back up you're under

18th 2023 while patrolling a boat ramp
officers observed a vessel maneuvering
erratically near other traffic an
officer instructed The Vessel to return
to the dock come here hey come
here come
here hey you come here here can you
safely pull up here and tie up all right
come

just don't want you to hurt yourself
somebody
else
okay you got a cleat right there can you
not come right up
here do you have another rope maybe you
can put on that cleat pull to the side I
I got plent of ropes
can you put one on that side or one on
this side we'll pull it up this side
this way your boat it's your boat your
boat yes sir okay can you get the
registration while you're looking for
that rope here we go we doing another
$890 I hadn't wrote you no tickets yet I
don't know what you're talking about I
don't know you I know how it was I
already had one and it wasn't a pretty
picture and the thing was that I was
actually the in the you have your ID
with you also yeah I got all right let
me take a look at it how long have you
had your
boat about like two years two years yeah
but I still don't understand this
[ __ ] okay why don't you tie that off you
got you got another rope or something it
off you say you got a rope or something
you going tow yeah got
PL the guy go get the truck is that guy
just truck is right there yeah well did
the guy go get the truck was there five
of y'all on board or
four you looking for live Jacks I'm
asking you did a guy just leave to go
get the truck he and us we got live Jack
okay okay I need you to show me five if
you could okay
five n n four
n okay do you have a fire extinguisher
over there I need you to get it I need
you to get it you're the captain
okay my shoes let me look at the
gauge they came with the they what they
came with theat came with the boat yeah
right okay all right step up here if you
don't
mind if you don't mind let's walk up
here off the ramp
here let's go down
here I and my thing on I went to this
well you been drinking today right uh I
ain't I I'm safe and everything good it
doesn't look like you're safe operating
the boat like you was operating why you
have to drink
today wow come on I know it
is much I ain't going to lie I'm safe
I'm I can't tell you how much I had to
drink because it's
it which way you want to go okay I'm
going ask you do some feel spread you
agree with that I wasn't the one driving
the boat the whole
time I understand so why you want to do
a Sur test watch this do Sur him that he
was the one driving not test the test is
a pass or fail excuse me a test is a
pass or
fail you want to go against me I don't
know already have a
DUI why are you drinking I wasn't the
one driving I you were I just seen you
matter of fact these people were yelling
about your Reckless operation that are
sitting here watching
you I Wasing that's why I didn't driving
but you were driving you said it's your
boat right how of do you drive
it you had it for two years said you had
it two years right no no I actually only
had it for one year okay what kind of
facility you what storage facility sir
storage facility manager oh your manager
yes sir so you're in pretty good shape
I'm asking you oh you're asking me yes
yeah I am you are when's the last time
you
work on Friday Friday okay you know what
today is yeah fatherday what it's Sunday
Sunday right okay you mind uh walking up
here with me you don't mind have a seat
right here for me okay have a seat right
here for me okay so you you don't wish
to participate in the
field help me but you know what
unfortunately I went through a du well
this is not DUI this would be Bui if
you're under the influence but I already
went and this was $890 that I had to
spent okay I have I have to advise you
that if you do not take the field spra
exercises that can be used against you
in court do you understand
that you do understand that yes okay and
what the field s consist of go stand up
there back back over there I need you to
back up please back up please back don't
get involved please Papito go please
listen to me it's going to make matters
worse let me deal with him
sorry okay I appreciate that all right
listen the Fieldy exercises what they
are they're divided attention task I'm
trying
to no I I haven't made a decision I'm
trying to make a decision but if you
don't take the fuel sobriety exercises
you're going to make me make a decision
based on my training experience what I
see smell and hear the totality of the
circumstances so I'm asking you to take
the fipr exis to dispel my belief that
you're not an impaired operator are you
agreeable to that I can agree with you
and everything else but yet then again
I'm going do the assign you're going to
try to make me up I can't lift them no
these are seated you're in a marine
environment these are seated you don't
have to walk the line and stuff like
that hold the leg up and all that kind
of stuff your light they're they're
seated what light thing I don't have a
light it's not a pass or fail okay what
what I was checking is what they call
horizontal gaze to stag it's involuntary
jerking of your eyeball your eye should
track as it follows an object like
rolling a marble across a piece of glass
your eyes are twitching the more they
twitch as soon as they start to track
the higher impairment you are okay so
you have there's a total of six Clues
you have all six clues in your eyes you
see them yeah I see all them that's so
what I'm trying to do here to help you
you're here to help me I appreciate that
okay if I'm going to get arrested let
should get arrested and get it over okay
so you're refusing to take the field I
say that I said I'm here to get arrested
well I'm asking you to take the
remaining fuel sobriety exercises to
dispel my belief the thing but if I'm
going to get arrested I I haven't made
that decision yet but that's see that's
why I'm asking you to take the field
sobriety exercises so you can dispel my
belief that you're not an impaired
operator ding you were driving I just
you ask about the video camera yeah it's
got you video spinning around out there
and stuff okay I've explained the feel
somebody exercises are you agreeable to
take them I'll take them okay all right
now mind you can your be yeah I'll I'll
explain each one I'll demonstrate it and
I'll ask you do you understand because
if you don't I'll tell you what is the
outcome the outcom if if you don't
dispel my belief that you're an impaired
operator and I believe that you're an
impaired operator I'm going to arrest
you and put you in the St John's County
jail if
you no I don't why do you think that do
you know me I don't know you I can't
believe let okay no I don't know you're
right I don't know I'm sorry I'm sorry
all right sit straight at sit straight
at the front edge of your seat put your
arms down by your side place your feet
shoulder width apart so you're
comfortable and stable put your feet
shoulder width apart sit at the
edge right put your arm down by your
side are you comfortable and stable yes
or no yes okay you're going to make a
fist with both hands you're going to
extend your index fingers and turn your
palms forward it's like this these are
your index fingers okay yeah that's a
tip of them that's the tip of your nose
okay you're going to extend your arms
down this way okay maintain that
position while I explain exercise to you
okay you understand okay when I say
begin you're going to tilt your head
back you're going to close your eyes
about 45° that's when I say begin okay
can I have something go now I need you
to record this it's already been
recorded everything here is on the want
to record on my side
okay what are you doing I'm get up the
fing floor you ain't walking online or
nothing I not yet I know I got you I
know maybe I'm wrong Maybe I'm Wrong
okay make a fist with both hands extend
your index fingers and turn your palms
forward remain in this position while I
explain the task to you do you
understand okay when I say begin you're
going to tilt your head back about 45°
you're going to close both eyes do you
understand that so far yes all right
when I tell you to you're going to touch
the tip of your nose with the tip of
your index finger and immediately return
it to your side it's like this one just
one you you got an index finger on each
hand so if I say right you come up with
your Right Touch put your put your hand
M down there's no practicing stuff okay
right when I say right you come up well
just be quiet so I can explain it to you
okay we both can't talk okay if I say
right come up with your right index
finger touch the tip of the finger to
the tip of the nose and back down if I
say left come up with that index finger
touch the tip of the finger tip of the
nose and back down it's one motion okay
don't leave your finger on your nose you
come up and touch it and come back down
sir keep your head til the back and keep
your eyes closed okay Don back up stand
over there back up you can record all
you want but you're not going to
interfere back up TOS the M please just
back
up as as I'm going to put you in jail if
you don't back up listen to me simple as
that stop making interfering I'm agree
you can hold all you want not back up
and stop interfering come on damn it I
shouldn't have done this I'm so sorry
637 see if the city or the Count's got
come on godam man I'm going to jail you
want me to call the city or the county
to come by and I need you to back up to
that freaking stand over there stand by
while I'm doing feel spry I
got Johanna please listen to me Johanna
I back up well I'm not going to record
Che he has
record I'm so sorry man okay
all
right do you understand the instructions
so far yes sir okay what why do you
think you're going to
jail the
irritating well they're with you that's
your family right I know right they
don't listen is there somebody that
hadn't been drinking that can get her
out of the way and stop interfering cuz
I'm going to have to put her in jail if
she don't
stop and it's going to be bad if you go
to jail and she goes to jail too yeah we
be like what's up yeah well that's not
going to be fun but if she interferes
again she's going to jail I just told
back okay well you did and now you're
upset that she's interfering so she's
interfering I'm trying to determine
whether you're an impaired operator and
if she comes over here again you can
express to her that she's going to be
arrested okay so I'm going to start this
again okay listen to me when I say begin
you tilt your head back about 45 degrees
and you close your eyes it's like this
your eyes closed okay when I tell you to
touch the tip of your
nose touch your nose with the tip of
your index finger and immediately return
it to your side it's like this if I say
right come up with your right index
finger touch tip look at me if I say
right come up with your right in exer
touch it come back down if I say left
come up and touch it and come back down
you understand all right so when I say
right you must touch your right in X
finger to your nose when I say left you
must touch your left and X finger to
your nose you understand that okay
again you understood the instructions
right I I heard you but I need you to
hear I'm definitely need to please just
be louder with your
left with your
right with your
left your
right with your
right okay
relax relax sit sit straight okay next
it's the Palm Pat place your hands Palm
to Palm with one hand up one hand down
it's like this just like this parallel
parallel parallel is this parallel is
this way this just like that yep all
right you're remain in this position
while I explaining the task do you
understand that okay when I tell you to
begin you're going to turn your top hand
over and you're going to count out loud
one then turn your hand back over and
count out loud two Counting only when
the hands I'm going to let me finish
reading this okay counting only when the
hands make contact it's like this one
two one two one two one two okay I got
you okay you're going to repeat this and
you speed up as you go do not stop until
I tell you to go ahead and begin one two
one two one two one two one two one two

pull your vessel up and tie it up to the

thinking yeah just drop me off and
