yes you were acting as a police officer am I right no I was acting as a surveillance you introduce yourself as an officer you detained somebody without specifying that you were not a police officer so do you think it's reasonable that this person believed that you were a police officer at that time do you think that he felt like he was free to leave from your custody at that time and that was definitely like I was not trying to and what what did they tell you that uh at your agency or or municipality or whatever did they tell you that this person had a warrant so why would you take it upon yourself to detain this person who hasn't committed a crime that you've witnessed instead of calling law enforcement to come out and handle an unruly subject or somebody who's trespassing something like that why what we're trying to understand is what made it okay in your mind to detain that person and and act the way you acted my understanding like I said was talking with Glendale and talking with Phoenix and all that like when I first moved down here I sat down with them okay so you just spoke verbally did you ever receive any training yeah I went through a class what kind of class was in an academy it was offered through my the bond company what kind of training did you get taser like all like how did these play situations how long was that training class uh five days five days okay did they teach you how to apply handcuffs yes okay did they did they teach you so they they taught you that you were allowed to trespass people from properties yes they told you that you're safe I wouldn't say that you've been trespassed oh literally just like that like that's always it's literally it's all I can say you've been trespassing well you can say that but totally that's all I can say so anybody can say that but you understand that by you saying that there's no there's no grounds right there's if now I'm starting to understand so basically what I was told isn't always true in every County or in every jurisdiction because when I spoke to Glendale in Phoenix they they sort of laid down a different set of rules okay like I can stop I could be non-stop I can detain individuals if I need to run them I can just I can detain them to run them okay aside from the fact that they said that if I told you right now if I wanted to I could go stop anybody and detain them and run them for warrants would you look me in the eye and tell me that that's a reasonable statement yes and no no that's not reasonable you cannot just stop anybody on the street and run them because you're a Bail Enforcement agent or whatever your title was at that day that's that's illegal that's unlawful detainment you understand that right that's what I want to make sure that you understand because I'm starting to understand yeah because you told us that your what is it you're is it an agency okay they assign you warrants so you're like a bounty hunter you go you look for a certain person so instead of looking for that person you went and patrolled with your vehicle that's equipped with red blue lights you hung out with the security guards all night and then you acted as a law enforcement officer by detaining searching and running for wants and warrants with no probable cause are we on the same page here yeah [Applause] very good curious if you're looking for a particular guy in the account why are you shadowing the security guys because those guys know those backgrounds they know where everything's hot I mean my guy's young for drug use [Applause] what specific area were you given to look for him well young Town's a large city or it's not a large city but it's a city what is it is that grand razor Grand from from Grand to Thunderbird from 113th to 93rd let's see General scope area that this guy has been known to hang out is there a did they give you a photograph of them uh yeah I don't need to see it I'm just asking yeah did he did he look anything like this this guy that you detained so there's other than the fact that you were just that's there you had no reason to be there really or or to detain them you know what I mean I wasn't trying to overstep stuff on anybody's toes or anything like that like I'm not trying to impersonate anything like that well aside aside from uh how did you search them because we didn't really talk about that too much how did you search them just held demonstration did you say anything to him I made it very clear can I search you yeah okay I'm gonna set this right here centered on my third right in front of him where's your ID okay thank you and you don't have to do any paperwork when you search somebody where is it if they have it yeah do you have any with you I don't have any with me like I said I'm just getting ready to go find fire so but you got your pest with you I'm just in there like I some of the stuff I didn't take out so what if you were gonna go detain somebody again tonight and search them you wouldn't have done that for him then I have to do that for him anytime I thought okay but I understand that but you just said you don't have them but you were out last night because I'm not going to stop somebody going or detain somebody I'm going to fight a fire I mean all my fire here sitting in my back seat like I'm I get it but you were out last night and you still got your vest in your car so why wouldn't you have those search forms see what I'm saying I took my case out of my front seat and I got home okay I'm just trying to understand because you got some stuff but you don't get others you got your red and blue lights but it always stays in my car so I mean I don't normally take that out okay because you might need it if you detain somebody on the street I just carry that I'm just of course I haven't I just don't take certain things out of my car and when was the last time you read in blues work it wasn't last night when you were showing opinion security because we got that on camera too is there anything else that you need to tell us [Applause] this is the Bail Enforcement no guard card no no certification and all it is is a five-day course so is there any way that I can get going I have just like an hour and a half Drive I'd have to be there at 7 30. I think this is over my baby head here what was that yeah I kind of understand that he's [ __ ] a lot of things up too late well it sounds to me like 15 minutes I mean that's what I'm leaning but I would definitely verify this is there that's Sergeant's idea too oh that's what he thinks I'm on I'm on board and he's if he agrees then I mean he dug his own gravy he told us everything all right you don't have your weapon with you right it's not in the car your firearm you have any other weapons in the car anything on you at all all right go ahead and turn around put your hands back unlawful detainment and important impersonating [Applause] way to just get a ticket no not right now you're under arrest you guys go over there all right do me a favor spank your feet he's gonna pat you down okay you got any property on you not that I know of okay [Applause] you got somebody who can come pick up your car uh possibly all right well it's on private property so we can leave it here it's not going to get towed or anything right now so almost Walgreens yeah up in your pocket's gonna poke me stick me stab me nope shouldn't open your boots no sir [Applause] [Applause] can you slide these boots off pretty easy yeah all right I'm gonna step on the hill and then just lift up and then same with the right one and then as soon as he searches them we'll have you step back in them I can't like like grab this side just pull it up for them have you ever been arrested before yep what was it for trespassing trespassing from a business or uh a church oh okay that was it and speeding tickets but I've never been arrested for this okay slide on in is there any way to like put these in the front possibly here when we get back to the district foreign [Applause]
